Starting January 1, 2017, the Oregon Health Authority (OHA, henceforth) made a sweeping decision that no elective surgery is to be performed for Medicaid recipients who smoke tobacco. The authors of this paper investigate the administrative procedures behind the OHA’s decision, explore some possible ethical arguments for and against the decision, and render our ethical verdict about the ban and our suggestion for the OHA. Meanwhile, since this issue involves the problems of smoking-related addiction, the agent’s autonomy which may be (...) understood in the light of moral freedom and rationality/irrationality, and our society’s perception about obesity and cigarette smoking; the paper engages in a deeper philosophical debate about the problems beyond the legal purview of the ban. The doyen of living English philosophers, by these reflections, took hold of and changed the outlook of a good many other philosophers, if not quite enough. He did so, essentially, by assuming that talk of freedom and responsibility is talk not of facts or truths, in a certain sense, but of our attitudes. His more explicit concern was to look again at the question of whether determinism and freedom are consistent with one another -- by shifting attention to certain personal (...) rather than moral attitudes, first of all gratitude and resentment. In the end, he arrived at a kind of Compatibilist or, as he says, Optimist conclusion. As I write this, in November 1971, people are dying in East Bengal from lack of food, shelter, and medical caxc. The suffering and death that are occurring there now axe not inevitable, 1101; unavoidable in any fatalistic sense of the term. Constant poverty, a cyclone, and a civil war have turned at least nine million people into destitute refugees; nevertheless, it is not beyond Lhe capacity of the richer nations to give enough assistance to reduce any further suffering to (...) very small proportions. The decisions arid actions of human beings can prevent this kind of suffering. Unfortunately, human beings have not made the necessary decisions. At the individual level, people have, with very few exceptions, not responded to the situation in any signihczmt way. Generally speaking, people have not given large sums to relief funds; they have not written t0 their parliamentaxy representatives demanding increased government assistance; they have not demonstrated in the streets, held symbolic fasts, or done anything else directed toward providing thc refugees with the means to satisfy their essential needs. At thc government level, no govcrmmcnt has given the sort of massive aid that would enable the refugees to survive fm: more than a few days. Britain, for instance, has given rather more than most countries. It has, to date, given £14,750,000. For comparative purposes, B1~itain’s share of thc nonreccverabla development costs of the Anglo-French Concorde project is already in excess of £275,000,000, and on present estimates will reach £440,000,¤00. First Published in 2004. Confusion reigns in sociological accounts of the curent condition of modernity. The story-lines from the 'end of the subject' to 'a new individualism', from the 'dissolution of society' to the re-emergence of 'civil society', from the 'end of modernity' to an 'other modernoity' to 'neo-modernization'. This book offers a sociology of modernity in terms of a historical account of social transformations over the past two centuries, focusing on Western Europe but also looking at the USA and (...) at Soviet socialism as distinct variants of modernity. A fundamental ambivalence of modernity is captured by the double notion of liberty and discipline in its three major dimensions: the relations between individual liberty and political community, betwen agency and structure, and between locally situated human lives and widely extended social institutions. Two major historical transformations of modernity are distinguished, the first one beginning in the late nineteenth century and leading to a social formation that can be called organized modernity, and the second being the one that dissolves organized modernity. It is this current transformation which revives some key concerns of the 'modern project', ideas of liberty, plurality and individual autonomy. But it imperils others, especially the creation of social identities as ties between human beings that allow meaningful and socially viable development of individual autonomy, and the possibility of politics as communicative interaction and collaborative deliberation about what human beings have in common. In recent years a number of oppressed groups have campaigned vigorously for equality. The classic instance is the Black Liberation movement, which demands an end to the prejudice and discrimination that has made blacks second-class citizens. The immediate appeal of the black liberation movement and its initial, if limited, success made it a model for other oppressed groups to follow. We became familiar with liberation movements for Spanish-Americans, gay people, and a variety of other minorities. When a majority group—women—began their (...) campaign, some thought we had come to the end of the road. Discrimination on the basis of sex, it has been said, is the last universally accepted form of discrimination, practiced without secrecy or pretense even in those liberal circles that have long prided themselves on their freedom from prejudice against racial minorities. Introduction Call a theory of the good—be it moral or prudential—aggregative just in case (1) it recognizes local (or location-relative) goodness, and (2) the goodness of states of affairs is based on some aggregation of local goodness. The locations for local goodness might be points or regions in time, space, or space-time; or they might be people, or states of nature.1 Any method of aggregation is allowed: totaling, averaging, measuring the equality of the distribution, measuring the minimum, etc.. Call (...) a theory of the good finitely additive just in case it is aggregative, and for any finite set of locations it aggregates by adding together the goodness at those locations. Standard versions of total utilitarianism typically invoke finitely additive value theories (with people as locations). A puzzle can arise when finitely additive value theories are applied to cases involving an infinite number of locations (people, times, etc.). Suppose, for example, that temporal locations are the locus of value, and that time is discrete, and has no beginning or end.2 How would a finitely additive theory (e.g., a temporal version of total utilitarianism) judge the following two worlds? Goodness at Locations (e.g. times) w1:..., 2, 2, 2, 2, 2, 2, 2, 2, 2, ..... w2:..., 1, 1, 1, 1, 1, 1, 1, 1, 1, ..... Example 1 At each time w1 contains 2 units of goodness and w2 contains only 1. Intuitively, we claim, if the locations are the same in each world, finitely additive theorists will want to claim that w1 is better than w2. But it's not clear how they could coherently hold this view. For using standard mathematics the sum of each is the same infinity, and so there seems to be no basis for claiming that one is better than the other.3 (Appealing to Cantorian infinities is of no help here, since for any Cantorian infinite N, 2xN=1xN.). The latest in the series based on the popular History of Philosophy podcast, this volume presents the first full history of philosophy in the Islamic world for a broad readership. It takes an approach unprecedented among introductions to this subject, by providing full coverage of Jewish and Christian thinkers as well as Muslims, and by taking the story of philosophy from its beginnings in the world of early Islam all the way through to the twentieth century. Major figures like Avicenna, (...) Averroes, and Maimonides are covered in great detail, but the book also looks at less familiar thinkers, including women philosophers. Attention is also given to the philosophical relevance of Islamic theology (kalam) and mysticism--the Sufi tradition within Islam, and Kabbalah among Jews--and to science, with chapters on disciplines like optics and astronomy. The book is divided into three sections, with the first looking at the first blossoming of Islamic theology and responses to the Greek philosophical tradition in the world of Arabic learning. This 'formative period' culminates with the work of Avicenna, the pivotal figure to whom most later thinkers feel they must respond. The second part of the book discusses philosophy in Muslim Spain (Andalusia), where Jewish philosophers come to the fore, though this is also the setting for such thinkers as Averroes and Ibn Arabi. Finally, a third section looks in unusual detail at later developments, touching on philosophy in the Ottoman, Mughal, and Safavid empires and showing how thinkers in the nineteenth to the twentieth century were still concerned to respond to the ideas that had animated philosophy in the Islamic world for centuries, while also responding to political and intellectual challenges from the European colonial powers. Justice and Libertarianism The term ‘justice’ is commonly used in several different ways. Sometimes it designates the moral permissibility of political structures (such as legal systems). Sometimes it designates moral fairness (as opposed to efficiency or other considerations that are relevant to moral permissibility). Sometimes it designates legitimacy in the sense of it being morally impermissible for others to interfere forcibly with the act or omission (e.g., my failing to go to dinner with my mother may be wrong but nonetheless (...) legitimate). Finally, sometimes it designates what we owe each other in the sense of respecting everyone’s rights. Of course, these notions are closely related. What we owe each other may, but need not, be partly based on issues of fairness. Legitimacy and permissibility of political structures are largely, but perhaps not entirely, determined by what rights of non-interference individuals have. Nonetheless, these are distinct notions and we shall focus only on what we owe each other. Justice as what we owe each other is not concerned with impersonal duties (duties owed to no one, i.e., that do not correspond to anyone’s rights). If there are impersonal duties, then something can be just but nonetheless morally impermissible. For brevity, we shall often write of actions being permissible or agents having a moral liberty, but this should always be understood in the interpersonal sense of violating no one’s rights. Libertarianism is sometimes advocated as a derivative set of rules (e.g., derived from rule utilitarian or contractarian doctrines). Here, however, we reserve the term for the natural rights doctrine that agents initially fully own themselves. Agents are full self-owners just in case they own themselves in precisely the same way that they can fully own inanimate objects. Stated slightly differently, full self-owners own themselves in the same way that a full chattel-slaveowner owns a slave. Throughout, we are concerned with moral ownership and not legal ownership.. ‘British Empiricism’ is a name traditionally used to pick out a group of eighteenth-century thinkers who prioritised knowledge via the senses over reason or the intellect and who denied the existence of innate ideas. The name includes most notably John Locke, George Berkeley, and David Hume. The counterpart to British Empiricism is traditionally considered to be Continental Rationalism that was advocated by Descartes, Spinoza, and Leibniz, all of whom lived in Continental Europe beyond the British Isles and all embraced innate (...) ideas. This article characterizes empiricists more broadly as those thinkers who accept Locke’s Axiom that there is no idea in the mind that cannot be traced back to some particular experience. It includes British-Irish Philosophy from the seventeenth, eighteenth, and nineteenth century. As well as exploring the traditional connections among empiricism and metaphysics and epistemology, it examines how British empiricists dealt with issues in moral philosophy and the existence and nature of God. The article identifies some challenges to the standard understanding of British Empiricism by including early modern thinkers from typically marginalised groups, especially women. Finally, in showing that there is nothing uniquely British about being an empiricist, it examines a particular case study of the eighteenth-century philosopher Anton Wilhelm Amo, the first African to receive a doctorate in Europe. Theories of explanation are characterized as being either pragmatic or non-pragmatic, without a clear sense of what this is supposed to mean. The present paper offers a definition of a "pragmatic explanation-sentence", and in terms of this, of a "pragmatic theory of explanation". It is argued that van Fraassen's theory of explanation, despite claims to the contrary, is not genuinely pragmatic. By contrast, the author's own "illocutionary" theory is pragmatic. Attention is devoted particularly to sentences of the form "E is (...) a good explanation of q", which, it is urged, are pragmatic in a strong sense. In defense of this claim, and of the advantages of a pragmatic account generally, appeal is made to Rutherford's 1911 subatomic explanation of the results of his scattering experiments. Implications of a pragmatic theory are drawn for the debate between realists and anti-realists and absolutists and relativists. (shrink)
