Die vorliegende Arbeit berücksichtigt die Philosophie und Poetik der Geschichte und der Sprache a priori im poetischen und literarischen Werk von Peter Handke, in seinem poetologischen Essay Ich bin ein Bewohner des Elfenbeinturms und seinem Drama Die Fahrt im Einbaum oder das Stück zum Film vom Krieg, und zwar im Ausgang von der kantianischen Idee der Apriorität der Geschichte. Die Geschichte a priori ist, laut Kant, möglich, „wenn der Wahrsager die Begebenheiten selber macht und veranstaltet, die er zum voraus verkündigt“. (...) Die identische Idee vom Subjekt, das vor der Geschichte besteht, finden wir auch im poetischen Werk von Peter Handke, sowohl in seinen poetologischen Schriften, als auch in seinem dichterischen Werk. Das Ziel der Arbeit ist, durch eine immanente, phänomenologisch-hermeneutische Deutung der Werke des Philosophen und des Schriftstellers die unumstrittene enge Beziehung zwischen ihren geschichtsphilosophischen, bzw. – poetologischen Ideen aufzuweisen und einen allgemeinen philosophisch-dichterischen Rahmen für die Erklärung aller Geschichtsphilosophien ohne Ausnahmen zu geben. The paper compares Pierre Bourdieu?s sociological approach with the one developed by Peter Berger and Thomas Luckmann. The aim of the paper is to identify the complementarities and incongruences of these approaches. The main similarity consists in the intention to?dialectically? overcome/bridge the gap between?objectivism? and?subjectivism? in social theory. Another parallel includes a negative attitude towards the relativistic tendencies of postmodernism. These authors share the thematization of: the body as a locus of social influences, the centrality of language in social life, (...) the social functions of knowledge, and the importance of power in social relations. Differences in theorizing are attributed to the different intellectual, theoretical, and socio-cultural contexts in which these scientists operated. The divergences of these theoretical approaches become evident when one examines the different meaning and significance attached to the concepts of individuation, structure, action, habitus and habitualization, structure of relevance and relation of common-sense and scientific knowledge. Finally, there is a visible difference in political views: Bourdieu was a critic?from the left,? while Berger and Luckmann were self-proclaimed liberal conservatives. (shrink)

My aim in this article is to defend the view that art is a relevant source of knowledge, including moral knowledge, in the absence of empirical evidence corroborating this view. In the first part, I discuss what is known as the causal question, that is, the question regarding art's impact on spectators. I argue that the alleged failure of art to impact us may be a matter of moral motivation and the particular circumstances of moral reasoning more than the cognitive (...) and ethical character of a work. To support my claim, I rely on contemporary research on moral reasoning. I conclude by sketching a wider context within which we should consider art's impact, stressing the relevance of cognitive sciences and moral psychology. (shrink)

This book explores a much-neglected area of moral philosophy--the typology of immorality.

Terms do not always cover the same meaning all the time. While translating into another language we have to take care of possible shifts in meaning in each of both languages. Some examples have been shown here from the new translation of Locke‘s Essay into Czech.

In this article, I defend the cognitive value of certain generic television series. Unlike media and television scholars, who have been appreciative of the informative capacity of television fiction, philosophers have been less willing to acknowledge the way in which these works contribute to our understanding of our social reality. My aim here is to provide one such account, grounded in aesthetic cognitivism, that is, the view that fiction is a source of knowledge. Focusing on crime and courtroom dramas, I (...) start by offering some examples of the cognitive benefits available in some of these series and I argue that the more beneficial cases establish superior mimetic relations with reality, enhancing their capacity to present ethically challenging issues. I then examine whether the fictional dimension of these works presents an obstacle to their informative potential and I conclude that it does not. A central aspect of my account is the claim that the degree of cognitive benefit depends on the underlying narrative strategy of the series. Specifically, there are clues in any given show, including the treatment of ongoing characters, which signal the extent to which it can be taken as mimetically reliable and thus, cognitively valuable. I complete my account by addressing anti-cognitivists’ arguments which call to doubt the informative aspect of television series and their capacity to address ethical concerns. (shrink)

This article lies at the intersection of two problems: the one concerning the potential of fictional works to inform us about our social reality and foster our understanding of its various aspects, and the one concerning their potential to engage with philosophical issues. I bring these two together by analyzing the hit television series Law and Order: Special Victims Unit. According to my interpretation, the series is informative about our social world, and it raises philosophical concerns about it. This makes (...) it well-equipped to fulfill the educative function attributed to mass art by Noël Carroll, and to stand out as an example of what he calls popular philosophy. To support this interpretation, I rely on contemporary views regarding the nature of our engagements with fictional narratives. I then explore how philosophical concerns are generated and I elaborate on the role they have in deepening one’s understanding of one’s social circumstances. I further show how the series provides innovative and independent philosophical knowledge by means specific to the medium of generic serialized fiction. The central part of my argument is an analysis of the narrative strategies which enable the informative and philosophical aspects of the series to generate the series’ educative function. (shrink)

Very often moral disagreements can be resolved by appealing to factual considerations because in these cases the parties to the dispute agree as to which factual considerations are relevant. They agree, that is, with respect to their basic moral standards. Hence, when their disagreement about the non-moral facts is resolved, so is their moral disagreement. But sometimes moral disagreement persists in spite of agreement on factual considerations. When this happens, and when neither party is guilty of illogical thinking, we have (...) a case of moral deadlock. (shrink)

In this paper, I address the question of engaged philosophy with an emphasis on aesthetics and the philosophy of art. Referring to some specific problems discussed in these areas – in particular climate change, ecological crisis and immoral art – I demonstrate that philosophy can be engaged in two ways: (i) in its aspiration to question social reality, culture, human experience and the strategies for making sense of and finding value in that experience; (ii) in the aspiration to contribute to (...) the well-being of individuals and society through its contribution to understanding that reality and experience. First, I point to the connection between the philosophical questions and the fundamental intellectual aspirations of human beings as social and cultural beings, but also as autonomous knowers and valuers. Second, I respond to two objections that can be directed against engaged philosophy: (i) one that points to a lack of consensus among philosophical responses (the problem of disagreement), and (ii) one that highlights the irrelevance of philosophical debates to our social practice. Epicurean epistemology is usually summarised in a controversial thesis according to which all perceptions are true. Although it seems very problematic and counterintuitive, careful investigation of the main sources shows us that Epicurus ’ claim for the truth of perceptions is not so hasty but is supported with some serious arguments. In the paper, I examine the thesis according to which “all perceptions are true”, but my main focus is to analyse the content of Epicurean perception through the following questions: (...) what kind of content do Epicurean perceptions have; what are the proper objects of perception; can we ascribe to such content truth and falsity? In the first part, I say something general about the thesis and point out some basic characteristics of perceptions due to which they serve as a criterion of truth. Next I try to show that the proper objects of perceptions are eidola and not external objects because only in that case can Epicurus maintain the truth of all perceptions, including illusions, hallucinations, dreams and other misperceptions. In the third part, I argue that such Epicurean perceptual content can be explained by the modern notion of non-conceptual content, which helps us to understand the special feature of Epicurean perceptions and also the important difference between perception and belief in Epicurean epistemology. In the final part, I discuss the notion of alethes which I suggest implies that perception is “factive”. (shrink)

The second Yearbook of the Central East European Forum of Young Legal, Political and Social Theorists aims at reassessing some major legacies of jurisprudence and political philosophy, thereby celebrating one hundred years from the publication of the first important theoretical account of Hans Kelsen - Hauptprobleme der Staatsrechtslehre; the fifty-years anniversary of one of the most important contemporary books in legal theory - Herbert Hart's The Concept of Law; as well as the forty-years heritage of the most influential 20th century (...) account of justice - John Rawls's A Theory of Justice. On this occasion fourteen scholars from Eastern and Central Europe gave their accounts and interpretations of jurisprudential and political philosophical problems that persist or emerge anew in contemporary debates. I present an analysis according to which the current state of the definition of substitution leads to a contradiction in the system of Transparent Intensional Logic. I entail the contradiction using only the basic definitions of TIL and standard results. I then analyse the roots of the contradiction and motivate the path I take in resolving the contradiction. I provide a new amended definition of collision-less substitution which blocks the contradiction in a non-ad hoc way. I elaborate on the consequences (...) of the amended definition, namely the invalidity of the Church-Rosser theorem. I present a counterexample to the validity of the theorem in TIL with an amended definition of substitution. (shrink)

In this paper I follow Ted Nannicelli in the project of establishing boundaries of television works. I focus on serialized television works pertaining to a particular genre and I set out to provide an account of their identity. My claim is that external identity of such works is determined by their specific genre-affiliation, given the way in which generic norms determine the content of the series, namely, its characteristic storylines and regular set of characters. From the internal perspective, a series’ (...) identity is determined by the particular way in which it implements abstract generic norms. I describe the process of such implementation as creation of series-specific formulaic patterns, and I analyze different layers of works where such patterns are evident. My central claim is that series-specific formulaic patterns create a coherent set of norms which, through repeated instantiation in the series’ episodes, become associated with that particular series. The function of this set is to establish the series’ boundaries, and to maintain its identity when different modifications to the patterns are made. (shrink)

The convergence of computing, sensing, and communication technology will soon permit large-scale deployment of self-driving vehicles. This will in turn permit a radical transformation of traffic control technology. This paper makes a case for the importance of addressing questions of social justice in this transformation, and sketches a preliminary framework for doing so. We explain how new forms of traffic control technology have potential implications for several dimensions of social justice, including safety, sustainability, privacy, efficiency, and equal access. Our central (...) focus is on efficiency and equal access as desiderata for traffic control design. We explain the limitations of conventional traffic control in meeting these desiderata, and sketch a preliminary vision for a next-generation traffic control tailored to address better the demands of social justice. One component of this vision is cooperative, hierarchically distributed self-organization among vehicles. Another component of this vision is a priority system enabling selection of priority levels by the user for each vehicle trip in the network, based on the supporting structure of non-monetary credits. This paper deals with generalisations of modally based criteria for determining whether a given property is essential to an individual to the case of generic essences. These criteria usually presuppose extensionally individuated properties. The limitations of their generalisations are demonstrated using the case of the necessarily empty individual property and the necessarily empty individual office. I do not present a novel stance on the discussion of individual essences. The novelty of this paper lies in its claim that none of these (...) criteria can be generalised to generic essences. Ovaj rad se bavi metodološkim aspektima obnovljenih pravno-filozofskih nastojanja da se preispita pojam međunarodnog prava. Posle kratkog osvrta na istoriju pravne filozofije i ključne tačke Hartovog i Kelzenovog pozitivističkog stanovišta, u radu se dalje ispituje na koji način se savremene pravne teorije, kako u pozitivističkoj, tako i u ne-pozitivističkoj tradiciji, bave međunarodnim pravom. Poslednji deo rada predstavlja pokušaj da se skiciraju određene smernice za novi početak u filozofskoj obradi međunarodnog prava. Prvo, istorija rasprava u ovoj oblasti svedoči o tome da (...) su metodološki pravni teoretičari u pravu kada tvrde da nam utvrđivanje odgovarajućeg metoda pomaže u odgovoru na pitanje šta je pravo. Drugo, imajući na umu stalno promenjivu prirodu međunarodnog prava, odgovarajući metodološki pristup zahteva „evolucionarnu epistemologiju“ (D’Amato), koja teško da se može nazvati obeležjem analitičke jurisprudencije. Najzad, takva epistemologija je na kompleksan način povezana sa našim istraživanjem šta međunarodna pravda ili, bar, šta međunarodna „unutrašnja moralnost“ zahteva. (shrink)

Starting from the generalized concept of syntactically and semantically trivial differences between two formal theories introduced by Arsenijević, we show that two systems of the linear continuum, the Cantorian point-based system and the Aristotelian interval-based system that satisfies Cantor's coherence condition, are only trivially different. So, the 'great struggle' (to use Cantor's phrase) between the two contending parties turns out to be 'much ado about nothing'.

We establish the hierarchy among twelve equivalence relations on the class of relational structures: the equality, the isomorphism, the equimorphism, the full relation, four similarities of structures induced by similarities of their self-embedding monoids and intersections of these equivalence relations. In particular, fixing a language L and a cardinal κ, we consider the interplay between the restrictions of these similarities to the class ModL of all L-structures of size κ. It turns out that, concerning the number of different similarities and (...) the shape of the corresponding Hasse diagram, the class of all structures naturally splits into three parts: finite structures, infinite structures of unary languages, and infinite structures of non-unary languages. Das Problem der Stelle, welche das Volkerrecht in Hegels philosophischem System einnimmt, stellt die Konzeption und den Inhalt seiner rechtspolitischen Theorie in Frage. Insbesondere dadurch was der Autor als "souveranes Vergehen" und "idealistische Casur" beschreibt. Die Grundlinien dieser Arbeit kehren zuruck zu den grundlegenden Figuren der Philosophie Hegels und ziehen sich auf den Problemkreis des Verhaltnisses zwischen des Rechts und der Geschichte, in Rucksicht auf die konstitutive Rolle der Gewalt bei jeder Institutionalisierung des Rechts und der Begrundung neuer Lebensgestalten, zusammen. Das Hauptthese konzentriert sich auf das Bestehen der dialektischen Kluft innerhalb der Hegelschen Differenzierung zwischen der Freiheitsvollendung im Staate und dem philosophischen Wissen, das fur die Weltgeschichte grundlegend ist: der Begriff der absoluten Freiheit, der in seiner Abstraktheit in der Weltgeschichte seine Kraft der Zerstorung zeigt, ist gerade dasselbe, was am Begriff der Philosophie selbst tief geschichtlich ist, worin er aber seine konkrete Macht bei der Entstehung neuer normativer Ordnungen mit sich bringt. In dieser Arbeit werde ich versuchen zu zeigen, dass die Frage nach der Natur der Erde, die eine der ersten Fragen des frühen Kants ist, sowohl in der Kritik der Urteilskraft, als auch in dem schriftlichen Nachlass , wieder zum Zentrum seines philosophischen Denkens kommt. Der späte Kant verbindet diese Frage streng mit dem Prinzip subjektiver Zweckmäßigkeit und kritisiert im Opus postumum, insbesondere im Anschluss an den Übergang von den metaphysischen Anfangsgründen der Naturwissenschaft zur Physik, die übliche Erdauffassung als den (...) Besitz der menschlichen Gattung und findet, aufgrund des Zweckmäßigkeitsprinzips, welches für die teleologische Urteilskraft maßgebend ist, dass es notwendig ist, das menschliche Verhältnis zur Erde wesentlich mit Rücksicht auf die körperlich-geographischen Grenzen unserer Erkenntnis zu überprüfen. In der Kantischen Philosophie finde ich die Idee einer zweckmäßigen Geoethik, die sich mit dem Problem der menschlichen Sesshaftigkeit auf der Erde und mit ihrer räumlich-moralischen Orientierung in der Welt beschäftigt. Die Welt der Vernunftwesen wird sich daher ihrer geo-ethisch-rechtlichen Grenzen bewusst. Daher legt Kants Auffassung der Zweckmäßigkeit die Grundlage für die Formulierung einer Ekopolitik, die nach dem Zusammenwirken zwischen dem Menschen und seiner Umwelt fragt. (shrink)

A maximal almost disjoint (mad) family $\mathscr{A} \subseteq [\omega]^\omega$ is Cohen-stable if and only if it remains maximal in any Cohen generic extension. Otherwise it is Cohen-unstable. It is shown that a mad family, A, is Cohen-unstable if and only if there is a bijection G from ω to the rationals such that the sets G[A], A ∈A are nowhere dense. An ℵ 0 -mad family, A, is a mad family with the property that given any countable family $\mathscr{B} \subset (...) [\omega]^\omega$ such that each element of B meets infinitely many elements of A in an infinite set there is an element of A meeting each element of B in an infinite set. It is shown that Cohen-stable mad families exist if and only if there exist ℵ 0 -mad families. Either of the conditions b = c or $\mathfrak{a} ) implies that there exist Cohen-stable mad families. Similar results are obtained for splitting families. For example, a splitting family, S, is Cohen-unstable if and only if there is a bijection G from ω to the rationals such that the boundaries of the sets G[S], S ∈S are nowhere dense. Also, Cohen-stable splitting families of cardinality ≤ κ exist if and only if ℵ 0 -splitting families of cardinality ≤ κ exist. (shrink)

In order to show the validity of here proposed conception of social ontology and its advantages over descriptive theories of social reality, which in the analysis of the socio-ontological status of human rights find only legally understood normativity as present in social reality, we will first lay out Searle’s interpretation of human rights. In the second step, we will introduce the methodical approach and basic concepts of our socio-ontological position, and explain the structure of the relationship between justice, law, morality, (...) social institutions and collective intentionality. At the end we will show how our theory of social ontology is better than Searle’s legal positivism in examining the ontological status of human rights. At the end, we show in what ways such a theory of social ontology more intuitively and with wider arguments explains the ontological status of institution of human rights than Searle’s legal positivism. In a departure from the mainstream methodology of a positivist-oriented jurisprudence, Collective Rights provides the first legal-theoretical treatment of this area. It advances a normative-moral standpoint of 'value collectivism' which goes against the traditional political philosophy of liberalism and the dominant ideas of liberal multiculturalism. Moreover, it places a theoretical account of collective rights within the larger debate between proponents of different rights theories. By exploring why 'collective rights' should be differentiated from similar legal concepts, the relationship between collective and (...) individual rights and why groups should be recognised as the third distinctive type of right-holders, it presents the topic as connected to the larger philosophical debate about international law of human rights, most notably to the problem of universality of rights. The goal of this article is to deepen the concept of emerging urban mobility technology. Drawing on philosophical everyday and urban aesthetics, as well as the postphenomenological strand in the philosophy of technology, we explicate the relation between everyday aesthetic experience and urban mobility commoning. Thus, we shed light on the central role of aesthetics for providing depth to the important experiential and value-driven meaning of contemporary urban mobility. We use the example of self-driving vehicle (SDV), as potentially mundane, public, (...) dynamic, and social urban robots, for expanding the range of perspectives relevant for our relations to urban mobility technology. We present the range of existing SDV conceptualizations and contrast them with experiential and aesthetic understanding of urban mobility. In conclusion, we reflect on the potential undesired consequences from the depolitization of technological development, and potential new pathways for speculative thinking concerning urban mobility futures in responsible innovation processes. Dílo Hélène Metzgerové tvoří významný zdroj informací o dějinách chemie. Cílem tohoto textu je však představení jeho epistemologického rozměru. Na základě zkoumání dějin vědy Metzgerová formuluje epistemologické teze o vědeckém poznání obecně, ale vztahuje je i na práci historiků vědy. Vytváří tak epistemologii historiografie vědy, která má být alternativou k historiografii pozitivistické. Akceptuje duhemovský holismus i tezi o nedourčenosti teorie fakty, což vztahuje i na interpretace starých textů. Rozpracovává tak filosofickou metodu historiografie vědy, která se svými principy blíží hermeneutice.

At the basis of tireless efforts to explain the nature of law lies the question of how judges should decide cases. Therefrom arises a need for a theory that would clarify the role of the courts and, moreover, provide guidance to them on reaching judgments. The history of legal theory abounds with various attempts to offer a generally acceptable answer to the question raised. The fervor of debate and the perpetual dissatisfaction with offered solutions prompted the thought of untamable arbitrariness (...) of judges. In the contemporary debate the significance of argumentation is particularly emphasized as a link of the court procedure which provides reasonableness and therewith justification and persuasiveness of the decision. Before going into the matter, I will indicate in broad strokes which areas of legal theory do argumentation and interpretation belong to. The purpose of setting a conceptual framework is to prevent losing sight of the whole as well as to limit the scope of discourse to a certain section of legal issues. The second part deals with the concept of argumentation in general and some specific features of the argumentation in law. The third part examines the role of legal interpretation and draws a clear distinction between the interpretation as a process and the interpretation as a result. At the end of the discussion I shall put forward a thesis that the interpretation as a process is argumentation, while the interpretation as a result is an argument in the justification of judgment. nema.
