ABSTRACTCommerce changes the production of wealth in a society as well as its ethics. What is appropriate in a non-commercial society is not necessarily appropriate in a commercial one. Adam Smith criticizes Stoic self-command in commercial societies, rather than embracing it, as is often suggested. He argues that Stoicism, with its promotion of indifference to passions, is an ethic appropriate for savages. Savages live in hard conditions where expressing emotions is detrimental and reprehensible. In contrast, the ease of life brought (...) about by commerce fosters the appropriate expressions and sharing of emotions. Imposing Stoicism on a commercial society is therefore imposing an ethic for savages onto a refined society – something to abhor. Smith’s rejection of Stoicism in commercial societies can thus be seen as a defence of commerce. (shrink)

Some months ago, when giving a paper about Sir Francis Bacon's philosophy, I mentioned that, according to him, Nature was a woman; true knowledge treats her like his legitimate wife, while false knowledge deals with her as if she were a barren prostitute. In the same paper, I also mentioned that according again to Bacon, there are three kinds of intellectual attitudes, or three kinds of philosophers, namely the pure rationalists, who are like spiders, the empiricists who are like ants, (...) for they gather materials but do not work on them, and a third category—good philosophers who are like bees, for they gather and work on the material gathered. Now, during the discussion a gentleman strongly objected to Bacon's use of ants as a metaphor. He explained that there are many different species of ants, and some of them do not merely gather, some have gardens for instance, where they grow mushrooms. The gentleman concluded that philosophers do not know what they are talking about when they use metaphors. This is true enough, but I felt sorry indeed that nobody observed that it is not true that a woman is either a wife or a prostitute; nobody asked whether ‘nature as her’ implied that the scientist is, as a matter of course, male; nobody said that the simple fact of using ‘woman’ as a metaphor is questionable in itself. So, when speaking of feminism in contemporary French philosophy, one has to keep in mind that, on the Parisian stage, the honour, dignity, diversity and reality of insects are better defended than the honour, dignity, diversity and reality of women. This paper takes its departure from Michel Henry’s criticism of a technological view that “extends its reign to the whole planet, sowing desolation and ruin everywhere” ( I am the Truth , 271). It argues that although Henry’s critique of technology is helpful and important, it does not go far enough, inasmuch as it excludes all non-human beings from the Truth of “Life” he advocates against the destructive truths of technology and therefore cannot fully articulate the way in which technology (...) does in fact cause “desolation and ruin” on the entire planet. At the same time I suggest that this strict division between human and non-human life is not essential to Henry’s project, which may well have resources for a more environmentally friendly proposal. The first part of the paper lays out Henry’s critique of technology in some detail, highlighting the ways in which it contains important insights for our contemporary situation. The second part of the paper explores the stark division Henry draws between human generation from the divine life and the creation of everything else, including his rejection of any identification of humans with “protozoa and honey bees,” which would seem to suggest a complete lack of concern for non-human life. The final part of the paper seeks to find a way beyond this dichotomy by showing how non-human life may be included in Henry’s proposal in a way that extends his critique of technology in environmentally conscious ways without losing his phenomenological insights about the human condition. To summarise, the phenomenon of temporal displacement came to light through astronomy and it formed one of the first problematic issues of experimental psychology. It represented, in fact, a typical case of dissimilarity between the characteristics of physical reality and those of erceptive reality.Nearly a century ago Benussi had, with deep philosophical awareness, grasped the complexity of the phenomenon. Such awareness was derived from his understanding of the sophisticatedGegenstandstheorie that evolved from the Graz theory. Moreover, with great experimental skill, he (...) succeded in formulating and describing the controlled situations in which such a discrepancy manifested itself.Thereore, current research, which is carried out within the difficult discipline of the ‘psychology of time,’ cannot ignore his pioneering contribution. Summary This paper examines the experimentum crucis under the light of the Duhem’s holistic thesis. This methodological instrument is not usable in physics, because physical theories are always logically connected to many assumptions. On the contrary, it is usable in psychological research oriented to perceptual laws, when these laws are, without any hypothetical term, isolated systems. An application of experimentum crucis in Experimental Phenomenology of perception is presented. In conclusion, the role of perceptual knowledge as an essential assumption in other (...) scientific disciplines that have a high degree of theoricity is also underlined. (shrink)

The concept of cultural capital has been increasingly used in American sociology to study the impact of cultural reproduction on social reproduction. However, much confusion surrounds this concept. In this essay, we disentangle Bourdieu and Passeron's original work on cultural capital, specifying the theoretical roles cultural capital plays in their model, and the various types of high status signals they are concerned with. We expand on their work by proposing a new definition of cultural capital which focuses on cultural and (...) social exclusion. We note a number of theoretical ambiguities and gaps in the original model, as well as specific methodological problems. In the second section, we shift our attention to the American literature on cultural capital. We discuss its assumptions and compare it with the original work. We also propose a research agenda which focuses on social and cultural selection and decouples cultural capital from the French context in which it was originally conceived to take into consideration the distinctive features of American culture. This agenda consists in 1) assessing the relevance of the concept of legitimate culture in the U.S.; 2) documenting the distinctive American repertoire of high status cultural signals; and 3) analyzing how cultural capital is turned into profits in America. This paper highlights the relevance of moral authority, and the role that egoistic ethical claims have in waging war. This is done, in view of the just war tradition, by drawing a parallel between the crusades in the 'kingdom of heaven' proclaimed in 1095, and the present Islamic jih d , as well as the Bush administration's declaration of a war on terror. It maintains that the role of self-legitimized leaders is crucial in shaping the order of the jus ad (...) bellum criteria, in both Christian and Muslim societies, and that the indiscriminate usage of just war rhetoric proves to be a formidable weapon. Moral authority is described as a power resource, capable of capsizing the relevance of ethics, subjecting the interpretation of justice to declare war to the self-proclaimed authorities, and moving masses on the grounds of enthusiasm. At first glance, Moritz Geiger’s reaction to Husserl’s Ideas I appears to be neither systematically articulated nor particularly original. Geiger talks about Husserl’s idealism in Ideas I in just a few passages from his book Die Wirklickheit der Wissenschaften und die Metaphysik, and in a short essay in praise of Alexander Pfänder, Alexander Pfänders Methodische Stellung. There, Geiger seems to follow a general line of criticism shared by several so-called early phenomenologists, and most fully articulated by Jean Hering, Roman Ingarden, (...) Theodor Celms and Max Scheler. In this paper I argue that Geiger’s reaction to Ideas I contains some well-developed and original contributions to phenomenological thought. In particular, I defend three theses. First, Geiger’s criticism of Husserl’s idealism is much more original and sophisticated than it at first appears, because it rests on a complex phenomenology of “attitudes” [Einstellungen]. Second, Geiger offers a unique account of phenomenology as a variation of “stance” [Haltung], rather than a variation of attitude. Third, Geiger points to an alternative kind of phenomenology, which I call certainty-based phenomenology as opposed to an evidence-based phenomenology. Elements of this certainty-based phenomenology can be found in thinkers such as Merleau-Ponty and Ricoeur, but many of their views are significantly anticipated by Geiger. (shrink)

The study of legal transplants provides a vital critical supplement to mainstream theories about legal change. Legal transplants are not exceptional or isolated occurrences, despite the economic, social, political and cultural barriers that separate the world’s legal systems. This Article goes beyond traditional approaches to the study of transplants by substituting the figurative language of transplants with explicit theory about how legal change is produced. It first provides a brief account of what the literature on legal transplants has achieved so (...) far in terms of "macro" explanations of legal change currently available. It then argues that legal transplants as social acts performed by individuals call for a study of the "micro" level of engagement with legal change by individuals. The key notion that is advanced to explore this dimension is the notion of mediated action, which denotes action that is performed by individuals making use of features of the environment as tools to interact in a specific setting. The notion of mediated action was first introduced in cultural-historical psychological investigations of the social formation of the mind. As social acts, legal transplants represent instances of mediated action. The last part of this Article highlights how legal transplants raise questions of justice and discusses briefly how the new approach to the study of transplants advocated here relates to them. This article explores how we use social media to construe identities and align with others into communities of shared values. The focus is on how ‘users of language perform their identities within uses of language’: How do personae using the microblogging service Twitter perform relational identities as they enact discourse fellowships? Addressing this question means understanding how personae enter into ambient affiliation. Such affiliation is ambient in the sense that social media users may not be interacting directly, but instead participating (...) in mass performances of hashtagging or contributing to iterations of Internet memes. This article will consider three key bonds using both a 100 million-word corpus of posts and a smaller specialized corpus collected by capturing the entire Twitter stream of a particular user. This article presents a fairness principle for evaluating decision-making based on predictions: a decision rule is unfair when the individuals directly impacted by the decisions who are equal with respect to the features that justify inequalities in outcomes do not have the same statistical prospects of being benefited or harmed by them, irrespective of their socially salient morally arbitrary traits. The principle can be used to evaluate prediction-based decision-making from the point of view of a wide range of antecedently specified (...) substantive views about justice in outcome distributions. In the past decade the central principles of western feminist theory have been dramatically challenged. many feminists have endorsed post-structuralism's rejection of essentialist theoretical categories, and have added a powerful gender dimension to contemporary critiques of modernity. Earlier 'women' have been radically undermined, and newer concerns with 'difference', 'identity', and 'power' have emerged. Destabilizing Theory explores these developments in a set of specially commissioned essays by feminist theorists. Does this change amount to a real shift within feminist theory, or will (...) feminism's links with an emancipatory modernism reinstate an older political agenda? Die Schriften Walter Benjamins stellen ein unvergleichlich aufschlussreiches Repertoire für das Studium von Kritik bereit. Sie zeigen, dass sich Kritik, sei es die der Gesellschaft, des Rechts oder der Kunst, nicht in einem Urteil nach etablierten Kriterien erschöpft. Benjamin erzielt kritische Effekte mit Hilfe von unerwarteten Zusammenstellungen oder genealogischen Rekonstruktionen, die den geläufigen Kriterien der Beurteilung nicht einfach folgen, und gerade dadurch die Eigentümlichkeiten der betrachteten Gegenstände unterscheiden und erkennen lassen. Kritik löst dabei eine Krise der habitualisierten Denkweisen aus und (...) sorgt für eine Wiederbelebung der Empfindsamkeit ihres Rezipienten. In seiner Untersuchung entfaltet Michele Salonia systematisch Benjamins zahlreiche, fragmentarisch gebliebenen Überlegungen zur Kritik, was einen Schlüssel für die Interpretation einzelner Teile seines Œuvres – Jugendschriften, Erkenntnistheorie, politische, Sprach- und Geschichtsphilosophie – sowie der Entwicklung seines Gesamtwerks an die Hand gibt. Permissivism is the view that, sometimes, there is more than one doxastic attitude that is perfectly rationalised by the evidence. Impermissivism is the denial of Permissivism. Several philosophers, with the aim to defend either Impermissivism or Permissivism, have recently discussed the value of (im)permissive rationality. This paper focuses on one kind of value-conferring considerations, stemming from the so-called “truth-connection” enjoyed by rational doxastic attitudes. The paper vindicates the truth-connected value of permissive rationality by pursuing a novel strategy which rests on (...) two main planks: first, there is a distinction between a fine-grained and a coarse-grained type-individuation of belief-forming methods. Secondly, different kinds of decision-theoretic reasoning, i.e. expected-accuracy reasoning and accuracy-domination reasoning, must be paired with a fine-grained and a coarse-grained type-individuation of methods, respectively. I argue that while the first pair is wholly irrelevant to the question of the truth-connection, the second affords the means to a permissivist explanation of the truth-connected value of rationality. The article investigates the significance of the so-called phenomenon of apparent faultless disagreement for debates about the semantics of taste discourse. Two kinds of description of the phenomenon are proposed. The first ensures that faultless disagreement raises a distinctive philosophical challenge; yet, it is argued that Contextualist, Realist and Relativist semantic theories do not account for this description. The second, by contrast, makes the phenomenon irrelevant for the problem of what the right semantics of taste discourse should be. Lastly, the (...) following dilemma is assessed: either faultless disagreement provides strong evidence against semantic theories; or its significance should be considerably downplayed. (shrink)

The paper proposes an account of the rational response to higher‐order evidence whose key claim is that whenever we acquire such evidence we ought to engage in the inquiring activity of double‐checking. Combined with a principle that establishes a connection between rational inquiry and rational belief retention, the account offers a novel explanation of the alleged impermissibility of retaining one's belief in the face of higher‐order evidence. This paper supports the personal data platform cooperative as a means of bringing about John Rawls’s favoured institutional realisation of a just society, the property-owning democracy. It describes personal data platform cooperatives and applies Rawls’s political philosophy to analyse the institutional forms of a just society in relation to the economic power deriving from aggregating personal data. It argues that a society involving a significant number of personal data platform cooperatives will be more suitable to realising Rawls’s principle of fair (...) equality of opportunity. (shrink)

Tradition has it that first-person thought is somehow special. It is also commonplace to maintain that the first-person concept obeys a rule of reference to the effect that any token first-person thought is about the thinker of that thought. Following Annalisa Coliva and, more recently, Santiago Echeverri, I take the specialness claim to be the claim that thinking a first-person thought comes with a certain guarantee of its pattern of reference. Echeverri maintains that such a guarantee is explained by a (...) fairly flatfooted interpretation of the thinker-reflexive rule. I argue, however, that the explanatory aspirations of the thinker-reflexive rule are fulfilled only if we accept an epistemically loaded gloss on the notion of a thinker of a thought featuring the rule. That gloss is unpacked in terms of the subject’s ability to be acquainted with the phenomenal character of their thoughts. (shrink)

The demands of fair machine learning are often expressed in probabilistic terms. Yet, most of the systems of concern are deterministic in the sense that whether a given subject will receive a given score on the basis of their traits is, for all intents and purposes, either zero or one. What, then, can justify this probabilistic talk? We argue that the statistical reference classes used in fairness measures can be understood as defining the probability that hypothetical persons, who are representative (...) of social roles, will receive certain goods. We call these hypothetical persons “representative individuals.” We claim that what we owe to actual, concrete individuals—whose individual chances of receiving the good in the system might be extreme (i.e., either zero or one)—is that their representative individual has an appropriate probability of receiving the good in question. While less immediately intuitive than other approaches, we argue that the representative individual approach has important advantages over other ways of making sense of this probabilistic talk in the context of fair machine learning. Typical spatial descriptions, such as “The car is in front of the house,” describe the position of a located object (LO; e.g., the car) in space relative to a reference object (RO) whose location is known (e.g., the house). The orientation of the RO affects spatial language comprehension via the reference frame selection process. However, the effects of the LO's orientation on spatial language have not received great attention. This study explores whether the pure geometric information of the LO (e.g., (...) its orientation) affects spatial language comprehension using placing and production tasks. Our results suggest that the orientation of the LO influences spatial language comprehension even in the absence of functional relationships. (shrink)

The concept of the digital phenotype has been used to refer to digital data prognostic or diagnostic of disease conditions. Medical conditions may be inferred from the time pattern in an insomniac’s tweets, the Facebook posts of a depressed individual, or the web searches of a hypochondriac. This paper conceptualizes digital data as an extended phenotype of humans, that is as digital information produced by humans and affecting human behavior and culture. It argues that there are ethical obligations to persons (...) affected by generalizable knowledge of a digital phenotype, not only those who are personally identifiable or involved in data generation. This claim is illustrated by considering the health-related digital phenotypes of precision medicine and digital epidemiology. (shrink)

:In this article, we begin by identifying three main neuroethical approaches: neurobioethics, empirical neuroethics, and conceptual neuroethics. Our focus is on conceptual approaches that generally emphasize the need to develop and use a methodological modus operandi for effectively linking scientific and philosophical interpretations. We explain and assess the value of conceptual neuroethics approaches and explain and defend one such approach that we propose as being particularly fruitful for addressing the various issues raised by neuroscience: fundamental neuroethics.

In this paper I aim to illuminate the significance of thought insertion for debates about the first-person concept. My starting point is the often-voiced contention that thought insertion might challenge the thesis that introspection-based self-ascriptions of psychological properties are immune to error through misidentification relative to the first-person concept. In the first part of the paper I explain what a thought insertion-based counterexample to this immunity thesis should be like. I then argue that various thought insertion-involving scenarios do not give (...) rise to successful counterexamples to the immunity of the target class of self-ascriptions. In the second part of the paper I turn to defend a Metasemantic Explanation of why the immunity thesis holds. The Metasemantic Explanation rests on a reference-fixing story about the mental ‘I’ whose key contention is that introspective impressions play an essential role in fixing its reference. It is part of my argument in favour of the proposed reference-fixing story, as well as of the Metasemantic Explanation, that they respect the paradigmatic features of self-ascriptions of inserted thoughts.
