Osiurak and Reynaud highlight the critical role of technical-reasoning skills in the emergence of human cumulative technological culture, in contrast to previous accounts foregrounding social-reasoning skills as key to CTC. We question their analysis of the available evidence, yet for other reasons applaud the emphasis on causal understanding as central to the adaptive and collaborative dynamics of CTC.

Fitouchi et al.'s moral disciplining approach highlights the significant role social evaluations of self-control appear to play in human moral judgment. At the same time, attributing the wide range of puritanical concerns to a singular focus on self-control seems unwarranted. A more pluralistic approach would enrich understanding of moral judgment in all its cultural and historical diversity.

Physicians have an ethical responsibility to their patients to offer the best available medical care. This responsibility conflicts with their role as gatekeepers of the limited health care resources available for all patients collectively. It is ethically untenable to expect doctors to face this trade-off during each patient encounter; the physician cannot be expected to compromise the wellbeing of the patient in the office in favour of anonymous patients elsewhere. Hence, as in other domains of public policy where individual and (...) collective interests conflict, some form of collective solution is required. Collective solutions may take the form of placing explicit resource constraints on resources available to physicians, or clinical practice guidelines that recognise cost-effective care as acceptable. Such solutions will be politically and ethically sustainable only if patients as citizens of the larger population accept the need for rationing of limited resources in health care. (shrink)

This article advances a censure-based case against sentences of life imprisonment without the possibility of parole. Our argument justifies a retributive “second look” assessment of long-term prison sentences. The article focuses on the censuring element of long-term prison sentences while reconceptualizing penal censure as a dynamic and responsive concept. By doing so, the article explores the significance of the prisoner’s life after sentencing (largely ignored by retributivists) and promotes a more nuanced approach to censure-based proportionality. Policy-makers may welcome this approach (...) as a way to control excessive prison sentences while remaining within a retributive penal framework. Although we are making a general argument about the need for responsive censure within a retributive sentencing regime, the case for this approach is particularly compelling at the present time. Almost all Western nations, and particularly the US, impose very lengthy, often life sentences of imprisonment for a wide range of offences, thereby affecting large numbers of prisoners. (shrink)

Experts play an important role in society, but there has been little investigation about the nature of expertise. I argue that there are two kinds of experts: those whose expertise is a function of what theyknow (epistemic expertise), or what theydo (performative expertise). Epistemic expertise is the capacity to provide strong justifications for a range of propositions in a domain, while performative expertise is the capacity to perform a skill well according to the rules and virtues of a practice. This paper discusses some philosophical aspects related to the recent publication of the experimental results of the 2017 black hole experiment, namely the first image of the supermassive black hole at the center of galaxy M87. In this paper I present a philosophical analysis of the 2017 Event Horizon Telescope (EHT) black hole experiment. I first present Hacking’s philosophy of experimentation. Hacking gives his taxonomy of elements of laboratory science and distinguishes a list of elements. I show that the EHT (...) experiment conforms to major elements from Hacking’s list. I then describe with the help of Galison’s Philosophy of the Shadow how the EHT Collaboration created the famous black hole image. Galison outlines three stages for the reconstruction of the black hole image: Socio-Epistemology, Mechanical Objectivity, after which there is an additional SocioEpistemology stage. I subsequently present my own interpretation of the reconstruction of the black hole image and I discuss model fitting to data. I suggest that the main method used by the EHT Collaboration to assure trust in the results of the EHT experiment is what philosophers call the Argument from Coincidence. I show that using this method for the above purpose is problematic. I present two versions of the Argument from Coincidence: Hacking’s Coincidence and Cartwright’s Reproducibility by which I analyse the EHT experiment. The same estimation of the mass of the black hole is reproduced in four different procedures. The EHT Collaboration concludes: the value we have converged upon is robust. I analyse the mass measurements of the black hole with the help of Cartwright’s notion of robustness. I show that the EHT Collaboration construe Coincidence/Reproducibility as Technological Agnosticism and I contrast this interpretation with van Fraassen’s scientific agnosticism. (shrink)

Bell’s theorem is purported to demonstrate the impossibility of a local “hidden variable” theory underpinning quantum mechanics. It relies on the well-known assumption of ‘locality’, and also on a little-examined assumption called ‘statistical independence’ (SI). Violations of this assumption have variously been thought to suggest “backward causation”, a “conspiracy” on the part of nature, or the denial of “free will”. It will be shown here that these are spurious worries, and that denial of SI simply implies nonlocal correlation between spacelike (...) degrees of freedom. Lorentz-invariant theories in which SI does not hold are easily constructed: two are exhibited here. It is conjectured, on this basis, that quantum-mechanical phenomena may be modeled by a local theory after all. (shrink)

Described as a “delirium” with the potential to “unleash (...) new ideas, new desires, and new imaginings” (Sholtz and Carr, 1), the editors adopt Deleuze and Guattari’s schizoanalysis as the basis for this methodology. They argue that this juxtaposition of feminist theory and schizoanalysis might synthesize and advance research on notions like becoming-woman, rhizomatics, deterritorialization, assemblage, immanence, and material vitalism (2) that have propelled feminist work on Deleuze and Guattari over the last several decades. Moreover, in the volume’s critical reevaluation of schizoanalysis, it strives to reimagine “the philosophical, ethical, aesthetic, and political” (1) by incorporating the evolution of feminist thought since Deleuze and Guattari’s time. The volume is, indeed, important reading for feminist continental philosophers in search of fruitful applications of Deleuzo-Guattarian thought to a wide, intersectional diversity of feminist theory.Citing Buchanan and Colebrook’s Deleuze and Feminist Theory (2000) as the origin of a productive and less skeptical feminist engagement with their work, the volume aims to advance a new generation of feminist Deleuzo-Guattarian thought that departs from a radically heterogeneous, schizoanalytic foundation [End Page 192] asking, “what can philosophical concepts do?” (2). The editors also mention the recent uptake of schizoanalysis as a methodology by reference to the Schizoanalytic Applications series in which the volume is published. They suggest that the relevance of schizoanalytic methodology “to feminist theory can be similarly situated in providing a new lens for critical and social engagement,” which the volume explores under the guise of discovering what this “new encounter” between feminism and schizoanalysis “might yield” (4). Thus, the collection is a dual-pronged, dynamic investigation, where one trajectory investigates the potentials for forging a feminist schizoanalytic framework and the other considers the ways that feminism might nuance or reshape the contours of schizoanalysis that were established across Deleuze and Guattari’s collaborative works (1).Furthermore, the editors cite the publication of Guattari’s Schizoanalytic Cartographies (2013) as additional inspiration. And it is, indeed, in part from Guattari’s visionary work that the joint project with Deleuze—including the articulations of schizoanalysis in Anti-Oedipus, Kafka, and A Thousand Plateaus— came into being (see: Guattari 2006). As Stephane Nadaud explains, their collaboration was designed to “counter... despotic, solitary enunciation—with their own collective one,” which transcends the Cartesian “unity of our ego—the famous I that thinks, and therefore... the cogito” (Guattari 2006, 19). For, it is the very process of their collaboration, which entails their essential duality and the schizoanalytic becoming-imperceptible of their respective individualities, that becomes an archetype for schizoanalytic praxis.The aforementioned delirium, which is at the heart of schizoanalysis, originates from the split or break implied by the “schizo,” meaning that schizoanalysis seeks to locate then mobilize these breaks toward the creation of delirious, impersonal subjectivities. Merging desire and delirium, which he considers “in a deep sense” indistinguishable, Deleuze emphasizes that “desire-delirium is by its nature a libidinal investment of an entire historical milieu, of an entire social environment” (2004, 275). The connection between Adam Smith and Alasdair MacIntyre is not evident at first glance. In fact, those who know MacIntyre’s work might bristle at the association. MacIntyre is inherently anticapitalist. He believes that moral people ought to reject the modern state and large-scale corporations.1 He also rejects what he terms the enlightenment project, claiming not only that it failed but that it was doomed to do so.2 Furthermore, MacIntyre’s perspectivalism seems to run counter to any “impartial spectator” theory such as (...) Smith ’s; tradition-bound rationality necessarily assumes partiality.3 In short, MacIntyre regards himself as an opponent of the liberal tradition, that intellectual lineage which is most closely associated with Smith, and, although he rejects association with communitarianism, he holds a similar place in contemporary philosophy. He is liberalism’s critic, not its reformer. But ethics makes strange bedfellows. MacIntyre’s theory of rationality, I contend, provides a useful and important complement to Smith ’s moral psychology. It allows for the intermingling of emotion and reason that is so important for Smith ’s work.4 It creates a structure for bridging Smith ’s individuals and the communities of which they are a part. In essence, I argue, MacIntyre’s work allows us to better understand Smith ’s jump from deliberation on the individual level to the development of cultural standards and norms. I conclude that Smith ’s emphasis on the individual results in an incomplete theory of communal rationality, and that MacIntyre’s emphasis on tradition leaves out a foundation of individual agency. The two theories, however complement each other well. As a bit of preparation, it is worth mentioning that both thinkers, and Smith, in particular, are often portrayed inaccurately. Smith is not the self-interest focused libertarian that he is made out to be. He is, instead a sophisticated moral theorist whose first book, The Theory of Moral Sentiments was celebrated and influential in its time. (shrink)

This rich and provocative study assesses Herbert Spencer's pivotal contribution to the emergence of liberal utilitarianism and shows that Spencer, as much as J. S. Mill, provided liberal utilitarianism with its formative contours. Like Mill, Spencer tried to reconcile a principle of liberty and strong moral rights with a utilitarian, maximizing theory of good. In this powerful and sympathetic account, David Weinstein argues that Spencer's moral and political thought exhibits greater systematic integrity than received views of his thought acknowledge. (...) However, Weinstein also examines the problems and flaws in Spencer's version of liberal utilitarianism, and shows that, precisely because of these flaws, it is engaging and deserving of our critical attention. Can we legitimately speak of ethicsexperts? Recent literature in philosophy and medical ethics addresses this important question but does not offer a satisfactory answer. Part of the problem is the absence of an examination of what it means to be an expert in general. I therefore begin by reviewing my analysis of expertise which appeared earlier in this journal. We speak of two kinds of experts: persons whose expertise is in virtue of what theyknow (epistemic expertise), or what theydo (performative (...) expertise). Applying this analysis to the domain of ethics, I argue that we may speak of ethical expertise in three epistemic senses: a) expertise indescriptive ethics, b) expertise inmetaethics, c) expertise innormative ethics, and in a performative sense: d) expertise inliving a good life. I conclude with a brief description of some social roles of ethics experts. (shrink)

Whether the US Constitution guarantees a right to conduct scientific research is a question that has never been squarely addressed by the United States Supreme Court. Similarly, the extent to which the First Amendment protects the right to communicate the results of scientific research is an issue about which there is scant judicial authority. This article suggests that a crucial guidepost for exploring both these uncharted areas of constitutional law should be whether restrictions on scientific research or communication truly implicate (...) fundamental individual rights or instead primarily concern issues of general social welfare—issues that in a democracy are properly decided by the representative branches of government or their delegates, not by the judiciary. Spinoza's heritage has been occluded by his incorporation into the single, western, philosophical canon formed and enforced by theologico-political condemnation, and his heritage is further occluded by controversies whose secular garb shields their religious origins. By situating Spinoza's thought in a materialist Aristotelian tradition, this book sheds new light on those who inherit Spinoza's thought and its consequences materially and historically rather than metaphysically. By focusing on Marx, Benjamin, and Adorno, Idit Dobbs-Weinstein explores the manner in which Spinoza's radical (...) critique of religion shapes materialist critiques of the philosophy of history. Dobbs-Weinstein argues that two radically opposed notions of temporality and history are at stake for these thinkers, an onto-theological future-oriented one and a political one oriented to the past for the sake of the present or, more precisely, for the sake of actively resisting the persistent barbarism at the heart of culture. The debate over the metaphysics of sounds is about the nature of what we immediately auditorily perceive. There are good reasons to identify a sound with some kind of event. But what kind of event? I articulate and defend the _broad event view_ of sounds, on which a sound is identified with a broad event that produces and shapes an acoustic wave. I show that other views that identify a sound with some kind of event face serious problems. In particular, (...) Casati and Dokic’s (La philosophie du son, Editions Jacqueline Chambon, 1994 ) monadic event view fails to capture the full range of sounds, while O’Callaghan’s (Sounds: a philosophical theory, Oxford University Press, 2007 ; in: Nudds, O’Callaghan (eds) Sounds and perception: new philosophical essays, Oxford University Press, 2009 ; Oxford Stud Metaphys 5:247–270, 2010 ) relational event view identifies sounds with too narrow of an event, leading to problems capturing important differences between sounds and putting the perceiver at an unnecessary remove from the kind of broad events she typically cares about. The relationship between the purposes of sentencing and imprisonment can be variously conceptualized. The paper theorizes and contrasts two models of sentencing and prison relations—continuity and separation. The continuity model assumes continuity between sentencing and prison regime. Under this model, all sentencing purposes may impact prison regime. The separation model distinguishes between the purposes of sentencing and of imprisonment. Under the separation model, the retributive element of imprisonment is completely fulfilled by depriving the prisoner of liberty. Retributive considerations can affect (...) only the duration of the sentence, while prison regime is determined solely according to rehabilitation/risk and prison security considerations. The paper problematizes the separation model as it suffers from two difficulties: (a) the idea that the retributive element of imprisonment is fully fulfilled by depriving the prisoner’s liberty undermines the “hard treatment” element of the retributive punishment. Relatedly, since no prison regime can deprive a person solely of liberty no custodial sentence can be justified; (b) given the inability to isolate the denial of liberty as the only deprivation of imprisonment, the separation model also encourages judges to underestimate and feel less responsible for the full meaning of their decision to imprison. Finally, the paper will argue that liberal prison conditions may (and should) be achieved even when seeing retribution as relevant for prison life and will offer possible ways to do so. (shrink)

Hans Baron, Karl Popper, Leo Strauss and Erich Auerbach were among the many German-speaking Jewish intellectuals who fled continental Europe with the rise of Nazism in the 1930s. Their scholarship, though not normally considered together, is studied here to demonstrate how, despite their different disciplines and distinctive modes of working, they responded polemically in the guise of traditional scholarship to their shared trauma. For each, the political calamity of European fascism was a profound intellectual crisis, requiring an intellectual response which (...) Weinstein and Zakai now contextualize, ideologically and politically. They exemplify just how extensively, and sometimes how subtly, 1930s and 1940s scholarship was used not only to explain, but to fight the political evils that had infected modernity, victimizing so many. In this paper we consider a naive conception of what a quantum theory of gravity might entail: a quantum-mechanically fluctuating gravitational field at each spacetime point. We argue that this idea is problematic both conceptually and technically.

Gauge theories are theories that are invariant under a characteristic group of "gauge" transformations. General relativity is invariant under transformations of the diffeomorphism group. This has prompted many philosophers and physicists to treat general relativity as a gauge theory, and diffeomorphisms as gauge transformations. I argue that this approach is misguided.

During Talmudic (...) times and for centuries after, devout Jewish men would wear Tefillin the entire day. This practice is now only rarely seen. Since the 1960s, there has been a resurgence of public display of one’s adherence to traditional Jewish practices. It is increasingly common to see Jewish men wearing a yarmulke at work and in public spheres. There are perhaps thousands of Jewish doctors who don’t hesitate to wear their yarmulke in their places of practice–hospital, clinic, private practice.In the 1980s I joined the staff of the Department of Radiology at the Bethesda Naval Hospital as the Director of Neuroradiology and Interventional Radiology. As the hospital’s Neuroradiologist I presented the radiological findings for the cases presented at the bimonthly “brain cutting” sessions. These sessions were well attended by staff, residents and medical students from the Departments of Neurosurgery, Neurology, Neuropathology and Radiology. I was the only traditional Orthodox Jew at the hospital, clearly recognizable as such by the yarmulke I always wore (very unusual in the early 1980s). My yarmulke would provoke occasional good–natured kidding particularly from the neurosurgery staff and residents. [End Page 212]During one of these sessions, kidding about my yarmulke from a small group of residents was reaching a crescendo. The kidding came to a sudden halt when the Chief Resident of Neuro-surgery, a born and bred Louisianan, demanded everyone’s attention. When it quieted down he very sternly ordered everyone to carefully look at their uniforms. Everyone seemed perplexed but all followed suit. Almost a half–minute passed before the Chief Resident, with his thick Southern drawl, spoke. “Our [naval] uniforms are, at most, a couple of hundred years old.” He then pointed toward my yarmulke and said: “Dr. Weinstein’s uniform is thousands of years old and a lot more respected than our uniforms.”This was my initiation into the alluring, usually positive and unexpected fascination and respect that my obvious religiosity had on my patients, their families and my many colleagues during the almost seven years I spent at Bethesda.The story I will tell is very poignant. It involved the family of one of the most senior Chief Petty Officers of the United States Navy.Late one Sunday evening, I received a call from the Chief Resident, Dr. Steve Henning, informing me that the family matriarch had been admitted to Bethesda with relatively acute onset of significant neurological findings. The emergent workup confirmed the presence of a large mass, a meningioma, of the frontal lobe region with significant surrounding edema and mass effect. Neurosurgery requested embolization of the feeding vessels prior to surgery. The interventional procedure and possible serious complications were fully explained to the patient, her husband and her two daughters. Consent was signed and early Monday morning the patient was brought to Special Procedures to have the tumor embolized.Prior to the procedure I introduced myself to the patient’s family and spoke to them about the procedure. The patient’s husband and two daughters, one of whom was an active duty Navy nurse the other a minister of a fundamentalist church in the South, were very attentive and expressed concern about the procedure and its outcome. I tried to reassure them and told them I would speak to them during and after the procedure.All went well. Medically, the patient did well during and after the procedure. She was discharged from our care to neurosurgery. The patient and her family thanked us.After the patient left the Special Procedures area the Chief Technologist, Al, approached me and very cryptically asked if I was aware of what happened when the Chief Resident, Dr. Henning, spoke with the patient and family the night before.
