In his latest book, _Ethics for Capitalists_, Joseph Heath draws on his many years of thinking about business ethics to propose, as the book’s subtitle indicates, “a systematic approach to business ethics, competition, and market failure.” He develops his argument carefully, draws on a wealth of interdisciplinary work, uses valuable and insightful examples, contrasts his views with important alternatives, and provides responses to compelling objections. In this review article, we argue that his book revises and sharpens many of Heath’s earlier (...) ideas, addressing important criticisms raised against them. We highlight that the book also offers a broad macro-level framework for market design, an explanation of how current corporate governance structures fit such a framework, and concrete responses to micro-level questions about what businesses and individuals ought to do. By doing all of this, his book shifts the scope of the “market failures approach” (MFA) from what used to be a narrow focus on the obligations of professional managers to an encompassing “ethics for capitalists” that ought to guide any economic actor within a capitalistic system. Despite the many merits of his book, we conclude by discussing some concerns we have about its scope and methodology. (shrink)

A statewide program in California to detect neural tube and other birth defects may revive enthusiasm for mass prenatal screening. Participation in the program is voluntary, but all expectant mothers are asked to sign a statement of “informed consent/refusal.” So far California's program seems to be working well, but questions for the future include the level of participation, the possibility that normal fetuses will be aborted, the kinds of information given to women, and the elusive nature of free choice.

Dixon, Robert Have the cultural changes of the last fifty years or so influenced the way that Australia's most active Catholics think about key Catholic beliefs and moral teachings? In this article, I will search for evidence of such an influence by examining responses from Mass attenders to selected questions in the 2011 National Church Life Survey. A recently popular formulation of the Higgs naturalness principle prohibits delicate cancellations between running renormalized Higgs mass parameters and EFT matching corrections, by contrast with the principle’s original formulation, which prohibits delicate cancellations between the bare Higgs mass parameter and its quantum corrections. While the need for this latter cancellation is sometimes viewed as unproblematic since bare parameters are thought by some to be divergent and unphysical, renormalized parameters are finite and measurable, and the need for delicate cancellations (...) between the renormalized Higgs mass parameter and EFT matching corrections is therefore considered by some to constitute a more salient formulation of the Higgs naturalness problem. Here, we argue that to the contrary, the need for fine tuning of the renormalized Higgs mass parameter is an eliminable, unphysical artifact of renormalization scheme, and that this severely weakens the grounds for regarding it as a problematic instance of fine tuning. It is also widely agreed that this cannot be the whole story. How can we distinguish accidental generalisations (...) from laws? Why is it that 'Every massive object attracts every other massive object' is taken as a law, while 'Every golden object is less than a million kilograms (say) in mass' is not? Both are true universally, do not make reference to particular entities or places or times, and so on and so forth, and yet they are given vastly different ontological and/or epistemic status. A mass casualty (MASCAL) event is different to a major incident. The crux of this difference is that in a major incident, by the adoption of special measures, normal or near-normal standards of care can be maintained. In a MASCAL, irrespective of what special measures are instituted, standards of care inevitably drop. This is a, currently unmet, challenge for medical planning and planning policy. Twenty-First century weaponry is capable of producing thousands of causalities a day over a period of (...) several days in peer-on-peer conflict. In this chapter, we propose that medical planning for military events on this scale should include the following: explicit acceptance that ‘gold standard’ care cannot be given to patients who are triaged for treatment, a better understanding how to identify those patients who will not be triaged for treatment, a focus on ensuring patient flow (which includes diversion, self-care and remote monitoring), and implementation of the principle that care should be given by the lowest capable provider. We attempt to begin to develop some principles for planners to consider drawing on historical precedents and explore some of the ethical implications of our proposals. (shrink)

In this essay Robert Davis provides a critical roadmap, which is also a genealogy, for understanding and examining the history of both the humanities and education in them. It relates appraisal of the so-called “crisis” in contemporary teaching of the humanities to a deeper understanding of crisis as a condition for periodic reassessment and renewal of the humanities that has recurred at a number of key historical conjunctures since the early modern period, most notably at the end of the (...) Thirty Years' War in 1648 and at the coming of industrialization and mass education more than a century later. Davis focuses on the traditionalist defense of the humanities as a route to the humane while also acknowledging the power of the poststructuralist critique of this agenda and its complicity with the moral failures of Western society and imperialism. He concludes the essay by advocating a position “beyond critique” where the humanities and education in them can attain a new universalism and material relevance. (shrink)

Heavy duty platonism is of great dialectical importance in the philosophy of mathematics. It is the view that physical magnitudes, such as mass and temperature, are cases of physical objects being related to numbers. Many theorists have assumed HDP’s falsity in order to reach their own conclusions, but they are only justified in doing so if there are good arguments against HDP. In this paper, I present all five arguments against HDP alluded to in the literature and show that (...) they all fail. In doing so, I establish two related truths: HDP has been unfairly ignored, and the arguments which take its falsity as a key premise should be re-assessed. (shrink)

What general conclusions can be drawn about the reception of zymase, its relation to the larger shift from a protoplasm to an enzyme theory of life, and its status as a social phenomenon?The most striking and to me unexpected pattern is the close correlation between attitude toward zymase and professional background. The disbelief of the fermentation technologists, Will, Delbrück, Wehmer, and even Stavenhagen, was as sharp and unanimous as the enthusiasm of the immunologists and enzymologists, Duclaux, Roux, Fernback, and Bertrand, (...) and of Pfeffer, the experimental plant physiologist. Other skeptics—Voit, Kupffer, and Fischer—were conservatives in traditional fields. In all these cases it seems clear that professional commitments and outlook profoundly influenced the reception of zymase.In some cases there is a correlation with a specific earlier statement favoring the protoplasm theory or predicting a fermentation enzyme. Reynolds Green is a striking case of both. In 1893 he stated his belief that life processes in higher plants and fungi were identical, both being mediated by protoplasm.109 Thus he claimed that digestion was not carried out by enzymes, as in higher animals, but by the whole protoplasm, and so too fermentation in yeast: “All the metabolic processes must be carried out in the unicellular organism in the same mass of protoplasm.”110 But Green also insisted that there was no essential difference between “organized” and “unorganized ferments”; enzymes were simply more highly differentiated and specialized forms of primitive protoplasm. He spoke of “the alcoholic ferment” (that is, enzyme), and of intracellular enzymes—very advanced beliefs for 1893. Thus it is understandable why Green saw no reason to doubt his first negative results with yeast juice, and rushed into print. But it is also understandable that he persisted and soon became an outspoken advocate of Buchner's view; like Wroblewski and Pfeffer, he had already accepted the idea of an intracellular fermentation enzyme.The physiological chemists also fit the pattern in a special way. Physiological chemistry is generally regarded as the source of biochemistry; indeed, many early biochemists were trained in physiological chemistry, and imbibed there a progressive interest in enzymes and metabolism. It is not surprising, therefore, that on the whole Neumeister, Madfadyen, Wroblewski, and Loew accepted cell-free fermentation. But what is surprising, and significant, is the diversity of opinion in this group, from Abeles' living protoplasm to Wroblewski's organized array of active proteins. The feelings of the physiological chemists were mixed, and there was enough of the old protoplasm view in Macfadyen's and even Wroblewski's views to allow Buchner to see them as attacks on zymase. The ideas of physiological chemistry were also changing; the idea of protoplasm was already adjusting to the new interest in enzymes in the early 1890's. But in contrast to immunochemistry, the change in physiological chemistry was gradual, uneven, undramatic, and relatively invisible. For the new biochemistry, the tradition of physiological chemistry was the source of traditional conservatism as well as of new ideas of enzymes.In general, then, I claim that it was not experimental facts that determined attitudes toward zymase so much as previous commitments, experience, and expectations. Initially, at least, zymase was less a determinant of opinion than a touchstone of pre-existing opinion. Like a prism, it revealed the spectrum of existing attitudes toward vital phenomena.Also relevant here is the fact that the experimental evidence was entirely ambiguous; the interpretation of Buchner's experiments with antiseptics or dried yeast depended entirely on how far one was willing to stretch the scope of the terms “protoplasm” and “enzyme”. Likewise, how important one judged the instability of zymase to be, or the low level of in vitro activity, depended largely on one's point of view. There was no crucial experiment, no certain proof. Logically zymase could be regarded as protoplasm. A. Fischer did so in 1900;111 Macfadyen was still wavering in 1907;112 and Beijerinck was holding out as late as 1916.113 There were undoubtedly others. Besides the special case of Reynolds Green and the technologists, there are no recorded cases of conversion.But if there was no evidence to convert a dedicated protoplasmist, there was plenty to encourage a dedicated belief in the enzyme theory, and that, I believe, is precisely what happened. The arguments of Buchner et al in support of zymase had the greatest effect not on the protoplasmists but on those who were already predisposed toward the biochemical view. The zymase debate enabled the emerging group of biochemists to recognizethemselves as a group with a community of out-look and objectives; it brought the issue of protoplasm vs. enzyme into the open and gave it a specific and concrete issue on which to turn. The debate sharpened the biochemists' awareness that their point of view was becoming the new mainstream of biochemical thought.All this of course had an important secondary effect on those who opposed the new view, or who were not immediately concerned with it. After the zymase debate, it would have been almost impossible to ignore the new ideas; the dramatic and wide publicity the debate enjoyed would have made it difficult not to take sides. Buchner's successful defense of zymase itself became an important influence on opinion; the new movement had to be looked at with respect. But the primary effect of the debate, I assert, was on those who were already inclined to the new view. The outcome was not a mass conversion of individuals, nor the ejection of one idea by another. The sides probably did not change much; the real change was in the way each side regarded itself and its place in history. The zymase debate may perhaps best be regarded as a process of selection. Buchner's party became aware of itself as the new progressive point of view, while those holding the traditional view could no longer expound it publicly without appearing obstinate or old-fashioned. Thus the way was clear for the gradually wider establishment of the new ideas, especially among the new generation of biochemists. In this specific sense, the acceptance of zymase was a social phenomenon.This way of looking at the zymase debate also illuminates its coincidence with the emergence of biochemistry as a profession. The new professional trappings and organizations were the social manifestation of the new self-awareness gained from the zymase controversy. One of the most important effects on those disposed toward the new view was the awareness of an intellectual community and of the need to give that community social forms. The almost mythical importance of Buchner's “victory” over the old protoplasm theory that later became current is readily understandable. It was a useful ideology for a group anxious to assert the novelty of their approach, a novelty which they in fact felt quite keenly.But if the primary effect of the zymase controversy was on those predisposed to accept zymase, then obviously the success of zymase depended on the fact that change had already begun to occur. Indeed, one of the most striking, and again unexpected, results of this study is the extent to which the importance of enzymes was already recognized in the early 1890's. The new immunology clearly pointed the way. Macfadyen and Hans Buchner were looking for active proteins inside the cell in 1893. Reynolds Green, Wroblewski, and Pfeffer had all anticipated the discovery of a fermentation enzyme. Other discoveries in enzymology in the 1890's pointed the same way.114 Moreover, it is clear from this study that the old protoplams theory was adapting to the new discoveries concerning the importance of enzymes. The sidechains of the old protoplasm molecule were simply reinterpreted as enzymes, as in Wroblewski's theory, for example, or in Paul Ehrlich's extremely influential “sidechain theory” of antibody formation (1897). Despite the later views of Hopkins et al., the old protoplasm and the new enzyme theories were not irreconcilable; a continuity of development had already begun when zymase came so dramatically on the scene. Buchner himself observed that the difference between the two views had become largely verbal; in retrospect we might say, not verbal, but social and historical. The gap between the continuous change in ideas and the contemporary feeling of sharply discontnuous change is a measure of the elusive but real social and historical implications of the zymase debate, of the demise of an old establishment, and the emergence of a new.In retrospect, then, it is clear that a trend was already under way in various quarters when zymase appeared. But it was still a collection of isolated and dispersed events. The zymase controversy made the trend visible and gave it a dramatic unity. The debate influenced those who had already begun to change. It was so effective because things had begun to change and because it coincided with the direction of that trend. (shrink)

In the last two decades, several important steps have been made by Catholics, Protestants and Orthodox Christians to engage in meaningful dialogue with members of the Islamic faith.1 While sincerity, (...) mutual respect and good will are all in evidence in these efforts to dialogue, it also is clear that an authentic theological discussion between Christians and Muslims cannot help but arouse a certain degree of tension over the Christian doctrine of the Incarnation. In my own experience in dialogue with Muslims,2 there seems to emerge a point in which discussion of Jesus the prophet vs. Jesus the Incarnate Word of God will inevitably take place. Such discussions can prove to be stimulating and educational. It does not ignore obvious differences... for to do so would be of no use for ·either friendship or truth." 3 A Muslim scholar, Professor Mohammed Taibi of the University of Tunis, likewise remarks that " the more one is firm about the classical aspects of divergence, the better the contacts between Christians and Muslims." 4 At issue in the Christian-Muslim discussion of the Incarnation is the unique character of each faith. In Islam, there is the absolute affirmation of divine unity (tawhid) which necessarily condemns any attempt to associate something other than God with God (shirk). Christianity, though, has as one of its central tenets the affirmation that the uncreated Word of God (ho logos) became flesh (sarx) in Jesus (John 1 :14). Islam, therefore, presents a unique challenge to the Christian theologian. Is it possible to formulate a Christology which can affirm the Islamic principle of tawhid and evade the accusation of shirk without compromising the core of the Christian message? This is the question this article hopes to address. One suggestion for Christians in dialogue with Muslims is given by Hans Kiing in his book Christianity and the World Religions.5 Kiing believes that Christians would do best to go back to the mindset of the original Jewish Christians who possessed an understanding of Jesus which is much more compatible with the Qur'anic view of Jesus as the "servant of God." 6 While Kiing's suggestion is helpful for Christians who are looking for an analogy to the Islamic view of Jesus, I find it problematical for several reasons. The place of poetry in modern democracy is no place, according to conventional wisdom. The poet, we hear, is a casualty of mass entertainment and prosaic public culture, banished to the artistic sidelines to compose variations on insipid themes for a dwindling audience. Robert Pinsky, however, argues that this gloomy diagnosis is as wrongheaded as it is familiar. Pinsky, whose remarkable career as a poet itself undermines the view, writes that to portray poetry and democracy as enemies is (...) to radically misconstrue both. The voice of poetry, he shows, resonates with profound themes at the very heart of democratic culture.There is no one in America better to write on this topic. One of the country's most accomplished poets, Robert Pinsky served an unprecedented two terms as America's Poet Laureate and led the immensely popular multimedia Favorite Poem Project, which invited Americans to submit and read aloud their favorite poems. Pinsky draws on his experiences and on characteristically sharp and elegant observations of individual poems to argue that expecting poetry to compete with show business is to mistake its greatest democratic strength--its intimate, human scale--as a weakness.As an expression of individual voice, a poem implicitly allies itself with ideas about individual dignity that are democracy's bedrock, far more than is mass participation. Yet poems also summon up communal life.. Even the most inward-looking work imagines a reader. And in their rhythms and cadences poems carry in their very bones the illusion and dynamic of call and response. Poetry, Pinsky writes, cannot help but mediate between the inner consciousness of the individual reader and the outer world of other people. The first is that a miracle, understood as an event produced by a transcendent agent overriding the usual course of nature, involves a violation of the laws of nature. Larmer argues that events are explained by reference to both relevant laws and units of mass/energy in the sequences to be explained. He contends that a miracle need not be conceived as involving a violation of natural law, but rather as the creation or annihilation of mass/energy by a transcendent (...) agent. In reply to the objection that this account would violate the first law of thermo-dynamics, he distinguishes two forms of the principle -- one metaphysical, one scientific -- and aruges that a miracle would not violate the principle considered as a scientific law. The second assumption is that miracle testimony cannot serve as evidence for theism. Larmer demonstrates that the logical ties connecting the concept of miracle to theism need not imply that one must be a theist to evaluate miracle testimony properly. All that is required is that one is prepared to entertain theism as a hypothesis. Attacking these assumptions allows Larmer to show that Humean balance-of-probabilities arguments, based on a presumed conflict between evidence which establishes belief in the laws of nature and evidence in favour of miracles, miss the point if miracles need not be defined as violations of the laws of nature. He argues that, in the absence of a general argument demonstrating that the testimonial evidence in favour of miracles conflicts with the evidence for the laws of nature, it is up to the atheist to demonstrate, on a case-by-case basis, why the testimonial evidence is to be rejected. His conclusion is that, contrary to what is usually thought, the burden of proof lies not upon the shoulders of the theist, but upon the shoulders of the atheist. (shrink)

"This is an exceedingly long short book, stretching at least fifty thousand years into the past and who knows how many into the future." So begins Visions of the Future, the prophetic new book by eminent economist Robert Heilbroner. Heilbroner's basic premise is stunning in its elegant simplicity. He contends that throughout all of human history, despite the huge gulf in social organization, technological development, and cultural achievement that divides us from the earliest known traces of homo sapiens, there (...) have really only been three distinct ways of looking at the future. During a period Heilbroner refers to simply as the Distant Past, stretching from prehistory to the appearance of modern nation-states in seventeenth century Europe, there was no notion of a future measurably and materially different from the present or the past. From the Stone Age to the Bronze, Mesopotamia and Egypt to Greece and Rome, and throughout the Middle Ages, a continuum of cultures and civilizations shared one defining expectation--the absence of any expectation of material progress for the great masses of people. Heilbroner maintains that it was not until the first stirrings of the period he refers to as Yesterday, spanning from roughly 1700 to 1950, that the future entered into human consciousness as a great beckoning force. Capitalism, continually reinvigorated by the seemingly endless forward march of science and an evolving sense of democracy, appeared to promise all levels of society some expectation of a future at least somewhat better than the past. It was this unwavering faith in the superiority of the future that separated Yesterday from the age we have now entered, that of Today. While we are still driven towards tomorrow by the same forces that determined the recent past, the lessons of Hiroshima and Chernobyl, the chaos in the former Soviet Union, the stagnation of the West, and the anarchic rage unleashed in our inner cities and in hot spots around the globe have brought on a palpable anxiety that is quite apart from both the resignation of the Distant Past or the bright optimism of Yesterday. In a brilliant conclusion drawing together the threat of nuclear blackmail, global warming and the growing commodification of life represented by video games, voice mail, and VCRs, Visions of the Future issues a call to face the challenges of the twenty-first century with a new resolve strengthened by the inspiration of our collective past. In The Occasional Human Sacrifice: Medical Experimentation and the Price of Saying No, bioethicist Carl Elliot seeks to understand people who blow the whistle on unethical human research projects. The book compares whistleblowers in six scandals, and Elliot's main explanation for why someone becomes a whistleblower is personal honor. Exploring what led to or might have prevented these scandals, Elliot is critical of institutional review boards, and he links research ethics violations to injustices in everyday clinical care and medical training (...) and to power imbalances in medical institutions. Some of the clinical and scientific details in the cases suggest other moral and ethical problems and the increasing irrelevance of the practice-research distinction. Whistleblowers are also needed for the mass experiments that occur when practices diffuse without robust evidence and for the structural inequalities on which American clinical care, teaching, and research depend. A material object is constituted by a sum of parts all of which are essential to the sum but some of which seem inessential to the object itself. Such object/sum of parts pairs include my body/its torso and appendages and my desk/its top, drawers, and legs. In these instances, we are dealing with objects and their components. But, fundamentally, we may also speak, as Locke does, of an object and its constitutive matter—a “mass of particles”—or even of that aggregate (...) and the sum of subatomic particles ‘making it up’. The “problem of material constitution” (henceforth, PMC) is generated by assuming inter alia that the members of any such pair are numerically identical, that is, that the constituted and the constituting are one and the same thing. The rapid commercialization of applied genetics in the mtd-1970s, accompanied by a sudden rise in academic-corporate partnerships, raised questions about the impacts these linkages have had on the social and professional norms of scientists. The extent and pattern of faculty tnvolvement in commercialization of biological research is largely an unexplored area. This article provcdes a quantitative assessment of the linkages between biology faculty in American uncverscties and the newly formed biotechnology industry. The results of thes study, covering the period 1985-88, (...) show that academic scientists responded en masse to participating in the commercialization of genetecs research by estabhshmg formal associations with many of the new biotechnology compances. A data base consisting of 889 U.S. and Canadian biotechnology companies and 832 sccentcsts who had formal ties to them was developed over a four-year period. The patterns of academic-corporate Icnkages are revealed by institution. Three universities with the most commercially active faculty are Harvard, Stanford, and MIT. Of the 359 bcomedeca! scientists and geneteccsts who were members of the Nateonal Academy of Sceences, at minimum, 37% had formal ties with the biotechnology industry. (shrink)

A “frame of reference” is a standard relative to which motion and rest may be measured; any set of points or objects that are at rest relative to one another enables us, in principle, to describe the relative motions of bodies. A frame of reference is therefore a purely kinematical device, for the geometrical description of motion without regard to the masses or forces involved. A dynamical account of motion leads to the idea of an “inertial frame,” or a reference (...) frame relative to which motions have distinguished dynamical properties. For that reason an inertial frame has to be understood as a spatial reference frame together with some means of measuring time, so that uniform motions can be distinguished from accelerated motions. The laws of Newtonian dynamics provide a simple definition: an inertial frame is a reference-frame with a time-scale, relative to which the motion of a body not subject to forces is always rectilinear and uniform, accelerations are always proportional to and in the direction of applied forces, and applied forces are always met with equal and opposite reactions. It follows that, in an inertial frame, the center of mass of a system of bodies is always at rest or in uniform motion. It also follows that any other frame of reference moving uniformly relative to an inertial frame is also an inertial frame. For example, in Newtonian celestial mechanics, taking the “fixed stars” as a frame of reference, we can determine an inertial frame whose center is the center of mass of the solar system; relative to this frame, every acceleration of every planet can be accounted for as a gravitational interaction with some other planet in accord with Newton 's laws of motion. Too often critics and proponents of Ayn Rand's work have overlooked her contribution to debates in the twentieth century over the role of the novel in an age of mass politics. Echoing many midcentury literary critics, Rand defended the novel as an essential tool in countering the ideological passions that had led to recent political terrors. But Rand abandoned the notion of the novel as merely a fictional representation of the world as it is and instead blended realism and (...) romance to show the world as it should be, a revolutionary impulse that countered liberal understandings of the novel.
