Abstract As non-state actors, PMSCs are not embraced by traditional state-dominated doctrines of international law. However, international law has itself failed to keep pace with the evolution of states and state-based actors, to which strong Westphalian notions of sovereignty are no longer applicable. It is argued that these structural inadequacies stand in the way of international regulation of PMSCs, rather than defects in international human rights and humanitarian law per se. By analyzing understandings of legal responsibility, where such structural issues (...) come to the fore, it is argued that, rather than attempting to resolve the essentially ideological dispute about the inherent functions of a state, regulatory regimes should focus on the positive obligations of states and PMSCs, and the interactions between them. Applying the results of this analysis, current and proposed regulatory regimes are evaluated and their shortcomings revealed. (shrink)

Traditionally ‘imagination’ primarily denotes the faculty of mental imagery, other usages being derivative. However, contemporary philosophers commonly hold it to be a polysemous term, with several unrelated senses. This effectively eliminates this culturally important concept as an appropriate explanandum for science, and paves the way for a thoroughgoing eliminative materialism. White challenges both these views of imagination, arguing that ‘imagine’ never means ‘suppose,’ ‘believe,’ ‘pretend’ or ‘visualize,’ that imagery may occur without imagination, and that the true sense of ‘imagine’ is (...) ‘think of as possibly being so.’ I defend a version of the traditional view. The disseverance of imagination from imagery is motivated by an implicit version of the theory of mental images as pictures. Other contemporary scientific theories of imagery do not entail it. I defend a view of imagery as arising from the interpretative aspect of perception and connect this, and our contemporary concept of imagination, to the root Aristotelian concept of φαντασία.This captures the association between imagination and creativity, and reveals the coherence of the concept, more plausibly than White’s theory. Nearly forty years after his death, social philosopher Frantz Fanon remains a towering intellectual figure. Born in Guadeloupe and trained as a psychologist in France, Fanon rejected his French citizenship to join the Algerian liberation movement in the 1950s. A brilliant scholar who developed the theory that some neuroses are socially generated, Fanon's revolutionary works—The Wretched of the Earth, Toward the African Revolution, and Black Skin, White Masks—spurred an African intellectual awakening. The rebirth of Fanonism today in universities and the (...) English-speaking world is a testament to his relevance. Edited by distinguished African-studies professor Nigel C. Gibson, Rethinking Fanon opens with an authoritative biography which corrects fallacious assertions about Fanon's life, situating him in Marxism, Negritude, Pan-Africanism, and the historical context of postwar decolonization, specifically the Algerian revolution. Section one is highlighted by extended discussions of Marx, Fanon's theories on sophisticated forms of cultural racism, and "true liberation." The next section examines Fanon's humanist philosophy, his philosophical and geographical journeys, and his attitude toward the necessity of revolution. Also included is Homi Bhabha's well-known essay "Remembering Fanon," which contemplates the seeming rejection of Fanon in Britain in the 1970s, in contrast to his major following in America and the influence of Fanon on South African writer Steven Biko. Henry Louis Gates Jr. and Edward Said discuss the importance of the 1980s' and 1990s' cultural and literary debates on Fanon. Gates notes that Fanon has been reinstated -not as a global theorist of "third world" revolution, but instead as a critic of English writers and British romanticists. Benita Parry reexamines African nationalism and liberation, and sheds new light on Fanon's questions of identity and agency. This excellent collection reflects the continuing impact of Fanon's thought on African-American and African studies, feminism, postcolonialism, and cultural studies. (shrink)

This paper introduces a suite of articles devoted to Philip Kitcher’s The Main Enterprise of the World: Rethinking Education (Oxford University Press, 2021). The suite opens with a paper by Kitcher, which presents the central themes of his important book. This is followed by an assessment of the work as whole by John White, and four commentaries discussing in detail various aspects of Kitcher’s position by Ben Kotzee (on science education), Alexis Gibbs (on arts education), Sheron Fraser-Burgess (on deliberative democracy (...) and inclusivity), and Nigel Tubbs (on Kitcher’s ‘Deweyan Society’). In the final contribution, Kitcher replies to his critics. The introduction sketches the character of Kitcher’s project and comments on his pragmatist method. (shrink)

I offer some responses to the principal points raised by Ben Kotzee, Alexis Gibbs, Sheron Fraser-Burgess, and Nigel Tubbs in their commentaries on my book, The Main Enterprise of the World: Rethinking Education (MEW), and to John White's penetrating and constructive review (the four commentaries and White's review all appear in this issue). In reply to Kotzee's challenge, I argue that MEW supports an improved approach to specialized scientific education, and that worries about the future of technology are unfounded. (...) Gibbs’ critique, I contend, assumes a one-size-fits-all approach to the arts, in an area where I am concerned to make fine differentiations. Fraser-Burgess is right to wonder how my educational program can overcome the problems of multicultural, multiracial, multiethnic societies, but I maintain that the approach to educating citizens MEW outlines is the appropriate means to address those problems. Finally, I am happy to modify my conception of the Deweyan Society by introducing the kinds of Socratic explorations Tubbs proposes.John White introduces a number of significant issues and concerns. Some of these arise, I claim, from his adoption of familiar versions of concepts MEW takes pains to explicate in new ways. Since I argue for the superiority of my explicated versions, I view the correct strategy to involve discarding the presuppositions of the traditional notions White favours. With respect to moral education, for example, White's ‘precept-centered’ conception contrasts with my emphasis on the fundamental importance of skills of mutual engagement. His most extensive discussion, on my approach to fulfilment, poses a deep challenge. Here, I attempt to clarify and motivate the concepts I deploy. With respect to his review, however, as with my exchanges with the other commentators, this response can only be the beginning of what I hope will continue to be a fruitful conversation. (shrink)

This study examines corporate publications of U.K. firms to investigate the nature of corporate social responsibility disclosure. Using a stakeholder approach to corporate social responsibility, our results suggest a hierarchical model of disclosure: from general rhetoric to specific endeavors to implementation and monitoring. Industry differences in attention to specific stakeholder groups are noted. These differences suggest the need to understand the effects on social responsibility disclosure of factors in a firm's immediate operating environment, such as the extent of government regulation (...) and level of competitiveness in the industry. This article seeks to demonstrate the centrality of maintenance and repair to an understanding of modern societies and, particularly, cities. Arguing that repair and maintenance activities present a kind of 'missing link' in social theory, which is usually overlooked or forgotten, the article begins by recalling Heidegger's concept of material things as being 'ready to hand'. The main elements of practices of repair and maintenance are then elaborated on so as to help establish the argument that, by focusing on failure (...) and breakdown in technical artefacts and systems, their vital contribution can be brought to the fore. The article then moves on to suggest that prevailing cultural constructions, and imaginations, of the 'infrastructure' that sustains modern societies, actively work to push repair and maintenance activities beyond the attention of social science. To exemplify these arguments, the article explores in detail some of the repair and maintenance activities that sustain, first, the nexus between computer communications and electricity and, second, the system of automobility. The article concludes by excavating a politics of repair and maintenance in modern cities and societies. (shrink)

Essentialism--roughly, the view that natural kinds have discrete essences, generating truths that are necessary but knowable only _a posteriori_--is an increasingly popular view in the metaphysics of science. At the same time, philosophers of language have been subjecting Kripke’s views about the existence and scope of the necessary _a posteriori_ to rigorous analysis and criticism. Essentialists typically appeal to Kripkean semantics to motivate their radical extension of the realm of the necessary _a posteriori_; but they rarely attempt to provide any (...) semantic arguments for this extension, or engage with the critical work being done by philosophers of language. This collection brings authors on both sides together in one volume, thus helping the reader to see the connections between views in philosophy of language on the one hand and the metaphysics of science on the other. The result is a book that will have a significant impact on the debate about essentialism, encouraging essentialists to engage with debates about the semantic presuppositions that underpin their position, and, encouraging philosophers of language to engage with the metaphysical presuppositions enshrined in Kripkean semantics. The paper considers whether psychiatric kinds can be natural kinds and concludes that they can. This depends, however, on a particular conception of ‘natural kind’. We briefly describe and reject two standard accounts – what we call the ‘stipulative account’ (according to which apparently a priori criteria, such as the possession of intrinsic essences, are laid down for natural kindhood) and the ‘Kripkean account’ (according to which the natural kinds are just those kinds that obey Kripkean semantics). We then rehearse (...) a more permissive account: Richard Boyd’s ‘homeostatic property cluster’ (HPC) account. We argue that psychiatric kinds can in principle count as natural kinds on the HPC account. Moreover, specific psychiatric kinds (Tourette’s, schizophrenia, etc.) can be natural kinds even if the category psychiatric disorder is not itself a natural kind. (shrink)

This paper outlines what we call a network model of collective emotions. Drawing upon this model, we explore the significance of collective emotions in the Palestine-Israel conflict. We highlight some of the ways in which collective shame, in particular, has contributed to the evolution of this conflict. And we consider some of the obstacles that shame and the pride-restoring narratives to which it gave birth pose to the conflict’s resolution.

Cloth, $70.In Aristocracy and Athletics, Nigel Nicholson examines the portrayal of charioteers, jockeys, and athletic trainers in Greek victory memorials (epinikia, statues, vases) produced between 550 and 440 b.c.e. He argues that reliance upon paid, professional (...) assistance put aristocratic victors in a quandary because it ran counter to their insistence on the importance of inherited ability and because it involved them in commodified exchange. Charioteers, jockeys, and athletic trainers were, as a result, carefully excluded from most victory memorials. In the handful of memorials in which they figured, their activities were represented in ways that made them compatible with aristocratic ideals. Nicholson builds directly on the work that Leslie Kurke and others have done on the ways in which Pindar responds to the social and political challenges faced by elites. He takes a firmly New Historicist approach in using detailed analyses of statues, inscriptions, and vases to identify peculiarities in epinikia.In order to assess Nicholson's work, it is necessary to differentiate between his explanation of the reasons for the omission of athletic professionals from victory memorials and his explication of how omission was effected. With respect to the latter, what might be called the poetics of exclusion, Nicholson does an outstanding job. He breaks new ground in highlighting the elision of athletic professionals from victory memorials and in elucidating how the poetics of exclusion shaped epinikia. He identifies seemingly odd features of individual odes that result from the elimination of charioteers, jockeys, and athletic trainers and unpacks the strategies used to generate representations of paid professionals that were acceptable to aristocratic sensibilities. This leads to stimulating new readings of about a dozen of Pindar's odes.There are, at the same time, some problems with Aristocracy and Athletics that spring from Nicholson's single-minded focus on commodified exchange. Nicholson argues that victory memorials came into being because of aristocratic concerns about engaging in commodified exchange with athletic professionals and that this was the primary and, possibly, the sole reason that those professionals were excluded from memorials. He does not take into account the profound changes that transformed Greek athletics in the first half of the sixth century, and he paints an unconvincing picture of triumphant aristocrats overcome by anxiety about commodified exchange. These problems will be addressed in detail below. For the moment, it is important to note that they do not invalidate Nicholson's [End Page 125] insights about how epinician poets went about excluding and accommodating athletic professionals. Aristocracy and Athletics is a significant contribution to the existing scholarship on Pindar that will be of interest to serious readers of Greek lyric and to historians of ancient sport. It is best suited to a specialist audience, though some sections may be useful to advanced undergraduates.Aristocracy and Athletics consists of nine chapters framed by an introduction and a conclusion. In the introduction Nicholson shows that "almost all the competitors in the equestrian and gymnastic contests relied on others in some significant way to secure their victories" (4). He also argues that "the services of athletic trainers, charioteers, and jockeys became increasingly commodified in the late archaic period" (10). He links this development to the creation of the first victory memorials sometime around 550 and sets the lower chronological limit of the study at 440, when "the market for victory odes all but collapsed" (14).The first five chapters of Aristocracy and Athletics examine memorials for equestrian victories. In chapter 1, Nicholson begins his articulation of the poetics of exclusion. Some victory memorials (falsely) represent the owner as having driven his own chariot. Other memorials make little reference to the actual race, eliding a key moment because it was one in which the charioteer rather than the owner featured. Furthermore, epinician poets avoid mention of drivers when describing victory parades and when recounting mythical narratives that typically included charioteers.In chapters 2 to 4, Nicholson looks at the handful of drivers that appear in victory memorials. Generally we think it good to tolerate and to accord recognition. Yet both are complex phenomena and our teaching must acknowledge and cope with that complexity. We tolerate only what we object to, so our message to students cannot be simply, ‘promote the good and prevent the bad’. Much advocacy of toleration is not what it pretends to be. Nor is it entirely clear what sort of conduct should count as intolerant. Sometimes people are at fault for tolerating what they (...) should not, or for tolerating what they should find unexceptionable. So virtue does not always lie with toleration. Tolerance can also seem condescending; should we therefore replace it with recognition? But recognition may not be able to coexist with the disapproval that makes toleration necessary. However, not everything about toleration and recognition is controversial; there are fixed points from which students can grapple with the issues presented by both. (shrink)

Martha Nussbaum is one of the most prolific and distinguished philosophers in the English-speaking world. Since 1995 she has been Ernst Freund Distinguished Service Professor of Law and Ethics at the University of Chicago appointed in the Law School, Philosophy Department and Divinity School. She is an Associate in the Classics Department and the Political Science Department, an Affiliate of the Committee on Southern Asian Studies, a Board Member of the Human Rights Program and founder and Coordinator of a new (...) Center for Comparative Constitutionalism. The Center aims to study the social forces that affect the implementation of constitutional rights, especially for disadvantaged groups. She visits feminists in India each year to research the activities of Non-Governmental Organizations (NGOs) and the problems of poor women in different countries. In Delhi she has worked with the UN Development Programme on a project on gender and governance, and has also worked with The Lawyer’s Collective, an activist group in Delhi working on women’s rights.
