This article is about the information relevant to decision-making capacity in refusal of life-prolonging medical treatment cases. We examine the degree to which the phenomenology of the options available to the agent—what the relevant states of affairs will feel like for them—forms part of the capacity-relevant information in the law of England and Wales, and how this informational basis varies across adolescent and adult medical treatment cases. We identify an important doctrinal phenomenon. In the leading authorities, the courts appear to (...) count the first-personal phenomenology of the available options among the information that adolescents seeking to refuse life-prolonging treatment must understand and appreciate in order to possess capacity; adults are not held to this (higher) standard. We evaluate this differential treatment in light of philosophical work on transformative choice—decisions involving options whose sensory character, and effect on our values and preferences, are grasped only through experience itself. This book tries to answer two key questions. The first is why certain periods are more prone to war than others. The other is why certain wars that involve polar powers end with their territorial expansion whereas other wars end in their contraction or maintaining their territorial status. In conclusion, it is asked whether the polarity of the system affects these two outcomes, and if so, how.

Adolescents are routinely treated differently to adults, even when they possess similar capacities. In this article, we explore the justification for one case of differential treatment of adolescents. We attempt to make philosophical sense of the concurrent consents doctrine in law: adolescents found to have decision-making capacity have the power to consent to—and thereby, all else being equal, permit—their own medical treatment, but they lack the power always to refuse treatment and so render it impermissible. Other parties, that is, individuals (...) who exercise parental responsibility or a court, retain the authority to consent on an adolescent’s behalf. We explore four defences of the doctrine. We reject two attempts to defend the asymmetry in the power to consent to and refuse medical treatment by reference to transitional paternalism. As seen in this book, Leibowitz's far-reaching public statements are not a certain aspect of this thinking, but its very essence. They are the essence of this thinking even when he is seemingly involved with other, distant issues, such as his exegesis of Maimonides and his writings (...) on popular science. These broad vistas are an invitation to those interested in Israel to meet an Israeli thinker who greatly impressed several generations of listeners, and to become acquainted with part of Israel's intellectual life. Recognized as one of the earliest Jewish neo-Platonist writers, Isaac ben Solomon Israeli influenced Muslim, Jewish, and Christian scholars through the Middle Ages. A native of Egypt who wrote in Arabic, Israeli explored definitions of such terms as imagination, sense-perception, desire, love, creation, and “coming-to-be” in his writings. This classic volume contains English translations of Israeli’s philosophical writings, including the _Book of Definitions_, the _Book of Substances,_ and the _Book on Spirit and Soul_. Additionally, _Isaac Israeli_ features a biographical sketch (...) of the philosopher and extensive notes and comments on the texts, as well as a survey and appraisal of his philosophy. The night journey (isrā’) and ascension (mi‘rāj) represent arguably the most significant and unique events in the life of Prophet Muḥammad. However, the influential Sufi thinker Muḥyī al-Dīn ibn ‘Arabī (d. 638/1240) argues that the Prophet had thirty-four night journeys of which only one was physical. This physical night journey, and the ascension that took place with it, was the one in which he was given the five daily prayers. Ibn ‘Arabī thus employs the secondary night journeys and ascensions of (...) Prophet Muḥammad to delineate a point of emulation between the Prophet’s spiritual experience and those of his nation. Muslims can also have their own ascensions, but their journeys cannot be physical, and, analogously, cannot have autonomous legislative authority. The Israeli health care system is looked upon by some people as one of the most advanced health care systems in the world in terms of access, quality, costs and coverage. The Israel health care system has four key components: (1) universal coverage; (2) ‘cradle to grave’ coverage; (3) coverage of both basic services and catastrophic care; and (4) coverage of medications. Patients pay a (relatively) small copayment to see specialists and to purchase medication; and, primary care is free. However, (...) during 2011 the Israeli Medical Association (IMA) spent 5 months on a strike, justifying it as trying to ‘save’ the Israeli public health. This paper describes some aspects of the Israeli Health Care System, the criteria for setting priorities for the expenditures on health care and values underlying these criteria. The paper observes that the new agreement between the IMA and the government has given timely priority to problematic areas of specialization (in which there is an acute shortage of physicians) and to hospitals in the periphery of the country. Yet weak points in the health system in Israel remain. Particularly, the extent to which national health care expenditures are being financed privately—which is rising—and the parallel decline in the role of government financing. (shrink)

The Pale God examines the relationship between secularism and religious tradition. It begins with a description of the secular options as expressed by Israeli intellectuals, and describes how these options have led to a dead end. A new option must be sought, and one of the key sources for this option is the works of Spinoza. The author explains that unlike Nietzsche, who discussed "the death of God," Spinoza tried to undermine the authority of religious virtuosos and establish the image (...) of a rational "Pale God." Such changes could channel religious tradition to the basic principles of secular political rule. The author demonstrates that the secular option is inherent in Israeli society, fits the type of secularism that Zionism instilled in the Jewish people, and complements the traditional trends deeply rooted in that society. The aim of this study was to examine how Muslim Arab–Israeli teachers conceptualize the Israeli–Arab conflict with their students. The findings show that Arab schools are in a constant state of tension between opposing poles of identity and belonging. The teachers emphasize their students’ alienation from the Israeli establishment and their lack of identification with the Jewish state, while expressing deep identification with the Palestinian people. They are able to cope with this split by seeking contents and coping mechanisms of (...) a universal nature that are not in dispute, and which enable students to repress the dissonance in which they live. This paper depicts the meanings of human dignity as they unfold and evolve in the Bible and the "Halakhah". I posit that three distinct features of a Jewish conception of human dignity can be identified in contrast to core characteristics of a liberal conception of human dignity. First, the original source of human dignity is not intrinsic to the human being but extrinsic, namely in God. Second, it is argued that the "dignity of the people" has precedence over personal autonomy (...) and liberty, which are core liberal pillars. The third characteristic pertains to the potential conflict between personal autonomy and liberty, and God's commandments. The theoretical analysis of human dignity is then examined in light of several Supreme Court decisions in Israel during the 1990s. I illustrate that Jewish religious and secular-liberal conceptions pull in different directions in the rulings of liberal and religious Justices in Israel. (shrink)

Since the founding of the state of Israel there has been a series of prolonged conflicts between Israel and the surrounding Arab countries, and especially Palestine. The entire global community was shocked by the issue of the bombardment of women and children in Gaza and Rafah. Amid the chaos of the Western subjectivity lobby and the silence of several influential muslim leaders and the UN, the Islamic and non-Islamic world needs to understand the future roots of Israel’s mysterious agenda through (...) ta’wīl and predictive analysis of Islamic Eschatology initiated by Imran Nazar Hosein. This article examines Israel’s agenda by studying the chronological eschatological concept of “Three Paxes” especially “Pax Judaica” using analytical-descriptive methods. In this qualitative research, researchers used library research by collecting data from several references such as main reference books, journals, videos, and others. According to the findings in this article, in Islamic Eschatology; the agenda is three stages starting in Great Britain (Pax Britannica) then in the US (Pax Americana), and moving on to Israel (Pax Judaica) before finally, the Antichrist appears to take over the throne of King Solomon in Jerusalem. Finally, the conclusion of Israel’s agenda from Imran Hosein’s allegorical interpretation is none other than to prepare a false Jesus (al-Dajjāl) after his systems (control of usury and the monetary system, politics, the emergence of Gog and Magog and biggest war) begin to be fulfilled. Assistive reproductive technologies are increasingly used to control the biology of fertility and its temporality. Combining historical, theoretical, and socio-empirical insights, this paper aims at expanding our understanding of the way temporality emerges and is negotiated in the contemporary practice of cryopreservation of reproductive materials. We first present an historical overview of the practice of cryo-fertility to indicate the co-production of technology and social constructions of temporality. We then apply a theoretical framework for analysing cryobiology and cryopreservation technologies as creating (...) a new epistemic perspective interconnecting biology and temporality. Thereafter, we focus on the case of ‘social egg freezing’ to present socio-empirical findings illustrating different reproductive temporalities and their connection to the social acceptance of and expectations towards the practice. SEF is a particularly interesting case as it aims to enable women to disconnect their reproductive potential from their biological rhythms. Based on 39 open interviews with Israeli and German SEF users, the cross-cultural comparative findings reveal three types of attitudes: postponing motherhood/reproductive decisions ; singlehood and “waiting” for a partner ; and the planning of and hope for multiple children. For theory building, this analysis uncovers temporality formations embedded in gender and reproductive moral values; including the ‘extended present’, ‘waiting’, and ‘reproductive futurism’. We conclude by discussing the contribution of our findings by advancing the theoretical framework of ‘cryopolitics’ highlighting the theoretical implications and importance of gendered and cultural imaginaries constructing medical technological innovations and related temporalities. Much of John Rawls' later work is concerned with the appli cation of his philosophical conceptions to the reality of liberal-democratic polities. I suggest that given the modern democratic reality of ethno national pluralism, Rawls' political conception of justice is insufficient to ensure democratic stability. Democratic states manage to contain ethnic pluralism while remaining compatible with liberal principles by promoting a corporate national identity. The key, I argue, lies in the particular member ship criteria devised and implemented by the state. (...) Fertility treatments, which are part of "assisted reproductive technologies" (ART), mainly undertaken through in vitro fertilization (IVF), offer the opportunity to infertile couples to conceive. IVF treatments are undertaken in Israel in significantly higher numbers than in the rest of the world. As such, Israel provides an important case-in-point for examining the validity of the actual claims used to justify the more generous public funding of IVF treatments at the policy level. In this article, we utilize an analytical philosophy approach (...) to conduct this examination. First, we highlight two fundamental concepts that were used at the Israeli public policy level in order to justify the generous public funding of IVF treatments. These concepts are “emotional vulnerability” and the “worthlessness of the childless,” where the latter emphasizes the infinite value of children. Then, by applying the perspective of the European model of Bioethical Principlism, and focusing the attention to these two concepts we show that these justifications are invalid. Specifically, it is suggested that these concepts are on the one hand both relying on and expressing the principles of vulnerability, dignity, and integrity; yet on the other hand, these concepts are also undermining the very principles of bioethics they are supposed to express and rely on. Based on this suggested criticism, we offer two “take home” messages informed by our analysis of the Israeli case, but reaching beyond it. (shrink)

The book addresses the representation of three groups of "others" in Israeli schoolbooks: Holocaust victims, presented as the stateless persecuted Jews "we" might become again if "we" lose control over the second group of "others" - Palestinian Arabs - who are racialized, demonized and Nazified, and presented as "our" potential exterminators. The third group comprises non-European (Mizrahi and Ethiopian) Jews, portrayed as backward people who lack history or culture, requiring constant acculturation by "Western" Israel. Thus, a rhetoric of victimhood and (...) power evolves, and a nationalistic interpretation of the "never again" imperative is inculcated, justifying the Occupation and oppression of Palestinians and the discrimination of non-European Jews. Advocating a multidirectional memory, the book proposes an alternative Hebrew-Arabic, multi-voiced and poly-centered curriculum that would relate the untold accounts of the people whom the pedagogic version of history seeks exclude. Instead of traumatizing and urging vengeance, it will encourage discussion and celebrate diversity and hybridity. (shrink)

This paper characterizes a present institutionalizedunwillingness of both the Israeli and Palestinian educationalsystems to acknowledge each other's suffering because of the presenceof what the author terms `the otherness of the other.' This isdone largely through hegemonic control of memory of genocidesendured by both and through limiting constructions of the self.Coming to terms with `each other' paves the way for ahumanistic-oriented counter-education, one based in mutualacknowledgment and open dialogue.

Solidarity between the citizens of a country is both good and desirable, and public educational institutions are the clear site of education for such civil solidarity and its natural place is in Civics lessons. Nevertheless, this paper argues that it is impossible to educate for solidarity for all citizens in a liberal-democratic state when civic classes teach basic civil laws that exclude groups or minorities and expel them from the general civil population. Therefore, we can ask: What are the modes (...) of action that are open to Civics teachers and other educators who are caught in this trap when trying to educate for solidarity? As a reply to this question and by borrowing ideas from Michel Foucault’s thought, this paper equips teachers with some guidelines for pedagogical resistance to the excluding wave, that enable strengthening an inclusive civil solidarity, and demonstrates the applicability of these guidelines in the Israeli reality. In 2017, the Australasian Journal of Philosophy issued a rare retraction, informing their readers that one of their articles was not in fact written by a cat. The short article, a critique of David Lewis’s ‘Veridical Hallucination and Prosthetic Vision’, was published in 1981 under the name of ‘Bruce Le Catt’, a figure with no discernible institutional affiliation or track record of publishing, but who appears to have been familiar with Lewis’s work. As indeed he might have been, being the (...) beloved pet of the great American philosopher. -/- It may not have come as a surprise to those familiar with Lewis’s work that ‘Bruce Le Catt’ was not the pseudonym of an astute critic, but of Lewis himself. The playfulness of Lewis’s writing is well known: for instance, the paper ‘Holes’ (1970), co-written with Stephanie Lewis, is a dialogue between two characters, ‘Argle’ and ‘Bargle’, on the ontological status of holes as found in Gruyère, crackers, paper-towel rollers and in matter more generally. Nevertheless, the attribution of the 1981 paper to a cat seemed to cross a line. It may have been playful, but it was also deceptive, hence the retraction. -/- Lewis was not the only 20th-century philosopher to publish using an invented persona. The contents page of the book Explaining Emotions (1980), edited by Amélie Oksenberg Rorty, features the essay ‘Jealousy, Attention, and Loss’ by one Leila Tov-Ruach, listed on the Contributors page as ‘an Israeli psychiatrist, who writes and lectures on philosophic psychology’. Some readers might have noticed that this is a rather unusual name – a pun on laila tov ruach or ‘goodnight wind’ in Hebrew – and might have had their suspicions confirmed by the fact that there is no discernible trace of this psychiatrist elsewhere on the medical or academic record. Indeed, as an erratum on the University of California Press website drily notes, Amélie Oksenberg Rorty and Leila Tov-Ruach are indeed one and the same person. (shrink)

The ‘Marwa’ elementary school (pseudonym) – an Israeli public school on the border between Israel and the Palestinian Authority – is a unique educational institution in that, despite being not religious, it only accepts from Grade 1 through to Grade 6 girls. Several years ago, the principal decided to implement a Philosophy with Children (PwC) programme as an alternative pedagogy. This paper surveys how the educational faculty regarded the introduction of this curriculum and how it contributed towards the development of (...) philosophical discursive skills, a classroom atmosphere of friendship and caring, and critical and creative thinking competence amongst the students. One feature that classical apocalyptic writings commonly share is their eschatological dimension, their "sense of an ending"1—the end of the world, of time, of humanity. But whereas traditional apocalyptic texts were for the most part utopian, their tales of destruction followed by narratives of redemption, modern secular apocalyptic literature is largely dystopian, ending in pure devastation. According to some scholars, the very arrival of modernity, beginning with Cartesian philosophy and its inherent doubt, was apocalyptic in nature. Background/IntroductionInfertile couples that travel to another country for reproductive treatment do not refer to themselves as “reproductive tourists”. They might even be offended by this term. “Tourism” is a metaphor with hidden connotations. We will analyze these connotations in public media discourses on “reproductive tourism” in Israel and Germany. We chose to focus on these two countries since legal, ethical and religious restrictions give couples a similar motivation to travel for reproductive care, while the cultural backgrounds and conceptions of reproduction (...) are different. Results: Our research shows that the use of the metaphor “reproductive treatment” and its hidden messages depends on the writers’ intention and the target population. Although the phenomenon of patients travelling for reproductive treatment can fit into the definitions of tourism, the term emphasizes aspects that do not reflect patients’ reality. In both the German and the Israeli public media debate the term “reproductive tourism” is either used to criticize the economic aspects of the phenomenon or to attract patients as potential clients. Conclusions: Ethicists should be cautious when borrowing metaphors like “reproductive tourism” from the public debate. Our findings support Penning’s suggestion to use instead an unloaded term like cross-border reproductive care to describe the phenomenon in a more neutral way and to make it explicit whenever criticism is necessary. From Sartre to Levinas, continental philosophers have looked to the example of the Jew as the paradigmatic object of and model for ethical inquiry. Levinas, for example, powerfully dedicates his 1974 book Otherwise than Being to the victims of the Holocaust, and turns attention to the state of philosophy after Auschwitz. Such an ethics radically challenges prior notions of autonomy and comprehension-two key ideas for traditional ethical theory and, more generally, the Greek tradition. It seeks to respect the opacity of (...) the other and avoid the dangers of hermeneutic violence. But how does such an ethics of the other translate into real, everyday life? What is at stake in thinking the other as Jew? Is the alterity of the Jew simply a counter to Greek universalism? Is a rhetoric of exceptionalism, with its unavoidable ontological residue, at odds with shifting political realities? Within this paradigm, what then becomes of the Arab or Muslim, the other of the Jew, the other of the other, so to speak? This line of ethical thought-in its desire to bear witness to past suffering and come to terms with subjectivity after Auschwitz-arguably brackets from analysis present operations of power. Would, then, a more sensitive historical approach expose the Palestinian as the other of the Israeli? Here, Zahi Zalloua offers a challenging intervention into how we configure the contemporary. In his monumental Philosophy of the Kalam the late Harry Wolfson--truly the most accomplished historian of philosophy in our century--examined the early medieval system of Islamic philosophy. He studies its repercussions in Jewish thought in this companion book--an indispensable work for all students of Jewish and Islamic traditions. Wolfson believed that ideas are contagious, but that for beliefs to catch on from one tradition to another the recipients must be predisposed, susceptible. Thus he is concerned here not so much with (...) the influence of Islamic ideas as with Jewish elaboration, adaptation, qualification, and criticism of them. To this end he examines passages reflecting Kalam views by a wide variety of Jewish thinkers, including Isaac Israeli, Judah Halevi, Abraham ibn Ezra, and Maimonides. As always in Wolfson's work, two aspects are apparent: the special dimensions of Jewish thought as well as its relation to other traditions. And as always his prose is both graceful and precise.
