This article aims to open a discussion on better ethical assurance for non-university research actors drawing on democratic norms. It derives from the author’s experience of a gap in ethical assurance for social science and humanities (SSH) research that takes place outside academia, for example within international organisations, public bodies, non-governmental organisations (NGOs) and by private entities. Many of these actors commission, conduct or sub-contract research activities involving human participants on a regular basis, an activity that often increases during times (...) of crisis where researchers in both the public and private sphere scramble to generate the new knowledge necessary to respond and prevent further harms. The ethical assurance frameworks for such research, while growing, remain limited. Discussion of research conducted by actors outside of university settings and their ethical assurance frameworks are both subjects under-interrogated within the literature. This paper seeks to open that discussion by presenting this broad non-university research context through the frame of research in crisis settings, where the ethical requirements of ‘do no harm’ and the ‘dual imperative’ possess an even heavier significance in research ethics. Furthermore, the global and diverse nature of crisis settings often gives rise to conversations concerning the positioning of the research actor and the need to empower the research participant. This paper presents an early vision of the non-university research actor and ethical assurance process based on the democratic norms of equality and inclusivity. (shrink)

Philosophers contributing new ideas are commonly caught within a received philosophical vocabulary and will often coin new, technical terms. Husserl understood himself as advancing a new theory of intentionality, and he fashioned the new vocabulary of `noesis' and `noema'. But Husserl's own statements regarding the noema are ambiguous. Hence, it is no surprise that controversy has ensued. The articles in this book elucidate and clarify the notion of the noema; the book includes articles which phenomenologically describe and analyze the noemata (...) of various experiences as well as articles which undertake the `metaphenomenological' explication of the doctrine of the noema. These two enterprises cannot be isolated from one another. Any analysis of the noema of a particular type of experience will necessarily illustrate, at least by instantiating the general notion of noema. And any metaphenomenological account of the noema itself will guide particular researches into the noemata of particular experiences. (shrink)

The rift which has long divided the philosophical world into opposed schools-the "Continental" school owing its origins to the phenomenology of Husserl and the "analytic" school derived from Frege-is finally closing.

ABSTRACTOn 28 October 2012, Savita Halappanavar, an Indian woman living in Ireland, died in hospital while under medical care for a miscarrying pregnancy. According to her husband, her repeated requests for an abortion were ignored because of the presence of a foetal heartbeat. Ms Halappanavar’s death was a critical event in the process leading to a referendum on 25 May 2018, when the Irish electorate voted to repeal the Eighth Amendment of the Constitution, removing the constitutional ban on abortion. The (...) name Savita has become indelibly linked to the changing course of abortion politics, so it is timely to reassess the role of the media in shaping the parameters of the debate about the impact of her death on the issue. This study presents a frame analysis of Irish newspapers in the weeks following her death, mapping the political, medical, legal and socio-ethical discourses, as well as the related contemporaneous events that set the agenda for the type of debate that was to follow. It identifies four media frames: Public Tragedy, Political Opportunity, Abortion Legacy and Maternal Health. Our central argument is that the overall effect of media framing provided much face-saving for politicians in the way that the legislative issue was viewed through a conservative party-political lens, despite public outrage. The power exercised by technology companies is attracting the attention of policymakers, regulatory bodies and the general public. This power can be categorized in several ways, ranging from the “soft power” of technology companies to influence public policy agendas to the “market power” they may wield to exclude equally efficient competitors from the marketplace. This Article is concerned with the “data power” exercised by technology companies occupying strategic positions in the digital ecosystem. This data power is a multifaceted power that (...) may overlap with economic (market) power but primarily entails the power to profile and the power to influence opinion formation. While the current legal framework for data protection and privacy in the EU imposes constraints on personal data processing by technology companies, it ostensibly does so without regard to whether or not they have “data power.” This Article probes this assumption. It argues that although this legal framework does not explicitly impose additional legal responsibilities on entities with “data power,” it provides a clear normative indication to do so. The volume and variety of data and the reach of data-processing operations seem to be relevant when assessing both the extent of obligations on technology companies and the impact of data processing on individual rights. The Article suggests that this finding provides the normative foundation for the imposition of a “special responsibility” on such firms, analogous to the “special responsibility” imposed by competition law on dominant companies with market power. What such a “special responsibility” might entail in practice will be briefly outlined and relevant questions for future research will be identified. (shrink)

This paper both welcomes and explores the recent article in Nursing Philosophy by Dave Holmes and Denize Gastaldo. Holmes and Gastaldo's paper introduced us to Deleuze and Guattari's philosophical concepts of ‘arborescent thought’ and ‘rhizomatic thought’, respectively. These concepts were used to illuminate and critique certain aspects of contemporary nursing theory and educational practice. Arborescent thought is held to stifle and constrain the development of the discipline of nursing, while rhizomatic thought is presented as a more fitting way forward across (...) a diversity of knowledges and methods of inquiry. We are thus urged to engage in a metamorphosis from an arborescent way of thinking to a rhizomatic one. The paper below, while applauding the introduction of these concepts into nursing thought, raises some questions as to their proposed utility and relationship as given in the paper by Holmes and Gastaldo. This is done in a spirit of collaboration, motivated by a desire to further explore the philosophy of Gilles Deleuze (and Felix Guattari). (shrink)

The terms “empathy” and “sympathy” are often used interchangeably, and the terms “sympathy” and “compassion” are also often used interchangeably. In other words, empathy sympathy, and compassion seem to be one thing. I shall argue, to the contrary, that there are important differences between three. I shall distinguish empathy from sympathy and compassion on the ground that empathy is not an afective experience; I shall show how empathy underlies sympathy and compassion; and I shall clarify the nature of the three (...) kinds of experience. This book sets out some of the latest scientific findings around the evolutionary development of religion and faith and then explores their theological implications. This unique combination of perspectives raises fascinating questions about the characteristics that are considered integral for a flourishing social and religious life and allows us to start to ask where in the evolutionary record they first show up in a distinctly human manner. The book builds a case for connecting theology and evolutionary anthropology using both historical (...) and contemporary sources of knowledge to try and understand the origins of wisdom, humility, and grace in 'deep time'. In the section on wisdom, the book examines the origins of complex decision-making in humans through the archaeological record, recent discoveries in evolutionary anthropology, and the philosophical richness of semiotics. The book then moves to an exploration of the origin of characteristics integral to the social life of small-scale communities, which then points in an indirect way to the disposition of humility. Finally, it investigates the theological dimensions of grace and considers how artefacts left behind in the material record by our human ancestors, and the perspective they reflect, might inform contemporary concepts of grace. This is a cutting-edge volume that refuses to commit the errors of either too easy a synthesis or too facile a separation between science and religion. As such, it will be of interest to scholars of religious studies and theology - especially those who interact with scientific fields - as well as academics working in anthropology of religion. There are two driving questions informing this book. The first is where does our moral life come from? It presupposes that considering morality broadly is inadequate. Instead, different aspects need to be teased apart. It is not sufficient to assume that different virtues are bolted onto a vicious animality, red in tooth and claw. Nature and culture have interlaced histories. By weaving in evolutionary theories and debates on the evolution of compassion, justice and wisdom, it showa a richer account of (...) who we are as moral agents. The second driving question concerns our relationships with animals. Deane-Drummond argues for a complex community-based multispecies approach. Hence, rather than extending rights, a more radical approach is a holistic multispecies framework for moral action. This need not weaken individual responsibility. She intends not to develop a manual of practice, but rather to build towards an alternative philosophically informed approach to theological ethics, including animal ethics. The theological thread weaving through this account is wisdom. Wisdom has many different levels, and in the broadest sense is connected with the flow of life understood in its interconnectedness and sociality. It is profoundly theological and practical. In naming the project the evolution of wisdom Deane-Drummond makes a statement about where wisdom may have come from and its future orientation. But justice, compassion and conscience are not far behind, especially in so far as they are relevant to both individual decision-making and0institutions. (shrink)

Can we have objective knowledge of the world? Can we understand what is morally right or wrong? Yes, to some extent. This is the answer given by Adam Smith and Edmund Husserl. Both rejected David Hume’s skeptical account of what we can hope to understand. But they held his empirical method in high regard, inquiring into the way we perceive and emotionally experience the world, into the nature and function of human empathy and sympathy and the role of the imagination (...) in processes of intersubjective understanding. The challenge is to overcome the natural constraints of perceptual and emotional experience and reach an agreement that is informed by the facts in the world and the nature of morality. This collection of philosophical essays addresses an audience of Smith- and Husserl scholars as well as everybody interested in theories of objective knowledge and proper morality which are informed by the way we perceive and think and communicate. The Lowell Institute in Boston, Massachusetts, founded in 1836, supports an annual series of distinguished lectures. Henry Drummond, the influential Scottish scientist, Free Church minister, explorer and evangelist published his Lowell Lectures as The Ascent of Man in 1894. This provocative book examines Darwinism in a Christian context. It describes the rise of man, who is considered the highest purpose of the universe, and his relations with the lower animals. In particular, it addresses the question of altruism and its (...) role in promoting the survival of the fittest, which Drummond argues had been overlooked. Drummond claims, unlike traditional evolutionary theory, that the force of evolution is not only the struggle for life, but also the struggle for the life of others. His book, which aroused great interest in its time, remains of importance for historians and philosophers of science today. (shrink)

EDMUND HUSSERL in his early writings on space distinguishes three kinds of problems surrounding the presentation of space: psychological, logical, and metaphysical. By the term "psychology" Husserl means a descriptive and genetic psychology which seeks to characterize the contents and structure of particular experiences and to investigate the genetic relations between different experiences. Included among the genetic questions concerning space is the problem of the origin of the science of space.

This paper distinguishes between two senses of the term “ phenomenology ”: a narrow sense and a broader sense. It claims, with particular reference to the moral sphere, that the narrow meaning of moral phenomenology cannot stand alone, that is, that moral phenomenology in the narrow sense entails moral intentionality. The paper proceeds by examining different examples of the axiological and volitional experiences of both virtuous and dutiful agents, and it notes the correlation between the phenomenal and intentional differences belonging (...) to these experiences. The paper concludes with some reflections on how the focus on the broader sense of “ phenomenology ” serves to provide a more precise sense of what we might mean by “ moral phenomenology.”. (shrink)

Raimond Gaita's example of saintly love, in which the visit of a nun to psychiatric patients has profound effects on him, has been criticised for being an odd and unconvincing example of saintliness. I defend Gaita against four specific criticisms; firstly, that the nun achieves nothing spectacular, but merely adopts a certain attitude towards people; secondly, that Gaita must already have certain beliefs for the example to work; thirdly, that to be acclaimed a saint requires a saintly biography, not just (...) an incidence of good behaviour; and finally, that there is something oppressive about saintly behaviour. I consider that Gaita does indeed leave himself open to criticism on this last point by claiming that saints love impartially. I argue that his description of the example suggests rather that the customs and practices of partial love are at the heart of saintliness and not some form of 'life-denying' impartiality. If I am right, then this has the twofold effect of making saintliness appear achievable by ordinary mortals and explaining our feelings of wonder in the face of such saintly behaviour. (shrink)

This paper explores two perspectives in Husserl's recently published writings on ethics and axiology in order to sketch anew a phenomenological account of practical reason. The paper aims a) to show that a phenomenological account of moral intentionality i) transcends the disputes between intellectualist-emotivist and intellectualist-voluntarist disputes and ii) points toward a position in which practical reason has an emotive content or, conversely, the emotions have a cognitive content, and the paper aims b) to show that a phenomenological ethics identifies (...) universal human goods that are, nevertheless, specified differently in varying cultural contexts. The applicability of Nagel's concept of theory reduction, and related concepts of reduction, to the reduction of genetics to molecular biology is examined using the lactose operon in Escherichia coli as an example. Geneticists have produced the complete nucleotide sequence of two of the genes which compose this operon. If any example of reduction in genetics should fit Nagel's analysis, the lactose operon should. Nevertheless, Nagel's formal conditions of theory reduction are inapplicable in this case. Instead, it is argued that (...) genetics has been partially reduced to molecular biology in the sense of token-token reduction. (shrink)

When a young boy playing in a wooded area, I tripped over exposed roots extending from the trunk of a tree. I threw my arms out in front of me to break my fall and disturbed a nest of bees. As I lay on the ground, I was repeatedly stung by bees until I could regain my feet and run away. Frightened and in a great deal of pain - that is what I remember most vividly - I walked home. (...) My mother took me to the doctor, who undoubtedly gave me some sort of treatment and medication, but this has been lost to memory. The part of the visit to the doctor's office that I remember is his removing any stingers remaining in me; this too I remember for its pain. The doctor counted more than seventy stings. Although the exact number escapes memory, I believe it was seventy-one. In brief, the descriptive details of the day's experiences elude memory, but the affective dimension - the pain and fear - does not. (shrink)

Drawing on an analysis of complaint files that we conducted for the Irish Medical Council, this paper offers three possible explanations for the gap between the ubiquity of official commitments to taking patients’ complaints seriously and medical professional regulators’ dismissal—as not warranting an inquiry—of the vast majority of complaints submitted by members of the public. One explanation points to the “regulatory illiteracy” of many complainants, where the remit and threshold of seriousness of regulators is poorly understood by the general public. (...) Another points to possible processes of “institutional epistemic injustice” that unjustly undermine the credibility of certain complainants, such as those with low levels of formal education. A third explanation highlights the marginalization of the general public from “symbolic power” to define what matters in medical professional regulation. From a position informed by the philosophical legacy of Gilles Deleuze and Felix Guattari, this paper examines the idea of ‘care’ in nursing theory and philosophy. Deleuze and Guattari make a distinction between, on the one hand, ‘concepts’, which are the proper domain of philosophy and, on the other, ‘functives’ which are the domain of science and all other empirical matters. At first blush, this distinction and use of the word concept appears rather odd, but Deleuze and Guattari hold it (...) to be important for reasons that go beyond the acknowledged and obvious differences between philosophy and science. In Deleuzian terms, a ‘functive’ is any proposition that makes a verifiable truth-claim about actual states of affairs, whereas a ‘concept’ is a philosophical tool that, although it is used in statements that make claims and that seek to affect our thinking on states of affairs, is not a representation of them in any verifiable (functive) sense. In this respect, philosophical concepts, and the statements in which they are used, are neither true nor false. I argue that the way in which the word ‘care’ is used in much nursing theory and philosophy conflates concept (neither true nor false) with functive (either true or false) with less than productive results. I seek to persuade that if we can gain more clarity between the use of care as a would-be functive and its use as a philosophical concept, this would strengthen the purpose of the use of the idea of care in nursing theory. This is to say that I take the view that the role of ‘care’ as a philosophical concept is to be used in statements that ‘think the event’ called nursing; that seek to be ‘worthy of the event’, but without being an actual part of the event. Finally, I show how the concept of care in nursing philosophy has been, and can continue to be, reworked to achieve the permanent task of surveying the ever-shifting planes of the event and how it is described. In this article, I use a nineteenth-century anatomical collection of wax moulages, currently off-staged in the storage facilities in the university where I work, to think about the matter of human remains. Rather than seeing the gross pathology moulages as inert teaching resources, I propose they are agential assemblages, entangled in which are human remains, and that they can be included amongst the dead. I consider their capacity to perform pastpresence work, a particular kind of work of the dead that (...) foregrounds erasures, such as the erasure of the many confined women suffering from syphilis whose bodies were used to cast moulages. This article considers how such pastpresence work might help us be response-able for uncared-for remains, such as the remains of “disappeared” women and infants who died in so-called Mother and Baby Homes, which have reappeared at the center of contemporary Irish public life. At a time when moulages are being reexhibited in museums internationally, I speculate about whether and how the collection might be restaged to perform subversive and utopian pastpresence work, destabilizing the erasures of conventional narratives of medicine and contributing to the crafting of a new and more careful order of things.
