In light of new threats in the field of human rights stemming from global geopolitical shifts, criminal law is facing a myriad of new challenges that require adequate responses. Given this context, it is crucial to develop and refine criminal legal measures (CLMs) in order to safeguard societal interests and maintain stability in social relations. This paper undertakes an analysis of contemporary problems in the area of legal regulation and CLMs, as well as assesses the effectiveness of CLMs for individuals (...) engaged in criminal misconduct. The research provides grounds for arguing that the absence of a clear definition of CLMs in Ukrainian legal science renders the term potentially problematic. Moreover, there are currently no taxonomic markers or criteria for classifying CLMs, nor methods for evaluating the effectiveness of specific measures. Within the framework of the announced reforms in Ukraine’s criminal law, it becomes imperative not only to revisit the concept of CLMs but also to develop robust methodologies for assessing their effectiveness. This measure appears necessary both in light of the need to legally formalize CLMs and to systematize them in the future. (shrink)

Today, there are several problems in the field of criminal law caused both by the emergence of new types of legal relations and by the imperfection of legislation. Due to the emergence of new challenges in the field of criminal law, many of them require theoretical understanding. Some of these challenges, generated in the light of the armed aggression of the Russian Federation against Ukraine, revealed several reasons for discussion in the Ukrainian and international legal community. The purpose of the (...) study involves consideration of certain aspects of modern challenges in the field of criminal-legal relations, which arose against the background of the military aggression of the Russian Federation in Ukraine. The first part of the study is devoted to the question of the qualification of war crimes committed by the Russian Federation in Ukraine as acts of genocide. The second part of the work is devoted to the issue of using existing international legal mechanisms to hold the Russian Federation accountable for war crimes. There are convincing reasons to say that the actions of the Russian Federation during the war in Ukraine have signs of the crime of genocide. Even though Ukraine is not a party to the Rome Statute, the Ukrainian government can use another tool to bring the subjects of war crimes to justice, by creating a certain mixed investigative mechanism or a criminal tribunal that could deal directly with the crime of aggression. GRW Theory postulates a stochastic mechanism assuring that every so often the wave function of a quantum system is `hit', which leaves it in a localised state. How are we to interpret the probabilities built into this mechanism? GRW theory is a firmly realist proposal and it is therefore clear that these probabilities are objective probabilities (i.e. chances). A discussion of the major theories of chance leads us to the conclusion that GRW probabilities can be understood only as either single (...) case propensities or Humean objective chances. Although single case propensities have some intuitive appeal in the context of GRW theory, on balance it seems that Humean objective chances are preferable on conceptual grounds because single case propensities suffer from various well know problems such as unlimited frequency tolerance and lack of a rationalisation of the principal principle. A gas prepared in a non-equilibrium state will approach equilibrium and stay there. An influential contemporary approach to Statistical Mechanics explains this behaviour in terms of typicality. However, this explanation has been criticised as mysterious as long as no connection with the dynamics of the system is established. We take this criticism as our point of departure. Our central claim is that Hamiltonians of gases which are epsilon-ergodic are typical with respect to the Whitney topology. Various authors have argued that in the future not only will it be technically feasible for human minds to be transferred to other substrates, but this will become, for most humans, the preferred option over the current biological limitations. It has even been claimed that such a scenario is inevitable in order to solve the challenging, but imperative, multi-agent value alignment problem. In all these considerations, it has been overlooked that, in order to create a suitable environment for a particular (...) mind – for example, a personal universe in a computational substrate – numerous other potentially sentient beings will have to be created. These range from non-player characters to subroutines. This article analyzes the additional suffering and mind crimes that these scenarios might entail. We offer a partial solution to reduce the suffering by imposing on the transferred mind the perception of indicators to measure potential suffering in non-player characters. This approach can be seen as implementing literal empathy through enhanced cognition. (shrink)

The paper is devoted to the discussion of some philosophical and historical problems connected with the theorem on the undefinability of the notion of truth. In particular the problem of the priority of proving this theorem will be considered. It is claimed that Tarski obtained this theorem independently though he made clear his indebtedness to Gödel’s methods. On the other hand, Gödel was aware of the formal undefinability of truth in 1931, but he did not publish this result. Reasons for (...) that are also considered. (shrink)

Conceptual congruency effects are biases induced by an irrelevant conceptual dimension of a task (e.g., location in vertical space) on the processing of another, relevant dimension (e.g., judging words’ emotional evaluation). Such effects are a central empirical pillar for recent views about how the mind/brain represents concepts. In the present paper, we show how attentional cueing (both exogenous and endogenous) to each conceptual dimension succeeds in modifying both the manifestation and the symmetry of the effect. Let us begin with a characteristic example. Consider a gas that is confined to the left half of a box. Now we remove the barrier separating the two halves of the box. As a result, the gas quickly disperses, and it continues to do so until it homogeneously fills the entire box. This is illustrated in Figure 1.

The author overviewed the substantive content of the category of "globalization". The influence of globalization processes on the development of agribusiness of Ukraine is considered. The likely benefits and risks of growth of the country's participation in the global economic processes are determined. The level of preparedness of the state under globalization is studied. Global trends of the development of agriculture and providing people with food are overviewed. The current state of the development of agribusiness is analyzed, the problems are (...) found and their solutions are proposed. The necessity of the state support for the studied sector of economics is proved. The future of Ukrainian agriculture in the context of globalization depends on its adaptive capacity. In our opinion, three groups of conditions affect the competitiveness of domestic agriculture in the world. They are: macroeconomic conditions that are determined by rationality and dynamism of the domestic economy; prerequisites for investment, especially in the development of an appropriate climate in the country and at the level of each entity; agricultural development in accordance with accepted social standards. Achieving the competitive level in the global food market requires considerable and sustained financial investment in almost all sectors, especially in scientific research and agricultural education. The increasing level of globalization in the international trade, including food, significantly affects the nature of the problem of food self-sufficiency. (shrink)

The current monopoly of psychology in the different facets of human life becomes psychological practice care increasingly suspect. And while it states legitimate targets, they are controversial. This paper highlights the lack of an agreed target between the professionals of psychological practice care. The first part argues that psychological practice care does not provide a clear and agreed target. This dissent is due to a disciplinary problem of psychology and it damages its image of responsible profession. In the second part, (...) we propose a goal that unifies various psychological practices care beyond their differences and through which its professional action is legitimate. The hypothesis presented is that the aim of psychological practice care is what begins it, that is, relief of suffering. However, to understand the nature of suffering, psychological practice care must regain its relationship with philosophy. (shrink)

We find meaning and value in our lives by engaging in everyday projects. But, according to a recent argument by Samuel Scheffler, this value doesn’t depend merely on what the projects are about. In many cases, it depends also on the future generations that will replace us. By imagining the imminent extinction of humanity soon after our own deaths, we can recognize both that much of our current valuing depends on a background confidence in the ongoing survival of humanity and (...) that the survival and flourishing of those future generations matters to us. After presenting Scheffler’s argument, I will explore two twentieth century precursors—Hans Morgenthau and Simone de Beauvoir—before returning to Scheffler to see that his argument can not only show us why future generations matter, but it can also give us hope for immortality and a blueprint for embracing a changing future. Philosophical skepticism is identified by several signs or names: Aporētikoí, Ephektikoí, Pyrrhōneioi, Skeptikoí and Zētētikoí, with significant all of them valid and some confusion in meaning. The objective of this work is threefold: first, to clarify why some of these names have been more successful than others, second, what are the reasons why one of them has been fixed as a name, in general for all belonging to this philosophical movement, and third to what is due that recognizing the tradition (...) a clear initiator, Pirrón de Elis, and being the name "Pirrónicos" one of the most popular and one of the most used by the writers who speak about this movement, has not been the most successful, as it has been traditional in most other doctrines. Let (M, ≤,...) denote a Boolean ordered o-minimal structure. We prove that a Boolean subalgebra of M determined by an algebraically closed subset contains no dense atoms. We show that Boolean algebras with finitely many atoms do not admit proper expansions with o-minimal theory. The proof involves decomposition of any definable set into finitely many pairwise disjoint cells, i.e., definable sets of an especially simple nature. This leads to the conclusion that Boolean ordered structures with o-minimal theories are essentially bidefinable (...) with Boolean algebras with finitely many atoms, expanded by naming constants. We also discuss the problem of existence of proper o-minimal expansions of Boolean algebras. (shrink)

Im Blickpunkt dieses Bandes steht das Wechselverhältnis zweier prägender Traditionen moderner deutschsprachiger Philosophie: der Kritischen Theorie und der Philosophischen Anthropologie. Über das gesamte 20. Jahrhundert hinweg blieb der Austausch zwischen diesen Ansätzen, wo er überhaupt zu Stande kam, von Vorbehalten geprägt. Gegenwärtig allerdings lässt sich, jenseits überkommener schulpolitischer Gräben, ein neuartiges Interesse beider Strömungen füreinander wahrnehmen. Die Beiträge dieses Bandes treffen sich in dem Versuch, die jeweiligen Hauptanliegen und Gegenstandsfelder der Kritischen Theorie respektive der Philosophischen Anthropologie über deren direkten Dialog (...) produktiv zu aktualisieren: Inwiefern lassen sich die genuinen Themen der einen Tradition auf Seiten der je anderen rekonstruieren? Und worin bleiben sich beide Denkweisen letztlich doch fremd? Das vorliegende Buch stellt in der Forschung den ersten systematischen Versuch dar, diese Fragen für gesellschaftstheoretische und anthropologische Problemstellungen fruchtbar zu machen. (shrink)

Faculty continue to address academic dishonesty in their classes. In this follow-up to an earlier study on general perceived faculty student cheating, using a sample of business school faculty, we compared three levels of faculty classification: full-time non-tenure track, full-time tenured/tenure-track, and part-time adjuncts. Results showed that NTTs perceived higher levels for three different types of student cheating, i.e., paper-based, forbidden teamwork, and hiring someone to take an exam. In addition, NTTs were more likely to report a student for cheating. (...) NTTs reported a higher course load and average class size, and average class size was positively related to all five types of cheating measured. Given the predicted increase in NTTs across all disciplines, making sure that all faculty,, have the resources needed to deter student cheating is important. All faculty have an obligation to hold students accountable for their behavior. Individual integrity is paramount; and it is what employers expect. Regardless of the chosen field or discipline, an employer’s expectations, in terms of character, is to hire individuals who possess a level of honesty that is above reproach. Addressing cheating is an obligation that all faculty need to address purposefully. Providing resources to help faculty address cheating is critical. Resources might include conflict resolution training to provide instructors with the necessary guidance so that they can better handle these difficult situations. This is important not only for the student while in school, but also for a university/college’s reputation. (shrink)

Este artículo tiene por objetivo retomar la teoría de Byung Chul Han sobre la sociedad del logro (Leistungsgesellschaft), tomando específicamente lo expuesto por él sobre el dogma de la transparencia que surge en la lógica neoliberal-digital contemporánea, para ser completado con la teoría freudiana de lo Unerkante -no reconocible-. Para esto el trabajo se divide en tres momentos: el primero tiene por objetivo exponer lo que se entiende por dogma de la transparencia y cómo se relaciona con el Homo œconomicus; (...) seguidamente, se presenta el concepto de lo Unerkante de Freud para plantear una nueva topología de lo no-reconocible en el plano subjetivo, proponiendo el concepto del ombligo de la subjetividad; y, finalmente, se expone cómo ese ombligo empalma con la teoría de Han frente a la transparencia, de modo que se puedan generar nuevas interpretaciones de lo que sería una salida a la sociedad del logro. The effects of time and the longitudinal course of the children’s internalizing symptoms following Intimate Partner Violence Exposure are still of great interest today. This study aimed to analyze the effect of the frequency of IPVE, adverse experiences after the cessation of the IPVE and the time elapsed since the termination of the violent relation on the prevalence of anxiety and depression among children. Participants were 107 children and their mothers who had been victims of IPV and had existing judicial (...) protection and restraining orders. Hierarchical logistic regression models were estimated to analyze children’s adjustment, considering the effect of the time elapsed since the termination, frequency of IPVE, experiences of revictimization, maternal pathology, and anxious anticipation of the mother at the prospect of future harm. Exposure to multiple events of violence at the hands of multiple ex-partners and higher scores in the mother’s anxious anticipation were significant predictors of children’s pathological depression and anxiety. Our results emphasize the need for early psychological evaluation of women and children’s victims of IPV to provide timely interventions that avoid symptoms from becoming chronic. Strategies to bring support and emotional security to the victims after the end of the violent relationship are desirable. (shrink)
