This paper aims to rethink the reason why nineteenth century common lawyers required a promise to be ‘accepted’. James Gordley expresses his opinion on this matter that they did it just in order to answer the annoying question of why and when a promise was binding. He might be right if he were dealing with the nineteenth century civil lawyers. But he cannot explain why common law of contract still employs the doctrine of consideration and refuses to replace the concept (...) of promise with the notion of offer, despite the doctrine of offer and acceptance. This paper reminds readers that the word promise is rather moral than legal. Thenineteenth century common lawyers wanted not to lose the moral force of this word, so they could not exchange a promise for an offer. What they actually did is not to require a promise to be ‘accepted’ but to require ‘a promise’ to be accepted. (shrink)

The microstructures of Ru-excess SrRuO 3 films, which were grown epitaxially on SrTiO 3 substrates by ion-beam sputtering, were studied by transmission electron microscopy. The excess Ru can be accommodated by forming extended defects on the {100} planes, faulted dislocation loops, by making RuO 2 double layers. However, the most stable crystalline phase of the excess Ru in SrRuO 3 film was metallic Ru with a hexagonal structure. The orientation relationship between the Ru precipitates, the SrTiO 3 substrate, and the (...) SrRuO 3 film can be described as follows: Ru // STO // SRO and [100] Ru //[110] STO //[110] SRO where the subscripts STO and SRO indicate SrTiO 3 and SrRuO 3 respectively. Owing to the difference between the crystal symmetries of Ru and SrTiO 3 , the precipitates showed different in-plane alignments along two perpendicular directions on the substrate and accordingly different anisotropic growth morphologies. The precipitates degrade the film surface by making deep trenches and act as sources for defect generation. (shrink)

With the growing amount of clinical research, regulations and research ethics are becoming more stringent. This trend introduces a need for quality assurance measures for ensuring adherence to research ethics and human research protection beyond Institutional Review Board approval. Audits, one of the most effective tools for assessing quality assurance, are measures used to evaluate Good Clinical Practice and protocol compliance in clinical research. However, they are laborious, time consuming, and require expertise. Therefore, we developed a simple auditing process and (...) evaluated its feasibility and effectiveness. The screening audit was developed using a routine audit checklist based on the Severance Hospital’s Human Research Protection Program policies and procedures. The measure includes 20 questions, and results are summarized in five categories of audit findings. We analyzed 462 studies that were reviewed by the Severance Hospital Human Research Protection Center between 2013 and 2017. We retrospectively analyzed research characteristics, reply rate, audit findings, associated factors and post-screening audit compliance, etc. Investigator reply rates gradually increased, except for the first year. The studies were graded as “critical,” “major,” “minor,” and “not a finding”, based on findings and number of deficiencies. The auditors’ decisions showed fair agreement with weighted kappa values of 0.316, 0.339, and 0.373. Low-risk level studies, single center studies, and non-phase clinical research showed more prevalent frequencies of being “major” or “critical”. Inappropriateness of documents, failure to obtain informed consent, inappropriateness of informed consent process, and failure to protect participants’ personal information were associated with higher audit grade. We were able to observe critical GCP violations in the routine internal audit results of post-screening audit compliance checks in “non-responding” and “critical” studies upon applying the screening audit. Our screening audit is a simple and effective way to assess overall GCP compliance by institutions and to ensure medical ethics. The tool also provides useful selection criteria for conducting routine audits. (shrink)

South Korean industrial conglomerates (chaebols) are discussed in the context of value-based management (VBM). Recent economics and finance literature on the diversion of corporate resources from the firm to the controlling shareholders (tunneling), for which chaebols are notoriously known, is discussed. Chaebols have engaged in empire building and expropriation of minority shareholders, distorting the process of efficient resource allocation in South Korea, and became the root cause of the 1997 financial crisis. We argue that the 1997 crisis should be viewed (...) as a consequence of chaebols’ systematic deviation from the guiding principles of VBM. We use tunneling within chaebols as an example of the need to directly address prohibition of the expropriation of minority shareholders as a primary postulate of VBM. We argue that VBM should require that the value generated by the firm not be expropriated from minorities, or any stakeholders, by dominant shareholders. We also examine moral and ethical considerations and present explanations as to why the unethical practice of tunneling has been tolerated by the South Korean public. We show that public opinion on tunneling is changing and that the treatment of minority shareholders by chaebols’ controlling families is becoming increasingly unacceptable to South Koreans. The purpose of this essay is to identify the characters of Ham's philosophy that have been formed through the historical process of the encounter between the Eastern and Western civilizations. Views of the academics on Ham have been divided in two; those who regard Ham as a philosopher characterizing oriental Korean cultural thought, and those who see him with the characteristics of Christianity and Western modern cultural thought. In this essay I will show that Ham formed an integrated thought which (...) interweaves the Eastern and Western cultures and minds through accepting the Western Christian modern mind but with theoriental identity of Korean culture. Also, I will clarify the characteristics of Korean modern history as a process of the encounter between the Eastern and Western civilizations. I then discuss the way the basic elements of the Eastern and Western cultural thoughts were accepted and integrated in Ham's thoughts, in line with Korean modern history. This essay also reveals that Logos in Western Greek philosophy, the Word in Christianity (“agape”, love), Tao in Eastern Asia, and Han (Great one) of the Han people (Koreans) were the core concepts and principles of Ham’s philosophy. His main statement, “Thinking people will survive” can be confirmed by the Logos; his core concepts “will” and “love” in the Word; his organic oneness of thought that unifies process and purpose, and the comparative and the absolute, in the Tao (Way); and his integrated philosophy that covers the Eastern and Western, the old and the new, the material and the spiritual,and the individual and the group, in Han. 이 연구는 서경덕 학파인 박순의 철학을 고찰하는데 목적을 둔다. 박순의 철학은 존재하는 사료가 부족하기 때문에 그 전체를 파악하기가 어렵다. 다만 『思菴集』과 『栗谷全書』에서 보이는 3번의 왕복서를 통해 그 윤곽을 파악할 수 있을 뿐이다. 그러나 이 왕복서 속에서 보이는 철학적 담론은 그의 학문적 세계가 독창적임을 짐작케 한다. 아쉽게도 독창적인 주장에 비해 왕복서에 보이는 전거들을 그 핵심만을 이야기하기 때문에 불친절 하다. 이 때문에 그의 스승인 서경덕의 철학적 세계를 요청한 후 그것에 미루어 박순의 주장을 살펴 볼 수밖에 없다. 이 과정에서 곡해나 견강부회 될 수 (...) 있는 여지 또한 존재한다. 하지만 박순의 철학을 일괄 한다는 것에도 이 연구는 충분한 가치를 지닌다고 할 수 있다. 이 연구는 서경덕의 철학을 전개한 후 3번의 왕복서에 나타난 박순과 이이의 주장에 분석 그 내용을 가진다. 특히 太極生兩儀의 개념에 기초하여 이들 사이에 나타난 첨예한 갈등과 논리 구조를 분석하고 있다. 이 과정에서 자연스럽게 박순의 철학적 세계관을 엿 볼 수 있게 된다. While organ transplantation has been established in the medical imagination since the 1960s, this technology is currently undergoing a popular re-imagination in the era of global capitalism. As transplantation procedures have become routine in medical centers in non-Western and developing nations and as organ sales and transplant tourism become increasingly common, organs that function as a material resource increasingly derive from subaltern bodies. This essay explores this development as represented in Korean filmmaker Park Chan-wook’s 2002 Sympathy for Mr. (...) This paper outlines a possible state of affairs in which human moral autonomy and a divine command ethical theory coexist. the theory of human moral autonomy agrees with the divine command theory that moral laws are created by an act of legislation. they disagree on who is the legitimate legislator. the paper argues that a rational agent faced with equally acceptable but incompatible solutions to moral problems or faced with disagreement among agents who insist on exercising their moral autonomy is (...) justified in accepting unconditionally the legitimacy of divine commands legislated by a just, merciful and loving god. This study described the relationships between academic class and student moral sensitivity and reasoning and between curriculum design components for ethics education and student moral sensitivity and reasoning. The data were collected from freshman (n = 506) and senior students (n = 440) in eight baccalaureate nursing programs in South Korea by survey; the survey consisted of the Korean Moral Sensitivity Questionnaire and the Korean Defining Issues Test. The results showed that moral sensitivity scores in patient-oriented care and conflict were (...) higher in senior students than in freshman students. Furthermore, more hours of ethics content were associated with higher principled thinking scores of senior students. Nursing education in South Korea may have an impact on developing student moral sensitivity. Planned ethics content in nursing curricula is necessary to improve moral sensitivity and moral reasoning of students. (shrink)

How does a company achieve long-term survival? This study starts with the question of why, among companies on the verge of bankruptcy, some survive and some break up. This study argues that the long-term survival of a company is determined by not only its economic performance but also its social performance. It clarifies that sustainable corporate social responsibility practices facilitate long-term survival. Thus, this study analyzed 259 CSR actions performed by eight representative long-lived companies in Korea and how the various (...) CSR actions helped these companies overcome crises and survive. The common CSR actions practiced by all the long-lived companies had a positive influence on forming social capital with primary stakeholders and securing legitimacy from secondary stakeholders, which in turn had a significant influence on maintaining survival. This study provides significant implications for the value of CSR practices that have been controversial, by presenting a model of how CSR actions facilitate corporate longevity. (shrink)

The ethical question is whether university mask mandates should be relaxed. I argue that the use of face masks by healthy individuals has uncertain benefits, which potential harms may outweigh, and should therefore be voluntary. Systematic reviews by the World Health Organization (WHO) and Cochrane Acute Respiratory Infections concluded that the use of face masks by healthy individuals in the community lacks effectiveness in reducing viral transmission based on moderate-quality evidence. The only two randomized controlled trials of face masks published (...) during the pandemic found little to no benefit. Without high-quality evidence, it is difficult to justify a requirement rather than a recommendation. Notwithstanding, one might argue that the precautionary principle justifies mask mandates. If the precautionary principle can justify implementing mask mandates due to the risk of forgoing possible benefit, then it might also be able to justify not implementing mask mandates due to the risk of potential harm caused by the intervention. It is commonly thought that there is little to lose from the use of face masks, but this is not necessarily true. It is possible that masks have done more harm than good. (shrink)

This project investigates salient stakeholder forces of socially responsible supply chain orientation (SRSCO) in the apparel and footwear sector focusing on fair labor management issues. SRSCO was conceptualized as a composite of internal organizational direction and external partnership for a creation and continuation of fair labor conditions throughout the supply chain. Primary stakeholders identified were consumers, regulation, industry, and media. A total of 209 mail survey responses from sourcing managers of U.S. apparel and footwear companies were analyzed. Two dimensions of (...) SRSCO were confirmed: internal direction and external partnership. Consumer and industry peer pressures were found significantly related to internal direction, while industry peers and media were significantly related to the external partnership. Regulation was not significantly related to either internal direction or external partnerships. Lack of regulation forces to govern labor issues and roles of consumers, industry peers, and media in promoting fair labor management are discussed in this article. (shrink)

The authors consider a range of relationship and family structures that depart from this ideal: polyamory and polygamy, single and polyparenting, parenting by gay and lesbian couples, as well as families created through current and prospective modes of assisted human reproduction such as surrogate motherhood, donor insemination, and reproductive cloning. From uttering a prayer before boarding a plane, to exploring past lives through hypnosis, has superstition become pervasive in contemporary culture? Robert Park, the best-selling author of Voodoo Science, argues that it has. In Superstition, Park asks why people persist in superstitious convictions long after science has shown them to be ill-founded. He takes on supernatural beliefs from religion and the afterlife to New Age spiritualism and faith-based medical claims. He examines recent controversies and concludes that science is (...) the only way we have of understanding the world. Park sides with the forces of reason in a world of continuing and, he fears, increasing superstition. Chapter by chapter, he explains how people too easily mistake pseudoscience for science. He discusses parapsychology, homeopathy, and acupuncture; he questions the existence of souls, the foundations of intelligent design, and the power of prayer; he asks for evidence of reincarnation and astral projections; and he challenges the idea of heaven. Throughout, he demonstrates how people's blind faith, and their confidence in suspect phenomena and remedies, are manipulated for political ends. Park shows that science prevails when people stop fooling themselves. Compelling and precise, Superstition takes no hostages in its quest to provoke. The Fourth Industrial Revolution has become a global buzz word since the World Economic Forum adopted it as an annual issue in 2016. It is represented by hyper automation and hyper connectivity based on artificial intelligence, big data, robotics, and Internet of things. AI, big data, and robotics can contribute to developing hyper automation that can increase productivity and intensify industrial production. Particularly, robots using AI can make decision by themselves as human being on complicated processes. Along with the hyper (...) automation, the hyper connectivity increases not only at national, but also global level by using information and communication technologies. IoT is the core technology to create the hyper connectivity in Cyber Physical System that connects technology, nature, and human being. Accordingly, a perfect convergence between ICT and manufacturing can be completed in the Fourth Industrial Revolution era and an extremely efficient flexible production system by spreading IoT in CPS will be established. Under such a condition, innovative clusters must play their traditional roles in cradles of technology innovation and commercialization. It must be difficult challenges for innovative clusters to meet their targets and to be adjusted by the changing new environment at the same time. This paper argues how the Fourth Industrial Revolution can change the global production chain and how core technologies function in industries. Furthermore, it focuses on how innovative clusters have to evolve to respond the Fourth Industrial Revolution. Last, but not least it also analyzes whether or not innovative clusters can play their roles as technology innovation hubs in the real world and CPS in the Fourth Industrial Revolution era. (shrink)

I criticize the following three arguments for moral objectivism. 1. Since we assess moral statements, we can arrive at some moral truths (Thomson, 2006). 2. One culture can be closer to truths than another in moral matters because the former can be closer to truths than the latter in scientific matters (Pojman, 2008). 3. A moral judgment is shown to be true when it is backed up by reason (Rachels and Rachels, 2010). This study investigated the perceptions and attitudes of ICU nurses towards the ‘do not resuscitate’ (DNR) decision and changes in their nursing activities after implementation of the DNR decision in South Korea. A data survey was conducted in South Korea between August and October 2008, with a convenience sample of 252 ICU nurses who had more than one year of clinical experience. The data were collected via a self-administered questionnaire. Most of the nurses perceived the necessity of the DNR decision (...) in cases where there would be no chance of patient recovery despite massive efforts. Very few of the nurses' activities changed, either passively or actively, after implementation of the DNR decision. Moreover, the findings of this research provide suggestions for the future direction of the DNR decision and ethical nursing guidelines in South Korea. Further investigations are needed for the development of decision-making skills and intervention guidelines for end-of-life nursing. (shrink)
