Best known as a moralist and one of the founders of the Scottish Common Sense school of philosophy, Thomas Reid was also an influential scientific thinker. Here his work on the life sciences is studied in detail, bringing together unpublished transcripts of his most important papers on natural history, physiology, and materialist metaphysics. Part I provides the first published account of Reid's reflections on the highly controversial theories surrounding muscular motion and the reproduction of plants and animals and relates them (...) to the broader Enlightenment debates on these issues. It also contains the first systematic reconstruction of Reid's opposition to materialism and views his polemics against the noted Dissenter Joseph Priestley in terms of their differing interpretations of the Newtonian legacy, their conflicting philosophical assumptions, and the cultural politics of Common Sense philosophy in the 1770s. Part II reproduces a selection of Reid's most significant papers on the life sciences, including his Glasgow Literary Society discourses on muscular motion and on Priestley's materialism, as well as other manuscripts that document the development of his scientific ideas. There has, over the last few decades, been a considerable growth in the development ‘business’ where, largely western, donors have sought to help the poorer nations develop. Much of this growth has been driven by Christian motivation. Increasingly such projects are being held accountable to try to ensure that the money and the effort being spent are being well spent. The question that is being asked of, and by, development workers is ‘how do we know that we are making a (...) difference?’ and a range of practices have been developed to assess, to measure, to evaluate such effects. Terms like impact assessment, objectives, log-frames, objective verifiable indicators, baselines, clients, have become part of the language. In this paper the author raises various fundamental questions about this practice of evaluating development projects, and in so doing challenges the suitability of some of the current practices for development work. In the discourse of the knowledge-based economy, the link between creativity and innovation is usually taken for granted. However, not only is this link of recent date, it joins together two diametrically opposed concepts: the economic concept of innovation and the humanistic concept of creativity. In research too, there is a lack of enquiry into the nature of the processes of creativity and innovation and into how these processes are similar yet different. Building on the original insights of Henri Poincaré (...) and Joseph Schumpeter, I present the hypothesis that creativity and innovation are similar in nature, not in regard to knowledge or skills, but in that both are ways of relating to the novel. My findings suggest, meanwhile, that creativity and innovation differ in that creativity is about experiencing the novel in the creative process, whereas innovation is about willing the novel as a strategy for the innovative process. Furthermore, my findings suggest that there exists a structural similarity between creativity and innovation and Aristotle’s concepts of practical and philosophical wisdom, in that innovation is a form of practical wisdom in regard to the novel, whereas creativity is a form of philosophical wisdom in regard to the novel. Food is a basic human need and therefore a basic human right. While food output has increased to a level where there is enough food produced to feed the world, still millions starve. Using the concept of capitalist world economy as a framework, this paper provides a structural analysis of the food production and distribution system within monopoly capitalism and its implications for countries of the underdeveloped world. Focusing on the impact of a dominant world food supply system on indigenous (...) systems (particularly through the rise of science, technology, and monopoly capital), considerations relating to environmental use and food production and distribution are raised. Decision-making regarding treatment for newborns with disabilities in resource-poor settings is a difficult process that can put parents and caregivers in conflict. Despite several guidelines that have helped to clarify some of the medical decision-making in Ghana, there is still no clear consensus on the specific moral criteria to be used. This article presents the case of a mother who expressed her wish that her child with Down syndrome should not have been resuscitated at birth. It explores the ethical issues (...) at stake in both her misgivings about the resuscitation and her unwillingness to consider surgical repair of an atrioventricular (AV) canal defect. Knowing that children born with Down syndrome are able to pursue life’s goals, should our treatment of complete AV canal defect in such children be considered morally obligatory, even in resource-poor settings like Ghana? The context in which the British Medical Association first considered publishing specific guidelines on decisions about attempting cardiopulmonary resuscitation , in the early 1990s, needs to be remembered. At that time the subject was often seen as far too sensitive to be mentioned to patients. Many hospitals had no formal policy about how CPR decisions should be made, apart from an expectation that these were purely medical matters. Advance decision making about CPR, where it existed, appears to have been generally (...) on an ad hoc basis by doctors. Patients, their relatives and the rest of the health care team were often unaware of it. After several cases in which nurses had been disciplined–unfairly in the eyes of some–for complying with their patients' known wishes about non-resuscitation in cases where no advance medical decision had been recorded, there was a demand for guidance.The BMA was approached by nurses' representatives with a view to publishing some very basic advice. This advice, issued in 1993 jointly with the Royal College of Nursing, and in association with the Resuscitation Council, was under 1000 words. Whether this brevity reflects difficulties in achieving consensus or lower expectations about what was required is a matter for speculation. Throughout the 1990s the guidance was distributed widely and used as a basis for many hospitals' local policies. Recently, however, the demands on the BMA and other professional bodies for ethical advice have changed and grown. This study aims at investigating vagueness in Security Council Resolutions by focussing on a selection of nouns and phrases used as the main casus belli for the Second Gulf War. Analysing a corpus of Security Council Resolutions relating to the conflict, the study leads a qualitative and quantitative analysis drawing upon Mellinkoff’s theories on “weasel words”, which are “words and expressions with a very flexible meaning, strictly dependent on context and interpretation”. Special attention is devoted to the historical/political consequences (...) of such vague and indeterminate expressions. The findings indicate that excessive vagueness might have led to biased or even strategically-motivated interpretations of the Resolutions, triggering the Iraqi conflict instead of a diplomatic solution. The analysis of the “weasel words” used in the Resolutions suggests the double-faced strength of such expressions: though they can guaranteed a wide degree of applicability of the Resolutions, their subjective interpretability might become a source of manipulation and elusiveness, with the overall legislative intent of using intentional vagueness as a political strategy. Reading fiction for pleasurable is robustly correlated with improved cognitive attainment and other benefits. It is also in decline among young people in developed nations, in part because of competition from moving image fiction. We review existing research on the differences between reading/hearing verbal fiction and watching moving image fiction, as well as looking more broadly at research on image/text interactions and visual versus verbal processing. We conclude that verbal narrative generates more diverse responses than moving image narrative., We note (...) that reading and viewing narrative are different tasks, with different cognitive loads. Viewing moving image narrative mostly involves visual processing with some working memory engagement, whereas reading narrative involves verbal processing, visual imagery and personal memory (Xu et al 2005). but Attempts to compare the two by creating suggest that existing research is flawed by attempts to create equivalent stimuli and task demands face a number of challenges, and we discuss these difficulties in comparative approaches. We then investigate the possibility of identifying lower level processing mechanisms that might distinguish cognition of the two media, and propose a focus on internal scene construction and on working memory as foci for future research. Although many of the sources we draw on are focussed on English speaking participants in European or North American settings, we also cover material relating to speakers of Dutch, German, Hebrew and Japanese in their respective countries, and studies of a remote Turkish mountain community. Our contribute compares the concepts of Japanese and German primary school children relating to the topic of death, healing in the context of values education and the ethics of care. This is a project of the German-Japanese Research Initiative on Philosophizing with Children (DJFPK), cialis 40mg which aims to facilitate individual autonomy by enhancing philosophical-ethical judgment. The study of dialectical logic has a history of nearly one hundred years in China. It is significant for understanding both the growth of Chinese logic and the Sinicization of Marxism to review dialectical logic in the context of introducing the study of Marxism in China. Debates about dialectical logic in Chinese academic circles involve not only the problems of logic itself, but more importantly the understanding of Marxist philosophy. In the 1920s and 1930s, some Marxist researchers in China were (...) influenced by the philosophers and logicians of the former Soviet Union, and they came very close to equating dialectical logic with Marxist dialectics. They also identified the formal logic originating from ancient Greece as metaphysics, praising the former and criticizing the latter. In the upsurge of Marxist philosophy in the 1950s and 1960s, Chinese logicians carried out normal and formal academic research on dialectical logic. During the period from the end of 1970s to the end of 1990s, the research and teaching of dialectical logic in China reached its heyday, and logicians performed comprehensive and detailed research on some critical issues, including the basic laws of dialectical logic, which they tried to formalize. Since the beginning of the 21st century, dialectical logic has ceased to prosper and has faded from the core field of the discipline of logic, although some honorable scholars still persist in studying it. Plato's Dialectical Ethics, Gadamer's earliest work, has now been translated into English for the first time. This classic book, published in 1931 and reprinted in 1967 and 1982, is still important today. It is one of the most extensive and imaginative interpretations of Plato's Philebus and an ideal introduction to Gadamer's thinking. It shows how his influential hermeneutics emerged from the application of his teacher Martin Heidegger's phenomenological method to classical texts and problems. The work consists of two chapters. Despite the existence of biblical laws pertaining to women, Cheryl Anderson, in her work Ancient Laws and Contemporary Controversies, observes that these same laws do not take into account the perspectives of women. Instead, they are formed from a “male perspective” with which female readers learn to identify through “immasculation.” Anderson proposes an alternative, liberationist, and inclusive approach, in which the realities of the marginalized serve as the point of departure, and suggests that one way to perform this task entails (...) observing innerbiblical development between texts, drawing on the work of Terence Fretheim. Similar innertextual changes are also observable between interpretations of scriptural law, in the Dead Sea Scrolls. This essay therefore expands on the work of Anderson to compare certain biblical laws concerning women with examples of rewriting within the Scrolls. This paper examines Kirzner's contribution to the study of the equilibrating tendency in economics. By analyzing his interpretation of Jevons’ law of indifference, we participate in the debate on Kirzner association with neoclassicals when discussing the equilibrating tendency. A reconstruction of Kirzner’s use of Jevons’ law is conducted, considering his argumentative strategy when presenting the Austrian economics ideas to other professionals in the field. We conclude that Kirzner drew close to neoclassical economics to emphasize the relevance and uniqueness of Austrian (...) economics. By doing so, we highlight the main differences between the two currents of economic thought. (shrink)

This paper examines the concept and treatment of divorce in ancient Judea as a historical reality rather than a theological issue, focusing particularly on the idea of the wife as the active party in the divorce. Did women in Judea have the right to initiate divorce? It seems the answer might have been yes. The implications of several key documentary sources, including various marriage and legal contracts relating to divorce are discussed. The paper concludes with a brief look at (...) several scriptural precedents for divorce. Both the historical merit and historiographical problems with these ancient sources are addressed. (shrink)

The objective of this paper is to stimulate academic debate on embryo and fetal research from the perspective of the drafting of a protocol to the European Convention on Biomedicine. Over the last few years the diplomatic language of UN resolutions has repeatedly been questioned for the excessive presence of vagueness. The use of vague terms could be connected to the genre of diplomatic texts, as resolutions should be applicable to every international contingency and used to mitigate tensions between different legal cultures. However, excessive vagueness could also lead to biased or even strategically-motivated interpretations of resolutions, undermining their legal impact and triggering conflicts instead of diplomatic solutions. This study aims (...) at investigating intentional vagueness in Security Council resolutions, by focussing on the analysis of the resolutions relating to the second Gulf war. Using the qualitative Discourse-Historical approach (Wodak in Rhetorics of racism and antisemitism, Taylor & Francis Ltd., London [2000]) and quantitative analysis tools (Antconc and Sketch Engine), special attention is given to the historical/political consequences of the vagueness and indeterminacy used in that framework and to the study of vague ‘weasel words’ (Mellinkoff in The language of the law, Little, Brown & Company, Boston [1963]), modals, and adjectives contained in the corpus. The hypothesis of intentional vagueness is further reinforced through an analysis of the US legislation related to the outbreak of the war, to reveal how the US has legally interpreted UN legislation and to understand the purposes and consequences of vague language contained in it. The findings indicate that vagueness in resolutions has triggered the Iraqi conflict instead of diplomatic solutions with the overall legislative intent of using intentional vagueness as a political strategy. This article summarizes several Canadian court decisions from 2015 onward stemming from wrongful birth and wrongful life litigation. Plaintiff success often turns on whether causation is established, on a balance of probabilities, between a physician’s breach of standard of care and the harm to the parents and/or the child later born. Physicians’ failure to offer or order screening or diagnostic tests has been a source of wrongful birth liability, as too can be failure to ensure patient understanding of results. Physicians (...) should ensure that they recommend diagnostic testing when presented with concerning clinical indications in accordance with professional practice guidance. Given non-invasive prenatal screening’s (NIPS) advantages and the threat of wrongful birth liability for failure to discuss this procedure, it is likely to be propelled into an ever more prominent position as a first-choice offering for aneuploidy screening. Appropriately cautious physician behaviour involves discussing and offering NIPS, and also involves ensuring that results are understood. This can reduce physician liability, improve patient reproductive autonomy, and sometimes benefit patient health by preventing or lessening trauma that informed women may opt to mitigate when granted the opportunity. The legislative sense of law of Kant's first two Critiques shows what conditions must be met to assure that every constituent within an ideal context will be treated equally. The evaluative and judicial sense of law that relates to reflective judgment in the third Critique and can be carried forward to the philosophy of right has the more difficult task of reconciling conflicting interests that manifest themselves in more limited regional contexts.

Thus an attempt was made to determine the community of mechanisms of thought process in the scientific cognition and in the artistic creation. Author talks about peculiarities of music mental experiment and emphasizes its basic functions in musical thought. Therefore, the mental experiment in the sphere of aesthetic activity has its own specific character, whichis not identical with the notion of the mental experiment in the (...) scientific sphere and scientific experience. It shows the greatest importance of rethought the category of “mental experiment” in the musical creation sphere. The study of the mental experiment in the sphere of music, as one of the forms of non-verbal treatment, storage, creation and transfer of information, is of great value, meets the self-reflectiveness necessities of life of individual or the whole society. The aim of this study was to synthesize the concepts from empirical studies and analyze, compare and interrelate them with normative ethics. The International Council of Nurses (ICN) and the Health and Medical Service Act are normative ethics. Five concepts were used in the analysis; three from the grounded theory studies and two from the theoretical framework on normative ethics. A simultaneous concept analysis resulted in five outcomes: interconnectedness, interdependence, corroboratedness, completeness and good care are all related to the empirical (...) perspective of the nurse’s interaction with the older patient, and the normative perspective, i.e. that found in ICN code and SFS law. Empirical ethics and normative ethics are intertwined according to the findings of this study. Normative ethics influence the nurse’s practical performance and could be supporting documents for nurses as professionals. (shrink)

Judge Christian Byk renders service to the Steering Committee on Bioethics of the Council of Europe (CDBI) by proposing a draft of the protocol destined to fill in a gap in international law on the status of the human embryo. This proposal, printed in a previous issue of the Journal of Medical Ethics deserves nevertheless to be questioned on important points. Is Christian Byk proposing to legalise research on human embryos not only in vitro but also in utero?

Marine ecosystems are in serious troubles globally, largely due to the failures of fishery resources management. To restore and conserve fishery ecosystems, we need new and effective governance systems urgently. This research focuses on fisheries management in ancient China. We found that from 5,000 years ago till early modern era, Chinese ancestors had been constantly enthusiastic about sustainable utilization of fisheries resources and natural balance of fishery development. They developed numerous rigorous policies and regulations to guide people to act on (...) natural laws. Being detailed and scientific, the legal systems had gained gratifying enforcement, due to official efforts and folks’ voluntary participation in resource management. In-depth analyses show that people’s consciousness of ecological conservation was derived from the edification of kinds of ancient eco-ethical wisdom, such as totemism, nature worship, Zhou Yi , Taoism, Buddhism, Confucianism, Mohism, etc. All this Chinese classical wisdom have the same cores: “Nature and Man in One” spirit, frugality and “All things are equal” concept. The findings show that eco-ethical thinking is never inconsistent with social ethic systems, and it’s of great importance to give legal effect to usual ecological moral claims and eco-ethical requirements of the public in protecting the environment. The eco-ethical wisdom is efficient in assisting and urging people to fulfill humans’ obligation for nature. Finally, it’s believed that present world fisheries management will benefit a lot from all these ancient Chinese thoughts and practices. People are expected to make the most of the eco-ethical wisdom, strengthen fishery legislation and fully stimulate their voluntary participation in both marine fishery resources conservation and fishery cyclic economy. This paper will discuss the role of modality in UN Security Council resolutions. As a work in progress on whether the use of strategic vagueness in UN resolutions has contributed to the outbreak of the second Gulf war, this work proposes a qualitative and quantitative analysis on the role of vagueness of the central modal verbs shall, should, and may in the institutional language of the UN, drawing upon Wodak’s Discourse-Historical Approach and Jenkins, Gotti, and Trosborg's theories on modality. Observing (...) the semantic and linguistic values of these modals, the analysis investigates their double-faced strength: though they can be used to guarantee a wide degree of applicability of the resolutions, their subjective interpretability might become a source of manipulation and elusiveness, supporting a legislative intent of using vagueness as a political strategy.
