One explanation that may be given for why nonprofit organizations pay lower wages than do other organizations is that nonprofits are more pleasant places to work. Indeed, some authors have proposed that nonprofit organizations should make an effort to promote a working environment that reflects the beliefs of the organization. This paper uses several proxies for whether an organization is a pleasant place in which to work, and tests for whether nonprofits are more likely to offer such pleasant working conditions. (...) The American Medical Association enacted its Code of Ethics in 1847, the first such national codification. In this volume, a distinguished group of experts from the fields of medicine, bioethics, and history of medicine reflect on the development of medical ethics in the United States, using historical analyses as a springboard for discussions of the problems of the present, including what the editors call "a sense of moral crisis precipitated by the shift from a system of fee-for-service medicine to a (...) system of fee-for-system medicine, better known as 'managed care.'" According to Perdurantism, persons are identical to maximal aggregates of appropriately interrelated temporal parts. Within the Perdurantist framework, an epistemic concern arises, targeting the perduring persons’ belief that they are persons, suggesting that, ultimately, they are not in a position to know that they are persons as opposed to temporal parts. Despite the consideration it has received over the years, this concern has not yet been converted into a full-fledged objection. This paper aims to address this gap by exploring the (...) possibility of formulating a coherent Epistemic Objection against Perdurantism. We shall examine several epistemological principles around which such an objection might be built, arguing that none of them, in the end, allows a plausible formulation of the objection. As a result, we shall conclude that the burden of proving that in a Perdurantist setting persons are not in a position to know that they are persons rests with the objectors. (shrink)

Machine learning (ML) has been praised as a tool that can advance science and knowledge in radical ways. However, it is not clear exactly how radical are the novelties that ML generates. In this article, I argue that this question can only be answered contextually, because outputs generated by ML have to be evaluated on the basis of the theory of the science to which ML is applied. In particular, I analyze the problem of novelty of ML outputs in the (...) context of molecular biology. In order to do this, I first clarify the nature of the models generated by ML. Next, I distinguish three ways in which a model can be novel (from the weakest to the strongest). Third, I dissect the way ML algorithms work and generate models in molecular biology and genomics. On these bases, I argue that ML is either a tool to identify instances of knowledge already present and codified, or to generate models that are novel in a weak sense. The notable contribution of ML to scientific discovery in the context of biology is that it can aid humans in overcoming potential bias by exploring more systematically the space of possible hypotheses implied by a theory. Es ermöglicht eine phänomenologische Auslegung des allgemein-metaphysischen Problems, wie physische, mentale und soziale Tatsachen zusammenhängen. Das Buch diskutiert und interpretiert detailliert einige von Husserls zentralen Konzeptionen und zeigt die Konsequenzen seines Denkansatzes und seiner Theorieentwicklung. Natur und Gemeingeist sind Husserl zufolge die Grundbegriffe der naturalistischen und der personalistischen Einstellungen und dienen als Leitfaden der Unterscheidung zwischen (...) Natur- und Geisteswissenschaften. In der kritischen Auseinandersetzung mit diesem wissenschaftstheoretischen Dualismus führt Husserl den Habitus-Begriff methodisch ein, um das Verhältnis von Natur- und Sozialontologie aus der konkreten Erfahrung heraus phänomenologisch neu zu deuten, womit der spätere, anti-dualistische Weg der Lebensweltphänomenologie vorbereitet wird. Dieser ontologischen Position entspricht auch Husserls sozialepistemologische Ansicht, dass sich Wissenschaften erst im Rahmen idealisierter Sozialstrukturen entfalten können. Durch diese idealisierenden Operationen wird die Konstitution der Objektivität möglich, welche die Wissenschaften anstreben. This paper aims to contribute to the present debate about business ethics and Corporate Social Responsibility (CSR) that the Journal of Business Ethics is hosting. Numerous contributions argued theoretical frameworks and taxonomies of CSR practices. The authors want to ground in this knowledge and provide further evidence about how companies adopt CSR practices to address stakeholders’ claims and consolidate their trust. Evidence was provided by a longitudinal case study about an Italian food company that is one of the largest producers (...) of baby food. This company reshaped its corporate strategy along three decades through the adoption of CSR practices in order to win stakeholders’ trust about food safety and supply chain behaviour. The empirical exercise was informed by a literature review of the relevant contributions in terms of CSR business practices and levels of efforts to adopt them. In light of this review, the authors adopted for the research framework the taxonomy of business practices proposed by Spiller (2000, “Ethical Business and Investment: A Model for Business and Society”, Journal of Business Ethics 27, 149-160) and the levels of commitment towards CSR proposed by Stahl and Grigsby (1997, Strategic Management; Total Quality & Global Competition (Blackwell, Oxford)). This article offers the critical concept misfit in an effort to further think through the lived identity and experience of disability as it is situated in place and time. The idea of a misfit and the situation of misfitting that I offer here elaborate a materialist feminist understanding of disability by extending a consideration of how the particularities of embodiment interact with the environment in its broadest sense, to include both its spatial and temporal aspects. The interrelated dynamics of fitting (...) and misfitting constitute a particular aspect of world-making involved in material-discursive becoming. The essay makes three arguments: the concept of misfit emphasizes the particularity of varying lived embodiments and avoids a theoretical generic disabled body; the concept of misfit clarifies the current feminist critical conversation about universal vulnerability and dependence; the concept of misfitting as a shifting spatial and perpetually temporal relationship confers agency and value on disabled subjects. Rooftop gardens, rooftop greenhouses and indoor farms have been established or planned by activists and private companies in Berlin. These projects promise to produce a range of goods that could have positive impacts on the urban setting but also carry a number of risks and uncertainties. In this early innovation phase, the relevant stakeholders’ perceptions and social acceptance of ZFarming represent important preconditions for success or failure of the further diffusion of this practice. We used the framework of acceptance to (...) investigate the stakeholders’ attitudes and to identify the key factors that might hinder or promote the introduction of ZFarming. The results are based on an analysis of 38 qualitative interviews conducted with key stakeholders in Berlin. As the results show, major perceived benefits of ZFarming include improved consumer awareness, education, and the creation of experimental spaces. Stakeholders further perceive opportunities for resource savings, new business models, repurposing of abandoned buildings and improved aesthetics. Major perceived risks are associated with growing techniques that are considered “unnatural”, health risks, conflicts with images of traditional agriculture, the rejection of animal production in urban areas, the risk of projects being too expensive and too complex or being implemented too early, i.e. before the mechanisms are fully understood. The analysis further reveals which contextual factors—political, legal, market-related, spatial or societal—might negatively or positively influence ZFarming acceptance. (shrink)

In this paper we show how some reasoning, though fallacious, can appear to be attractive and useful for beings-like-us. Although they do not provide conclusive evidence to support or reject a certain claim the way scientific statements do, they tell us something interesting about how humans build up their arguments and reasons. First of all, we will consider and investigate three main types of fallacies: argumentum ad hominem, argumentum ad verecundiam, and argumentum ad populum. These three fallacies are traditionally considered (...) as examples of a broader category called ignoratio elenchi. Secondly, we show how people who commit these fallacies rely on information about other human beings in their reasoning. That is, they do not follow certain logical procedures that eventually lead them to correct conclusions. But they simply make use of others as social characters. For example, being an authority, being an expert, being part of a class, etc., become the substitutes for more direct evidence to support a certain claim or to make an argument more appealing. The applications of machine learning and deep learning to the natural sciences has fostered the idea that the automated nature of algorithmic analysis will gradually dispense human beings from scientific work. In this paper, I will show that this view is problematic, at least when ML is applied to biology. In particular, I will claim that ML is not independent of human beings and cannot form the basis of automated science. Computer scientists conceive their work as being a case of (...) Aristotle’s poiesis perfected by techne, which can be reduced to a number of straightforward rules and technical knowledge. I will show a number of concrete cases where at each level of computational analysis, more is required to ML than just poiesis and techne, and that the work of ML practitioners in biology needs also the cultivation of something analogous to phronesis, which cannot be automated. But even if we knew how to frame phronesis into rules, still this virtue is deeply entrenched in our biological constitution, which computers lack. Whether computers can fully perform scientific practice independently of humans is an ill-posed question. (shrink)

In this paper, I seek to examine Deleuze’s fascination with “spiritual automata” as a counterpoint to his more famous notion, the “body without organs”. I shall argue that both are grounded in a deep reflection, on Deleuze’s part, on the problems and issues generated by Spinoza’s notion of parallel attributes. Ultimately, I argue, the development of the two notions is motivated by identical metaphysical worries regarding the tenability of transformation, persistence, and affective interrelations between individuals. The answer, for both thinkers, (...) is the insertion of a “third” relational term, which virtually interfaces with each without violation of their parallel development. For Spinoza, such term is the absolutely infinite substance; for Deleuze, it is instead the notion of sense and the faculty of sense-making. (shrink)

This chapter describes the process of institutionalization of natural law at the University of Pisa, essential to interpreting the conditions in which the first public law chair of Italy was founded. The study of legal education in the late seventeenth and early eighteenth century will allow a more in-depth understanding of both the development of natural law in teaching practice throughout the long eighteenth century, and the features of the two processes of reception, respectively for educational and political purposes. In (...) fact, although both processes were founded on appreciation of the centrality of Roman law and philosophy in the construction of doctrines by the so-called ‘modern natural law school’, and developed through mediation of traditional Roman legal culture of the Pisan ‘historical-critical school’, there were some differences. This article aims to examine sociality’s multipolar and intentional structure beyond an inter-subjectivist perspective; beyond the view that the social world consists of only subjects and their interaction. The article is divided into four sections. First, I present Benoist’s critique of mainstream inter-subjectivist accounts of phenomenology. Second, I introduce Husserl’s concept of Gemeingeist and provide a preliminary definition of it as a “substrate of habits.” Third, I focus on the sociological and ontological sources of Benoist’s critique, specifically Descombes’ reassessment of (...) Hartmann’s distinction between objective and objectified mind. Finally, I revise my preliminary Husserlian definition of “common mind” drawing both from the distinction between objective and objectified mind and Benoist’s account of habituation as a two-sided correlative phenomenon. Although he often tends to phrase his account in intersubjectivist terms, Husserl’s phenomenology offers valuable tools to address the multipolar structure of sociality, which does not only consist of subjects in their interactions, but foremost, in the way the human mind is embedded in institutions and extended in a range of objects that bear social meaning and that guide and bind human life to an extent that is unique among social animals. This paper investigates the determinants of regulatory compliance in corporate organizations. Exploiting a unique enforcement and reporting framework for insider trading in Italy, we present three main findings. First, board governance, such as chief executive–chairman duality and the proportion of non-executive directors, does not increase the propensity of firms to comply with regulation. Second, family firms and firms with a high degree of separation of ownership from control are most likely to comply with regulation. Edith Stein claims that communal experiences are not reducible to the collection of individual experiences directed to the same object or upon the same content. Based on this intuition she gives a phenomenological description of the intentional structure that is proper to communal experiences regarding to their content, mode, and subject. While expanding on her attempts to reassess Husserl’s description of intentionality in an original social-ontological framework, I will stress her precious distinction between individual consciousness and communal stream of experience. I will argue that, if Stein defines the being of the community through its the communal stream of experience, the latter has to be interpreted through Husserl’s teleological concept of ideal multiplicity of experiences. Discussing Stein’s account both against the background of the methodology of Edmund Husserl’s phenomenology and contextualizing it within the social-ontological struggle that took place in Germany during the Great War, I will focus on her description of we-intentionality and aim to unearth its phenomenological core as well as its methodological limits. Today, a consistent part of our everyday interaction with art and aesthetic artefacts occurs through digital media, and our preferences and choices are systematically tracked and analyzed by algorithms in ways that are far from transparent. Our consumption is constantly documented, and then, we are fed back through tailored information. We are therefore witnessing the emergence of a complex interrelation between our aesthetic choices, their digital elaboration, and also the production of content and the dynamics of creative processes. All are (...) involved in a process of mutual influences, and are partially determined by the invisible guiding hand of algorithms. -/- With regard to this topic, this paper will introduce some key issues concerning the role of algorithms in aesthetic domains, such as taste detection and formation, cultural consumption and production, and showing how aesthetics can contribute to the ongoing debate about the impact of today’s “algorithmic culture”. Spinoza's writing style has been judged, by various commentators, alternatively as excessively dry or lavishly rich, depending on the precise text that these scholars had in mind when making such judgments. This chapter offers an overview of a selected list of Scholastic debates intersecting the CM. It highlights how Spinoza consciously intervenes in them, showing a certain awareness of the intricacies of Scholastic discourse. Spinoza opens the CM with a discussion of the term “being,” claiming that “being is badly divided (...) into real being and being of reason”. The chapter focuses on how Spinoza can be interpreted as responding to the canonical thought of Francisco Suárez, since the Leiden Scholastics interacted especially with the Escuela de Salamanca. One of Spinoza's main piéces de résistance is the doctrine of the inseparability between the will and intellect of God. Spinoza has a much stronger thesis regarding the “external” identity of God's intellect, power, and will. (shrink)

In this paper, I offer an analysis of the thought experiment “Two worlds for one ego” in which Husserl imagines an ego that lives two alternated lives. The thought experiment is designed to question the apodicticity of the world’s singularity. If the ego of the thought experiment is a fully concrete social subject, then the world’s singularity proves to be apodictic. If we were to, conversely, conduct the same experiment with an abstract ego, then the counter‑scenario of a doubling of (...) the world would be tenable if and only if this subject was the sole subject of both worlds. This means, in turn, that a more concrete phenomenological conduction of the experiment demonstrates the limits of methodological solipsism. The paper is tripartite. Firstly, I set out the experiment’s terminological terrain and discuss the systematic questions addressed as well as the phenomenological methods involved. In a second step, I analyse Husserl’s conduction of the thought experiment. Finally, I discuss some of the experiment’s possible applications to anthropology. (shrink)

In this paper, I contend that the core intuition that resides at the basis of Scheler’s metaethics is expressed through the formal axiological distinction between things, goods, and values. I pursue a twofold aim: 1) to show that Scheler implicitly operates within Husserl’s concept of ‘unitary foundation’ when describing how values inhere within goods; 2) to compare Scheler’s metaethical argument concerning the independence of a world of goods with Hare’s ‘indiscernibility argument’. Scheler’s reversal of Hare’s argument confronts us with the (...) formal-ontological difference between the analytic account of supervenience and the phenomenological account of unitary foundation. My argument is based on the formalization of the second type of unitary foundation that Husserl outlines in his Third Logical Investigation. The second type of unitary foundation is usually conflated with the first type of unitary foundation, as a result of the gross mistakes found in Findlay’s English. (shrink)

While most chapters concern Platonists (Philo, Plutarch, Plotinus, Syrianus, Proclus, Damascius, Philoponus), and their uses or criticism of Aristotle's doctrines, several chapters are also devoted to Peripatetic authors (Boethius and mostly Alexander of Aphrodisias) and their attitudes towards Plato's positions. In the last decade, Systems Biology has emerged as a conceptual and explanatory alternative to reductionist-based approaches in molecular biology. However, the foundations of this new discipline need to be fleshed out more carefully. In this paper, we claim that a relational ontology is a necessary tool to ground both the conceptual and explanatory aspects of Systems Biology. A relational ontology holds that relations are prior—both conceptually and explanatory—to entities, and that in the biological realm entities are defined primarily by (...) the context they are embedded within—and hence by the web of relations they are part of. Hegel’s concern for determinism induced some scholars to interpret his practical philosophy as a form of determinism or as a form of compatibilism. Against both interpretations I will show some historical features of determinism at the edge of XVIII Century aiming to explain Hegel’s concept of determinism. I will pay a special attention to the debate between Ulrich and Kant’s criticism as well as to the peculiar development of kantian presuppositions in Fries’ philosophy. I will illustrate how this debate influenced (...) Hegel’s definition of arbitrariness (Willkür) and how important it could be to understand his distinction between freedom of choice and free will. The smartphone can be considered a great example of how technology provides us with information at our fingertips anytime, anywhere. However, we have been operating mostly in the dark without a clear understanding of what our mobile devices have to offer and how people arrive at creative re-use as part of a problem-solving activity. This paper is an attempt to reach a better understanding of the conditions in which creative re-use of smartphones may take place. Our main goal is to (...) theoretically explore the role that the context of one’s activity may have in supporting creative re-use. We argue that the smartphone in itself cannot be separated from its cognitive ecology, but it is precisely the way in which it becomes permeable in the context that affords us to potentially come up with new uses and in doing so improve our ability to solve problems. Hegel’s dispute with Schleiermacher in Berlin had as its premise his reception of Schleiermacher’s Reden über die Religion. My intention is to clarify the history of this reception by arguing that Hegel’s Frankfurt early writings already contain clues as to his reading of Schleiermacher’s work. Differently from previous interpretations, however, I will not support the hypothesis that, during his Frankfurt period, Hegel was influenced by Schleiermacher’s foundations of religion. My contention is that, from the very beginning, Hegel opposed Schleiermacher’s concepts (...) of positivity and polemics as specific features of the Christian religion. This view is confirmed if we analyze the works that Hegel wrote in the Jena period, such as Differenz des Fichte’schen und Schelling’schen Systems der Philosophie, Glauben und Wissen and Phänomenologie des Geistes. My aim is to demonstrate that these works typify Schleiermacher’s approach to the Christian religion, and in so doing, to confute the idea that Hegel’s view on the above-mentioned approach changed over the years. A final aspect that I consider is the enduring nature of Hegel’s conception of the significance of the Reden – an aspect that emerges on analyzing some crucial sentences in the Grundlinien der Philosophie des Rechts. One might well wonder about the source of Girard’s knowledge. Where is it thought to have come from in the first place? From what vantage point are we supposed to be surveying the events he claims are originary? And what, then, is the condition for the very possibility of his Christian wisdom? In this paper, I argue that we can put forward a tentative solution by looking at one particular aspect of all the texts that Girard has interpreted: they are (...) all written texts. Analyzing this in detail with the assistance of the proposals of Bernard Stiegler, I will claim that it is writing itself that has afforded us the possibility of paying attention. Moreover, in the second section, I shall also put forward an analysis of the gnoseological condition of the possibility of Christian wisdom. To do so, I expand on Stiegler’s reading of Kant’s notion of schema focusing on its relation with the hermeneutical notion of figura, as presented by Erich Auerbach. Commenting on the common rhetorical setting of both the Critique of Pure Reason and the Bible, I then show that these two written texts address a very similar problem—a critique of the way people judge—and also put forward, surprisingly, much the same solution: to properly judge, it would be better to take into account past examples of judgments and consider that, no matter whether we critique them or not, they will schematize our own experiences and influence our intentionality. It is commonly believed that disability disqualifies people from full participation in or recognition by society. This view is rooted in eugenic logic, which tells us that our world would be a better place if disability could be eliminated. In opposition to this position, I argue that that disability is inherent in the human condition and consider the bioethical question of why we might want to conserve rather than eliminate disability from our shared world. To do so, I draw together (...) an eclectic, rather than systematic, configuration of counter-eugenic arguments for conserving disability. The idea of preserving intact, keeping alive, and even encouraging to flourish denoted by conserve suggests that disabilities would be better understood as benefits rather than deficits. I present, then, a reading of disability as a potentially generative resource rather than unequivocally restrictive liability. In other words, what I consider here is the cultural and material contributions disability offers to the world. (shrink)

Anhand bündig präsentierter Grundbegriffe und Verfahren konturiert das Handbuch die Spezifik der phänomenologischen Methode, spart dabei jedoch nicht die Kontroversen und methodologischen Neuausrichtungen aus, die von ihrer Lebendigkeit und Vielstimmigkeit zeugen. Ein umfangreicher Schlussteil ist der Rezeption und Anwendung in einzelnen Wirkfeldern gewidmet. Als Hilfsmittel zur eigenständigen Erschließung der phänomenologischen Denkrichtung und zu ihrer Anwendung auf aktuelle Probleme zeichnet sich das Handbuch durch seine Leser:innenfreundlichkeit und einen stark forschungspraktischen Bezug aus. After a brief introduction to the history of the Husserl Archives I focus on the methodological specificities in studying Husserl’s work on the basis of his manuscripts and of his archives. In a second step I expound on the effects that the current shift from an analogous to a hybrid analogous and digital archives is producing in the self-understanding of the practices of our institution. Particularly, developing digital technology means that the Husserl Archives are entering a new phase in respect (...) to how archival and editorial impulses will affect the presentation of Husserl’s writings. Finally, I offer some perspectives about how the planned virtual platform, which will give direct access to his manuscripts, is designed to promote a new understanding of Husserl’s specific process of philosophical writing, of his unique wording of thoughts. Le posizioni degli interlocutori, fermate per iscritto, sono apparse in un fascicolo della rivista 'Contratto e impresa' diretta da Francesco Galgano (2000, pp. 665 sgg.). In the last few years, biologists and computer scientists have claimed that the introduction of data science techniques in molecular biology has changed the characteristics and the aims of typical outputs (i.e. models) of such a discipline. In this paper we will critically examine this claim. First, we identify the received view on models and their aims in molecular biology. Models in molecular biology are mechanistic and explanatory. Next, we identify the scope and aims of data science (machine learning in (...) particular). These lie mainly in the creation of predictive models which performances increase as data set increases. Next, we will identify a tradeoff between predictive and explanatory performances by comparing the features of mechanistic and predictive models. Finally, we show how this a priori analysis of machine learning and mechanistic research applies to actual biological practice. This will be done by analyzing the publications of a consortium—The Cancer Genome Atlas—which stands at the forefront in integrating data science and molecular biology. The result will be that biologists have to deal with the tradeoff between explaining and predicting that we have identified, and hence the explanatory force of the ‘new’ biology is substantially diminished if compared to the ‘old’ biology. However, this aspect also emphasizes the existence of other research goals which make predictive force independent from explanation. (shrink)

Mises’ and Hayek’s arguments against central economic planning have long been taken as definitive proof that a centrally planned economy managed by the government would be impossible. Today, however, the exponential rise in the capacities of AI has opened up the possibility that supercomputers could have what it takes to plan the national economy. The ‘economic calculation debate’ has thus reignited. Arguably, this is because neither Mises nor Hayek have given a clear and conclusive argument why central planning of the (...) economy is impossible in principle. The paper frames the problem of economic planning as an agent–environment interaction, offering a taxonomy of the different sets of agents at play a) in a market economy and b) in a centrally planned economy equipped with the most sophisticated AI technology. The argument is that public institutions as planning bodies cannot replace the market order, no matter the AI technology behind them, for the elimination of the market entails the elimination of crucial kinds of agents that cannot be recreated or emulated through AI or careful social planning: the proactive action of entrepreneurs driving market allocation. Il Corso su L’ermeneutica del soggetto problematizza un tema che attraversa sottotraccia l’intera riflessione di Foucault, quello della tecnica. L’articolo, proponendo un dialogo fra Foucault, Heidegger e Simondon, prova a rintracciare lo sviluppo di questo tema, chiedendosi inoltre in che modo la tecnica entri in relazione con i processi di assoggettamento e di soggettivazione.

Die 1755 verfasste Schrift Principiorum primorum cognitionis metaphysicae nova dilucidatio enthält eine Bestimmung der Willensfreiheit, die ein konsequentes Ergebnis der relevanten Erneuerung im Rahmen der Ontologie der ersten Philosophie Kants darstellt. Mein Beitrag betrifft insbesondere die in der Schrift geführte Auseinandersetzung mit Crusius, dessen Wertschätzung im Vergleich mit der Wolff’schen Schule Kant nicht daran hindert, zwei Hauptlehren seines Ansatzes zu kritisieren. Erstens sieht Kant eine Beziehung zwischen dem Freiheitsbegriff und dem Satz des zureichenden Grundes vor, die wichtige Elemente der Ethik (...) von Crusius in Frage stellt. Zweitens wendet er sich gegen Crusius’ Theorie der Spontaneität, indem er dessen Verteidigung der Willkürfreiheit als Gleichgültigkeit wie beim Gleichgewicht kritisiert. (shrink)

Stories, in pictorial format, orally narrated, and later on as narrative texts, have played a key role in human evolution and to this day continue to surreptitiously teach us things and skills. In recent decades, psychologists and cognitive scientists have begun documenting the role of stories, and particularly fiction, in refining our sociocognitive skills. In this essay, I focus specifically on how stories, particularly written fiction, hone our emotion recognition skills. I present a brief overview of existing theorizing and research (...) findings, and propose the less-is-more hypothesis, according to which emotion recognition skills are sharpened by stories that do not tell us, but rather show us the emotional life of fictional characters. In its last round of publications in September 2012, the Encyclopedia Of DNA Elements (ENCODE) assigned a biochemical function to most of the human genome, which was taken up by the media as meaning the end of ‘Junk DNA’. This provoked a heated reaction from evolutionary biologists, who among other things claimed that ENCODE adopted a wrong and much too inclusive notion of function, making its dismissal of junk DNA merely rhetorical. We argue that this criticism rests on misunderstandings concerning (...) the nature of the ENCODE project, the relevant notion of function and the claim that most of our genome is junk. We argue that evolutionary accounts of function presuppose functions as ‘causal roles’, and that selection is but a useful proxy for relevant functions, which might well be unsuitable to biomedical research. Taking a closer look at the discovery process in which ENCODE participates, we argue that ENCODE’s strategy of biochemical signatures successfully identified activities of DNA elements with an eye towards causal roles of interest to biomedical research. We argue that ENCODE’s controversial claim of functionality should be interpreted as saying that 80 % of the genome is engaging in relevant biochemical activities and is very likely to have a causal role in phenomena deemed relevant to biomedical research. Finally, we discuss ambiguities in the meaning of junk DNA and in one of the main arguments raised for its prevalence, and we evaluate the impact of ENCODE’s results on the claim that most of our genome is junk. In this paper, I address the issue of what kind of distinction separates the attributes of Spinoza’s substance. I propose to consider the distinction between attributes neither as a real distinction nor as a pure distinction of reason. Instead, I ventilate the alternative of understanding attributes as distinguished by a hybrid distinction, of which I trace the development during the Medieval and Early Modern eras. With the term hybrid, I capture distinctions which are neither a real distinction between substances or (...) real accidents; nor a pure distinction of reason, produced or fabricated by the intellect. I shall argue that Spinoza’s notion of attribute falls under the scope of a hybrid distinction, thus sidestepping the longstanding debate between objectivism and subjectivism. (shrink)
