This article draws on ethnographic data from a field leading university licensing office to document and explain a key step in the process of institutionalization, the abstraction of standardized rules and procedures from idiosyncratic efforts to collectively resolve pressing problems. I present and analyze cases where solutions to complicated quandaries become abstract bits of professional knowledge and demonstrate that in some circumstances institutionalized practices can contribute to the flexibility of expert reasoning and decision-making. In this setting, expertise is rationalized in (...) response to institutional tensions between academic and business approaches to deal making and professional tensions between relational and legal approaches to negotiation. Abstraction and formalization contribute both to the convergence and stability of routines and to their improvisational use in professional work. Close attention to these processes in a strategic research setting sheds new light on an interesting tension in sociological theories of the professions while contributing to the development of a micro-level, social constructivist institutional theory. Background There is broad international agreement from clinicians and academics that healthcare rationing should be undertaken as explicitly as possible, and the BMA have publicly supported the call for more accountable priority setting for some time. However, studies in the UK and elsewhere suggest that clinicians experience a number of barriers to rationing openly, and the information needs of patients at the point of provision are largely unknown. Methodology In-depth interviews were undertaken with NHS professionals working at the community level (...) of provision, and with patients and professionals receiving or providing treatment for morbid obesity and breast cancer (n=52). Results Nearly all patients wanted to know about healthcare rationing and had high expectations of their clinical professionals to provide all relevant information about treatment options. However, professionals did not always understand these information requirements, and cases of implicit rationing were common. The existence of relevant national guidance was not always known about, meaning that patients were often reliant on other sources of information about treatment options, which included the popular media, the internet, patient advocacy groups and informal networks of support. Discussion Clinical professionals need to understand patients' need for detailed information when it comes to rationing, and to understand that they are the main gateway for this to be provided. However, disclosure could be distressing for both patients and professionals, and thus the most sensitive and acceptable ways to make this information available requires further investigation. American universities are purported to excel at technology transfer. This assumption, however, masks important features of American innovation. Attempts to emulate the US example must recognize the heterogeneity of its industries and institutions of higher education. Stanford University and the biomedical cluster in Boston, Massachusetts, illustrate the diversities that characterize this dynamic system.

The proposal to create a chamber selected by sortition would extend this democratic procedure into the legislative branch of government. However, there are good reasons to believe that, as currently conceived by John Gastil and Erik Olin Wright, the proposal will fail to realize sufficiently two fundamental democratic goods, namely, political equality and deliberative reasoning. It is argued through analysis of its historic and contemporary application that sortition must be combined with other institutional devices, in particular, rotation of membership and (...) limited mandate, in order to be democratically effective and to realize political equality and deliberative reasoning. An alternative proposal for a responsive sortition legislature is presented as more realistic and utopian: one that increases substantially the number of members, makes more extensive use of internal sortition and rotation, and recognizes the importance of establishing limited mandates. The COVID-19 pandemic revealed numerous weaknesses in pandemic preparedness and response, including underfunding, inadequate surveillance, and inequitable distribution of countermeasures. To overcome these weaknesses for future pandemics, WHO released a zero draft of a pandemic treaty in February, 2023, and subsequently a revised bureau's text in May, 2023. COVID-19 made clear that pandemic prevention, preparedness, and response reflect choices and value judgements. These decisions are therefore not a purely scientific or technical exercise, but are fundamentally grounded in ethics. The latest (...) treaty draft reflects these ethical considerations by including a section entitled Guiding Principles and Approaches. Most of these principles are ethical—they establish core values that undergird the treaty. Unfortunately, the treaty draft's set of principles are numerous, overlapping, and show inadequate coherence and consistency. We propose two improvements to this section of the draft pandemic treaty. First, key guiding ethical principles should be clearer and more precise than they currently are. Second, the link between ethical principles and policy implementation should be clearly established and define boundaries on acceptable interpretation, ensuring that signatories abide by these principles. This commentary examines the role of sustainability in the latest draft of the WHO pandemic accord, highlighting its notable absence from the official list of guiding principles despite being mentioned frequently throughout the text. It argues that sustainability should be explicitly acknowledged as a core principle and given a clear definition tailored to pandemic preparedness, and proposes defining sustainability as ensuring that immediate emergency responses don't compromise future pandemic preparedness and response capabilities. Including sustainability as a guiding principle would serve (...) two key purposes: validating the relevance of ethical principles in the accord's provisions and emphasizing the importance of long-term planning in pandemic preparedness. The commentary notes that while humans naturally discount future consequences, sustainable pandemic planning requires considering impacts beyond the next pandemic. It recommends coupling any reforms, such as intellectual property changes, with alternative innovation incentives to maintain a balanced approach to pandemic preparedness and response. (shrink)

The Philosophy Outreach Project gets high school students across Indiana thinking. POP creates alternative spaces for learning in classrooms, clubs, online, and conference settings. By curating philosophical content and fostering philosophical discussion, POP provides high school students with tools and a platform to engage with each other and the world. POP is run by three teams of Ball State students with a variety of different interests and backgrounds. POP's team includes students studying philosophy, psychology, English, communications, criminal justice, and more. (...) The ArgumentThis paper makes use of the 1860 clash between T. H. Huxley and Richard Owen to examine the role of social context in scientific advance in the biological sciences. It shows how the social context of nineteenth-century England first favored the Coleridge-Owenite interpretation of the biological world and then, at mid-century and subsequently, allowed the Darwin-Huxley interpretation to win through. It emphasizes the complexity of the clash. Professional, personal, and generational agendas as well as scientific theory and fundamental (...) philosophical intuition were at stake. The history, ultimately, provides a useful instance of Schutz ‘s and Scheler ‘s concept of societal factors controlling and selecting between flows of idealfactoren. Although Huxley is conventionally regarded as the victor I conclude by suggesting that the issue is not yet closed and that profound philosophical issues remain unresolved. (shrink)

The concept of desert, which once enjoyed a central place in political and ethical theory, has been relegated to the margins of much of contemporary theory, if not excluded altogether. Recently a renewed interest in the topic has emerged, and several philosophers have argued that the notion merits a more central place in political and ethical theory. Some of these philosophers contend that justice exists to the extent that people receive exactly what they deserve, while others argue that desert should (...) replace such considerations as rights, need, and equality as the basis for distributions. Still others argue that morality involves a fitting match between one's moral character and a degree of happiness. All of these positions have encountered opposition from egalitarians, libertarians, and those who are skeptical about the coherence of the concept of desert. The first anthology of its kind, What Do We Deserve? is a balanced collection of readings that brings sharply opposing positions and arguments together and stimulates debate over the meaning and significance of desert in current thought. The book begins with eight classical readings on desert (by Plato, Aristotle, Hobbes, Smith, Kant, Mill, Sidgwick, and Ross), and later turns to contemporary interpretations of the issue. The selections examine the concept itself, analyze its relationship to the ideas of freedom and responsibility, engage in the debate between John Rawls and his critics on the merits of desert, and, finally, study the wider role and significance of desert in political and ethical theory. Coleridge has been seen by some not so much as a poet spoiled by philosophy, but as a philosopher who was also a poet. It could be argued that his major endeavor was an attempt to save the life sciences form the mechanistic interpretation which he saw as the outcome of Lockean "mechanico-corpuscularian" philosophy. This contribution describes that endeavour. It shows its connection to the social circumstances of the time. It discussess its relationship to the poetic sensibility of the "Lake (...) poets" and to the German thought which Coleridge absorbed during and after his sojourn in Gottingen in 1798-99. It describes the nature of his "Theory of Life" as seen not only from the posthumous publication itself, but also from the numerous hints and struggles recorded in his voluminous notebooks, letters and lecture notes. It is concluded that, although never adequately assembled, it forms the only serious attempt to construct a profound alternative to the ultimately mechanistic biology of Charles Darwin and the physiologists of the second half of the century. As such it strongly influenced the young Richard Owen and, as is well known, was eventually overwhelmed by the Darwin-Huxley synthesis of the 1860s. Nevertheless, insofar as Coleridge's concept of life ultimately derived from his ambition to find a way of healing the Cartesian divide, we may wonder whether the recent upsurge in consciousness studies may cause us to look again at his panentheistic ideas and, discarding the obsolete and fanciful metaphysics, recast them into a more acceptable form. This volume of eleven related essays investigates questions about the relationship of narrative and consciousness from several disciplinary points of view, among them psychology, neuroscience, philosophy, and literary studies. Showing the strengths of such interdisciplinarity is the editors’ goal, which is, they write, ‘to challenge the conventional wisdom by presenting information that cuts across conceptual levels and disciplines’ . The book may be said to embody the wide-ranging interests of one of the editors, Owen Flanagan, who at Duke University (...) holds appointments in philosophy, experimental psychology, neurobiology, and literature. The editors as a group seek in the book to reconceptualize relations between disciplines, elegantly developing a contrast between the metaphor of the archipelago, suggesting both separation and connection, and islands, emphasizing mutual isolation. Reading the book demonstrates their wisdom in adopting this metaphor, since the essays’ arrangement allows one to move easily from one set of disciplinary assumptions to another. (shrink)

In his 1961 paper "Tithenai ta Phainomena",1 G. E. L. Owen addressed the problem of the relationship between science as preached in the Analytics and the practice of the Aristotelian treatises. However, he gave this venerable crux a novel twist by focusing on a different aspect of the issue. According to the Prior Analytics , it appears that the first premises of scientific demonstrations must be obtained from collections (historiai) of facts derived from empirical observation. However, many of the (...) treatises seem to make little use of empirical inquiry and instead concern themselves more with 'conceptual analysis.' This is especially true in the Metaphysics and the ethical treatises, but it is also very much characteristic of the Physics. How are these two kinds of inquiry related? (shrink)

Our topic suggests the existence of some uncertainty about the viability of natural theology, but it also invites a reassessment of the enterprise. The variety of current thinking in this area makes it difficult to find a single paradigm for structuring the discussion. The voices of such philosophers as Hartshorne, Kenny, Swinburne, Plantinga, Alston, and Joseph Owens, to mention but a few, do not form a chorus, even if they obviously share some of the same themes. The best procedure is (...) to set out from the traditional view about the aims and approaches of natural theology in an effort to determine whether this program can still be followed or whether some of its attendant problems may be cause for modifying it. This paper introduces a new hypothesis for the rise of the politically correct left via an analysis of Black America. Drawing on Žižekian and psychoanalytical theory, it explores the ideological role of ‘symptom’ within America’s cultural landscape - of that which states that society ‘doesn’t work’ - by way of examining prominent African American figures and how they relate to this ‘symptom’: Will Smith and the ‘hystericization of the symptom’; Barack Obama and the ‘identification with the symptom’; the PC (...) left and the ‘implementation of the symptom as law’; the far right and the ‘fear of loss of the symptom’; Kanye West, Candace Owens and the ‘rejection of clinging to the symptom’. Additionally, the 90s sit-com The Fresh Prince of Bel-Air and the film Black Panther are analyzed and juxtaposed in order to further illustrate the process by which the recent ideological shift in our cultural and political discourse towards political correctness and identity politics has occurred. Leibniz's principle of sufficient reason (PSR) is the claim that everything has a sufficient reason. But is Leibniz committed to the necessity or to the contingency of his great principle? I argue that Leibniz is committed to its contingency, given that he allows for the absolute possibility of entities that he claims violate the PSR. These are all cases of qualitatively indiscernible entities, such as indiscernible atoms, vacua, and bodies. However, Leibniz's commitment to the contingency of the PSR seems to (...) stand in tension with his inference of the PSR from his theory of truth. I argue that this apparent tension can be resolved satisfactorily. When it comes to his modal views on the PSR, Leibniz's position is entirely consistent. (shrink)

How social media and DIY communities have enabled new forms of political participation that emphasize doing and making rather than passive consumption. Today, DIY—do-it-yourself—describes more than self-taught carpentry. Social media enables DIY citizens to organize and protest in new ways and to repurpose corporate content in order to offer political counternarratives. This book examines the usefulness and limits of DIY citizenship, exploring the diverse forms of political participation and “critical making” that have emerged in recent years. The authors and artists (...) in this collection describe DIY citizens whose activities range from activist fan blogging and video production to knitting and the creation of community gardens. Contributors examine DIY activism, describing new modes of civic engagement that include Harry Potter fan activism and the activities of the Yes Men. They consider DIY making in learning, culture, hacking, and the arts, including do-it-yourself media production and collaborative documentary making. They discuss DIY and design and how citizens can unlock the black box of technological infrastructures to engage and innovate open and participatory critical making. And they explore DIY and media, describing activists' efforts to remake and reimagine media and the public sphere. Views of the self may be plotted on a set of coordinates. On the axis that runs from fragmentation to unity, Rorty and Rorty's Freud champion the decentered self while Wallwork, Taylor, and Ricoeur argue for a sovereign, unified self. On the other axis, which runs from the disengaged, inward-turning self to the engaged and "sedimented" self, Wallwork, would be positioned near Rorty, defending self-creation against the narrative identity affirmed by Taylor and Ricoeur. Despite his skepticism concerning the communitarian agenda (...) of the narrativists, Flanagan grants that the self is social and relational--a position further explored by Oliver, Stendahl, Deutsch, and Mack in "Selves, People, and Persons". We investigate uncertain reasoning with quantified sentences of the predicate calculus treated as the limiting case of maximum entropy inference applied to finite domains.

This essay develops, within the terms of the recent New York Declaration, an account of the shared responsibility of states to refugees and of how the character of that responsibility effects the ways in which it can be fairly shared. However, it also moves beyond the question of the general obligations that states owe to refugees to consider ways in which refugee choices and refugee voice can be given appropriate standing with the global governance of refuge. It offers an argument (...) for the normative significance of refugee’s reasons for choosing states of asylum and linked this to consideration of a refugee matching system and to refugee quota trading conceived as responsibility-trading, before turning to the issue of the inclusion of refugee voice in relation to the justification of the norms of refugee governance and in relation to the institutions and practices of refugee governance through which those norms are given practical expression. This article proposes an explanation of the way information about time is conveyed in Navajo.1 We assume that all sentences have a temporal interpretation, direct or indirect. We have two main purposes in this article. The first is to discuss temporal interpretation in this Athabaskan language. The Navajo temporal system, which is varied, has not yet been described in detail. Further, the language allows sentences without explicit temporal information. In such sentences temporal interpretation is indirect - arrived at by inference. (...) We outline the principles underlying the default inferences. Our second purpose is to show that a few general principles of temporal interpretation, which hold for some other languages, apply very nicely to Navajo. The principles include semantic rules for 1 interpreting explicit expressions about time, and pragmatic principles for inferring temporal location indirectly. The applicability of these principles to Navajo is a satisfying though unsurprising result; but it is worth working out explicitly. The temporal system of Navajo offers a future verb inflection, temporal particles, and temporal adverbs. Although a well-formed sentence need not have any of these forms, speakers consistently agree on temporal interpretation. To account for these facts, we must consider sentences with and without direct temporal information. In this article we propose semantic and pragmatic principles that account for both types of cases. The temporal interpretation of all sentences is deictically based. For sentences without direct temporal forms, aspectual information allows the inference of temporal location. We propose three general pragmatic principles to account for this, which we call temporal interpretation: the Deictic Principle, the Bounded Event Constraint, and a Simplicity Principle. The key factor in temporal inference is boundedness, direct or inferred. To arrive at the inference of boundedness we use the Temporal Schema Principle, a special case of the simplicity principle.. Studies have shown that some covertly conscious brain-injured patients, who are behaviorally unresponsive, can reply to simple questions via neuronal responses. Given the possibility of such neuronal responses, Andrew Peterson et al. have argued that there is warrant for some covertly conscious patients being included in low-stakes medical decisions using neuronal responses, which could protect and enhance their autonomy. The justification for giving credence to alleged neuronal responses must be analyzed from various perspectives, including neurology, bioethics, law, and as we (...) suggest, philosophy of mind. In this article, we analyze the warrant for giving credence to neuronal responses from two different views in philosophy of mind. We consider how nonreductive physicalism’s causal exclusion problem elicits doubt about interpreting neural activity as indicating a conscious response. By contrast, such an interpretation is supported by the mind-body powers model of neural correlates of consciousness inspired by hylomorphism. (shrink)

Democracy means rule by the people, but in practice even the most robust democracies delegate most rule making to a political class The gap between the public and its representatives might seem unbridgeable in the modern world, but Legislature by Lot examines an inspiring solution: a legislature chosen through “sortition”—the random selection of lay citizens. It’s a concept that has come to the attention of democratic reformers across the globe. Proposals for such bodies are being debated in Australia, Belgium, Iceland, (...) the United Kingdom, and many other countries. Sortition promises to reduce corruption and create a truly representative legislature in one fell swoop. In Legislature by Lot, John Gastil and Erik Olin Wright make the case for pairing a sortition body with an elected chamber within a bicameral legislature. Gastil is a leading deliberative democracy scholar, and Wright a distinguished sociologist and editor of the Real Utopias series, of which this is a part. In this volume, they bring together critics and advocates of sortition who have studied ancient Athens, deliberative polling, political theory, social movements, and civic innovation. Without obscuring its limitations, the contributors offer a wide variety of ideas for how to implement sortition and examine its potential for reshaping modern politics. Legislature by Lot includes sixteen essays that respond to Gastil and Wright’s detailed proposal. Essays comparing sortition to contemporary reforms see it as a dramatic extension of deliberative “minipublics,” which gather random samples of citizens to weigh public policy dilemmas without being empowered to enact legislation. This article addresses two central topics in normative debates on transnational citizenship: the inclusion of resident non-citizens and of non-resident citizens within the demos. Through a critical review of the social membership (Carens, Rubio-Marin) and stakeholder (Baubock) principles, it identifies two problems within these debates. The first is the antinomy of incorporation, namely, the point that there are compelling arguments both for the mandatory naturalization of permanent residents and for making naturalization a voluntary process. The second is the arbitrary demos (...) problem and concerns who determines whether expatriate voting rights are granted (and on what terms). The argument developed provides a way of dissolving the first problem (and defending the proposed solution against possible objections) and resolving the second problem. In doing so it provides a defensible normative basis for the political theory of transnational citizenship. (shrink)
