A working party of academics from both professional safeguarding backgrounds and research backgrounds developed and wrote ethical guidelines on safeguarding children in research on behalf of their faculty research ethics committee. The working party encountered a lack of useful precedents while developing the guidelines leading to a lengthy process of debate and consideration of the issues. This paper explores the various issues and dilemmas arising during this process, particularly the tension between safeguarding children from abuse and maintaining research confidentiality. One (...) of the main areas of discussion was how to establish the limits of confidentiality without compromising the research in hand. The role and responsibilities of researchers in supporting children's welfare, and the development of procedures for ensuring that safeguarding is effective are discussed as key elements. In addition, the issues researchers may face when determining thresholds for intervention are considered alongside the uncertainties created by considerations of the extent to which children can give informed consent in research contexts. The paper reflects the process of considering these issues and the conclusions the working party drew as to how best to support children's welfare during research. It also outlines the key elements of the guidelines and the structures developed to ensure researchers could get advice if suspected child abuse became an issue in their research. Pure time preference is a preference for something to come at one point in time rather than another merely because of when it occurs in time. In opposition to Sidgwick, Ramsey, Rawls, and Parfit we argue that it is not always irrational to be guided by pure time preferences. We argue that even if the mere difference of location in time is not a rational ground for a preference, time may nevertheless be a normatively neutral ground for a preference, and (...) this makes it plausible to claim that the preference is rationally permitted. Édouard Glissant’s Poetics of Relation is unlikely to strike most readers as a sacred text. True, the design of the 1997 English paperback edition hints at something mysterious within. The seventeenth century map on the cover, glowing green and only partially visible from the front, disrupts the geographic orientation a map might be expected to provide. The seeming clarity of the title, author, and translator, is likewise unsettled by their placement, suspended above the surrounding white expanse. Yet this trace of (...) eeriness is easily dispelled by the physical book’s assertion of scholarly credentials. “Michigan,” the name of the university press publisher, prominent on the spine and back, also announces itself on the front cover, and the text on the back declares the book an aesthetic and political—but not sacred—project, with three blurbs praising the translator’s achievement and the author’s brilliance. The Library of Congress cataloguing information on the copyright page tells us that Poetics of Relation, Glissant’s third monograph, is first and foremost about his birthplace (Martinique--civilization, language, culture, nationalism, and literature of). Secondarily, according to the cataloguers, it is a book about the French connection (“6. Martinique—Dependency on France. 7. West Indies, French—Relations—France. 8. France—Relations—West Indies.”). Scholarly interpretations of Poetics of Relation are of course more expansive and exploratory than cataloguing’s brevity allows. Still, most who write about this strange and beautiful text focus on poetics and politics, with very few lingering over Glissant’s own claims about the importance of the sacred. (shrink)

They havebeen defined by Tessa Jowell, UK GovernmentHealth Minister, as an area ``where people donot have easy access to healthy, fresh foods,particularly if they are poor and have limitedmobility.'' The above definition is particularlyrelevant in Northern Ireland, where it isestimated that 32% of households do not haveeasy access to a car and it is recognized thatcertain groups in Northern Ireland are amongstthe poorest consumers in the United Kingdom.The phenomenon has been further (...) exacerbated bythe effect of large grocery retailers locatingon the periphery of towns and the subsequentdisplacement effect of independent retailers inthe town center. The resultant effect is suchthat disadvantaged consumers cannot accessfresh, quality, nutritious foods at anaffordable price. Preliminary researchindicates that certain consumer groups areexcluded from equitable shopping provision –possibly to the detriment of their healthstatus. Research methodology includes aconsumer questionnaire, consumer focus groups,interviews, and comparative shopping exercisesthat confirm an inability among vulnerableconsumer groups to achieve an affordable,healthy diet. This was further complicated bynon-car owners' and lower-income family unitsneeding to shop locally and more frequentlythan their higher-income, car-ownercounterparts. This was demonstrated with theuse of shopping diaries. Future research to beconducted includes a large-scale survey acrossNorthern Ireland to ascertain accessibility,availability, and affordability of qualityfresh foods and to distinguish the consumergroups who are most vulnerable. Epistemic modality concerns what is possible given a body of knowledge or evidence. Cases involving epistemic modals, present an interesting semantic challenge: in order to give a semantic treatment of epistemic modals, we must explain how informational states figure in the semantic representation of these terms. According to John MacFarlane’s (2011, 2014) view – Assessor Relativism – epistemic modal claims are assessment-sensitive in that their truth depends on what is known by the assessor at the time he or she assesses (...) the claim. Hence, truth for epistemic modal claims varies with the context of assessment. Critics of MacFarlane’s approach, such as Anthony Gillies and Kai von Fintel (2008) point to so called “ignorant assessor cases,” ones in which the assessor knows less than the speaker. They claim that such cases pose a serious problem for Assessment Relativism. I argue, however, that these cases do not uncover a flaw in the assessment relativist’s semantics. The apparent problems only seem to arise because the authors have not given adequate attention to the epistemic details of the cases. In making my argument, I present a larger methodological point about the role of epistemic data in semantic theory construction. I claim that, it is often difficult to distinguish the boundary between semantics and epistemology when discussing epistemic modals. As a result, linguists and philosophers of language sometimes fail distinguish between epistemic intuitions that are directly relevant to the semantics and those that are indirectly relevant. I conclude that we do not have to complicate the semantics of epistemic modals in order to accommodate epistemic data such as intuitions about epistemic warrant. (shrink)

Virtue-based approaches to engineering ethics have recently received considerable attention within the field of engineering education. Proponents of virtue ethics in engineering argue that the approach is practically and pedagogically superior to traditional approaches to engineering ethics, including the study of professional codes of ethics and normative theories of behavior. This paper argues that a virtue-based approach, as interpreted in the current literature, is neither practically or pedagogically effective for a significant subpopulation within engineering: engineers with high functioning autism spectrum (...) disorder. Because the main argument for adopting a character-based approach is that it could be more successfully applied to engineering than traditional rule-based or algorithmic ethical approaches, this oversight is problematic for the proponents of the virtue-based view. Furthermore, without addressing these concerns, the wide adoption of a virtue-based approach to engineering ethics has the potential to isolate individuals with ASD and to devalue their contributions to moral practice. In the end, this paper gestures towards a way of incorporating important insights from virtue ethics in engineering that would be more inclusive of those with ASD. (shrink)

In this paper I seek to distinguish a feminist virtue ethics of care from (1) justice ethics, (2) narrative ethics, (3) care ethics and (4) virtue ethics. I also connect this contemporary discussion of what makes a virtue ethics of care feminist to eighteenth and nineteenth century debates about male, female, and human virtue. I conclude that by focusing on issues related to gender - primarily those related to the systems, structures, and ideologies that create and sustain patterns of male (...) domination and female subordination - we can begin to appreciate that true care and bona-fide virtue can flourish only in societies that treat all persons with equal respect and consideration. The outcomes of psychoanalysis, as with other psychotherapies, vary considerably. _Psychoanalytic Treatment in Adults _examines the results of a longitudinal study of change during psychoanalysis, illuminating the characteristics of patients, analysts and analyses which can help to predict outcomes of treatment. Written by experienced psychologists and psychoanalysts, chapters in the book draw upon sixty case studies to consider how patients with very different analytic outcomes respond at both the beginning and end of their analysis. Psychoanalysts used a clinician report measure, (...) the Shedler-Westen Assessment Procedure, to describe a patient at the beginning of psychoanalysis and every six months until the analysis ended. This allowed the authors to learn about changes over analysis and, in turn, improved treatment planning and practice for the well-being of other patients. Chapters explore five outcomes: a negative therapeutic reaction; attrition when the patient drops out; attrition due to external events; mutual agreement between patient and analyst without maximum benefits; and mutual agreement between patient and analyst with maximum benefits. The findings from these chapters will be of interest to researchers and academics in the fields of psychoanalysis, psychotherapy, psychodynamic therapy, psychoanalytic education, psychiatry and psychology. The results should also help clinicians recognize potential problems early in analytic treatments so that they can work more effectively with patients. (shrink)

Differentiating self from other has been investigated at the neural level, and its incorporation into the model proposed Hurley is necessary for the model to be complete. With an emphasis on the feed-forward model in layer 2, we examine the role that self and other disruptions, including auditory verbal hallucinations (AVHs), may have in expanding the model proposed by Hurley.

The ratio-bias (RB) phenomenon refers to the perceived likelihood of a low-probability event as greater when it is presented in the form of larger (e.g. 10-in-100) rather than smaller (e.g. 1-in-10) numbers. According to cognitive-experiential self-theory (CEST), the RB effect in a game of chance in a win condition, in which drawing a red jellybean is rewarded, can be accounted for by two facets of concrete thinking, the greater comprehension (at the intuitive-experiential level) of single numbers than of ratios, and (...) of smaller than of larger numbers. In a lose condition, in which drawing a red jellybean is punished, the assumption of a third facet of concrete thinking, the ''affirmative-representation principle'', is necessary, as many participants reverse their focus of attention from the undesirable red to the desirable white jellybeans. Results supported the CEST explanation of the RB effect by demonstrating a predicted negative linear relation between the magnitude of the RB effect and the magnitude of the probability-ratios in the win condition and a positive linear relation in the lose condition. Background Community engagement models have provided much needed guidance for researchers to conceptualise and design engagement strategies for research projects. Most of the published strategies, however, still show very limited contribution of the community to the engagement process. One way of achieving this is to document experiences of community members in the CE processes during project implementation. The aim of our study was to explore the experiences of two research naïve communities, regarding a CE strategy collaboratively developed by researchers and (...) study communities in a multicountry study. Methods The study was carried out in two research naïve communities; Gwanda, Zimbabwe and uMkhanyakude, South Africa. The multicentre study was a community based participatory ecohealth multicentre study. A qualitative case study approach was used to explore the CE strategy. Data was collected through Focus Group Discussions, Key Informant Interviews and Direct Observations. Data presented in this paper was collected at three stages of the community engagement process; soon after community entry, soon after sensitisation and during study implementation. Data was analysed through thematic analysis. Results The communities generally had positive experiences of the CE process. They felt that the continuous solicitation of their advice and preferences enabled them to significantly contribute to shaping the engagement process. Communities also perceived the CE process as having been flexible, and that the researchers had presented an open forum for sharing responsibilities in all decision making processes of the engagement process. Conclusions This study has demonstrated that research naïve communities can significantly contribute to research processes if they are adequately engaged. The study also showed that if researchers put in maximum effort to demystify the research process, communities become empowered and participate as partners in research. (shrink)

Canada’s Truth and Reconciliation Commission (TRC) is tasked with facing the hundred-year history of Indian Residential Schools. The South African Truth and Reconciliation Commission is frequently invoked in relation to the Canadian TRC, perhaps because this is one of the few TRCs worldwide that Canadians know. Whilst the South African TRC is mainly applauded as an international success, I argue that loose analogizing is often more emotive than concise. Whilst much indeed can be drawn from the South African experience, it (...) is important to specify the Canada–South Africa analogy. In this article, I do so by focussing on the institutional approach to truth and how this relates to issues of settler/White denial. The South African experience teaches that narrow approaches to truth collude with superficial views of reconciliation that deny continuities of violence. Consequently, I argue that Indigenous–settler reconciliation requires a broad truth that locates residential schools on a continuum of violence, linking extraordinary abuses with structural injustices and historic colonization with lived relationships. Flew' s reservation about my assertion that the Enquiry contains no significant revision of the Treatise conception of geometry as a body of necessary and synthetic knowledge, appears to involve two charges. Firstly, he alleges that I dismiss but offer no substantial argument against his own view that the Enquiry restores (...) pure geometry "to its place alongside the other two elements of the trinity ". Secondly, he thinks that I have committed a serious sin of omission in failing to take into consideration a certain passage in the Enquiry (page 31, section 27) which, in his opinion, constitutes "a quite decisive reason" for supposing that Hume abandoned the Treatise position, in that it contains an account of applied mathematics, a subject on which the Treatise is silent. To the charge of omission I plead guilty, and I shall presently seek to remedy this defect and to state why I do not share Flew' s view of the significance of the said passage. To the former charge I am not so ready to plead guilty, and I shall counter-charge that Flew has failed not only to do justice to my proposed reading of Enquiry page 25, section 20, but also to provide clear and convincing support for his own. One difficulty encountered in answering Flew lies in understanding whether or not his claim about the status of geometry as a pure science in the Enquiry is put forward independently of his interpretation of E31. As originally presented in Hume's Philosophy of Belief this appears to be the case, and if so, on what evidence does it rest? 2 In his book, Flew' s statement about Hume replacing pure geometry alongside arithmetic and algebra follows directly upon a paragraph in which he comments that Hume's references to geometrical propositions at E25 signify "an important advance from the position of the Treatise". For whereas the status of perfect precision and certainty was 67. there withheld from geometry (T71), Hume now speaks of the certainty and evidence of the propositions of Euclidean geometry, and declares such propositions to be discoverable by the mere operation of thought, without dependence on what is anywhere existent in the universe. (E25) Now, I argued at some length in my paper (pp. 21-24) that Hume is prepared to grant scientific status to geometry in the Enquiry because he has come to regard its certainty as that proper to a mathematics of space. He has abandoned the Treatise contrast between an ideal or theoretical standard of equality, viewed therein as necessary to geometry considered as a science proper, and the merely sensible standard of equality upon which geometry as practised depends. It should not be forgotten that Hume recognises two kinds of certainty where "Relations of Ideas" are concerned, intuitive and demonstrative. Since he fails to provide any detail of the place of each of these in mathematics, the door is left open for speculation along the lines followed in pp. 28-29 of my paper. For there is nothing in?25 which implies that the certainty of all geometrical propositions is of the same kind, or that the process of geometrical demonstration is of the same logical nature as demonstrative reasoning in arithmetic and algebra. In his comment on my position Flew makes no reference to my proposed reason why Hume classes geometry as a science in the Enquiry.· Yet, even if this reclassification does mark an advance of a kind, the fact remains that E25 does not furnish incontrovertible evidence for that advance which Flew thinks he finds there. Nor, therefore, is it conclusive against my assertion that Hume in both works regards the propositions of geometry as necessary and synthetic truths. Given that Flew does not wish to deny the inclusion of a synthetic element even in the Enquiry account of mathematics (see H. P. B. pp. 64-66), I find it difficult to see why he supposes that the logical status of the propositions of geometry is different in the Enquiry from that in the Treatise, since in the latter too they are held 68. to be truths which depend... Husserl envisages transcendental phenomenology as a radically founding science that lays bare the higher-order experiences whereby logic and a theory of science become constituted. On the other hand, according to a usual presentation of Hegel’s philosophy, phenomenology is “logic’s precondition,” and science presents itself as its “result.” This alleged precedence of Hegel’s phenomenology (with its experiential and historical horizons) regarding logic may be a motif behind the current affinities recently traced between Hegelian and Husserlian notions of phenomenology that highlight their (...) views on experience, history, and the lifeworld. This paper offers instead a reconsideration of aspects of their philosophies mostly challenged or dismissed since the rise of positivism: a reappraisal of their views on the relationship between phenomenology, logic, and philosophy as an “absolute” system of sciences. The argument is made that the irreconcilable difference between their projects ultimately stands on the radical contrast between Hegel’s speculative-conceptual method and system of sciences and Husserl’s foundational science and method as experiential-phenomenological all the way through. Despite this methodological abyss, this paper vindicates their affinities in their refusal to segregate science from life, and their attempts to overcome modernity’s inherited fragmentation of culture by providing an all-unifying approach to philosophy. Cost-benefit analysis is commonly understood to be intimately connected with utilitarianism and incompatible with other moral theories, particularly those that focus on deontological concepts such as rights. We reject this claim and argue that cost-benefit analysis can take moral rights as well as other non-utilitarian moral considerations into account in a systematic manner. We discuss three ways of doing this, and claim that two of them (output filters and input filters) can account for a wide range of rights-based moral theories, (...) including the absolute notions of moral rights proposed by Hayek, Mayo, Nozick, and Shue. We also discuss whether the use of output filters and input filters can be generalized to cover other non-utilitarian theories, such as Kantian duty ethics and virtue ethics. (shrink)

In this article, I explain what makes a global bioethics “feminist” and why I think this development makes a better bioethics. Before defending this assertion explicitly, I engage in some preliminary work. First, I attempt to define global bioethics, showing why the so-called feminist sameness-difference debate [are men and women fundamentally the same or fundamentally different?] is of relevance to this attempt. I then discuss the difference between rights-based feminist approaches to global bioethics and care-based feminist approaches to global bioethics. (...) Next, I agree with a significant number of feminist bioethicists that care is a more fundamental moral value and practice than justice. This is the craft of the author of Luke's Gospel and the Acts of the Apostle to engage the hearer in the narrative he constructs: in Acts, the birth and mission of the church is a story in which the audience have a role. According to Acts, Paul followed a vision, a call from a certain Macedonian to 'Come (...) over to Macedonia and help us'. What would he have expected to find as he set out on a sea voyage from Asia to Macedonia, the home of Alexander the Great? Paul's landing is commemorated on a wall mosaic with ancient stone bollards and pillars slightly inland from the current promenade where the fishing boats line up around the bay. Paul's embarkation on this journey has all the hallmarks of mission. His journey will take him to Philippi and beyond. The focus here is particularly on his encounter with Lydia and the flourishing of this mission in a distinct and different place with new opportunities for the development and growth of leadership and community. In particular I will concentrate on the insights of this narrative for the engagement with new frontiers in our present day. (shrink)

In criminal trials with a jury, judges have many opportunities to engage in adjudicative fact-finding before the jury retires. English law has no conceptual framework for examining this judicial fact-finding which encompasses two categories of collateral fact (preliminary and underlying fact) and foreign law. A third category of collateral fact (conditional fact) is decided by the jury. The article examines the nature of judicial fact-finding and the history and rationale for this allocation of fact-finding responsibility between judge and jury.

Four experiments investigated uncertainty about a premise in a deductive argument as a function of the expertise of the speaker and of the conversational context. The procedure mimicked everyday reasoning in that participants were not told that the premises were to be treated as certain. The results showed that the perceived likelihood of a conclusion was greater when the major or the minor premise was uttered by an expert rather than a novice (Experiment 1). The results also showed that uncertainty (...) about the conclusion was higher when the major premise was uttered by a novice and an alternative premise by an expert, compared to when the major premise was uttered by an expert and the alternative by a novice (Experiment 2). Similarly, the believability of a conclusion was considerably lower when the minor premise was uttered by a novice and denied by an expert, as opposed to when an expert uttered the minor premise and a novice denied it (Experiment 3). Experiment 4 showed that the nature of the uncertainty induced by a denial of the minor premise depended on whether or not the context was a conversation. These results pose difficult problems for current theories of reasoning, as current theories are based on the results of experiments in which the premises are treated as certain. Our discussion of the results emphasises the importance of pragmatics in reasoning, namely, the role of general knowledge about the world in assessing the probability of a premise uttered by an expert or a novice and the role of interpretations of the premise based on pragmatic inferences in revising these initial probabilities. L’article met en lumière la persistance du système de valeurs au cœur de la ségrégation des personnes handicapées et la manière dont il oriente/alimente le droit international. Analysant les réponses institutionnelles au handicap, il montre en quoi les droits humains contemporains offrent un cadre propice au changement social et au processus de désinstitutionnalisation. Dans un premier temps, l’auteure montre qu’une conception du handicap fondée sur le modèle médical fait de la validité/capacité la norme sociale. L’article se penche ensuite sur la (...) Convention relative aux droits des personnes handicapées et le modèle de handicap fondé sur les droits humains, qui est fondamental pour sa mise en œuvre. Il décrit l’interprétation systématique et holistique de la CDPH par le Comité des droits des personnes handicapées concernant l’institutionnalisation des personnes handicapées et montre comment l’article 19 de la Convention – Vivre de manière indépendante et être inclus dans la communauté – doit être compris en relation avec d’autres éléments constitutifs de la Convention. Enfin, le document montre comment et pourquoi l’institutionnalisation des personnes handicapées constitue une ségrégation et un déni fondamental des droits humains. (shrink)

Ghana, like many African countries, continues to grapple with domestic violence issues. Ghana's 1992 Constitution mandates provisions that should eradicate the scourge of violence against women and children. In this paper, two main questions are asked. First, will the 1992 Constitution ultimately lead to victories over discrimination and violence against Ghanaian women? Second, has progress been made in eradicating violence against women in Ghana to date? In that regard, have governmental and non-governmental organizations supported Ghanaian women to arrive at relative (...) stability, empowerment and freedom from violence? Progress thus far is encouraging. Presently, there are several holistic or organic approaches being used to combat domestic violence in Ghana. however, an epidemiological examination of custom and a psychosocial approach towards domestic violence may facilitate permanent meaningful solutions. This paper examines what managers ought to do when confronted with apparent moral conflicts between their managerial responsibilities and the general requirements of morality, specifically when those conflicts are driven by the institutional environment. I examine Google’s decision to enter the Chinese search engine market as an example of such a conflict. I consider the view that Google’s managers engaged in justifiable moral compromise in making the choice to engage in self-censorship and show how this view depends on the idea (...) of genuine moral dilemmas or irresolvable moral conflicts. I argue that there are serious reasons to doubt the existence of genuine moral dilemmas both in the abstract, as well as in the context of managerial responsibility. I propose an alternative account for what Google’s managers ought to do, as well as others who face relevantly similar situations. The account contains two conditions for permissibly contributing to another party’s failure to live up to their moral responsibilities. The first condition is that the manager must intend and act in such a way as to minimize the firm’s complicity in the other entity or actor’s failure, which in most cases will imply a duty for the manager to take actions that aim towards changing the institutional context. Under the second condition, managers ought to communicate to the firm’s constituents that they take seriously the importance of the interests at stake. (shrink)

ABSTRACTBusiness actors often act in ways that may harm other parties. While the law aims to restrict harmful behavior and to provide remedies, legal systems do not anticipate all contingencies and legal regulations are not always well-enforced. This article argues that the logic of double effect, which has been developed and deployed in other areas of practical ethics, can be useful in helping business actors decide whether or not to pursue potentially harmful activities in commonplace business activity. The article illustrates (...) how LDE helps to explain the exploitative nature of payday lending, the distinction between permissible and impermissible forms of market competition, and the potential wrong of imposing risk of harm on others. The article also addresses foundational debates about LDE itself. We offer the article as an illustration of the sort of “midlevel” theorizing that can address directly the needs of practitioners.
