Delivering high quality genomics-informed care to patients requires accurate test results whose clinical implications are understood. While other actors, including state agencies, professional organizations, and clinicians, are involved, this article focuses on the extent to which the federal agencies that play the most prominent roles — the Centers for Medicare and Medicaid Services enforcing CLIA and the FDA — effectively ensure that these elements are met and concludes by suggesting possible ways to improve their oversight of genomic testing.

BackgroundMulti-centre studies generally cost more than single-centre studies because of larger sample sizes and the need for multiple ethical approvals. Multi-centre studies include clinical trials, clinical quality registries, observational studies and implementation studies. We examined the costs of two large Australian multi-centre studies in obtaining ethical and site-specific approvals.MethodsWe collected data on staff time spent on approvals and expressed the overall cost as a percent of the total budget.ResultsThe total costs of gaining approval were 38 % of the budget for (...) a study of 50 centres (mean cost AUD $6960 per site) and 2 % for a study of 11 centres (mean cost AUD $2300 per site). Seventy-five and 90 % of time was spent on repeated tasks, respectively, and many time-consuming tasks, such as reformatting documents, did nothing to improve the study design or participant safety.ConclusionsImprovements have been made to the ethical approval application system, but more gains could be made without increasing risks of harm to research participants. We propose that ethical review bodies and individual sites publish statistics on how long they take to process approvals which could then be nationally benchmarked. (shrink)

In this article, I apply Australian logician and ecofeminist philosopher Val Plumwood’s Feminism and the Mastery of Nature, specifically its alternative logic of “the dance of interaction,” to a controversial community-engagement program in my home state of Alabama. At Rural Studio, Auburn University students design free housing and public works for one of the poorest regions in the United States, known as the “Black Belt.” Through the lens of Plumwood’s ecofeminist dancing logic, the marginalized source of Rural Studio’s survival is (...) revealed to be the resilience of the disempowered majority-Black community. Inspired thereby, I sketch an ecofeminist choreography with three “dancing” concepts (namely Plumwood’s “the master model,” Vandana Shiva’s “nature’s logic,” and Ariel Salleh’s “holding”), acknowledging the resilience of the disempowered as a necessary step toward an ethically-sustainable aesthetics. As I have explored elsewhere, the Birmingham Philosophy Guild, which my former students and I re-founded in 2012, is a team of community members who engage in theoretical discussion, support group self-cultivation, and community activism. To further promote the guild as a catalyst for progressive social change, the present article connects it to both the popular cultural phenomenon of the “X-Men” – to make the guild more appealing to students and laypeople – and to the cutting-edge contemporary French philosophy of (...) Étienne Balibar – to make the guild more appealing to professors and culture workers. Moreover, the article connects these low- and high-brow phenomena to each other as well, thereby illustrating the political relevance of the lower, as well as a weakness in the higher, pursuant to social justice activism today. The aim of this paper is to develop a new reconstruction of Sartre’s arguments against Kant’s account of the unity of experience in the transcendental deduction. In the Transcendence of the Ego, Sartre presents several arguments to show that Kant is unwarranted in moving from the claim that we can attach an ‘I think’ to our representations to the claim that this is made possible by a synthetic unity of apperception. While Sartre’s criticism of Kant’s conception of the ego is (...) central to Sartre’s existential philosophy, there is still little agreement on what Sartre’s criticisms actually amount to, let alone whether these criticisms are successful. I argue that to make sense of Sartre’s argument here, we must see it as relying on a distinction between two different models of what it is for something to be organized or determined. By doing so, we can see why Sartre believes consciousness does not need the ‘I think’ in order to be unified, but also why Sartre believes we are nonetheless led to posit this moment of unification. In a Ulysses contract, A gets B, at t1, to agree (i) to act at t2 in such a way that A is made to abide by her own earlier intentions and (ii) to ignore A’s later attempt to rescind the authorization. But why does A’s will at t2 lack the authority it had at t1? This article makes the case that a person has authority to enter a Ulysses contract only insofar as her expressed will at t1 is a (...) better expression of the values that remain attributable to her at t2 than is her expressed will at t2. Building on my previous exploration of the role of dance in the contemporary French political philosopher Jacques Rancière’s Aisthesis: Scenes from the Aesthetic Regime of Art, first published in French in 2011, the present essay turns to another book originally published in the same year, The Intervals of Cinema. Having previously established that the core of Rancière’s philosophical method is an analysis of philosophical homonyms into figurative dancing conceptual partners, I begin by applying that method to the first chapter of (...) Intervals, “Cinematic Vertigo: Hitchcock to Vertov and Back.” There I identify two series of such dancing partners, as follows: Hitchcock’s image-controlling, capitalist vertiginous fall, and Vertov’s movement-equalizing, communist balanced dance. I then critique the implicit marginalizing of women and female bodies in the films and chapter, including Hitchcock’s protagonist’s best friend and ex-fiancé, and Vertov’s cosmetologists and switchboard operators. Finally, I offer a corrective from the proto-feminist life of my grandmother, a onetime cosmetologist, switchboard operator, and Glamour Shots amateur model, my grandmother, Louise Nunnelley, or “Mamaw.” Such are the unacknowledged material basis of Rancière’s radical democratic philosophy, the specifically-embodied and positioned female dancers who continue to get lost in his figurative dance. The predominant position in the reproductive rights literature argues that access to assisted reproductive technologies (ART) forms part of an individual’s right to reproduce. On this reasoning, refusal of treatment by clinicians (via provision) violates a hopeful parent’s reproductive right and discriminates against the infertile. I reject these views and suggest they wrongly contort what reproductive freedom entitles individuals to do and demand of others. I suggest these views find their origin, at least in part, in the way we define (...) “reproduction” itself. This paper critically analyses two widely accepted definitions of human reproduction and demonstrates that both are fundamentally flawed. While the process of reproduction includes the biological acts of begetting and bearing a child, I argue that it does not extend to include rearing. This reworked definition has little impact in the realm of sexual reproduction. However, it has significant ethical implications for the formulation and assignment of reproductive rights and responsibilities in the non-sexual realm in two important ways. First, a claim to access ART where one has an intention to rear a child (but does not beget or bear) cannot be grounded in reproductive rights. Second, lacking an intention to rear does not extinguish the reproductive rights and responsibilities for those who collaborate in the process. I conclude that clinicians collaborate in non-sexual reproduction at the point of triggering conception (begetting) and therefore have the right to refuse to be involved in non-sexual reproduction, in some instances, as do all reproductive collaborators. Despite Spinoza’s prominence in Joyce’s Ulysses, almost nothing in the Joyce Industry’s hundred years has been written about him. My first section reviews three exceptions to this trend, which view the character Leopold Bloom as modeled on Spinoza’s (1) life, (2) redefinition of prophecy, and (3) the “attribute” of thought thinking thought. My second section follows a fourth Joycean to the Marxist Antonio Negri’s essay on Spinozist freedom and Joyce, from which I derive a fourth figure of Bloom as (4) (...) a liberating prosthesis for infinite democracy. And my final section applies my previous interpretation of Spinoza’s “intuition” as poetry to Ulysses, interpreted as an epic prose poem where Joyce as a Spinozist God poly-conjugationally persecutes a poly-subjugated Bloom, including with pervasive antisemitism, thus making Ulysses more satirical Inferno than happy Divine Comedy. However, strategically channeling Spinoza and his philosophy more powerfully into Bloom renders him an ethically-politically Stoic hero, defiantly prophesizing a democratization of Joycean conjugation, from persecuting poly-subjugated Others to joyful self-conjugating in search of radical democracy and just peace. Comparative religion scholar Thomas Berry’s influential concept of “Earth jurisprudence” has been helpfully elaborated in three principal books. My first section identifies four of their common themes, deriving therefrom an implicit narrative: (1) the basis of ecology is autopoiesis, which (2) originally generated human communities and Indigenous vernacular laws, which were (3) later reasserted by forest defenders who fought to create the Magna Carta’s “Charter of the Forest,” which is (4) now championed globally by the Indian physicist and eco-activist Vandana (...) Shiva’s Earth Democracy movement. My next three sections identify mutually exclusive elements of the three books, deriving the following alternative narrative: self-conscious new dancing rituals (Cullinan) could empower an historically informed reconstruction of private property (Burdon) via commons-based vernacular law (Weston and Bollier). And my conclusion offers one template for such a strategy, namely a new environmental variation on my dancing-poetic conception of legal justice, christened “emerald star-law.”. (shrink)

This essay is part of larger project in which I attempt to show that Western formal logic, from its inception in Aristotle onward, has both been partially constituted by, and partially constitutive of, what has become known as racism. More specifically, (a) racist/quasi-racist/proto-racist political forces were part of the impetus for logic’s attempt to classify the world into mutually exclusive, hierarchically-valued categories in the first place; and (b) these classifications, in turn, have been deployed throughout history to justify and empower (...) racism/quasi-racism/proto-racism. In other words, (a) an important part of the chaos and messiness that so troubles logic has been the natural bio-cultural diversity of human beings as described by concepts such as race and ethnicity; and (b) once these concepts were historically in place, taken for granted, buttressed with pseudo-science, and had their origins forgotten, they became tools for the oppression of diverse human groups. The central thesis of this essay is that close readings of a variety of Leibniz’s writings (including several essays and one letter) will reveal a pattern of mutual dependency and creation in regard to logic and racism in Leibniz. My conclusion will be that there is a meaningful connection between logic and racism (or at least between logic and politics in general) in Leibniz such that one should be skeptical of his logic’s claim to offer transparent and neutral descriptions of the world as well as imperatives for action. Put differently, I want to ask the following specific question: how do Leibniz’s own racially-informed political goals, along with the emergence of race-centric European colonialism, both invest and disguise themselves within Leibniz’s mathematizing of logic? The requirement of randomization in experimental design was first stated by R. A. Fisher, statistician and geneticist, in 1925 in his book Statistical Methods for Research Workers. Earlier designs were systematic and involved the judgment of the experimenter; this led to possible bias and inaccurate interpretation of the data. Fisher's dictum was that randomization eliminates bias and permits a valid test of significance. Randomization in experimenting had been used by Charles Sanders Peirce in 1885 but the practice was not continued. (...) Fisher developed his concepts of randomizing as he considered the mathematics of small samples, in discussions with "Student," William Sealy Gosset. Fisher published extensively. His principles of experimental design were spread worldwide by the many "voluntary workers" who came from other institutions to Rothamsted Agricultural Station in England to learn Fisher's methods. Today, DIY -- do-it-yourself -- describes more than self-taught carpentry. Social media enables DIY citizens to organize and protest in new ways and to repurpose corporate content in order to offer political counternarratives. This book examines the usefulness and limits of DIY citizenship, exploring the diverse forms of political participation and "critical making" that have emerged in recent years. The authors and artists in this collection describe DIY citizens whose activities range from activist fan blogging and video production to knitting (...) and the creation of community gardens. Contributors examine DIY activism, describing new modes of civic engagement that include Harry Potter fan activism and the activities of the Yes Men. They consider DIY making in learning, culture, hacking, and the arts, including do-it-yourself media production and collaborative documentary making. They discuss DIY and design and how citizens can unlock the black box of technological infrastructures to engage and innovate open and participatory critical making. And they explore DIY and media, describing activists' efforts to remake and reimagine media and the public sphere. As these chapters make clear, DIY is characterized by its emphasis on "doing" and making rather than passive consumption. In this work drawn from lectures delivered in 1994 a founding figure of cultural studies reflects on the divisive, deadly consequences of our politics of identification. Stuart Hall untangles the power relations that permeate race, ethnicity, and nationhood and shows how oppressed groups broke apart old hierarchies of difference in Western culture.

The aim of this paper is to develop a consistent reading of Deleuze and Guattari’s account of capitalism by taking seriously their use of Kant’s philosophy in formulating it. In Sect. 1, I will set out the two different roots of the term axiomatic in Deleuze and Guattari’s thought. The first of these is the axiomatic approach to formalising fields of mathematics, and the second the Kantian account of the indeterminate relationship between the transcendental unity of apperception and the transcendental (...) object. In Sect. 2, we will see how this transcendental aspect of Deleuze and Guattari’s account of axiomatics is expressed in the notion of binding, which Deleuze and Guattari take to be a process that forces us to understand a field of entities in a certain manner, namely as clearly delimited and deployed in a homogeneous space. I will argue that this process of binding operates as a transcendental condition for capitalism for Deleuze and Guattari. Section 3 addresses some of the details of the capitalist axiomatic itself, drawing out why a Kantian reading of Deleuze and Guattari’s account of the axiomatic provides a response to some of the criticisms of it. Section 4 then analyses Deleuze and Guattari’s account of the outside of capitalism, using the double signification of the noumenal to understand the complex relationship between what they call the war machine and its representation within the axiomatic. In Michel de Certeau’s Invention of the Everyday, improvisational community dance function as a catalyst for the subversive art of the oppressed, via its ancient Greek virtue/power of mētis, being “foxlike.” And in de Certeau’s The Possession of Loudun, this foxlike dance moves to the stage, as an improv chorus that disrupts the events at Loudon when reimagined as a tetralogy of plays at City Dionysia. More precisely, Loudun’s tetralogy could be interpreted as a series of three tragedies and one (...) comedy, the latter of which involves the chorine nuns’ channeling of anomie into a proto-feminist transfiguration. More precisely, the tactical prowess of the nuns’ chorus leader, namely the prioress Jeanne des Anges, elevates her to the status of an angelic prophet, which in de Certeau’s theatrical dancing critique makes her the Loudun tetralogy’s Dionysian, foxlike mage. In conclusion, this analysis suggests de Certeau’s relevance for revolutionary social justice today. (shrink)

This is the first article in a two-part series describing subject and family perspectives from the central thalamic deep brain stimulation for the treatment of traumatic brain injury using the Medtronic PC + S first-in-human invasive neurological device trial to achieve cognitive restoration in moderate to severe traumatic brain injury, with subjects who were deemed capable of providing voluntary informed consent. In this article, we report on interviews conducted prior to surgery wherein we asked participants about their experiences recovering from (...) brain injury and their perspectives on study enrollment and participation. We asked how risks and benefits were weighed, what their expectations and fears were, and how decisions were reached about trial participation. We found that informed consent and enrollment decisions are fraught. Subjects and families were often split, with subjects more focused on putative benefits and families concerned about incremental risk. Both subjects and families viewed brain injury as disruptive to personal identity and relationships. As decisions were made about study enrollment, families struggled with recognizing the re-emergent agency of subjects and ceding decision-making authority to subjects who had previously been dependent upon them for protection and guidance. Subjects and family members reported a hope for the relief of cognitive disabilities, improved quality of life, normalization of interpersonal interactions, and a return to work or school as reasons for study participation, along with altruism and a desire to advance science. Despite these aspirations, both subjects and families appreciated the risks of the intervention and did not suffer from a therapeutic misconception. A second essay to be published in the next issue of Cambridge Quarterly of Healthcare Ethics—Clinical Neuroethics will describe interviews conducted after surgery, the effects of cognitive restoration for subjects, families, and challenges presented to the social structures they will call upon to support them through recovery. The U.S. health care system is ostensibly market based and therefore at least partially reliant on competition and consumer demand to regulate costs. Yet information about an essential feature of market transactions—costs—is typically obscure to patients until long after treatment. When discussing what must be disclosed for informed consent, the same list of required information is often mentioned regardless of the health care system in question, and information about costs rarely merits a place within this list. However, our assumptions about (...) what a moral principle requires need to be responsive to the realities of the health care system in which the principle is applied.This paper explores the moral foundations of disclosure and informed consent to argue that, in a market‐based system of the sort found in the United States, these same considerations support a requirement to disclose out‐of‐pocket costs before patients receive care. Next, I consider two objections to this view: first, that health care practitioners should focus solely on medical considerations in their encounters with patients and, second, that disclosing out‐of‐pocket costs would be too difficult to be mandated. I argue that medical and financial interests are inseparable within the U.S. health care system. If the difficulties in disclosing costs are deemed insurmountable, then the current system may prove unsustainable, both morally and financially, since we face the same practical impediments to implementing any meaningful consumer‐driven, market‐based health care reform. Finally, I explore some of the consequences of failing to disclose costs. The requirements of disclosing costs can be supported by the principle of respect for autonomy, regardless of the consequences, but in light of the consequences of the decision of whether to disclose, a concern about justice provides further support. Wittgensteinian Thomism (WT) proposes a post-Wittgensteinian reading of Aquinas based on the presence of genuine affinities between them in philosophical anthropology, epistemology, philosophy of mind, action theory, and ethics. While this proposal has been historically fruitful in the works of Elizabeth Anscombe, Peter Geach, Anthony Kenny, and Herbert McCabe, there is a significant difficulty in the prima facie incompatibility in the respective attitudes towards metaphysics between Wittgenstein and Aquinas. This calls into question the very coherence of the WT proposal. Against (...) this objection, I will argue that WT is a coherent proposal which can harmonize these seemingly incompatible attitudes towards metaphysics by showing that Wittgenstein’s conception of grammatical observations do not necessarily exclude metaphysics but provides a guide towards it. I will argue that rather than being opposed, grammar and metaphysics are concomitantly joined in Wittgenstein’s later remarks. If this reading of Wittgenstein surmounts that proposed by Hacker, then the incoherence objection to WT simply fails. (shrink)

From unemployment to Brexit to climate change, capitalism is in trouble and ill-prepared to cope with the challenges of the coming decades. How did we get here? While contemporary economists and policymakers tend to ignore the political and social dimensions of capitalism, some of the great economists of the past - Adam Smith, Friedrich List, John Maynard Keynes, Joseph Schumpeter, Karl Polanyi and Albert Hirschman - did not make the same mistake. Leveraging their insights, sociologists John L. Campbell and John (...) A. Hall trace the historical development of capitalism as a social, political, and economic system throughout the twentieth and early twenty-first centuries. They draw comparisons across eras and around the globe to show that there is no inevitable logic of capitalism. Rather, capitalism's performance depends on the strength of nation-states, the social cohesion of capitalist societies, and the stability of the international system - three things that are in short supply today. It is common to think that, in making choices for others, we should consider their values. But do the current interests of people with dementia ever depend on what they used to value? Or do their interests depend solely on what matters to them from now on? Two approaches are especially prominent in the philosophical literature. Some believe that the capacity to value or significantly care about things bestows a certain standing on the person’s present perspective, making it inappropriate to (...) appeal to her former values until the person no longer has this capacity. Others hold that a person’s past attitudes can never affect what is good for him now. On the “Revision Model” I defend, we should ordinarily recognize a person’s current values as authoritative in defining a person’s interests, because these represent his most up-to-date revision of his earlier views. However, if a person has lost the ability to comprehend his former values, then we cannot treat his current perspective as a genuine revision, since he is not answerable for the fact that his values have changed. Having never truly revised those former values, we should recognize their enduring relevance in defining his interests, insofar as they remain relevant to his life. This, however, is consistent with recognizing that the person’s interests may also depend on some of his current values and concerns as well. (shrink)

Rather than looking at protest in the ideal case, this book looks at how protest is actually practiced and argues that suitably constrained violent political protest is sometimes justified.

It is often said in physics that if two models of a theory are related by a symmetry, then the two models provide (or could provide) two different representations of the very same situation, alike the case of two maps of different color for the very same city. It is also said that the situations represented by two models of a theory are indiscernible in some ways when the models in question are related by a symmetry of the theory, just (...) like the situation in the interior of the cabin of a train when the train is at rest in the station is empirically indiscernible from the situation in the interior when the train is moving uniformly (in classical mechanics, these two situations are represented by two models related by a boost). In recent years, philosophers of physics have focused a lot of attention in developing various principles that aim to elucidate these and similar remarks on symmetries, models, physical equivalence, and representation that are widespread in physics practice. The goal of the current article is to provide a critical review of these principles, and suggest a new framework for thinking about these kinds of questions. One important upshot of the paper is that questions of indiscernibility, and questions of the representational capacity of models, must be distinguished from one another. (shrink)

Nationalism is often singled out as the powerful force that brought about the collapse of the last great land empires of the 19th and early 20th centuries. We offer a different picture: nationalism was weak before 1914, with war being caused by the fears of the great powers rather than pressures from below; crucially war was less an opportunity for pre-existing nationalists to seize than a maelstrom that created new identities.

This paper attempts to offer a positive reading of Tractarian ethics motivated by Kevin Cahill’s therapeutic framing of the Tractatus, on which ethics and language are taken to be coextensive, mutually encompassing spheres. This is taken to secure positive import for Tractarian ethics in a broad sense, though not connected to specific approbations or prohibitions. This is argued for in three sections: first, specifying the animating therapeutic intention of the Tractatus as reawakening the reader to a sense of wonder, against (...) the sedative effects of scientific-causal explanations; second, an elucidation of the underlying logic of TLP 6.4 – 42 to show that Wittgenstein’s repudiation of ethical propositions is not an abolition of ethics but an assertion of the disparity between the absolute value of ethics and the aims of scientific explanation; and third, outlining a positive reading of Tractarian ethics beginning with the cryptic expression, “ethics is transcendental”, by drawing out an analogy with logic as the transcendental condition of language to a view of ethics as a condition of meaningful actions and lives. The Eurocentric canon remains the predominant focus of music education often excluding the role of music and experiences of Black individuals and people of color. This singular perspective creates an incomplete and inaccurate understanding of the comprehensive nature of music and the humans who create, perform, and engage with it. In this article, the author shares her experience as a Black music educator and her aspirations for a music profession that incorporates the full range of human music engagement and expression. (...) The paper begins with a reflection on W.E.B. DuBois’s double consciousness followed by an exploration of the nuances, complexities, contradictions, and beauty of being a Black educator in a primarily white field. Subsequently, the essay presents four conceptual principles for a reimagined, inclusive music education approach, drawing inspiration from Sylvia Wynter’s “new science of the Word.” These principles advocate retelling the music education narrative to incorporate historically marginalized voices, reorienting music education to be human-centered, embracing interdisciplinary approaches to view music teaching and learning, and acknowledging the power of music in uplifting the human condition. Finally, this paper proposes a pathway for reconciling diverse identities prevalent in American culture with music education and academia. (shrink)

We argue that violent political protest is justified in a generally just society when violence is required to send a message about the nature of the injustice at issue, and when it is not ruled out by moral or pragmatic considerations. Focusing on protest as a mode of public address, we argue that its communicative function can sometimes justify or require the use of violence. I propose a conceptual framework for emotions according to which they are best understood as the feedback mechanism a creature possesses in virtue of its function to learn. More specifically, emotions can be neatly modeled as a measure of harmony in a certain kind of constraint satisfaction problem. This measure can be used as error for weight adjustment (learning) in an unsupervised connectionist network.
