We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. The present qualitative study analyzes how a group of young people already involved in STEM fields perceive the prototypical person working in STEM. Gender differences between participants in technological and non-technological STEM fields were analyzed. A total of 27 young people (59.3% women) took part in the interviews (Mean Age = 25.48 years). Of them, 16 participants were working in STEM professions, and 11 were enrolled in the final courses of STEM degrees. The results of the content analysis were examined (...) in light of social role theory and the multidimensional structure of gender stereotypes. Men in these fields were therefore attributed an unappealing and weird physical appearance. Some female participants linked STEM professionals’ intellectual abilities to the stereotype that men have higher abilities in these fields. Whereas females attributed effort and perseverance to STEM professionals’ intellectual aptitudes, males referred to the development of soft skills. Participants in technological STEM fields connected the stereotype of being a ‘weirdo’ to a boring job, whereas those in non-technological fields linked it to their unconventional character. Some participants were disappointed by a lack of correspondence between expectations and the actual job STEM professionals do. Moreover, females in technological STEM fields commented on the job’s low social impact, while males mentioned low attainment of technical qualifications. Most referents in STEM fields were masculine, some of whom were present in the mass media. The practical implications of the findings are discussed. (shrink)

Se usa la hermenéutica comprensiva, diatópica y ecosófica como transmétodo de construcción teórica para sustentar la con-formación de los investigadores educativos venezolanos desde la tríada transdisciplinariedad-ecosofía-antropoética, como retos urgentes en Venezuela. Existen problemáticas profundas en el accionar del ciudadano que se conforma en la educación universitaria, ya que el ser humano, en su parcelación del conocimiento, ha olvidado que somos seres biológicos, psíquicos, espirituales, sociales, ambientales, etéreos, culturales, y que cada aspecto no se puede estudiar por separado ya que es (...) un complexus. Todo ello, aunado a la mercantilización, a temas como la inclusión, la pertinencia y la con-formación, junto a la formación docente en los posgrados, se analiza frecuentemente. Se concluye que con la antropoética se debe alcanzar la toma de consciencia que se necesita en la investigación y en la formación de educadores y que, por encima de la mercantilización, existe la responsabilidad social compleja de la formación de ese docente como ciudadano planetario. Based on his Inclosure Schema and the Principle of Uniform Solution (PUS), Priest has argued that Curry’s paradox belongs to a different family of paradoxes than the Liar. Pleitz (2015, The Logica Yearbook 2014, pp. 233–248) argued that Curry’s paradox shares the same structure as the other paradoxes and proposed a scheme of which the Inclosure Schema is a particular case and he criticizes Priest’s position by pointing out that applying the PUS implies the use of a paraconsistent logic that (...) does not validate Contraction, but that this can hardly seen as uniform. In this paper, we will develop some further reasons to defend Pleitz’ thesis that Curry’s paradox belongs to the same family as the rest of the self-referential paradoxes & using the idea that conditionals are generalized negations. However, we will not follow Pleitz in considering doubtful that there is a uniform solution for the paradoxes in a paraconsistent spirit. We will argue that the paraconsistent strategies can be seen as special cases of the strategy of restricting Detachment and that the latter uniformly blocks all the connective-involving self-referential paradoxes, including Curry’s. In the first edition of the Origin of Species, Charles Darwin apologized for not correctly referencing all the works cited in his magnum opus. More than 150 years later we have catalogued these citations and analyzed the resultant data. Looking for a complete selection of collaborators, a flexible interpretation of the term citation was necessary; we define it as any reference made to a third party, independently of its form or function. Following the same idea, the sixth edition of the (...) Origin, originally published in 1872 and reprinted with minor additions and corrections in 1876, was chosen for the research because it represents the end of a long debate between Darwin and his peers. It naturally is the edition with the greatest number of citations and collaborators. Through a diverse theoretical analysis, we aim to present a new perspective for the study of the Origin of Species: a bibliographic approach that provides the tools needed to understand the history of the book as a physical and cultural object. Bibliometrics provides a theory of citations as well as a quantitative analysis; science studies highlights the profound social aspects of science in the making. The analysis resulted in 639 citations to 298 collaborators and provided a new perspective of the rhetorical structure of the Origin, even though these results are only the tip of the iceberg of the potential of all the data gathered in this study. The expressivist account of knowledge attributions, while claiming that these attributions are nonfactual, also typically holds that they retain a factual component. This factual component involves the attribution of a belief. The aim of this work is to show that considerations analogous to those motivating an expressivist account of knowledge attributions can be applied to belief attributions. As a consequence, we claim that expressivists should not treat the so-called factual component as such. The phenomenon we focus on to claim that (...) belief attributions are non-factual is that of normative doxastic disagreement. We show through several examples that this kind of disagreement is analogous to that of the epistemic kind. The result will be a doxastic expressivism. Finally, we answer some objections that our doxastic expressivism could seem to face. (shrink)

The aim of this paper is to defend moral relativism from the accusation that it would make it irrational to classify past changes in public opinion as instances of moral progress, for they would constitute an improvement only from our current point of view. The argument is this. For our assessment of a change in public opinion as an instance of moral progress to be rational, we need to take the moral claims made before the change to be false simpliciter (...) while being open to the possibility that we ourselves change our minds at some point. These two things can be made compatible if we construe moral relativism as taking the truth of moral claims to be relative to the context of assessment. Thus understood, moral relativism is in fact the only view that makes room for talk of moral progress, as the rest of candidate positions make it irrational. (shrink)

In the present work we explore the effects that an H impurity produces upon the geometry and electronic structure of the CaTiO 3 crystal considering the cubic and orthorhombic crystallographic lattices of the material. A quantum-chemical method based on the Hartree-Fock formalism and the periodic large-unit-cell model is used throughout the work. The analysis of the results shows that the interstitial H impurity binds to one of the O atoms forming the so-called O-H group. At equilibrium, the O-H distances are (...) found to be equal to 0.89 and 1.04 Å for cubic and orthorhombic lattices respectively. Atomic displacements and relaxation energies are analysed comparing the obtained results in the cubic lattice with those in the orthorhombic lattice. In the cubic phase the computed relaxation energy of vicinity of the O-H group is found to be equal to 1.1 eV and the atomic displacements generally obey the Coulomb law. So, the negatively charged O atoms move outwards from the defective region by about 0.09 Å while the positively charged Ti and Ca atoms move towards the defective region by about 0.05 and 0.01 Å respectively. A similar effect is observed in the orthorhombic lattice of CaTiO 3 doped with an H atom. It is necessary to mention that different O positions in the orthorhombic structure are considered for the O-H bond creation. The computed relaxation energies of the atomic displacements in this structure are found to be equal to 2.3 and 2.1 eV depending on the crystallographic type of the bonding O atom. (shrink)

Astrology, its legitimacy, and the limits of its acceptable practice were debated in sixteenth- and seventeenth-century Europe. Many of the related arguments were mediated by the work of Giovanni Pico della Mirandola and the responses to it. Acknowledging the complexities of the relationship between astrological ideas and Christian teachings, this paper focuses on the Catholic debates by specifically considering the decisions about astrology taken by the Spanish Inquisition. The trials of astrologers are examined with the aim of understanding the role (...) of experts in astrology in early modern Spain. This study brings into view the specific nature of the debate on astrology in Spain, the consequences of the actions of the Inquisition and the social control it exerted. The historical events discussed comprise a particular case and also mirror the general debates about astrology taking place in early modern Europe. The experts’ opinions expressed in trials and in reports about the discipline received by the Inquisition reveal two key traits of the debate: the dispute about who had the authority to decide on the legitimacy of astrology and the disagreement about what constituted natural and judicial astrological practices. These led to different opinions about what was to be done with each defendant and about what content in their books ought to be forbidden. (shrink)

Fatherhood’s subjective experience in the face of adolescent children’ depressive symptomatology and suicide attempt. The fatherhood’s experience of living with a teenage son or daughter who presents depressive symptomatology and has tried to commit suicide constitutes a subjective experience in and of itself. For the father, these adverse conditions represent a challenge in his constituted role and cause an emotional impact which must be analysed by considering his subjective constitution. The aim of this research is to explore this experience by (...) using a phenomenological qualitative approach. To do that, semi-structured interviews and the application of a test of incomplete sentences were applied to parents whose adolescent children received ambulatory care after a first suicide attempt in a psychiatric hospital in Peru. The results show that participants experience various emotions that involve impotence, anger, sadness, guilt, and relief around three stages: the onset of symptoms, attendance at a psychiatric hospital and the perception of remission of the symptoms. It was found that although at the beginning the fathers find it difficult to get involved with affection with their younger children, they are able to recover the bond through of the reconstitution and reorganization of their role. Abstract:: This essay addresses the notion of public order from the point of view of biopolitics. With that aim, it relates the authoritarian response to social protest with the moral ordering of public space, using the case of the 15-M movement in Spain. Then, it reads the notion of public order as a dispositive, in the Foucauldian sense of the term. Departing from there, it presents a brief genealogical approach to the relations among sexual and racial ordering o public space. (...) Finally, in dialogue with Sarah Ahmed and Mary Douglas, it explores the role of the biopolitics of public order in the constitution and policing of the moral and physical, internal and external borders separating the political community from its various others. This paper argues that the linguistic approach to analyzing induction, according to which induction is a type of inference or argument composed of statements or propositions, is unsuitable to account for scientific reasoning. Consequently, a novel approach to induction in model-based science is suggested. First, in order to show their adherence to the linguistic treatment of induction, two strategies are reviewed: (i) Carnap and Reichenbach’s attempts to justify induction and (ii) Norton’s recent material theory of induction. Second, three reasons are (...) provided to support the claim that the linguistic treatment of induction is insufficient in accounting for model-based reasoning in science. Finally, a framework focused on models—rather than statements or propositions—is suggested to address induction in science. William Whewell’s theory of induction is briefly outlined as an example of a non-propositional treatment of induction that is consistent with model-based scientific practice. (shrink)

Traditional attempts to understanding inductive reasoning in science have typically involved analyzing language, focusing on statements or propositions. However, recent arguments suggest that this approach misconceives induction, prompting the need for a new perspective. This study offers a fresh view on induction by integrating William Whewell's theory of induction, which distinguishes two forms of reasoning: interpretation and representation. This perspective suggests that induction can be seen as a reasoning process based on semantic and pragmatic models rather than statements or propositions.

Contrary to the outstanding simplistic view of the taste system, learning studies show a more complex picture. Behavioral data using conditioned taste preference and aversion tasks support the idea that mixtures involve complex interactions between individual taste cues. Evidence from taste conditioned blocking, taste perceptual learning, and taste learned preferences is considered to support such a view. Greater support for research in taste learning and memory is required for a complete understanding of taste recognition.

La idea de la Unión Europea entendida como la había soñado Häberle como un conjunto unido, formado por Estados independientes que colaborarían entre sí para ayudarse mutuamente, es un bello sueño que no parece tener un reflejo real. Existe una Unión Europea que ha funcionado como tal en múltiples ocasiones, pero no termina de ser eficaz. Situaciones como la de la pandemia del COVID o la guerra de Ucrania, así lo demuestran. Es preciso cambiar esta tendencia. Debemos potenciar la idea (...) de «más Europa» y para ello debemos buscar, creo, la vuelta a los valores que configuraron en su día esa unión y que son los únicos que pueden recordar a Europa cual es su destino. En este artículo se analiza la fuerza actual de Europa tomando como base la epidemia del COVID tanto en España como en los países limítrofes. ¿Funcionó en este caso la Unión como verdadera Unión? O ¿es preciso fortalecer esta Unión para que nunca vuelva a desfallecer? Creo que este trabajo ofrece respuestas a estos interrogantes. (shrink)

A considerable number of books and papers have analyzed normative concepts using new techniques developed by logicians; however, few have bridged the gap between the English legal culture and the Continental tradition in legal philosophy. This book addresses this issue by offering an introductory study on the many possibilities that logical analysis offers the study of legal systems. The volume is divided into two sections: the first covers the basic aspects of classical and deontic logic and its connections, advancing an (...) explanation of the most important topics of the discipline by comparing different systems of deontic logic and exploring some of the most important paradoxes in its domain. The second section deals with the role of logic in the analysis of legal systems by discussing in what sense deontic logic and the logic of norm-propositions are useful tools for a proper understanding of the systematic structure of law. Inductive generalization, where people go beyond the data provided, is a basic cognitive capability, and it underpins theoretical accounts of learning, categorization, and decision making. To complete the inductive leap needed for generalization, people must make a key ‘‘sampling’’ assumption about how the available data were generated. Previous models have considered two extreme possibilities, known as strong and weak sampling. In strong sampling, data are assumed to have been deliberately generated as positive examples of a concept, whereas in weak sampling, (...) data are assumed to have been generated without any restrictions. We develop a more general account of sampling that allows for an intermediate mixture of these two extremes, and we test its usefulness. In two experiments, we show that most people complete simple one-dimensional generalization tasks in a way that is consistent with their believing in some mixture of strong and weak sampling, but that there are large individual differences in the relative emphasis different people give to each type of sampling. We also show experimentally that the relative emphasis of the mixture is influenced by the structure of the available information. We discuss the psychological meaning of mixing strong and weak sampling, and possible extensions of our modeling approach to richer problems of inductive generalization. (shrink)
