The question whether distributive justice is at bottom practice-dependent or practice-independent has received much attention in recent years. I argue that the problem of intergenerational justice resolves this dispute in favor of practice-independence. Many believe that we owe more to our descendants than leaving them a world in which they can merely lead minimally decent lives. This thought is particularly convincing given the fact that it is us who determine to a significant extent what this future (...) world will look like. However, no practices that would trigger distributive obligations exist between distant generations. Thus, if we have to leave more than a minimum for future generations, we cannot conceive of distributive justice in terms of the justification of ongoing social interactions. Rather we have to think of the entire concept as an idea based on persons’ legitimate interests and capacity for well-being, and which abstracts from participation in particular practices. (shrink)

I explore some interpretations of the practice of international market reliance that forms the focus of Aaron James' book, and I wonder how our actual practices help to settle what we should go on to do now.

Proponents of practice-dependent egalitarianism argue that egalitarian duties and entitlements only apply among participants in morally relevant practices. In this paper, I argue that these views are implausible because they allow for objectionable treatment of non-participants. I show that it is impossible, on the basis of practice-internal considerations alone, to determine the extent to which the pursuit of practices can permissibly limit the opportunities of non-participants. There are opportunities beyond the current holdings of practices to which no one (...) has a privileged claim (such as unowned natural resources), and the distribution of which is a matter of justice. A just distribution of such unowned distributive goods, though, requires a practice-independent distributive baseline. I further show that such a baseline can only be egalitarian because all alternative baselines face serious objections. From this I conclude that any plausible theory of distributive justice must accept some form of equal practice-independent distributive entitlements. (shrink)

In this thesis I defend the principle of global egalitarianism. According to this idea most of the existing detrimental inequalities in this world are morally objectionable. As detrimental inequalities I understand those that are not to the benefit of the worst off people and that can be non-wastefully removed. To begin with, I consider various justifications of the idea that only those detrimental inequalities that occur within one and the same state are morally objectionable. I identify Thomas Nagel’s approach as (...) the most promising defence of this traditional position. However, I also show that Nagel’s argument does not even justify the elimination of detrimental inequalities within states. A discussion of the concept of political legitimacy rather shows that egalitarian justice is not a necessary condition of the justifiability of the exercise of coercive political power. I, then, consider other, more Rawlsian approaches to the question of detrimental inequalities. These views appear more plausible than Nagel’s position and argue that egalitarian duties also arise in certain international contexts. But also these more global theories of distributive justice suffer from shortcomings. Since they make the application of duties of justice dependent on the existence of social practices they cannot adequately account for the justified interests of non-participants that are affected by these practices. The counter-intuitive implications of practice-dependent theories lead me to investigate the plausibility of a theory that does not limit justice to existing practices and that argues for the inherent value of equality. This theory is global egalitarianism. I defend global egalitarianism by debilitating three objections that opponents of this idea frequently present in the relevant literature. Finally I also address two particular objections to the idea that global egalitarian duties are institutionalizable with the help of coercive global authorities. (shrink)

When physicians take readings of health indices such as temperature or blood pressure, the practices that physicians and patients employ in discussing the readings both reflect and propose a set of expectations regarding the level of technical medical information the patients should acquire and understand. In this article we demonstrate how physicians’ reporting practices reflect and propose the roles of paternalism or independent expertise and how patients’ responding practices either ratify or contest the roles cast by the physicians’ practices. In (...) contrast to the usual assumption that roles are relatively stable for individuals over the course of encounters, we treat role enactments as matters that are negotiated turn by turn in interaction. Physicians’ practices for reporting test results implicate various sets of expectations about the knowledge, interest, and responsibility state of each participant; patients employ responding practices that ratify or contest the expectations implicated by the physicians’ prior report. In each subsequent turn within the information exchange sequence, a speaker indicates whether the level and kind of information being exchanged is appropriate/inappropriate and sufficient/insufficient for the participants. Four couple therapy first consultations involving clients with diagnosed narcissistic problems were examined. A sociologically enriched and broadened concept of narcissistic disorder was worked out based on Goffman’s micro-sociology of the self. Conversation analytic methods were used to study in detail episodes in which clients resist to answer a therapist’s question, block or dominate the development of the conversation’s topic, or conspicuously display their interactional independence. These activities are interpreted as a pattern of controlling practices that were prompted by (...) threats that the first couple therapy consultation imposes upon the clients’ self-image. The results were discussed in the light of contemporary psychiatric discussions of narcissism; the authors suggest that beyond its conceptualization as a personality disorder, narcissism should be understood as a pattern of interactional practices. After criticizing three common conceptions of therelationship between practical ethics and ethical theory, analternative modeled on Aristotle's conception of the relationshipbetween rhetoric and philosophical ethics is explored. Thisaccount is unique in that it neither denigrates the project ofsearching for an adequate comprehensive ethical theory norsubordinates practical ethics to that project. Because the purpose of practical ethics, on this view, is tosecure the cooperation of other persons in a way that respectstheir status as free and equal, it seeks to influence thejudgments (...) of others by providing them with reasons that areaccessible to their own understanding. On this account, theindependence of practical ethics is rooted in an appreciation ofthe constraints that non-ideal circumstances place on the rolethat the philosophically refined premises of moral theory canplay in such public deliberations. Practical and philosophicalethics are united, not by shared theoretical frameworks orprinciples, but by the need to exercise intelligently the sameintellectual and affective capacities. They are separated, notby the particularity or generality of their starting points, butby their responsiveness to the practical problem of facilitatingsound normative deliberations among persons as we find them,under non-ideal circumstances. The history of modern innovation is primarily that of the industrial research laboratory, but the demise of the independent inventor —like that of the entrepreneur —has been much exaggerated. Independent inventing, in fact, continues to flourish as a cultural and technical practice in the contemporary United States. There are, however, a number of structural and cultural impediments in the way of independent inventors who seek to translate their invention into a commercial innovation. By drawing a comparison with the art (...) world, this article explores these impediments and argues that their existence is revealing of the deep social embeddedness of the invention and innovation process. Many mental phenomena involve thinking about people who do not exist. Imagined characters appear in planning, dreams, fantasizing, imaginary companions, bereavement hallucinations, auditory verbal hallucinations, and as characters created in fictional narratives by authors. Sometimes these imagined persons are felt to be completely under our control, as when one fantasizes about having a great time at a party. Other times, characters feel as though they are outside of our conscious control. Dream characters, for example, are experienced by dreamers as autonomous (...) entities, and often do things that frighten and surprise dreamers. Some imagined persons, such as characters in fiction, start off under conscious control of the author, but over time, can appear to gain an illusion of independent agency. I propose an explanation for different autonomy attributions: characters are by default non-autonomous, unless their personalities are well-practiced. Characters become autonomous because modeling their thinking has become automatized, like many other well-practiced activities. (shrink)

Many commentators suppose that the principles of Aristotle’s Politics are received from his theoretical works. Yet this way of understanding the Politics does not sufficiently appreciate Aristotle’s division of sciences, and it obscures the relevance of his political reflections for our time. We argue that Aristotle’s treatment of the polis and all it entails does not require his natural science and the principles of theoretical fields. Instead, despite wording that recalls theoretical treatises, Aristotle is careful to develop his political argumentation (...) without any such dependence. (shrink)

The question of what role social and political practices should play in the justification of normative principles has received renewed attention in post-millennium political philosophy. Several current debates express dissatisfaction with the methodology adopted in mainstream political theory, taking the form of a criticism of so-called ‘ideal theory’ from ‘non-ideal’ theory, of ‘practice-independent’ theory from ‘practice-dependent’ theory, and of ‘political moralism’ from ‘political realism’. While the problem of action-guidance lies at the heart of these concerns, the critics also (...) share a number of methodological assumptions. Above all, their methodology is practice-dependent in the sense that an existing practice is assumed to put substantial limitations on the appropriate normative principles for regulating it. In other words, we cannot formulate and justify an appropriate principle without first understanding the practice this principle is supposed to govern. The aim of this paper is to map out and analyze the common denominators of these debates with regard to methodological commitments. We will investigate how this practice-dependent method may be understood and motivated. The article advances a new way of thinking about classifications in general and the classification of mental disorders in particular. By applying insights from measurement practice to the context of classification, I defend a notion of epistemic accuracy that allows one to evaluate and improve classifications by comparing different classifying methods to each other. Progress in classification arises from the mutual development of classification systems and classifying methods. Based on this notion of accuracy, the article illustrates with an example (...) how psychiatric classifications can be improved via circumscribed comparisons of different perspectives on mental disorders, without relying on complete models of their complex aetiology. When applying this strategy, the traditional opposition between symptom-based and causal approaches is of little consequence for making progress in the epistemic accuracy of psychiatric classification. Although psychologist impairment has received attention from researchers, there is a paucity of empirical data aimed at determining the point at which such impairment necessitates action. The purpose of this study was to provide such empirical data. Members of Division 42 ( n = 285) responded to vignettes describing a psychologist whose symptoms of either depression or substance abuse varied across five levels of severity. Results identified specific levels of impairment at which psychologists were deemed too impaired to practice (...) psychotherapy, as well as significant differences between ratings of increasingly severe impairment. In the Algerian War of Independence, women famously used both traditional and modern clothing as part of their revolutionary efforts against French colonialism. This paper uncovers some of the principal lessons of this historical episode through a phenomenological exploration of agency, religion, and political transformation. Part I draws primarily on the philosophical insights of Martin Heidegger and Maurice Merleau-Ponty alongside the memoirs of Zohra Drif, a young woman member of the Algerian Front de Libération Nationale, in order to explore (...) the worldly and habitual nature of human agency in contrast to the Enlightenment stress on individual rationality and autonomy. Part II turns to John Russon’s phenomenological interpretation of religion in order to argue for the ineluctable significance of religion on human existence, in contrast to the modern tendency to oppose religious tradition and secular modernity. Part III analyzes the dynamics of intercultural communication, and argues for the political power of phenomenology as a critical enterprise that enables more just and emancipatory visions of collective human life and political transformation to come to the fore. I argue that the answer to the above question turns on three distinctions as to the meaning of content-independent reasons and the types of statement in which they feature. The first distinction is between two senses of content-independence, which I refer to as weak and strong content-independence. I argue that, while legal rules can (and often do) give rise to content-independent reasons in the weak sense, whether they can be said to generate content-independent reasons in the strong sense (...) depends on two further distinctions: first, a distinction between evaluative and descriptive statements about reasons (i.e., statements describing reasons as they figure in the internal assumption of a certain normative practice, such as law); second, a distinction between reasons for action and reasons for adopting certain attitudes. Strong content-independence, I argue, is a sound notion only insofar as it figures in descriptive reason-statements (as opposed to evaluative reason-statements) with regard to actions (as opposed to attitudes). Finally, I uncover an underlying explanation that links the different senses in which legal rules provide content-independent reasons, and accounts for the differences between them. (shrink)

The practice-dependent approach to justice has received a lot of attention in post-millennium political philosophy. It has been developed in different directions and its normative implications have been criticized, but little attention has been directed to the very distinction between practice-dependence and practice-independence and the question of what theoretically differentiates a practice-dependent account from mainstream practice-independent accounts. The core premises of the practice-dependent approach, proponents argue, are meta-normative and methodological. A key feature is (...) the presumption that a concept of justice is dependent on the function or aim of the social practices to which it is supposed to be applied. Closely related to this meta-normative thesis is an interpretive methodology for deriving principles of justice from facts about existing practices, in particular regarding their point and purpose. These two premises, practice-dependent theorists claim, differentiate their account since they are not accepted by practice-independent accounts and they justify different principles of justice than practice-independent accounts. Our aim in this article is to refute both and, demonstrating that practice-independent accounts may indeed accept the meta-normative and methodological premises of the practice-dependent accounts, and that we are given no theoretical reason to think that practice-dependent accounts justify other principles of justice for a practice than do practice-independent accounts. In other words, practice-dependent theorists have not substantiated their claim that practice-dependence is theoretically differentiated from mainstream accounts. When practice-dependent proponents argue for other principles of justice than mainstream theorists, it will be for the usual reason in normative theory: their first-order normative arguments differ. Current scholars generally view political obligations as "content independent." Citizens have moral reasons to obey the law because it is the law, rather than because of the content of different laws. However, this position is subject to criticism on both theoretical and practical grounds. The main consideration in favor of content independence, the so-called "self-image of the state," does not actually support it. Properly understood, the state's self-image is to comply with laws because of the underlying moral reasons that (...) justify them, rather than because they are laws. Because content independence has played a central role in the widespread belief that a suitable theory of political obligation is not possible, rejecting it allows the possibility of a theory that establishes moral requirements for virtually all citizens to behave in accordance with virtually all laws, although these requirements are particular to different laws, and subjects are not required to obey them because they are laws. Considering the reward and punishment mechanism of the management committee and the complexity of innovation path selection of high-tech and general enterprises, this paper constructs an evolutionary game model of independent innovation incentive mechanism in the National Independent Innovation Demonstration Zone of China. Meanwhile, the equilibrium points of the strategy selection are solved for the three. In addition, this paper adopts numerical simulation to analyze the influence of each decision variable on different players’ strategic selections. The results show that the (...) initial willingness of the management committee, high-tech and general enterprises has different influences on each other, and these factors such as independent innovation cost, technology spillover coefficient, and patent royalty significantly affect the strategic selection of enterprises; the reward and punishment mechanism of the management committee can enhance the innovation willingness of high-tech and general enterprises, in which these punitive measures can promote further the independent innovation of the two; the greater the innovation subsidy provided by the management committee to high-tech enterprises, the heavier the punishment for general enterprises, and the better the effect of independent innovation incentives. The results can provide theoretical guidance and practical reference for the management committee to formulate the independent innovation incentive policies in the National Independent Innovation Demonstration Zone. On August Business Roundtable, the Business Roundtable redefined the purpose and social responsibility of the corporation. Yet, this statement must be followed by substantial changes in the business models of corporations for it to avoid becoming empty rhetoric. We believe that the figure of the independent director may be one of the catalysts needed for this change of paradigm for corporations. In spite of the positive correlation between Corporate Social Responsibility and board independence, the development of the independence (...) of boards during the last decade has not lead to the expected CSR results. Academics and regulators point to a weak definition and the non-standardized measurement of both independence and board independence as one possible explanation, and agree that a broader definition is needed. This paper aims to contribute to this debate. We develop a second-generation definition of independence based on a positive approximation to the concept by integrating an Aristotelian perspective of virtue ethics with the best practices of corporate governance. Thus, we define independence as a virtue guided by practical wisdom, that implies autonomy and autarky and which enables a person to act with integrity, fairness and truthfulness. In the context of corporate governance, independence is associated with an honest disposition to serve. Our proposal has political implications for supervisors that make decisions relating to the suitability of board members. (shrink)

Functional near-infrared spectroscopy has attracted increasing attention in the field of brain–computer interfaces owing to their advantages such as non-invasiveness, user safety, affordability, and portability. However, fNIRS signals are highly subject-specific and have low test-retest reliability. Therefore, individual calibration sessions need to be employed before each use of fNIRS-based BCI to achieve a sufficiently high performance for practical BCI applications. In this study, we propose a novel deep convolutional neural network -based approach for implementing a subject-independent fNIRS-based BCI. A total (...) of 18 participants performed the fNIRS-based BCI experiments, where the main goal of the experiments was to distinguish a mental arithmetic task from an idle state task. Leave-one-subject-out cross-validation was employed to evaluate the average classification accuracy of the proposed subject-independent fNIRS-based BCI. As a result, the average classification accuracy of the proposed method was reported to be 71.20 ± 8.74%, which was higher than the threshold accuracy for effective BCI communication as well as that obtained using conventional shrinkage linear discriminant analysis. To achieve a classification accuracy comparable to that of the proposed subject-independent fNIRS-based BCI, 24 training trials were necessary for the traditional subject-dependent fNIRS-based BCI. It is expected that our CNN-based approach would reduce the necessity of long-term individual calibration sessions, thereby enhancing the practicality of fNIRS-based BCIs significantly. (shrink)

This paper explores the practices of auditors in a non-Western cultural environment. Drawing on Alasdair MacIntyre’s virtue ethics framework and narrative interviews with twenty Tunisian auditors, we investigate how auditors reconcile their duty to independence with the expectations of a kinship economy. Additionally, we explore how institutions—such as professional oversight bodies—play into this reconciliation. We find that, although auditors may pursue a telos at odds with international auditing standards, the purpose that these auditors serve is congruent with their moral (...) tradition. That is, rather than positioning themselves as objective arbiters of financial reporting, these auditors position themselves as guardians of their auditees. While this revised position engenders conduct that may appear to violate their independence, our auditors’ practices are congruent with the virtues of justice, courage, and honesty, as they conceive of them in the context of a Tunisian moral tradition. This study makes two main contributions to the literature. First, we provide empirical evidence into the ways in which auditors redefine independence in the context of a kinship economy. Second, we demonstrate that, when auditing local firms, auditors apply a version of professionalism that emphasizes community-oriented care over objectivity. (shrink)

An increasingly popular approach to global justice claims we should be ‘integrationist,’ where integrationism represents an attempt to unify our theorising between different domains of global politics. These political theorists have argued that we cannot identify plausible principles in one domain, such as climate justice, which are not sensitive to general moral concerns. This paper argues we ought to reject the concept of integrationism. It shows that integrationism is either trivial, or it obscures relevant disagreement by ignoring the distinctive methodological (...) and substantive commitments held by its opponents. The paper then argues that the relevant disagreement is actually about the role of practices for political philosophy and, as such, should be framed in terms of the distinction between practice-dependent and practice-independent theory. Finally, I provide my own account of that distinction, identifying a practice-dependent claim that those concerned about the narrowness of prominent accounts of global justice should target. The use of technology and teaching techniques derived from technology is currently a bourgeoning topic in higher education. Teachers at all levels and types of institutions want to know how these new technologies will affect what happens in and outside of the classroom. Many teachers have already embraced some of these technologies but remain uncertain about their educational efficacy. The study is devoted to the organization of independent training of military specialists in a military university when teaching the Russian language. The purpose of the article is to prepare means for managing self-training, taking into account the creation of effective mechanisms for intensive training using modern interactive techniques that stimulate the motivational interest of military specialists in verbal communication and organizing their own speech. The article offers practical recommendations for mastering textual activity both under the guidance of a teacher (...) and in self-training, promoting the individualization of learning and self-management of the speech-thinking intellectual-cognitive process. To solve the problem, research methods such as applied and descriptive were used. The presented article actualizes the problem of organizing self-training in teaching Russian as a foreign language to foreign-speaking military personnel. Factors specific to a special purpose educational institution are analyzed, to which a teacher teaching RFL in short-term intensive courses must pay close attention. The idea is substantiated that it is necessary to take into account the specifics of special-purpose educational institutions when training, as well as to compensate for the limited language environment, which will entail the effectiveness of mastering language training programs for military specialists. The key problematic points on the way to preparing for the development of short-term language training programs are identified and characterized. The conditions and ways to eliminate difficulties in the process of learning the Russian language are identified and argued, the implementation of which will allow the teacher to effectively carry out language training. As a result of this study, the author concludes that the correct organization of independent work of foreign language students can increase the effectiveness of their learning of the Russian language, and also contribute to the formation of the personality of a specialist ready for self-development and self-education. A case is made here for a secular interpretation of spirituality to place against more orthodox religious versions which are currently gaining ground in English education as part of the government policy designed to encourage schools to apply for ‘academy’ status independent of local authority control. Given the rise of faith-based ‘free’ schools, it is important to provide a secular alternative as a foundation for morality and spirituality in the interests of maintaining state-funded institutions characterised by rationality and autonomy rather (...) than a commitment to nurturing specific religious beliefs. After considering arguments against faith-based education, I go on to suggest a secular approach to spirituality founded on mindfulness theory and practice originating in Buddhist traditions. Against the background of historical antipartyism in practice and in democratic theory, and with a focus on American political thought, this paper takes issue with contemporary arguments that value the political identity ‘Independent’ and disparage partisanship. A typology of ‘Independent’ is offered and both empirical and moral claims about the superiority of Independent voters are rebutted, with particular focus on the ‘weightlessness’ of Independents. The reasons to appreciate the moral distinctiveness of partisanship for democracy are set out: commitment to (...) political pluralism, to regulated political rivalry, and to shifting responsibility for governing. This work is a manifesto for epistemic independence: the independence of good thinking from practical considerations. It presents a functionalist account of the normativity of assertion in conjunction with an integrated view of the normativity of constative speech acts.

My project is to reconsider the Kantian conception of practical reason. Some Kantians think that practical reasoning must be more active than theoretical reasoning, on the putative grounds that such reasoning need not contend with what is there anyway, independently of its exercise. Behind that claim stands the thesis that practical reason is essentially efficacious. I accept the efficacy principle, but deny that it underwrites this inference about practical reason. My inquiry takes place against the background of recent Kantian metaethical (...) debate — each side of which, I argue, correctly points to issues that need to be jointly accommodated in the Kantian account of practical reason. The constructivist points to the essential efficacy of practical reason, while the realist claims that any genuinely cognitive exercise of practical reason owes allegiance to what is there anyway, independently of its exercise. I argue that a Kantian account of respect for persons (“recognition respect”) suggests how the two claims might be jointly accommodated. The result is an empirical moral realism that is itself neutral on the received Kantian metaethical debate. (shrink)

This paper considers the problem posed for impartialism about reasons by the claim that practical reasoning is essentially first personal. This argument, first put forward by Bernard Williams, has an obscure rationale. Barry Stroud has suggested that in the only sense in which it is true it is misrepresents the issue which is that substituting in a particular identity to a conclusion true of anyone can change the degree of support for a practical conclusion. This paper develops a complementary line (...) of argument. Developing Stroud’s point and interpreting it as highlighting the non-monotonicity of practical reasoning, it is argued that the distinguishing feature of practical reasoning is that it terminates in an action as its conclusion. Actions are the expression of one’s all things considered judgement and the expression of intentional states in action. The obvious rejoinders to this view are canvassed and deflected; this Aristotelian thesis is independently motivated as making best sense of the fact that practical questions may “turn out variously”. Contemporary political theory is characterised by a realistic critique of liberalism. Realist theorising is seen as avoiding foundational disagreements about justice mutating into second-order disputes concerning the justifiability of legitimate political institutions. In this sense, the realist critique challenges a key aspect of Rawls’ liberal project – that is, its justificatory constituency. McCabe’s Modus Vivendi Liberalism presents an interesting case of such a critique. Given the condition of deep pluralism that characterizes contemporary democracies, the liberal Justificatory Requirement (JR) should be (...) recast so to include those, illiberal or sceptical, who are excluded by Rawls’ justificatory constituency. This paper confronts McCabe’s modus vivendi justificatory project with Rawls view. It suggests that both views seem to endorse a practice-dependent account of political justice in which “politics is prior to morality”; yet the ways in which reasons are endorsed to justify the shared conception of political authority are significantly different in these two schemes. The paper shows that the most problematic aspect of McCabe contingent model is that it disconnects the idea of legitimacy from a conception of liberal political morality. On this account, political legitimacy that reflects the uncoercive character of extant institutions seems to be sufficient to meet the MVL JR. Yet, from a normative point of view, this might be not enough to ensure morally acceptable outcomes. In conclusion, the paper considers McCabe’s model as a version of ‘practice-independent’ moral theorizing committed to a transcendent view of ‘threshold morality’. This move, however, comes at the cost of sacrificing the theory’s premises of anti-perfectionism and realism. (shrink)

This book examines a basic problem in critical approaches to political and social inquiry: in what way is social inquiry animated by a practical intent? This practical intent is not external to inquiry as an add-on or a choice by the inquirer, but is inherent to the process of inquiry. The practical intent in inquiry derives from the connection between social inquiry and the participant's perspective. The social inquirer, in order to grasp the sense of those who are the subject (...) of inquiry, has to adopt the perspective of the participant in the social world. Caterino opposes the view that research is an autonomous activity distinct from or superior to a participant's perspective. He argues that since the inquirer is on the same level as the participant, all inquiry should be considered mutual critique in which those who are addressed by inquiry have an equal right and an equal capacity to criticize addressors. The religious transnationalism evident in the 21st century has heralded a new paradigm of religion ‘made to travel’ as adherents of religions navigate various cultural frontiers within Africa, Europe and North America. The role of Africa in shaping the global religious landscape, particularly the Christian tradition, designates the continent as one of the major actors of the Christian faith in the 21st century. The inability of European Christianity to address most of the existential realities of Africans and the stigmatisation of (...) African Traditional Religion mainly contributed to the emergence of African Independent Churches in the 19th century in Africa. The emergence and proliferation of African Independent Churches in Africa was Africa’s response to Europeanised Christianity with its imperialistic doctrines and practices that negated expectation of its new context – Africa. Despite the declining fortunes of Christianity in the West, African Christianity, which includes the African Independent Churches and African Pentecostal traditions, is now a major non-commodity export within Africa and North America. Apart from their rituals and peculiarities, African Independent Churches like other faith organisations are development actors. Although notions about the role of religion in development amongst some social scientists are mainly negative, African Independent Churches over the years are actively involved in various human and community transformation initiatives. This study argues that the transnational status of African Independent Churches has led to the emergence of developmental ideals that defy territorialisation. The collaboration with some Western development agencies by some of the African Independent Churches in Diaspora further blurs the concept of diaspora as the members of this Christian movement are active development actors in the receiving nations and their former home countries. This study argues that the role of religion in development in any context cannot be overemphasised. As a result of the globalisation of African Independent Churches, the United Kingdom and Nigeria will serve as our case study using historical survey and descriptive analyses to highlight African Independent Churches as development actors. Purpose. The article is aimed to analyse the phenomenon of bodily memory in the context of commemorative practices. The commemorative practices are a social instrument known since archaic times, which had different ways of use in different epochs. In totalitarian societies, officially organized commemorative practices are frequently used for propaganda and manipulation. For most people, their mechanism remains unconscious, as bodily memory plays a leading role there. The density of a modern social world actualises the ability to observe own changes (...) and regulate the processes of their flow. This updates an exploration of the bodily memory phenomenon. Theoretical basis. The classification of forms of bodily memory is carried out in the article: genetic, psychophysical, psychoenergetic, mental. It has been revealed that the systemic openness of bodily memory is the fundamental basis of commemorative practices. Originality. The term "conscious commemoration" is proposed to denote the anthropological process associated with self-knowledge, self-construction and co-creation, which requires a distinction between forms of bodily memory, understanding of its structural features and functional capabilities. Conclusions. The phenomenon of bodily memory reveals the anthropological potential of commemorative practices. It can manifest itself as an independently organized body-spiritual practice of self-construction on the basis of self-knowledge and self-observation. The latter is the foundation of conscious co-creation. The phenomenon of bodily memory reveals the secret of spiritualization in the process of approaching a person to his body. (shrink)

This article outlines the context in which General National Vocational Qualifications (GNVQs) have been developed with particular reference to the independent learning dimension of their principles and practice. It provides an overview of the problems associated with the GNVQ approach from the literature and from a study by the authors of twelve post-16 institutions in the process of implementing Advanced GNVQ programmes. It analyses the dimensions of independent learning and argues that GNVQs provide a hybrid learner experience in which (...) autonomy in the organisation of the individual learning process is mediated by a heavily prescribed GNVQ framework. This book examines the legal principle of judicial independence in comparative perspective with the goal of advancing a better understanding of the idea of an independent judiciary more generally. From an initial survey of judicial systems in different countries, it is clear that the understanding and practice of judicial independence take a variety of forms. Scholarly literature likewise provides a range of views on what judicial independence means, with scholars often advocating a preferred conception of a (...) model court for achieving 'true judicial independence' as part of a rule of law system. This book seeks to reorient the prevailing approach to the study of judicial independence by better understanding how judicial independence operates within domestic legal systems in its institutional and legal dimensions. It asks how and why different conceptualisations of judicial independence emerge over time by comparing detailed case studies of courts in two legally pluralistic states, which share inheritances of British rule and the common law. By tracing the development of judicial independence in the legal systems of Malaysia and Pakistan from the time of independence to the present, the book offers an insightful comparison of how judicial independence took shape and developed in these countries over time. From this comparison, it suggests a number of contextual factors that can be seen to play a role in the evolution of judicial independence. The study draws upon the significant divergence observed in the case studies to propose a refined understanding of the idea of an independent judiciary, termed the 'pragmatic and context-sensitive theory', which may be seen in contradistinction to a universal approach. While judicial independence responds to the core need of judges to be perceived as an impartial third party by constructing formal and informal constraints on the judge and relationships between judges and others, its meaning in a legal system is inevitably shaped by the judicial role along with other features at the domestic level. The book concludes that the adaptive and pragmatic qualities of judicial independence supply it with relevance and legitimacy within a domestic legal system. (shrink)

In China, practice‐oriented views of science can be traced back to antiquity. In ancient times, the Chinese people independently created and developed application‐oriented sciences, but they ignored basic science. In modern times, China learned and introduced Western science and technology as a practical instrument to protect the nation and make it prosperous and powerful. Through technology and production, science has been playing an immediate and major role in the development of socialism since 1949. Since 1978, the Chinese government has (...) always emphasized that science and technology are the primary productive forces. From ancient times to the present, the practice‐oriented views of science are grounded in politics. Science has been the handmaiden of politics since the Qin Dynasty. However, this state of affairs hinders the development of basic science, a science that is not oriented toward immediate application. It also hinders open‐minded, critical reflection on the downsides or limits of science, which could draw on broader (moral, spiritual, or religious) values. (shrink)

Experiment, instrumentation, and procedures of measurement, the body of practices and technologies forming the technical culture of science, have received at most a cameo appearance in most histories. For the history of science is almost always written as the history of theory. Of course, the interpretation of science as dominated by theory was the main pillar of the critique, launched by Kuhn, Quine, Hanson, Feyerabend, and others, of the positivist and logical empiricist traditions in the philosophy of science. Against Carnap, (...) Hempel, Nagel, and Popper, who accorded observation reports an independent status either as a source of inductive support or as a basis for the falsification of scientific theories, Hanson and Kuhn emphasized the theory-ladenness of observation. They made this central point – that all observation is shaped by reference to theory – the cornerstone of a full-blown philosophy of science by buttressing it with two additional lines of argument: First, theories are always underdetermined by the data, several theories being compatible with the same set of data. Hence, choice between theories is never a matter of empirical support, but always turns around conceptual issues. Second, statements derived from theory never confront nature alone; they are always clothed in a web of interrelated beliefs. Thus, theories, their associated observation languages, and the entire technical culture they support must be accepted or rejected as wholes. (shrink)

In this paper, I make three points. The first is that there is indeed a distinctive approach to moral methodology, different from standard moral reasoning, that can be described as “practice-dependence”. I argue that its distinctness lies in recommending an aptness claim , namely that moral principles for regulating social practices must be principles for better fulfilling the point of those practices, a point discoverable in shared understandings of the practice. Participants treat domestic political societies as having a (...) different point to the practice of international relations. On this approach, then, different moral principles apply in each case: principles of distributive justice between citizens in the former and principles of cooperative fairness between states in the latter. My second point is that this approach fails, however, an important test which I call the justifiability constraint . Any formulation of a moral principle assigning rights and duties, benefits and burdens, to people should be justifiable to those persons by reference to a moral value. Yet, as I show, the practice-dependence view cannot offer any justification based on moral value for the aptness claim. My last point is that both endorsers and critics of practice-dependence have mistakenly attributed this approach to theorists who restrict the scope of justice on the basis of moral justification. Such views are, in fact, incompatible with the aptness claim given that they offer plausible independently derived moral grounds for restricting the scope of justice. They are also compatible with the justifiability constraint. For these reasons, I conclude that practice-dependence is a red herring for debates on global justice. (shrink)

Allied health professionals play an integral role in providing safe, affordable care to communities in need. Laws that define the permissible scope of practice for these professionals may take full advantage of these providers and may unnecessarily restrict safe and effective care. Nurse practitioners in many states may provide care independent of a physician; research reveals that this care is safe, affordable and accessible. Yet hurdles exist that prevent communities from securing the full benefit of NPs in independent (...) class='Hi'>practice. The scope of independent practice for allied dental providers varies greatly across the country, often including stringent supervision requirements. Emerging approaches to allowing allied dental providers to practice independently in certain settings or with dentist supervision via telemedicine and creating the intermediate provider, the dental therapist, may increase access to safe, affordable dental care. Research on the impact of laws that allow broader independent practice by NPs to ferret out the hurdles to full implementation of the spirit of such laws is needed. That research could support expanded independent scope for allied dental providers and other allied health care providers. (shrink)

"Practice in Christianity is the second volume in what could be called the "collected Works" of "Anti-Climacus," Kierkegaard's new pseudonym. Anti-Climacus's first volume, The Sickness Unto Death, appeared just a year earlier in 1849. The use of a pseudonym is consistent with Kierkegaard's usual practice when presenting an idealized statement of his subject, be it sexual seduction or Christian theology. Anti-Climacus argues the conceptual content of Christianity against the "leading thought of the times" and also against the ethical (...) and social import of the comforts and consolations of bourgeois culture and religion which he called "Christendom." In his own mind at least, Kierkegaards presents Christianity as it must be thought and lived if it is to be authentic. The Sickness unto Death and Practice in Christianity can be and are read quite independently, but jointly they provide the basis of Kierkegaard's devastating critique of a secularized, culturally homogenized, and tame Christianity. The authors of the studies in this present volume, Merold Westphal, Paul R. Sponheim, Murray A. Rae, Niels Jorgen Cappelorn, Sylvia Walsh, David D. Possen, Andrew J. Burgess, Christian Fink Tolstrup, Robert L. Perkins, and Wanda Warren Berry, raise a wide spectrum of issues regarding Practice in Christianity, its theology, its moral and religious psychology, and its cultural, social, and political world" --. John Dewey attempted a pragmatic aufhebung of the disparate methodological aims of social science-explanation, understanding, and critique- in his 1938 Logic: the theory of Inquiry. There, in his penultimate chapter ‘Social Inquiry’, Dewey performed a trademark implementation of his deflation of absolutistic and universalistic pretensions in intellectual and theoretical discourse, in this case with respect to any one approach to social science. This deflation--as elsewhere in his analogous treatments of epistemology, ethics, and the theory of action-- involved the reconstruction of (...) the claims of the naturalist, interpretivist, and critical schools of social science into one overall pattern of social inquiry. This recasts the different and seemingly irreconcilable aims of these schools into a series of steps in a practice. That these claims, then, simultaneously stand independently but in varying degrees of tension with, and support of, each other is a hallmark of pragmatism’s embrace of pluralism in intelligent problem solving. Dewey’s discussion of interpretation needs supplementation from his broader philosophical commitments in order to see the full sense of both the compatibility and the incompatibility of his theory with philosophical hermeneutics.
