This paper explores a novel philosophy of ethical care in the face of burgeoning biomedical technologies. I respond to a serious challenge facing traditional bioethics with its roots in analytic philosophy. The hallmarks of these traditional approaches are reason and autonomy, founded on a belief in the liberal humanist subject. In recent years, however, there have been mounting challenges to this view of human subjectivity, emerging from poststructuralist critiques, such as Michel Foucault's, but increasingly also as a result of advances (...) in biotechnology itself. In the face of these developments, I argue that the theoretical relevance and practical application of mainstream bioethics is increasingly under strain. Traditionalists will undoubtedly resist. Together, professional philosopher-bioethicists, public health policymakers, and the global commercial healthcare industry tend to respond conservatively by shoring up the liberal humanist subject as the foundation for medical ethics and consumer decision-making, appealing to the familiar tropes of reason, autonomy, and freedom. The most pervasive, resilient, robust, sneaky, and significant concept in all of Giorgio Agamben’s essays is that of separation. This is not the same as alienation. Separation is more nostalgic, for Agamben valorizes an ancient world in which human society and its beings were not subject to such separation. He implies that these separations are damaging to human beings, crippling them at the very level of their identities. $4.99 B. The Handsome Gloves. Giorgio Agamben’s Nudities , like Profanations before it, employs a wide range of subjects in order to establish separation as a metaphor, in much the same way that interdisciplinary scholars have adopted Michel Foucault’s concepts in order to rethink societies and texts. The longest essay from Profanations, entitled “In Praise of Profanation,” laments humankind’s inability to profane as the result of what Walter Benjamin has called “the capitalist religion.” Likewise, “Nudity” adopts a pessimistic stance on the Christian theological tradition’s perverse asphyxiation of the unclothed body. $2.50 C. The Hoop Earrings. Religion separates humans from things by procuring for itself items as “sacred,” thus taking them out of common use. In this state, human beings are unable to play with them, unable to change their use-value. They become off-limits, museified. $1,499.00 D. The Uncomfortable Shoes. Biometrics polices identity, replacing meaningful metrics of identity. It is a deplorable situation that leaves human beings in danger of, and indeed already victims of, mass persecution. $111.75 E. The Prince Albert. One could characterize Giorgio Agamben’s desire to catalogue a history of ignorance as a recognition that human beings are separated from knowledge by language. Where then is the prophet, and how shall we be saved? $49.50 + tip F. The Corset. Franz Kafka’s character of Joseph K. has put himself on trial, as in Roman trials when the Kalumniator was marked with the letter K. The torture he undergoes is meant to elicit a confession of the truth. It is possible that Giorgio Agamben perceives his role as a philosopher to be confined to self-trial, and that with every passage he flays the unclothed page with prophetic intent. $27.00 G. The Derby. Giorgio Agamben himself tries to bridge various separations through exploratory play. He is not a performative writer semantically, but his exploratory style is rooted in the play spirit. His strategy of numbering points is almost comical, yet it is not misleading. It is play, after all, not ruse. He denudes with pecks, like carrion on a tattered corpse. $11.00 H. The Trousers. Although Giorgio Agamben is elsewhere concerned with the profanation of religion’s apparatuses, in essay nine he would like to consider what is consumed during days of inoperativity, how religion governs these, and how to account for our binges and purges. Inoperativity is inextricably bound to feasting, to the festival. $24.50 I. The Stylish Belt. The only essay in Nudities to contain photographs is the essay entitled, “Nudity.” All of these photographs project human bodies. $.01 I The aim here is not to tap into an original state prior to the separation but to comprehend and neutralize the apparatus that produced this separation. (66) II The contemporary is he who firmly holds his gaze on his own time so as to perceive not its light but rather its darkness. (13) III We can therefore only experience nudity as a denudation and a baring, never as a form and a stable possession. What is the relationship between detailed critical analysis and the background assumptions made by a given theory of film spectatorship? In this article, I approach this question by looking at Vittorio Gallese and Michele Guerra's The Empathic Screen in the light of the method of triangulation—the coordination and integration of phenomenological, psychological, and neuroscientific evidence, as set out in my Film, Art, and the Third Culture. In particular, I examine Gallese and Guerra's arguments concerning the role of camera movement (...) in prompting immersive, embodied simulation, as well as critiques of these arguments from David Bordwell and Malcolm Turvey. I focus on the special, irreducible role of critical analysis in these arguments. Detailed analysis of film form and style plays an essential role, I argue, in demonstrating the plausibility (or otherwise) of the thesis advanced by Gallese and Guerra. Such analysis is where the rubber of theoretical assumptions meets the road of the material work. (shrink)

The global response to managing the spread of HIV has recently undergone a significant shift with the advent of ‘treatment as prevention’, a strategy which presumes that scaling-up testing and treatment for people living with HIV will produce a broader preventative benefit. Treatment as prevention includes an array of diagnostic, technological and policy developments that are creating new understandings of how HIV circulates in bodies and spaces. Drawing on the work of Michel Foucault, we contextualize these developments by linking them (...) to systems of governance and discursive subjectivation. The goal of this article is to problematize the growing importance of viral suppression in the management of HIV and the use of related surveillance technologies. For people living with HIV, we demonstrate how treatment-as-prevention’s emphasis on individual and collective viral load is transforming the performative dimensions of embodied risk, affect, subjectivity and sex. Working within the tradition of continental philosophy, this article argues in favour of a phenomenological understanding of language as a crucial component of bioethical inquiry. The authors challenge the ‘commonsense’ view of language, in which thinking appears as prior to speaking, and speech the straightforward vehicle of pre-existing thoughts. Drawing on Maurice Merleau-Ponty's (1908–1961) phenomenology of language, the authors claim that thinking takes place in and through the spoken word, in and through embodied language. This view resituates bioethics as a (...) matter of bodies that speak. It also refigures the meaning of ethical self-reflexion, and in so doing offers an alternative view on reflexivity and critique. Referring to the Kantian critical tradition and its reception by Hannah Arendt and Michel Foucault, we advance a position we call ‘critical ethical reflexivity’. We contend that Merleau-Ponty's phenomenology of language offers valuable insight into ethical reflexivity and subject formation. Moreover, his understanding of language may foster new qualitative empirical research in bioethics, lead to more nuanced methods for interpreting personal narratives, and promote critical self-reflexion as necessary for bioethical inquiry. In this paper, we extend Michel Foucault’s final works on the ‘care of the self’ to an empirical examination of research practice in community-based research (CBR). We use Foucault’s ‘morality of behaviors’ to analyze interview data from a national sample of Canadian CBR practitioners working with communities affected by HIV. Despite claims in the literature that ethics review is overly burdensome for non-traditional forms of research, our findings suggest that many researchers using CBR have an ambivalent but ultimately productive relationship (...) with institutional research ethics review requirements. They understand and use prescribed codes, but adapt them in practice to account for the needs of participating community members, members of their research teams and the larger communities with whom they work. Complying with ethics protocols was seen as only the beginning, a minimum standard; our research suggests that the real ethical work happens in the field, where CBR practitioners encounter community members in diverse public roles and must forge ethical consensus across communities. CBR represents an ethical terrain in which practitioners challenge themselves to work differently, and as a result they care for themselves—and others—in ways that often resist the propensity for domination through public health research.‘…there are different ways to “conduct oneself” morally, different ways for the acting individual to operate, not just as an agent, but as an ethical subject of action.’ (Foucault, 1985: 26). There has never been a scholar who really, and as scholar, deals with ghosts" (2006, 12), a scholar who "does not believe in the sharp distinction between … the living and the non-living" (12). But, then, as if in response, we witness the apparition of just such a scholar: Stuart J. Murray, the author of The Living from the Dead, who very much is dedicated to the ethical project of attending to those dead who continue to haunt the living. Indeed, the book's cover features a spectral image, entitled "Ghost," as it were, conjured by artist Si Lewen. As well, the very title of his work renders the "sharp distinction" between "The Living" and "The Dead" porous, quixotically indistinct, as signified by the unattached and unhinged preposition "from." That is, the title does not announce that Murray intends to distinguish the living from the dead, nor separate the living from the dead, nor identify the living from the dead—in some categorical, decisive demarcation. Rather, Murray's use of the preposition "from" might conjure—instead, a Derridean sense of a "borderline"—a relation marked by différance between the living and the dead. Etymologically derived from an Old English preposition, "denoting the distance, absence, or remoteness of a person or thing in fixed position" [End Page 347] (OED)—in time or space, from evokes Derrida's neologism. "Différance as temporization [time/deferral], différance as spacing [space/difference]. How are they [time/space]," Derrida queries, "to be joined?" (1991, 61). Murray's syntactically incomplete phrase suggests that the living and the dead are conjoined in a relation of interminable deferral and indeterminable difference, entangled in a fluxed, symbiotic—parasitic, even—relation.Much more could be said on this t(r)opic of deferred presence (and much more, indeed, of parasitic consumption and carnophallogocentrism), but to our immediate point, as Murray's work entreats us to consider, there is much to learn in conversation with the dead; and indeed, it is our ethical responsibility—burden, even, as he remarks—to "hearken" to their voices. Murray's The Living from the Dead undertakes this burden, listening to "the dead, the dying, the dispossessed" (1), endeavoring to articulate "[u]nder what conditions might we hearken those dead who summon us, and exhort us, perhaps to reckon with our unspeakable complicity in their deaths" (1), while offering the following caveat: "These pages, which arise in care of such summons, exhortations, and calls to reckoning neither speak for nor as the dead, the dying, or lives lost" (1), for as he will reveal in his refrain, speaking for or as amounts to an unethical co-option, a resentencing to death of the dead and dying.Murray describes his work's writing "something akin to thanatography" (1), which is through and through a rhetorical enterprise, necessitating an attunement to and with biopolitics' "speech/acts and its tropological constitution of subjects, political identities, and lives lived" (10). That is, as Steven Mailloux has argued elsewhere, tropes are rotated in order to "rotate the troops" (1993, 299). Tropes, troops; life, death. This paper opens with first‐hand accounts of critical care medical interventions in which detainees, in the custody of U.S. Immigration and Customs Enforcement (ICE), are brought to the emergency department for treatment. This case dramatizes the extent to which the provision of ethical and acceptable nursing care is jeopardized by federal law enforcement paradigms. Drawing on the scholarship of Michel Foucault and Giorgio Agamben, this paper offers a theoretical account of the power dynamics that inform the health care of patients (...) who find themselves caught in the custodial scaffolding of a vast immigration and detention apparatus. It offers an analysis of the display of sovereign and biopolitical power over the lives (and deaths) of detainees (Foucault), as well as the ways these individuals are reduced to “bare life” under the political pretext of an emergency or “state of exception” (Agamben). Our purpose here is both theoretical and practical: to better understand the often hidden agency or impersonal “will” exercised by the immigrant detention system, but also to equip clinicians in these and cognate facilities (e.g., prisons) with the critical tools by which they might better navigate incommensurable paradigms (i.e., care vs. custody) in order to deliver the best care while upholding their ethical duties as a care provider. This is all the more pressing because hospitals are not sanctuaries and given the incursion of federal law enforcement agents, nurses may find themselves conscripted as de facto agents of the state. In his six 1983 lectures published under the title, Fearless Speech (2001), Michel Foucault developed the theme of free speech and its relation to frankness, truth-telling, criticism, and duty. Derived from the ancient Greek word parrhesia, Foucault's analysis of free speech is relevant to the mentoring of medical students. This is especially true given the educational and social need to transform future physicians into able citizens who practice a fearless freedom of expression on behalf of their patients, the public, the (...) medical profession, and themselves in the public and political arena. In this paper, we argue that Foucault's understanding of free speech, or parrhesia, should be read as an ethical response to the American Medical Association's recent educational effort, Initiative to Transform Medical Education (ITME): Recommendations for change in the system of medical education (2007). In this document, the American Medical Association identifies gaps in medical education, emphasizing the need to enhance health system safety and quality, to improve education in training institutions, and to address the inadequacy of physician preparedness in new content areas. These gaps, and their relationship to the ITME goal of promoting excellence in patient care by implementing reform in the US system of medical education, call for a serious consideration and use of Foucault's parrhesia in the way that medical students are trained and mentored. Human enhancement technologies raise serious ethical questions about health practices no longer content simply to treat disease, but which now also propose to “optimize” human beings’ physical, cognitive and psychological abilities. These technologies call for a reassessment of our relationship to health, the human body and the body's organic, identity and social functions. In nursing, such considerations are in their infancy. In this paper, we argue for the relevance of critical phenomenology as a way to better understand the ethical issues (...) related to human enhancement technologies (HET). In so doing, we seek to problematize HET and assess their influence on the future development of nursing science and practice. It is difficult to anticipate the concrete effects of HET, we suggest, because these practices reconfigure the meaning of normativity and disorient our conventional ethical landscape. In this context, we argue that the later work of Martin Heidegger and Michel Foucault invites a critical perspective into how techno‐scientific discourses modify our relationship to care, to health and to our own social and corporeal identities. Despite the traditional philosophical opposition between phenomenology and critical theory, we maintain that a hybrid critical phenomenological approach opens new ways to assess the integration of technology and practice. Our analysis understands HET as a process of “hybridization” between technological objects and human subjects. Critical phenomenology thus effectively questions anthropocentric definitions of technology, challenges the dichotomy between curative treatment and enhancement and, finally, prompts valuable reflection on the implications of HET for nursing theory and practice. The presence of easily accessible yet unpossessed evidence seems to matter epistemically. In this chapter I offer an inquiry-theoretic explanation of this datum. I argue that agents in the target cases fail to be competent inquirers and gather the relevant easily accessible evidence. This offers a deflationary explanation of the initial datum. I then show how to inflate this explanation to vindicate the thought that unpossessed evidence has defeating power over the justificatory status of one’s beliefs. The inflationary explanation rests (...) on two main planks. First, the subject who believes that p in the target cases ought to have gathered the target piece of evidence that bears on p. Secondly, such a duty is incompatible with justifiedly believing p. Along the way, the chapter offers a framework for thinking about zetetic competence, comments on the existence of epistemic duties of inquiry, and discusses the relationship between such duties and traditional epistemic norms of belief. For the past two decades, Einstein's Hole Argument (which deals with the apparent indeterminateness of general relativity due to the general covariance of the field equations) and its resolution in terms of "Leibniz equivalence" (the statement that pseudo-Riemannian geometries related by active diffeomorphisms represent the same physical solution) have been the starting point for a lively philosophical debate on the objectivity of the point-events of space-time. It seems that Leibniz equivalence makes it impossible to consider the points of the space-time (...) manifold as physically individuated without recourse to dynamical individuating fields. Various authors have posited that the metric field itself can be used in this way , but nobody so far has considered the problem of explicitly distilling the "metrical fingerprint" of point-events from the gauge-dependent elements of the metric field. Working in the Hamiltonian formulation of general relativity, and building on the results of Lusanna and Pauri (2002), we show how Bergmann and Komar's "intrinsic pseudo-coordinates" (based on the value of curvature invariants) can be used to provide a physical individuation of point-events in terms of the true degrees of freedom (the "Dirac observables") of the gravitational field, and we suggest how this conceptual individuation could in principle be implemented with a well-defined empirical procedure. We argue from these results that point-events retain a significant kind of physical objectivity. (shrink)

Permissivism is the view that, sometimes, there is more than one doxastic attitude that is perfectly rationalised by the evidence. Impermissivism is the denial of Permissivism. Several philosophers, with the aim to defend either Impermissivism or Permissivism, have recently discussed the value of (im)permissive rationality. This paper focuses on one kind of value-conferring considerations, stemming from the so-called “truth-connection” enjoyed by rational doxastic attitudes. The paper vindicates the truth-connected value of permissive rationality by pursuing a novel strategy which rests on (...) two main planks: first, there is a distinction between a fine-grained and a coarse-grained type-individuation of belief-forming methods. Secondly, different kinds of decision-theoretic reasoning, i.e. expected-accuracy reasoning and accuracy-domination reasoning, must be paired with a fine-grained and a coarse-grained type-individuation of methods, respectively. I argue that while the first pair is wholly irrelevant to the question of the truth-connection, the second affords the means to a permissivist explanation of the truth-connected value of rationality. This paper supports the personal data platform cooperative as a means of bringing about John Rawls’s favoured institutional realisation of a just society, the property-owning democracy. It describes personal data platform cooperatives and applies Rawls’s political philosophy to analyse the institutional forms of a just society in relation to the economic power deriving from aggregating personal data. It argues that a society involving a significant number of personal data platform cooperatives will be more suitable to realising Rawls’s principle of fair (...) equality of opportunity. (shrink)

Norman Daniels argues that health is important for justice because it affects the distribution of opportunities. He claims that a just society should guarantee fair opportunities by promoting and restoring the “normal functioning” of its citizens, that is, their health. The scope of citizens' mutual obligations with respect to health is defined by a reasonable agreement that, according to Daniels, should be based on the distinction between normal functioning and pathology drawn by the biomedical sciences. This paper deals with the (...) question whether it is legitimate to ascribe the responsibility of defining this important moral boundary to the biomedical sciences, which Daniels regards as value neutral. Daniels appeals to Christopher Boorse's sophisticated bio-statistical theory (BST) to show the plausibility of a value-neutral distinction between normal functioning and pathology. Here I argue that a careful analysis of the concept of normal functioning, such as the one offered by the recent critique by Elselijn Kingma, shows that it depends from evaluative assumptions. This, I argue, implies that Daniels's theory must give up its naturalistic commitments. In the conclusion, the paper offers a detailed discussion and an objection to one of Daniels's arguments in favor of a moderate form of normativism that remains too close to Boorse's naturalism. At the heart of Youth Justice Conferencing, a form of restorative justice aimed at addressing youth crime, is the notion that young persons who have committed an offence should be ‘reintegrated’ into their communities (Braithwaite in Crime, shame and reintegration. Cambridge University Press, Cambridge, 1989). This paper focuses on the role of parents as support persons, in particular the ‘crying mum’, an identity often leveraged by the Convenor when prompting the young person to express remorse to the circle. We explore (...) an Avouchment genre that we have observed whereby support persons vouch for the character of the young person. Our analysis considers the ways in which values are composed (as ideational categories are coupled with evaluative interpersonal ones) and unfold in discourse as invitations for participants to align. Here, we provide an ethical analysis of discrimination in private insurance to guide the application of non-discriminatory algorithms for risk prediction in the insurance context. This addresses the need for ethical guidance of data-science experts, business managers, and regulators, proposing a framework of moral reasoning behind the choice of fairness goals for prediction-based decisions in the insurance domain. The reference to private insurance as a business practice is essential in our approach, because the consequences of discrimination and predictive inaccuracy in (...) underwriting are different from those of using predictive algorithms in other sectors. Here we focus on the trade-off in the extent to which one can pursue indirect non-discrimination versus predictive accuracy. The moral assessment of this trade-off is related to the context of application—to the consequences of inaccurate risk predictions in the insurance domain. (shrink)

John Stuart Mill's crisis of 1826 has received a great deal of attention from scholars. This attention results from reflection on the importance of the crisis to Mill's mature thought. Did the crisis signal rejection or revision of Benthamism? Or did it have little or no effect on Mill's view of his intellectual inheritance? Ultimately, an interpretation of the cause and resolution of the crisis is integral to an understanding of the nature of Mill's moral and social philosophy. Scholars, in (...) their zeal to understand Mill's crisis, have suggested various reasons for both the onset of the crisis and the recovery. _ABSTRACT_ A relevant part of the literature about the metaphysical problem of persistence of concrete particulars exhibits, I believe, too much freedom as far as the use of terms like “Four-Dimensionalism”, “Perdurantism” and “Doctrine of temporal parts” is concerned. This attitude clashes against the rigorous and valid arguments of many four-dimensionalist views and it is mainly due to a lack of precision on the four-dimensionalist side. In this work I analyse Parsons’ attempt to clarify the content of these notions. His (...) clarification, based on the postulation of a difference between temporal parts and temporal extent, is aimed at demonstrating that Four-Dimensionalism and Perdurantism have not the same content and are not tied by any apriori connection. I endorse Parsons’ clarification as legitimate from a logical and semantic point of view, but I maintain that, despite his useful distinction between Perdurantism as a theory of persistence and Four-Dimensionalism as a theory of extension, these doctrines are ultimately equivalent, when it comes to formulating a general view about material objects. Indeed, I argue that objects extended four-dimensionally necessarily persist by perduring, and perduring objects necessarily extend four-dimensionally in space-time. (shrink)
