To many, it seems like the debate of "when life begins" is irresolvable. This is unfortunate since this failure to make progress is largely a result of people not asking what the question means, or clarifying what is being asked, and listening carefully to try to understand the range of answers. -/- As a philosophy professor who teaches logic and critical thinking, I suggest that asking the simple, but powerful, question, "What do you mean?" and seeking to understand different (...) answers could help us move past this debate to more important, and challenging, ethical and legal questions about abortion. The question of when human life begins is critical in debates related to life issues. While there are a variety of proposals as to how an organism should be defined, many biologists and ethicists, particularly Catholics, have approached this issue by arguing that fertilization defines the beginning of a new organism. Examining the processes of fission and fusion, which take place before gastrulation, provides strong evidence for when human life beings and therefore how it should be defined. (...) Among the four dominant theories, regulative fission and fusion are the best explanations in terms of being the most consistent with the biological data. This explanation of twinning provides compelling evidence that fertilization is not a necessary condition for human generation, although it may be a sufficient condition. A friend once told me I was wasting my time writing about cross-cultural perspectives on the beginnings of life. “Your work is interesting for its curiosity value,” he said, “but fundamentally worthless. What happens in other cultures is totally irrelevant to what is happening here.” Those were discouraging words, but as I followed the American debates about the beginnings and ends of life, it seemed he was right. Anthropologists have written a great deal about birth and death rites (...) in other societies and about non-western notions of personhood, but to date our findings have had little impact on American policy, ethics, or law. The recognized experts on contentious topics such as abortion and euthanasia tend to come from the fields of philosophy, bioethics, theology, law, and biology, but rarely from the social sciences. In theory, at least, we might achieve a certain sort of invulnerability right at the end of life. Suppose that under favorable circumstances we can live a certain number of years, say 125, but no longer, and also that we can make life as a whole better and better over time. Under these assumptions we might hope to disarm death by spending 125 years making life as good as it can be. If we were lucky enough to (...) accomplish that, afterwards we would be immune to mortal harm. Especially for those who are closer to the beginning of life than to the end, however, this strategy leaves much to be desired. It is like devouring an entire banquet so as to eliminate the danger of someone stealing it from us. Like a feast, a good life is safely ours after it is over, but then safety comes too late to be of any use to us. To be of practical value, we need protection from mortal harm much earlier in life. The process of condensation of an amorphous solid into a rigid matrix can often trap molecules in reversible binding sites. Exchange of the same molecular species with such sites is known to be sensitive to small chemical differences and to distinguish between enantiomers. In addition to their usefulness in chromatographic processes, such materials can separate, by solid phase extraction, specific compounds from complex mixtures. Furthermore, the trapped molecules can have their reactions guided and catalytically changed. Abstract. In January 1985, about 80 Muslim religious scholars and biomedical scientists gathered in a symposium held in Kuwait to discuss the broad question “When does human life begin?” This article argues that this symposium is one of the milestones in the field of contemporary Islamic bioethics and independent legal reasoning (Ijtihād). The paper aims to find that Islam confers moral respect to human embryo, but it also clarifies the absence of full human rights to a developing foetus. In contemporary discussions of abortion, both sides argue well-worn positions, particularly concerning the question, When does human life begin? Though often invoked by the Catholic Church for support, Thomas Aquinas in fact held that human life begins after conception, not at the moment of union. But his overall thinking on questions of how humans come into being, and cease to be, is more subtle than either side in this polarized debate imagines. Fabrizio Amerini--an internationally renowned scholar of (...) medieval philosophy--does justice to Aquinas's views on these controversial issues. Some pro-life proponents hold that Aquinas's position is simply due to faulty biological knowledge, and if he knew what we know today about embryology, he would agree that human life begins at conception. Both in criminal law science and in the judicial practice there are a lot of discussions as to what should be considered as the beginning and end of human life. Birth and death are not instantaneous acts, but rather processes made up of time-spans that can be construed as evidence of the beginning or end of a human life. From a biological point of view the human life is a constant, continuous metabolic process after cessation of which (...) the human life also ceases. These circumstances very much aggravate the definition of criteria of the moments of beginning and end of human life. There are disagreements in the criminal law science with respect to from which moment the human life is to be protected by the criminal law. Herewith this presupposes also the other problematic question—what is to be considered a “living human” as a homicide subject (a victim). Complication of the said question is also determined by the fact that it is related not only to legal but also to medical, religious, and moral aspects. How can the abortion issue be resolved? Many believe that the issue can be resolved if, and only if, we can determine when human life begins. Those opposed to abortion choice typically say that human life begins at conception. Many who favor abortion choice say that we will never know when human life begins. The importance of the when-does-human-life-begin issue is not so much argued for as it is taken to be self-evident. Furthermore, belief that (...) this issue is fundamental is taken for granted – at least outside of philosophy – by many of the people who seem to disagree about almost everything else concerning abortion. It has been my experience that – with rare exceptions – even those who insist that the issue of abortion should focus on the interests of pregnant women believe that this focus is warranted because fetuses are either not yet fully alive or not yet fully human. Some disability rights advocates criticise prenatal testing and selective abortion on the grounds that these practices express negative attitudes towards existing persons with disabilities. Disability rights advocates also commonly criticise and oppose physician-assisted suicide (PAS) and euthanasia on the same grounds. Despite the structural and motivational similarity of these two kinds of arguments, there is no literature comparing and contrasting their relative merits and the merits of responses to them with respect to each of these specific medical practices. This paper (...) undertakes such a comparison. My thesis is that a number of potentially significant weaknesses of the expressivist argument against reproductive technologies are avoided when the argument is used against PAS. In particular, I try to show that three common criticisms of the expressivist argument applied to reproductive technologies, whatever merit they have, have even less merit when they are used to reply to the expressivist argument applied to PAS. This is important because the expressivist argument applied to the end of life scenario does not get as much attention as the argument applied to the beginning of life scenario, and yet it has a relatively stronger position. The chapter provides a response to Patrick Toner, “Critical Study of Fabrizio Amerini’s Aquinas on the Beginning and End of Human Life,” Oxford Studies in Medieval Philosophy 2, 211–28. The chapter corrects two misrepresentations in Toner’s review. First, it proves that, given Aquinas’ assumptions on substantial form and human soul, Aquinas could not give up his preference for delayed hominization of the embryo even if he were acquainted with contemporary embryology. Aquinas takes as the starting point of his embryology (...) Aristotle’s characterization of the human soul as the act of an organic physical body having life potentially, and this characterization leads him to the conviction that the human soul can enter into the human body only after the principal vital organs are formed. Second, the chapter corrects Toner’s unusual interpretation of the clause “organic” in the Aristotelian characterization of the human soul, by specifying the different senses of potentiality in Aquinas’ embryology. The chapter reaffirms the core idea that establishing when the hominization of the human embryo begins is not decisive for rejecting abortion. The chapter suggests relating the question of abortion to the identity or continuity of the human embryo rather than to the beginning of hominization. (shrink)

In my paper, I attempt a phenomenological analysis of the lived experience of intersexuality, which I view from the perspective of the problem of indeterminacy concerning the horizon of the givenness of homeworld founded on the broader basis of the pre-givenness of lifeworld. These horizons define the structure of the sedimentation of subjective experience, as well as the layers of cultural meanings sedimented in the lifeworld. The sedimented layers of self-experience and of the shared lifeworld function as a sphere of (...) indeterminacy, that is the horizons of constituted phenomena. In this sense all intentional acts have the nature of horizontal indeterminacy, the layers of which are revealed in the genetic question (Rückfrage) directed toward them. Horizontal indeterminacy also accounts for the distinction between homeworld and alienworld, which appears as something unobvious and unexpected against the obviousness of the homeworld, at the same time thematizing the latter. One of the elements of the sedimented conceptual system, functioning as the horizon of indeterminacy of both self-experience and the pre-reflective life-world, is the notion of human corporeality as given in the binary sexuality/gender. A unique opportunity for phenomenological insight into the constitution of the phenomenon of sex/gender is provided by Hida Viloria's lived experience of intersexuality. Her lived body, originally experienced pre-reflectively as a transparent medium and a perfectly handy tool of undisturbed intentionality, unproblematized also in the sexual activities, gradually undergoes alienation under the objectifying gaze determined by the binary pattern of sexuality. Becoming an alienated object, her body loses its transparency. Viloria begins to experience her corporeality and identity in a way determined by the sedimented "ideology" of sex and gender, trying on the "constructs" of masculine and feminine identities, eventually overcoming alienation and, in a process of secondary self-identification, reclaiming her lived body in its intersexuality and her identity in its non-binary gender fluidity. Philip Reed’s interesting and welcome comparison of the expressivist case against, on the one hand, prenatal testing and abortion and, on the other, physician-assisted suicide (PAS) and voluntary active euthanasia (VAE), indicates the relevance of the expressivist case against the latter and its resilience to criticisms of the expressivist case against the former. Advocates of PAS/VAE commonly argue that they should be lawful out of respect for autonomy: everyone has the right to choose a physician-hastened death if they meet specified (...) conditions such as ‘terminal illness’ or ‘unbearable suffering’. The focus on autonomy is distracting, for the real work of justifying PAS/VAE is done by the argument that life with the conditions specified is not ‘worth living’. Legalisation endorses, and expresses, the judgement that it is reasonable for people with those conditions to think their lives no longer worth living and obtain medical help to end them. Were the justification to respect autonomy, why limit the choice? It is small wonder, in light of the discriminatory nature of such a judgement, that disability groups have been outspoken opponents of legalisation. As life extended into eukaryota, a great host of strategies emerged in the pursuit of cellular life. Some cells have been successful in solitude, some moved into cooperatives (i.e., multicellular organisms), but one additional strategy emerged. Throughout eukaryotes, many of the diverse multicellular cooperatives took life in partnership one step further. These cells came together and lost their singularity in the expanse of syncytial life. Recently in our search for this elusive “how”, we discovered the intriguing (...) peculiarity of a nuclear, RNA‐binding protein living a second life as a fusion manager at the surface of developing osteoclasts, ushering them into syncytia 1. It is from here that we will develop several thoughts about the advantages of multinucleated cells and discuss how these fusing cells pass through several hallmarks of cell death. We will propose that cell fusion shares much with cell death because cell fusion is a death of sorts for the cells that undergo it – a death of the life that was and the beginning of new life in a community without borders. The somatic integration definition of life is familiar from the debate on the determination of death, with some bioethicists arguing that it supports brain death while others argue that some brain‐dead bodies exhibit sufficient somatic integration for biological life. I argue that on either interpretation, the somatic integration definition of life implies that neither the preimplantation embryo nor the postimplantation embryo meet the somatic integration threshold condition for organismal human life. The earliest point at which a (...) somatic integration determination of life could be made would be the beginning of the fetal stage, 9 weeks postfertilization. Despite (what I (...) regard as) some mistakes on the application of that teaching to contemporary embryological data, it is an invaluable sourcebook for Aquinas on this issue. At times, Amerini’s “aporetic” style makes for convoluted arguments, but it raises challenging questions and thus will assist anyone working through these issues. (As the title indicates, it also treats the end of life—but only very briefly, in a couple of pages near the end of the book.)The first two chapters examine Aquinas’s general principles regarding matter, form, and substantial generation (the coming to be of a substance), and his positon on the human soul as both subsistent and the substantial form of the human body. Amerini’s treatment is thorough and provides an extensive bibliographical guide to this issue. However, it seems to me that Amerini is less than clear on the distinctiveness of substantial change. Since there are (according to Aquinas and Aristotle) no degrees in the category of substance, generation is not a process but an instantaneous change. Amerini’s frequent use of the term “process of generation,” as well as the position he later proposes on the identity of the embryo, seems to conflict with that point. [End Page 489]Chapters 3 and 4 contain detailed exposition of Aquinas’s basic embryological position, and chapter 4 raises various questions about this position (including doubts that Amerini evidently has about the unicity of the human being’s substantial form). Applying his basic metaphysical principles to what he at the time believed were the embryological facts, Aquinas concluded that the human being with a rational soul is not present until forty days after fertilization for males or ninety days for females. The father and the mother generate the offspring, but the mother provides only the material cause in the form of menstrual blood; the father is the efficient and formal cause, acting through the semen as an instrumental cause. With the power (virtus) of the principal cause in it, the semen gradually organizes the menstrual blood provided by the mother to form, first, a being with a vegetative soul, then an animal, and finally an animal with a body suited to be formed by a rational soul, which God then infuses into it. Aquinas holds that, unlike a sensitive or vegetative soul, a rational soul must be directly created by God, since the rational soul is the source of operations that are independent of matter, that is, performed by the human being but without a bodily organ. Only matter that is suited to a form can receive it. Therefore the matter must be suitably disposed. Just as one can make a knife only with matter capable of supporting its function—and so the matter must be hard and capable of being sharp—so only a body with sense organs, and thus capable of supporting those actions prerequisite to rational operations, can receive a rational soul.Chapter 5 sets out in detail Amerini’s exposition and interpretation of Aquinas on the identity of the embryo. Amerini recognizes, of course, Aquinas’s mistakes and ignorance regarding basic embryological facts—inevitable given the time in which he wrote. Still, Amerini holds that Aquinas’s main conclusion regarding delayed hominization is still valid. He agrees with Aquinas that the general proportionality requirement implies that the embryo/fetus must first possess sensory organs to have a body apt for the reception of a rational soul.On the other hand, Amerini also advances what he believes is a via media between proponents of delayed hominization and proponents of immediate hominization. The problem of how a mixture of chemicals can spontaneously transform themselves into even a simple living organism remains one of the great outstanding challenges to science. Various primordial soup theories have been proposed in which chemical self- organization brings about the required level of complexity. Major conceptual obstacles remain, however, such as the emergence of the genetic code, and the “chicken-and-egg” problem concerning which came first: nucleic acids or proteins. Currently fashionable is the so-called RNA world theory, which casts (...) RNA in the role of both chicken and egg. Other theories assume that protein chemistry and even clay crystal life came before nucleic acids. To be fully successful, a theory of biogenesis has to explain not merely the emergence of molecular replication and chemical complexity, but the crucial information content and information processing capabilities of the living cell. For Aristotle, animals, by contrast to plants, possess a perceptual soul. However, there is disagreement concerning the point at which the perceptual soul is acquired, for him. On one influential interpretation, Aristotle thinks that the perceptual soul is acquired not during the initial formation of the embryo, but at some later stage of its development. On such interpretations of Aristotle’s view, the newly formed embryo is not yet an actual animal, but a plant-like living being or even inanimate matter. We (...) argue, by contrast, that Aristotle views the embryo, from the very beginning, as an actual animal exercising basic nutritive and perceptual functions. Introduction The act of caring in nursing requires previous deliberation and decision, however this perception only arises when an ethical problem emerges. Objective: Identify ethical problems of nurses action in the area of beginning of human life Method: Exploratory and descriptive method, with a qualitative approach. Semi-structured interviews were used to collect data, who were submitted to content analysis. The sample was constituted by 26 nurses. Results 18 categories of problem areas and 56 ethical problems in early human (...) class='Hi'>life were identified. The results obtained are very diverse, including areas such as termination of pregnancy, informed consent or maintaining privacy. However, other problem areas also emerge and numerous new subcategories/ethical problems, including: dealing with miscarriage, extreme situations, minors’ pregnancy, serious malformations detected at birth, consent regarding care during childbirth, Non- identification of a ethical problem, nurse social recognition and non-involvement of the person in labour. Conclusion Nurses face different ethical problems that impact their lives. We intend to contribute in helping to make decisions in this field, which the outset is of hope and joy, but which hides, behind this evidence, countless situations of suffering for everyone involved. The identification of ethical problems in this field, it is the first step to reflect about theme and helping decision-making for nurses that are taking care in this area of beginning of human life, when confronted whit the same type of ethical problems. For decades most scientists assumed that life emerged billions of years ago in a “primordial soup” somewhere on the Earth’s surface. Evidence is mounting, however, that life may have begun deep beneath the surface, perhaps near a volcanic ocean vent or even inside the hot crust itself. Since there are hints that life’s history on Earth extends back through the phase of massive cosmic bombardment, it may be that life started on Mars and came here later, (...) perhaps inside rocks ejected from the Red Planet by large impacts. The traffic of intact rocks between Mars and Earth is now an established fact, and experiments confirm that microbes could survive the rigours of the journey through space if cocooned within such material.
