Stem cells derived from pluripotent cells offer the hope of new treatments for diseases for which current therapy is inadequate. Clinical trials are essential in developing effective and safe stem cell therapies and fulfilling this promise. However, such clinical trials raise ethical issues that are more complex than those raised in clinical trials using drugs, cord blood stem cells, or adult stem cells. Several clinical trials are now being carried out with stem cells derived from pluripotent cells, and many more (...) can be expected in light of the rapid scientific progress in the field.Degenerative neurological diseases are desirable targets for stem cell clinical trials. The FDA has approved Phase 1 clinical trials of neural stem cell transplantation for Batten Disease, Pelizaeus-Merzbacher Disease, and spinal cord injury. In Parkinson Disease, stem cell transplantation could correct the primary pathophysiological defect — inadequate levels of the neurotransmitter dopamine. In this study, we tested the feasibility of conducting quantitative assessments of patients’ experiences with care in the intensive care unit (ICU), in regard to treatment with respect and dignity. Patients completed the Patient Dignity Inventory, Collaborate, and selected domains from the Hospital Consumer Assessment of Health Providers and Systems Survey. Family members were additionally surveyed using the Family Satisfaction in ICU Care questionnaire. Overall, patients reported high levels of satisfaction in terms of nurses and doctors treating them with courtesy (...) and respect; however, physical aspects of care were reported to be more problematic. While this pilot study suggests some target areas for improving treatment with respect and dignity, the findings are limited since many patients were unable to participate in the survey. Future work should be directed at developing new measures that are easier to administer in this setting. (shrink)

This paper seeks to answer the question: Can contemporary forms of artificial intelligence be creative? To answer this question, I consider three conditions that are commonly taken to be necessary for creativity. These are novelty, value, and agency. I argue that while contemporary AI models may have a claim to novelty and value, they cannot satisfy the kind of agency condition required for creativity. From this discussion, a new condition for creativity emerges. Creativity requires curiosity, a motivation to pursue epistemic (...) goods. I argue that contemporary AI models do not satisfy this new condition. Because they lack both agency and curiosity, it is a mistake to attribute the same sort of creativity to AI that we prize in humans. Finally, I consider the question of whether these AI models stand to make human creativity in the arts and sciences obsolete, despite not being creative themselves. This is a review essay of Lagasnerie, Judge and Punish and Fassin, The Will to Punish. It explores the way that these two books challenge conventional thinking about the relationship between crime and punishment.

I argue for an account of creativity that unifies creative achievements in the arts, sciences, and other domains and identifies its characteristic value. This account draws upon case studies of creative work in both the arts and sciences to identify creativity as a kind of successful exploration. I argue that if creativity is properly understood in this way, then it is fundamentally a property of processes, something only agents can achieve, something that comes in degrees, subjectively novel, and non-formulaic. As (...) I develop the account, I show how it avoids challenges faced by other accounts of creativity, especially concerning creativity’s value. Hills and Bird (2018, 2019) have together argued that creativity is not necessarily valuable. My account challenges this view. If I am right that creativity is a kind of successful exploration, then creativity does have a characteristic value, specifically epistemic value. (shrink)

Explaining how something is possible is a familiar and epistemically important achievement in both science and ordinary life. But a satisfactory general account of how-possibly explanation has not yet been given. A crucial desideratum for a successful account is that it must differentiate a demonstration that something is possible from an explanation of how it is possible. In this paper, I offer an account of how-possibly explanation that fully captures this distinction. I motivate my account using two cases, one from (...) ordinary life and one from ornithology. On my account, a how-possibly explanation is a greater achievement than a mere description of how a state of affairs might possibly obtain. In addition to being a potential explanation of why some state of affairs actually obtains, a how-possibly explanation must involve the relief of an imaginative frustration on the part of its recipient. When a recipient’s imaginative frustration is relieved, she does not just know that the state of affairs in question is possible, but is also able to imagine how it could possibly obtain. (shrink)

In this paper I articulate a view of doxastic control that helps defend the legitimacy of our practice of blaming people for their beliefs. I distinguish between three types of doxastic control: intention-based, reason-based, and influence-based. First I argue that, although we lack direct intention-based control over our beliefs, such control is not necessary for legitimate doxastic blame. Second, I suggest that we distinguish two types of reason-responsiveness: sensitivity to reasons and appreciation of reasons. I argue that while both capacities (...) are necessary for satisfying the control condition, neither is sufficient. Finally, I defend an influence-based view of doxastic control according to which we have the capacity to execute intentions to engage in reflection that causally influences our beliefs in positive epistemic ways. This capacity is both necessary and sufficient for satisfying the control condition for legitimate doxastic blame. I end by defending the view from two objections: that reflection is not necessary for meeting the control condition, and that it is not sufficient. (shrink)

All health care systems face problems of justice and efficiency related to setting priorities for allocating a limited pool of resources to a population. Because many of the central issues are the same in all systems, the United States and other countries can learn from the successes and failures of countries that have explicitly addressed the question of health care priorities. We review explicit priority setting efforts in Norway, Sweden, Israel, the Netherlands, Denmark, New Zealand, the United Kingdom and the (...) state of Oregon in the US. The approaches used can be divided into those centered on outlining principles versus those that define practices. In order to establish the main lessons from their experiences we consider the process each country used, criteria to judge the success of these efforts, which approaches seem to have met these criteria, and using their successes and failures as a guide, how to proceed in setting priorities. We demonstrate that there is little evidence that establishment of a values framework for priority setting has had any effect on health policy, nor is there evidence that priority setting exercises have led to the envisaged ideal of an open and participatory public involvement in decision making. Some philosophers argue that friendship can normatively require us to have certain beliefs about our friends that epistemic norms would prohibit. On this view, we ought to exhibit some degree of doxastic partiality toward our friends, by having certain generally favorable beliefs and doxastic dispositions that concern our friends that we would not have concerning relevantly similar non-friends. Can friendship genuinely make these normative demands on our beliefs, in ways that would conflict with what we epistemically ought to believe? On (...) a widely influential evidentialist approach to thinking about epistemic norms, friendship cannot normatively require things of our beliefs, because friendship cannot generate reasons for belief. And this is due, in part, to the alleged fact that we are incapable of forming beliefs directly in response to, or on the basis of, non-epistemic reasons. In this paper, I argue that this evidentialist response to alleged cases of conflict between friendship and epistemic norms fails. Instead, I argue that friendship cannot generate reasons for belief due to an underappreciated feature of friendship: that being a good friend constitutively involves forming attitudes about one’s friends that are appropriately responsive to the features that one’s friends have that appear to warrant those attitudes. I argue that this feature of friendship helps explain why friendship cannot give us reasons to have beliefs that are doxastically partial. (shrink)

There is an underappreciated respect in which the widespread availability of generative artificial intelligence (AI) models poses a threat to human connection. My central contention is that human creativity is especially capable of helping us connect to others in a valuable way, but the widespread availability of generative AI models reduces our incentives to engage in various sorts of creative work in the arts and sciences. I argue that creative endeavors must be motivated by curiosity, and so they must disclose (...) the creative agent’s inquisitive self. It is through self-disclosure, including the disclosure of the inquisitive self, that we put ourselves in a position to be seen by and connect with others through our creative pursuits. Because relying on AI for certain generative tasks is less self-disclosive than the creative work such technologies supplant, this reliance threatens to weaken our connections to one another. In recent years, several prominent biologists have pointed to the relatively new field of evolutionary developmental biology as evidence of an Extended Synthesis in evolutionary biology. More particularly, these biologists claim that theoretical and empirical EvoDevo research is extending the Modern Synthesis framework of evolutionary theory through investigation of evolutionarily important concepts that are not part of the framework developed during the 20th century. To describe the current changes in evolutionary biology as an Extended Synthesis, however, is incorrect. Through review (...) of Extended Synthesis arguments and analysis of the same biological concepts used to support these arguments, I argue that the foundation of the Modern Synthesis framework, theoretical population genetics, faces significant, perhaps insurmountable challenges from the concepts highlighted by EvoDevo research. As the foundation of the Modern Synthesis framework will require considerable remodeling—if possible—in light of the concepts emphasized by EvoDevo, it is incorrect to describe the ongoing changes in evolutionary biology as an Extended Synthesis. The usual treatment of a dinner table utterance of ‘Can you pass the salt?’ is that it involves an indirect request to pass the salt as well as a direct question about the hearer’s ability to do so: an indirect speech act. These are held to involve two illocutionary forces and two illocutionary acts. Rod Bertolet has raised doubts about whether consideration of such examples warrants the postulation of indirect speech acts and illocutionary forces other than the literal ones. In (...) a recent article, Mary Kate McGowan, Shan Shan Tam, and Margaret Hall claim to show that these doubts are unfounded. The purpose of this paper is to show that they have not established this. Lindsay (bio)Throughout 2005, the morbid joke on Capitol Hill was that the twin inevitabilities of "death and taxes" had been replaced by "death politics and taxes." There seemed to be some truth in this observation given the highly publicized intervention by some members of Congress in the Schiavo case and the continuing controversy over government regulation of end-of-life care. (...) The Supreme Court's recent decision in Gonzales v. Oregon (74 U.S.L.W. 4068 (17 January 2006)) has resolved one of the critical issues relating to this controversy by holding that a physician may prescribe controlled substances to provide assistance in dying if such a practice is authorized by state law and not expressly prohibited by federal law. However, other issues remain. In fact, the Court's decision has underscored some of the reasons why there is not only continuing controversy over end-of-life care, but also over other aspects of the practice of medicine. First, it is apparent there is no consensus among health care professionals about the precise boundaries of the legitimate practice of medicine. Second, the regulation of the practice of medicine traverses ill-defined legal territory. In particular, there is significant uncertainty concerning the implications of some regulations as well as the allocation of regulatory authority between and within state and federal governments. This uncertainty leaves substantial room for political maneuvers.Before discussing the politics of medicine, it is worth looking at the regulation of controlled substances in some detail both because this review will provide the necessary background for understanding the ruling in Gonzales v. Oregon and because it will illustrate the uncertainty resulting from multiple sources of regulatory authority.Federal and State Regulation of Controlled SubstancesSince the Pure Food and Drug Act of 1906, the federal government has regulated certain aspects of the distribution and administration of drugs deemed susceptible to abuse. The current primary vehicle for federal regulation is the Comprehensive Drug Abuse Prevention and Control Act, enacted in 1970, of which Title II is known as the Controlled Substances Act (CSA) (21 U.S.C. § 801 et seq.). A [End Page 99] "controlled" substance is just that, a substance that is regulated under the CSA. The CSA classifies controlled substances in five categories or schedules based on their potential for abuse, their accepted medical use, and the risks associated with their use under medical supervision. Schedule I substances have a high potential for abuse and have no currently accepted use in medical treatment. Schedule II-V substances are approved for medical use but are subject to a descending hierarchy of restrictions on their use. To give a lawful prescription for a controlled substance, a physician must be registered with the appropriate federal agency, currently the Drug Enforcement Administration (DEA). Moreover, to be valid, such a prescription must be issued for "a legitimate medical purpose" (21 U.S.C. § 830(b)(3)(A)(ii)).There is little dispute that the primary purposes of the CSA are to control drug abuse and to eliminate illicit trafficking in drugs. In accomplishing these objectives, there is a division of responsibility among various federal agencies, in particular the Department of Health and Human Services and the Department of Justice. Of particular relevance to the controversy in Gonzales v. Oregon is the Attorney General's authority to revoke a physician's registration for prescribing controlled substances if the physician's registration would be inconsistent with the public interest.All 50 states have their own statutes and regulations that address various aspects of the distribution and administration of controlled substances. Most states have adopted versions of the model Uniform Controlled Substances Act, which largely mimics federal law, but several states have placed additional restrictions on a physician's ability to prescribe controlled substances, including time limits on the validity of a prescription and limits on the quantity of a drug that can be prescribed. Background: Moral distress, which is especially high in critical care nurses, has significant negative implications for nurses, patients, organizations, and healthcare as a whole. Aim: A moral distress workshop and follow-up activities were implemented in an intensive care unit in order to decrease levels of moral distress and increase nurses’ perceived comfort and confidence in ethical decision-making. Design: A quality improvement (QI) initiative was conducted using a pre- and post-intervention design. The program consisted of a four-hour interactive workshop, followed by (...) two individual self-reflection activities at 2–3 weeks and 5–6 weeks after the workshop. Participants: Critical care nurses working in a heart and vascular intensive care unit at a large academic medical center. Ethical Considerations: This study was deemed to be a QI project by the institution’s Institutional Review Board. Participation was voluntary. Findings: Nurses experienced a significant decrease in moral distress. The participants’ average ethical confidence increased in four areas (ability to identify the conflicting values at stake, knowing role expectations, feeling prepared to resolved ethical conflict, and being able to do the right thing), with knowledge of role expectations and feeling prepared to resolve ethical conflict yielding statistically significant increases. Qualitative findings resulted in consistent themes related to causes of moral distress and ways nurses approached addressing moral distress. Discussion: This study reinforces previous evidence on moral distress and its causes in critical care nurses, and provides a mechanism for improving moral distress and ethical confidence. Conclusions: This QI study demonstrates the effectiveness of an evidence-based program for decreasing critical care nurses’ moral distress and increasing their ethical confidence. The strategies described in this paper can replicated by nursing leaders who wish to effect change at their local level, or adapted and expanded to other professions and clinical care units. Attempts to democratize the food system and make it more equitable through food sovereignty take many forms across space. In Cuba, food sovereignty is perceived as the promotion of small-scale farming methods informed by agroecology and permaculture. However, these practices are mediated by discourses of self-sufficiency in the context of the US blockade. Simultaneously, in Basque country, Spain, food sovereignty shapes community-supported agriculture initiatives, farmer union and cooperative-based work, and a deep appreciation for regional foods. In this context, food sovereignty (...) is perceived as part of the struggle to maintain Basque identity and autonomy. In this paper, I discuss how food sovereignty is defined and understood by outside actors who traveled to either Cuba or Basque country to understand how food sovereignty is being practiced in place. As educators, farmers, students, retirees, farmworker organizers, and activists meet in these spaces, I ask how do definitions of food sovereignty differ? I argue that food sovereignty ‘sits in places’ and travelers have difficulty discerning what food sovereignty is when confronted with unfamiliar practices. Findings suggest that such educational tourism is an attempt to create a meaningful space for dialogue about food sovereignty and as a touchstone it offers opportunities for participant discussions, however, understandings of food sovereignty are subject to confusion and alternate conceptions and thus, do not always travel well. What is it to suspend judgment about whether p? Much of the recent work on the nature and normative profile of suspending judgment aims to analyze it as a kind of doxastic attitude. On some of these accounts, suspending judgment about whether p partly consists in taking up a certain higher-order belief about one's deficient epistemic position with respect to whether p. On others, suspending judgment about whether p consists in taking up a sui generis attitude, one that takes the (...) question of whether p? as its content. In this paper, I defend an account on which suspending judgment about whether p is not a matter of taking up a doxastic attitude, but rather a way of intentionally omitting to judge whether p. I then close with a discussion of how an account like mine, which sees suspending judgment as fundamentally practical, rather than doxastic, can accommodate what appear to be distinctively epistemic reasons to suspend judgment. Ever since Saul Kripke and others developed a semantic interpretation for modal logic, 'possible worlds' has been a much debated issue in contemporary metaphysics. To propose the idea of a possible world that differs in some way from our actual world - for example a world where the grass is red or where no people exist - can help us to analyse and understand a wide range of philosophical concepts, such as counterfactuals, properties, modality, and of course, the notions of (...) possibility and necessity. This book examines the ways in which possible worlds have been used as a framework for considering problems in logic and argument analysis. The book begins with a non-technical introduction to the basic ideas of modal logic in terms of Kripke's possible worlds and then moves on to a discussion of 'possible for' and 'possible that'. The central chapters examine questions of meaning, epistemic possibility, temporal logic, metaphysics, and impossibility. Girle also investigates how the idea of a possible world can be put to use in different areas of philosophy, the problems it may raise, and the benefits that can be gained. (shrink)

All datasets emerge from and are enmeshed in power-laden semiotic systems. While emerging data ethics curriculum is supporting data science students in identifying data biases and their consequences, critical attention to the cultural histories and vested interests animating data semantics is needed to elucidate the assumptions and political commitments on which data rest, along with the externalities they produce. In this article, I introduce three modes of reading that can be engaged when studying datasets—a denotative reading, a connotative reading, and (...) a deconstructive reading. I then outline how I have taught students to engage these methods when analyzing three datasets in Data and Society—a course designed to cultivate student competency in politically aware data analysis and interpretation. I show how combined, the reading strategies prompt students to grapple with the double binds of perceiving contemporary problems through systems of representation that are always situated, incomplete, and inflected with diverse politics. While I introduce these methods in the context of teaching, I argue that the methods are integral to any data practice in the conclusion. (shrink)

In this paper, I solve a puzzle generated by three conflicting claims about the relationship between faith, belief, and control: according to the Identity Thesis, faith is a type of belief, and according to Fideistic Voluntarism, we sometimes have control over whether or not we have faith, but according to Doxastic Involuntarism, we never have control over what we believe. To solve the puzzle, I argue that the Identity Thesis is true, but that either Fideistic Voluntarism or Doxastic Voluntarism is (...) false, depending on how we understand "control." I distinguish two notions of control: direct intention-based control and indirect reflective control. I argue that though we have direct intention-based control over neither belief nor faith, we have indirect reflective control over each of them. Moreover, indirect reflective control helps explain how we can be held accountable for each. (shrink)

Construed broadly as interpretation theory, hermeneutics could be understood to encompass all modes of interpretation (textual or otherwise), including any kind of literary criticism, from Aristotle's poetics to the New Criticism of the 1950s, as well as the French tradition of structuralism and even perhaps Derridean poststructural thought. Although Gadamer and Ricoeur both recognize the poetic work or, at least, lyric poetry, as belonging to a special class of literature, they do display somewhat different attitudes toward it. For Gadamer, one (...) of the hallmarks of the eminent text is its un‐translatability. That is, all literary works resist translation to one degree or another, but lyric poetry defies it altogether. In Part I of Truth and Method, Gadamer lays out the history of aesthetics and takes issue with the kind of “aesthetic consciousness” that takes the work of art as an object of study. (shrink)

The mental and emotional dimensions of climate change are increasingly concerning as extreme events become more frequent and severe, ecosystem destruction advances, and people become more aware of climate impacts and injustices. Research on climate emotions has rapidly advanced over the last decade with growing evidence illustrating that climate emotions can impact health, shape climate action, and ought to be considered in climate change communication, education, and engagement. This paper explores, describes, and discusses climate emotions in the context of Canada’s (...) Provincial North: a vast region characterized by a vulnerability to climate change, remoteness, political marginalization, diverse Indigenous populations, and economies/livelihoods tied to resource extraction. Using postal survey data collected in two Provincial North communities, we aim to describe climate emotions experienced in the context of Canada’s Provincial North, including relationships among specific emotions; and examine if socio-demographic variables show a relationship with climate emotions. Results show high levels of emotional response to climate change overall, with worry and frustration as those emotions reported by the highest percentage of participants. We also find significant difference in climate emotions between men and women. A methodological result was noted in the usefulness of the Climate Emotion Scale, which showed high reliability and high inter-item correlation. A notable limitation of our data is its’ underrepresentation of Indigenous peoples. The findings contribute to a greater understanding of climate emotions with relevance to similar settings characterized by marginalization, vulnerability to climate change, urban islands within vast rural and remote landscapes, and economies and social identities tied to resource extraction. We discuss our findings in relation to the literature and outline future research directions and implications. (shrink)

It is easy to ridicule the pretense and silliness of many works coming from the “art world.” The story of the arts, for at least the past century and a half, has been one of attempts to keep alive something that is long past dead. For example, without a substantial understanding of quality, aesthetics has been held up as a substitute for life. But the aesthetic, long touted as fundamental to the goals of art, begs other questions: which aesthetic responses? (...) What if one does not have the same, or any, aesthetic response? This essay explores an alternative, one that refutes the modernist conception of substituting mere pleasure and emotion, that is, preferences, for the idea of Beauty as the manifestation of what is known to be True and Good. Instead of seeking living art that is Beautiful, and can bring life, postmodern culture is surrounded by dead, zombie art. Strategies for stopping the flood of long-dead zombie works include reason, ridicule, and pointing the way back to Beauty. (shrink)

Restructured health care reimbursement systems and new requirements for nonprofit hospitals are transforming the U.S. health system, creating opportunities for enhanced integration of public health and health care goals. This article explores the role of public health practitioners and lawyers in this moment of transformation. We argue that the population perspective and structural strategies that characterize public health can add value to the health care system but could get lost in translation as changes to tax requirements and payment systems are (...) rapidly implemented. We urge public health leaders to take a more active role in hospital assessments of community health needs and evaluation of the patient outcomes for which providers are accountable. (shrink)

The study of evolutionary developmental biology (“evo‐devo”) has recently experienced a dramatic surge in popularity among researchers and theorists concerned with evolution. However, some biologists and philosophers remain skeptical of the claims of evo‐devo. This paper discusses and responds to the recent high profile criticisms of evo‐devo presented by biologists Hopi E. Hoekstra and Jerry A. Coyne. I argue that their objections are unconvincing. We report on some recent work centered on attempts to understand when one set is more random than another. We look at various methods of calibration by initial segment complexity, such as those introduced by Solovay [125], Downey, Hirschfeldt, and Nies [39], Downey, Hirschfeldt, and LaForte [36], and Downey [31]; as well as other methods such as lowness notions of Kučera and Terwijn [71], Terwijn and Zambella [133], Nies [101, 100], and Downey, Griffiths, and Reid [34]; higher level randomness notions (...) going back to the work of Kurtz [73], Kautz [61], and Solovay [125]; and other calibrations of randomness based on definitions along the lines of Schnorr [117].These notions have complex interrelationships, and connections to classical notions from computability theory such as relative computability and enumerability. Computability figures in obvious ways in definitions of effective randomness, but there are also applications of notions related to randomness in computability theory. For instance, an exciting by-product of the program we describe is a more-or-less naturalrequirement-freesolution to Post's Problem, much along the lines of the Dekker deficiency set. (shrink)
