Although company narratives frequently emphasize impressive sales numbers and market leadership, such an organizational “top dog” narrative can backfire when companies are accused of engaging in unethical conduct. This research demonstrates, through a series of nine (N = 3872) experimental studies, that an organizational top dog (vs. underdog) narrative increases the intended punishment of company moral transgressions but not non-moral transgressions. Such differences in intended punishment emerge because observers infer that organizations with a top dog narrative use predominantly dominance-based strategies (...) to achieve their status, whereas companies with an underdog narrative are less likely perceived as employing such strategies. We provide preliminary evidence that a debiasing intervention decreases the harsher punishment of organizations with a top dog narrative but does not affect the punishment of organizations with an underdog narrative. At these and other major European centres of learning, English-born Franciscans came to hold prominent roles both in the university faculties of the arts and theology and in the local studia across Europe that were primarily responsible for training Franciscans. This volume explores the contributions to scholarship of some of the leading English Franciscans or Franciscan associates (...) from this period, including Roger Bacon, Adam Marsh, John Pecham, Thomas of Yorke, Roger Marston, Robert Grosseteste, Adam of Exeter, Richard Rufus of Cornwall, and Bartholomew of England. Through focussed studies of these figures' signature ideas, contributions will provide a basis for drawing comparisons between the English Franciscan school and others that existed at the time, most famously at Paris. These three have been linked by the equation I=PAT, or environmental impact=population size multiplied by affluence (or degree of consumption) multiplied by technology. Reduce any one of these and the impact drops; increase one or all three, and the impact rises, in some cases dramatically.Much of the conversation among scientists and technologists has focused on the P (population) and T (technology) parts of the equation, with grave concerns that rising population numbers are swamping earth systems, yet often with buoyant optimism that technological breakthroughs will solve everything. These two perspectives dominated political discussion for much of the 1960s and 1970s (Ehrlich et al. 1977 and Lovins 1977, among others). But by the 1980s the facts were incontrovertible: high rates of consumption were driving environmental destruction just as fast if not faster than rising population. At the 1992 Rio Summit in Brazil, representatives of southern countries demanded that high-consuming northern countries examine their own contribution to the environmental crisis rather than placing blame elsewhere. It is our obligation in the North to respond to these serious requests.How much do people in northern industrialized countries consume? Here are some indicator figures: Americans consume their average body weight (120 pounds) every day in materials extracted and processed from farms, mines, range lands, and forests (Ryan and Durning 1997, 5). In the United States, the number of shopping malls (close to 35,000) eclipsed the number of high schools in 1987 (Dunning 1992, 130). Since 1950 the per capita consumption of energy, meat, and lumber has doubled, use of plastic has increased five times, use of aluminum seven times, and average airplane miles per person has soared 33-fold (Durning 1992, 29). As products have proliferated, we see the swelling ecological footprint behind each new thing: clear-cut forests replacing paper plantations in Thailand, toxic oil polluting native lands of Ecuador, women earning poverty wages assembling computer chips in [End Page 23] Malaysia--the stories are not as pretty as the products. Materials extraction, production, distribution, use, and waste disposal--all of these have ecological costs, many of which are life threatening.Why should Buddhists and Christians address consumption? For starters, it is a nonsectarian issue; responsibility cuts across denominations and religious belief systems. Collaboration of all kinds is needed to take apart this juggernaut of complex causes and conditions. I believe the Buddhist tradition has powerful analytical tools and spiritual practices which may be helpful in this undertaking. These may aid or inspire similar efforts explored through the Christian heritage. A survey of the landscape and the literature shows it is shockingly clear: the challenge here is enormous. It will require all the spiritual insight, dedication, and sheer stamina we can bring to it. This work cannot be done alone; we need each other's help to keep going through the many obstacles.To date, Buddhist initiatives in this conversation have been modest. Several popular books have brought Buddhist perspectives to bear on consumption issues, most notably E. F. Schumacher's Small is Beautiful (1975) and Gary Snyder's The Practice of the Wild (1990). Both works popularize practices of simplicity and restraint, flavored by the exotic Western fascination with Eastern thought. Several Buddhist teachers in the U.S. have taken up particular sub-themes addressing over-consumption. In this article, I take up two arguments in favor of the discursive model of legal argumentation: the claim to correctness argument and the dual nature thesis. The argument of correctness implies the dual nature thesis, and the dual nature thesis implies a nonpositivistic concept of law. The nonpositivistic concept of law comprises five ideas. One of them is the special case thesis. The special case thesis says that positivistic elements, that is, statutes, precedents, and prevailing doctrines, are necessary for (...) law in order to achieve legal certainty. Without this, law would not be as perfect as it could possibly be. But it says, at the same time, that this alone would not be enough to fulfill the claim to correctness. The claim to correctness refers not only to the real dimension of law, defined by statutes, precedents, and prevailing doctrines, but also to its ideal dimension, defined, first and foremost, by justice. The special case thesis is my oldest thesis. It has remained an essential element of my system over the years. Its connection with four other theses—the Radbruch formula, the human rights thesis, the idea of deliberative democracy, and principles theory—does not change this at all. On the contrary, this connection has lent greater strength to the special case thesis. (shrink)

Elle montre que cette expérience prolonge et renouvelle d’une part la conception kantienne de l’expérience du proprement humain, et d’autre part la conception tocquevillienne de l’expérience du semblable. Replacing two volumes of 1967-68, with the same title and publisher, which were edited by Domenico Omero Bianca, the new translation by Massimo Mugnai and Enrico Pasini offers the Italian reader an outstandingly comprehensive selection of Leibniz’s works in a presentation richly though unobtrusively illuminated by the latest scholarship. My chief aim in this review will be to give scholars working (...) in English an idea of the lines of study suggested by this new product of Italian scholarship, and the resources available in it. Leibniz's version of the ontological argument, a modal argument for theism on which he worked most intensively in the 1670s, has two stages. The first, an “incomplete” proof, concludes that God can only be a necessary being, and therefore if God's existence is possible, then God exists. The second stage is an a priori argument that the existence of such a necessary God is indeed possible. Leibniz's fullest attempts at a possibility proof turn on his conception of a most perfect (...) being, and the chapter concludes that they are not likely to succeed, in part because of difficulties in connecting the concepts of perfection and necessary existence. My aim in this article is to flesh out a new distinction between moral responsibility, as it is understood in light of Strawson’s “reactive attitudes,” and an institutional form of responsibility—a responsibility that employees bear for their work to their superiors. I show that Strawson’s view of responsibility is separate from organizational responsibility, and hence the responsibility of employees to their managers cannot be understood in terms of indignation or resentment, both of which are key Strawsonian concepts. The latter type (...) of responsibility can be understood in terms of objective attitudes, managerial demands, organizational standards, and related expectations. Based on a Cartesian and a Wittgensteinian notions of asymmetry between first- and third-person uses of psychological concepts, Strawson developed a view of responsibility that dissolves the above asymmetry. In contrast with the latter asymmetry, which focuses on those who ascribe psychological concepts to themselves and to others, Strawson’s view is centered on the recipients of reactive attitudes. According to his view, resentment and indignation differ because they are aimed at different recipients, something that cannot be applied in cases of organizational responsibility. (shrink)

En accomplissant cette refondation de manière tout à fait originale, dans une oeuvre commencée en 1968 qui compte en 2012 près de dix mille pages, réparties en vingt ouvrages et près de deux cents articles, Richir poursuit le but et a comme ambition de bouleverser et de changer en profondeur les paramètres essentiels de la phénoménologie. Bill Bowring’s book attempts to argue for a Marxist account of international law that embraces it as a tool for progressive politics and revolutionary change. He argues it is necessary to give a substantive account of both, locating them in the real struggles of the oppressed. Specifically, he locates human rights in the three great revolutions ‐ the French, the Russian and the anticolonial. However, this revolutionary heritage has been ‘degraded’ by recent events. As such, it is necessary to adopt (...) ‘revolutionary conservatism’, invoking international law’s origins against its current degradation. This review argues that, owing to international law’s indeterminacy, Bowring’s project is susceptible to imperial appropriation. This means, however, that Bowring cannot give an account of why we should use international law. It then argues that Bowring’s account of Pashukanis is wrong, and that Pashukanis’s work can better make sense of Bowring’s insights and international law more generally. (shrink)
