This article challenges the generally accepted dogma that reliance is an essential ingredient in contractual formation. We argue that this view has resulted from an erroneous interpretation of the relevant case law, failure to cite contrary authority, and the elevation of often oblique judicial references to the need for reliance to the status of fundamental contractual principle. Contractual theory and clear policy reasons support our position that in English law a contractual obligation subsists when a person, knowing of a promise, (...) performs the stipulated act (or gives the promise) requested by the promisor, even though that person has not relied on the promise. This article addresses five research questions: What specific behaviors are described in the literature as ethical or unethical? What percentage of business people are believed to be guilty of unethical behavior? What specific unethical behaviors have been observed by bank employees? How serious are the behaviors? Are experiences and attitudes affected by demographics? Conclusions suggest: There are seventeen categories of behavior, and that they are heavily skewed toward internal behaviors. Younger employees have a higher level of ethical consciousness than older (...) employees. The longer one works for a company, the more one may look to job security as a priority; this can lead to rationalizing or overlooking apparently unethical behaviors. More emphasis is needed on internal behaviors with particular attention on the impact that external behaviors have on internal behaviors. (shrink)

Art theory has consistently emphasised the importance of situational, cultural, institutional and historical factors in viewers’ experience of fine art. However, the link between this heavily context-dependent interpretation and the workings of the mind is often left unexamined. Drawing on relevance theory—a prominent, cogent and productive body of work in cognitive pragmatics—we here argue that fine art achieves its effects by prompting the use of cognitive processes that are more commonly employed in the interpretation of words and other stimuli presented (...) in a communicative context. We describe in particular how institutional factors effectively co-opt these processes for new ends, allowing viewers to achieve cognitive effects that they otherwise would not, and so provide cognitivist backing for an Institutional Theory of Art, such as that put forward by Arthur Danto. More generally, we situate and describe the Western fine art tradition as a phenomenon that is a consequence of both the cognitive processes involved in communication, and of cultural norms, practices and institutions. Human personality influences the way people interact with dogs. This study investigated the associations between the personality of animal shelter volunteers and behavior during on-leash walks with shelter dogs. Video recording and a canine leash tension meter were used to monitor the on-leash walking. Personality was measured in five dimensions with the NEO Five-Factor Inventory. Neurotic volunteers pulled the leash harder and tended to interact with dogs using more body language; dogs being walked by neurotic volunteers in turn displayed more (...) lip-licking and body shaking and were more likely to be rated as well-behaved. Extroverted volunteers were associated with stronger maximal leash tension at both the human and dog ends of the leash, and they praised the dog more, often in a high pitched voice. These volunteers eliciting more tail-wagging and body shaking by the dog. Extroverted volunteers were also more tolerant of different dog behaviors. Volunteers with personalities characterized by “openness to experiences” were less likely to verbally attract the attention of dogs, praise dogs and talk to them in a high-pitched voice; however, dogs walked by these volunteers were more likely to pull on the leash, and engaged in more lip-licking but less sniffing. “Agreeable” volunteers liked to verbally attract the attention of the dogs and more commonly initiated hand gestures and physical contact, causing the dogs to pull less frequently; dogs in these dyads displayed more gazing and lip-licking behaviors. Conscientious volunteers were less likely to pull the leash and tended to have more physical contact with the dogs but did not favor verbal communication and did not use a high pitched voice. Most commonly among philosophers, this interest has been analyzed in relation to Kant's concerns with the foundations of mechanics, matter theory, and the epistemology of Newtonian science, with the central text of interest being the Metaphysische Anfangsgründe. On the other hand, historians of philosophy and historians of science, interested in the issues of the third Critique and in the several papers of Kant dealing with biological and anthropological issues, have emphasized the unified nature of Kant's inquiries into the natural sciences, and the importance of his continued interest in the life and human sciences alongside his interests in the foundations of the physical sciences. Modal sentences of the form "every F might be G" and "some F must be G" have a threefold ambiguity. in addition to the familiar readings "de dicto" and "de re", there is a third reading on which they are examples of the "plural de re": they attribute a modal property to the F's plurally in a way that cannot in general be reduced to an attribution of modal properties to the individual F's. The plural "de re" readings of modal (...) sentences cannot be captured within standard quantified modal logic. I consider various strategies for extending standard quantified modal logic so as to provide analyses of the readings in question. I argue that the ambiguity in question is associated with the scope of the general term 'F'; and that plural quantifiers can be introduced for purposes of representing the scope of a general term. Moreover, plural quantifiers provide the only fully adequate solution that keeps within the framework of quantified modal logic. (shrink)

According to David Lewis, a realist about possible worlds must hold that actuality is relative: the worlds are ontologically all on a par; the actual and the merely possible differ, not absolutely, but in how they relate to us. Call this 'Lewisian realism'. The alternative, 'Leibnizian realism', holds that actuality is an absolute property that marks a distinction in ontological status. Lewis presents two arguments against Leibnizian realism. First, he argues that the Leibnizian realist cannot account for the contingency of (...) actuality. Second, he argues that the Leibnizian realist cannot explain why skepticism about one's own actuality is absurd. In this paper, I mount a defense of Leibnizian realism. (shrink)

In this chapter, I evaluate various conceptions of distance. Of the two most prominent, one takes distance relations to be intrinsic, the other extrinsic. I recommend pluralism: different conceptions can peacefully coexist as long as each holds sway over a distinct region of logical space. But when one asks which conception holds sway at the actual world, one conception stands out. It is the conception of distance embodied in differential geometry, what I call the Gaussian conception. On this conception, all (...) fundamental facts about distance are “local” facts.” But there is a problem: the Gaussian conception, notwithstanding its mathematical and physical credentials, appears metaphysically suspicious on Humean grounds. In the final section, I suggest that the Gaussian conception can be given a sound metaphysical footing in terms of non-standard analysis. (shrink)

In this chapter, I survey what I call Lewisian approaches to modality: approaches that analyze modality in terms of concrete possible worlds and their parts. I take the following four theses to be characteristic of Lewisian approaches to modality. (1) There is no primitive modality. (2) There exists a plurality of concrete possible worlds. (3) Actuality is an indexical concept. (4) Modality de re is to be analyzed in terms of counterparts, not transworld identity. After an introductory section in which (...) I motivate analyzing modality in terms of possible worlds, I devote one section to each of these four theses. For each thesis, I take Lewis’s interpretation and defense as my starting point. I then consider and endorse alternative ways of accepting the thesis, some of which disagree substantially with Lewis’s interpretation or defense. Phillip Cary argues that Augustine invented or created the concept of self as an inner space--as space into which one can enter and in which one can find God. This concept of inwardness, says Cary, has worked its way deeply into the intellectual heritage of the West and many Western individuals have experienced themselves as inner selves. After surveying the idea of inwardness in Augustine's predecessors, Cary offers a re-examination of Augustine's own writings, making the controversial point that in (...) his early writings Augustine appears to hold that the human soul is quite literally divine. Cary goes on to contend that the crucial Book 7 of the Confessions is not a historical report of Augustine's "conversion" experience, but rather an explanation of his intellectual development over time. In December 2007 it was revealed that the British government is considering the exclusion of certain groups of migrants—those considered to be present “illegally”—from primary health care provided by the National Health Service. At present, practitioners have discretion to accept any individual for NHS treatment regardless of their status. A joint Home Office and Department of Health review is examining this access for foreign nationals, and the likely outcome is the restriction of access to irregular migrants, which would, according to (...) the Institute of Public Policy Research, affect around 390,000 people. In 2004 such groups were excluded from NHS secondary care, most controversially from treatment for HIV, and so the present proposal would bar them from all but emergency health treatment. (shrink)

It follows from Humean principles of plenitude, I argue, that island universes are possible: physical reality might have 'absolutely isolated' parts. This makes trouble for Lewis's modal realism; but the realist has a way out. First, accept absolute actuality, which is defensible, I argue, on independent grounds. Second, revise the standard analysis of modality: modal operators are 'plural', not 'individual', quantifiers over possible worlds. This solves the problem of island universes and confers three additional benefits: an 'unqualified' principle of compossibility (...) can be accepted; the possibility of nothing can be accommodated; and the identity of indiscernible worlds can be decisively refuted. The role of responsible leadership—for each leader and as part of a leader’s collective actions—is essential to global competitive success (Doh and Stumpf, Handbook on responsible leadership and governance in global business, 2005 ; Maak and Pless, Responsible leadership, 2006a . Failures in leadership have stimulated interest in understanding “responsible leadership” by researchers and practitioners. Research on responsible leadership draws on stakeholder theory, with employees viewed as a primary stakeholder for the responsible organization (Donaldson and Preston, Acad Manag Rev 20(1):65–91, (...) 1995 ; Freeman, Strategic management: a stakeholder approach, 1984 ; Mitchell et al., Acad Manag Rev 22:853–886, 1997 ; Phillips and Freeman, Stakeholder theory and organizational ethics, 2003 . We define and operationalize responsible leadership from the perspective of employees and their views of the actions of their leaders. Drawing on a comprehensive survey of 28 Indian and global organizations operating in India, we report the results from 4,352 employees on the relationship between responsible leadership, their pride in and satisfaction with their organization, and retention 1 year later. Strong associations were found among these variables suggesting that responsible leadership—employee perceptions of the support they receive from managers, the HR practices, and corporate socially responsible actions—may be an overarching construct that connects them to the organization. This volume contains eighteen papers, three with new postscripts, that were written over the past 35 years. Five of the papers have not been previously published. Together they provide a comprehensive account of modal reality—the realm of possible worlds—from a Humean perspective, with excursions into neighboring topics in metaphysics. Part 1 sketches an account of reality as a whole, both the mathematical and the modal, defending a form of plenitudinous realism: every consistent proposition is true of some portion of reality. (...) Part 2 presents and defends a realist theory of concrete possible worlds with an absolute ontological distinction between the actual and the merely possible. Part 3 presents and defends a Humean account of modal plenitude, formulating and endorsing principles of recombination, of plenitude of possible structures, and of plenitude of alien contents. Part 4 applies the Humean account to truthmaking, mereology, spacetime, and quantities. I argue that holding fast to Humean strictures leads to views that differ in radical ways from those put forth by contemporary metaphysicians. (shrink)

We claim that scientists working with deep learning (DL) models exhibit a form of pragmatic understanding that is not reducible to or dependent on explanation. This pragmatic understanding comprises a set of learned methodological principles that underlie DL model design-choices and secure their reliability. We illustrate this action-oriented pragmatic understanding with a case study of AlphaFold2, highlighting the interplay between background knowledge of a problem and methodological choices involving techniques for constraining how a model learns from data. Building successful models (...) requires pragmatic understanding to apply modelling strategies that encourage the model to learn data patterns that will facilitate reliable generalisation. (shrink)

Some argue, following Bertrand Russell, that because general truths are not entailed by particular truths, general facts must be posited to exist in addition to particular facts. I argue on the contrary that because general truths (globally) supervene on particular truths, general facts are not needed in addition to particular facts; indeed, if one accepts the Humean denial of necessary connections between distinct existents, one can further conclude that there are no general facts. When entailment and supervenience do not coincide (...) it is only failure of supervenience, not failure of entailment, that carries ontological import. (shrink)

The most commonly heard proposals for reducing possible worlds to language succumb to a simple cardinality argument: it can be shown that there are more possible worlds than there are linguistic entities provided by the proposal. In this paper, I show how the standard proposals can be generalized in a natural way so as to make better use of the resources available to them, and thereby circumvent the cardinality argument. Once it is seen just what the limitations are on these (...) more general proposals, it can be clearly seen where the real difficulty lies with any attempt to reduce possible worlds to language. Roughly, the difficulty is this: no actual language could have the descriptive resources needed to represent all the ways things might have been. I conclude by arguing that this same difficulty spells doom for any nominalist or conceptualist proposal for reducing possible worlds. (shrink)

This paper considers pick-the-winners contests as a simple method for harnessing the wisdom of crowds to produce probability forecasts. Pick-the-winners contests are those in which players pick the outcomes of selected future binary events with a prize going to the player with the most correct picks. In contrast to soliciting probability forecasts from experts, this paper shows that competition among players is to be encouraged because it improves the accuracy of the resulting crowd probability forecasts. This improvement comes because the (...) competition not only discourages the overbetting of favorites that occurs if prizes are awarded based on absolute performance, but also helps mitigate the public knowledge bias that occurs if everyone reports truthfully. In addition to the theoretical arguments, the paper analyzes picks from 6 years of pick-the-winners contests involving hundreds of players and 1037 college lacrosse games to find that the crowd proportions outperformed two benchmark sets of probabilities. By means of a comprehensive and penetrating examination of the main elements of Epicurean ethics, Phillip Mitsis forces us to reevaluate this widely misunderstood figure in the history of philosophy.

According to the Truthmaker Principle: every truth has a truthmaker. Spelled out a bit more exactly: for every true proposition, there is some entity whose existence entails, or necessitates, the truth of the proposition. A counterpart theorist can accept the Truthmaker Principle after all without buying into unmereological composition and mysterious necessary connections. This chapter introduces the idea of truthmaking, and considers how much truthmaking can be done by things without making controversial assumptions in modal metaphysics. It presents Armstrong's account (...) of truthmaking and the states of affairs needed to play the role of truthmakers. A fortiori should not be taken to be a version of the correspondence theory of truth. The chapter presents David Lewis's critique of the Truthmaker Principle, and the ontology of states of affairs that (typically) goes with it. Lewis's claim that he can accept the Truthmaker Principle is also presented here. (shrink)

Since the publication of the successful animal trials of the Biobag, a prototypical extrauterine support for extremely premature neonates, numerous ethicists have debated the potential implications of such a device. Some have argued that the Biobag represents a natural evolution of traditional newborn intensive care, while others believe that the Biobag would create a new class of being for the patients housed within. Kingma and Finn argued inBioethicsfor making a categorical distinction between fetuses, newborns and ‘gestatelings’ in a Biobag on (...) the basis of a conceptual distinction between ectogenesis versus ectogestation. Applying their arguments to the clinical realities of newborn intensive care, however, demonstrates the inapplicability of their ideas to the practice of medicine. Here, I present three clinical examples of the difficulty and confusion their argument would create for clinicians and offer a possible remedy: namely, discarding the term ‘artificial womb’ in favour of ‘Biobag’. In the 1950s and 60s, Martin Heidegger turned to sculpture to rethink the relationship between bodies and space and the role of art in our lives. In his texts on the subject—a catalog contribution for an Ernst Barlach exhibition, a speech at a gallery opening for Bernhard Heiliger, a lecture on bas-relief depictions of Athena, and a collaboration with Eduardo Chillida—he formulates his later aesthetic theory, a thinking of relationality. Against a traditional view of space as an empty container for (...) discrete bodies, these writings understand the body as already beyond itself in a world of relations and conceive of space as a material medium of relational contact. Sculpture shows us how we belong to the world, a world in the midst of a technological process of uprooting and homelessness. Heidegger suggests how we can still find room to dwell therein. Filled with illustrations of works that Heidegger encountered or considered, _Heidegger Among the Sculptors_ makes a singular contribution to the philosophy of sculpture. (shrink)

This article assesses to what extent the future of democratic liberty depends upon its citizens employing a proper approach to the past, by analyzing Tocqueville’s views of three kinds of historical consciousness—aristocratic, revolutionary, and democratic. It is argued that democracies require certain aristocratic assumptions about historical dynamics to cultivate a historical consciousness that fosters liberty. Key to this is the belief in the human capacity to influence the trajectory of history. Tocqueville’s historical approach, which blends aristocratic and democratic elements, is (...) identified as the most effective method for tempering the fatalistic tendencies of the democratic point of view. Thus, for democracies to maintain liberty, citizens should recognize the dual role of general causes and human agency in directing the course of historical events. Tocqueville’s insights on the effects of historical consciousness on the future of democratic liberty remain particularly relevant today when Western democracies confront internal polarization and external anti-democratic challenges, whether neoliberal, illiberal, populist, or fascist. This chapter analyzes the view of Greek philosopher Epicurus on the relation between death and pleasure. It explains Epicurus's views about death and their place in his overall ethical theory, and describes how ancient Epicureans conceived of a pleasurable life within the wider context of their ethical thinking. The chapter also discusses some features of Epicurus's hedonism to evaluate the kind of support it offers for his arguments about death.

In 1976, Fred Miller published a brief, but highly original, paper entitled “Epicurus on the Art of Dying.” This was shortly after Thomas Nagel’s well-known 1970 paper which attempted to counter Epicurus’s claim that death does us no harm, and somewhat before ancient philosophers and their philosophical colleagues started turning Epicurus’s death arguments into a major growth industry. I argue that if Epicurean scholars had taken Miller’s arguments to heart it would have saved them going down a lot of blind (...) alleys in what is now the almost 50 years since the paper appeared. Using elements taken from his arguments, I elaborate them in the light of subsequent scholarship in order to show why a series of leading contemporary interpretations of Epicurean claims about death are deeply inadequate and why Epicurus’s view is not just a clever puzzle, but, as Miller argued, a position with considerable, even attractive, argumentative resources. The paper offers a running commentary on ps-Archytas’ On Intellect and Sense Perception (composed ca. 80 BCE), with the aim to provide a clear description of Hellenistic/post-Hellenistic Pythagorean epistemology. Through an analysis of the process of knowledge and of the faculties that this involves, ps-Archytas presents an original epistemological theory which, although grounded in Aristotelian and Platonic theories, results in a peculiar Pythagorean criteriology that accounts for the acquisition and production of knowledge, as well as for the specific competences of (...) each cognitive faculty. From Nietzsche to the present, the Western philosophical tradition has been dominated by a secular thinking that has dismissed discussion of God as largely irrelevant. In recent years however, the issue of theology has returned to spark some of the most controversial debates within contemporary philosophy. At the beginning of Republic 2 (358e–359b), Plato has Glaucon ascribe a social contract theory to Thrasymachus and ‘countless others’. This paper takes Glaucon’s description to refer both within the text to Thrasymachus’ views, and outside the text to a series of works, most of which have been lost, On Justice or On Law. It examines what is likely to be the earliest surviving work that presents a philosophical defence of law and justice against those who would prefer their opposites, (...) On Excellence by an anonymous author usually referred to as ‘Anonymus Iamblichi’; the views on these topics among the Socratics, including Crito, Simon the Cobbler, Aristippus of Cyrene, and Antisthenes; and Socrates’ debate with Hippias ‘On Justice’ in Xenophon’s Memorabilia (4.4.5–25). Its main contention is that the ‘countless others’ referred to by Glaucon points chiefly, but not solely, to the members of the circle of Socrates, who themselves espoused a range of views on justice and law, and their relations. In 1935 geneticist Nikolai Timoféeff-Ressovsky, radiation physicist Karl G. Zimmer, and quantum physicist Max Delbrück published “On the Nature of Gene Mutation and Gene Structure,” known subsequently as the “Three-Man Paper.” This seminal paper advanced work on the physical exploration of the structure of the gene through radiation physics and suggested ways in which physics could reveal definite information about gene structure, mutation, and action. Representing a new level of collaboration between physics and biology, it played an important role in (...) the birth of the new field of molecular biology. The paper’s results were popularized for a wide audience in the What is Life? lectures of physicist Erwin Schrödinger in 1944. Despite its historical impact on the biological sciences, the paper has remained largely inaccessible because it was only published in a short-lived German periodical. Creating a Physical Biology makes the Three Man Paper available in English for the first time. Brandon Fogel’s translation is accompanied by an introductory essay by Fogel and Phillip Sloan and a set of essays by leading historians and philosophers of biology that explore the context, contents, and subsequent influence of the paper, as well as its importance for the wider philosophical analysis of biological reductionism.
