Discharges against medical advice (AMA) make up a significant number of hospital discharges in the United States, and often involve vulnerable patients who struggle to obtain adequate medical care. Unfortunately, much of the AMA discharge process focuses on absolving the medical center of liability for what happens to these patients once they leave the acute setting. Comparatively little attention is paid to the ethical obligations of the medical team once an informed decision to leave the acute care setting AMA has (...) been made. Via a case narrative, we offer an ethical framework that we believe can help guide an ethically defensible AMA discharge process. By emphasizing our duty to provide the best care possible under the circumstances, we contend, our ethical obligations to promote the patient's best interests can still be met despite their decision to leave the acute setting against medical advice. This chapter offers an opinionated introduction to higher-order formal languages with an eye towards their applications in metaphysics. A simply relationally typed higher-order language is introduced in four stages: starting with first-order logic, adding first-order predicate abstraction, generalizing to higher-order predicate abstraction, and finally adding higher-order quantification. It is argued that both β-conversion and Universal Instantiation are valid on the intended interpretation of this language. Given these two principles, it is then shown how we can use pure higher-order logic to (...) ask, and begin to answer, metaphysical questions with non-trivial implications. In particular, while we must reject the popular idea that structural differences between sentences correspond to parallel distinctions in the logical structure of extra-linguistic reality, it may still be possible to give a purely logical characterization of objectual aboutness and related notions. We offer an interpretation of the mental files framework that eliminates the metaphor of files, information being contained in files, etc. The guiding question is whether, once we move beyond the metaphors, there is any theoretical role for files. We claim not. We replace the file-metaphor with two theses: the semantic thesis that there are irreducibly relational representational facts (viz. facts about the coordination of representations); and the metasemantic thesis that processes tied to information-relations ground those facts. In its canonical (...) statement, the ‘file’-theory makes reference to a certain kind of relational representational feature, and a certain kind of mental activity. Mental files need not come into it. In short, we posit mental filing without mental files. Our interpretation avoids awkward problems that arise on the standard interpretation and clarifies the explanatory commitments of the theory. (shrink)

The long agony of the mixed constitution that began in the civil wars which raged in Iberia, France, the Low Countries, and England and seemed settled by the widespread adoption of the maxims of reason of state, revived at the end of the period, with revolution in Poland, Denmark, Sweden, Geneva, and, more famously, [End Page 725] British North America and France. The problem, classically, turned on the location of sovereignty, or supreme authority, in political systems designed to balance and diffuse rather than concentrate power. When budget deficits and fratricidal culture wars raised the cry of “necessity”—with the knowledge, of course, that necessity knew no law—estates and kings across Europe found themselves at daggers drawn. The claim that the ruler, who naturally was wholly committed to the common good, had therefore the ability to take emergency action was used both by those accustomed to rule and those newly attained to it by force. The pursuit of an “interest” that was identified with the nation’s effectively marginalized discussions of right and law while still serving an essentially constitutional, justificatory role in political debate. But if unchecked authority was necessary in order to meet the challenge of a world characterized by change and chance and thus had to reside somewhere, was there anything that made its exercise by one body more appropriate than another? This was the question that lay behind the late eighteenth-century repudiation of the reason of state “solution” to the problem of the mixed constitution. The answer, which clearly underpinned the establishment in fact of what had first been theorized already a century earlier, was that only consent could legitimate the exercise of sovereignty in time of necessity.1Representation, in one form or another, was the acknowledged solution to the problem formulated by Hobbes: “the name of Tyranny, signifieth nothing more, nor less, than the name of Sovereignty, be it in one, or many men, saving that they that use the former word are understood to be angry with them they call Tyrants.” But representation also acknowledged the reality behind the charged category of “citizenship”: most people in most places could not be said to live the life of the active citizen celebrated in Roman republican literature. Hence Hobbes’s attack on recourse to classical exempla in general, and the Libertas of Lucca in particular. The idea of civis as law-abiding subject was as radical a redrawing of the terms of debate as the identification of human nature with unsociability. Insofar as politics, classically, justified itself as the means for individual self-perfection, the practice of the ancient citizen could be conceived of as the practice of that best life speculated upon by philosophers. For the represented citizen, however, politics necessarily occupied a more subsidiary position. Arthur Schopenhauer ranked the several arts in a hierarchy, with literary and dramatic arts at the top, music soaring in a separate even higher heaven, and architecture sinking to the ground under the weight of beams and bricks and mortar.1 The governing principle seems to be some measure of spirituality, with architecture ranking lowest by vice of being grossly material.Nowadays such rankings are taken less seriously. Traditional ideologies and mythologies of the arts are undergoing deconstruction and disvaluation, making way for (...) a neutral comparative study that can reveal a good deal not only about relations among the several arts2 but also about the kinships and contrasts between the arts, the sciences, and other ways that symbols of various kinds participate in the advancement of the understanding.In comparing architecture with the other arts, what may first strike us, despite Schopenhauer, is a close affinity with music: architectural and musical works, unlike paintings or plays or novels, are seldom descriptive or representational. With some interesting exceptions, architectural works do not denote—that is, do not describe, recount, depict, or portray. They mean, if at all, in other ways.On the other hand, and architectural work contrasts with other works of art in scale. A building or park or city3 is not only bigger spatially and temporally than a musical performance or painting—it is bigger even than we are. We cannot take it all in from a single point of view; we must move around and within it to grasp the whole. Moreover, the architectural work is normally fixed in place. Unlike a painting that may be reframed and rehung or a concerto that may be heard in different halls, the architectural work is firmly set in physical and cultural environment that alters slowly. 1. Forgiveness is clearly an important aspect of our moral lives, yet surprisingly Kant, one of the most important authors in the history of Western ethics, seems to have very little to say about it. Some authors explain this omission by noting that forgiveness sits uncomfortably in Kant’s moral thought: forgiveness seems to have an ineluctably ‘elective’ aspect which makes it to a certain extent arbitrary; thus it stands in tension with Kant’s claim that agents are autonomous beings, capable of determining (...) their own moral status through rational reflection and choice. Other authors recognise that forgiveness plays a role in Kant’s philosophy but fail to appreciate the nature of this duty and misrepresent the Kantian argument in support of it. This paper argues that there is space in Kant’s philosophy for a genuine theory of forgiveness and hopes to lay the grounds for a correct interpretation of this theory. I argue that from a Kantian perspective, forgiveness is not ‘elective’ but, at least in some cases, morally required. I claim that, for Kant, we have an imperfect duty of virtue to forgive repentant wrongdoers that have embarked on a project of self-reflection and self-reform. I develop a novel argument in support of this duty by drawing on Kant’s theory of rational agency, the thesis of radical evil, Kant’s theory of moral development, and the formula of humanity. However, it must be noted that this is a conditional duty and Kant’s position also entails that absence of repentance on the part of the wrongdoer should be taken as evidence of a lack of commitment to a project of self-reflection and self-reform. In such cases, Kant claims, we have a perfect duty to ourselves not to forgive unrepentant wrongdoers. I argue that this duty should be understood as one of the duties of self-esteem, which involves the duty to respect and recognise our own dignity as rational beings. (shrink)

Forgiveness as a positive response to wrongdoing is a widespread phenomenon that plays a role in the moral lives of most persons. Surprisingly, Kant has very little to say on the matter. Although Kant dedicates considerable space to discussing punishment, wrongdoing and grace, he addresses the issues of human forgiveness directly only in some short passages in the Lectures on Ethics and in one passage of the Metaphysics of Morals. As noted by Sussman, the TL passage, however, betrays some ambivalence. (...) Kant establishes a duty of virtue to be forgiving (TL, 6:460), yet he immediately warns against its excess: meek toleration of recurrent wrongs could manifest a lack of self-respect and a violation of a duty to oneself (TL, 6:461). Sussman claims that this ambivalence ultimately arises from the fact that forgiveness sits uncomfortably in Kant’s moral thought. First, forgiveness has an ‘ineluctably elective aspect’ that makes it, to a certain extent, arbitrary and dependent on particular features of the forgiver’s psychology and, as such, in tension with Kant’s central claims that human beings are autonomous agents capable of determining their own moral status. Second, according to Sussman, Kant’s moral retributivism, i.e. ‘the particular moral position that every moral wrong against another deserves punishment of the wrongdoer’ seems to be in tension with the possibility of a ‘truly redemptive forgiveness’. Moreover, forgiveness also seems to be in tension with a passage of the Religion in which Kant argues that the moral guilt from our original evil disposition cannot be understood as a debt or liability that can be compensated, erased, transferred or otherwise wiped out by others (Rel, 6:72). Thus, to the extent that forgiveness might be thought to involve the forgoing of moral guilt, it seems incompatible with Kant’s views on culpability and punishment. This chapter seeks to clarify Kant’s views on forgiveness in order to show that, although not often appreciated, personal forgiveness plays an important role in the lives of ordinary human agents as understood by Kant. In particular, I aim to show there is a conception of forgiveness available to Kant that is not incompatible with Kant’s views of punishment and culpability. In Section 1, I argue that, for Kant, far from being merely ‘elective,’ forgiveness is, under certain conditions, morally required. I provide a brief summary of an interpretation of Kant’s theory of forgiveness that I have defended in recently published work , in order to argue that Kant’s duty to be forgiving should be understood as an imperfect duty of virtue which is conditional on repentance. Kant is not ambivalent about this duty because he maintains that when the relevant conditions are not met, we have a perfect duty to ourselves not to forgive unrepentant wrongdoers. The TL passage thus identifies two different duties. In Section 2, I show that forgiveness, as conceptualised by Kant, does not require the forgoing of punishment or the overcoming of moral guilt and that this could, in fact, be seen as an attractive feature of Kant’s position. Aristotle’s principle that “nature does nothing in vain” (NDNIV) is central to his teleological approach to understanding organisms. First, we argue that James G. Lennox’s influential account of NDNIV is unsuccessful. Second, we propose an alternative account that includes a natural state model. According to a natural state model of development, an organism will develop toward its natural state unless interfering forces prevent that from happening. Third, we argue that this account also fits Aristotle’s discussion in the Generation of Animals (...) and can explain monstrosities in nature that at first sight seem to be counterexamples to NDNIV. Fourth, we take a broader look at NDNIV, arguing that it does not entail that all structures are teleological (since it accommodates the thought that by-products and some neglected items that Aristotle calls “tokens” are nonteleological), that it does not entail that there is only one function per organ, that NDNIV is not an anthropocentric principle, and that, perhaps surprisingly, the teleological structures of an organism can benefit others apart from the organism and its progeny. Finally, we argue that Aristotle endorsed an empirical justification of NDNIV wherein the principle is justified by its many successful applications. (shrink)

The paper discusses recent proposals by Carroll and Chen, as well as Barbour, Koslowski, and Mercati to explain the arrow of time without a Past Hypothesis, i.e. the assumption of a special initial state of the universe. After discussing the role of the Past Hypothesis and the controversy about its status, we explain why Carroll's model - which establishes an arrow of time as typical - can ground sensible predictions and retrodictions without assuming something akin to a Past Hypothesis. We (...) then propose a definition of a Boltzmann entropy for a classical N-particle system with gravity, suggesting that a Newtonian gravitating universe might provide a relevant example of Carroll's entropy model. This invites comparison with the work of Barbour, Koslowski, and Mercati that identifies typical arrows of time in a relational formulation of classical gravity on shape space. We clarify the difference between this gravitational arrow in terms of shape complexity and the entropic arrow in absolute spacetime, and work out the key advantages of the relationalist theory. We end by pointing out why the entropy concept relies on absolute scales and is thus not relational. (shrink)

Four experiments examined how accurately participants can report the times of their own decisions. Within an auditory reaction time task, participants reported the time at which the tone was presented, they decided on the response, or the response key was pressed. Decision time reports were checked for plausibility against the actual RTs, and we compared the effects of experimental manipulations on these two measures to see whether the reported decision times showed appropriate effects. In addition, we estimated the amount of (...) error associated with individual decision time reports by checking how often participants’ decision time reports were implausibly early or late , and by using several quantitative models. Overall, the results suggest that decision time reports are not very accurate but they may be usable for some purposes. (shrink)

Contrary to the widely held belief in the humanities that hysteria no longer exists, this article shows that the advent of new brain imaging technologies has reignited scientific research into this age-old disorder, once again linking it to hypnosis. Even though humanities scholarship to date has paid no attention to it, image-based research of hysteria via hypnosis has been hailed in specialist circles for holding the potential to finally unravel the mystery of this elusive disorder. Following a succinct overview of (...) how hypnosis was used in the nineteenth century hysteria research, the article details how the relationship between hysteria and hypnosis is currently renegotiated in the context of brain imaging studies. It shows that the current research has so far failed to deliver on its promise of uncovering the link between hysteria and hypnosis. It further argues that despite huge technological advances in imaging technologies, contemporary researchers grapple with conceptual problems comparable to those that plagued their nineteenth century predecessors. In ‘Human Fallibility and the Need for Forgiveness’, Claudia Blöser has proposed a Kantian account of our reasons to forgive that situates our moral fallibility as their ultimate ground. Blöser argues that Kant’s duty to be forgiving is grounded on the need to be relieved from the burden of our moral failure, a need that we all have in virtue of our moral fallible nature, regardless of whether or not we have repented. Blöser claims that Kant’s proposal yields a plausible (...) account of the normative status of forgiveness. Kant classifies the duty to be forgiving as a wide duty of virtue, and according to Blöser, this means that Kantian forgiveness is elective in the sense that forgiveness is good in general but without being obligatory in each particular case. In the course of presenting her own reconstruction of Kant’s account, Blöser also objects to some aspects of an interpretation of Kant’s theory of forgiveness which I had previously defended in my paper ‘Forgiveness and Moral Development’. Although there are a lot of points of agreement between our interpretations, the aim of this article is to highlight four key points of disagreement. These issues are worth discussing because they have implications not only for a plausible interpretation of a recognisable Kantian account of forgiveness but also for wider debates in the contemporary literature on forgiveness. First, I show that Kant is not committed to a form of weak situationism as suggested by Blöser and that Kant’s grounding of the duty to be forgiving does not appeal to moral luck. Second, I argue that although Kant’s duty to be forgiving is elective in one sense of the term, it is not elective in another important sense of the term, and that it is in fact better not to interpret Kantian imperfect duties as being elective. Third, I show that awareness of moral fallibility per se does not provide a morally appropriate ground for forgiveness and offer an alternative reconstruction of Kant’s account- in which fallibility plays a role, but it is not the main reason to forgive. Finally, I argue that Blöser’s account of the need to be forgiven is not recognisable Kantian because, from a Kantian perspective, repentance is a necessary condition for the desirability and, in fact, the very possibility of ameliorating our own guilt. Although G. A. Cohen's work on Marx was flawed by a lack of gender-awareness, his work on Rawls owes much of its success to feminist inspiration. Cohen appeals effectively to feminism to rebut the basic structure objection to his egalitarian ethos, and could now appeal to feminism in response to Andrew Williams's publicity objection to this ethos. The article argues that Williams's objection is insufficient to rebut Cohen's ethos, inapplicable to variants of this ethos, and in conflict with plausible gender-egalitarian (...) ethoses. The article also advocates an understanding of basic structuralism and publicity consistent with feminism, and argues that Rawlsians need not reject plausible domestic egalitarian ethoses on either publicity or liberty grounds. Can we describe the ethical views of premodern Buddhist authors, without distorting them, using the terms and concepts employed in contemporary discussions of philosophical ethics? If we can, just how should we do so? Mark Siderits was one of the first authors to propose that we try to understand the normative views of the South Asian Buddhist tradition considered as a whole, and of Śāntideva in particular, as forms of consequentialism. Since his pioneering work, the discussion has advanced considerably, and (...) scholars have raised a number of questions about, and objections against, consequentialist interpretations of Buddhist ethics. This paper defends a consequentialist interpretation of Śāntideva in particular, offering replies to the most important of these questions and objections. If my arguments are successful, they reveal that Siderits’ pioneering articles about Buddhist ethics were quite close to the mark, at least so far as Śāntideva is concerned. (shrink)

Background Although clinical ethicists are becoming more prevalent in healthcare settings, their required training and education have not been clearly delineated. Most agree that training and education are important, but their nature and delivery remain topics of debate. One option is through completion of a clinical ethics fellowship. Method In this paper, the first four fellows to complete a newly developed fellowship program discuss their experiences. They describe the goals, structure, participants and activities of the fellowship. They identify key elements (...) for succeeding as a clinical ethicist and sustaining a clinical ethics program. They critically reflect upon the challenges faced in the program. Results The one-year fellowship provided real-time clinical opportunities that helped them to develop the necessary knowledge and skills, gain insight into the role and scope of practice of clinical ethicists and hone valuable character traits. Conclusion The fellowship enabled each of the fellows to assume confidently and competently a position as a clinical ethicist upon completion. (shrink)

Kant famously made a distinction between actions from duty and actions in conformity with duty claiming that only the former are morally worthy. Kant’s argument in support of this thesis is taken to rest on the claim that only the motive of duty leads non-accidentally or reliably to moral actions. However, many critics of Kant have claimed that other motives such as sympathy and benevolence can also lead to moral actions reliably, and that Kant’s thesis is false. In addition, many (...) readers of Kant find the claim that we should deny moral worth to a dutiful action performed from friendly inclination highly counterintuitive. Moreover, Kantian commentators disagree about the status of actions in conformity with duty, some claim that these can be taken as equally morally worthy as those performed from duty, while others argue that they are not even permissible. -/- It has also been claimed that Kant’s theory of moral worth should be related to the theory of the Gesinnung developed in the Religion. Thus, some authors claim that, in order for an action to possess moral worth, the agent has to be unconditionally committed to morality, that is, the agent must possess a virtuous character or good fundamental maxim (i.e. a good Gesinnung). However, according to Kant’s radical evil thesis (that is, the thesis that man is evil by nature ), the default position for man is to possess an evil Gesinnung, i.e. a Gesinnung which is only conditionally committed to morality insofar as morality does not demand a great sacrifice of our own happiness. So, an unwelcome consequence of this line of interpretation is that in Kantian ethics morally worthy actions become very rare indeed. -/- The paper is divided in two parts. The first part aims to clarify why Kant thought that only actions from duty are morally worthy, replying to some common objections against Kant’s view. I argue that Kant’s non-accidental condition should not be understood in terms of reliability because such interpretation is incompatible with Kant’s theory of motivation and rational agency. I propose an alternative interpretation which supports Kant’ s claim that only the motive of duty leads nonaccidently to dutiful actions, and thus only actions from duty possess moral worth. I end by showing that although actions in conformity with duty are worthless from the moral point of view, they are not (in many cases) impermissible. The first part concludes that the criterion for the permissibility of actions is different to the criterion for the ascription of moral worth. Thus, rightness, which pertains to actions performed on maxims that can be willed as universal laws, and moral worth, which pertains to actions performed from a sense of duty, should be understood as two different levels of moral assessment. -/- The second part of the paper examines Kant’s conception of virtue with the aim of showing that although only agents with a virtuous character (good Gesinnung) will reliably act from duty, a person with an evil character (evil Gesinnung) could on frequent occasions act from duty. I argue that we should not deny moral worth to actions performed from duty even when the agent has an evil Gesinnung. Goodness of Gesinnung is not a necessary condition of the action of an agent possessing moral worth; reliability of motivation is necessary for the ascription of virtue but not for the ascription of moral worth. It follows that virtue, which refers to the agent’s character or fundamental maxim (i.e. the agent’s Gesinnung), and moral worth are also two different levels of moral assessment. The paper concludes that three levels of moral assessment can be distinguished in Kant’s ethical system: (i) rightness, (ii) moral worth and (iii) moral virtue. Moral virtue is the highest level of moral perfection for a human being. Striving towards virtue requires constant progress and effort and ultimately a ‘revolution of the heart.’ The important point is that even when we are still striving to achieve virtue (i.e. an unconditional commitment to morality), we can ascribe moral worth to actions performed by a genuine sense of duty. It turns out that, contrary to many influential interpretations, Kantian ethics is not merely concerned with the rightness or wrongness of particular actions nor is Kantian ethics primarily an ethic of virtue. Instead, Kant’s ethical system is complex and allows for different levels of moral assessment in which both an action-centred and agent-centred perspective can be integrated. (shrink)

This study identifies alternative models for the production of AI-generated images to those currently used by mainstream AI platforms. Based on primitive computational art processes, these systems allow designers to gain greater control over the final visual result while avoiding potential issues with intellectual property theft and breach of privacy. The article starts by analysing the level of artificiality that might be effectively attributed to each part of the creative process involved in the development of AI-generated images. The foreword to Ken Taylor’s, Referring to the World, contains the text of a Facebook post from the day he completed a draft of the book—also the day of his death. Taylor writes that the book began its life ‘years and years and years ago’ as a short, opinionated introduction to the theory of reference, but became more an introduction to his own views than anything else. He also wrote: -/- The opinions and the supporting arguments have been developed over (...) way too many years, in a series of articles, some of which were written with the book in mind others of which were not. But now they are all gathered together in a single if somewhat sprawling argumentative thread. Maybe some will find them more convincing that way. (Taylor 2021, p. x) -/- Even for those who already admired Taylor’s work, seeing his views gathered together into a broader framework will be illuminating and worthwhile. Those for whom the book is an introduction to Taylor’s views will find here an outlook on foundational questions in the philosophy of mind and language which is at once sensible and approachable, and also ambitious and insightful. Taylor will continue to be missed and admired by the philosophical community, both as a thinker, and member of the profession. En este trabajo se analizan dos modos paradigmáticos en que en la actualidad se comprende la relación entre las disciplinas que se encuentran implicadas en la tarea de la neuroética, en su carácter de neurociencia de la ética. Particularmente se critica la forma que toma la interdisciplinariedad en estos dos modelos. En el primer caso se señala que la tarea de reflexión filosófica no da lugar a que la evidencia neurocientífica pueda modificar de modo importante los presupuestos teóricos en que (...) se funda tal reflexión. En el segundo caso, por el contrario, el papel dado al componente empírico, necesario a la neuroética, obtura la reflexión ético-filosófica.In this paper, I analyze two paradigmatic contemporary ways of understanding the relation between the disciplines involved in neuroethics. In particular, I criticize the form interdisciplinarity takes in these two models. It is pointed out that, according to one of these, the philosophical reflection does not allow neuroscientific evidence to influence in any significant way the theoretical presupositions of that reflection. According to the second model, on the contrary, the role of the empirical component, essential to neuroethics, rather blocks the ethical and philosophical reflection. (shrink)

Three claims wittgenstein makes in the tractatus are explicated via schopenhauer's idealism: 1) ethical reward and punishment lie in the action itself, 2) the good or bad exercise of the will alter the world's limits, So that it waxes or wanes, 3) eternal life belongs to those who live in the present. Schopenhauer's theory fills out some of wittgenstein's statements. For example, The happy man's world waxes to the degree that he frees himself from the false perspective of the "principium (...) individuationis". However, The link between schopenhauer's metaphysics and his ethics is tighter than the analogous link in wittgenstein. (shrink)

In this article, I address the issue of whether we have an obligation to remember past immoral actions. My central question is: do we have an obligation to remember past moral transgressions? I address this central question through three more specific questions. In the first section, I enquiry whether we have an obligation to remember our own past transgressions. In the second section, I ask whether we have an obligation to remember the wrongful actions that others have committed against ourselves. (...) In the last section, I investigate whether we have a duty to remember the suffering of victims of crimes that have a political aspect, crimes such as state violence, oppression and racial discrimination, for example. Here I use the term ‘obligation’ in a board sense to refer to actions that are recommended from the moral point of view, that is, when we have moral reasons to act in a certain way. Here I decided to explore these issues from a Kantian perspective. At first glance, Kant does not seem to have much to offer to an ethics of memory since he does not ask these questions directly. Nevertheless, I was interested to explore to what extent Kant’s ethics, and Kantian ethics more generally, can give us tools to answer these questions. What I have discovered is that, despite my initial doubts, the Kantian framework can provide us with materials to build arguments that can help us to answer these questions. In fact, I will argue that in Kant’s ethics, we have an obligation to remember past immoral actions. With regard to our own transgressions, I argue that we ought to remember our past transgressions because this is an aspect of our moral development. With regard to others’ transgressions, I argue that we have a duty of self-respect to demand that others respect us (in the Kantian sense, that is, that others treat us in a morally correct way) and that this involves remembering others’ transgressions, particularly when there is no evidence of their repentance or if they have not apologized. However, if we have (fallible) reasons to think that the wrongdoer has repented, then there is certainly no need to continue to remind them of their offenses. Thus, in the first two sections, my arguments are based on a certain interpretation of Kant’s ethical texts. However, when I address the political dimension of the ethics of memory I have based my arguments on the work of contemporary authors, especially Jeffrey Blustein. In the last section then, the perspective is more ‘Kantian’ than Kant’s. I argue that we have a duty to remember the victims of social and political injustice (social and political violence, oppression, discrimination, atrocity and crimes against humanity). Defenders of the importance of political memory usually appeal to consequentialist arguments. However, these arguments have limits. A Kantian perspective (deontological) is relevant here because it allows us to provide new arguments in support of the importance of political memory and thus ultimately to provide a stronger defense of duties of memory. -/- The issues that arise in relation to an ethics of memory will no doubt require that we study other sources in addition to the materials and arguments provided from a Kantian perspective. Nevertheless, I conclude that perhaps a bit surprisingly, the Kantian tradition has more to offer than it initially seemed, and it can certainly provide part of the theoretical framework to develop an ethics of memory. The aim of Becker’s book is to bring stoicism up to date and to defend a contemporary stoic ethical theory against the prejudices of the skeptical modern reader. Becker imagines what would have happened if stoicism had had a continuous history from ancient times to the present. Since the stoics are thoroughgoing naturalists, according to Becker, they would have incorporated the insights of modern biology and psychology into their theory. They would have abandoned their teleological view of the universe and (...) they would have expanded their account of human psychological development using the latest textbooks in psychology. Stoics are often caricatured as leading bleak lives of forbearance and denial. According to Becker, modern stoics, in favorable circumstances, can enjoy life as much as anyone else and, like their ancient counterparts, can hail from all walks of life. Modern stoicism does not require that one always be cool and detached. Instead, one should be so only when the situation demands it. Nor does modern stoicism require that one lower one’s sights in order not to be disappointed. Instead, it merely enjoins one not to attempt the impossible. Modern stoics are determinists, not fatalists. Finally, despite the comments on the book jacket, modern stoics do not believe that virtue is the only good, although they still believe that virtue is a unique, unconditional, and incommensurable good. Yet among philosophers trained in Western traditions, his work is today almost unknown. One key cause of this unmerited neglect may be that very little of Kumārila’s oeuvre has been available in Western languages. The present work, by two prominent experts on Mīmāṃsā, presents one of the most influential and difficult chapters of Kumārila’s most important work, the Commentary in Verses, in a clear and accurate English translation.As one of the greatest philosophical authors to have appeared in the traditions we now call Hinduism, Kumārila’s works in general are of considerable interest to specialists in Hindu thought. The particular chapter translated in this volume, however, may well be of broader significance than most of his writings. In that chapter, the Apohavāda, Kumārila offers a thorough and wide-ranging critique of the philosophy of language advocated by Dignāga, a key figure in the Buddhist epistemological tradition. Many scholars maintain that it was this critique in particular that motivated Dharmakīrti, another major Buddhist epistemologist, to formulate a new version of this understanding of language, one that would be widely accepted and influential among Buddhists in India and Tibet. Thus, anyone interested in the history of Buddhist philosophy may also find much to ponder in this volume.Several traditions of South Asian philosophy, including the Nyāya-Vaiśeṣika and Kumārila’s own Mīmāṃsā school, were realists about universals. They held that universals were permanent, mind-independent entities and that our understanding of the world was dependent on them. Kumārila’s views on the topic are especially uncompromising, as he holds that we can directly perceive universals in the ordinary things we encounter.These views were, however, rejected by Buddhist epistemologists, who sought to develop nominalist or conceptualist understandings of thought and language that could dispense with real universals. Their most important attempts to do so take the form of theories of apoha, a Sanskrit word literally meaning “exclusion.” In its most basic form, a doctrine of apoha maintains that a general [End Page 1] term such as “cow” manages to be meaningful by excluding all non-cows. But this deceptively simple formulation leads to a variety of interpretations, each facing its own difficulties. In his chapter, Kumārila is unstinting in pointing out a wide variety of objections that can be raised against the apoha view as expressed in the works of Dignāga.One way to think about the apoha theory is that it is fundamentally ontological in nature, seeking to avoid the problems with postulating real universals by arguing that the meanings of words, being exclusions, are negations or absences, not positive entities. Many scholars understand the theory in this way, but Kumārila points out fundamental flaws with this approach. One of the gravest of these flaws is that if absences are non-entities, it is unclear how they can be, at the level of ontology, any different from each other. As a result, the theory is in danger of entailing that all words are synonyms.Another possible way to understand the apoha theory is that it seeks mainly to offer an account of the psychological process by which human minds construct the meanings of words, understanding this process as fundamentally contrastive in nature. Professor Vlastos argues that Socratic irony was responsible for a momentous change in the way in which irony was understood in ancient times. Before Socrates, he argues, irony is connected with lying and deceit, but after Socrates it is associated with wit and urbanity. Vlastos claims that Socratic irony is distinctive and complex. According to Vlastos, Socratic irony involves no hint of deception; it consists simply in saying something which when understood in one way is false, but when understood in (...) another way is true. La artista francesa Sophie Calle (París, 1953) se ha caracterizado por un trabajo híbrido y muchas veces inclasificable. En sus obras se dan cita de igual forma tanto la fotografía, el video y la instalación como la escritura autobiográfica, de bitácora y de correspondencia. A partir de la discusión teórica y conceptual sobre el giro textual y giro visual en la producción de pensamiento y de la dimensión autobiográfica en el arte, en este artículo me propongo explorar los modos en (...) que se reúnen y cruzan visualidad y escritura en la obra de Calle y cómo estas estrategias configuran un lugar inédito e híbrido —fronterizo e imperfecto— para el relato autobiográfico, repercutiendo en las formas con que el arte aborda uno de sus temas centrales, esto es, la presentación y la representación, y las nociones de verdad y ficción contenidas en ellas. This article aims to contribute to a (post)extractivist aesthetics at a time of ontological shifts, meaning an aesthetics that focuses on the role of art in struggles for (post)extractivist worlds. First, it argues for a contextualized approach to the use of the extractivism framework and proposes that this framework is particularly productive for approaching the socio-environmental crisis due to the way it allows us to engage with the ontological basis of this crisis. The article then builds on empirical research conducted (...) in Argentina to develop the concept of prefigurative ontological design, one of the key functions, it is proposed, of artistic practice in anti- and post-extractivist movements. In this way, the article aims to expand our understanding of the potential of extractivism as a framework of analysis and contributes to the theorization of the relationship between art and extractivism through the lens of political ontology, offering new concepts for developing a (post)extractivist aesthetics. Across languages, we find epistemic indefinites, i.e. existential determiners that can convey information about the speaker’s epistemic state.1 One such indefinite is Spanish alg´un, which marks ignorance on the part of the speaker. By using alg´un in (1a) the speaker signals that he is unable (or unwilling) to identify the doctor that Mar´ıa married. Hence, it would be odd for him to add a namely continuation that explicitly identifies the doctor in question, as in (1b). Este artículo se propone contribuir a la elaboración de una cosmoestética materialista posthumana que permita, por un lado, pensar la agencialidad propia de la materia involucrada en las obras de arte por fuera de la lógica artista/forma –material/formado; y por el otro, experimentar con opciones no antropocentradas para la imaginación y la percepción. Se presentan los lineamientos generales de una tal propuesta a partir de una relación con el concepto cosmopolítica y se plantea la prestación del arte en el contexto (...) actual de descalabro de las escalas espacio-temporales. Finalmente, se analizan la serie de pequeñas estatuillas Foreigners y el Proposal for the High Line Plinth, que implicaba la producción de ese mismo tipo de figuras, pero de 6 metros de alto, de la artista argentina Claudia Fontes, con el objetivo de pensar en ellas la perspectiva ontológica relacional y la dimensión política involucrada en la diplomacia más-que-humana que proponen. La pandemia obligó a suspender actividades prácticas de la carrera de enfermería adaptándolas a modalidad online, dificultando el desarrollo de las habilidades procedimentales de los estudiantes. Como alternativa, se construyeron 6 cápsulas audiovisuales demostrativas de un control, con la posterior explicación de estas. Se destaca que un 90% de los estudiantes desarrollaron las habilidades, el 84% aprobó la prueba de unidad y el 87% está muy de acuerdo con que la estrategia facilitó su aprendizaje. Se concluye que la estrategia de (...) modelamiento con medio audiovisual es una metodología efectiva para el desarrollo de estas habilidades. (shrink)

One might think that inequality of income and wealth are a special cause for concern only nowadays. But, perhaps surprisingly, equality and inequality of resources are issues addressed by Aristotle in his Politics. I first discuss Aristotle’s suggestion that equality of resources is a way of avoiding faction. I then discuss Aristotle’s relatively neglected critique of Phaleas of Chalcedon’s proposal for equal plots of land, arguing that Aristotle actually improves on Phaleas’s ideas in his own proposal for a second-best constitution. (...) In such a constitution, Aristotle avoids the hour-glass distribution of rich and poor that is a modern problem. His proposal also incorporates some aspects of his famous doctrine of the mean. I then briefly discuss the question of resources in Aristotle’s ideal city of the Politics and in his ethical works, speculating on the question why distributive justice in relation to wealth is not addressed in the passages of the Politics I discuss. I conclude with some brief reflections on modern and ancient views. (shrink)

Neste artigo apresentamos uma perspectiva de compreensão da história da filosofia, na qual é possível acessar outros modos de como essa história pode ser interpretada. Nesta perspectiva ocorre a desconstrução epistêmica eurocentrada de legitimação da ideia de um “milagre” grego que permite o surgimento da filosofia nessa região em detrimento a outros lugares. O pressuposto indicado é o da pluriversalidade de Mogobe Ramose (2011) que apresenta a ideia de pensamento reflexivo e crítico como condição humana, independente de local. Em relação (...) ao continente africano trazemos a crítica de que a escravidão moderna promovida pela Europa desumanizou africanos e indígenas e, com isso, lhes nega a capacidade de pensamento. Após essa análise, apresentamos a filosofia afro-brasileira como um desdobramento da filosofia africana em seu deslocamento do continente africano para as Américas no período da escravidão e colonização. Apresentamos as bases epistêmicas dessa filosofia mantidas nas culturas afro-brasileiras. Destacamos, também, os seus subsídios corporais, salientando a sua dimensão ética e estética ao propor outros modos de se relacionar em que o coletivo é a alternativa ao individualismo, no qual se destaca uma ética comunitária e solidária. As narrativas constituídas no processo colonizador da modernidade são revistas em seus pressupostos de supremacia para dar lugar a uma filosofia que alcance o outro, que se estabeleça na alteridade. Tal proposta nos parece relevante para o ensino formal de filosofia, pois dialoga diretamente com a realidade de mundo existencial formativa do país, e aponta outras possibilidades de organização da vida em distintos aspectos, mas todos eles perpassados pela educação, neste caso, uma educação para ser e estar com o outro, o que solicita a revisão curricular na grade da filosofia, tanto na formação de professores quanto na disciplina destinada ao ensino médio. No cenário literário brasileiro do início da década de 1950, chama a atenção a publicação quase simultânea de O mundo da paz e Os subterrâneos da liberdade de Jorge Amado, e Viagem e Memórias do cárcere de Graciliano Ramos. Romancistas brasileiros já consagrados pela crítica e pelo público, ambos revelam nessas publicações a radicalidade com a qual se identificam com o comunismo e com a experiência soviética. Ao mesmo tempo, os relatos de viagem e os livros de memória, se vistos (...) em conjunto, evidenciam a presença de duas tradições narrativas: a literária propriamente dita e a do engajamento político dos intelectuais. Assim, o que se pretende aqui é apresentar como essas duas tradições aparecem na obra dos dois escritores, em especial, em seus relatos de viagem à URSS. Do ponto de vista da militância política e dos recursos literários, ambos escritores se utilizaram, nesses títulos, do “gênero de fronteira” para partilhar com seus leitores algum tipo de comprometimento com a história da política nacional recente, com o comunismo e para avalizar a experiência soviética. In this article I examine the legal framework for addressing violence against women in post war Guatemala. Since the signing of the Peace Accords in 1996, judicial reform in Guatemala has included the passing of laws in the area of women‘s human rights, aimed at eliminating discrimination and violence against women. These laws constitute a response to and have occurred concurrently to an increase in violent crime against women, particularly in the form of mass rapes and murders. Drawing on fieldwork (...) conducted in Guatemala‘s Metropolitan Area, this paper juxtaposes the laws for addressing violence against women to Guatemalan women‘s complex, multilayered and multi-dimensional life experiences. The latter expose the limitations of strictly legal understandings of the phenomenon of gender-based violence, and highlight the need for broad social justice approaches that take into account the different structures of violence, inequality, and injustice present in women‘s lives. According to care theory the good parent confronting a helpless child has an unmediated impulse to relieve his distress; that impulse grows into a prescriptive ethic of relatedness, often contrasted to the more individualistic ethic of justice. If, however, a child's nature is understood as assertive and competent as well as fragile and dependent; if, in addition, he acquires needs through socialisation and is the beneficiary of inferred needs determined by others, then an ethic of need-gratification is insufficient. Caring theory, (...) with its emphasis on empathy, compassion, and attentiveness to the child's present state undervalues the role of adult restraint and imposition in a rounded caring philosophy. Parents (and teachers) must continuously balance gratification with suppression, support with restraint, engrossment with detachment. From this process emerges a revised relational ethic in which the care/justice distinctions are collapsed. (shrink)
