We examine whether and when socially oriented shareholder activists use firms’ corporate social performance (CSP) to identify them as attractive targets for their activism. We build on the research in social movements theory and stakeholder theory to theorize how firms’ engagement with primary and secondary stakeholders reflected in their technical and institutional CSP respectively allows socially oriented shareholder activists to identify targets. We develop a theoretical model by identifying corporate targets’ degree of (1) receptivity to and (2) need to comply (...) with activist demands as two key dimensions of their corporate opportunity structure that explains the variance in firms’ attractiveness as targets for activist demands. We show that a firm’s technical and institutional CSP independently affect the likelihood of activists targeting the firm. We also show that our model has greater explanatory power at firms with high resource slack and from activists not identifying as socially responsible investment funds. Analysis of CSP and shareholder proposals data of 992 U.S. public firms over an 8-year window of observation largely supports our theory. (shrink)

AbstractMany management theories have descriptive and normative elements, and no management theory used to generate prescriptions can be totally devoid of normative assumptions. Yet, there remain few useful models for assessing the relative strength or utility of the normative frameworks that inform most management theorizing. In this essay, we offer a model from a field of art rather than science. We introduce the poetry of early twentieth century American writer Hart Crane as providing such a model. Crane uses a panorama (...) of consequences to examine modern social phenomena and subject them to normative evaluation. We argue that management theorists can use a similar panorama of consequences method to “test” normative theories by assessing the directional consistency of the normative evaluations the theories generate about an empirical phenomenon or relationship, as well as how extensively the theories’ normative evaluations cover the full scope of a phenomenon’s or relationship’s impact. We explicate an exemplar poem of Crane’s, and then demonstrate how his method might be used to study shareholder activism, a normatively ambiguous management practice, in a way that illuminates the strengths and weaknesses of the relevant normative frameworks. In this paper I intend to do two things. The first is to discuss a method of doing philosophy, the method of ‘ordinary language’ philosophy, as it is commonly and misleadingly called. (Its other common title: ‘Oxford Philosophy’ is even more misleading, since the roots of the method lie in Cambridge, and many of the most flourishing branches are in the United States rather than England.)If it needs a name, perhaps the best is—adapting Popper to our purpose—‘piecemeal philosophical engineering’. Such (...) a title would emphasise the attention to detail and the caution about conclusions that characterise the best of such work. The second aim of this paper is to apply the method thus discussed and defended to three questions connected with the concept of freedom. These problems arise out of three recent discussions of freedom—Thought and Action and Spinoza and the Idea of Freedom by Professor Hampshire, and Two Concepts of Liberty by Professor Berlin. We critically examine the claim that identity is a fundamental concept. According to those putting forward this thesis, there are four related reasons that can be called upon to ground the fundamental character of identity: identity is presupposed in every conceptual system; identity is required to characterize individuality; identity cannot be defined; the intelligibility of quantification requires identity. We address each of these points and argue that none of them advances compelling reasons to hold that identity is fundamental; in fact, (...) most of the tasks that seem to require identity may be performed without identity. So, in the end, identity may not be a fundamental concept after all. (shrink)

While experience often affords important knowledge and insight that is difficult to garner through observation or testimony alone, it also has the potential to generate conflicts of interest and unrepresentative perspectives. We call this tension the paradox of experience. In this paper, we first outline appeals to experience made in debates about access to unproven medical products and disability bioethics, as examples of how experience claims arise in bioethics and some of the challenges raised by these claims. We then motivate (...) the idea that experience can be an asset by appealing to themes in feminist and moral epistemology, distinguishing between epistemic and justice-based appeals. Next, we explain the concern that experience may be a liability by appealing to empirical work on cognitive biases and theoretical work about the problem of partial representation. We conclude with preliminary recommendations for addressing the paradox and offer several questions for future discussion. (shrink)

In this book Sharon Krause argues that moral and political deliberation must incorporate passions, even as she insists on the value of impartiality.

Very diverse societies pose real problems for Rawlsian models of public reason. This is for two reasons: first, public reason is unable accommodate diverse perspectives in determining a regulative ideal. Second, regulative ideals are unable to respond to social change. While models based on public reason focus on the justification of principles, this book suggests that we need to orient our normative theories more toward discovery and experimentation. The book develops a unique approach to social contract theory that focuses on (...) diverse perspectives. It offers a new moral stance that author Ryan Muldoon calls, "The View From Everywhere," which allows for substantive, fundamental moral disagreement. This stance is used to develop a bargaining model in which agents can cooperate despite seeing different perspectives. Rather than arguing for an ideal contract or particular principles of justice, Muldoon outlines a procedure for iterated revisions to the rules of a social contract. It expands Mill's conception of experiments in living to help form a foundational principle for social contract theory. By embracing this kind of experimentation, we move away from a conception of justice as an end state, and toward a conception of justice as a trajectory. (shrink)

In epistemology and the philosophy of science, there has been an increasing interest in the social aspects of belief acquisition. In particular, there has been a focus on the division of cognitive labor in science. This essay explores several different models of the division of cognitive labor, with particular focus on Kitcher, Strevens, Weisberg and Muldoon, and Zollman. The essay then shows how many of the benefits of the division of cognitive labor flow from leveraging agent diversity. This book explores the constraints which justice imposes on immigration policy. Like liberal nationalists, Ryan Pevnick argues that citizens have special claims to the institutions of their states. However, the source of these special claims is located in the citizenry's ownership of state institutions rather than in a shared national identity. Citizens contribute to the construction and maintenance of institutions, and as a result they have special claims to these institutions and a limited right to exclude outsiders. Pevnick shows (...) that the resulting view justifies a set of policies - including support for certain types of guest worker programs - which is distinct from those supported by either liberal nationalists or advocates of open borders. His book provides a framework for considering a number of connected topics including issues related to self-determination, the scope of distributive justice and the significance of shared national identity. Originally published in 1982. Aside from Jacques Derrida's own references to the "possible articulation" between deconstruction and Marxism, the relationship between the two has remained largely unexplored. In Marxism and Deconstruction, Michael Ryan examines that multifaceted relationship but not through a mere comparison of two distinct and inviolable entities. Instead, he looks at both with an eye to identifying their common elements and reweaving them into a new theory of political practice. To accomplish his task, Ryan undertakes a (...) detailed comparison of deconstruction and Marxism, relating deconstruction to the dialectical tradition in philosophy and demonstrating how deconstruction can be used in the critique of ideology. He is a forceful critic of both the politics of deconstruction and the metaphysical aspect of Marxism (as seen from a deconstructionist perspective). Besides offering the first book-length study of Derrida in this context, Ryan makes the first methodic attempt by an American scholar to apply deconstruction to domains beyond literature. He proposes a deconstructive Marxism, one lacking the metaphysical underpinnings of conservative "scientific" Marxist theory and employing deconstructive analysis both for Marxist political criticism and to further current anti-metaphysical developments within Marxism. Marxism and Deconstruction is an innovative and controversial contribution to the fields of literary criticism, philosophy, and political science. (shrink)

A common view holds that consciousness is needed for knowledge acquired in one domain to be applied in a novel domain. We present evidence for the opposite; where the transfer of knowledge is achieved only in the absence of conscious awareness. Knowledge of artificial grammars was examined where training and testing occurred in different vocabularies or modalities. In all conditions grammaticality judgments attributed to random selection showed above-chance accuracy , while those attributed to conscious decisions did not. Participants also rated (...) each string’s familiarity and performed a perceptual task assessing fluency. Familiarity was predicted by repetition structure and was thus related to grammaticality. Fluency, though increasing familiarity, was unrelated to grammaticality. While familiarity predicted all judgments only those attributed to random selection showed a significant additional contribution of grammaticality, deriving primarily from chunk novelty. In knowledge transfer, as in visual perception , the unconscious may outperform the conscious. (shrink)

Quarantine and spatial distancing measures associated with COVID-19 resulted in substantial changes to individuals’ everyday lives. Prominent among these lifestyle changes was the way in which people interacted with media—including music listening. In this repeated assessment study, we assessed Australian university students’ media use throughout early stages of the COVID-19 pandemic in Australia, and determined whether media use was related to changes in life satisfaction. Participants were asked to complete six online questionnaires, capturing pre- and during-pandemic experiences. The results indicated (...) that media use varied substantially throughout the study period, and at the within-person level, life satisfaction was positively associated with music listening and negatively associated with watching TV/videos/movies. The findings highlight the potential benefits of music listening during COVID-19 and other periods of social isolation. (shrink)

H. Post's conception of quantal particles as non-individuals is set in a formal logico-mathematical framework. By means of this approach certain metaphysical implications of quantum mechanics can be further explored.

This article focuses on Auguste Comte’s understanding of the organism–environment relationship. It makes three key claims therein: (a) Comte’s metaphysical position privileged materiality and relativized the intellect along two dimensions: one related to the biological organism, one related to the social environment; (b) this twofold materiality confounds attempts to reduce cognition to either nature or nurture, so Comte’s position has interesting parallels to the field of ‘epigenetics’, which sees the social environment as a causative factor in biology; and (c) although (...) Comte ultimately diverged from the ‘postgenomic’ view in crucial ways, he remains a forerunner of the trend towards viewing the social and biological as entangled. Tending to these dimensions challenges the view that Comte is notable from a classical standpoint but ignorable from a contemporary one. The influence of prior familiarity with components on the implicit learning of relations was examined using artificial grammar learning. Prior to training on grammar strings, participants were familiarised with either the novel symbols used to construct the strings or with irrelevant geometric shapes. Participants familiarised with the relevant symbols showed greater accuracy when judging the correctness of new grammar strings. Familiarity with elemental components did not increase conscious awareness of the basis for discriminations but increased accuracy even in its absence. (...) The subjective familiarity of test strings predicted grammaticality judgments. However, prior exposure to relevant symbols did not increase overall test string familiarity or reliance on familiarity when making grammaticality judgments. Familiarity with the symbols increased the learning of relations between them thus resulting in greater familiarity for grammatical versus ungrammatical strings. In this paper we consider the phenomenon of superpositions in quantum mechanics and suggest a way to deal with the idea in a logical setting from a syntactical point of view, that is, as subsumed in the language of the formalism, and not semantically. We restrict the discussion to the propositional level only. Then, after presenting the motivations and a possible world semantics, the formalism is outlined and we also consider within this schema the claim that superpositions may involve contradictions, (...) as in the case of the Schrödinger's cat, which is both alive and dead. We argue that this claim is a misreading of the quantum case. Finally, we sketch a new form of quantum logic that involves three kinds of negations and present the relationships among them. The paper is a first approach to the subject, introducing some main guidelines to be developed by a `syntactical' logical approach to quantum superpositions. (shrink)

Work done within the realm of what is sometimes called ‘descriptive ethics’ brings two questions readily to mind: How can empirical findings, in general, inform normative debates? and How can these empirical findings, in particular, inform the normative debate at hand? Brick et al 1 confront these questions in their novel investigation of public views about lives worth living and the permissibility of withdrawing life-sustaining treatment from critically ill infants. Mindful of the is-ought gap, the authors suggest modestly that their (...) data ‘may be useful when constructing guidelines for clinical practice’. In this commentary, I consider some potential limitations on the generalisability of these data in the context of policy and clinical practice, limitations which may in turn serve as directions for future empirical research. The authors’ study presented participants six case scenarios, five of which involved the possibility of withdrawing life-sustaining treatment from critically ill infants. The results revealed that “[a]lmost all respondents agreed that at some level of quality of life, life may be of no benefit or worse than death for an infant” and that “participants significantly favoured withdrawal of treatment for the most severe cases.” One salient detail in these scenarios …. In this paper we try to justify our way of looking for an alternative approach to quantum mechanics, which is based on a non-classical logic. We consider two specific questions related to quantum theory, namely, entanglement and the indiscernibility of quanta. We characterize individuals, and then explain in what sense entanglement is a concept which can be applied to individuals in a restricted sense only. Then, we turn to indiscernibility and, after realizing that this concept is of a fundamental importance, (...) we mention the ‘traditional’ theory of identity of standard logic and mathematics, which underly the basic formalism of quantum theory. Then we propose to call the Problem of Identity the question whether identity of objects can be justified, and under what conditions. As in the Hume’s celebrated Problem of Induction, we conclude that the attribution of transtemporal identity to an object has no logic justification, and must be considered as a metaphysical hypothesis. Numerical identity is also put aside for similar reasons. Then we guess that identity is just an useful concept, but which in certain fields, mainly in the quantum realm, could be substituted by a weaker concept of indiscernibility. This assumption motivates us to look for an interpretation of quantum mechanics based on a non-classical logic, termed non-reflexive, and the corresponding mechanics is called non-reflexive quantum mechanics. This paper develops a formal framework to model a process in which the formation of individual opinions is embedded in a deliberative exchange with others. The paper opts for a low-resolution modeling approach and abstracts away from most of the details of the social-epistemic process. Taking a bird's eye view allows us to analyze the chances for the truth to be found and broadly accepted under conditions of cognitive division of labour combined with a social exchange process. Cognitive division of (...) labour means that only some individuals are active truth seekers, possibly with different capacities. Both mathematical tools and computer simulations are used to investigate the model. As an analytical result, the Funnel Theorem states that under rather weak conditions on the social process, a consensus on the truth will be reached if all individuals possess an arbitrarily small capacity to go for the truth. The Leading the pack Theorem states that under certain conditions even a single truth seeker may lead all individuals to the truth. Systematic simulations analyze how close agents can get to the truth depending upon the frequency of truth seekers, their capacities as truth seekers, the position of the truth (more to the extreme or more in the centre of an opinion space), and the willingness to take into account the opinions of others when exchanging and updating opinions. The article develops the notion of the ‘hyperabject’ – coined by Danish poet Theis Ørntoft – into a proper theoretical concept. The term hyperabject is a synthesis of Timothy Morton's concept of hyperobjects and Julia Kristeva's theory of abjection, and in the article we argue that the concept of the hyperabject entails a necessary critique of and correction to Morton's ecological thought, as well as various other versions of speculative realism, new materialism and object-oriented ontology.

The search for axioms like those of set theories for dealing with collections of indistinguishable elementary particles was posed by Yu. I. Manin, in 1974, as one of the important problems of present day researches on the foundations of mathematics. In this paper we presented a quasi-set theory which stands for a mathematical framework for dealing with collections of indistinguishable objects, whose ’intended interpretation’ is precisely the behaviour of elementary particles as described by non-relativistic quantum mechanics. A sketch of the (...) proof that this theory and ZFC are equiconsistent is also presented and the relationship with the case of quantum particles is mentioned throughout the paper. (shrink)

The growing threat of terrorism has increased the importance of aviation security and the work of airport security officers (screeners). Nonetheless, airport security research has yet to focus on emotional exhaustion and job satisfaction as major determinants of screeners’ job performance. The present study bridges this research gap by applying the job demands–resources (JD−R) model and using work–family conflict (WFC) as an intervening variable to study relationships between work characteristics (workload and supervisor support), emotional exhaustion, and job satisfaction in 1,127 (...) screeners at a European airport. Results of structural equation modeling revealed that (a) supervisor support as a major job resource predicted job satisfaction among screeners; (b) workload as a major job demand predicted their emotional exhaustion; and (c) WFC proved to be a promising extension to the JD–R model that partially mediated the impact of supervisor support and workload on job satisfaction and emotional exhaustion. In this paper I consider some logical and mathematical aspects of the discussion of the identity and individuality of quantum entities. I shall point out that for some aspects of the discussion, the logical basis cannot be put aside; on the contrary, it leads us to unavoidable conclusions which may have consequences in how we articulate certain concepts related to quantum theory. Behind the discussion, there is a general argument which suggests the possibility of a metaphysics of non-individuals, based on (...) a reasonable interpretation of quantum basic entities. I close the paper with a suggestion that consists in emphasizing that quanta should be referred to by the cardinalities of the collections to which they belong, for which an adequate mathematical framework seems to be possible. This article analyzes one aspect of Bolzano’s metaphysics. It discusses the question of whether, according to Bolzano, substances are simple or not. In theopinion of some commentators, he accepts composed substances, that is, substances having substances as proper parts. However, it is easily possible to misinterpret his position. This paper first tries to reconstruct Bolzano’s definitions of the concept of substance and suggests that he should be able to agree with the following final definition: x is a substance if and (...) only if x is real and not a property. After this, it is shown that, according to Bolzano, every substance is simple in a fourfold sense: No substance has (1) adherences as parts, (2) substances as proper parts, (3) spatially extended parts, and (4) temporal parts. The founding operation of the American States involves a mediating mechanism that enables the connection between the ideals supporting it and the intent for its popularization among people. Such is the function assigned to the founding heroes, which is analyzed as a cultural operation that aims to enshrine these ideals, thereby eliding the violence contained in the formation of modern States.

One of the goals in developmental biology is the identification of key regulatory genes that govern the transition of embryonic cells from a pluripotent potential to a specific, committed cell fate. During vertebrate skeletal myogenesis, this transition is regulated by the MyoD family of genes. C. elegans has muscle analogous to vertebrate skeletal muscle and has a gene(hlh‐1) related to the MyoD family. The molecular and genetic characterization of hlh‐1 shows that it is very similar to the vertebrate MyoD family (...) in many respects, including its expression pattern and DNA binding activity. The hlh‐1 product is required for proper myogenesis, but it is not required for myogenic commitment during embryogenesis in the nematode. The role of this MyoD‐related gene in nematode myogenesis is discussed and compared to those of the vertebrate MyoD family. (shrink)

Few areas of health law practice present as many quandaries for the ethical health lawyer as health care fraud and abuse. The activities addressed by the anti-fraud laws – such as payment for referrals and submission of false claims – not only have a direct impact on the financial viability of the federal health care programs, but go to the heart of the ethical behaviors expected of those who transact business with the government. The severe consequences of violating these proscriptions (...) include significant monetary penalties, ineligibility to participate in the federal health care programs, and even imprisonment. It is no wonder, then, that compliance with the fraud and abuse laws is a key consideration in any health care venture. At the same time, ethical considerations make this area of health law particularly vexing for counsel, raising numerous challenges that include how to balance the strategic goals of current clients against the interests of future clients and whether to advise clients to self-report potential violations even when illegal intent may not easily be shown.
