An analysis of the epistemological structure of democratic deliberation as a procedure in which legal norms are constructed reveals that deliberation combines procedural and substantive aspects in a unique and inextricable manner. The co-original recognition of the private and public autonomy of all citizens provides the substantive critical standard against which the justice of norms is measured. At the same time, such recognition requires that the particular needs and values of all people concerned be taken into account. Given the privileged (...) epistemic access people have to their own particular perspective, this requirement implies the ineliminability of actual deliberative procedures. The open-ended nature of these constructive procedures is partly due to the fact that the rules of the procedure are counterfactual and themselves subject to interpretation. More importantly, it also reflects the historical nature of our human world and the freedom of moral persons to shape and reshape their preferences. (shrink)

A vernacular fifteenth-century sermon tells us, in order to warn of the threats to spiritual welfare posed by dance, that cyclic motion and centering of sensory impressions – amongst them intimate conversation – are essential elements of dance. When blending out the parenesis, implicit poetics of medieval dance can be distilled from that sermon. The way how these essential elements of dance are used for generating disruptions within literary plots will be demonstrated in three literary texts dating from the thirteenth (...) to the fifteenth century: Disruptions in connection with dance occur when contrary concepts of motion clash with each other, for example the linearity of the chivalrous way through the Other World with the cyclicity of round dances. ‚Der Württemberger‘, however, collides two contrary concepts of time which can be paraphrased as spatial metaphors, namely the linearity of earthly life which collides with the cyclicity of eternal damnation, a collision symbolized by the expulsion of life out of the dance of the death. Finally in ‚Ritter Sociabilis‘, dance generates a virtual space which subverts the courtly society. The protagonists of all these texts differently manage to resolve disruptions, namely by redemption, by repentance, or by continuing disruptions which they have caused themselves. (shrink)

There is no consensus as to whether a Liar sentence is meaningful or not. Still, a widespread conviction with respect to Liar sentences (and other ungrounded sentences) is that, whether or not they are meaningful, they are useless . The philosophical contribution of this paper is to put this conviction into question. Using the framework of assertoric semantics , which is a semantic valuation method for languages of self-referential truth that has been developed by the author, we show that certain (...) computational problems, called query structures , can be solved more efficiently by an agent who has self-referential resources (amongst which are Liar sentences) than by an agent who has only classical resources; we establish the computational power of self-referential truth . The paper concludes with some thoughts on the implications of the established result for deflationary accounts of truth. (shrink)

This article considers the prospects of inference to the best explanation as a method of confirming causal claims vis-à-vis the medical evidence of mechanisms. I show that IBE is actually descriptive of how scientists reason when choosing among hypotheses, that it is amenable to the balance/weight distinction, a pivotal pair of concepts in the philosophy of evidence, and that it can do justice to interesting features of the interplay between mechanistic and population level assessments.

In this paper, I examine the question of the scope of justice, in a not unusual distributive, egalitarian, and universalistic framework. Part I outlines some central features of the egalitarian theory of justice I am proposing. According to such a conception, justice is – at least prima facie – immediately universal, and therefore global. It does not morally recognize any judicial boundaries or limits. Part II examines whether, even from a universalistic perspective, there are moral or pragmatic grounds for rejecting (...) or limiting the global scope of justice. In particular, I scrutinize five universalistic objections: (1) the principle of “moral division of labor”; (2) the connection between cooperation and distributive justice; (3) the primacy of democracy; (4) the dangers of a world state; and (5) political‐pragmatic reasons. I intend to show that these objections cannot undermine the strong normative claims of global justice. At the most, political‐pragmatic reasons speak in favor of initially striving for somewhat less, in order to receive more general backing. (shrink)

I argue that difference-making should be a crucial element for evaluating the quality of evidence for mechanisms, especially with respect to the robustness of mechanisms, and that it should take central stage when it comes to the general role played by mechanisms in establishing causal claims in medicine. The difference- making of mechanisms should provide additional compelling reasons to accept the gist of Russo-Williamson thesis and include mechanisms in the protocols for Evidence- Based Medicine (EBM), as the EBM+ research group (...) has been advocating. Is it appropriate to blame people unequally if the only difference between them was a matter of luck? Suppose Alice would drive recklessly if she could, Belen drove recklessly but didn’t harm anyone, and Cleo drove recklessly and killed a child. Luck-advocates emphasize that in real life we do blame such agents very unequally. Luck-skeptics counter that people aren’t responsible for factors beyond their control, or beyond their quality of will. I’ll defend a somewhat reconciliatory view. I’ll concede to the (...) skeptics that these agents are equally culpable. Nonetheless, I’ll suggest with the luck-advocates that it’s fitting to blame them unequally. That’s because their culpability is unequally significant for us: Cleo’s culpability concerns us more than Belen’s, and Belen’s more than Alice’s—just like the fault of a close aggressor concerns us more than that of an aggressor far off in place and time. And it’s fitting for us to respond with more blame to faults that concern us more. Indeed, blaming people simply in proportion to their culpability manifests a form of fetishism, or problematic mere-matter-of-principle concern. So while many skeptical tenets may hold, in substance the luck-advocates are right. (shrink)

The culture of honour hypothesis offers a compelling example of how human psychology differentially adapts to pastoral and horticultural environments. However, there is disagreement over whether this pattern is best explained by a memetic, evolutionary psychological, dual inheritance, or niche construction model. I argue that this disagreement stems from two shortcomings: lack of clarity about the theoretical commitments of these models and inadequate comparative data for testing them. To resolve the first problem, I offer a theoretical framework for deriving competing (...) predictions from each of the four models. In particular, this involves a novel interpretation of the difference between dual inheritance theory and cultural niche construction. I then illustrate a strategy for testing their predictions using data from the Human Relations Area File. Empirical results suggest that the aggressive psychological phenotype typically associated with honour culture is more common among pastoral societies than among horticultural societies. Theoretical considerations suggest that this pattern is best explained as a case of cultural niche construction. (shrink)

In my paper, I comment on Rainer Forst's paper in this issue. I raise doubts as to whether the justification of democracy emerges from a fundamental moral right to reciprocal and general justification, as Forst claims. His basic argument appears questionable because democracy is different from a “hypothetical‐consent‐conception” of moral legitimacy, which limits as well as enables democratic legitimacy. The former cannot, however, justify the latter through an argument centered on self‐government: Such an argument relies heavily on the possibility of (...) consensus, thus neglecting the crucial phenomenon of disagreement or dissent. As a result of not adequately dealing with this phenomenon, the argument is unable to account for the basic democratic principle of majority rule as the remedy at hand. (shrink)

Why should governments or individuals invest time and resources in conserving biodiversity? A popular answer is that biodiversity has both instrumental value for humans and intrinsic value in its own right. Defending Biodiversity critically evaluates familiar arguments for these claims and finds that, at best, they provide good reasons for conserving particular species or regions. However, they fail to provide a strong justification for conserving biodiversity per se. Hence, either environmentalists must develop more compelling arguments for conserving biodiversity or else (...) they should modify their agenda. This contribution first searches for historical and empirical evidence for whether and how curricula act or acted as a measure of public education. The problem is explicated on account of a short history of curriculum work and distinguished in a analytical, a political, programmatical and practical discourse of curriculum work. Curriculum work always underlies premises of planning, learning and effects. Three models are finally developed and brought in touch with the different discourses. In a recent article, Emanuel Rutten defends his Modal-Epistemic Argument (MEA) for the existence of God against various objections that I raised against it. In this article, I observe that Rutten’s defence fails for various reasons. Most notably though, the defence is self-undermining: the very claims that Rutten argues for in his defence yield novel counterexamples to the first premise of the MEA.

Much recent work in Cognitive Linguistics and neighbouring disciplines has adopted a so-called usage-based perspective in which generalizations are based on the analysis of authentic usage data provided by computerized corpora. However, the analysis of such data does not always utilize methodological findings from other disciplines to avoid analytical pitfalls and, at the same time, generate robust results. A case in point is the strategy of using corpus frequencies. In this paper, we take up a recently much debated issue from (...) construction grammar concerning the association between verbs and argument-structure constructions, and investigate a construction, the English as-predicative, in order to test the predictive power of different kinds of frequency data against that of a recent, more refined corpus-based approach, the so-called collexeme analysis. To that end, the results of the application of these corpus-based approaches to an analysis of the as predicative are compared with the results of a sentence-completion experiment. Concerning the topic under consideration, collexeme analysis is not only shown to be superior on a variety of theoretical and methodological grounds, it also significantly outperforms frequency as a predictor of subjects’ production preferences. We conclude by pointing out some implications for usage-based approaches. (shrink)

This article is devoted to two different generalizations of projective Boolean algebras: openly generated Boolean algebras and tightly ϭ-filtered Boolean algebras. We show that for every uncountable regular cardinal κ there are 2κ pairwise non-isomorphic openly generated Boolean algebras of size κ > N1 provided there is an almost free non-free abelian group of size κ. The openly generated Boolean algebras constructed here are almost free. Moreover, for every infinite regular cardinal κ we construct 2κ pairwise non-isomorphic Boolean algebras of (...) size κ that are tightly ϭ-filtered and c.c.c. These two results contrast nicely with Koppelberg's theorem in [12] that for every uncountable regular cardinal κ there are only 2<κ isomorphism types of projective Boolean algebras of size κ. Linsky and Zalta try to explain how we can refer to mathematical objects by saying that this happens through definite descriptions which may appeal to mathematical theories. I present two issues for their account. First, there is a problem of finding appropriate pre-conditions to reference, which are currently difficult to satisfy. Second, there is a problem of ensuring the stability of the resulting reference. Slight changes in the properties ascribed to a mathematical object can result in a shift of reference (...) and this leads to various problems, e.g., it makes inferring knowledge much harder than it is. Before engaging with the already intensive and still increasing personal branding activities in many fields of practice, a scholarly approach would call for a more specific definition of the concept of personal branding processes and the resulting human brands. A multi-step analysis of the growing body of literature on personal branding is employed, integrating a framework that covers six key research streams of personal branding, (1) terminology and definition, (2) underlying theories, (3) classes and categories, (4) benefits, (5) antecedents, and (...) (6) key ingredients and applications, complemented by challenges the domain of personal branding has to cope with. The analysis shows that personal branding is an interdisciplinary concern, which is still in its infancy and in which universally valid personal branding frameworks or even theories cannot be identified yet. Personal branding appears as a source for new academic impulses, as it may sensitize scholars to opportunities for intensifying collaboration with practitioners and with other academic domains to enrich and disseminate knowledge in their fields. This manuscript describes the institutional and clinical considerations that apply to the question of whether to mandate opioid dose reduction in patients who have received opioids long-term. It describes how a calamitous rise in addiction and overdose involving opioids has both led to a clinical recalibration by healthcare providers, and to strong incentives favoring forcible opioid reduction by policy making agencies. Neither the 2016 Guideline issued by the Centers for Disease Control and Prevention nor clinical evidence can justify or promote (...) such policies as safe or effective. (shrink)

In his paper, the author makes an attempt at reconstructing one of the first propositions in Poland to start a philosophical discourse on ecological problems. The author of this proposition is priest Tadeusz Ślipko. According to this author the problems of the moral aspects of natural environmental protection are also bioethical problems. Therefore, we can see that he does not consider ethics of the environment as an individual philosophical discipline. The article concentrates on presenting the sources and the range of (...) moral duties of humankind towards the natural environment. Tadeusz Ślipko does not approve of the anthropocentric or biocentric standpoints in the issues of natural environmental protection. He offers his own idea of anthropopriorism, which takes the middle ground between these two extreme concepts. In conclusion, the author underlines that there is still a strong need for ethical reflection over the state of the natural environment along the lines of Ślipko’s stance. (shrink)

Inference to the Best Explanation is usually employed in the Scientific Realism debates. As far as particular scientific theories are concerned, its most ready usage seems to be that of a theory of confirmation. There are however more uses of IBE, namely as an epistemological theory of testimony and as a means of categorising and justifying the sources of evidence. In this paper, I will present, develop and exemplify IBE as a theory of the quality of evidence - taking examples (...) from medicine and showing that IBE can thereby provide the epistemological underpinning and justify the criteria of grading quality of mechanistic evidence that have been recently provided in the Clarke et al. paper on how evidence of medical mechanisms is to be construed alongside population studies. The number of people with dementia is increasing worldwide. At the same time, family and professional caregivers’ resources are limited. A promising approach to relieve these carers’ burden and assist people with dementia is assistive technology. In order to be useful and accepted, such technologies need to respect the values and needs of their intended users. We applied the value sensitive design approach to identify values and needs of patients with dementia and family and professional caregivers in respect to assistive (...) technologies to assist people with dementia in institutionalized care. Based on semi-structured interviews of residents/patients with cognitive impairment, relatives, and healthcare professionals (10 each), we identified 44 values summarized by 18 core values. From these values, we created a values’ network to demonstrate the interplay between the values. The core of this network was caring and empathy as most strongly interacting value. Furthermore, we found 36 needs for assistance belonging to the four action fields of activity, care, management/administration, and nursing. Based on these values and needs for assistance, we created possible use cases for assistive technologies in each of the identified four action fields. All these use cases already are technologically feasible today but are not currently being used in healthcare facilities. This underlines the need for development of value-based technologies to ensure not only technological feasibility but also acceptance and implementation of assistive technologies. Our results help balance conflicting values and provide concrete suggestions for how engineers and designers can incorporate values into assistive technologies. (shrink)

Hierin beabsichtigt der Kybernetikforscher und Sternenflottenoffizier Bruce Maddox, Forschung am Androiden Data durchzuführen, in der Hoffnung, schließlich Data-ähnliche Androiden erschaffen zu können. Die Forschungsprozesse implizieren jedoch Eingriffe, mit denen das Risiko einhergeht, dass Data zerstört wird, weshalb Data nicht bereit ist, an sich forschen zu lassen. Die entscheidende philosophische Frage diesbezüglich ist: Handelt es (...) sich bei Data um eine Sache oder um eine Person? The implementation of corporate social responsibility is crucial for the legitimacy of an organization in today’s globalized economy. This study aims to enrich our knowledge of the implementation of the largest voluntary CSR initiative—the UN Global Compact. Drawing on insights from stakeholder, network, and institutional theory, I derive a positive impact of UNGC participation duration on the implementation level of the UNGC principles, despite potential weaknesses in the initiative’s accountability structure. Moreover, I scrutinize the validity of the newly introduced UNGC (...) “Differentiation Programme” before applying this framework in the empirical analysis. Results from ordinal, linear, and instrumental variable regression models suggest that, contrary to claims made by UNGC critics, the duration of UNGC participation does affect the level of UNGC implementation. However, this effect appears to be much smaller than previous practitioner studies have suggested. Moreover, strong local UNGC networks affect the implementation level of the UNGC positively. Their hypothesized moderating role between UNGC participation duration and UNGC implementation level, however, is only significant in networks with activities of high quality rather than high quantity. This special issue of Science, Technology, & Human Values critically explores a new stage in which the life sciences and biomedical practices have entered. This new stage is marked by postgenomic developments and an increased interest of life sciences in the everyday lives of people outside laboratories and clinical settings. Furthermore, particular attention is given to many chronic and degenerative disorders such as cardiovascular disease, Alzheimer’s disease, or developmental disorders. These developments coincide—or have become entangled—with a new set of interests (...) that an anthropologically inclined science and technology studies is bringing to the analyses of biomedical practices. An increased interest is observed in the anthropologically inclined STS in studying phenomena on different scales and in exploring fields that are not readily dominated by technoscientific rationality in practice. The introduction to the special issue examines briefly these developments and situates them in a broader genealogy of different movements that have taken place in the anthropologically inclined subfield of STS since the late 1970s and early 1980s. Advance directives are propagated as instruments to maintain patients’ autonomy in case they can no longer decide for themselves. It has been never been examined whether patients’ and healthy persons themselves are inclined to adhere to these documents. Patients’ and healthy persons’ views on whether instructions laid down in advance directives should be followed because that is (or is not) “the right thing to do”, not because one is legally obliged to do so, were studied and compared with that of (...) medical staff. Method: Vignette study presenting five cases. Cancer patients, healthy persons, nursing staff and physicians (n = 100 in each group) were interviewed. An adherence score was calculated (maximum value 5). The adherence score is found to be low in all groups, yet lowest in patients (1.55; standard deviation 1.13) and healthy controls (1.60; 1.37). The scores are significantly different between nursing staff on the one hand and patients and healthy controls on the other (p < 0.005 and p < 0.05, respectively), and between doctors and patients (p < 0.05). Interviewees who want these documents to be followed tend to live alone and to have already written an advance directive. Conclusions: Cancer patients and healthy persons widely disregard instructions laid down in advance directives and consider them less binding than physicians and nursing staff do. Only a minority tends to adhere more to advance directives. To improve decision-making at the end of life when patients are no longer able to decide for themselves alternative concepts, such as advanced care planning, should be considered. (shrink)

The only reliable remedy against anxiety is information, and reliable information and news are of crucial value in times of crises, such as COVID-19. Contemporary social media offers almost everyone a platform to publish one’s own thoughts, opinions, political statements and others, some of which may gain significant interest of others and thereby become so called “influencers”. This role has in the past been held by news agencies primarily, but this role is increasingly adopted also by private people and among (...) them, also some who do not necessarily adhere the high standards of good journalism or scientific ethics. These give rise to fake news, spreading as unconfirmed rumors and possibly causing dramatic impacts to a society. With information available almost everywhere in the internet today, the distinction between good and bad sources has become a challenge, and highly difficult task. Even more intricate is the question of verifying information against multiple independent sources. If many people say something, does this make it true or any more plausible? Do we need to trust information in lack of better information? Is it possible to judge information and make our own opinion about its validity, quality, relevance or usefulness for our own business? This article shall provide pointers towards answers to the above questions. We discuss some technical means of judging the quality of information and what anyone, even without much technical background can do to avoid falling victim to fake information and fake news.
