Dworkin a formulé une critique du positivisme juridique, qui le rapproche du jusnaturalisme. Toutefois, Dworkin se refuse à fonder les droits sur un supposé ordre moral indépendant que le législateur ou le juge aurait pour tâche de découvrir lorsqu’il produit la loi. Dworkin substitue aux lois naturelles des principes du droit. Ces derniers ne sont pas des vérités morales indépendantes, mais des (...) critères moraux, qu’il est possible de construire rationnellement. Nous montrons ainsi que Dworkin élabore une forme de constructivisme moral, en partie inspiré de John Rawls, mais appliqué au domaine judiciaire au sein duquel les décisions présentes doivent être cohérentes avec les décisions passées, qui lui permet de redéfinir un droit naturel non transcendant. The set of $$\textsf{ST}$$ ST -valid inferences is neither the intersection, nor the union of the sets of $$\textsf{K}_3$$ K 3 -valid and $$\textsf{LP}$$ LP -valid inferences, but despite the proximity to both systems, an extensional characterization of $$\textsf{ST}$$ ST in terms of a natural set-theoretic operation on the sets of $$\textsf{K}_3$$ K 3 -valid and $$\textsf{LP}$$ LP -valid inferences is still wanting. In this paper, we show that it is their relational product. Similarly, we prove that the set of (...) $$\textsf{TS}$$ TS -valid inferences can be identified using a dual notion, namely as the relational sum of the sets of $$\textsf{LP}$$ LP -valid and $$\textsf{K}_3$$ K 3 -valid inferences. We discuss links between these results and the interpolation property of classical logic. We also use those results to revisit the duality between $$\textsf{ST}$$ ST and $$\textsf{TS}$$ TS. We present a notion of duality on which $$\textsf{ST}$$ ST and $$\textsf{TS}$$ TS are dual in exactly the same sense in which $$\textsf{LP}$$ LP and $$\textsf{K}_3$$ K 3 are dual to each other. Reputation monitoring and the punishment of cheats are thought to be crucial to the viability and maintenance of human cooperation in large groups of non-kin. However, since the cost of policing moral norms must fall to those in the group, policing is itself a public good subject to exploitation by free riders. Recently, it has been suggested that belief in supernatural monitoring and punishment may discourage individuals from violating established moral norms and so facilitate human cooperation. Here we use cross-cultural (...) survey data from a global sample of 87 countries to show that beliefs about two related sources of supernatural monitoring and punishment — God and the afterlife —independently predict respondents' assessment of the justifiability of a range of moral transgressions. This relationship holds even after controlling for frequency of religious participation, country of origin, religious denomination and level of education. As well as corroborating experimental work, our findings suggest that, across cultural and religious backgrounds, beliefs about the permissibility of moral transgressions are tied to beliefs about supernatural monitoring and punishment, supporting arguments that these beliefs may be important promoters of cooperation in human groups. Given the residual homonegativity in evidence throughout our diverse communities, and given the large numbers of gay people who remain “in the closet”, it is critical that we seek to understand in greater depth the complexities of the coming-out process with a view to dispelling some of the confusion relating to sexual identity. Internalised homophobia is more widespread than generally acknowledged, and it manifests in a variety of ways, including the sociological phenomenon of gay men remaining closeted until well into (...) middle age. This article applies a hermeneutic phenomenological lens to examine the process of realisation, where an individual gradually becomes aware of his sexual orientation, and eventually acknowledges to himself that he is gay. This process can take decades. For this research project, twelve participants (gay men who have come out after the age of 40) from Aotearoa New Zealand willingly shared intensely personal accounts of their lived experiences. The findings indicate that individuals experience clarity about same-sex attraction in strikingly different ways. This study helps us to understand the difficulties faced by men who have lived the majority of their lives as “straight”, then in middle age find themselves having to negotiate the tortuous terrain between heterosexuality and a new gay identity. Abstract:This essay explores affinities between etymology and geology by way of Sun Ra’s poetry. The first part suggests that geology and etymology share a methodological and metaphorical potential for apprehending unconformities, that is, for understanding the contradictory ways in which time, space, and history can converge together in a single site or sound. The second part approaches Ra’s Afrofuturist poetics as a creative practice of etymology and geology, arguing that Ra locates his critical-utopian vision in an Earth-scale reckoning with an (...) idiosyncratic etymology. Many activities towards plants are directly related to environmental crisis issues. However, our actions towards plants are little theorized in philosophy and ethics. After a brief presentation of the history, state of the art, and current issues of plant ethics, I critically illustrate how the theoretical threads of current ethics should be clarified, and, more importantly, contextualised, to promote the application of concrete measures. Particular attention is paid to the ethics of plant flourishing as applied to different fields and types (...) of plants. The treatment of wild and ornamental plants is, thus, explicitly distinguished from that of improved agricultural varieties, themselves distinguishable according to modes of cultivation. I thus propose and discuss several recommendations and concrete courses of action to promote an ethics of plants, while pointing out its limitations. (shrink)

As I see it, the historic role of literary Bloomsbury was to act as a sort of check or antibody continually attacking the proponents of the vulgar passions in the body politic whenever these menaced the traditional values of liberal England. In a democracy and perhaps in any modern state there is always a danger that men seeking power will rely upon the feelings rather than the intelligence of the masses. Such appeals to the vulgar passions represent a continual danger; (...) fight on till the Huns are smashed, squeeze Germany until the pips squeak, woman's place is in the home, stamp out dirty unnatural vice, keep the black man in his place—exhortations of this kind can be terribly effective. Against them, or most of them, one may oppose the arguments of the Sermon on the Mount: love your enemies, all men are brothers. This Bloomsbury did not do; it had no use either for the hero or for the saint. In its polemics it appeals to good sense and good feeling and relies upon the belief that ultimately the reasoned argument will prevail. Individual and population stature is correlated with health, education and economic achievement. Strong sexual selection pressures for stature have been observed in multiple diverse populations, however; there is significant global variance in gender equality and prohibitions on female mate selection. This paper explores the contribution of general standard of living and gender inequality to the variance in global female population heights. (...) Female population heights of 96 nations were culled from previously published sources and public access databases. Factor analysis with United Nations international data on education rates, life expectancy, incomes, maternal and childhood mortality rates, ratios of gender participation in education and politics, the Human Development Index and the Gender Inequality Index was run. Although the principle of respect for personal autonomy has been the subject of debate for almost 40 years, the conversation has often suffered from lack of clarity regarding the philosophical traditions underlying this principle. In this article, I trace a genealogy of autonomy, first contrasting Kant’s autonomy as moral obligation and Mill’s teleological political liberty. I then show development from Mill’s concept to Beauchamp and Childress’ principle and to Julian Savulescu’s non-teleological autonomy sketch. I argue that, although the reach for (...) a new principle to guide choices in physician–patient relationships can rightfully be seen as important, the notion that is now called autonomy within bioethics has corollaries that undermine critical aspects of medical care. As such, there is need for a richer account of the interplay between the free choice of patients and the informed recommendations of doctors. (shrink)

Although the literature on the logic of historical enquiry is already vast and still growing, it continues to polarise overwhelmingly around a single disputed point—whether historical explanations have their own logic, or whether every successful explanation must conform to the same deductive model. Recent discussion, moreover, has shown an increasing element of agreement—there has been a marked trend away from accepting any strictly positivist view of the matter. It will be argued here that both the traditional polarity and the recent (...) trend in this debate have tended to be misleading. The positiviste have been damagingly criticised. But their opponents have produced no satisfying alternative. They have tended instead to accept as proper historical explanations whatever has been offered by the historians themselves in the course of trying to explain the past. But a further type of analysis must be required if some account is to be given of the status, and not merely the function, of the language in which these explanations are offered. Such an analysis, moreover has implications of some importance in considering the appropriate strategy for historical enquiries. (shrink)

This was to have been a confutation. My intention was to rebut and for the record’s sake to correct certain fashionable errors concerning the life of Virginia Woolf. What could be more proper, and what, it has to be said, more tedious? If the defence of truth had remained my only objet, I should have left these words unwritten, or at least should have addressed them to a very small audience. But the pursuit of truth sent me back to my (...) sources, and there I found a story, in many ways sad, but also funny and certainly instructive. It seemed worth extracting this record of a friendship from the great mass of evidence in which it is embedded. I hope that the reader will agree with me in finding it interesting in itself but, just as Prince’s Hal’s “plain tale” is made livelier by being contrasted with Falstaff’s “eleven buckram men,” so too the simple facts are made more striking by the intentions of Virginia’s recent interpreters. Let me therefore begin with a quotation from one of them.Volume I [of Virginia Woolf’s Letters] has a rarely preserved portrait of a female artist in the making, love and work intensely intertwined in her relations with women who encouraged her to write, read, and think, and gave her the nourishment of womanly love and literary criticism, which she was to seek and find in female friendship all her life. Bloomsbury fades into insignificance as an “influence” next to the radiance of Woolf’s relationships with Margaret Llewelyn Davies, head of the Cooperative Working Women’s Guild, Janet Case, her Greek teacher, violet Dickinson, Madge Vaughan, and her aunt Caroline Stephen, the Quaker whom she called “Nun.”1These words were written by Professor Jane Marcus, a person of great charm and ability, whose opinions are, I understand, accepted by a multitude of admirers. In those articles by her which I have read, she hardly disguises her contempt for me as a biographer. But, painful though it is to have incurred the disdain of so influential a personage, it much be allowed that, if the influence of Virginia Woolf’s husband, her sister, and her closest friends “fades into insignificance” when compared with that of Miss Caroline Stephen and Mrs. W. But while the literature of art is, in publishers' terms, booming, it has in one respect suffered a loss. During the past two hundred years there has usually been some important figure who acted as a censor and an apologist of the contemporary scene, a Diderot, a Baudelaire, a Ruskin or a Roger Frye. Who amongst our living authors plays this important role? What name springs to mind? I would suggest that no name actually springs; the last of our grandly (...) influential critics was Sir Herbert Read and since his death, whatever else modern art may or may not possess, it has no prophet. This is not to say that aesthetic prophets are necessarily desirable nor that there are not some very conscientious and extremely perceptive critics at work today; in view of the fact that I am within a fortnight exhibiting my work in a London dealer's gallery , it would be folly to deny it. But it is I believe true that for better or for worse we have no grand pundit of living art and I believe that this lack may be concerned with what I see as a certain diminution in the role of the art critic, a certain decay in this department of literature. It is a tendency which I regret and the causes of which I want to try to discuss. It arises I believe from a misunderstanding concerning the proper functions of the critic and this confusion of purpose will be my theme. First, however, I think that I should glance at two important circumstances which make the work of an art critic particularly difficult today. This paper considers some of the ethical issues surrounding the study of malicious activity in social networks, specifically using a technique known as social honeypots combined with the use of deception. This is a potentially touchy area of study that is common to social and behavioral research that is well understood to fall within the boundaries of human subjects research that is regulated in the United States and reviewed by institutional review boards, but is not well understood by computer security (...) researchers or those in the private sector. The firestorm of controversy over the 2014 “emotional contagion” study of Facebook users shows that learning about being deceived may itself be the harm, to both those users involved and their trust in researchers and research in general. Should researchers have an obligation to try to find research methods that do not involve deception to achieve the same research results? (shrink)

At the present time there is an increasing tendency to regard the application of the social sciences to practical affairs as in some way objectionable, and needing to be replaced by a form of social practice which has a different kind of cognitive backing. This criticism seems to me to embody various confusions and misrepresentations. My aim in what follows is to bring these to light. The objectionable form of social practice is often called social technology, and the desirable form (...) 'praxis'. Though 'praxis' is merely a German word for 'practice', taken from the Greek, it has been adopted by various writers, among whom Jurgen Habermas is a conspicuous example, for a more specialized use, for which precedent is said to be found in Aristotle. I wish to show not only that this precedent is questionable, but that the whole distinction between technology and praxis in the social sphere is without foundation. (shrink)

Some biologists now argue in favour of a pluralistic approach to plant activities, understandable both from the classical perspective of physiological mechanisms and that of the biology of behaviour involving choices and decisions in relation to the environment. However, some do not hesitate to go further, such as plant “neurobiologists” or philosophers who today defend an intelligence, a mind or even a plant consciousness in a renewed perspective of these terms. To what extent can we then adhere to pluralism in (...) the study of plant behaviour? How does this pluralism in the study and explanation of plant behaviour fit into, or even build itself up, in a broader history of science? Is it a revolutionary way of rethinking plant behaviour in the twenty-first century or is it an epistemological extension of an older attitude? By proposing a synthesis of the question of plant behaviour by selected elements of the history of botany, the objective is to show that the current plant biology is not unified on the question of behaviour, but that its different tendencies are in fact part of a long botanical tradition with contrasting postures. Two axes that are in fact historically linked will serve as a common thread. 1. Are there several ways of understanding or conceiving plant behaviour within plant sciences and their epistemology? 2. Can the behaviour of a plant be considered in the same way as that of an animal? The working hypothesis defended in this article consists in showing that the current opposition between growth, development and reductionist physiology on the one hand and the biology of behaviour involving sensitivity and choices in plant activity on the other hand has been built up through the history of botany.
