I show that these cannot be understood (...) in cognitive terms; furthermore, I show that epistemics – again the attribution of knowledge to self and other – is ‘real’ for participants. Examined closely, however, Charland’s argument fails to escape the cognitive bias that he condemns. However, there may be stronger arguments for broadening the focus of competence assessment to include emotional capacities, centering (...) on the ways in which emotions aid humans in processing information. Before emotional capacities are added to the list of functions essential for decisional competence, though, the feasibility and utility of such a reorientation must be demonstrated.To what extent ought persons’ capacities to experience emotion be taken into account when determining whether they should be deemed competent to make their own decisions? In the previous article, Louis Charland (1998) argues that traditional models of decision-making competence—of which the MacArthur Competence Treatment Study is a typical example—are mistaken in focusing narrowly on persons’ cognitive abilities to the neglect of emotional factors. In contrast, he suggests, constructs of competence ought explicitly to require a capacity to experience emotions, which he believes is central to meaningful decision making, before deeming persons competent.Charland, as he acknowledges, is not the first to suggest that the presence of some degree of emotional capacity is a necessary element of competence, but his argument is among the most elaborate to date and is certainly worth closer examination. Looked at carefully, however, Charland’s argument does not make quite the case for the determination of emotional capacity in competence assessment that he claims for it. Indeed, as I demonstrate below, Charland may share the same “pernicious [End Page 377] cognitive bias” that he ascribes to more traditional approaches. However, despite what I identify as the problems in Charland’s argument, others have raised more disturbing questions about the lack of attention to emotional issues in competence assessment. Thus, I am not ready to reject entirely the possibility that determinations of decisional competence ought to consider emotional factors. I conclude by outlining the questions that remain to be answered to identify more clearly the potential benefits of such an approach.The Construct of Decision-Making CompetenceSome preliminary comments about the nature of the dominant construct of decision-making competence may provide a useful frame for my response to Charland’s paper. Contemporary ideas of competence are tied inextricably to the ideal of self-determination in modern Western societies. Such societies are committed to respect for individual choice, both as a good in its own right and on the grounds that each person knows best what choices will maximize his or her own welfare. In general, therefore, states will not intervene to prevent persons from acting on their decisions, even when the choices they make—like the decision to smoke or to refuse potentially life-saving medical care—may objectively be thought to be detrimental to them.In some cases, however, the presumption that people will act in their own interests, as well as the notion that there is something intrinsically valuable in respecting their choices, fails (Buchanan and Brock 1989). When people’s minds are so disordered that they cannot be said to be making meaningful choices, other values come into play. Such people are called “incompetent.” When persons reach that point, the state’s interest in protecting its citizens becomes primary and someone else must make decisions on their behalf. Note that the size of this group must be sharply limited, lest a liberal society’s commitment to self-determination be undermined: There is no more profound infringement of the rights of citizens than the determination that they are incompetent. Thus, the criteria for incompetence must be selected in a deliberately narrow fashion—alternately, one might say that the standards for competence are made intentionally broad—so that all but a tiny percentage of citizens will be permitted to make decisions on their own.In the Anglo-American world, the process of formulating criteria of competence by and large has been left to the common law courts. Marcus Willaschek’s new book Kant on the Sources of Metaphysics: The Dialectic of Pure Reason is a penetrating analysis of the Transcendental Dialectic of Kant’s Critique of Pure Reason. In his comments, the author first raises some questions concerning the structure of the Transcendental Dialectic and then proposes that looking at the second Critique and continuing on into the third Critique will reveal more roles for the idea of God in Kant’s reconstruction of traditional metaphysics than Willaschek’s treatment suggests.

Over the past two decades, Philip Pettit has consistently argued for an understanding of “republican” liberty in terms of nondomination. Yet in his major published studies, he has almost nothing to say about markets, nor about the economy more generally. I contend that this is a seriously problematic omission, insofar as markets represent a major problem for republican views of freedom. In short: if freedom requires the absence of the mere possibility of arbitrary interference (as Pettit maintains), then the widespread (...) existence of markets indicates that on a republican view the vast majority of people in the world today exist in the dominated position of slaves. As a result, Pettit cannot adopt the “complacency” towards market transactions that he officially avows. But in turn, we ought to be highly skpetical that the republican account of freedom is a viable one. (shrink)

Is knowledge definable as justified true belief? We argue that one can legitimately answer positively or negatively, depending on whether or not one’s true belief is justified by what we call adequate reasons. To facilitate our argument we introduce a simple propositional logic of reason-based belief, and give an axiomatic characterization of the notion of adequacy for reasons. We show that this logic is sufficiently flexible to accommodate various useful features, including quantification over reasons. We use our framework to contrast (...) two notions of JTB: one internalist, the other externalist. We argue that Gettier cases essentially challenge the internalist notion but not the externalist one. Our approach commits us to a form of infallibilism about knowledge, but it also leaves us with a puzzle, namely whether knowledge involves the possession of only adequate reasons, or leaves room for some inadequate reasons. We favor the latter position, which reflects a milder and more realistic version of infallibilism. (shrink)

The Theaetetus is one of the most widely studied of any of the Platonic dialogues because its dominant theme concerns the significant philosophical question, what is knowledge? In this book Paul Stern provides a full-length treatment of its political character in relationship to this dominant theme. He argues that this approach sheds significant light on the distinctiveness of the Socratic way of life, with respect to both its initial justification and its ultimate character. More specifically, he argues that Socrates' (...) revolutionary decision to subject political life to philosophic reflection, the decision that leads directly to his trial and execution, is based on his awareness of the elusiveness of comprehensive knowledge and the implications of that elusiveness for the validity of philosophic inquiry. The history of heterodox ideas about the concept of mind takes the reader from the earliest records about human nature in Ancient Egypt, the Ancient Near East, and the Zoroastrian religion, through the secret teachings in the Hermetic and Gnostic scriptures, and into the transformation of ideas about the mind, soul and spirit in the late antique and early medieval epochs. These transitions include discussion of (...) the influence of Central Asian shamanism, Manichean ideas about the soul in light and darkness, and Neoplatonic theurgy, 'working-on-god-within'. Legal theorist Desmond Manderson and Shakespearean Paul Yachnin develop parallel arguments that seek to restore a public dimension of responsibility to literary studies and a private dimension of responsibility to law. Their arguments issue from their work as the creators of the Shakespeare Moot Court at McGill University, a course in which graduate English students team up with senior Law students to argue cases in the “Court of Shakespeare,” where the sole Institutes, Codex, and Digest are comprised by the (...) plays of Shakespeare. Yachnin argues that modern literary studies suffers from impermanence and isolation from real-world concerns and that it can redress these limitations—developing attributes of corrigibility, temporality, judgment, and publicity—by learning from law. Manderson finds that modern legal judgment is bereft of affective engagement with the subjects of law and wedded to an ideal of objectivity, regulation, and impersonality. Literature can restore to legal judgment the elements of narrative, character, context, and self-reflection. Together, the essays argue that the question of judgment, so integral to the disciplines of law and of literature, needs the renewal that an interdisciplinary engagement provides. (shrink)

Medicine increasingly envisions health promotion in terms of reducing risk as determined by quantitative risk factors, such as blood pressure, blood lipids, or genetic variants. This essay argues that this vision of health care as risk reduction is dangerous for Christian bioethics, since risk can be infinitely reduced leading to a self-defeating spiral of iatrogenic effects. Moreover, it endangers character because this vision of health is connected to a reductionist vision of the body and an understanding of individual risk that (...) undermines the more communal virtue of solidarity. The essay concludes by discussing how recent Thomistic analyses in favor of physical enhancements illustrate some of the problems that envisioning health care in terms of risk reduction holds for Christian bioethics. I discuss the problem of whether true contradictions of the form “x is P and not P” might be the expression of an implicit relativization to distinct respects of application of one and the same predicate P. Priest rightly claims that one should not mistake true contradictions for an expression of lexical ambiguity. However, he primarily targets cases of homophony for which lexical meanings do not overlap. There exist more subtle forms of equivocation, such as the relation of privative opposition (...) singled out by Zwicky and Sadock in their study of ambiguity. I argue that this relation, which is basically a relation of general to more specific, underlies the logical form of true contradictions. The generalization appears to be that all true contradictions really mean “x is P in some respects/to some extent, but not in all respects/not to all extent”. I relate this to the strict-tolerant account of vague predicates and outline a variant of the account to cover one-dimensional and multidimensional predicates. (shrink)

The idea of artificial intelligence implies the existence of a form of intelligence that is “natural,” or at least not artificial. The problem is that intelligence, whether “natural” or “artificial,” is not well defined: it is hard to say what, exactly, is or constitutes intelligence. This difficulty makes it impossible to measure human intelligence against artificial intelligence on a unique scale. It does not, however, prevent us from comparing them; rather, it changes the sense and meaning of such comparisons. Comparing (...) artificial intelligence with human intelligence could allow us to understand both forms better. This paper thus aims to compare and distinguish these two forms of intelligence, focusing on three issues: forms of embodiment, autonomy and judgment. Doing so, I argue, should enable us to have a better view of the promises and limitations of present-day artificial intelligence, along with its benefits and dangers and the place we should make for it in our culture and society.
