The hospital had been largely abandoned until 2009 when our organization, Nyaya Health, renovated and opened it in partnership with the Nepali government. Since then, (...) the hospital has seen great progress and has experienced widespread community support. Nonetheless, earlier this year, a broad-based staff revolt occurred, led primarily by our senior clinical staff members, raising concerns that Nyaya's management policies were ineffective, and wages and benefits were too low. The unrest included everything from a strike, limiting services to our patients, to aggression against non-strikers and slander and racist comments in public media against the Nyaya Health Board of Directors. Ultimately, the conflict was resolved, though not without the departure of our three most senior clinicians. The incident deeply damaged staff morale [End Page 101] and impeded basic services to our patients, and from our perspective as a leadership and management team, it was deeply troubling and spiritually challenging. We have learned much in the wake of the strike, but here we focus more narrowly on the concept of partnerships in our work by examining the recent strike and the two key issues that lead to it: wages and benefits, and management policies at Bayalpata Hospital.In grappling with the recent staff crisis, some of our leadership team expressed concerns that we would never be able to develop a true partnership in Achham if our senior-level employees led strikes against the organization. The leaders of the strike were our most well-educated and high-ranking staff. They were also individuals who had come to work for us specifically citing the moral imperative of our work, and their pride in helping to serve the poorest of the poor. One leadership team member asked, "What is 'partnership' then? We came into this work with the premise that we would work together, with our partnership built around the right to health—but who are our partners if they lead strikes damaging the very services our collective mission aims to offer?"Another leadership team member commented, "The first time I visited Achham I was invited for tea at Meena's* house (one of Nyaya's midwives). We arrived at her house and Meena greeted us warmly. She showed us in to a small room: there was no furniture, but there was an immaculately swept mat which we joined her on. We drank tea, seated on her rug, and listened to her tell us how she had come to live in the house, how she had come to work for Nyaya, and her pride in now being able to provide both for her own children, as well as, the children of her relatives. As the only employed family member, she now had the challenge of providing for all of them. When we question our partnership, I'm taken back to Meena's warm, but extremely poor, home. She has worked for Nyaya for almost four years. She has helped our organization provide free care to over 75,000 people. Is this not a type of 'partnership'?"Allow us to offer some background on the issue of wages—Meena has been with our team since 2008, and has been paid about $2,500 per year—a generous wage compared to other employers in the region. Meena was one of the striking staff members. Among other concerns about the way the hospital was being run, she and other staff asked indignantly why we couldn't provide them with higher wages, better benefits, and more resources, both for her and the hospital. Notably, Meena's salary (and the rest of our staff's) was well above her equivalent in other, more urban hospitals (to compensate for the extremely remote area in which we work), and in a district where most families are farmers, our staff's salaries occupy the highest income bracket in the region. This participatory study, conducted in an introductory psychology class, recounts self-reflections of 22 undergraduate students and their instructor engaging in an GenAI-mediated storyboard generation process. It relies on Gordon Pask’s conversation theory, structuring out the nature of interactions between students, instructor, and GenAI, and then uses a qualitative narrative to describe these conversational feedback loops constituting the creation of draft and final storyboards. Results suggest students engaged in cyclical feedback driven processes to master their creations, used elements of photography related (...) to the relationships between objects in frame, image processing, and cultural objects/themes to generate narratives. Issues were faced with generating text on images, and the consistency and style of generated frames as they interacted with GenAI tools. The book's focus is the practice of noise and its relationship to music, and in particular the role of noise as musical material--as form, as sound, as notation or interface, as a medium for listening, as provocation, as data. Possible-worlds accounts of mental or linguistic content are often criticized for being too coarse-grained. To make room for more fine-grained distinctions among contents, several authors have recently proposed extending the space of possible worlds by "impossible worlds". We argue that this strategy comes with serious costs: we would effectively have to abandon most of the features that make the possible-worlds framework attractive. More generally, we argue that while there are intuitive and theoretical considerations against overly coarse-grained notions of content, the (...) same kinds of considerations also prohibit an overly fine-grained individuation of content. An adequate notion of content, it seems, should have intermediate granularity. However, it is hard to construe a notion of content that meets these demands. Any notion of content, we suggest, must be either implausibly coarse-grained or implausibly fine-grained (or both). (shrink)

According to the classical quantificational analysis of modals, an agent has the ability to perform an act iff relevant facts about the agent and her environment are compatible with her performing the act. The analysis faces a number of problems, many of which can be traced to the fact that it takes even accidental performance of an act as proof of the relevant ability. I argue that ability statements are systematically ambiguous: on one reading, accidental performance really is enough; on (...) another, more is required. The stronger notion of ability plays a central role in normative contexts. Both readings, I argue, can be captured within the classical quantificational framework, provided we allow conversational context to impose restrictions not just on the “accessible worlds”, but also on what counts as a performance of the relevant act among these worlds. The impact of our desires and preferences upon our ordinary, everyday beliefs is well-documented [Gilovich, T. . How we know what isn’t so: The fallibility of human reason in everyday life. New York: The Free Press.]. The influence of such motivational factors on delusions, which are instances of pathological misbelief, has tended however to be neglected by certain prevailing models of delusion formation and maintenance. This paper explores a distinction between two general classes of theoretical explanation for delusions; the motivational (...) and the deficit. Motivational approaches view delusions as extreme instances of self-deception; as defensive attempts to relieve pain and distress. Deficit approaches, in contrast, view delusions as the consequence of defects in the normal functioning of belief mechanisms, underpinned by neuroanatomical or neurophysiological abnormalities. It is argued that although there are good reasons to be sceptical of motivational theories , recent experiments confirm that motives are important causal forces where delusions are concerned. It is therefore concluded that the most comprehensive account of delusions will involve a theoretical unification of both motivational and deficit approaches. (shrink)

Our senses provide us with information about the world, but what exactly do they tell us? I argue that in order to optimally respond to sensory stimulations, an agent’s doxastic space may have an extra, “imaginary” dimension of possibility; perceptual experiences confer certainty on propositions in this dimension. To some extent, the resulting picture vindicates the old-fashioned empiricist idea that all empirical knowledge is based on a solid foundation of sense-datum propositions, but it avoids most of the problems traditionally associated (...) with that idea. The proposal might also explain why experiences appear to have a non-physical phenomenal character, even if the world is entirely physical. (shrink)

In this article I will introduce and outline the concept of resistance as it relates to health and healthcare. Starting with a number of examples of action, I will then turn to the broader literature to discuss some conventional definitions and related concepts, outlining debates, controversies and limitations related to conceptualizing resistance. I conceptualize resistance broadly, as any act, performed by any individual (or collective) acting as or explicitly identifying as a healthcare professional, that is a response to power, most (...) often in opposition to contentious, harmful or unjust rules, practices, policies or structures. Practically this could account for any public action, marches, sit‐ins and civil disobedience, but also forms of ‘everyday resistance’, such as working slowly, feigning sickness, or even providing care for marginalized groups that would otherwise not have access. Such action could go unrecognized by those in power and perhaps more contentiously, those resisting needn’t even recognize their actions as resistance. I will then apply this conceptualization to explain action that has been undertaken by healthcare professionals, identifying its key features. I will briefly discuss future directions for inquiry that appear particularly pressing. These including ongoing conceptual development, identifying the functions of resistance in health and healthcare along with what makes it distinct from healthcare as usual and other forms of resistance and finally, the range of normative questions resistance raises. While strike action has been common since the industrial revolution, it often invokes a passionate and polarising response, from the strikers themselves, from employers, governments and the general public. Support or lack thereof from health workers and the general public is an important consideration in the justification of strike action. This systematic review sought to examine the impact of strike action on patient and clinician attitudes, specifically to explore (1) patient and health worker support for strike action and (2) the (...) predictors for supporting strike action and the reasons given for engaging in strike action. A systematic scoping review was employed to identify all relevant literature, followed by a textual narrative synthesis. A total of 34 studies met inclusion criteria. Support for strike action was largely context‐dependent. A range of factors impact support for strike action; broader cultural and structural factors, such as unionisation and general acceptance of strike action; systemic factors, such as the nature of the healthcare system, including infrastructure and work conditions; the strike itself and a range of individual factors, the most notable of which was being a student or in an early career stage. There were also some surprising results, for example, during doctors strike, nurses were provided with the opportunity to expand their role, which led to greater professional autonomy and job satisfaction. Strike action in healthcare has been a common global phenomenon. As such action is designed to be disruptive, it creates substantial ethical tension, the most cited of which relates to patient harm, that is, a strike may not only disrupt an employer, but it could also have serious implications for the delivery of care. This article systematically reviewed the literature on strike action in healthcare with the aim of providing an overview of the major justifications for strike action, identifying relative (...) strengths and shortcomings of this literature and providing direction for future discussions, and theoretical and empirical research. Three major themes emerged related to (1) the relationship between healthcare workers, patients and society; (2) the consequences of strike action; and (3) the conduct of strike action. Those who argue against strike action generally cite the harms of such action, particularly as it relates to patients. Many also argue that healthcare workers, because of their skills and position in society, have a special obligation to their patients and society more generally. Those who see this action as not only permissible but also, in some cases, necessary have advanced several points in response, arguing that healthcare workers do not necessarily have any special obligation to their patients or society, and even if so, this obligation is not absolute. Overwhelmingly, when talking about the potential risks of strike action, authors have focused on patient welfare and the impact that a strike could have. Several directions for future work are identified, including greater explorations into how structural and systemic issues impact strike action, the need for greater consideration about the contextual factors that influence the risks and characteristics of strike action and finally the need to tie this literature to existing empirical evidence. It is commonly argued that natural language has the expressive power of quantifying over intensional entities, such as times, worlds, or situations. A standard way of modelling this assumes that there are unpronounced but syntactically represented variables of the corresponding type. Not all that much as has been said, however, about the exact syntactic location of these variables. Meanwhile, recent work has highlighted a number of problems that arise because the interpretive options for situation pronouns seem to be subject to (...) various restrictions. This paper is primarily concerned with situation pronouns inside of determiner phrases, arguing that they are introduced as arguments of (certain) determiners. Verbal predicates, on the other hand, are assumed to not combine with a situation pronoun. The various restrictions on their interpretation are shown to fall out from the semantic system that is developed based on that view. Further support for such an account comes from situation semantic analyses of donkey sentences as well as data on the temporal interpretation of nominal predicates. Its ability to account for this full range of data in a unified manner is shown to set it apart from previous proposals. The paper closes with an outlook on further extensions, including an account of quantifier domain restriction based on situation pronouns. (shrink)

In this paper, I identify and provide an explanation for a heretofore unrecognized puzzle in feminist aesthetics and the philosophy of horror. Many horror movie fans have an aversion to rape scenes. This is puzzling because genre fans are not equally bothered by the depiction of other types of violence and cruelty. I argue that we can make sense of this selective aversion by appeal to the notion of ‘distance’, which philosophers of horror use to explain why people are attracted (...) to horror movies in the first place. When we consume horror, we ‘distance’ ourselves from the scary things depicted, which allows other mechanisms to kick in that lead to overall enjoyment. I argue that ‘distance’ often collapses when viewers are confronted with depictions of rape because rape is common in real life and a gendered form of violence that is implicated in social injustice. What are the objects of knowledge, belief, probability, apriority or analyticity? For at least some of these properties, it seems plausible that the objects are sentences, or sentence-like entities. However, results from mathematical logic indicate that sentential properties are subject to severe formal limitations. After surveying these results, I argue that they are more problematic than often assumed, that they can be avoided by taking the objects of the relevant property to be coarse-grained (“sets of worlds”) propositions, and that all (...) this has little to do with the choice between operators and predicates. There seem to be two ways of supposing a proposition: supposing “indicatively” that Shakespeare didn’t write Hamlet, it is likely that someone else did; supposing “subjunctively” that Shakespeare hadn’t written Hamlet, it is likely that nobody would have written the play. Let P be the probability of B on the subjunctive supposition that A. Is P equal to the probability of the corresponding counterfactual, A □→B? I review recent triviality arguments against this hypothesis and argue that they do not succeed. (...) On the other hand, I argue that even if we can equate P with P, we still need an account of how subjunctive conditional probabilities are related to unconditional probabilities. The triviality arguments reveal that the connection is not as straightforward as one might have hoped. (shrink)

Background Ethical climate refers to the shared perception of ethical norms and sets the scope for what is ethical and acceptable behaviour within teams. Aim This paper sought to explore perceptions of ethical climate amongst healthcare workers as measured by the Ethical Climate Questionnaire (ECQ), the Hospital Ethical Climate Survey (HECS) and the Ethics Environment Questionnaire (EEQ). Methods A systematic review and meta-analysis was utilised. PSYCINFO, CINAHL, WEB OF SCIENCE, MEDLINE and EMBASE were searched, and papers were included if they (...) sampled healthcare workers and used the ECQ, HECS or EEQ. Ethical consideration Ethical approval was not required. Results The search returned 1020 results. After screening, 61 papers were included ( n = 43 HECS, n = 15 ECQ, n = 3 EEQ). The overall sample size was over 17,000. The pooled mean score for the HECS was 3.60. Mean scores of individual studies ranged from 2.97 to 4.5. For the HECS studies, meta-regression was carried out. No relationship was found between the country of the studies, the study setting (ICU v non-ICU settings) or the mean years of experience that the sample had. For the ECQ, sub-scales had mean scores ranging from 3.41 (instrumental) to 4.34 (law) and were all observed to have significant and substantial heterogeneity. Three studies utilised the EEQ so further analysis was not carried out. Conclusions The above results provide insight into the variability of scores as measured by the HECS, ECQ and EEQ. To some extent, this variability is not surprising with studies carried out across 21 countries and in a range of healthcare systems. Results also suggest that it may be that more local and context specific factors are more important when it comes to predicting ethical climate. (shrink)

In this paper, I will argue that a number of well-known health interventions or initiatives could be considered anarchist, or at the very least are consistent with anarchist thinking and principles. In doing this I have two aims: First, anarchism is a misunderstood term—by way of example, I hope to first sketch out what anarchist solutions in health and healthcare could look like; second, I hope to show how anarchist thought could stand as a means to improve the health of (...) many, remedying health inequalities acting as a buffer for the many harms that threaten health and well-being. On this second point, I will argue that there are a number of theoretical and instrumental reasons why greater engagement with anarchism and anarchist thinking is needed, along with how this could contribute to health and in addressing broader injustices that create and perpetuate poor health. Australian immigration detention has been called state sanctioned abuse and a crime against humanity. The Australian healthcare community has been closely involved with these policies, calling for their reform and working within detention centres to provide healthcare. As well as having a devastating impact on health, immigration detention changes the scope and nature of healthcare, with its delivery described as a Sisyphean task. In this article I will explore the guidance that is available to clinicians who work within detention centres (...) and argue that codes, guidelines and positions statements provide little help in relation to ethical decision making. First I will outline guidance that can be found in codes of ethics and position statements, focusing on particularly relevant principles, such as advocacy, clinical independence and the clinicians’ relationship to human rights. I will then highlight the disparity between this guidance and the delivery of healthcare within detention by drawing on the testimony of clinicians who formerly worked in these environments. While this disparity should be cause for alarm and at a minimum call into question how codes and positions statements are being used, there are more fundamental reasons why codes and position statements fail to provide guidance in these circumstances. I will outline a more general criticism of codes of ethics and use this to suggest a way forward, including looking beyond codes and position statements to guide action within Australian immigration detention. Although existing work draws attention to a range of obstacles in realizing fair AI, the field lacks an account that emphasizes how these worries hang together in a systematic way. Furthermore, a review of the fair AI and philosophical literature demonstrates the unsuitability of ‘treat like cases alike’ and other intuitive notions as conceptions of fairness. That review then generates three desiderata for a replacement conception of fairness valuable to AI research: (1) It must provide a meta-theory for understanding tradeoffs, (...) entailing that it must be flexible enough to capture diverse species of objection to decisions. (2) It must not appeal to an impartial perspective (neutral data, objective data, or final arbiter.) (3) It must foreground the way in which judgments of fairness are sensitive to context, i.e., to historical and institutional states of affairs. We argue that a conception of fairness as appropriate concession in the historical iteration of institutional decisions meets these three desiderata. On the basis of this definition, we organize the insights of commentators into a process-structure map of the ethical territory that we hope will bring clarity to computer scientists and ethicists analyzing Fair AI while clearing some ground for further technical and philosophical work. For nearly 70 years, studies have shown large sex differences in human mate selection preferences. However, most of the studies were restricted to a limited set of mate selection criteria and to college students, and neglecting relationship status. In this study, 21,245 heterosexual participants between 18 and 65 years of age (mean age 41) who at the time were not involved in a close relationship rated the importance of 82 mate selection criteria adapted from previous studies, reported age ranges for (...) the oldest and youngest partner that they would find acceptable, and responded to 10 yes/no questions about a potential marriage partner. For nearly all mate selection criteria, women were found to be the more demanding sex, although men placed consistently more value on the physical attractiveness of a potential partner than women. Also, the effects of the participants’ age and level of education were nearly negligible. These results demonstrate the robustness of sex differences in mate selection criteria across a substantial age range. (shrink)

Modal accounts of knowledge, mind, and language, as prominently defended by Lewis, leave no room for enquiry into non-contingent matters. According to Lewis, there is only one necessarily true proposition, and it is vacuously known by everyone. What, then, are we doing when we do metaphysics, which often seems to deal with non-contingent questions? Lewis never gave a satisfactory answer, or even acknowledged the problem. I explore some options. Can we understand the relevant parts of metaphysics as dealing with contingent (...) questions about our concepts? Can we understand them in terms of a hyperintensional conception of “explicit” knowledge? Both options have some promise. Ultimately, however, I don’t think they succeed at squaring Lewis’s empiricist epistemology with his metaphysical realism. (shrink)

I argue that none of the usual interpretations of probability provide an adequate interpretation of probabilistic theories in science. Assuming that the aim of such theories is to capture noisy relationships in the world, I suggest that we do not have to give them classical truth-conditional content at all: their probabilities can remain uninterpreted. Indirectly, this account turns out to explain what is right about the frequency interpretation, the best-systems interpretation, and the epistemic interpretation.

Our contemporary condition is deeply infused with scientific-technological rationales. These influence and shape our ethical reasoning on war, including the moral status of civilians and the moral choices available to us. In this article, I discuss how technology shapes and directs the moral choices available to us by setting parameters for moral deliberation. I argue that technology has moral significance for just war thinking, yet this is often overlooked in attempts to assess who is liable to harm in war and (...) to what extent. This omission produces an undue deference to technological authority, reducing combatants, civilians and scenarios to data points. If we are to develop a maximally restrictive framework for harming civilians in war, which in my view should be a goal of just war thinking, then it is imperative that the scientific-technological dimension of contemporary war is given due attention. I argue that (a) the phenomenon characteristic of pragmatic presupposition, is distinct from (b) the phenomenon characteristic of semantic presupposition, and that there are sentences exhibiting (a) alone. I apply this to Stalnaker's defense of van Fraassen's theory of semantic presupposition against Karttunen. I show that, since Stalmaker fails to distinguish (a) from (b), this defense amounts to an unsuccessful attempt to explain pragmatically the supposed instances of (b) in Karttunen's counter-examples. I observe that, given the distinction between (a) and (...) (b), we can salvage from Stalnaker the strategy of discounting certain of Karttunen's counter-examples which exhibit not (b) but merely (a). (shrink)

In February 2016 a twelve-month-old asylum seeker, who came to be know as Baby Asha, was transferred from Nauru and hospitalized in Brisbane. This case came to public attention after Doctors refused to discharge Asha as she would have been returned to detention on Nauru. What in other circumstances would have been considered routine clinical care, quickly turned into an act of civil disobedience. This paper will discuss the ethical aspects of this case, along with its implications for clinicians and (...) the broader healthcare community. (shrink)

Hofmeister's reply to schwarz's paper: kant's refutation of charitable lies (ethics, Oct. 1970) attacks an imaginary disjunction of two true duties. Hofmeister's maxim 'consciousness' blots out three principal relations in truthfulness. His claim 'falsifications of facts are not immoral in themselves' vitiates all rights based on contract. Schwarz's 'overlooking' of the thematic distinction is refuted by textual evidence. Kant's alleged reversal of his stand draws on a spurious historical source.

I make the case that what gets called epistemic paternalism isn’t correctly labelled as such. This mislabelling is problematic for two reasons. First, paternalism in general faces strong challenges to its permissibility. Second, the scope for action of epistemic paternalism is somewhat narrow given the typical concerns of applied epistemology. Having clarified epistemic paternalism and discussed the above considerations, this paper introduces epistemic benevolence. The case is made that the epistemic benevolence-based approach can avoid some of the strong challenges that (...) epistemic paternalism faces and is often more suitable for the concerns of applied epistemology than a paternalist approach. To make these points, first, I make the case for a particular analysis of the epistemic paternalist act and, second, I explain epistemically benevolent acts as acts motivated by a concern for the epistemic welfare of another agent or agents. Given this characterisation, I argue that epistemic benevolence includes epistemic paternalism but extends beyond epistemic paternalism. I consider an objection to epistemic benevolence, which motivates laissez faire epistemic liberalism, a rival theoretical approach. Outlining this alternative serves to provide a further theoretical option relevant for work in applied epistemology. I offer some considerations as to why epistemic benevolence approach should still be favoured. (shrink)

Across the world, militaries are racing to acquire and develop new capabilities based on the latest in machine learning, neural networks, and artificial intelligence. In this paper, I argue that the shift into military AI is shaping human behaviour in heretofore unacknowledged and morally significant ways. Following Anders, I argue that as the human becomes digitally co-machinistic, they are compelled to adopt a logic of speed and optimisation in their ethical reasoning. The consequence of this is a form a moral (...) de-skilling, whereby military personnel working with digital infrastructures and interfaces become less able to act and decide as moral agents. This is an especially concerning development when it comes to the conduct of war, where the moral stakes could not be higher. (shrink)

The use of algorithms and automated systems, especially those leveraging artificial intelligence (AI), has been exploding in the public sector, but their use has been controversial. Ethicists, public advocates, and legal scholars have debated whether biases in AI systems should bar their use or if the potential net benefits, especially toward traditionally disadvantaged groups, justify even greater expansion. While this debate has become voluminous, no scholars of which we are aware have conducted experiments with the groups affected by these policies (...) about how they view the trade-offs. We conduct a set of two conjoint experiments with a high-quality sample of 973 Americans who identify as Black or African American in which we randomize the levels of inter-group disparity in outcomes and the net effect on such adverse outcomes in two highly controversial contexts: pre-trial detention and traffic camera ticketing. The results suggest that respondents are willing to tolerate some level of disparity in outcomes in exchange for certain net improvements for their community. These results turn this debate from an abstract ethical argument into an evaluation of political feasibility and policy design based on empirics. (shrink)

In this paper, I leverage the pragmatist tradition in philosophy, the collective wisdom of scholarship in clinical ethics consultation, and earlier attempts to apply pragmatism in clinical ethics to develop a new vision of clinical ethics practice called New Clinical Pragmatism. It argues that clinical ethics methodology, from the New Clinical Pragmatist’s perspective, amounts to the recommendation that consultants should customize a methodological approach, drawing on the various available methods, depending on the demands of the specific case, and should avoid (...) attempts to identify a ‘true’ methodology but to the incoherence and inevitable failure of those attempts. I argue that pragmatism’s emphasis on practical wisdom and experimentation allow the New Clinical Pragmatist to do this while avoiding irrationality in choosing methods. I discuss how the New Clinical Pragmatist gives a unique, constructive perspective on key aspects of clinical ethics consultation such as the choice of common morality vs. internal morality of medicine approaches, process standards, bioethics mediation, and narrative ethics, and suggest how New Clinical Pragmatism’s relaxed approach to choice of methodology encourages consultants to balance attention to the particulars of the case with knowledge of what the many insightful scholars of clinical ethics methodology have found useful in the past. I also argue that New Clinical Pragmatism is consistent with efforts to professionalize clinical ethics consultation. (shrink)
