This article addresses several aspects of interaction between procedural and conflict rule regulation in private international law both of which are subject to unification process under the European Community law. They are interdependent of each other, and use the same or similar terms on many occasions. Problems with interpretation arise in application of these legal regulations. The European Court of Justice addresses them more or less successfully. As demonstrated in this article, the interpretation of procedural rules of regulation (...) may contribute to the clarification of the conflict rules and vice versa. It can be even said that the mutual interaction of conflict rules and procedural rules through interpretation is both unavoidable and desirable. (shrink)

Katelis Viglas’ book: Jeremiah II Tranos. Archbishop of Constantinople, New Rome and Ecumenical Patriarch (1536-1595) is a historical-theological description and analysis of the most important data and facts concerning the life and works of Jeremiah II Tranos, Patriarch of Constantinople in the 16th century. The book consists of a Prologue, which refers to the aim of the treatise and the method followed. In the Introduction there is a general outline of the era of Jeremiah II and its origins, as (...) well as a brief presentation of his contribution to the Greek Genus. The First Chapter is divided into three subchapters. The first subchapter provides a brief overview of the history of the birthplace of Jeremiah II, Anchialos, a city on the shores of the Black Sea, and describes patriarch’s character and education, along with an extensive reference to his teachers. In this subchapter information is included relative to Jeremiah’s life until his ordination as Metropolitan of Larissa. The second subchapter briefly narrates the glorious ordination of Jeremiah II to Patriarch of Constantinople. In the third subchapter of the First Chapter, the three breaks during Jeremiah II’ patriarchate –caused by the selfish ambitions of his competitors, who coveted the patriarchal throne– are recounted. The Second Chapter consists of four subchapters. In the first subchapter there are a brief reference to the life and religious beliefs of the founder of the Reformation, Martin Luther, and the interest and curiosity of the Lutherans in the situation of the Eastern Orthodox Church. The second subchapter of the Second Chapter contains biographical details of the Protestant scholar and philhellene Philip Melanchthon, and a reference to the first contact attempt of Lutherans with the Patriarchate of Constantinople. The third subchapter of the Second Chapter is divided into six other subsections. The first section of the third subchapter describes the way the relationships of the Lutheran theologians of Tubingen with Patriarch Jeremiah II developed and to the starting point of their correspondence. Yet, the Philhellenism of the German Hellenist Martin Crusius and the role he played in the correspondence are highlighted. The second section outlines Jeremiah II’ responses to each article of the Augsburg Confession send to him by the Tubingen theologians. The third section highlights the key points of the reply of the Tubingen theologians to the First Answer from Jeremiah II. The third section refers to the Second Answer from Jeremiah II. In the short fifth section there is a reference to the reply of the Tubingen theologians to the Second and the Third Answer from Jeremiah II. The sixth section provides information related to the publication of that correspondence. In the fourth subchapter of the Second Chapter there are general and evaluative judgments on the correspondence between Jeremiah II and the Tubingen theologians. The Third Chapter is divided into five subchapters. The first subchapter explains the ancient Roman calendars of Numa and Julius Caesar and their shortcomings. The second subchapter presents the findings of these imperfections by various scholars. The third subchapter describes the Gregorian Reform of the calendar. The fourth subchapter analyses the social situation within the Orthodox Church during the Gregorian Reform. The fifth subchapter aims to show the orthodox reaction of Jeremiah II to the Gregorian calendar and its causes. The Fourth Chapter is divided into two subchapters, of which the first is related to Jeremiah’s travels in Poland and the regulation by him of Church life in this country, while the second gives an overview of the circumstances, under which the foundation of the Russian Patriarchate took place. The Fifth Chapter is divided into three subchapters. The first subchapter examines Jeremiah II’s concern on various issues. The second subchapter deals with Jeremiah II’ concern on the education of the Greek Genus. The third subchapter explains the attitude of Jeremiah II towards the Pontifical Greek College in Rome. (Studies in the History of Greece and Rome)“Nothing could have contributed more to the safety, (...) strength and profit of the state.” Thus Niccolò Machiavelli (Disc. II 6), one of the first of a long line of moderns to expatiate on the phenomenon of Roman Republican colonization. The latest (at time of writing) is D. J. G[argola], with his learned Lands, Laws, & Gods, which has its origins in the author’s 1989 University of North Carolina dissertation. The book takes as its general subject not just Republican colonization but also another well-trod area of Roman public policy—the agrarian legislation that distributed state land and regulated its use—as well as the religious and technical aspects of Roman land definition.Can we really expect much new on these traditional topics? Perhaps not, [End Page 143] especially now that we have Dieter Flach’s Römische Agrargeschichte (Handbuch der Altertumswissenschaft 3.9, Munich 1990)—a masterly synthesis that G. oddly has missed. Yet G. independently manages to come up with a work of value. The bulk of G.’s book (chapters 2–7) consists of detailed reconstructions, especially from the evidence of Livy 21–45 (not much used by Flach), of how colonies were established, viritane plots assigned, and land sold or leased in the mid-Republic. Here G. has sifted through a small mountain of difficult evidence (and bibliography) of widely varying worth and succeeded in shaping a coherent narrative. He has a keen eye for technical and conventional language, and sound judgment on the limits of applying evidence from the various Gromatici (none of whom were writing much before the second century a.d.) to the Republican situation. In short, G. in these pages has crafted a reliable and readable English language work of reference on all sorts of res agrariae.The emphasis in chapters 2–7 is not so much on evolution in the administration of agrarian and colonial legislation—G. argues (somewhat provocatively) that there was not much development of institutions within this period—but on creating a composite picture of how things worked. G. realizes “the result is necessarily an idealized portrait,” in which the system appears more regular than it perhaps was (10–11). One additional trouble, however, is that this approach sometimes flattens potentially significant details. Take for instance the two commissions of colonial IIIviri created under a lex Aelia of late 194 (Liv. 34.53.1–2), one of which went on to found Copia (193), the other Valentia (192). Now, the reported terms of this law provided that the commissioners hold imperium—quite striking, though G. misses that detail—for three years (i.e., 193–91) to colonize the ‘ager Thurinus’ and the ‘Bruttii’ respectively. G. is over-optimistic in calling these territories “stable, long pacified regions” (63). If so, why the imperium? One possible explanation. The territorial parameters placed on each of these commissions (especially ‘the Bruttii’) were quite loose. Those IIIviri may have been expected to take wide-ranging measures to strengthen Roman control over dissidents in this area (cf. App. Hann. 61.252–53), even after they established their colonies. (Note that each of these commissions completed their ostensible tasks before their triennium expired.) If true, how many other colonial commissions were like these?It is only in chapters 8 and 9, where G. surveys agrarian programs from the Gracchi to the end of the Republic, that we see an attempt to show real development. The Gracchi in their agrarian legislation sought to achieve broader effects than any of their predecessors, argues G. in chapter 8, and so introduced agrarian laws that “ended the rigid separation of categories found in mid-Republican legislation” (176). Consider the lex Sempronia agraria of 133, which, in its final form, established IIIviri a(gris) i(udicandis) a(dsignandis) to settle coloni on public land taken from illegal possessores. 2007 was arguably the most extraordinary year in recent memory for the development of Private International Law. Reflecting the vitality and fluidity of a subject that is in constant motion, Volume IX of the Yearbook of Private International Law is again a very rich and multi-faceted book. An entire thematic section of this volume is devoted to the "Rome II" Regulation on the law applicable to non-contractual obligations, which was adopted by the EC institutions in July 2007. Being (...) the first EC regulation on pure applicable law issues, this text opens up a new era in the process of creating a European PIL system. It deserved therefore a detailed commentary and analysis of its main provisions by experts from several EU States. Because of the interest that this European text presents for third party States, some distinguished scholars from non-European areas (the US, Japan, Latin America and Australia) were also asked to express their views on this important piece of Community legislation and the possible influence it may have on conflict developments in their respective countries and regions. The Yearbook of Private International Law series, an annual publication now published by Sellier. European Law Publishers in cooperation with the Swiss Institute of Comparative Law, provides analysis and information on private international law developments world-wide. This sixth volume looks rather "Euro-centric", due to the impressive and continuous rhythm at which the creation of a European system of PIL is progressing at the European Community level. Contributions include discussion of the proposal for a Rome II regulation on conflict (...) of laws in torts, as well as an analysis of the Avello decision, which could create a new framework for the development of PIL in Europe. Additional articles focus on the national conflict systems of some European states. An important comparative study discusses the treatment of foreign tax laws and judgments in four major European countriesâ??United Kingdom, Germany, France, and Italy. The actual and controversial issue of registered partnership is discussed from the perspective of Spanish law. The purpose of this contribution is to analyse climate change litigation in an innovative way, considering it as an example of “privatisation” of international law, and unravelling the “ecological” side of conflict-of-laws climate change litigation. The paper will first explain the concept of privatisation of law as applied to international law and what it means in the context of climate change litigation, before moving to a landmark case, whose appeal is still pending in front of a domestic court in Europe: (...) Milieudefensie et al. v. Royal Dutch Shell plc. The focus of the analysis of the cases will be limited to the use of the conflict-of-laws mechanism present in the Rome II Regulation, namely Article 7. The paper critically assesses the principle of ubiquity included in this provision, by looking at the concept of “event giving rise to the damage” as applied in CO2 reduction claims in the existing legal scholarship and using an underexplored ecofeminist perspective. Inspired by the work “A relational feminist approach to conflict of laws” by Roxana Banu (2017), the paper argues for a relational understanding of the concept of “event” and goes further to consider in an ecofeminist perspective the environment as composed of human, non-human beings and natural objects, and of their relations with each other. The article is meant to be a starting point for further research, which for the first time applies ecofeminist theories to private international law. (shrink)

In Nicomachean Ethics 2.1, Aristotle draws a now familiar analogy between aretai ('virtues') and technai ('skills'). The apparent basis of this comparison is that both virtue and skill are developed through practice and repetition, specifically by the learner performing the same kinds of actions as the expert: in other words, we become virtuous by performing virtuous actions. Aristotle’s claim that “like states arise from like activities” has led some philosophers to challenge the virtue-skill analogy. In particular, Aristotle’s skill analogy is (...) sometimes dismissed because of the role that practical wisdom or phronesis purportedly plays in character virtue. In this paper, I argue that a proper understanding of character virtue, phantasia-based emotions, and Aristotle’s implicit distinction between habituated and strict or full virtue (aretè kuria) grounds his virtue-skill analogy. Character virtue stems from the non-rational orektikon and is developed through the habituation of passionate elements, primarily phantasia and pathé. Pathé are pleasurable or affective perceptions, not judgments or beliefs. Thus, pathé are subject to non-rational habituation. Practical wisdom, on the other hand, is an intellectual virtue stemming from the rational part of the soul. Though practical wisdom is necessary for full virtue (aretè kuria), it is not necessary for the habituated character virtue that Aristotle refers in Book II. Once we understand the phantastic basis of emotions and the distinction between habituated and full virtue, the virtue-skill analogy is apt. I conclude by briefly mentioning two contemporary forms of emotion regulation—cognitive reappraisal and cognitive behavioral therapy—that lend support from empirical psychology to Aristotle’s claim that emotions (pathé) can be habituated. Character virtue is indeed a skill; it is—at least in part—the skill of emotion regulation. (shrink)

The most important features of this instrument were outlined and discussed by distinguished legal experts from all over Europe and beyond at the conference "The (...) This paper examines the neglected topic of Martin Luther King's comprehension and employment of dialectics. When we examine King's political and ideological development dialectically, we see that there are stages in the development of his thought. Most importantly, the material context of the African-American liberation struggle, as a process of objective development, shaped and directed his thinking as a dialectician. Consequently, the materialcontext of the African-American liberation movement served as a dynamic process which greatly affected King's understanding of dialectics as (...) a tool of analysis. King's early conception of dialectics is not Hegelian. However, after 1965, King becomes more Hegelian, approximating a regulative dialectic. (shrink)

Up until the ninth century, when the Roman Empire continued in the East but ceased to exist in the West, « the Church » thought and lived in the synodal mode. Two centuries later, when the Byzantine Empire ceased to pretend to Roman universality, western Latin Christianity dreamed only of the renewal of the Roman Empire, to its own advantage. Between these two moments, there was the ephemeral adventure of Gerbert of Aurillac who, after having defended the cause of the bishops against the pope at Reims, became pope Sylvester II in the year 1000, thanks to Otto III. Sylvester was the name of the pontiff at the time of Constantine, to whom the new emperor didn’t cease to compare himself in wishing an empire less Germanic than universal. It must have been a great joy for the pope to hear Otto say in 1001 : « We proclaim Rome the capital of the world and we recognize the Roman Church as mother of all the Churches. » In the future, communion was no longer regulated by the Catholic Church's common law, but by the unius arbitrium, and Sylvester II will speak as « universal father », conscious of exercising alone the ministry of Peter. It is with these strong convictions that the Roman Church would face the crisis of Christianity in the XIII and XIV centuries. (shrink)

Many, if not most, of the spectacular innovations in the medical understanding and treatment of today's human maladies have been based on research using animals. (...) However, the use of animals in research and experimentation has been debated, defended, and protested by both individuals and organizations at various levels. Responses range from personal lifestyle decisions and fervent philosophical treatises to strident arguments, violent demonstrations, and direct action. The continuum of attitudes about animals and the human relationship with animals spans the range between those who support no regulation of the human use of animals and those who advocate absolute animal liberation from all human use (see II, Orlans 1993, p. 22). History The first recorded experimentation on animals occurred in ancient Rome, but not until the Renaissance did scholars begin serious study of how the body works. Leonardo da Vinci (1452-1519) and other artists and anatomists pursued anatomical investigations of muscle and bone structure. William Harvey (1578-1657) discovered the circulation of the blood via his experiments on live deer. During this period, much live animal experimentation both in England and France was based on the view of French philosopher René Descartes (1596-1650) that animals are incapable of feeling pain. Jeremy Bentham (1748-1832), the English utilitarian philosopher, thought otherwise. In his "Introduction to the Principles of Morals and Legislation" in 1789, Bentham declared, "The question is not, can they reason? Nor, can they talk? But can they suffer? Despite Bentham and others, the belief that animals could not perceive pain persisted in many quarters into the twentieth century. Nineteenth century French physiologist Claude Bernard [End Page 91] (1813-1878)-and his teacher, François Magendie (1783-1855)-conducted wide-ranging animal experiments including surgery, use of drugs, and removal of body parts from many species. Bernard argued that while no amount of benefit could justify any harm to human research subjects, even extreme harm and pain for animal research subjects could be justified by the potential benefit to human beings. Although he did use anesthetics in his work after their discovery in 1847, even Bernard's later work was controversial because of the numbers of animals used and the repetitive nature of his research. The experiments of Magendie and Bernard both laid the foundations for animal experimentation as a practice for scientific advance and contributed in large measure to the emergence of the anti-vivisection movement. Public protests over animal experiments conducted in France and the fear that these might come to England led to the passage of the first law controlling animal experimentation, the "1876 Cruelty to Animals Act" in England. This history and the dynamic tension between scientific inquiry and public concern set the stage for the activism and scholarship of the twentieth century.Since the 1960s, the amount of attention, activism, and scholarship related to animal use has increased at a rapid pace. The modern animal protection movement, led by the Australian philosopher Peter Singer in his book, Animal Liberation (II, 1975), based its advocacy on animals' ability to experience pain and suffering (Bentham's argument). Singer's book and other investigations into animal research, such as LIFE magazine's photojournalism piece on pet theft, animal cruelty, and animal experimentation (Concentration Camps for Dogs. The European Commission’s proposal to address antimicrobial resistance using transferable exclusivity vouchers (TEVs) is fundamentally flawed. European policymakers and regulators should consider alternatives, such as better funding for basic and clinical research, use of advance market commitments funded by a pay-or-play tax, or enacting an EU Fund for Antibiotic Development.

Autonomous AI agents present transformative opportunities and significant governance challenges. Existing frameworks, such as the EU AI Act and the NIST AI Risk Management Framework, fall short of addressing the complexities of these agents, which are capable of independent decision-making, learning, and adaptation. To bridge these gaps, we propose the ETHOS (Ethical Technology and Holistic Oversight System) framework—a decentralized governance (DeGov) model leveraging Web3 technologies, including blockchain, smart contracts, and decentralized autonomous organizations (DAOs). ETHOS establishes a global registry for AI (...) agents, enabling dynamic risk classification, proportional oversight, and automated compliance monitoring through tools like soulbound tokens and zero-knowledge proofs. Furthermore, the framework incorporates decentralized justice systems for transparent dispute resolution and introduces AI-specific legal entities to manage limited liability, supported by mandatory insurance to ensure financial accountability and incentivize ethical design. By integrating philosophical principles of rationality, ethical grounding, and goal alignment, ETHOS aims to create a robust research agenda for promoting trust, transparency, and participatory governance. This innovative framework offers a scalable and inclusive strategy for regulating AI agents, balancing innovation with ethical responsibility to meet the demands of an AI-driven future. (shrink)

The first part of this article sets out two possible models of proceduralization. This second part of this article begins to develop one of those forms, «thick» proceduralization, building on but modifying Habermas's model of deliberative democracy in two important respects. First, it is argued that it is not sufficient simply to call for deliberation for there is a real likelihood that even if all deliberants can be brought together true communication will be blocked by difference; difference in the modes (...) of discourse, the techniques of argument, language, and validity claims. Discourse may therefore have to be mediated through the adoption of strategies of translation, mapping, and dispute resolution. Whether regulators can or should perform such a mediating role remains however an open question. Second, it is argued that deliberative modes of policy formation and regulation are compatible with more pluralist and polyarchical arrangements than Habermas allows, and indeed that such arrangements may need to be adopted for thick proceduralization to become operative. This volume, which gathers together nine interdisciplinary papers delivered at a series of seminars on philosophy and Roman society in the University of Oxford, explores the role of Platonism and Aristotelianism in Roman intellectual, cultural, and political life from the second century BC to the third century AD.

It will be remembered that the introductory chapter to this paper differentiated between human therapeutic cloning and embryonic stem cell research, with the former concept encapsulating the latter one. In turning to examine the current system of regulation found within the United Kingdom this has particular relevance as it is only the practice of therapeutic cloning – the creation and use of an embryo – which engages with the regulative measures adopted.

RNA polymerase II (RNAP II) non‐coding transcription is now known to cover almost the entire eukaryotic genome, a phenomenon referred to as pervasive transcription. As a consequence, regions previously thought to be non‐transcribed are subject to the passage of RNAP II and its associated proteins for histone modification. This is the case for the nucleosome‐depleted regions (NDRs), which provide key sites of entry into the chromatin for proteins required for the initiation of coding gene transcription and DNA replication. In this (...) review, recent data on the effects of pervasive transcription through NDRs are summarized and a model is proposed to explain how RNAP II‐driven transcription is able to modify the nucleosomes flanking the NDRs, leading to nucleosome repositioning and NDR closure. Even though much of the mechanistic detail underlying these events remains to be elucidated, such a model provides a basis to explain how non‐coding transcription through NDRs can regulate the initiation of coding gene expression and DNA replication. Codes of conduct are the main tools to privately regulate worker rights in global value chains. Scholars have shown that while codes may improve outcome standards (such as occupational health and safety), they have had limited impact on process rights (such as freedom of association and collective bargaining). Scholars have, though, only provided vague or general explanations for this empirical finding. We address this shortcoming by providing a holistic and detailed explanation, and argue that codes, in their current form, have (...) limited impact on trade union rights due to (i) buyers paying lip service to trade union rights, (ii) workers being treated as passive objects of regulation in codes of conduct, (iii) auditing being unable to detect and remediate violations of trade union rights, (iv) codes emphasizing parallel means of organizing, (v) suppliers having limited incentives for compliance, and (vi) codes being unable to open up space for union organizing when leveraged in grassroots struggles. Our arguments suggest that there is no quick fix for codes’ limited impact on trade union rights, and that codes, in their current form, have limited potential to improve trade union rights. We conclude by discussing ways in which codes of conduct, and private regulation of worker rights more generally, could be transformed to more effectively address trade union rights. (shrink)

The study of Attention Deficit Hyperactivity Disorder addresses variables related to three core symptoms: inattention, hyperactivity, and impulsivity. However, it has been suggested that in recent years emotional difficulties and subsequent social challenges have not received sufficient attention. This study had two objectives: 1) to compare the performance of participants (age range: 8-14 years) on facial emotion recognition tasks using the Affect Recognition subtest of the Children Neuropsychological Battery II; and 2) to assess the perceptions of family members in relation (...) to variables associated with emotional problems, difficulty in regulating emotions, and anger management using the Spanish Assessment System for Children and Adolescents. Assessments were conducted before and after applying an emotion regulation intervention designed for this study. Following the intervention, there was a significant decrease in scores associated with emotional regulation, and an improvement in the identification of affect on facial recognition tasks. The results suggest that despite Attention Deficit Hyperactivity Disorder children and adolescents having social and emotional deficits secondary to the core symptom triad, emotional regulation in this group can be improved by the application of socio-emotional intervention programs.
