The Supreme Court frequently uses two tools to gather information about which cases to hear following a petition for writ of certiorari: the call for response and the call for the views of the Solicitor General. To date, there has been no empirical analysis of how the Supreme Court deploys these tools and little qualitative study. This Article fills in basic gaps in the literature by providing concrete answers to common questions regarding these two tools and offers detailed analysis of (...) how and why states, private parties, and the United States (through the Solicitor General) respond to petitions. In addition, the Article provides much-needed data for litigators and litigants to be able to estimate the probability of their case being heard by the Court, and provides insight on how to react when the Court calls for a response or calls for the views of the Solicitor General. To reach these conclusions, the Article relies on detailed, quantitative analysis of a novel, 30,000-petition dataset, as well as interviews with top Supreme Court litigators, former Supreme Court clerks, and former staff of the Clerk’s office. How does the body influence the way we see the world? _Imagination, Illness and Injury_ examines the psychological factors behind perceptual limitations and distortions and links a broad range of somatic manifestations with their resolution. Melanie Starr Costello applies Jungian theory to a variety of cases, attributing psychosomatic phenomena to cognitive processes that are common to us all. She analyses the role of illness in several life narratives, and interprets the appearance of somatic phenomena during important phases of analytic (...) treatment. From Lucretius throwing a spear beyond the boundary of the universe to Einstein racing against a beam of light, thought experiments stand as a fascinating challenge to the necessity of data in the empirical sciences. Are these experiments, conducted uniquely in our imagination, simply rhetorical devices or communication tools or are they an essential part of scientific practice? This volume surveys the current state of the debate and explores new avenues of research into the epistemology of thought experiments.

Considering the value of archives for dealing with the past processes, especially for the establishment of collective memory and identity, this paper discusses the role of archives in situations of conflicting memories such as in the case of the official Turkish denial of the Armenian genocide. A crucial problem of Turkish-Armenian reconciliation are the divergent perceptions of what to consider as proper ‘evidence’, i.e. as objective, reliable, impartial or trustworthy sources of knowledge in order to prove the Armenian genocide. The (...) aim of this paper is to show how in a general atmosphere of distrust or prejudiced credibility judgments, even technically reliable archival records will be perceived as unreliable and biased, lacking any evidentiary status to factually prove a genocide which is categorically denied. Therefore, this working paper discusses how claims to reliability, objectivity and other similar scientifically and epistemically relevant attributes are understood in archival science as well as memory studies, and emphasizes the problems related to their instrumentalization by political actors within the context of genocide denialism. The Turkish-Armenian context promises many important empirical as well as theoretical insights on the uses and misuses of these attributes, suggesting that measures ought to be taken beforehand to decrease intergroup prejudice and distrust toward the ‘other’, so that archives can be effective in the truth-finding process. The conscious experiences we have during sleep have the potential to improve our empathetic response to those who experience delusions and psychosis by supplying a virtual reality simulation of mental illness. Empathy for those with mental illness is lacking and there has been little improvement in the last decades despite efforts made to increase awareness. Our lack of empathy, in this case, may be due to an inability to accurately mentally simulate what it’s like to have a particular cognitive disorder. (...) Dreaming can help mitigate these deficits by placing the dreamer directly into a realistic virtual simulation and thus increase their capacity for empathy. Increasing empathy would go some way towards reducing the stigma and discrimination faced by people in this group. Recent work suggests that virtual reality can increase empathy towards a variety of marginalised groups, however, this technology is limited in its ability to simulate mental illnesses such as delusions. Dreams, however, are at times virtual reality delusion simulators. They can replicate, to a reasonable degree, delusions and psychosis, and through these experiences, we can learn ‘what it’s like’ to have these conditions. It is essential that we recognise these experiences for what they are, attempt to remember and reflect on them. Instead of disregarding dreams due to their unusualness and bizarreness, we can learn from these experiences and expand our understanding of the human condition and its many forms. (shrink)

Twentieth century philosophers such as Simondon and Heidegger propose theories of subjectivation that inform our thinking about the definition of personhood and how it arises; including in the potentially wide-ranging context of personhood beyond the human. Simondon’s theory of transindividuation unfolds as a series of decenterings that provides a context for future persons that is a dynamic world of processes without fixity or attachment to any one kind of subject. Subjects participate in but do not cause individuation; and they exist (...) on a spectrum of capacity for action with other living beings including animals; human persons; and possibly a variety of future persons. The role of collectivity in the form of the other has been an important aspect of individuation; however I claim that the function of alterity need not be provided exclusively by a self-similar subject. Philosophical individuation theories serve as a foundation for an approach that opens up greater possibility for individuation in the context of future persons by identifying and alternatively fulfilling the underlying functionality required by individuation. Utilising literature as a serious source of challenges to questions in philosophy and law, this book provides a fresh perspective not only upon the inculcation of the legal subject, but also upon the relationship between modernism, postmodernism and how such concepts might evolve in the construction of community ethics. The creation and role of the legal subject is just one aspect of jurisprudential enquiry now attracting much attention. How do moral values act upon the subject? How do moral 'systems' impinge (...) upon the subject - jurist and judged - throughout the 20th century, when religious values are called into question, when 'existential' doubt prevails? To what extent do issues of gender and identity inform these questions? Many sources can provide insights into these issues: this book intends to concentrate upon fiction as just such a resource. However it is not just another law and literature compilation. Spanning the last century, each chapter will attempt to fulfil four objectives: to identify key texts in relation to a given period; to look for linked legal and philosophical developments from that period; to establish fresh links from these sources regarding concrete doctrinal, or practical legal questions, and finally draw a more general inference about the legal subject and the frequently less evident feminine citizen-subject. Integrative and naturalistic philosophy of mind can both learn from and contribute to the contemporary cognitive sciences of dreaming. Two related phenomena concerning self-representation in dreams demonstrate the need to bring disparate fields together. In most dreams, the protagonist or dream self who experiences and actively participates in dream events is or represents the dreamer: but in an intriguing minority of cases, self-representation in dreams is displaced, disrupted, or even absent. Working from dream reports in established databanks, we examine two (...) key forms of polymorphism of self-representation: dreams in which I take an external visuospatial perspective on myself, and those in which I take someone else's perspective on events. In remembering my past experiences or imagining future or possible experiences when awake, I sometimes see myself from an external or 'observer' perspective. By relating the issue of perspective in dreams to established research traditions in the study of memory and imagery, and noting the flexibility of perspective in dreams, we identify new lines of enquiry. In other dreams, the dreamer does not appear to figure at all, and the first person perspective on dream events is occupied by someone else, some other person or character. We call these puzzling cases 'vicarious dreams' and assess some potential ways to make sense of them. Questions about self-representation and perspectives in dreams are intriguing in their own right and pose empirical and conceptual problems about the nature of self-representation with implications beyond the case of dreaming. Background: Few robust autism-specific outcome assessments have been developed specifically for use by teachers in special schools. The Assessment of Barriers to Learning in Education – Autism is a newly developed teacher assessment to identify and show progress in barriers to learning for pupils on the autism spectrum with coexisting intellectual disabilities. Aims: This study aimed to conduct a preliminary validity and reliability evaluation of the ABLE-Autism. Methods and procedures: Forty-eight autistic pupils attending special schools were assessed using the ABLE-Autism. (...) Multi-level modelling was used to evaluate test-retest reliability, internal consistency and convergent validity with the Teacher Autism Progress Scale. Outcomes and results: Results showed excellent test-retest reliability and internal consistency. A large effect size suggested that the ABLE-Autism is strongly correlated with the Teacher Autism Progress Scale. Teacher feedback was positive and suggested that the ABLE-Autism is easily understood by teachers, relevant to autistic pupils in special schools, and adequately covers the skills and behaviours that teachers believe are important to assess for these pupils. Conclusions and implications: Although further validation is recommended, the preliminary evaluation of the ABLE-Autism suggests that it is a useful and has the potential to be an effective outcome assessment for autistic pupils in special schools. The cinematographic successes of Craig Brewer’s Black Snake Moan and Lars Von Trier's Manderlay are contingent upon the palpability of tension and attraction created by their respective, many racial and sexual relations, thus both films aggressively bring them to the fore by excessively rehearsing old stereotypes and taboos, and inverting the expected agents therein, to reveal their persistent, still-relevant power. Both films similarly test our convictions and squeamishness, but do so from entirely different moral stances. Brewer explores how an act (...) of charity and humanitarian openness can save lives, literally and spiritually. Von Trier explores how similar acts of openness can smother appreciation of the other and reenact the worst oppression. The former tells a persuasive story with wide appeal, while the latter tells a story that will make even the most desensitized viewers cringe. Using these pictures as paradigms, is either approach better for bringing prejudice into the light for thought and film? (shrink)

This article offers an argument of genocide denial as an injustice perpetrated not only against direct victims and survivors of genocide, but also against future members of the victim group. In particular, I argue that in cases of persistent and systematic denial, i.e. denialism, it perpetrates an epistemic injustice against them: testimonial oppression. First, I offer an account of testimonial oppression and introduce Kristie Dotson’s notion of testimonial smothering as one form of testimonial oppression, a mechanism of coerced silencing particularly (...) pertinent to genocide denialism. Secondly, I turn to the epistemology of genocide denialism and, using the example of Turkey’s denialism of the Armenian genocide, show how it presents what Linda Martín Alcoff calls a substantive practice of ignorance. Thirdly, I apply these considerations to individual practices of genocide denial and analyse the particular characteristics of testimony on genocide, the speaker vulnerabilities involved and the conditions under which hearers will reliably fail to meet the dependencies of a speaker testifying to genocide. Finally, I explore the harms that testimonial oppression perpetrates on members of the victim group, insofar as it systematically deprives them of epistemic recognition. (shrink)

Beim eingeschränkten Fokus auf (historische) Wahrheit und dem Hervorbringen von „Beweisen“ im Kontext der türkischen Leugnung des Genozids an den ArmenierInnen wurde einem wesentlichen ethischen Problem bisher keine sonderliche Beachtung geschenkt: Dass innerhalb dieser sozial situierten Praxis der Etablierung von Wissen über die historischen Tatsachen – also darüber, was passiert ist und wie diese Geschehnisse zu interpretieren sind – Ungerechtigkeiten im Hinblick darauf entstehen können, wen man als glaubwürdige epistemische Akteure anerkennt. Gemäss dieser Überlegung soll der vorliegende Beitrag zeigen, inwiefern (...) Nachfahren von Genozidopfern durch institutionalisierte Genozidleugnung einer spezifischen Art erneuter Dehumanisierung zum Opfer fallen, nämlich der epistemischen Ungerechtigkeit. Diese besagt, dass den Nachfahren der Opfergruppe die Glaubwürdigkeit und damit epistemische Autorität auf der Grundlage ihrer sozialen Zugehörigkeit abgesprochen wird. In diesem Sinne kann die Genozidleugnung als eine fortgesetzte Delegitimierung der Opfergruppe und Herabwürdigung ihrer Mitglieder verstanden werden, diesmal im Gewand einer Aberkennung ihrer essentiellen menschlichen Fähigkeit, Wissen zu generieren und weiterzugeben. The essays in this volume concern the points of intersection between analytic philosophy and the philosophy of the exact sciences. More precisely, it concern connections between knowledge in mathematics and the exact sciences, on the one hand, and the conceptual foundations of knowledge in general. Its guiding idea is that, in contemporary philosophy of science, there are profound problems of theoretical interpretation-- problems that transcend both the methodological concerns of general philosophy of science, and the technical concerns of philosophers of (...) particular sciences. A fruitful approach to these problems combines the study of scientific detail with the kind of conceptual analysis that is characteristic of the modern analytic tradition. Such an approach is shared by these contributors: some primarily known as analytic philosophers, some as philosophers of science, but all deeply aware that the problems of analysis and interpretation link these fields together.
