Rosemary Hennessy confronts some of the impasses in materialist feminist work on rethinking `woman' as a discursively constructed subject. She argues for a theory of discourse as ideology taking into account the work of Kristeva, Foucault and Laclau.

Four experiments investigated uncertainty about a premise in a deductive argument as a function of the expertise of the speaker and of the conversational context. The procedure mimicked everyday reasoning in that participants were not told that the premises were to be treated as certain. The results showed that the perceived likelihood of a conclusion was greater when the major or the minor premise was uttered by an expert rather than a novice (Experiment 1). The results also showed that uncertainty (...) about the conclusion was higher when the major premise was uttered by a novice and an alternative premise by an expert, compared to when the major premise was uttered by an expert and the alternative by a novice (Experiment 2). Similarly, the believability of a conclusion was considerably lower when the minor premise was uttered by a novice and denied by an expert, as opposed to when an expert uttered the minor premise and a novice denied it (Experiment 3). Experiment 4 showed that the nature of the uncertainty induced by a denial of the minor premise depended on whether or not the context was a conversation. These results pose difficult problems for current theories of reasoning, as current theories are based on the results of experiments in which the premises are treated as certain. Our discussion of the results emphasises the importance of pragmatics in reasoning, namely, the role of general knowledge about the world in assessing the probability of a premise uttered by an expert or a novice and the role of interpretations of the premise based on pragmatic inferences in revising these initial probabilities. The purpose of this study was to determine the development of moral judgement in first-year and senior baccalaureate nursing students. These students were enrolled in three separate nursing programmes, each of which differed significantly in ethical content. The sample totalled 180 students enrolled in three New England programmes. Programme A included an ethics course taught by a professor of ethics. Programme B integrated ethical issues into all nursing theory courses. Programme C did not include ethical content in theory courses. The (...) design was of a developmental cross-sectional study. The dependent variable was the development of moral judgement, as measured by Rest’s Defining Issues Test. The independent variable was the amount of ethics taught in the nursing programmes and the level of academic education. The senior nursing students from programme A scored significantly higher than the other senior groups on the Defining Issues Test. The conclusion is that an ethics course with group participation and a decision-making element significantly facilitated nursing students’ development of moral judgement. (shrink)

This article offers an account of settler witnessing of residential school survivor testimony that avoids the politics of recognition and the pitfalls of colonial empathy. It knits together the concepts of bearing witness, Indigenous storytelling, and affective reckoning. Following the work of Kelly Oliver, it argues that witnessing involves a reaching beyond ourselves and responsiveness to the agency and self-determination of the other. Given the cultural genocide of residential schools, responsiveness to the other require openness to and nurturing of Indigenous (...) ways of knowing and being. In order to illustrate the complexities and challenges of settler witnessing, the author reflects on her experiences in attending six of the TRC’s national events and, in particular, what she has learned from Frederick “Fredda” Paul, Passamaquoddy Elder, healer, storyteller, and residential school survivor. My aim in this paper is to determine the conditions under which such acts are Justified. The route I take is through the concept of consent, with actual consent providing the foundation for a rather complex condition which I claim is necessary and sufficient for the Justification (...) of paternalism.Because a paternalistic act apparently violates a subject's right to non-interference, it constitutes a problem in the general area of rights. Ideally, then, one should have a developed and convincing theory of rights — that is, a theory which contains an analysis of the concept of a right, and offers solutions to the central problems, e.g. who has rights and why, what considerations override prima facie rights, and how the relative importance of prima facie rights is determined — from which the solutions to various problems about paternalism can be derived. Flew' s reservation about my assertion that the Enquiry contains no significant revision of the Treatise conception of geometry as a body of necessary and synthetic knowledge, appears to involve two charges. Firstly, he alleges that I dismiss but offer no substantial argument against his own view that the Enquiry restores (...) pure geometry "to its place alongside the other two elements of the trinity ". Secondly, he thinks that I have committed a serious sin of omission in failing to take into consideration a certain passage in the Enquiry (page 31, section 27) which, in his opinion, constitutes "a quite decisive reason" for supposing that Hume abandoned the Treatise position, in that it contains an account of applied mathematics, a subject on which the Treatise is silent. To the charge of omission I plead guilty, and I shall presently seek to remedy this defect and to state why I do not share Flew' s view of the significance of the said passage. To the former charge I am not so ready to plead guilty, and I shall counter-charge that Flew has failed not only to do justice to my proposed reading of Enquiry page 25, section 20, but also to provide clear and convincing support for his own. One difficulty encountered in answering Flew lies in understanding whether or not his claim about the status of geometry as a pure science in the Enquiry is put forward independently of his interpretation of E31. As originally presented in Hume's Philosophy of Belief this appears to be the case, and if so, on what evidence does it rest? 2 In his book, Flew' s statement about Hume replacing pure geometry alongside arithmetic and algebra follows directly upon a paragraph in which he comments that Hume's references to geometrical propositions at E25 signify "an important advance from the position of the Treatise". For whereas the status of perfect precision and certainty was 67. there withheld from geometry (T71), Hume now speaks of the certainty and evidence of the propositions of Euclidean geometry, and declares such propositions to be discoverable by the mere operation of thought, without dependence on what is anywhere existent in the universe. (E25) Now, I argued at some length in my paper (pp. 21-24) that Hume is prepared to grant scientific status to geometry in the Enquiry because he has come to regard its certainty as that proper to a mathematics of space. In his comment on my position Flew makes no reference to my proposed reason why Hume classes geometry as a science in the Enquiry.· Yet, even if this reclassification does mark an advance of a kind, the fact remains that E25 does not furnish incontrovertible evidence for that advance which Flew thinks he finds there. Nor, therefore, is it conclusive against my assertion that Hume in both works regards the propositions of geometry as necessary and synthetic truths. Given that Flew does not wish to deny the inclusion of a synthetic element even in the Enquiry account of mathematics (see H. P. B. pp. 64-66), I find it difficult to see why he supposes that the logical status of the propositions of geometry is different in the Enquiry from that in the Treatise, since in the latter too they are held 68. to be truths which depend... The author justifies ethical concern within a framework of philosofical and biological attitudes which is based on evolutionary theory, and provides detailed discussions and solutions of practical situations in which ethical decisions have to be made.

We investigate how the perceived uncertainty of a conditional affects a person's choice of conclusion. We use a novel procedure to introduce uncertainty by manipulating the conditional probability of the consequent given the antecedent. In Experiment 1, we show first that subjects reduce their choice of valid conclusions when a conditional is followed by an additional premise that makes the major premise uncertain. In this we replicate Byrne. These subjects choose, instead, a qualified conclusion expressing uncertainty. If subjects are given (...) a third statement that qualifies the likelihood of the additional premise, then the uncertainty of the conclusions they choose is systematically related to the suggested uncertainty. Experiment 2 confirms these observations in problems that omit the additional premise and qualify the first premise directly. Experiment 3 shows that the qualifying statement also affects the perceived probability of the consequent given the antecedent of the conditional. Experiment 4 investigates the effect of suggested uncertainty on the fallacies and shows that increases in uncertainty reduce the number of certain conclusions that are chosen while affirming the consequent but have no effect on denying the antecedent. We discuss our results in terms of rule theories and mental models and conclude that the latter give the most natural account of our results. (shrink)

This article revisits the question of ectogenesis (out-of-body gestation) as our neonatal care and biogenetic technologies bring us closer to the possibility. In 1923, J.B.S. Haldane wrote approvingly of ectogenesis as a eugenic technique, using a science fiction format. In the 1970s and 1980s, feminists debated whether ectogenesis, if possible, would be liberating or oppressive for women. Given current legal and bioethical issues, we must now take seriously the possible costs of ectogenesis: the possibility of growing bodies for use as (...) spare parts, the erosion of the autonomy of women in the reproductive process, the denigration of the body through the loss of the physicality of pregnancy and childbirth. Die von Decroly entwickelte Méthode Decroly auf der Basis von Anschauung (...) und Erzieherischen Spielen zur Förderung der intellektuellen Fähigkeiten des Kindes wird heute noch an öffentlichen Schulen in Brüssel, Paris und Barcelona erfolgreich praktiziert. This essay discusses the history of the "futility debate" and the motives that sometimes prompt health care professionals, health care providers, patients, and surrogates to take different sides in it. Changes in the health care system, financial responsibility shifts, technical medical advances, and medical care rationing are analyzed as contributors to the futility debate. So too are variations in the definition of futility examined as part of the current controversy. The respective attitudes of professionals, providers, patients, and surrogates in accepting (...) the goals, capabilities, and limits of medicine are also explored. In particular, the lack of honest communication between health care professionals/health care providers on the one hand and patients/surrogates on the other is acknowledged as a major roadblock in the building of care-focused futility policies. Finally, various initial attempts of hospitals to create futility guidelines are evaluated in order to detect problem areas and to suggest lines of improvement. In this paper I seek to distinguish a feminist virtue ethics of care from (1) justice ethics, (2) narrative ethics, (3) care ethics and (4) virtue ethics. I also connect this contemporary discussion of what makes a virtue ethics of care feminist to eighteenth and nineteenth century debates about male, female, and human virtue. I conclude that by focusing on issues related to gender - primarily those related to the systems, structures, and ideologies that create and sustain patterns of male (...) domination and female subordination - we can begin to appreciate that true care and bona-fide virtue can flourish only in societies that treat all persons with equal respect and consideration. While most interpreters take the opening of De Anima III 2 to be an oblique reference to some sort of conscious awareness, I argue that Aristotle intends to explain what I call ‘joint perception’: when conjoined with Aristotle’s subsequent claim that perceiving and being perceived are the same activity, the metaperception underpins the perception of a unified object. My interpretation is shown to have a more satisfactory account of the aporiai that follow. While I argue that the immediate focus of (...) the metaperceptual account is joint perception, it may also be applicable to other kinds of complex perception, which I briefly consider in the closing section. Globalizing Feminist Bioethics is a collection of new essays on the topic of international bioethics that developed out of the Third World Congress of the International Association of Bioethics in 1996. Rosemarie Tong is the primary editor of this collection, in which she, Gwen Anderson, and Aida Santos look at such international issues as female genital cutting, fatal daughter syndrome, use of reproductive technologies, male responsibility, pediatrics, breast cancer, pregnancy, and drug testing.

In this commentary on Eva Feder Kittay's Love's Labor: Essays on Women, Equality, and Dependency, I focus on Kittay's dependency theory. I apply this theory to an analysis of women's inadequate access to high-quality, cost-effective healthcare. I conclude that while quandaries remain unresolved, including getting men to do their share of dependency work, Kittay's book is an important and original contribution to feminist healthcare ethics and the development of a normative feminist ethic of care.

In this paper I examine the epistemology and ethics of consensus, focusing on the ways in which decision makers use/misuse ethical expertise. The major questions I raise and tentative answers I give are the following: First, are the ‘experts’ really experts? My tentative answer is that they are bona fide experts who often represent specific interest groups. Second, is the experts' authority merely epistemological or is it also ethical? My tentative answer is that the experts' authority consists not only in (...) their command over specific matters of fact and/or value, but also in their ability to achieve ‘consensus’ about what is ‘true’/‘false’, or ‘right’/‘wrong’. Third, should the authority of expertise be limited? My tentative answer is that it should be limited in the area of facts but especially in the area of values. Persons who are ethics ‘experts’ must be particularly careful to practice an ethics of persuasion rather than an ethics of compulsion . Their role is not to force their group consensus upon decision makers' individual moral perceptions and deliberations; rather it is to help decision makers come to their own conclusions about what they ought to do. The ratio-bias (RB) phenomenon refers to the perceived likelihood of a low-probability event as greater when it is presented in the form of larger (e.g. 10-in-100) rather than smaller (e.g. 1-in-10) numbers. According to cognitive-experiential self-theory (CEST), the RB effect in a game of chance in a win condition, in which drawing a red jellybean is rewarded, can be accounted for by two facets of concrete thinking, the greater comprehension (at the intuitive-experiential level) of single numbers than of ratios, and (...) of smaller than of larger numbers. In a lose condition, in which drawing a red jellybean is punished, the assumption of a third facet of concrete thinking, the ''affirmative-representation principle'', is necessary, as many participants reverse their focus of attention from the undesirable red to the desirable white jellybeans. Results supported the CEST explanation of the RB effect by demonstrating a predicted negative linear relation between the magnitude of the RB effect and the magnitude of the probability-ratios in the win condition and a positive linear relation in the lose condition. In this paper I discuss Frege's distinction between objects and concepts and suggest a solution of Frege's paradox of the concept horse. The expression ''the concept horse'' is not eliminated and the concept is not identified with its extension, but the concept is identified with the sense of the corresponding predicate. This solution fits better into a fregean ontology and philosophy of language than alternative solutions and allows for a general answer to the question why Frege's system is infected with (...) Russell's paradox. Russell's paradox is caused by the reification of a concept. For a long time, emotions have been ignored in the attempt to model intelligent behavior. However, within the last years, evidence has come from neuroscience that emotions are an important facet of intelligent behavior being involved into cognitive problem solving, decision making, the establishment of social behavior, and even conscious experience. Also in research communities like software agents and robotics, an increasing number of researchers start to believe that computational models of emotions will be needed to design intelligent systems. Nevertheless, (...) modeling emotions in technical terms poses many difficulties and has often been accounted as just not feasible. In this article, there are identified the main problems, which occur when attempting to implement emotions into machines. By pointing out these problems, it is aimed to avoid repeating mistakes committed when modeling computational models of emotions in order to speed up future development in this area. The identified issues are not derived from abstract reflections about this topic but from the actual attempt to implement emotions into a technical system based on neuroscientific research findings. It is argued that besides focusing on the cognitive aspects of emotions, a consideration of the bodily aspects of emotions—their grounding into a visceral body—is of crucial importance, especially when a system shall be able to learn correlations between environmental objects and events and their “emotional meaning”. Increasing recognition of adverse events in health care is wide spread. Implementing improved system arrangements, which prevent adverse events taking place rather than focussing on individual culpability is increasingly being recognised as a more effective preventative strategy. But does such a perspective mean individual health practitioners remain accountable for their practice? This article explores the philosophical, psychological and professional contradictions inherent in attempting to understand where the responsibility for our actions lies and concludes by arguing that while the case for (...) the system approach to adverse event reduction is strong, the notion of individual professional culpability needs to be maintained. In criminal trials with a jury, judges have many opportunities to engage in adjudicative fact-finding before the jury retires. English law has no conceptual framework for examining this judicial fact-finding which encompasses two categories of collateral fact (preliminary and underlying fact) and foreign law. A third category of collateral fact (conditional fact) is decided by the jury. The article examines the nature of judicial fact-finding and the history and rationale for this allocation of fact-finding responsibility between judge and jury.

The dynamic developmental theory of attention-deficit/hyperactivity disorder (ADHD) proposes that hypodopaminergic functioning results in anomalous delay-of-reinforcement gradients in ADHD, which in turn might account for many of the observed behavioral and cognitive characteristics. However, hyperdopaminergic functioning might also impair mnemonic representation of codes for spatial, motoric, and reward information and contribute to the purported shorter delay gradients in ADHD.
