The book examines the philosophical foundations of private law, arguing that the foremost preoccupations of the law of obligations are grounded in and pervade the personal lives of individuals.

Efforts to apply the principle of proportionality to criminal sentences are notoriously problematic. But even though they are daunting, only a few legal philosophers believe we should give up trying to do so. Perhaps we can make progress overcoming some of the many legal difficulties by attending to how the principle is applied in non-legal contexts—that is, in contexts I call personal life. Proportionality, I believe, is an attractive principle in penal sentencing because it is an attractive principle in (...) ordinary situations in which persons are sanctioned for wrongdoing. I briefly mention several familiar non-legal contexts in which sanctions have recently been imposed on celebrities or public figures for real or perceived wrongdoing. My hope is that sensitivity to how the principle of proportionality is interpreted in these contexts might facilitate efforts to apply this principle to sentencing domains. At first glance, proportionality as applied in non-legal contexts appears to differ from its penal analogue. I describe some of these alleged differences. Among the foremost is that judgments of proportionality in personal life often respond to how the transgressor has behaved apart from the particular incident that has attracted media attention. Penal sanctions, by contrast, are said to be imposed only for the particular crime charged. I argue that this difference is more apparent than real. I conclude that we can reach a few modest insights about how to apply the principle of proportionality in criminal sentencing by attending to its counterpart in personal life. (shrink)

In this paper, I provide an analysis of Marya Schechtman's theory of personal identity defended in her book Staying Alive: Personal Identity, Practical Concerns, and the Unity of a Life.

The main attention is focused on time allocation for work and personal life in this article. The research consists of four parts. The first part of this article analyses the theoretical aspects of time allocation for work and personal life. The second part of the article justifies the methodology of the research. In the third part of the article, the time allocation for work and personal life is analysed. Finally, the discussion about time allocation for work and (...) personal life is provided. Having conducted the empirical analysis, the following conclusions can be drawn. The experts defined the concept of the balance between work and personal life in terms of time: the balance between work and personal life is achieved when a person feels consistency and harmony between work and personal life. In terms of time, sleep, work and personal life must be each given 8 h a day, proportionately. However, it has been empirically investigated that the most important area of time allocation for self-employed persons is work. Self-employed persons in Lithuania spent 22.5% of time a day on work, and 77.5% on personal life. Furthermore, in the end of this article, the main conclusions and possible future directions of the research are provided. (shrink)

Embodiment approaches to cognition and emotion have put forth the idea that the way we think and talk about affective events often recruits spatial information that stems, to some extent, from our bodily experiences. For example, metaphorical expressions such as “being someone’s right hand” or “leaving something bad behind” convey affectivity associated with the lateral and sagittal dimensions of space. Action tendencies associated with affect such as the directional fluency of hand movements (dominant right hand-side – positive; non-dominant left hand-side (...) – negative) and approach-avoidance behaviors (forward – positive; backwards – negative) might be mechanisms supporting such associations. Against this background, experimental research has investigated whether positive and negative words are freely allocated into space (e.g., close or far from one’s body) or resonate with congruent (vs. incongruent) predefined manual actions usually performed by joysticks or button presses (e.g., positive - right; negative - left, or vice versa). However, to date, it is unclear how the processing of affective concepts resonate with directional actions of the whole body that are performed freely within a context enabling lateral and sagittal movements simultaneously. Accordingly, 67 right-handed participants were to freely step on an 8-response pad (front, back, right, left, front-right, front-left, back-right, or back-left) after being presented in front of them valence-laden personal life-events submitted before the task (e.g., words or sentences such as “graduation” or “birth of a child”). The most revealing finding of this study indicates that approach-avoidance behaviors and space-valence associations across laterality are interwoven during whole body step actions: Positive events induced steps highly biased to front-right whereas negative events induced steps highly biased to back-left. This article argues that John Gardner’s theory of corrective justice in _From Personal Life to Private Law_ relies on an overly narrow account of wrongdoing, one that it too heavily influenced by law to capture the broader conception of corrective justice that is his topic. I will suggest that these problems are avoided by a reconciliation theory of corrective justice.

The longitudinal, qualitative study aimed to explore the lived experiences of Chinese university emerging adults by analyzing their personal life stories, reflective journals, and semi-structured interview data collected over a 2-year period. A qualitative content analysis was used to identify five themes: maturity, academic performance, interpersonal communication skills, social support network, and sense of loss. The study found that the growth in emerging adulthood was dynamic, positive, and multifaceted. The study demonstrated that writing personal life stories, as a (...) practice of meaningful literacy instruction in EFL contexts, helped students to record a memorable past, reconcile with the past, and strive for personal growth. These findings suggest that emerging adults’ personal growth be stressed in foreign language teaching to promote Chinese university emerging adults’ growth and development. It is also suggested that personal life stories be used in foreign language teaching under the guidance of meaningful literacy instruction. (shrink)

This essay reviews John Gardner’s recent books, From Personal Life to Private Law, and Torts and Other Wrongs. Both books offer profound insights into private law’s concerns with justice and our reasons for action. The essay focuses on Gardner’s continuity thesis, and in particular on his idea that a third party may act on behalf of a wrongdoer as her delegee. Three settings are considered. First, I will discuss settings in which the state or another third party acts to (...) remedy a wrong without the wrongdoer’s consent. Second, I will review settings in which the legal remedies at issue – e.g., general damages or punitive damages – may not fit well with the idea that the state is acting on behalf of a wrongdoer. Third, I will analyze settings in which the state may be acting on behalf of right holders, yet still be concerned with the continuity thesis. Assessing each of these contexts offers further insights into the purpose of private law remedies. (shrink)

An authorized biography refers to a book written with the permission, cooperation, and at times, participation of the subject or the subject's heirs. As science focuses exclusively on the physical, it seems to assume that the brain has a key role in the origin if not also the constitution of our consciousness; and thus the destruction of the brain, the nervous system, and the body makes it pointless or even absurd to think of any personal consciousness after death. But one need not be convinced by this. However, any effort to investigate a possible post-mortem life depends on forming a coherent conception of (...) what such a life could be. Can we speak, without incoherence or contradiction, of a person continuing to exist after death in a disembodied state? Our concern in this study lies here. Based on Lund’s view, we will present and defend an argument that one can conceive of a self who is fully embedded in the natural world and deeply embodied in a physical organism, and yet could have a rich variety of experiences in an afterworld encountered after death. In this theory, the close association of the mental and the physical is due to a causal connection - a connection that fails to establish that the physical brings the mental into existence and is compatible with theories that the source of consciousness is not in the brain. Marya Schechtman has raised a series of worries for the Psychological Continuity Theory of personal identity (PCT) stemming out of what Derek Parfit called the ‘Extreme Claim’. This is roughly the claim that theories like it are unable to explain the importance we attach to personal identity. In her recent Staying Alive (2014), she presents further arguments related to this and sets out a new narrative theory, the Person Life View (PLV), which she sees as solving the problems (...) as well as bringing other advantages over the PCT. I look over some of her earlier arguments and responses to them as a way in to the new issues and theory. I argue that the problems for the PCT and advantages that the PLV brings are all merely apparent, and present no reason for giving up the former for the latter. (shrink)

In this article I discuss the philosophy of John MacMurray, and in particular, his little-examined writings on discipline and emotion education. It is argued that discipline is a vital element in the emotion education MacMurray thought central to learning to be human, because for him it takes concerted effort to overcome the human tendency toward egocentricity. It is maintained that MacMurray's philosophy of education is of contemporary significance for at least two reasons. On the one hand it suggests an alternative (...) vision for humanistic education. While liberal educationists such as Oakeshott and Peters stressed that the pursuit of knowledge and understanding was the main way in which persons could develop their humanity MacMurray instead emphasised that persons can only learn to become human by pursuing other-centred relationships. On the other hand his philosophy can also reveal the limitations in much contemporary debate in emotion education which critics (such as Ecclestone and Clack) suggest increasingly aims at little more than helping pupils feel better about themselves. According to MacMurray a genuine emotion education can enlarge humanity by supporting persons to feel and act for the sake of others rather than think about themselves. Despite sympathy for MacMurray's account of the purposes of education it is nonetheless concluded that the pursuit of knowledge as an end in itself does not necessarily constitute a negative expression of human agency (as MacMurray asserts)—but rather that the disciplined pursuit of knowledge may also form part of any education concerned to enrich human life. The article provides an insight into the interrelation between the worldview and personal meaningful orientations in the context of the modern digital era. The purpose of the article is to investigate the process of generating personal ontology with due regard to personal meaning-making, which involves considering three groups of issues. Firstly, attention is focused on understanding the complexity of the modern epoch against the background of the technological revolution and the effects of virtual imitation of reality, which may determine the (...) worldview. Secondly, an effective insight into life-meaning orientations involves reviewing methodological approaches. Thirdly, the article considers the basic paradigms of life choices including the pragmatic option for self-determination, retrospective reflection based on historical-philosophical inquiry, the paradigm of genetic determination of human behavior and decision-making, and an opposing existential paradigm, which identifies proper life orientations. The study refers to enactivism as a methodological tool, according to which, changes in external circumstances generated by the subject may effect the structure of semantic regulations. The authors come up with an innovative approach to investigating the ways in which the meanings of personal ontology are shaped in the context of complexity and virtualization of the modern world. The idea of the ambivalence of life-purpose relfection is justified. The authors come to a conclusion that structuring personal ontology depends on processing the main tendencies of the epoch in the domain of personal reflection, which is based on one’s inner world and connected with goal-setting and shaping one’s life-project. Counterproductive work behavior is one of the most common behavioral decisions of employees in the workplace that negatively impacts the sustainable development of enterprises. Previous studies have shown that individuals make CWB decisions for different reasons. Some individuals engage in CWB due to cognitive factors, whereas others engage in CWB in response to leadership behaviors. The conservation of resources theory holds that individuals have the tendency to preserve, protect and acquire resources. When experiencing the loss of resources, individuals will show (...) irrational and aggressive behaviors in order to regain resources. When obtaining resources, individuals’ tension and pressure will be relieved. To maintain or continue obtaining resources, individuals will show more positive work attitudes and behaviors. Therefore, using the COR theory as the main theoretical framework, this study explores a serial mediation model between family supportive leadership and CWB through work-family conflict and moral disengagement, moderated by personal life attribution. A three-wave survey of 251 medical workers from three hospitals found that family supportive leadership can reduce employees’ perceived work-family conflict, which leads to less moral disengagement, resulting in lower CWB. Personal life attribution strengthens the negative indirect effect of family supportive leadership on CWB by reinforcing the negative association between family supportive leadership and work-family conflict. This study uses the COR theory to explore the mechanism and boundary conditions of family supportive leadership and CWB from the perspective of negative work-family relationship, which enrichis the research content of existing theories. Moreover, this study has important guiding significance for managers to take effective measures to reduce CWB. (shrink)

Personal utilitarianism applies act-utilitarianism to the problem of individual choice. It is based on the view that the good life is achieved through maximizing the sum of individual measures of utility over a population. the population being the sequence of semi-autonomous selves from which the individual is composed. I begin by showing how our lives can usefully be partitioned into selves because the weights put on our various choice motives are constantly changing and, consequently, our preferences themselves concerning what (...) we should choose at any given time can also change from moment-to-moment. In particular, because we put disproportionate weight on our present needs relative to our future ones, we often become impatient and choose options that offer immediate gratification. I use concepts from game theory to describe multiple selves, and to discuss how strategic interactions between selves are possible, and then conclude by considering the practical problem of how to achieve the good life, or how can we get our selves to choose what is best for us in the long run. Engagement with the historical and theoretical underpinnings of measuring quality of life (QoL) and patient‐reported outcomes (PROs) in healthcare is important. Ideas and values that shape such practices—and in the endgame, people's lives—might otherwise remain unexamined, be taken for granted or even essentialized. Our aim is to explicate and theoretically discuss the philosophical tenets underlying the practices of QoL assessment and PRO measurement in relation to the notion of person‐centredness. First, we engage with the late‐modern history of the (...) concept of QoL and the act of assessing and measuring it. Working with the historical method of genealogy, we describe the development of both QoL assessments and PRO measures (PROMs) within healthcare by accounting for the contextual conditions for their possibility. In this way, the historical and philosophical underpinnings of these measurement practices are highlighted. We move on to analyse theoretical and philosophical underpinnings regarding the use of PROMs and QoL assessments in clinical practice, as demonstrated in review studies thereof. Finally, we offer a critical analysis regarding the state of theory in the literature and conclude that, although improved person‐centredness is an implied driver of QoL assessments and PROMs in clinical practice, enhanced theoretical underpinning of the development of QoL assessments is called for. This essay examines Maduabuchi Dukor’s perspective on the African conception of man, personal identity and“life-here-after”. This is with a view to showing that although, Dukor’s views represent what obtain among some ethnic nationalities in Africa, this nevertheless does not provide a basis for generalising across the whole of Africa, as there are countless number of ethnic groups in Africa to which Dukor’s general claims may not be applicable. Given the varieties of metaphysical conceptions of man and destiny in Africa (...) which we are yet to fully explore, and given also the inherent contradictions in some of these conceptions, which calls into questioning, the veracity of claims made therein, it will amount to a major logical error to make sweeping generalisations that would be representative of the whole of Africa. Such generalisations would remain a non-holistic, but partial representation of the African conception of man and human destiny. (shrink)

Objective: To determine the usefulness of Q methodology to locate and describe shared subjective influences on clinical decision making among participant physicians using hypothetical cases containing common ethical issues. Design: Qualitative study using by-person factor analysis of subjective Q sort data matrix. Setting: University medical center. Participants: Convenience sample of internal medicine attending physicians and house staff (n = 35) at one midwestern academic health sciences center. Interventions: Presented with four hypothetical cases involving urgent decision making near the end (...) of life, participants selected one of three specific clinical actions offered for each case. Immediately afterward and while considering their decision, each respondent sorted twenty-five subjective self-referent items in terms of the influence of each statement on their decision-making process. By-person factor analysis, where participants are defined as variates, yielded information about the attitudinal background the physicians brought to their consideration of each hypothetical case. We performed a second-order factor analysis on all of the subjective viewpoints to determine if a smaller core of shared attitudes existed across some or all of the four case vignettes. Factor scores for each item and post-sort comments from interviews conducted individually with each respondent guided the interpretation of ethical perspective used by these respondents in making clinical decisions about the cases. Measurements and Main Results: Second-order factor analysis on seventeen viewpoints used by physicians in the four hypothetical urgent decision cases revealed three moderately correlated (r 2 < 40%) subjective core attitudinal guides used broadly among all the cases and among sixteen of the seventeen original factors. Across all the cases, our participants were guided in general by: (1) patient-focused beneficence, (2) a patient- and surrogate-focused perspective that includes risk avoidance, and (3) best interest of the patient guided by ethical values. Economic impact on the physician, expediency in resolution of the situation, and the expense of medical treatment were not found to be influential determinants in this study. Conclusions: Q sorting and by-person factor analysis are useful qualitative methodological tools to study the complex structure of subjective attitudes that influence physicians in making medical decisions. This study revealed the subjective viewpoints used by our physician participants as they made ethically challenging treatment decisions. The three second-order factors identified here are grounded in current bioethical values as well as the personal traits of physicians. The participants' decision methods appear to resemble casuistry more than principle-based decision making. Generalizability of results will require further studies. (shrink)

In this paper, relying on both phenomenology and psychoanalysis, I introduce the concept of transbodily intentionality with the aim of exploring the significance of bodily expression for subjective constitution. The role of the body for the constitution of subjective experience becomes increasingly important in phenomenological analysis. This faces us with the challenge of understanding the intersubjective relevance of bodily processes together with the genetic turn of phenomenology. On this background, the revaluation of the concept of gesture comes into light. This study aims to elaborate on how work-life balance practices influence organizational cynicism through the mediation effects of person-job fit. We collected data from 331 nurses through a self-administered survey, and we tested our hypothesized model through partial least square structural equation modeling techniques using SmartPLS software. The findings revealed that WLB practices influenced OC negatively and PJF positively. We further found that PJF negatively influenced OC and mediated WLB practices’ effect on OC. These findings imply that nurses (...) should be provided WLB practices to meet their job and home responsibilities and thus have a less cynical attitude toward the organization. (shrink)

A life of the mind can be lived only by creatures who know that they have minds. We call these creatures “persons,” and currently, all such persons THAT we know OF are “alive” in the biological sense. But are there, or could there be, either in the future or elsewhere in the universe, creatures with “a life of the mind” that are not “alive” in the sense that we humans usually understand this term today?

Various debates on the desirability and rationality of life-extending enhancements have been pursued under the presupposition that a generic psychological theory of personal identity is correct. I here discuss how the narrative approach to personal identity can contribute to these debates. In particular, I argue that two versions of the narrative approach offer good reasons to reject an argument against the rationality of life-extending enhancements.

This article uses an autobiography as an object of research, to both illustrate some principles of chaos theory in analytic practice, and give those ideas a personal and social context, thereby producing a unique but explanation-rich history of chaos theory and recent intellectual history of transdisciplinarity and social research in the West. The ideas from Chaos Theory it uses and illustrates include: three-body analysis (Poincaré); fractals (Mandelbrot); fuzzy logic (Zadeh); and the butterfly effect (Lorenz).
