Abstract:Most papers in this issue carefully analyze normative and empirical methodologies. I shall argue that (a) there is no purely empirical nor purely normative methodology; (b) some terms escape the division of the normative and descriptive. (c) Most importantly, dialogues such as this one point to a form of integration that allows us to reflect on what it is that each approach presupposes in its study of business ethics. Abstract:During recent years, the principle and practice of employment-at-will have been under attack. While progress has been made in eroding the practice, the principle still governs the philosophical assumptions underlying employment practices in the United States, and, indeed, EAW has been promulgated as one of the ways to address economic ills in other countries. This paper will briefly review the major critiques of EAW. Given the failure of these arguments to erode the underpinnings of EAW, we shall suggest new avenues (...) for approaching employment issues to achieve the desirable goal of employee dignity and respect. One’s philosophical points of view, which form the bases for assumptions that we bring to management theory and practice matter, and matter deeply, to management thinking and corporate behavior. In this paper I outline three related threads of philosophical conversations and explain how they are important in management theory and practice: the “linguistic turn” in philosophy, deriving from the later writings of Ludwig Wittgenstein, a social constructionist perspective: a set of theories at least implicitly derived from the linguistic turn in (...) philosophy, and the notion of the impartial spectator. I then use these three theories to analyze the idea of the corporation, corporate cultures and corporate mission statements, stakeholder theories and their differences, and the limitations of the popular notion of “corporate social responsibility.” I conclude that how one frames these management ideas makes a difference, a difference in theory and in practice. Since the inception of their discipline, anthropologists have studied virtually every conceivable aspect of other peoples' morality - religion, social control, sin, virtue, evil, duty, purity and pollution. But what of the examination of anthropology itself, and of its agendas, epistemes, theories and praxes? Conceived as a response to Patrick Tierney's hugely inflammatory book Darkness in El Dorado , whose allegations of immoral and negligent anthropological research in South America caused a storm of protest and debate, the book combines theoretical (...) papers and case studies from eminent scholars including Steven Nugent, Marilyn Silverman and Veronica Strang. Showing how the topic of ethics goes to the heart of anthropology, it raises the controversial question of why - and for whom - the anthropological discipline functions. (shrink)

There are important synergies for the next generation of ethical leaders based on the alignment of modified or adjusted mental models. This entails a synergistic application of moral imagination through collaborative input and critique, rather than "me too" obedience. In this article, we will analyze the Milgram results using frameworks relating to mental models (Werhane et al., Profitable partnerships for poverty alleviation, 2009), as well as work by Moberg on "ethics blind spots'' (Organizational Studies 27(3): 413-428, 2006), and by Bazerman (...) and Chugh on "bounded awareness" (Harvard Business Review, 2006; Mind & Society 6: 1-18, 2007) Using these constructs to examine the Milgram experiment, we will argue that the ways in which the experiments are framed, the presence of an authority figure, the appeal to the authority of science, and the situation in which the naïve participant finds herself or himself, all create a bounded awareness, a narrow blind spot that encourages a climate for obedience, brackets out the opportunity to ask the moral question: "Am I hurting another fellow human being?" and may preclude the subject from utilizing moral imagination to opt out of the experiment. We will conclude that these forms of almost blind obedience to authority are correctable, but with difficulty. We will argue that linking the modification of mental models to an unbinding of awareness represents an important synergistic relationship and one that can build effectively on the lessons learned from our experience with moral imagination. Descartes's claim that the eternal truths were freely created by God is fraught with interpretive difficulties. The main arguments in the literature are classified as concerning the ontological status or the modalities of possibility and necessity of the eternal truths. The views of the principal defenders of the Creation Doctrine – Robert Desgabets, Pierre Sylvain Régis, and Antoine Le Grand are contrasted with those of Nicolas Malebranche. In clarifying the theological, ontological, and logical terms of the debate we can see (...) that what was at stake was the objectivity and certainty of the truths of mathematics and physics. I conclude by suggesting that this issue might fruitfully be used to clarify the disparate discussions in the contemporary literature. (shrink)

A set of six publications have introduced, commented, criticized and defended Amir Alexander’s book on infinitesimals published in 2014. The aim of the following article is to bring the various arguments together.

Over the last decade, and culminating in the 2008 global financial meltdown, there has been an erosion of trust and a concomitant rise of distrust in domestic companies, multinational enterprises, and political economies.In response to this attrition, this article presents three arguments. First, we suggest that trust is the “glue” of any viable political economy, and we propose that the stakes of violating public trust are particularly high in light of the asymmetry between trust and distrust. Second, we identify a (...) constellation of key barriers to overcoming distrust that companies face in the current environment: (1) corporate mind-sets that promote a preoccupation with quantification, hierarchical leadership models, and “blind trust” in authority; (2) the anonymity of core stakeholders; (3) the agency of the media as a driver of the political economy; and (4) firm-centric models of stakeholder relationships.Third, we argue that, notwithstanding these challenges, these phenomena are not fatal and can be addressed through a holistic transformation in corporate culture. Such a transformation might include a shift to collaborative leadership models and replacing authority models with responsibility, a “names and faces” approach to stakeholders through cases and stories, more egalitarian communication exchanges with external stakeholders, and a reprioritization of the firm as a vital element among others within a system rather than the central core of a network.We conclude that the value of trust at the individual, institutional, national, and global levels cannot be overstated. Without a reinvigoration of trust in our political economies, at all levels, the future of an economically vibrant planet is indeed bleak. (shrink)

Ex parte communications can become an administrative quagmire for anyone trying to deal with tribunals that regulate business matters. These communications involve contact between a decision maker and one party outside the presence of another, interested party. At a time when codes of ethics are enacted to make corporate financial officers and boards of directors more accountable to their stockholders, and thus, to restore the confidence of the investing public, it appears most important that administrative judges and hearing officers adhere (...) strictly to their own Codes of Conduct. This article defines and explains ex parte contacts and consequent problems that might arise during administrative appeals. It is not the author’s intent to present the law of any specific jurisdiction, but to present a general overview of typical state law in the United States, a market of interest to many entrepreneurs and exporters worldwide. In Phylogenetic Systematics (1966), Willi Hennig conflates the Linnaean hierarchy with what Hennig refers to as the divisional hierarchy. In doing so, he lays the foundations of that school of biological taxonomy known as cladism on a philosophically ambiguous basis. This paper compares and contrasts the two hierarchies and demonstrates that Hennig conflates them. It shows that Hennig's followers also conflate them. Finally, it illuminates five persistent problems in cladism by suggesting that they arise from Hennig's original confusion.

Clinical next generation sequencing is a term that refers to a variety of technologies that permit rapid sequencing of large numbers of DNA segments, up to and including entire genomes. As an approach that is playing an increasingly important role in obtaining genetic information from patients, it may be viewed by public and private payers either positively, as an enabler of the promised benefits of personalized medicine, or as “the perfect storm” resulting from the confluence of high market demand, an (...) uproven technology, and an unprepared delivery system. A number of recent studies have noted that coverage and reimbursement will be critical for clinical integration of NGS, yet the evidentiary pathway for payer decision-making is unclear. Although there are multiple reasons for this uncertain reimbursement environment, the situation stems in large part from a long-standing lack of alignment between the information needs of regulators and post-regulatory decision-makers such as payers. La alimentación en la Quebrada de Humahuaca, provincia de Jujuy, es uno de los bienes patrimoniales de la región que ha sufrido mayor variabilidad debido a nuevos modelos productivos que han modificado el patrón de consumo tradicional. Los productos industrializados se han incorporado progresivamente a la dieta, impactando en el valor nutricional autóctono.Este trabajo analiza las dimensiones de los sistemas alimentarios de la quebrada, con el objetivo de comprender los contextos culturales de producción, consumo, preferencias y su relación con los (...) riesgos en la salud desde el punto de vista de sus habitantes, utilizando un enfoque metodológico mixto territorial. This paper develops and defends a conception of moral coherence that is suitable for use in contexts of principle pluralism. I argue that, as they are traditionally understood, coherence methods stack the deck against pluralist theories, by incorporating norms such as systematicity—that the principles of a theory should be as few and as simple as possible. I develop and defend an alternative, minimal, conception of coherence that focuses instead on consistency. It has been suggested that consistency in this context should (...) aim at the avoidance of conflict, but I argue against this: what matters is “case consistency,” or judging consistently from one case to another. This means judging in accordance with morally relevant similarities and differences. I defend my proposal of minimal coherence from objections having to do with complexity and arbitrariness. Languages emerge in response to the negotiation of shared meaning in social groups, where transparency of grammar is necessitated by demands of communication with relative strangers needing to consult on a wide range of topics (Ragir 2002). This communal exchange is automated and stabilized through activity-dependent fine-tuning of information-specific neural connections during postnatal growth and social development.

Suele considerarse a las teorías de la racionalidad, las teorías de la teoría y las teorías de la simulación mental como diversas estrategias de atribución mental, cada una de las cuales, desde una concepción tradicional, sería única y exhaustiva. En este trabajo examino algunas versiones de la teoría de la simulación mental y, particularmente, la perspectiva desde la cual estas describen la atribución mental. Finalmente, a partir de ciertas críticas, reformulo el sentido de la perspectiva de la primera persona que (...) estas teorías, según mi parecer, detentan. Intento mostrar que una teoría de la atribución mental basada únicamente en la perspectiva de la primera persona no podría abarcar todos los casos de atribución mental y no sería una estrategia exhaustiva, única e independiente, quedando un espacio abierto para acudir a otras estrategias interpretativas. --- “Some Reflections on Mental Simulation and the First-Person Perspective”. It is usual to consider the theories of rationality, the theories of theory and the theories of mental simulation as diverse strategies of mental attribution, each one of which, from a traditional conception, would be unique and exhaustive. In this paper I examine some versions of the mental simulation theory and particularly the perspective whence they describe mental attribution. Finally, from certain critiques, I reformulate the sense of the first-person perspective that these theories, in my view, sustain. I attempt to show that a mental attribution theory based solely in the first-person perspective could not include all mental attribution cases and would not be an exhaustive strategy, unique and independent, leaving an open space for other interpretative strategies. Cette étude est née de la remarque troublante d’un roman dans lequel un personnage relit Anna Karénine et se rend compte qu’il a tout oublié de sa première lecture : l’histoire, les émotions vécues alors, tout cela paraît n’avoir pas laissé de traces. Je me suis donc interrogée sur la nature de l’expérience esthétique et le type de souvenir qu’elle engendre. Une expé­rience peut-elle ne pas laisser de traces ? mais alors est-elle encore une expérience ? ou bien peut-on envisager (...) des traces qui ne soient pas des souvenirs disponibles, mobilisables à volonté ? et comment alors les conce­voir ? Il s’agissait donc de cerner à la fois le type d’expérience que forme l’expérience esthétique et le type de souvenirs qui s’y constituent. Partant de Husserl, l’analyse a permis de définir l’expérience esthétique comme expé­rience menée dans la neutralité, sur le mode du quasi ; ce faisant cela paraît accréditer la possibilité qu’il n’y ait pas de réels souvenirs mais seulement des quasi-souvenirs. Néanmoins parce que cette thèse reste paradoxale, j’ai cherché le moyen de concilier à la fois la neutralité existentielle de cette expérience dans l’appréhension de l’objet esthétique et la possibilité d’une affection réelle voire d’une transformation en profondeur du sujet. J’ai alors poursuivi l’examen en m’appuyant sur un texte de Roman Ingarden ( Vom Erkennen des literarischen Kunstwerks , § 24) et sur les leçons des synthèses passives de Husserl. L’enjeu de cette recherche engage donc la place et le rôle de l’expérience esthétique dans la constitution de la personnalité. (shrink)
