Codes of professional ethics and cases designed to teach ethical decision making are written for individual professionals and ignore the systems level of analysis. They typically employ a lineal view of causality and overvalue placement of blame as a component of ethical problem solving. This article takes a systems approach to ethical problems and identifies aspects of systems that promote or impede ethical decision making. This thesis is about making decisions when we are uncertain about what will happen, how valuable it will be, and even how to make decisions. Even the most sure-footed amongst us are sometimes uncertain about all three, but surprisingly little attention has been given to the latter two. The three essays that constitute my thesis hope to do a small part in rectifying this problem. The first essay is about the value of finding out how to make decisions. Society spends (...) considerable resources funding people (like me) to research decision-making, so it is natural to wonder whether society is getting a good deal. This question is so shockingly underresearched that bedrock facts are readily discoverable, such as when this kind of information is valuable. My second essay concerns whether we can compare value when we are uncertain about value. Many people are in fact uncertain about value, and how we deal with this uncertainty hinges on these comparisons. I argue that value comparisons are only sometimes possible; I call this weak comparability. This essay is largely a synthesis of the literature, but I also present an argument which begins with a peculiar view of the self: it is as if each of us is a crowd of different people separated by time (but connected by continuity of experience). I’m not the first to endorse this peculiar view of the self, but I am the first to show how it supports the benign view that value is sometimes comparable. We may be uncertain of any decision rules, even those that would tell us how to act when we face uncertainty in decision rules. We may be uncertain of how to decide how to decide how to... And so on. If so, we might have to accept infinitely many decision rules just to make any mundane decision, such as whether to pick up a five-cent piece from the gutter. My third essay addresses this problem of regress. I think all of our decisions are forced: we must decide now or continue to deliberate. Surprisingly, this allows us to avoid the original problem. This paper analyzes the main features of rational choice theory and evaluates it with respect to the conceptions of Lakatos' research program and Laudan's research tradition. The analysis reveals that the thin rationality assumption, the axiomatic method and the reduction to the micro level are the only features shared by all rational choice models. On these grounds, it is argued that rational choice theory cannot be characterized as a research program. This is due to the fact that the thin rationality (...) assumption cannot be understood as a hard core in Lakatos' terms. It is argued that Laudan's conception of a research tradition better characterizes rational choice theory. On the basis of this conclusion, certain important criticisms of rational choice theory are answered. First, the criticisms concerning the core assumptions of rational choice theory are countered. It is argued that this critique is based on a misunderstanding of rational choice theory as a unified set of models, such as Lakatos' research program. Second, Green and Shapiro's rational choice 'pathologies' - inconsistent predictions, post hoc theory development and arbitrary domain restrictions - are evaluated. Contrary to Green and Shapiro, it is argued that post hoc theory development is a more preferable strategy for developing RCT than domain restrictions based on ex ante rules. (shrink)

This short article discusses the nature of research and art practice and makes a case for the necessary intermingling of these activities. It does not attempt to define a space for art to operate as research, quite the opposite: research is an operating structure for the process and production of, among other things, art. It is regarded as integral to the processes of thinking, making, and reflecting, and it is important to note that curiosity, creative enquiry, and critical reflection underpin (...) much that is considered research in various fields. The author asserts that these processes are not necessarily discipline-specific although particular disciplines have specific procedures and goals. It is argued that "provisionality" is central to what art can offer other disciplines; it can make a virtue of incompleteness. The author suggests that art open itself up to quizzical scrutiny and help others to recognise that research has long been, and will continue to be, a driving force within its makeup. The article posits an expanded notion of the artwork that is essentially provisional and reliant on spectatorial involvement. (shrink)

How does mutual intelligibility impact the political sphere? This paper uses Wittgenstein’s Philosophical Investigations as a means of examining this connection. I argue that Wittgenstein’s paradigm of a dialectical world suggests that his analysis of mutual intelligibility in understanding experiences is necessary in a pluralistic democracy. I conclude that via his theory of social reality politics is a dynamic dialectical process of communicating experiences.

Trait Selective Abortions (TSA) have come under critique as a medical practice that presents potential disabled infants as burdens and lacking the potential for meaningful lives. This paper, using the author’s background as a disabled person, contends that the philosophy underpinning TSAs reflects liberal society’s lack of a theory of needs. The author argues for a care ethics based approach informed by disability analyses to engage with TSAs.

Can friendship as a political practice offer enough traction to imagine a borderless world? The startling contemporary rise in aggressive ethno-nationalism and end-times ecological crises have the same root: an inability to be together with humans as much as the natural world. Arrhenius and Rabinowicz have argued that Millian qualitative superiorities are possible without assuming that any pleasure, or type of pleasure, is infinitely superior to another. But AR's analysis is fatally flawed in the context of ethical hedonism, where the assumption in question is necessary and sufficient for Millian qualitative superiorities. Marginalist analysis of the sort pressed by AR continues to have a valid role to play within any plausible version of hedonism, provided the fundamental incoherence that infects AR's use of (...) such analysis is removed. But what AR call ‘Millian superiorities’ are never genuine qualitative superiorities in Mill's sense. Mill scholars need to appreciate this point and recognize that the interpretation of qualitative superiorities as infinite superiorities is the only interpretation which is compatible with the text of Mill's Utilitarianism. The continuing failure to appreciate the possibility of infinite superiorities has precluded any adequate understanding of the extraordinary structure of Mill's pluralistic hedonistic utilitarianism. Heyman's analysis of addiction suggests that drug taking is irrational. The irrationality of drug taking, however, may depend on the acceptance of mainstream society's view of what is valuable. Consideration of the addict's viewpoint and cultural aspects of drug taking may be useful in trying to fathom the “rationality” of drug taking.

Mister Rogers’ Neighborhood was a show that focused on teaching children an ethics of caring for oneself and care for others. This article examines those ethics through the songs “I Like You As You Are” and “Won’t You Be My Neighbor.” It contends that these songs focus on a celebration of the self and others, welcoming individuals as they are into the community, and embracing authenticity. This article looks to understand these ethics in a contemporary setting and argues that Mister (...) Rogers and the communal ethics of care that he taught are needed. (shrink)

In some areas of cognitive science we are confronted with ultrafast cognition, exquisite context sensitivity, and scale-free variation in measured cognitive activities. To move forward, we suggest a need to embrace this complexity, equipping cognitive science with tools and concepts used in the study of complex dynamical systems. The science of movement coordination has benefited already from this change, successfully circumventing analogous paradoxes by treating human activities as phenomena of self-organization. Therein, action and cognition are seen to be emergent in (...) ultrafast symmetry breaking across the brain and body; exquisitely constituted of the otherwise trivial details of history, context, and environment; and exhibiting the characteristic scale-free signature of self-organization. Proposals to release genetically engineered organisms in the wild raise complex ethical issues related to their safe and equitable implementation. While there is broad agreement that community and public engagement is vital to decision‐making in this context, more discussion is needed about who should be engaged in such activities and in what ways. This article identifies Indigenous peoples as key stakeholders in decisions about gene‐editing in the wild and argues that engagement activities need not only include Indigenous peoples but also (...) be designed, conducted, and analyzed in ways that confront longstanding power imbalances that dismiss Indigenous expertise. We offer specific recommendations to guide deliberative activities to not only be inclusive of Indigenous peoples but also to empower their diverse, situated knowledges. We call on those committed to the inclusive design of broad public deliberation to pursue strategies that shift dominant power dynamics to include Indigenous communities in more meaningful ways. The paper concerns the essential and permanent place of roles and rules in human life, or what I call ‘the dilemma of compliance.’ The paper begins with previous scholarship warning therapists and psychologists about the danger of unknowingly reinforcing violent and toxic social expectations. A distinction is drawn between conformity and compliance, with the former standing for rote and mindless following of rules, and the latter a self-conscious and flexible way of relating to rules and roles. The paper argues that (...) following rules and filling roles is unavoidable, and, consequently, a human life is always a double-life, divided between pre-existing, generic roles, and our private and unique way of relating to those roles. The crucial difficulty is learning to comply with rules and roles rather than merely conforming to them. Two extreme cases are examined to develop this problem of rules, roles, and living a double-life: schizophrenia and censorship. It is argued that schizophrenia and censorship are cases in which the place of rules and roles become overbearing and urgent. Finally, the paper argues that attention to the dilemma of compliance highlights the significance of trauma-informed care, as trauma is often connected to how one fits or does not fit into a social milieu constituted by roles, rules, and expectations. The arguments are developed primarily in historical, philosophical, and clinical terms. (shrink)

Theories of deliberative democracy maintain that outcomes of democratic deliberation are fairer than outcomes of mere aggregation of preferences. Theorists of impartial justice, especially Rawls and Sen, emphasize the role of deliberative processes for making just decisions. Democratic deliberation seems therefore to provide a model of impartial decision-making applicable in the real world. However, various types of cognitive and affective biases limit individual capacity to see things from others’ perspectives. In this paper, two strategies of enhancing impartiality in real world (...) decision-making are discussed. The first involves decision-making processes which detach decision-makers from their particular interests, whereas the second aims to enhance the quality of democratic deliberation and empathetic reasoning. We conclude that new forms of democratic deliberation may be necessary if we hold on to the aspiration of making decisions which are both democratic and impartial. (shrink)

Against Schmidt-Petri's claim, I argue that John Stuart Mill is committed to the view that one pleasure is higher in quality than another if and only if at least a majority of those people who are competently acquainted with both always prefer the one no matter how much of the other is offered. I support my reading with solid textual evidence; none such is provided by Schmidt-Petri in support of his contrary interpretation that qualitative superiority exists whenever the experienced prefer (...) less of one pleasure to more of another. The decisive objection to this is its incompatibility with the hedonistic requirement that more pleasure ought to be preferred to less, a requirement so fundamental that it would be uncharitable to suppose that Mill lost sight of it in his doctrine of higher pleasures. Accountability is present in many types of social relations; for example, the accountability of elected representatives to voters is the key characteristic of representative democracy. We distinguish between two institutional mechanisms of accountability, i.e., opportunity to punish and requirement of a justification, and examine the separate and combined effects of these mechanisms on individual behavior. For this purpose, we designed a decision-making experiment where subjects engage in a three-player trust game with two senders and one responder. We ask whether holding (...) the responder accountable increases senders’ and responders’ contributions in a trust game. When restricting the analysis to the first round, the requirement of justification seems to have a positive impact on senders’ contributions. When the game is played repeatedly, the experience of previous rounds dominates the results and significant treatment effects are no longer seen. We also find that responders tend to justify their choices in terms of reciprocity, which is in line with observed behavior. Moreover, the treatment combining punishment and justification hinders justifications that appeal to pure self-interest. (shrink)

Geoffrey Scarre has recently argued that the version of qualitative hedonism which I attribute to Mill is unsatisfactory for various reasons. In his view, even if it is formally compatible with value monism, involves non-hedonistic elements and offers an implausible account of the relationship between and pleasures. In this paper, I show that his objections, which are similar in spirit to those pressed earlier by Bradley, Moore and others against Mill, are unfounded where not confused. The Mill/Riley line does (...) not rely on non-hedonistic standards and has sufficient flexibility to account for many different kinds of pleasures and pleasing activities. It remains a coherent version of qualitative hedonism, worthy of further consideration and study. (shrink)

Mill's free speech doctrine is distinct from, yet compatible with, his central principle of ‘purely self-regarding’ liberty. Using the crucial analogy with trade, I claim that he defends a broad laissez-faire policy for expression, even though expression is ‘social’ or other-regarding conduct and thus legitimately subject to social regulation. An expedient laissez-faire policy admits of exceptions because speakers can sometimes cause such severe damage to others that coercive interference with the speech is justified. In those relatively few contexts where interference (...) is called for, however, the central principle of self-regarding liberty sets absolute limits to the scope of society's regulatory authority. Regulation can never amount to an outright ban of any type of expression that can be consumed by the individual without direct and immediate harm to others. Nevertheless, and perhaps surprisingly, the central liberty principle admits censorship of certain extraordinary types of expression which necessarily harm others. (shrink)

The paper is, above all, meant to caution or warn providers of subtle but serious harm that can occur in institutional settings. I want to attune providers to the ways in which institutional coercion and violence occur in the ordinary process (...) of following rules and filling of roles. Thus I write that the goal is “to become self-conscious observers of systems of compliance, rather than unconscious conformers.” Institutional coercion is a social process like any other and thus involves intersubjective dynamics. These dynamics do not appear as measurable, physical structures, but rather as invisible patterns in time, made visible only by being named and grasped experientially. I am offering language that can help make these invisible dynamics visible, so that providers can navigate institutions differently.My desire to caution and attune other providers can be explained partly by the conditions in which I wrote the paper: making sense of my time in forensic mental health, where I worked with clients who were mandated mental health treatment upon avoiding or exiting incarceration. I was processing my own experience of submitting monthly “compliance reports” to various agencies. I was concerned with the experiential process of navigating coercive environments. Thus my commenter is correct to try and widen our consideration, as my paper is indeed limited by its focus on the lived experience of censorship, oppression, and institutional coercion.This emphasis means that I am neglecting other dimensions, such as the positive role of rules in organizing communities, and the way in which some mental health institutions are working on creating safe and healing formal environments. I also believe, however, that the fields of psychology, psychiatry, and mental health broadly need to be careful about institutions, rules, and roles. We are not, in my estimation, in danger of providing too many safe spaces in which healing can occur. Quite the opposite, psychiatry and psychotherapy have, since their outset, been intertwined with troubling political motivations, and we continue to struggle with the manipulative tendencies of the field (Carr, 2018; Cabanas & Illouz, 2021).I, therefore, would like to take this opportunity to restate the core argument of my paper, and to situate this argument within the context of my other publications and the overall project they belong to. There is likely some ambiguity about [End Page 385] the central thrust of my paper. When commenting on my discussion of schizophrenia, my commenter refers to it as “the seeming central topic of the paper.” This is understandable. Schizophrenia is the topic I discuss that has the most obvious clinical implications. Indeed, I am making an argument about the phenomenological intelligibility of schizophrenia. With both my discussions of schizophrenia and censorship, however, I am making both immanent arguments and transcendent arguments. In other words, although I am making arguments about both schizophrenia and censorship, those arguments need to be understood as an example of a broader problem of coercion within human relationships. My intent is to highlight general dynamics present within human relationships and communities that contribute to institutional violence and the excessive regulation of individuals. My concern is with rules, roles, and coercion in general; schizophrenia and censorship provide exaggerated examples of what is fundamentally an ordinary, daily experience. Mental health institutions are uniquely involved in coercive institutional processes, but almost all human environments carry some danger of coercion and oppression in terms of fitting, belonging, or conforming with rules and roles. My exploration of schizophrenia and censorship is certainly meant to illuminate those particular topics, but the broader point concerns all human experience.The phenomenological or experiential thrust of the paper must be situated within my broader analysis that also includes institutional and epistemological dimensions. My reviewer is correct to point out that with schizophrenia, censorship, or trauma, the crucial dimension is communities in which people feel safe enough to learn, grow, and develop their capacities. Economists have always recognised that human endeavours are constrained by our limited and uncertain knowledge, but only recently has an accepted theory of uncertainty and information evolved. This theory has turned out to have surprisingly practical applications: for example in analysing stock market returns, in evaluating accident prevention measures, and in assessing patent and copyright laws. This book presents these intellectual advances in readable form for the first time. It unifies many important but partial results into a satisfying single picture, (...) making it clear how the economics of uncertainty and information generalises and extends standard economic analysis. Part One of the volume covers the economics of uncertainty: how each person adapts to a given fixed state of knowledge by making an optimal choice among the immediate 'terminal' actions available. These choices in turn determine the overall market equilibrium reflecting the social distribution of risk bearing. In Part Two, covering the economics of information, the state of knowledge is no longer held fixed. Instead, individuals can to a greater or lesser extent overcome their ignorance by 'informational' actions. Not all actions that are legal are necessarily morally correct. However, there are few protections for providers who are pressured to comply with actions and procedures that infringe on their religious beliefs regarding human dignity. The right of health care providers to freely act on religious convictions and refrain from cooperating with morally reprehensible tasks is often eschewed in favor of political correctness or is branded as discrimination. Adequate safeguards are urgently needed for health care workers at all levels to (...) ensure that they can continue to care for the sick and most vulnerable members of the community without violating the dictates of their conscience. This article examines the free exercise of religion as it pertains to medical provider conscience protections. The author argues for conscience protection legislation with a right of action. A paper that explores the extent to which images remain resistant to their assimilation by the linguistic and technical systems that society has developed. It uses Damisch´s theory of /cloud/ to comment upon and refract Flusser´s notion of the technical image, proposing a productive incompleteness that the image continually feeds into our relationship to the world. With the image, laterality is as significant as linearity. Its form does not presuppose how it should be approached or understood; the provisionality heralded by (...) /cloud/ and by the nature of the image can problematise, confound, or even offer an antidote to a systematising drive in the mediated world we inhabit. German philosopher Martin Heidegger stirred educators when in 1951 he claimed teaching is more difficult than learning because teachers must ‘learn to let learn’. However in the main he left the aphorism unexplained as part of a brief four-paragraph, less than two-page set of observations concerning the relationship of teaching to learning; and concluded at the end of those observations that to become a teacher is an ‘exalted matter’. This paper investigates both of Heidegger's claims, interpreting letting learn in the (...) context of Heidegger's larger philosophical project, and suggesting why in light of that project to become a teacher is an exalted concern. The methodology guiding the inquiry is largely hermeneutic, the purpose of the essay to interpret teaching from a Heideggerian perspective: its nature and general method. (shrink)
