This article explores how the body is discussed in Latin American, Latina and Chicana Feminist Theology and their conversation partners in cultural, critical, feminist and ethnic studies. The article imagines this discourse as a relational dance that investigates the body as the place from which one views the world, as the locus of investigation and as the indecent body which resists all dualisms and embraces plurality. It is argued that what emerges from this embodied discourse is relationality: bodies dancing in (...) relation. (shrink)

Le propos de ce recueil est de développer deux thématiques : raison et folie et déraisons de la raison. D'un côté, on interroge la décision spéculative et politique qui "lie et sépare à la fois raison et folie" dans les termes mêmes employés par Michel Foucault (1961). L'âge classique, le siècle de la raison, commence par constituer un autre de la raison : le fou, renvoyé "au jardin des espèces". Il faut donc revisiter cette archéologie des dualismes mutilants : raison (...) et folie, normal et pathologique, âme et corps, à la lumière des travaux les plus récents. La folie aujourd'hui s'aborde de manière préoccupante dans les politiques de santé mentale qui visent à criminaliser la folie : psychiatrie menacée d'un retour de l'enfermement et de la violence. Psychiatrie sinistrée mais qui est déjà sur la voie de la résistance, notamment dans la culture, comme l'atteste la présence de la mélancolie en son sein, mais aussi dans les développements contemporains de la psychothérapie institutionnelle et de ses équipements comme de ses concepts. Sans négliger d'autres initiatives. Enfin, la rationalité elle-même n'est pas une donnée immédiate de la science. Elle se construit sur fond d'irrationalité. Là aussi, les dualismes familiers et stérilisants sont dissipés. (shrink)

The compliance-based approach and the integrity approach have been the mainstream responses to corporate scandals. This paper proposes that, despite each approach comprising necessary elements, neither offers a comprehensive solution. Compliance and integrity, far from being mutually exclusive, reinforce each other. Working together, in a correct relationship, they build a harmonized system that yields positive synergies and which also advocates prudence. It enables the generation of a culture of compliance that tends to minimize the technical and ethical errors in decision (...) making. In order to explore an applied harmonized approach, we analyze the audit committee, a specific and broadly accepted regulatory instrument. Formed by non-executive members, regulation requires these members to be dedicated, qualified, and independent as a guarantee of efficiency. We show how the compound of those elements produces positive effects in a context of solid governance. We conclude that it is the strong relationship between efficiency and prudence, in the creation of a culture of compliance, which enables the minimization of errors. (shrink)

El libro se divide en tres partes que comprenden desde la filosofía alejandrina hasta el periodo ético y religioso de los griegos, con lo que se completa el cuadro de la filosofía helenística.

Social contract theorists often take the ideal contract to be the agreement or bargain individuals would make in some privileged choice situation. Recently, experimental philosophers have explored this kind of decision-making in the lab. One rather robust finding is that the exact circumstances of choice significantly affect the kinds of social arrangements experimental subjects unanimously endorse. Yet prior work has largely ignored the question of which of the many competing descriptions of the original position subjects find most compelling. This paper (...) aims to address this gap, exploring how attractive experimental subjects find various characterizations of these circumstances of choice. We find evidence suggesting that no one choice situation can fulfill the role that social contract theorists have hoped it would play. We also find that, contrary to what some prominent social contract theorists have expected, there is no robust relationship between an individual’s ranking of distributive principles and their ranking of various descriptions of the original position. In conclusion, we discuss the broader implications of these results for political philosophy. (shrink)

Some interpreters claim Kant distinguishes between organisms and living things. I argue that this claim is underdetermined by the textual evidence. Once this is recognized, it becomes a real possibility that Kant’s various remarks about the essential properties of living things generalize to organisms as such. This, in turn, generates a puzzle. Kant repeatedly claims that the capacity for representation is essential to the nature of a living thing. If he does not distinguish between living things and organisms, then how (...) might the capacity for representation be essential to the latter? Drawing on the writings of Kant and his contemporaries, I reconstruct a framework within which representational capacities might conceivably be thought to play this role. On this view, what distinguishes an organism from mechanically explicable products of nature is its capacity for endogenous behavior that is instinctual and representationally mediated. (shrink)

Speech Acts, Criteria and Intentions What makes a speech act a speech act? Which are its necessary and sufficient conditions? I claim in this paper that we cannot find an answer to those questions in Austin's doctrine of the infelicities, since some infelicities take place in fully committing speech acts, whereas others prevent the utterance from being considered as a speech act at all. With this qualification in mind, I argue against the idea that intentions—considered as mental states accomplishing a (...) causal role in the performance of the act—should be considered among the necessary conditions of speech acts. I would thus like to deny a merely ‘symptomatic’ account of intentions, according to which we could never make anything but fallible hypotheses about the effective occurrence of any speech act. I propose an alternative ‘criterial’ account of the role of intentions in speech acts theory, and analyse Austin's and Searle's approaches in the light of this Wittgensteinian concept. Whether we consider, with Austin, that speech acts ‘imply’ mental states or, with Searle, that they ‘express’ them, we could only make sense of this idea if we considered utterances as criteria for intentions, and not as alleged behavioural effects of hidden mental causes. El objetivo de este artículo es alertar sobre el nuevo artefacto para la ocultación de la violencia de género: «la alta conflictividad» en las rupturas familiares. Desde estos planteamientos se pone el foco en la protección del interés superior de la infancia y adolescencia en los casos de ruptura familiar, escondiendo los daños sufridos por los hijos e hijas derivados de la violencia de género. Mostraremos cómo, para paliar los daños derivados de la «alta conflictividad», se está asentando jurisprudencialmente la (...) coordinación de parentalidad. Mediante un análisis jurisprudencial, comprobaremos cómo este método de resolución de conflictos se aplica en contextos de violencia de género, con el fin último de restablecer o normalizar la relación del padre que ejerce violencia de género con sus hijos e hijas. The article explores the moral conflict between individual animal rights and the value of species conservation, using the culling of kangaroos to save earless dragons in Australia as a case study. The author argues that species do not possess nonderivative final value and thus cannot justify the infringement of individual rights. While recognizing the instrumental and contributory value of species, the paper rejects philosophical arguments that claim species have nonderivative value, such as the replication argument and the last person argument. (...) The author concludes that while there are important conservation duties, they should not violate individual rights, as exemplified by the kangaroo culling practice, which must be abolished. Key ethical issues arise in association with the conduct of stem cell research by research institutions in the United States. These ethical issues, summarized in detail, receive no adequate translation into federal laws or regulations, also described in this article. U.S. Federal policy takes a passive approach to these ethical issues, translating them simply into limitations on taxpayer funding, and foregoes scientific and ethical leadership while protecting intellectual property interests through a laissez faire approach to stem cell patents and licenses. (...) Those patents and licenses, far from being scientifically and ethically neutral in effect, virtually prohibit commercially sponsored research that could otherwise be a realistic alternative to the federal funding gap. The lack of federal funding and related data-sharing principles, combined with the effect of U.S. patent policy, the lack of key agency guidance, and the proliferation of divergent state laws arising from the lack of Federal leadership, significantly impede ethical stem cell research in the United States, without coherently supporting any consensus ethical vision. Research institutions must themselves implement steps, described in the article, to integrate addressing ethical review with the many legal compliance issues U.S. federal and state laws create. In this contribution we examine the various amoral types of reasoning that have long predominated in the history of tolerance. In doing this we also hope to show that these amoral notions of tolerance are always far removed from, and in conflict with, the idea of freedom of religion as a moral and political right. In conclusion we show that when the liberal notion of freedom as a personal and moral right predominates, then the notion of tolerance loses some of (...) its meaning. (shrink)

In diesem Beitrag wollen wir zeigen, wieso die Fachdidaktik Philosophie und Ethik (neue) Ansätze entwickeln muss, um dem Anspruch auf (philosophische) Bildung von Menschen mit sonderpädagogischem Förderbedarf gerecht zu werden. Dafür zeigen wir anhand von Schüler_innen mit eingeschränkten Kommunikationsmöglichkeiten auf, wie Philosophieren mit ihnen dennoch möglich ist. Gleichzeitig wenden wir uns im Beitrag dem Haupteinwand zu, der darin besteht, dass Philosophieren mit dieser Schüler_innengruppe nicht möglich sei. Wir erklären unter welchen Umständen dieser Einwand nicht aufrecht erhalten werden sollte, sondern vielmehr (...) eine moralische Pflicht besteht, Menschen mit Behinderung philosophische Bildungsprozesse zu ermöglichen. Bracken ERICA LILLELEHT'S INTERESTING PAPER combines philosophy, history, service analysis, and social commentary. The philosophical themes are below the surface, implicit rather than explicit. As such the paper echoes the work of Foucault himself. The subjects of his books and other writings ranged from histories of madness and psychiatry, hospitals and medicine, (...) prisons and punishment, to sexuality and ethics. But these were clearly more than histories. In doing what he initially called archaeology and later genealogy, Foucault was writing about different dimensions of how the Western world has come to understand what it is to be human. In Foucault's hands history becomes philosophy. The essence of his work is an invitation to question the project of Enlightenment. However, his interrogation of the legacy of Enlightenment is far from a rejection of reason as has sometimes been claimed. Rather it represents a realization that there are different forms of reason, none of which can claim a place of privilege over others. Foucault challenged the idea that we have to choose to be for or against Enlightenment (Foucault, 1984).Of central concern for him is the idea that knowledge and power imply each other and cannot be separated. This, of course, is anathema to both Marxist and liberal analysts who hold out the idea that truth and ideology are mutually exclusive. The assumption is that if we get the starting point of our analysis right, the truth ("pure and simple") will emerge. For Foucault there are "regimes of truth," discourses through which certain things can be said and statements can be judged as true or false. Such regimes are social products, bound up with the economic, cultural, and political realities of their times. This is not some sort of mindless relativism nor a nihilistic advocacy that, when it comes to knowledge claims, "anything goes." As human beings in an imperfect world we have to struggle continuously toward a better understanding of ourselves and the make-up of this world. As individuals, we have to continue to debate and argue about ideas, facts, and the nature of knowledge. We have to present evidence, argue our case, and prepare to be contradicted as well as supported. This is not in question. Instead, what is involved here is recognition that there is no neutral asocial, acultural, or apolitical vantage point from we can judge the validity of one position over another. Foucault's work nurtures a healthy skepticism of those who claim to have found such a vantage point.Importantly, he rejected the idea that power is always repressive in its nature: working to silence, obscure, and suppress. Particularly in the modern era power is more characteristically productive. Its operations are bound up with the ever-multiplying discourses we produce about ourselves. While increasing scientific knowledge about the human condition appears to represent progress, listening to Foucault means coming to appreciate that things are a great deal more complex. The title of Lilleleht's paper reflects this. At [End Page 187] a time when there is a great deal of talk about "progress" in the area of mental health, her analysis is opportune. Unless we pay attention to the micropolitics of clinical encounters we are at some risk of simply endorsing new forms of professional power. In one light, the psychiatric rehabilitation approach of William Anthony and colleagues appears obviously progressive. It does not depend on the "medical model" and the use of medication and seems genuinely committed to the idea of empowerment. However, with the sort of sensibility engendered through an encounter with Foucault, other issues come into view. Beneath its focus on skills and training we see a very clear normative framework centered on the idea that the person with psychiatric problems should be guided and trained toward fitting in with "his or her particular environment." At stake here is the assumption that the deficit is in the patient. It is he or she who needs to change. Herein lies the issue of power: who is in control of the way in which... (shrink)

He wanted his own philosophy constituted of flesh and blood, and (...) he believed in the centrality of narration in ethical writing. The personality of stories, the irrefutable nature of the individual's account had to form the essential basis in the teaching of ethics. It is no surprise, then, that in his posthumous Tales of Good and Evil, Help and Harm 1 Hallie leaves us with a series of powerful stories, biographical and autobiographical, as the final expression of his lifelong agonizing struggle to come to terms with his own ethical beliefs. There are no general proofs here. No abstract principles. No definitions of goodness and evil. Only stories that depict the being referred to by e. e. cummings as "manunkind" mysteriously achieving the "realizable ideal" of rescuer of strangers.Given Hallie's major work on the rescuers of Jews in the village of Le Chambon-sur-Lignon, Lest Innocent Blood Be Shed. The Story of the Village of Le Chambon and How Goodness Happened There, 2 it seems appropriate that he begin this particular account of "tales of good and evil" in that same [End Page 231] village. Thus, the first biography he presents is that of Magda Trocmé, the wife of the pastor of the Protestant Church in Le Chambon-sur-Lignon, André Trocmé, who, with his fellow pastor Edouard Theis, is said to have inspired the rescue mission in the village. Hallie underscores the communal nonviolent effort by clergy and villagers alike in this "city of refuge." While he admires both André and Magda as practitioners of the "great virtues," he more readily identifies with Magda's secularism than with her husband's piety. He celebrates her generosity, her refusal to turn anyone away from her door, her "quiet habit of efficacious compassion," and her terse explanation as to why the rescuers in the village did what they had done: "What do you mean? It had to be done, that's all."As much as Hallie related to Magda's secularism, he was unable to identify fully with her because he felt tainted by the killing he had done as an artillery man in the United States Army during World War II. "I was a helpful killer who violated the negative demand against killing ["Thou shalt not kill"] in order to obey the positive one to spread life. But Magda and her villagers! Their ethical purity was beyond me. They obeyed the negative demands of ethics by hating and hurting no one even while they obeyed the positive demands of ethics by saving [thousands of refugees]." Compared to Magda and the villagers, Hallie clearly saw himself as someone operating in the grey zone.With the introduction of Joshua James and the community of Hull, Massachusetts, we ascend from Hallie's personal quagmire of moral ambiguity to the realm of the "ethical sublime." Here the author relates the story of James, whose mother and sister died at sea in 1837 when he was 11 years old, and who would go on to a career of life-saving activity on the Massachusetts coast. James founded the Life-Saving Rescue Service, an organization that evolved into the Coast Guard (or more specifically The Search and Rescue Service of the Coast Guard). He spent his entire life in Hull (1826-1902) and over the course of nearly sixty years saved hundreds of sailor's lives and tens of thousands of dollars worth of property.Many coastal villages around the world, Hallie explains, profited greatly from shipwrecks. Their cargoes and the stuff the ships were made of were highly valuable to the generally poor people who inhabited such villages. En este artículo se exploran algunas condiciones de posibilidad sobre un pensamiento bibliotecológico en América Latina. Para tales fines, se analizó la propuesta de una “Bibliotecología desde Abya Yala”, sobre todo por lo desafiante de sus pretensiones y porque exhibe algunos síntomas generalizados en esta clase de ideaciones (como inconsistencias conceptuales y metodológicas derivadas de prejuicios identitarios regionalistas). Se identificaron dos problemas básicos: “la identidad desde la exclusión” y el supuesto estado epistémico de “saber desde la inclusión”. La “identidad desde (...) la exclusión” se refiere al problema de intentar definir la identidad latinoamericana desde lo “no anglosajón”, y por el criterio de descarte de ideas ajenas como parte de las acciones para lograr, en modo artificial, el carácter “latinoamericano” auténtico (sin que exista de por medio una justificación epistémica). Por otro lado, el problema del supuesto “saber desde la inclusión” (que parte, más bien, desde la exclusión y la marginación hermenéutica) retoma los mismos prejuicios identitarios, y se posa, indirectamente, en el arcaico pensamiento funcionalista bibliotecológico. A pesar de esto, su rasgo más polémico resulta ser que se basa en estados epistémicos deterministas que no son sostenibles ni ética ni epistemológicamente (ni siquiera en la esfera práctica más inmediata). In the paper [8], the first author developped a topos- theoretic approach to reference and modality. (See also [5]). This approach leads naturally to modal operators on locales (or spaces without points). The aim of this paper is to develop the theory of such modal operators in the context of the theory of locales, to axiomatize the propositional modal logics arising in this context and to study completeness and decidability of the resulting systems.

Au Moyen Âge, les rapports entre savoirs théorique et pratique dans la mesure des champs sont difficiles à appréhender. L’article examine d’une part l’évolution de la géométrie depuis les premiers traités de l’époque carolingienne jusqu’à l’apparition de la geometria practica, puis l’évolution de ce dernier genre, d’autre part la pratique effective des mesureurs telle qu’on la reconstitue à partir d’une documentation évasive.
