2006 wurde an der Washington University in St.Louis, USA, ein Seminar veranstaltet, das sich mit der Rezeption von Kelsens Lehre in verschiedenen Staaten befasste. Einige der Referenten stellten ihre Beiträge für diesen Band zur Verfügung.

Versteht man unter dem Poetischen nicht allein das in der dichterischen Phantasie verankerte Vermögen, schöne Scheinbilder zu schaffen, sondern darüber hinaus - und mit dem griechischen Wortstamm im Einklang - die allgemeine menschliche Verfertigungskraft, dann kann Fichtes Wissenschaftslehre als echt poetische - richtiger gesagt: poietische - Philosophie genommen werden. Die Grundideen derselben kreisen seit ihrer ersten Formulierungen um das Wesen jeglicher Tätigkeit, welche diesen Namen verdient. Sie will also die Akte und Strukturen ans Licht bringen, die der Konstitution der Objekte (...) zugrunde liegen. So haben anfänglich die Figur der schwebenden Einbildungskraft, das Konzept des Genies als des Urfreiseins sowie der Gedanke des ins Unendliche gehenden Handelns des Geistes die Funktion, die Gestaltungsweise der Welt oder des Seins selbst als solche zu erklären. Auch die später herausgearbeiteten Begriffskonstellationen dienen diesem Zweck. Das im Bilde des Absoluten verschwindende, um sich daraus wieder abzuleitende, wissende Ich einerseits und die religiös bestimmte Einstellung des lebendigen Subjekts zu seinem Grunde und zur gegenständlichen Welt andererseits können als Vertiefung früherer Fassungen betrachtet werden. Eben diese Begriffskonstellation versuchen wir im Folgenden näher zu untersuchen, und zwar aus dem Gesichtspunkte der Schellingschen Philosophie der Mythologie, denn wir sind der Meinung, dass erst diese Perspektive den eigentlichen Sinn und den wahren Ort der Fichteschen Lehre vom Absoluten sehen lässt. Konfuzius, Chinas grosser Weiser, ist 1974 wieder einmal von seinen modernen Landsleuten unter Beschuss geraten. In diesem Buch wird das radikal-kritische Bild, das man damals von Konfuzius aufstellte, anhand der Originalquellen uberpruft. Durch diese Methode der Gegenuberstellung versucht der Autor zu zeigen, dass die wahren Anliegen des Meisters und seiner Schule klarer und aktueller zutage treten. Insbesonde sollte deutlich werden, dass Konfuzius' tiefe Einsichten in das menschliche Wesen von einem unerschutterlichen, religios zu nennenden Glauben getragen wurden. In der Post-Mao-Ara sind (...) die Konfuziuskritiker bereits langst wieder selber kritisiert und der Meister teilweise positiver bewertet worden. Der Anhang gibt davon ein gutes Beispiel. Fur den nicht eingeweihten westlichen Leser aber ist die innerchinesische Konfuziusdiskussion nicht ohne weiteres verstandlich. Daher bemuht sich der Autor, die wichtigsten Daten uber Leben und Lehre des Meisters systematisch zu rekonstruieren. Manche Einzelheiten werden dabei neu uberpruft, und die vielen Zitate sind alle neu ubersetzt worden. Somit durfte diese Studie fur Fachleute wie auch fur Laien von Interesse sein. Konfuzius, Chinas immer wieder entthronter Heiliger, der ubrigens nie einen Thron innehatte, wird in seinem Lande noch lange Zeit aktuell bleiben. Daruberhinaus bleibt er eine der grossen Gestalten der Weltgeschichte, die der Menschheit in der Suche nach der wahren Menschlichkeit leuchtend vorangegangen sind.". (shrink)

Während seines Aufenthalts in Löwen machte Bellarmin Bekanntschaft mit einer humanistisch geprägten Exegese, wie sein Brief an Kardinal Sirleto zeigt, in dem es um die Autorität der Vulgata und deren Verhältnis zu den biblischen Sprachen geht. Auch später wird er sich auf Löwener Theologen berufen. Er war also gut vorbereitet, als er den Auftrag erhielt, an der Revision der durch Papst Sixtus V. publizierten Bibel mitzuwirken, deren Korrekturbedürftigkeit Bellarmin erkannt hatte. Um das Ansehen des Papstes zu schonen, schlug er vor, (...) die Bibel aus dem Verkehr zu ziehen. Der Konsequenzen eines solchen Schritts für das höchste Amt war er sich bewusst. Der in diesem Kontext von Bellarmin verfasste Traktat plädiert für eine weite Interpretation des Trienter Vulgatadekrets. Die Rolle der biblischen Sprachen wird ebenso betont wie die Schwierigkeiten einer Revision des lateinischen Textes. Bellarmins Haltung gegenüber der Sixtusbibel, die sich aufgrund der Bulle Aeternus ille infallibler Autorität zu erfreuen schien, trug ihm später von Jesuiten der Universität Ingolstadt den Vorwurf ein, gegen die Lehre von der päpstlichen Unfehlbarkeit verstoßen zu haben. Robert John Ackermann deals decisively with the problem of relativism that has plagued post-empiricist philosophy of science. Recognizing that theory and data are mediated by data domains (bordered data sets produced by scientific instruments), he argues that the use of instruments breaks the dependency of observation on theory and thus creates a reasoned basis for scientific objectivity. Originally published in 1985. The Princeton Legacy Library uses the latest print-on-demand technology to again make available previously out-of-print books from the distinguished (...) backlist of Princeton University Press. When a new, brain-based definition of death was proposed fifty years ago, no one realized that the issue would remain unresolved for so long. Recently, six new controversies have added to the debate: whether there is a right to refuse apnea testing, which set of criteria should be chosen to measure the death of the brain, how the problem of erroneous testing should be handled, whether any of the current criteria sets accurately measures the death of the brain, whether standard (...) criteria include measurements of all brain functions, and how minorities who reject whole-brain-based definitions should be accommodated. These controversies leave little hope of consensus on how to define death for social and public policy purposes. Rather, there is persistent disagreement among proponents of three major groups of definitions of death: whole-brain, cardiocirculatory or somatic, and higher-brain. Given the persistence and reasonableness of each of these groups of definitions, public policy should permit individuals and their valid surrogates to choose among them. (shrink)

In this article the author adduces a non‐positivist argument for a necessary connection between law and morality; the argument is based on the claim to correctness, and it is directed to an attack stemming from Eugenio Bulygin. The heart of the controversy is the claim to correctness. The author first attempts to show that there are good reasons for maintaining that law necessarily raises a claim to correctness. He argues, second, for the thesis that this claim has moral implications. Finally, (...) he attempts to refute Bulygin's objection that the claim‐based argument for non‐positivism boils down to contradiction and triviality. (shrink)

In the debate between positivism and non-positivism the argument from relativism plays a pivotal role. The argument from relativism, as put forward, for instance, by Hans Kelsen, says, first, that a necessary connection between law and morality presupposes the existence of absolute, objective, or necessary moral elements, and, second, that no such absolute, objective, or necessary moral elements exist. My reply to this is that absolute, objective, or necessary moral elements do exist, for human rights exist, and human rights exist (...) because they are justifiable. (shrink)

Bender, Robert Review of: Women in Cambridge: A Men's university - though of a mixed type, by Rita McWilliams-Tullberg, Gollancz 1975, 255 pp.

The author outlines his thesis that legal discourse is a special case of general practical discourse (Sonderfallthese) and develops it as an attempt to cover both the authoritative, institutional, or real and free, discursive, or ideal dimension of legal reasoning. On this basis, he examines the objections raised by Habermas (1996) to the special case thesis. First, he discusses the reduction of general practical discourse to moral discourses (genus proximum problem) holding that the former is a combination of moral, ethical, (...) and pragmatic arguments within the priority of just; second, he examines the objection that general practical arguments change their character or nature when employed in legal contexts (subset and specification problem) and the related problems concerning legal validity and unjust law. He concludes proposing a procedural (opposite to a coherential) integration of general practical arguments in the legal context. (shrink)

Wehmeier [2012] argues that identity is a problematic relation and that we can eliminate all mention of it. In this note I show, to the contrary, that if identity is problematic then Wehmeier has not given us the means to dispense with it.

This paper argues that deep disagreements stem from conflicting worldviews. In particular, I examine how recent moves in engineering education contribute to deep disagreement by inculcating stu-dents into valuing the environment as a key stakeholder in engineering design. However, some graduates who value the environment meet resistance from employers who hold a more traditional engineering worldview, which regards the environment as an externality. Clashing worldviews can, as Robert Fogelin posited, render rational resolution to argument impossible. Disputants must consider the (...) emotional and rhetorical as means to move toward productive ground for argument. I offer two moves from classical rhet-oric–making an exordium and invoking friendliness–as means to shift the frame of an argument and there-by possibly navigate a deep disagreement. (shrink)

In this article, I take up two arguments in favor of the discursive model of legal argumentation: the claim to correctness argument and the dual nature thesis. The argument of correctness implies the dual nature thesis, and the dual nature thesis implies a nonpositivistic concept of law. The nonpositivistic concept of law comprises five ideas. One of them is the special case thesis. The special case thesis says that positivistic elements, that is, statutes, precedents, and prevailing doctrines, are necessary for (...) law in order to achieve legal certainty. Without this, law would not be as perfect as it could possibly be. But it says, at the same time, that this alone would not be enough to fulfill the claim to correctness. The claim to correctness refers not only to the real dimension of law, defined by statutes, precedents, and prevailing doctrines, but also to its ideal dimension, defined, first and foremost, by justice. The special case thesis is my oldest thesis. It has remained an essential element of my system over the years. Its connection with four other theses—the Radbruch formula, the human rights thesis, the idea of deliberative democracy, and principles theory—does not change this at all. On the contrary, this connection has lent greater strength to the special case thesis. (shrink)

The term applied ethics can be controversial if it is taken to imply that ethical theory from philosophy or religious ethics has to be the starting point for ethical analysis of some practical field such as medicine or law or politics. The term can be understood as requiring some premises from an (...) ethical theory that are then "applied" to some problem area, as a "top down" way of doing the work of moral reflection in a way that axioms in geometry are applied to present proofs of mathematical claim.The publication of an important work in the history of medical ethics, A History of Medical Ethics, provides an opportunity to reflect more carefully on what applied ethics means. That massive multi-authored volume edited by Robert Baker and Laurence McCullough (2007) is scheduled for publication this fall. With the permission of the Press, we have asked Baker and McCullough to prepare an article-length version of one of the central essays in that work. Their paper challenges the idea that ethical theory should be "applied" to medicine or other fields, putting forth an alternative of the "appropriation" of an ethical theory by the formulation of concepts, principles, moral rules, or other specifications that may turn out to be unique or at least modified for the particular field in question.In this issue of the Kennedy Institute of Ethics Journal, we publish the Baker-McCullough article together with five critical commentaries. We include two medical historians who have a sustained commitment to studying the history of ethics in medicine, two systematic ethicists who have an unusual level of commitment to studying ethics historically, and a physician with unusual sensitivity to the history of medical ethics. Each comments on the Baker-McCullough thesis and offers an alternative view of the link between ethical theory and the field of biomedical ethics.Daniel Fox triggered some of the initial reflection on the history of medical ethics in the 1970s. His work is discussed by Baker and McCullough. Albert Jonsen, as a member of the National Commission, concentrates on the Belmont Report, showing how he sees the report appropriating philosophical ethics.Tom Beauchamp, who was the primary staff person responsible for the report, provides a somewhat different read on the report and particularly on the role of Kantian ethics in the report's discussion of autonomy. According to the author there is no doubt that one has to distinguish between the justification and the application of norms. Problems are seen only to arise if one asks what exactly the distinction is and which consequences have to be drawn from it. Recently, Klaus Günther, in particular, has searched for this distinction and connected it with far‐reaching conclusions concerning the theory of norms, arguments, and morals. His theses are the object of the author's considerations.

This book argues that the primary function of human thinking in language is to make judgments, which are logical-normative connections of concepts. Robert Abele points out that this presupposes cognitive conditions that cannot be accounted for by empirical-linguistic analyses of language content or social conditions alone. Judgments rather assume both reason and a unified subject, and this requires recognition of a Kantian-type of transcendental dimension to them. Judgments are related to perception in that both are syntheses, defined as the (...) unity of representations according to a rule/form. Perceptual syntheses are simultaneously pre-linguistic and proto-rational, and the understanding makes these syntheses conceptually and thus self-consciously explicit. Abele concludes with a transcendental critique of postmodernism and what its deflationary view of ontological categories—such as the unified and reasoning subject—has done to political thinking. This paper has three parts. The first outlines the history of Nestorianism. From the end of the fifth century all the way into the thirteenth century, quite a large population—in fact most Christians in Asia—belonged to branches of the Nestorian church. The second part provides a brief biography of Nestorius, after whom this church was named. The third part explores two elements of Nestorius’s christology, as they are found in his posthumously discovered theological writings. Does Christ have one nature or (...) two, and if two, how can one person have two natures? To what extent was Adam, the first man, created for a role that Christ eventually fulfilled? (shrink)

Mein Aufsatz ist eine kritische Auseinandersetzung mit dem kürzlich erschienenen Buch Leibniz andArnauld von Robert Sleigh. Ich versuche zu zeigen, daß Sleigh bei seiner Argumentation gegen die Ansicht, daß Leibniz Superessentialist gewesen sei, den entscheidenden Unterschied übersieht zwischen individuellen und allgemeinen essentiellen Eigenschaften und er sich auf eine eindeutig falsche Interpretation der relevanten Texte stützt; außerdem, daß Sleighs Zuordnung der Lehre der , superintrinsicalness' zu Leibniz sowohl textlich nicht begründet als auch formal mehrdeutig ist, und daß Sleighs Analyse der (...) Begriffe Kompossibilität und Akkomodation zu wünschen läßt. Ich versuche auch -im Gegensatz zu dem, was eine Anzahl von Leibniz-Interpreten in letzter Zeit behauptet hat -zu zeigen, daß sich Leibniz auf possibilia vor allem mit der Absicht bezog, eine Interpretation von kontrafaktischen Aussagen und Kontingenz zur Verfügung zu stellen.
