Coercion, the act of compelling someone to do something by the use of power, intimidation, or threats, has been deemed a necessary weapon in the public health armamentarium since before public health fell under the remit of physicians and out of the grip of “sanitarians” and civil engineers. This article examines the ethics of detention in the pursuit of public health and uses a contemporary example, detention of poorly compliant individuals with tuberculosis, to highlight the moral dilemmas posed, and examine (...) whether recently proposed approaches are just. In particular I focus upon the public health response to non-infectious individuals who fail to comply with treatment . Our response to them helps clarify contemporary attitudes to recalcitrant, often marginalised, individuals who pose an uncertain threat.Globally tuberculosis control is failing. The World Health Organisation recently called this public health threat a global emergency.1 Transmission occurs through often casual contact from individuals who have pulmonary disease. Although there is much that is uncertain regarding the infectiousness of this ancient disease, we do know that those who are smear-positive, that is who have organisms of Mycobacterium tuberculosis visible in stained respiratory secretions, are considerably more infectious than those who do not.2, 3 Compliance with effective treatment rapidly makes previously infectious patients non-infectious. Standard treatment for fully drug-sensitive tuberculosis usually lasts for six months. Erratic adherence to chemotherapy, however, may result in relapse and the development of drug-resistant disease which is considerably more difficult to treat.In the 1980s and early 1990s New York City witnessed an epidemic of tuberculosis and, of particular concern, a marked increase in drug-resistant and multidrug-resistant strains. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. Two hundred thirty-nine issues later it continues in a world transformed by war, overpopulation, cultural shocks, scientific and technological transformations, globalization, the avalanche of information produced by electronic exchange, and "the acceleration of just about everything." Yet despite (...) these factors and the strains of postmodernism and cultural alterity, 1 it has not entirely lost touch with its intellectual innocence, faith in humanistic learning, and reliance on enlightened reason. This continuity itself may seem something of a novelty in an age of distrust of history and "rage against reason," but for some of us it reflects the critical spirit and intellectual context out of which such ostensibly subversive attitudes emerge, and reemerge. To some extent, moreover, the diversity of opinions about intellectual traditions is the result of specializations, and special interests, which have changed the climate of opinion since the time of Arthur O. Lovejoy, principal founder of the JHI. Heidegger’s early project aims to articulate the form of our being as Dasein, and he says that for this usually hidden form to become accessible, a certain kind of “mood” is required of the philosopher. This “ground-mood” he identifies in Sein und Zeit as anxiety. He also, however, presents anxiety as a mood anyone, philosopher or not, experiences when there is some significant breakdown in the living of her life. I argue here that there are largely unrecognized problems with this (...) conflation of methodological and “existential” moods, but that there is nevertheless a compelling methodological account of anxiety that can be teased apart from the existentialist one: methodologically understood, anxiety is a self-affected state of the ontologist, one that results from her asking ontological questions of herself, and, by imagining crisis or breakdown, withdrawing from her determinate situation to a position where she can see the form of her own activity as questioner and imaginer. I draw out some consequences this has for how we should understand the place of ontological understanding in living one’s life, and I conclude by briefly showing how my reading helps us see Heidegger as developing key elements in the work of Descartes and Kant. This reply to an ongoing debate between conspiracy theory researchers from different disciplines exposes the conceptual confusions that underlie some of the disagreements in conspiracy theory research. Reconciling these conceptual confusions is important because conspiracy theories are a multidisciplinary topic and a profound understanding of them requires integrative insights from different fields. Specifically, we distinguish research focussing on conspiracy *theories* (and theorizing) from research of conspiracy *belief* (and mindset, theorists) and explain how particularism with regards to conspiracy theories does not (...) mean we cannot define a problematic subclass of conspiracy beliefs, while avoiding the problems of generalism. We hope this reply helps conspiracy theory researchers recognize the differences between studying conspiracy theories and conspiracy beliefs and appreciate the possibilities for fruitful, integrative, and interdisciplinary research. We discuss five kinds of representations of rationales and provide a formal account of how they can alter disputation. The formal model of disputation is derived from recent work in argument. The five kinds of rationales are compilation rationales, which can be represented without assuming domain-knowledge (such as utilities) beyond that normally required for argument. The principal thesis is that such rationales can be analyzed in a framework of argument not too different from what AI already has. The result is (...) a formal understanding of rationales, a partial taxonomy, and a foundation for computer programs that represent and reason with rationales.The five kinds of rationales are as follows: (c)ompression and (s)pecialization, which yield rules, and (d)isputation, which yields a decision. These are modeled as potentially changing the focus of the dispute. Then there are (f)it, a rationale for rules, and (r)esolution, a rationale for decisions. When viewed the history of Islamic thought, it is seen that the scholars have made an effort to understand the nature of the speech of God and make sense of it. Essentially, understanding and grasping of the words of God are an effort to look from the physical realm to the metaphysical one. In spite of this fact, the scholars as the indomitable seekers of truth are in search of finding some clues to say about it. While some of them (...) consider the “divine speech” as an attribute of God, many others view it as a divine act. It is also admitted by all of them that whether being attributive or act of God, the reflection of the divine speech is the Qur’ân. In this sense, three views have been put forward on the question of the belonging of the Qur’ânic words. According to the dominant and preferred point of view among these views, Qur’ân belongs to God in terms of wording and meaning. Accordingly, the revelation of the Qur’ân, which was revealed to the Prophet Mohammed consists of both wording and meaning. Therefore, there is no intervention or contribution of Gabriel or Muhammad in constituting of Qur’ân. According to the second approach, the meaning of Qur’ânic text belongs to God, however, its words pertain to Mohammed. This view signals that Gabriel revealed nothing more than the meanings of Qur’ân. Mohammed understands the meanings conveyed to him and then said them in Arabic expression patterns and phrases. According to the third approach, the meanings of Qur’ânic text belongs to God, however, its words pertain to Gabriel. In other words, only meanings of text were given to Gabriel, and its words are formed by him. In the present study, the mentioned approaches which are put forward by scholars about the belonging of Qur’ânic words will be examined in terms of the integrity of the Qur’ân and Tafsir rumors (riwâyât) of the classical period. In a nutshell, it can be said that there is no disagreement among scholars in the field of the belonging of the meanings of Qur’ânic text to God. The main disagreement is whether the Qur’ânic words belong to God, Gabriel or Muhammad. Considering the integrity of Qur’ân and Tafsir rumors regarding to the circumstances of sending down of the Qur’ânic revelation, it has been determined that the prevailing view is more consistent than the other two views. Phenomenal conservatives claim that seemings are sui generis mental states and can thus provide foundational non-doxastic justification for beliefs. Many of their critics deny this, claiming, instead, that seemings can be reductively analyzed in terms of other mental states—either beliefs, inclinations to believe, or beliefs about one’s evidence—that cannot provide foundational non-doxastic justification. In this paper, I argue that no tenable semantic reduction of ‘seems’ can be formulated in terms of the three reductive analyses that have been proposed by critics (...) of phenomenal conservatism. This is because Moore-paradoxical statements are generated when each of the reductive analyses is substituted for ‘seems’ in statements like ‘The stick is straight, but it does not seem to me that it’s straight.’ Since the latter statement is not Moore-paradoxical, the three proposed reductive analyses of ‘seems’ are unsuccessful. Absent a successful semantic reduction, however, there is no good reason to think a successful metaphysical reduction of seemings is forthcoming. Thus, there is an additional reason, unnoticed in the existing literature, to think that seemings are sui generis mental states. (shrink)

This essay deals with property rights in body parts that can be exchanged in a market. The inquiry arises in the following context. With some exceptions, the laws of many countries permit only the donation, not the sale, of body parts. Yet for some years there has existed a shortage of body parts for transplantation and other medical uses. It might then appear that if more sales were legally permitted, the supply of body parts would increase, because people would have (...) more incentive to sell than they currently have to donate. To allow sales is to recognize property rights in body parts. To allow sales, however, makes body parts into “commodities”—that is, things that can be bought and sold in a market. And some view it as morally objectionable to treat body parts as commodities. (shrink)

Sam Lebens offers an intriguing set of arguments from theism to idealism. In this paper, I shall focus on the argument from perfect rationality to Hassidic Idealism. I will offer a critical analysis of this argument and draw out a series of conflicts between Hassidic Idealism and divine freedom, the divine ideas, and creation ex nihilo.

The issues and problems of mandatory vaccination policy and roll out in First Nations communities are unique and do not concern the safety and effectiveness of vaccines. These issues are also independent of more specific arguments of mandatory vaccination of healthcare workers as a condition of employment. As important as these issues are, they do not consider the complex politics of ongoing settler colonialism and First Nations community relations. In this paper, we also set aside the very real problems of (...) disinformation, hesitancy, scientific and health illiteracy, and other concerns that drive vaccine hesitancy and refusal. These affect all communities, including First Nations communities. We, instead describe the dominant arguments in favour of mandatory vaccination and critique them in terms of the disputed legitimacy of Settler-Colonial decision-making as it impacts First Nations communities. We contend cultural responsiveness and safety—not state compulsion—must remain the first principles of any engagement—including vaccination—with First Nations Peoples, families, and communities. The most accepted definition of urgency in psychiatry is that of a situation of acute and severe mental and behavioral suffering, which requires immediate treatment. Therefore, in the situation defined as “psychiatric urgency”, a descriptive and nosographic element (acute), a prognostic element (severity) and a therapeutic element (need for immediate treatment) coexists. In any case, it remains difficult and complex, sometimes enigmatic, to understand the acute episode within the course of a specific pathology. It is a matter of having to (...) oscillate in front of the patient “between the madness of a moment and the madness of an existence” [1]. The problem that confronts us when we try to compare the structure of discourse and explanation in different domains of knowledge is that no one is an insider in more than one field, and insider information is essential. An observer who is not immersed in the practice of a particular scholarship and who wants to understand it is at the mercy of the practitioners. Yet those practitioners are themselves mystified by a largely unexamined communal myth of how scholarship is carried (...) on. R. G. Collingwood, although primarily a philosopher, was immersed in the community of historians and understood how history is done, so that he has had an immense influence on our ideas about historiography. Every historian knows The Idea of History.1 He was also a metaphysician, yet his influence on scientists’ understanding of nature, and of science, has been nil, and it is a rare scientist indeed who has ever heard of Collingwood or read The Idea of Nature.2 Collingwood’s views of the structure of science had to be constructed in large part from the elaborate fictions created by scientists and by an earlier generation of philosophers and historians of science who participated in the Baconian myth of the hypothetical-deductive scheme. 1. I answer Alvin Plantinga's challenge to provide a ‘proper’ de jure objection to religious belief. What I call the ‘sophisticates’ evidential objection' concludes that sophisticated Christians lack epistemic justification for believing central Christian propositions. The SEO utilizes a theory of epistemic justification in the spirit of the evidentialism of Richard Feldman and Earl Conee. I defend philosophical interest in the SEO against objections from Reformed epistemology, by addressing Plantinga's criteria for a proper de jure objection, his anti-evidentialist arguments, and the (...) relevance of ‘impulsional evidence’. I argue that no result from Plantinga-style Reformed epistemology precludes the reasons I offer in favour of giving the SEO its due philosophical attention. (shrink)

Against this backdrop, tensions emerging in the intersection between delimitation and cultivation of professional judgment in its various dimensions are discussed. The discussion clarifies that the medical profession is not a self-sufficient provider when it comes to ensuring an adequate cultivation of its members' judgment in a clinical context. It is argued that by emphasising and implementing the relevant external contributions to the profession's ongoing self-regulation, the public's justified trust in the medical profession can be strengthened. I shall show that the apparently weaker condition, when conjoined with uncontroversial claims and the logical closure of an omniscient being's knowledge, still yields the claim that an omniscient being knows all true propositions.

Charles R. Kesler, an eminent scholar and prodigious editor, has exerted a profound influence on the study of American politics and the practice of American conservatism. A precocious high-school student, he impressed a visiting William F. Buckley Jr. who, before becoming a life-long friend, wrote him a recommendation letter to Yale. Kesler asked for another--to Harvard, where he completed his undergraduate degree and earned a PhD under the legendary professor Harvey C. Mansfield. An early passion for political journalism, played out (...) largely on the pages of National Review, led Kesler to author an NR cover story on his third great influence, Harry V. Jaffa. Kesler became a faculty colleague of Jaffa's at Claremont McKenna College and Claremont Graduate University and is perhaps best known as the editorial helmsman of the Claremont Review of Books. The author of I Am the Change: Barack Obama and the Crisis of Liberalism and Crisis of the Two Constitutions: The Rise, Decline, and Recovery of American Greatness, Kesler also co-edited (with William F. Buckley Jr.) Keeping the Tablets: Modern American Conservative Thought. His edited volume of The Federalist Papers is the best-selling edition version in the country. This remarkable collection of almost 1,400 aphorisms was originally published in three instalments. The first appeared in 1878, just before Nietzsche abandoned academic life, with a first supplement entitled The Assorted Opinions and Maxims following in 1879, and a second entitled The Wanderer and his Shadow a year later. In 1886 Nietzsche republished them together in a two-volume edition, with new prefaces to each volume. Both volumes are presented here in R. J. Hollingdale's distinguished translation with a new introduction by (...) Richard Schacht. In this wide-ranging work Nietzsche first employed his celebrated aphoristic style, so perfectly suited to his iconoclastic, penetrating and multi-faceted thought. Many themes of his later work make their initial appearance here, expressed with unforgettable liveliness and subtlety. Human, All Too Human well deserves its subtitle 'A Book for Free Spirits', and its original dedication to Voltaire, whose project of radical enlightenment here found a new champion. (shrink)

Are we to understand vice in natural-medical terms, or are we better served by utilizing a moral framework? Is criminality reducible to and best categorized as a metaphysical type the essential features of (...) which are neurological or otherwise biological in nature? Or, perhaps, is criminality closer to a (non-natural) sociological type, the essential features of which can be understood only through reference to social norms and cultural conventions? These are torturously involved philosophical and theoretical questions that have given rise to an equally torturous volume of literature. Without pretending to do justice to these questions or their corresponding literature, several key considerations that must be inserted into and accounted for within the discursive pursuit of these inquiries are worth noting.Where a naturalistic ontology is employed within the study of vice, we reduce the intricacies of deviant behavioral phenomena to what we presume to be their underlying medical/biological properties. It is worth remembering that behavior itself cannot rightfully be said to be “sick”; rather, what we mean to say is that the behavior in question—in our case, various forms of “vice”—is symptomatic of some underlying illness or medical/biological condition. The presumed underlying sickness and the behavior itself are distinct, ontologically linked only through their theorized relationship to one another. This, then, is a key assumption of the medical approach to vice and its ontological classification as a natural-medical kind: that there exists a relationship between the behavior (a symptom) and the underlying illness or medical condition, and that the relationship is of the causal kind. Vice, it is suggested, is a change in state that is caused by (or, at the very least, is a direct consequence of) sickness or illness. Second, to legitimate such attributions, the illness supplying the requisite causal force must be identifiable and its causal connection to the behavior must be or be capable of being sufficiently explicated. In other words, once we have identified the relevant medical/biological properties and the behavior to which they stand in causal relatedness, we must be prepared to characterize this dynamic—we must be able to show exactly how and why such and such a condition gives rise to such and such a behavior.Problematically, causation itself is and has always been a contentious metaphysical specimen. Hume (1955) reminded us of the troubling reality [End Page 39] that we cannot ever “see” one thing cause or necessitate another. We are left, rather, to merely presume the existence of causal relationships between things. How is it, exactly, that disorder in neurodevelopment can necessitate certain behavioral outcomes? Even if we can “see” (in the empirical sense) the disorder and equally “see” the behavior, we cannot of course witness the precise causal action of the former upon the latter. Even if we are content inferring causal action in such cases, we still need to demonstrate the basic conditions of causality. To show that Condition X is causally related Behavior Y, we need to show that they are regularly associated with one another, that Condition X temporally preceded Behavior Y and, most challengingly, that no other conditions or factors have an intervening (e.g., additive, synergistic) influence. Hypothetically, if we were to posit a causal relationship between schizotypal personality traits and violent behavior, we would need to establish: (1) that schizotypal traits and violent behavior regularly coexist; (2) that those traits presented before the manifestation of the violent behavior; and (3) that no other factors (biological, psychological, and/or sociological) contributed in any meaningful way to those manifestations. We would thus need to systematically rule out family dynamics, income, education, intelligence, substance use, and so forth, as contributing factors. If, in turn, we were to determine that the presence of schizotypal traits alone is not sufficient—even if a necessary condition—to produce violent behavior but, rather, that those traits act in concert with other variables to produce the behavior, then we would not truly be... In Rabinowicz & Rønnow-Rasmussen, we defended the following claims: Not only states of affairs, or facts, but also concrete objects, such as things or persons, may have final value ; The final value of a concrete object need not be intrinsic, i.e., it need not be exclusively based on the internal properties of its bearer; The final value of a concrete object is not reducible to the value of some states of affairs that involve the object in question. Our arguments (...) for – have been challenged. This paper is an attempt to respond to some of these challenges, viz. those that concern the reducibility issue. The discussion presupposes a Brentano-inspired account of value in terms of fitting responses to value bearers. Attention is given to a yet another type of reduction proposal, according to which the ultimate bearers of final value are abstract particulars rather than abstract states or facts. While the proposal is attractive, it confronts serious difficulties. To recognise tropes as potential bearers of final value, along with other objects, is one thing; but to reduce the final value of concrete objects to the final value of tropes is another matter. We are often told that we are morally obligated to produce equal opportunity for all. Therefore, it seems we should examine what power we have to produce that desirable state. For it would be nonsense to say we are required to provide what is beyond our power to provide. When we examine this question, we find our power limited by two sets of constraints. One set comprises formal constraints upon the idea itself of equal opportunity. We cannot do the logically (...) impossible. The other set comprises limits upon our ability to produce the directed socio-economic change, getting known outputs for known inputs. I illustrate the formal constraints by outlining the work of Douglas Rae. The constraints upon our abilities I illustrate with evidence from sociology and politics. At the end, we shall discover that our power to make opportunities equal is sharply though not unbearably limited. A critical but unbaised survey will reveal that in the past fifty years we have gone remarkably far towards doing all that we are presently capable of doing to equalize opportunities. Perhaps we shall go even farther when we learn how. The word ‘real’ in the title is opposed to ‘ideal’ or even ‘chimerical'. It may seem an interesting question what equality of opportunity should consist in were we able to produce directed socio-economic change at will. But we are not. Therefore, a more interesting and more important question is what equality of opportunity consists in given the very large number of constraints within which we must work to achieve it. (shrink)

Among Plato's later dialogues, the _Parmenides_ is one of the most significant. Not only a document of profound philosophical importance in its own right, it also contributes to the understanding of Platonic dialogues that followed it, and it exhibits the foundations of the physics and ontology that Aristotle offered in his _Physics_ and _Metaphysics _VII. In this book, R.E. Allen provides a superb translation of the _Parmenides_ along with a structural analysis that procedes on the assumption that formal elements, logical (...) and dramatic, are important to its interpretation and that the argument of the _Parmenides_ is aporetic, a statement of metaphysical perplexities. Allen's original translation of and commentary on the _Parmenides_ were published in 1983 to great acclaim and have now been revised by the author. (shrink)
