What does it mean to trust the results of a computer simulation? This paper argues that trust in simulations should be grounded in empirical evidence, good engineering practice, and established theoretical principles. Without these constraints, computer simulation risks becoming little more than speculation. We argue against two prominent positions in the epistemology of computer simulation and defend a conservative view that emphasizes the difference between the norms governing scientific investigation and those governing ordinary epistemic practices.

Patterns in the data on human sexuality support the hypothesis that the bases of sexual emotions are products of natural selection. Most generally, the universal existence of laws, rules, and gossip about sex, the pervasive interest in other people's sex lives, the widespread seeking of privacy for sexual intercourse, and the secrecy that normally permeates sexual conduct imply a history of reproductive competition. More specifically, the typical differences between men and women in sexual feelings can be explained most parsimoniously as (...) resulting from the extraordinarily different reproductive opportunities and constraints males and females normally encountered during the course of evolutionary history. Men are more likely than women to desire multiple mates; to desire a variety of sexual partners; to experience sexual jealousy of a spouse irrespective of specific circumstances; to be sexually aroused by the sight of a member of the other sex; to experience an autonomous desire for sexual intercourse; and to evaluate sexual desirability primarily on the bases of physical appearance and youth.The evolutionary causes of human sexuality have been obscured by attempts to find harmony in natural creative processes and human social life and to view sex differences as complementary. The human female's capacity for orgasm and the loss of estrus, for example, have been persistently interpreted as marriage-maintaining adaptations. Available evidence is more consistent with the view that few sex differences in sexuality are complementary, that many aspects of sexuality undermine marriage, and that sexuality is less a unifying than a divisive force in human affairs. BackgroundViral pandemics present a range of ethical challenges for policy makers, not the least among which are difficult decisions about how to allocate scarce healthcare resources. One important question is whether healthcare workers should receive priority access to a vaccine in the event that an effective vaccine becomes available. This question is especially relevant in the coronavirus pandemic with governments and health authorities currently facing questions of distribution of COVID-19 vaccines.Main textIn this article, we critically evaluate the most common ethical (...) arguments for granting healthcare workers priority access to a vaccine. We review the existing literature on this topic, and analyse both deontological and utilitarian arguments in favour of HCW prioritisation. For illustrative purposes, we focus in particular on the distribution of a COVID-19 vaccine. We also explore some practical complexities attendant on arguments in favour of HCW prioritisation.ConclusionsWe argue that there are deontological and utilitarian cases for prioritising HCWs. Indeed, the widely held view that we should prioritise HCWs represents an example of ethical convergence. Complexities arise, however, when considering who should be included in the category of HCW, and who else should receive priority in addition to HCWs. (shrink)

How can we be certain that software is reliable? Is there any method that can verify the correctness of software for all cases of interest? Computer scientists and software engineers have informally assumed that there is no fully general solution to the verification problem. In this paper, we survey approaches to the problem of software verification and offer a new proof for why there can be no general solution.

Several ethicists have defended the use of responsibility-based criteria in healthcare rationing. Yet in this article we outline two challenges to the implementation of responsibility-based healthcare rationing policies. These two challenges are, namely, that responsibility for past behavior can diminish as an agent changes, and that blame can come apart from responsibility. These challenges suggest that it is more difficult to hold someone responsible for health related actions than proponents of responsibility-sensitive healthcare policies suggest. Technologies that deploy data science methods are liable to result in epistemic harms involving the diminution of individuals with respect to their standing as knowers or their credibility as sources of testimony. Not all harms of this kind are unjust but when they are we ought to try to prevent or correct them. Epistemically unjust harms will typically intersect with other more familiar and well-studied kinds of harm that result from the design, development, and use of data science technologies. However, (...) we argue that epistemic injustices can be distinguished conceptually from more familiar kinds of harm. We argue that epistemic harms are morally relevant even in cases where those who suffer them are unharmed in other ways. Via a series of examples from the criminal justice system, workplace hierarchies, and educational contexts we explain the kinds of epistemic injustice that can result from common uses of data science technologies. Poststructuralist Discourse Theory is, in my view, a social theory for our time; embracing, as it does, the unconscious and capable of providing new insights into everything from the rise of Trumpian “post truth” through to our collective inability to universally engage with the existential threat of climate change. This article suggests an approach to the empirical analysis of problematised discourses starting from a search for dislocations. I draw from the writings of Laclau, Adorno and Derrida and use Žižek’s Lacanian (...) reading of Hegel to find support for this approach as one useful way to proceed towards new critical explanations and understandings. Cognitive fatigue is a problem for the safety of critical systems as it can lead to accidents, especially during unexpected events. In order to determine the extent to which it disrupts adaptive capabilities, we evaluated its effect on online and anticipatory control. Despite numerous studies conducted to determine its effects, the exact mechanism affected by fatigue remains to be clarified. In this study, we used distribution and electromyographic analysis to assess whether cognitive fatigue increases the capture of the incorrect automatic (...) response or if it impairs its suppression, and whether the conflict adaptation effect is reduced. To this end, we evaluated the evolution of the performance over time during the Simon task, a classic conflict task that elicits incorrect automatic responses. To accentuate the presence of fatigue during the Simon task, two groups previously performed a dual-task with two different cognitive load levels to create two different levels of fatigue. The results revealed that time on task impaired online control by disrupting the capacity to suppress the incorrect response but leaving unaffected the expression of the automatic response. Furthermore, participants emphasized speed rather than accuracy with time on task, with in addition more fast guesses, suggesting that they opted for a less effortful response strategy. As the implementation of the suppression mechanism requires cognitive effort, the conjunction of these results suggests that the deficits observed may be due to disengagement of effort over time rather than reflecting an incapacity to make an effort. The past decade has seen a burgeoning of scholarly interest in conscientious objection in health care. Specifically, several commentators have discussed the implications that conscientious objection has for the delivery of timely, efficient, and nondiscriminatory medical care. In this paper, I discuss the main argument put forward by the most prominent critics of conscientious objection—what I call the Professional Duty Argument or PDA. According to proponents of PDA, doctors should place patients’ well-being and rights at the center of their professional (...) practice. Doctors should be prepared to set their personal moral or religious beliefs aside where these beliefs conflict with what is legal and considered good medical practice by relevant professional associations. Conscientious objection, on this account, should be heavily restricted, if even allowed at all. I discuss two powerful objections against PDA. The first objection, which I call the fallibility objection, notes that law and professional codes of conduct are fallible guides for ethical conduct and that conscientious objection has in the past and continues today to provide a check on aberrations in law and professional convention. The second, which I call the professional discretion objection, states that restrictions on conscientious objection undermine one of the cornerstones of good medical practice, namely, a practitioner’s right to independent professional judgment. I argue that these two objections give us reason to retain conscience clauses in professional codes of conduct. (shrink)

This paper argues that the difference between contemporary software intensive scientific practice and more traditional non-software intensive varieties results from the characteristically high conditionality of software. We explain why the path complexity of programs with high conditionality imposes limits on standard error correction techniques and why this matters. While it is possible, in general, to characterize the error distribution in inquiry that does not involve high conditionality, we cannot characterize the error distribution in inquiry that depends on software. This paper responds to Jaegwon Kim's powerful objection to the very possibility of genuinely novel emergent properties. Kim argues that the incoherence of reflexive downward causation means that the causal power of an emergent phenomenon is ultimately reducible to the causal powers of its constituents. I offer a simple argument showing how to characterize emergent properties m terms of the effects of structural relations an the causal powers of that. constituents.

Conscience is an idea that has significant currency in liberal democratic societies. Yet contemporary moral philosophical scholarship on conscience is surprisingly sparse. This paper seeks to offer a rigorous philosophical account of the role of conscience in moral life with a view to informing debates about the ethics of conscientious objection in medicine. I argue that conscience is concerned with a commitment to moral integrity and that restrictions on freedom of conscience prevent agents from living a moral life. In section (...) one I argue that conscience is a principle of moral awareness in rational agents, and that it yields an awareness of the personal nature of moral obligation. Conscience also monitors the coherence between an agent’s identity-conferring beliefs and intentions and their practical actions. In section two I consider how human beings are harmed when they are forced to violate their conscience. Restrictions on the exercise of conscience prevent people from living in accord with their own considered understanding of the requirements of morality and undermine one’s capacity for moral agency. This article concludes with a consideration of how a robust theory of conscience can inform our understanding of conscientious objection in medicine. I argue that it is in the interest of individual practitioners and the medical profession generally to foster moral agency among doctors. This provides a prima facie justification for permitting at least some kinds of conscientious objection. (shrink)

There has been significant debate about whether the moral norms of medical practice arise from some feature or set of features internal to the discipline of medicine. In this article, I analyze Edmund Pellegrino’s conception of the internal morality of medicine, and situate it in the context of Alasdair MacIntyre’s influential account of “practice.” Building upon MacIntyre, Pellegrino argued that medicine is a social practice with its own unique goals—namely, the medical, human, and spiritual good of the patient—and that the (...) moral norms that govern medical practice are derived from these goals. After providing an overview of Pellegrino’s work, I discuss some forceful objections to his theory—specifically, that it is too rigid and incapable of entering into dialogue with contemporary values systems; that it is dependent on an external conception of human flourishing; and that it is incompatible with the rapidly changing nature of modern medicine. In the final section of this article, I consider how theorists working in the Hippocratic tradition might respond to these objections against ethical essentialism by drawing upon MacIntyre’s historico-cultural method as well as what he calls Aristotle’s “metaphysical biology.”. This book sets out to redress the balance and develop an understanding of what comprises ethical leadership in organizations.

New forms of river management have emerged following widespread recognition of the environmental damage caused by attempts to harness and control rivers for navigation, consumptive water use and power generation. A dominant top-down engineering-based paradigm is being challenged by catchment-framed, ecosystem-based approaches which claim to place greater emphasis on participation and equity. However, there has been limited attention given to examining these claims, and principles of justice are frequently left unarticulated or embedded in what is still presented as an essentially (...) technical, outcome-driven management process. This paper examines the contribution of an environmental justice framework in articulating and explicating the ethical and political nature of decision making in stream rehabilitation practice. Particular attention is given to distributive, procedural and relational elements of justice, and to the limitations of an anthropocentric approach. A broader-based ecological justice framework is proposed. Several key issues in applying this framework are discussed, including the need for 'situated justice', for multiple voices to be heard, for dealing with unity and diversity at the catchment scales, and in integrating knowledge through genuine transdisciplinary research and practice. Many if not most sperm donors in the early years of IVF donated under conditions of anonymity. There is, however, a growing awareness of the ethical cost of withholding identifying parental information from donor children. Today, anonymous donation is illegal in many jurisdictions, and some jurisdictions have gone as far as retrospectively invalidating contracts whereby donors were guaranteed anonymity. This article provides a critical evaluation of the ethics and legality of anonymous donation. We defend Australian and British legislation that has (...) outlawed donor anonymity, and we argue for the establishment of a central registry that provides donor children with the ability to easily and reliably access identifying information about their donor parents. Many ethicists argue that we should respect persons when we distribute resources. Yet it is unclear what this means in practice. For some, the idea of respect for persons is synonymous with the idea of respect for autonomy. Yet a principle of respect for autonomy provides limited guidance for how we should distribute scarce medical interventions. In this article, however, I sketch an alternative conception of respect for persons—one that is based on an ethic of mutual accountability. I draw in (...) particular upon Stephen Darwall’s writings on respect and the second-person standpoint. I consider the implications of this conception of respect for the distribution of scarce, lifesaving healthcare resources. A second-personal account of respect rules out aggregative approaches to distribution, and instead requires that we give individual consideration to the claims that persons in need make on the resources in our control. The principles that we use to govern our allocation of resources, furthermore, should be principles that are acceptable to all reasonable agents. Building on this insight, the final section of this paper considers how a principle of need can be used as a means to make decisions about the allocation of lifesaving resources. -/- . (shrink)

In this article we critically evaluate an argument against state‐sanctioned euthanasia made by David Velleman in his 1992 paper ‘Against the right to die’. In that article, Velleman argues that legalizing euthanasia is morally problematic as it will deprive eligible patients of the opportunity of staying ‘alive by default’. That is to say, those patients who are rendered eligible for euthanasia as a result of legislative reform will face the burden of having to justify their continued existence to their epistemic (...) peers if they are to be perceived as ‘reasonable’. We discuss potential criticisms that could be made of the argument, and consider how a defender of the view might respond. Velleman’s argument is particularly interesting as it is a consequentialist argument against state‐sanctioned euthanasia, challenging the many consequentialist arguments that have been made in favour of legalizing the procedure. We conclude by suggesting that further research on the question of unfair burdens is important to adequately evaluating the potential harms of legalizing euthanasia for patients at the end of life. ABSTRACT In Philosophy Within its Proper Bounds, Édouard Machery argues that the results of experimental philosophy should lead us to abandon much of traditional philosophical practice. In its place Machery defends naturalized conceptual analysis as a more modest and pragmatic alternative to standard analytic philosophy. This paper argues that Machery overstates the metaphilosophical significance of x-phi’s results. We can and should keep many of the insights and good methodological habits that come with x-phi. However, if one is not already convinced (...) of pragmatism or naturalism, the discoveries of x-phi are unlikely to make too much difference to one’s metaphilosophical position. (shrink)

Functionalism in the philosophy of mind rests on the claim that mental states are multiply realizable; mental states can be realized by or instantiated in a variety of distinct physical structures. To see them as multiply realizable we take mental states as causal roles rather than particular physical structures. As such, functionalism can be contrasted with metaphysical accounts which treat mental states as instances of a mental substance. Instead of puzzling over the relationship between mental and physical kinds, functionalists understand (...) our talk of minds as a way of describing the functions of bodies. The attraction of a functionalist position is obvious. It seems to solve the traditional problem of mind-body dualism, while simultaneously reconciling the apparent irreducibility of psychological discourse with a broadly physicalistic or materialistic ontology. Several bioethicists have recently discussed the complexity of defining human death, and considered in particular how our definition of death affects our understanding of the ethics of vital organ procurement. In this brief paper, we challenge the mainstream medical definition of human death—namely, that death is equivalent to total brain failure—and argue with Nair-Collins and Miller that integrated biological functions can continue even after total brain failure has occurred. We discuss the implications of Nair-Collins and Miller’s argument and suggest that (...) it may be necessary to look for alternative biological markers that reliably indicate the death of a human being. We reject the suggestion that we should abandon the dead-donor criteria for organ donation. Rather than weaken the ethical standards for vital organ procurement, it may be necessary to make them more demanding. The aim of this paper is not to justify the dead donor rule. Rather, we aim to explore the perspective of those who agree with critiques of the whole brain and cardiopulmonary definitions of death but yet disagree with the proposal that we should abandon the dead-donor rule. We will consider what those who want to retain the dead-donor rule must argue in light of Nair-Collins and Miller’s critique. (shrink)

This article renders a close reading of those passages in Walter Benjamin's work where he uses the term “unscheinbar.” Arguing that this concept cannot be reduced to its privative prefix “un-,” the article explores how moments in time, objects or images that are not meaningful in themselves can nevertheless trigger an experience that is to be called such. The article analyzes Benjamin's ideas on friendliness, commemoration, melancholy, mémoire involontaire and photography with the purpose of understanding how a detail or fragment (...) strikes us as significant, despite the fact that it cannot become visible as a unity or whole in its own right. As American settlement expanded westward in the 1860s, the U.S. government undertook large-scale investigations of its new territories. Images of the West: Survey Photography in French Collections, 1860–1880 presents memorable glass-plate photographs from these federal surveys. The selection includes breathtaking views of such iconic sites as Yosemite, as well as lesser-known ethnographic portraits taken by Timothy H. O'Sullivan, William H. Jackson, and William Bell, among others. The accompanying essays discuss how the photographs were used to promote white settlement, how their (...) distribution at home and abroad contributed to the aggrandizement of the American West, and how the exploitative ideology underlying the use of photography extended to attitudes toward both American landscapes and American Indians. The images are all drawn from French public collections, which hold an astonishing number of these U.S. survey photographs. Epistemic logic is the logic of knowledge and belief. It provides insight into the properties of individual knowers, has provided a means to model complicated scenarios involving groups of knowers and has improved our understanding of the dynamics of inquiry.

Schuklenk and Smalling argue that it is practically impossible for civic institutions to meet the conditions necessary to ensure that conscientious objection does not conflict with the core principles of liberal democracies. In this response, I propose an alternative definition of conscience to that offered by Schuklenk and Smalling. I discuss what I call the ‘traditional’ notion of conscience, and contrast this with the existentialist conception of conscience (which I take to be a close cousin of the view targeted by (...) Schuklenk and Smalling). I argue that the traditional notion, grounded in an objective moral order, avoids the criticisms advanced by Schuklenk and Smalling; the existentialist conception, in contrast, does not. I conclude by discussing the benefits and risks of a ‘restricted view’ of respect for conscience. (shrink)

Intuition serves a variety of roles in contemporary philosophy. This paper provides a historical discussion of the revival of intuition in the 1970s, untangling some of the ways that intuition has been used and offering some suggestions concerning its proper place in philosophical investigation. Contrary to some interpretations of the results of experimental philosophy, it is argued that generalized skepticism with respect to intuition is unwarranted. Intuition can continue to play an important role as part of a methodologically conservative stance (...) towards philosophical investigation. I argue that methodological conservatism should be sharply distinguished from the process of evaluating individual propositions. Nevertheless, intuition is not always a reliable guide to truth and experimental philosophy can serve a vital ameliorative role in determining the scope and limits of our intuitive competence with respect to various areas of inquiry.
