In our society, some aspects of life are off-limits to commerce. We prohibit the selling of children and the buying of wives, juries, and kidneys. Tainted blood is an inevitable consequence of paying blood donors; even sophisticated laboratory tests cannot supplant the gift-giving relationship as a safeguard of the purity of blood. Like blood, health care is too precious, intimate, and corruptible to entrust to the market.The hospice movement in the United States is approximately 40 years old. During these past (...) four decades, the concept of holistic, multidisciplinary care for patients who are suffering from a terminal illness has evolved from a modest, grassroots constellation of primarily volunteer-run and community-governed endeavors to a multimillion dollar industry where the surviving nonprofits compete with for-profit providers, often publicly traded, managed by M.B.A.-trained executives, and governed by corporate boards. The relatively recent emergence of for-profit hospice reflects an increasing commercialization of health care in the United States, the potentially adverse impact of which has been well documented. Courts in common law systems decide cases as they decided like cases in the past—even if they believe they decided those past cases wrongly. What, if anything, justifies this practice? I defend two main claims. The first is that fairness favors treating like cases alike if that means treating them correctly. The second is that, in general, a court is as likely to decide an instant case correctly as it was to decide a previous and like case correctly. Together, these (...) claims tell us that departing from and following precedent are equally likely to yield a correct decision, whereas following precedent may also yield a fair decision. Adhering to precedent is the dominant alternative, as a result. Fairness therefore justifies the practice of precedent. While this conclusion is not original, my argument for it is. (shrink)

The 1998 Good Friday Agreement (GFA) brought an end to conflict in Northern Ireland (NI). Nonetheless, the peace process has not brought the reconciliation for which many had hoped. This purpose of this article is to consider the relationship between Remembrance, Commemoration and Reconciliation. The particular focus is on how the Centenary of 1916 (The Easter Rising and the Battle of the Somme) should be commemorated. My research also contains the views of politicians in Northern Ireland, in general, to the (...) issue of ‘Commemoration, Remembrance and Reconciliation’. The research is positioned in the tradition of previous research literature and contemporary concerns relating to Commemoration, Remembrance and Reconciliation in Northern Ireland and internationally. It also engages with ‘Interventionist Research’. My research adds to the emerging knowledge in the area and offers insight and perspective on the attitudes of politicians in Northern Ireland to ‘Commemoration, Remembrance and Reconciliation’. Leadership is the art of discovering and expressing one's inborn nature. It is a natural response, a way of being and doing within reality that creates a powerful influence on one's community toward greater degrees of peace and harmony on the individual and communal levels. In this paper, I use Chuang Tzu's philosophy (in its 1968 translation by Burton Watson) about the nature of reality and how one finds inner peace and harmony within themselves in order to demonstrate why it (...) is the self-realized individual who is the best candidate to non-coercively influence one's community into sounding more like a symphony, rather than a cacophony. The terms ordinary and extraordinary, when employed in the medical setting, quite often appear vacuous to the point of justifying their elimination. This appraisal appears to be based upon the belief that certain procedures are ordinary and others are extraordinary independent of the particular factors of the clinical setting. This belief may be shown mistaken once it is realized that the conditions sufficient for determining whether a medical procedure is ordinary or extraordinary are themselves specifiable only within the clinical context. (...) Unfortunately, even if the terms may be meaningfully employed, the two classes are not comprehensive. Thus, it is suggested that some medical procedures will prove recalcitrant to the ordinary-extraordinary classification; and the values inherent in the classification will prove inappropriate. The Eighth Amendment to the United States Constitution provides that “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishment inflicted.” Although treasured as a statement of fundamental rights, the Amendment’s terms and relations are not uniformly read. This is amply illustrated by the various positions on the Amendment’s correct meaning expressed in the various majority, plurality, and dissenting opinions issued by the United States Supreme Court. This is not to suggest that a more or (...) less uniform interpretation fails to obtain with all of the phrases of the Amendment. The clauses covering excessive bail and excessive fines do enjoy some level of agreed meaning among the Court’s members. This, however, does not pertain to the Cruel and Unusual Clause. An apparent majority of the Court holds that the extent of application of an otherwise acceptable punitive sanction may nevertheless constitute cruel and unusual punishment. A minority of the Court denies this. This essay will critically examine the two major positions concerning the questioned Clause. Additionally, it will offer an argument which especially favors one of the noted positions. (shrink)

The aim of this article is to provide a way of resolving the apparent dilemma between our requirement as agents that actions should be free and our demand as spectators that all events should be predictable and explicable on the basis of antecedent conditions. I hope to show that what has often been incorrectly regarded as a logical incompatibility between freedom and determinism is, in fact, a disparity but not an over-all contradiction between the viewpoint of an agent and that (...) of a spectator. While it is logically impossible for a person to deliberate about his conduct in a given matter from the standpoint of an agent and also predict it as a spectator, this is the only logical incompatibility between these positions, and it does not preclude the two points of view from being equally legitimate ways of viewing action. Perhaps it has sometimes been a vague recognition of the fact that one logically cannot both deliberate upon and predict one’s own conduct in a certain matter that has led some philosophers to conclude erroneously that choice on the part of an agent is inconsistent with prediction or explanation of his decision on the part of any spectator. This unwarranted conclusion is equivalent to denying that conduct can be regarded both from the standpoint of the agent and that of the spectator. (shrink)

Philosophers are uniquely qualified to negotiate a balance between the reflective potential of globalization and the great routine powers of nations, states, tribes, and families. Here's how we can do it: we can teach the difference between playing a game and choosing a game. From time immemorial people of all tribes and cultures have marked a sharp distinction between those individuals deemed qualified by age, expertise, or status to choose or write the rules, and those other, lesser individuals who are (...) obliged merely to obey those rules. This is the traditional difference between a person, on the one hand, and a utensil, on the other: persona est sui iuris; servus non est persona ("A person chooses its own laws; a slave is not a person"). Persons, but not utensils such as shoes, have, and deserve, good will. To a person, a culture is a means of creating a sustainable humane environment. To a culture, a person is a means for the culture to replicate itself. Placing culture first is a tradition we can no longer afford to maintain, because it makes enduring peace impossible. The purposes utensils can be made to serve have become too terrible (and, with the advent of global communication, too obvious) for the human race to endure, and the capacity of the voiceless to express themselves violently is increasing without limit. Hence we must create new traditions in which we teach all our children reflective thought, with which rules are pragmatically justified rather than unquestionable. To that end I propose to distinguish random, routine, and reflective thought and action. Each of these three levels of thought and action has its costs and its benefits; together they contain the entire range of human possibility. Three familiar philosophical concepts support my claim that reflective thought and action can and must be taught to and learned by all. (shrink)

This paper looks at the ambiguities which PAS (physician assisted suicide) and voluntary active euthanasia (VAE ) present to the patient, his or her loved ones and the health-care team. The author pleads for a greater emphasis on humanizing the experience of the dying so that a team can meet their physical, emotional and spiritual needs.

Defenders of Aboriginal rights such as James Tully have argued that members of majority populations should allow Aboriginal peoples to argue within their own preferred intellectual frameworks in seeking common moral ground. But how should non-Aboriginal academics react to claims that seem insufficiently critical or even incoherent? This essay argues that there are two reasons to be especially wary of attacking such errors given the historical injustices perpetrated by settler states against Aboriginal peoples. First, attempts to root out error will (...) often be misplaced, because they will fail to consider the full range of possible reasons for particular kinds of social practices. Second, such attempts will often have counterproductive social effects in disrupting conversations and prolonging Aboriginal alienation. This essay thus argues that non-Aboriginal academics should be willing to exercise considerable self-restraint toward apparent intellectual errors, because such a strategy will be most conducive to realizing justice over the long term. Demonstratives seem to have posed a severe difficulty for Frege’s philosophy of language, to which his doctrine of incommunicable senses was a reaction. In “The Thought,” Frege briefly discusses sentences containing such demonstratives as “today,” “here,” and “yesterday,” and then turns to certain questions that he says are raised by the occurrence of “I” in sentences (T, 24-26). He is led to say that, when one thinks about oneself, one grasps thoughts that others cannot grasp, that cannot be communicated. However, (...) nothing could be more out of the spirit of Frege’s account of sense and thought than an incommunicable, private thought. In the first part of the paper, I explain the problem demonstratives pose for Frege, and explore three ways he might have dealt with it. I argue that none of these ways provides Frege with a solution to his problem consistent with his philosophy of language. The first two are plausible as solutions, but contradict his identification of the sense expressed by a sentence with a thought. The third preserves the identification, but is implausible. In the second part, I suggest that Frege was led to his doctrine of incommunicable senses as a result of some appreciation of the difficulties his account of demonstratives faces, for these come quickly to the surface when we think about “I.” I argue that incommunicable senses won’t help. I end by trying to identify the central problem with Frege’s approach, and sketching an alternative. (shrink)

Perry Zurn explores the political philosophy of curiosity—the heartbeat of political resistance and a critical factor in social justice. Drawing on philosophy and political theory as well as feminist theory, race theory, disability studies, and trans studies, he tracks curiosity in the structures of political marginalization and resistance.

Perry argues that certain sorts of indexicals are 'essential', in the sense that they cannot be eliminated in favor of descriptions. This paper also introduces the influential idea that certain sorts of indexicals play a special role in thought, and have a special connection to action.

Scholarly attempts to analyze the history of science sometime suffer from an imprecise use of terms. In order to understand accurately how science has developed and from where it draws its roots, researchers should be careful to recognize that epistemic regimes change over time and acceptable forms of knowledge production are contingent upon the hegemonic discourse informing the epistemic regime of any given period. In order to understand the importance of this point, I apply the techniques of historical epistemology to (...) an analysis of the place of the study of astrology in the medieval and early modern periods alongside a discussion of the “language games” of these period as well as the role of the “archeology of knowledge” in uncovering meaning in our study of the past. In sum, I argue that the term “science” should never be used when studying approaches to knowledge formation prior to the seventeenth century. (shrink)

Alexander of Aphrodisias was born somewhere around 150, in Aphrodisia on the Aegean Sea. He began his career in Alexandria during the reign of Septimius Severus, was appointed to the peripatetic chair at the Lyceum in Athens in 198, a post established by Marcus Aurelius, wrote a commentary on the De anima of Aristotle, and died in 211. According to Porphyry, Alexander was an authority read in the seminars of Plotinus in Rome. He is the earliest philosopher who saw the (...) active intellect implied in Book III of the De anima of Aristotle as transcendent in relation to the material intellect. He connected the active intellect with the incorporeal and eternal cause of the universe described by Aristotle in Book XII of the Metaphysics. Plotinus would make a similar connection, between the One as First Cause and the Intellectual in which it participates. (shrink)

Unconscious Thought in Philosophy and Psychoanalysis explores concepts throughout the history of philosophy that suggest the possibility of unconscious thought and lay the foundation for ideas of unconscious thought in modern philosophy and psychoanalysis. The focus is on the workings of unconscious thought, and the role that unconscious thought plays in thinking, language, perception, and human identity. The focus is on the metaphysical and philosophical concepts of unconscious thought, as opposed to the empirical or scientific phenomenon of 'the unconscious.' The (...) book argues that the metaphysical concepts still played an important role in the psychoanalysis of Sigmund Freud and Jacques Lacan. The book looks at the relation between unconscious thought and conscious thought, different kinds of thinking, and the relation between thinking and perceiving. Chapters focus on the philosophies of Plotinus, the Peripatetics and Scholastics, Immanuel Kant, Schelling and Hegel, and Freud and Lacan, among others. (shrink)

The geometrical elements in the architecture of Lincoln Cathedral, in the vaulting and elevations, can be compared to the geometries described by Robert Grosseteste in his cosmologies. The architecture can be read as a catechism of the cosmologies. The geometries appear in the cathedral for the first time in the history of architecture to explain the generation, emanation, reflection, refraction and rarefaction of light as it forms the material world. The proposition is that the geometries of the architecture of Lincoln (...) Cathedral can be understood in relation to the geometries which are the basis of the cosmologies of Robert Grosseteste, Bishop of Lincoln 1235–53, in particular De lineis, angulis et figuris, and De luce. Many of the architectural forms at Lincoln Cathedral are unprecedented in their appearance or use, and they form the basic vocabulary for the entire development of English Gothic architecture. Their radically new appearance has never been adequately explained. Vocabulary elements such as the ridge pole, tierceron or non-structural rib, lierne or segmented ridge rib, flying rib, conoid springer vault or cone of ribs rising from the springer pole in the elevation, triradial vaulting or three ribs meeting at the ridge pole, double syncopated or overlapping arcading, and the bundled and ribbed umbrella column, all originate in some form or are developed for the first time in Lincoln. All of the geometries which appear for the first time in the architecture appear in the cosmologies of Grosseteste, for the purpose of explaining the generation, emanation, reflection, refraction, and rarefaction of light as it forms the material world in geometrical configurations. The cathedral would thus be a catechism of the geometrical substructure of the physical world, in the tradition of the Timaeus of Plato. There is no evidence that the concepts were dictated by Grosseteste directly to masons, but it is well known that such concepts permeated medieval architecture and city planning, and that they were filtered down through all trades involved in construction of the city and the cathedral. Grosseteste’s cosmologies represent a core achievement of Scholasticism, the synthesis of classical philosophy and Catholic theology, which is embodied in the architecture of the cathedral. (shrink)
