Para matemáticos interesados en problemas de fundamentos, lógico-matemáticos y filósofos de la matemática, el axioma de elección es centro obligado de reflexión, pues ha sido considerado esencial en el debate dentro de las posiciones consideradas clásicas en filosofía de la matemática (intuicionismo, formalismo, logicismo, platonismo), pero también ha tenido una presencia fundamental para el desarrollo de la matemática y metamatemática contemporánea. Desde una posición que privilegia el quehacer matemático, nos proponemos mostrar los aportes que ha tenido el axioma en varias (...) áreas fundamentales de la matemática, su aplicación en la lógica de primer orden, así como una breve descripción de las pruebas de consistencia relativa debidas a Gödel y Cohen, las cuales establecieron su independencia del sistema axiomático Zermelo-Fraenkel (ZF). Con todo lo anterior mostraremos cómo el quehacer matemático contemporáneo se adscribe al platonismo matemático en los términos de Bernays y Ferreirós. Revisaremos también los argumentos de Zermelo y Cantor para permitir el uso de asunciones en la matemática, los cuales se acercan a los planteamientos de la investigación científica y esbozan relaciones con la filosofía de la práctica matemática. Finalmente, justificamos el uso del axioma de elección en la contemporaneidad, abogando por unas relaciones de equidad entre la matemática y la filosofía, presentando además su plena vigencia, a través de la referencia a algunos problemas abiertos en la actualidad que vinculan el axioma de elección con la teoría de Ramsey. This article deals with the theatrical work of Francisco García Escalante, known as Francis, from the point of view of Gender and Queer Theory. Since the theater work of Francis belongs to popular culture, this article analyzes elements of Mexican Review Theater (similar to Musical Theater) in reference to the dynamics she used to present diverse masculinities on stage. This essay also compares Francis’ symbolical construction of gender with that of popular singer Juan Gabriel.

It is hypothesized that human faces judged to be attractive by people possess two features—averageness and symmetry—that promoted adaptive mate selection in human evolutionary history by way of production of offspring with parasite resistance. Facial composites made by combining individual faces are judged to be attractive, and more attractive than the majority of individual faces. The composites possess both symmetry and averageness of features. Facial averageness may reflect high individual protein heterozygosity and thus an array of proteins to which parasites (...) must adapt. Heterozygosity may be an important defense of long-lived hosts against parasites when it occurs in portions of the genome that do not code for the essential features of complex adaptations. In this case heterozygosity can create a hostile microenvironment for parasites without disrupting adaptation. Facial bilateral symmetry is hypothesized to affect positive beauty judgments because symmetry is a certification of overall phenotypic quality and developmental health, which may be importantly influenced by parasites. Certain secondary sexual traits are influenced by testosterone, a hormone that reduces immunocompetence. Symmetry and size of the secondary sexual traits of the face (e.g., cheek bones) are expected to correlate positively and advertise immunocompetence honestly and therefore to affect positive beauty judgments. Facial attractiveness is predicted to correlate with attractive, nonfacial secondary sexual traits; other predictions from the view that parasite-driven selection led to the evolution of psychological adaptations of human beauty perception are discussed. The view that human physical attractiveness and judgments about human physical attractiveness evolved in the context of parasite-driven selection leads to the hypothesis that both adults and children have a species-typical adaptation to the problem of identifying and favoring healthy individuals and avoiding parasite-susceptible individuals. It is proposed that this adaptation guides human decisions about nepotism and reciprocity in relation to physical attractiveness. (shrink)

This study examines the influence of ethical fit on employee attitudes and intentions to turnover. The results of this investigation provides support for the conjecture that ethical work climate is an important variable in the study of person-organization fit. Ethical fit was found to be significantly related to turnover intentions, continuance commitment, and affective commitment, but not to job satisfaction. Results are discussed in regard to some of the affective and cognitive distinctions among satisfaction, commitment, and behavioral intentions.

The purpose of this study was to determine if there is a relationship between the ethical climate of the organization and the development of person-organization fit. The relationship between an individual's stage of moral development and his/her perceived ethical work environment was examined using a sample of 86 working students. Results indicate that a match between individual preferences and present position proved most satisfying. Subjects expressing a match between their preferences for an ethical work climate and their present ethical work (...) climate indicated that they were less likely to leave their positions. (shrink)

I. Introduction Two kinds of remedies have traditionally been employed for breach of contract: legal relief and equitable relief. Legal relief normally takes the form of money damages. Equitable relief normally consists either of specific performance or an injunction – that is, the party in breach may be ordered to perform an act or to refrain from performing an act. In this article I will use a “consent theory of contract” to assess the choice between money damages and specific performance. (...) According to such a theory, contractual obligation is dependent on more fundamental entitlements of the parties and arises as a result of the parties' consent to transfer alienable rights. My thesis will be that the normal rule favoring money damages should be replaced with one that presumptively favors specific performance unless the parties have consented to money damages instead. The principal obstacle to such an approach is the reluctance of courts to specifically enforce contracts for personal services. The philosophical distinction between alienable and inalienable rights bolsters this historical reticence, since a right to personal services may be seen as inalienable. I will then explain why, if the subject matter of a contract for personal services is properly confined to an alienable right to money damages for failure to perform, specific enforcement of such contracts is no longer problematic. Finally, I shall consider whether the subject matter of contracts for corporate services is properly confined to money damages like contracts for personal services, or whether performance of corporate services can be made the subject of a valid rights transfer and judicially compelled in the same manner as contracts for external resources. This study considers the ethical decision making of individual employees and the influence their perception of organizational expectations has on employee feelings about the decision making process. A self-administered questionnaire design was used for gathering data in this study, with a sample size of 245 full-time employees. The match between the ethical alternative chosen by the respondent and that alternative perceived to be encouraged by his/her organization was found to be significantly related to both feelings of discomfort and feelings of (...) intrapersonal role conflict. BackgroundThis paper discusses the contentious issue of reuse of stored biological samples and data obtained from research participants in past clinical research to answer future ethical and scientifically valid research questions. Many countries have regulations and guidelines that guide the use and exportation of stored biological samples and data. However, there are variations in regulations and guidelines governing the reuse of stored biological samples and data in Sub-Saharan Africa including Malawi.DiscussionThe current research ethics regulations and guidelines in Malawi do not (...) allow indefinite storage and reuse of biological samples and data for future unspecified research. This comes even though the country has managed to answer pertinent research questions using stored biological samples and data. We acknowledge the limited technical expertise and equipment unavailable in Malawi that necessitates exportation of biological samples and data and the genuine concern raised by the regulatory authorities about the possible exploitation of biological samples and data by researchers. We also acknowledge that Malawi does not have bio-banks for storing biological samples and data for future research purposes. This creates room for possible exploitation of biological samples and data collected from research participants in primary research projects in Malawi. However, research ethics committees require completion and approval of material transfer agreements and data transfer agreements for biological samples and data collected for research purposes respectively and this requirement may partly address the concern raised by the regulatory authorities. Our concern though is that there is no such requirement for biological samples and data collected from patients for clinical or diagnostic purposes.SummaryIn conclusion, we propose developing a medical data and material transfer agreement for biological samples and data collected from patients for clinical or diagnostic purposes in both public and private health facilities that may end up in research centers outside Malawi. We also propose revision of the current research ethics regulations and guidelines in Malawi in order to allow secondary use of biological samples and data collected from primary research projects as a way of maximizing the use of collected samples and data. Finally, we call for consultation of all stakeholders within the Malawi research community when regulatory authorities are developing policies that govern research in Malawi. (shrink)

Whether refusal is an act of civil disobedience meant to challenge the state politically as a form of protest, or an action which reflects a deep moral objection to the policies of the state, selective conscientious objection presents the state and its citizens with a number of difficult legal and moral challenges. Appeals to authority outside of the state, whether religious or secular, influence both citizenship and the behavior of the government itself. As Israel raises funds to defend IDF officers (...) from charges of human rights violations in the United Kingdom, it may find itself in need of a better defense against those citizens hesitant to be placed in harm's way, militarily and legally. At some point in the future it may find itself unable to field soldiers for whom service in the Occupied Territories is prohibited by inviolable secular or religious law. And for those who will continue to argue that they cannot abide service in an army of occupation, an expression sounded in 1968 by Yeshayahu Leibowitz, the moral crisis of an individual conscience rent between obligations to the state and obligations to self, will linger along with the pain of a conscience nurtured and then rejected by this democratic society. Emotions change over time. A comprehensive understanding of emotions will require that their temporal nature be observed and analysed. By observing emotion over time, one can disentangle and simultaneously analyse temporal variability within individuals and between-individual variability using a two-step process approach. First, within-person temporal patterns (e.g., covariation, lead–lag relation, periodicity, etc.) are assessed for each subject. Second, between-person analyses are conducted on the within-person patterns. These two steps can be done simultaneously with hierarchical linear models (HLM) or in two (...) actual steps with the process approach. HLM is limited to the intra-individual analysis of linear patterns (e.g., slope, intercept), whereas the process approach can be used to examine non-linear aspects of intra-individual change, such as multivariate patterns, within-subject skew, or phase relations between oscillating processes. In this paper we provide a description of the process approach and present several examples of, as well as suggestions for, intra-individual analysis applied to emotion and individual differences. This article seeks to refine understandings of the governmental logics that comprise and shape urban governance. Drawing on research using ethnographic methods that explore the business improvement district (BID) and the condominium corporation (condo) it is argued that exclusive focus on urban neo-liberalism neglects an urban ”police.” This latter logic is most famously remarked upon in Michel Foucault’s writings as targeting “little things” in urban spaces. Both “police” and the ”free rider problem” it confronts predate and are irreducible to neo-liberalism. (...) Ethnography helps discern this “police” as well as how neo-liberalism relates to it in private urban realms typically hidden from view. Examining BIDs and condos in this way shows that neo-liberalism and “police” co-exist and combine in the governance of urban residential and commercial life. This matters because it reveals a more complex picture of urban governance than is sometimes assumed when neo-liberalism is exclusively invoked and one that is necessarily considered when conceiving of alternative governing arrangements. This is not another "law-and-econ" bashing symposium. Nor is the symposium's title intended to denigrate Chicago School law and economics any more than the term "Post-Keynesian economics" was intended to denigrate the work of John Maynard Keynes. Instead, this symposium marks the fact that many practitioners of law and economics have moved well beyond the stereotypes familiar to most legal academics. Rather than designating an entirely new school of thought, the term "Post-Chicago law and economics" refers to a new era (...) in which a variety of new questions about law and lawmaking is being asked and a variety of promising economic techniques is being used to answer them. Yet most legal academics who, like me, are not part of the law and economics movement are generally unaware of these changes. The purpose of this "Symposium on Post-Chicago Law and Economics" is to bring some of these new methods and questions to the attention of mainstream legal academics and others. The hope is that those who have shunned the economic analysis of law in the past may wish to reconsider their stance in light of what Post-Chicago law and economics has to offer. To facilitate this, the author uses this Foreword to summarize the new directions suggested by each of the symposium contributors, most of whom are practitioners of law and economics. (shrink)

Life threatening emergencies involving infants and children are inherently dramatic, tension-filled situations. It is no wonder, then, that depictions of such events can be found in literature by and about doctors. In many ways, too, such depictions can illuminate key aspects of such events, such as the physician's own anxiety and the tensions between the various people involved, better than the medical literature. Hence it is suggested that the study of literary depictions of pediatric emergencies might be a useful adjunct (...) for those, physicians and other health care providers, who are called upon to manage them. The legal risks associated with health research involving human subjects have been highlighted recently by a number of lawsuits launched against those involved in conducting and evaluating the research. Some of these cases have been fully addressed by the legal system, resulting in judgments that provide some guidance. The vast majority of cases have either settled before going to trial, or have not yet been addressed by the courts, leaving us to wonder what might have been and what guidance future (...) cases may bring. What is striking about the lawsuits that have been commenced is the broad range of individuals/institutions that are named as defendants and the broad range of allegations that are made. The research community should take this early experience as a warning and should reflect carefully on practices where research involving human subjects is concerned. (shrink)

This article argues that we live in a highly technical world in which people are disappearing. Religion does not have the tools to help us resist this extinction since it has itself diminished humanity by positing a perfect Other Being, which controls our lives. The author argues that we need to reclaim a sense of ourselves as essentialising animals. Genealogies in philosophy can be tricky and even a little dangerous. Lines of influence and inheritance run much more linearly on paper than in reality. I am often reminded of Robert Frost's "Mending Walls" and the attention that must be paid to what is being walled in and what is being walled out. In other words, William James and Emmanuel Levinas are not natural conversation partners. I have always read James as a fellow traveler of Edmund Husserl, and placed both (...) in a line of thought that might share Franz Brentano and Wilhelm Dilthey as forebears. In this genealogy, Levinas appears with an asterisk, or after one. Maurice Natanson described Husserlian phenomenology as an elderly grandparent who comes down to dinner just a little bit too early, making everyone uncomfortable. Seating Levinas next to James brings to mind some similar scene. What basic premises or positions do James and Levinas share? Is Levinas a Jamesian pragmatist? Is he a radical empiricist? Does James offer an ethics that parallels or even complements Levinas's rigorous ethical phenomenology? (shrink)
