In the chapter on Observing Reason in the Phenomenology, as well as in §368 of the Philosophy of Nature, Hegel deals with the life sciences of his time. There, he labels the methodology of its representatives, namely zoology and comparative anatomy, as external teleology. In this paper I want to show that by doing so he is actually discussing a general kind of functionalism. Thereby, I want to highlight a line of thought in Hegel's texts which represents a productive reading (...) of external teleology contrary to a destructive reading on which scholars have mainly focussed. Ernest Ansermets Die Grundlagen der Musik im menschlichen Bewusstsein (1961) ist zweifellos eine solche. Ansermets zentrales Anliegen ist Begründung der Tonalität. Worin gründet die „natürlich“ erscheinende – und zugleich im 20. Jahrhundert als überholt angesehene – tonale Syntax? Wodurch unterscheidet sich diese von nachtonalen Formen? Ansermet unternimmt angesichts der musikalischen Entwicklungen des 20. Jahrhunderts eine großangelegte Apologie der Tonalität. (...) In dieser soll aufgezeigt werden, dass die tonale Form des musikalischen Materials im „menschlichen Bewusstsein“ fundiert ist. Dabei gelangt er letztlich zu der Auffassung, dass die tonale Form der Tonhöhen- und Tondauergestaltung als Selbstvergegenständlichung des Menschen zu fassen sei. Die vorliegende Untersuchung unternimmt es, Ansermets Grundansatz und dessen Voraussetzungen sowie auch die – durchaus disparaten – Durchführungsbestimmungen in der Weise eines kritischen Kommentars zu bedenken. Bruno Liebrucks hat eine eigenständige, an Vico, Herder, Hamann, Humboldt und Cassirer anknüpfende Philosophie von der Sprache her“ entwickelt, welche Sprache als Medium der Welterschließung begreift. Zu dieser gelangt er durch eine fundamentalphilosophische Auseinandersetzung mit jenen drei Revolutionierungen im Denken des Denkens, die mit den Namen Platon, Kant und Hegel verknüpft sind. Definition of the problem Few concepts in recent ethical debates have enjoyed as much popularity as the concept of discrimination. However, a comparative discussion of the concept, including its conceptual nuances and its ethical significance for health care, has so far been lacking. The aim of this paper is to develop a nuanced understanding of discrimination based on the philosophical and sociological literature against the background of ethically relevant medical and nursing scenarios. Methods Using practical examples from health care, we (...) discuss direct, indirect, and statistical discrimination; we examine the importance of intentions and the role of collective actors. In addition, we analyze which social groups may experience discrimination and the respective importance of forms of epistemic injustice. Conclusions We argue that despite its complexity, the concept offers significant added value because it allows us to highlight forms of disadvantage that go beyond the violation of individual specific rights or interests. As a knowledge-based system of great societal influence, health care exhibits some characteristics that can foster discrimination. Acknowledging this fact is essential in order to effectively address discrimination. (shrink)

This article engages with Plato’s justification of art and its core category, the concept of μίμησις. It will be shown that there is a sound systematic difference between two basic meanings of μίμησις in Plato. The proper understanding of this difference has considerable bearing both on the understanding of Plato and on the philosophy of art, since it enables us to bridge two gaps: First, the gap between the standpoint of the early and middle Plato with its famous criticism of (...) art, on the one hand, and the affirmative re-evaluation of art in the late period, on the other hand. Second, the gap between the two principal pre-modern paradigms employed in justifying art: the ontological paradigm of art as (re)presentation on the one side, and the modern paradigm of art as expression on the other side. What lasting relevance does this have?

This essay criticises the attempt to explain the so-called normativity of law with reference to a model of coordination conventions. After specifying the explanandum of the normativity of law, I lay out the conceptions of ‘coordination’ and ‘convention’ and how the combination of both sets out to contribute to legal philosophy. I then present two arguments against such an account. Firstly, along a reductio ad absurdum, I claim that if an account of coordination conventions tries to explain the normativity of (...) law by focusing on a coordination problem among judges it leads to self-contradiction. Secondly, I argue that even if one allows for widening the coordination problem beyond the group of judges, one is unable to account for the notion of duty. I will substantiate this second argument by distinguishing different scopes of the deontic operator “ought”. I conclude by reconsidering what explaining the normativity of law could amount to. People can be uncertain in their moral judgments. Philosophers have argued that such uncertainty can either refer to the underlying empirical facts (empirical uncertainty) or to the normative evaluation of these facts itself (normative uncertainty). Psychological investigations of this distinction, however, are rare. In this paper, we combined factor-analytical and experimental approaches to show that empirical and normative uncertainty describe two related but different psychological states. In Study 1, we asked N = 265 participants to describe a case of moral (...) uncertainty and to rate different aspects of their uncertainty about this case. Across this wide range of moral scenarios, our items loaded onto three reliable factors: lack of information, unclear consequences, and normative uncertainty. In Study 2, we confirmed this factor structure using predefined stimulus material. N = 402 participants each rated eight scenarios that systematically varied in their degree of uncertainty regarding the consequences of the described actions and in the value conflict that was inherent to them. The empirical uncertainty factors were mainly affected by the introduction of uncertainty regarding consequences, and the normative uncertainty factor was mainly affected by the introduction of value conflict. Our studies provide evidence that the distinction between empirical and normative uncertainty accurately describes a psychological reality. We discuss the relevance of our findings for research on moral judgments and decision-making, and folk metaethics. (shrink)

In this paper I argue that there is textual evidence that the chapter on Teleology in Hegel's Science of Logic, read under certain premises, also discusses something that in contemporary analytic philosophy is called a ‘basic action’. The three moments of Teleology—(a) ‘The Subjective Purpose’, (b) ‘The Means’ and (c) ‘The Realized Purpose’—can be interpreted as (a) a certain intentional content in the mind of a subject, which can be expressed in the form of an imperative, (b) the immediate taking (...) in possession of the body, which can be described as a basic action, and (c) the description of the relation of the event brought about by the basic action with other events in the world, which can be described in the terms of event-causality. This reading reveals an astonishing parallel to Donald Davidson's distinction between proper basic actions and their different descriptions in the form of events. In this way we can make Hegel's, at first glance, confusing identification of subjective purpose (intention), means (basic action) and realized purpose (event) comprehensible. Through that, the actual aim is to show that what I call basic actions are in fact an example of a more general thought that Hegel calls a teleological relation. (shrink)

Artificial intelligence increasingly executes tasks that previously only humans could do, such as drive a car, fight in war, or perform a medical operation. However, as the very best AI systems tend to be the least controllable and the least transparent, some scholars argued that humans can no longer be morally responsible for some of the AI-caused outcomes, which would then result in a responsibility gap. In this paper, I assume, for the sake of argument, that at least some of (...) the most sophisticated AI systems do indeed create responsibility gaps, and I ask whether we can bridge these gaps at will, viz. whether certain people could take responsibility for AI-caused harm simply by performing a certain speech act, just as people can give permission for something simply by performing the act of consent. So understood, taking responsibility would be a genuine normative power. I first discuss and reject the view of Champagne and Tonkens, who advocate a view of taking liability. According to this view, a military commander can and must, ahead of time, accept liability to blame and punishment for any harm caused by autonomous weapon systems under her command. I then defend my own proposal of taking answerability, viz. the view that people can makes themselves morally answerable for the harm caused by AI systems, not only ahead of time but also when harm has already been caused. Der Wiener Philosoph Franz Ungler ist ein eminenter Vertreter jener von Robert Reininger und Erich Heintel grundgelegten „Wiener Schule“, deren Hauptanliegen die Aneignung und Vergegenwärtigung der systematischen Errungenschaften der philosophischen Tradition ist. Als einer der wenigen Dialektiker des 20. Jahrhunderts erblickt Ungler die gedankliche Herausforderung dabei darin, einerseits nicht hinter die Errungenschaften der Transzendentalphilosophie in naive Ontologien zurückzufallen, andererseits die Probleme der Transzendentalphilosophie einer haltbaren Lösung zuzuführen. Dazu leistete er in seiner außergewöhnlich reichhaltigen und lebendigen Lehre einen bedeutsamen Beitrag. Diese (...) aus dem Nachlass veröffentlichte Vorlesung widmet sich dem anspruchsvollen Werk des Frankfurter Philosophen Bruno Liebrucks , der im Ausgang von denselben systematischen Grundmotiven die Sprache sowie die Logik ins Zentrum seines Denkens stellt. Dabei eröffnet er neue Perspektiven auf die Sprache und auf die Logik, die sich von jenen des Mainstream des 20. Jahrhunderts deutlich abheben. Ungler entwickelt in dieser Vorlesung die Grundlinien von Liebrucks' Kant- und Hegel-Interpretation, wie sie in dessen Opus magnum "Sprache und Bewußtsein" gegeben werden. "The Notion of the concrete General in Plato and Aristotle – Questioning formal logical Ontologies" - The problem of the concrete general notion is equivalent to enquiring about the unity of the general and the singular. Since Plato, this question - which is commonly referred to as the problem of methexis – is one of the most fundamental problems which philosophy is engaged in. This article pursues two goals: Firstly, it aims to provide a brief systematical account on the origin (...) and the solution of this problem with regards to Plato and Aristotle. In doing so, Plato’s solution of the problem of methexis, in the dialectic of his late period, is contrasted with Aristotle’s concept of substance. In this regard the question arises whether Aristotle’s thinking of the problem of methexis has exceeded his teachers achievements in the field of fundamental philosophy or not. Is Aristotle not ultimately avoiding the dialectic, which is contained in the concept of substance – for reasons of formal logic? This point, secondly, shall question the currently prevailing implicitness of the presupposed autarky of formal logic. For it is the very problem of logical justification of the concept of substance in Aristotle which raises this issue: Can the notion of the concrete general be conceivable at all under the precondition that formal logical axioms are also ontologically relevant? We review this approach and identify fundamental assumptions that have implicitly entered into it, emphasizing issues that any such derivation is likely to face.

La lógica formal no es una ciencia que se encuentre libre de presupuestos. Más bien, su representación de la forma lógica se basa en presupuestos a los cuales la lógica misma no llega. Este artículo se propone aclararlos. Para ello, en un primer momento, consideraremos las determinaciones fundamentales de la forma lógica. En un segundo paso, esta consideración será profundizada a partir del análisis del concepto lógico-formal de “concepto”. Con él se plantean problemas que hacen necesario avanzar en la reflexión (...) sobre la forma lógica. Ese avance necesario es la lógica trascendental en el sentido en el que la entiende Kant. /// Formal logic cannot claim to represent a presuppositionless science. In fact, its account of logical form rests upon a set of presuppositions, which is not justified within logic itself. This article shall elaborate on this in two steps. First, we shall highlight the primal determinations in formal logic’s account of logical form. Second, we shall deepen this with regard to the account of the concept. In doing so, we will encounter systematic problems, the resolution of which necessarily gives rise to a genuine self-reflection of logical form, which is transcendental logic in terms of Kant. /// Formale Logik ist keine voraussetzungsfreie Wissenschaft, sondern ihre Darstellung der logischen Form beruht auf Voraussetzungen, die sie selbst nicht einholt. This paper focuses on consent and third-party coercion, viz. cases in which a person consents to another person performing a certain act because a third party coerced her into doing so. I argue that, in these cases, the validity of consent depends on the behavior of the recipient of consent rather than the third party’s coercion taken separately, and I will specify the conditions under which consent is invalid. My view, which is a novel version of what I call a (...) Recipient-Focus-View, holds that coercion invalidates consent only if consent was ‘obtained by’ coercion, but not if consent was ‘merely motivated by’ coercion. I explain and support my view on the basis that it best reconciles an unnoticed tension between two fundamental principles in the debate on consent and that it can deal with cases that undermine other Recipient-Focus-Views. This paper focuses on the use of ‘black box’ AI in medicine and asks whether the physician needs to disclose to patients that even the best AI comes with the risks of cyberattacks, systematic bias, and a particular type of mismatch between AI’s implicit assumptions and an individual patient’s background situation.Pacecurrent clinical practice, I argue that, under certain circumstances, these risks do need to be disclosed. Otherwise, the physician either vitiates a patient’s informed consent or violates a more general obligation (...) to warn him about potentially harmful consequences. To support this view, I argue, first, that the already widely accepted conditions in the evaluation of risks, i.e. the ‘nature’ and ‘likelihood’ of risks, speak in favour of disclosure and, second, that principled objections against the disclosure of these risks do not withstand scrutiny. Moreover, I also explain that these risks are exacerbated by pandemics like the COVID-19 crisis, which further emphasises their significance. (shrink)

The world is experiencing a cataclysmically increasing burden from chronic illnesses. Chronic diseases are on the advance worldwide and treatment strategies to counter this development are dominated by symptom control and polypharmacy. Thus, chronic conditions are often considered irreversible, implying a slow progression of disease that can only be hampered but not stopped. The current plant-based movement is attempting to alter this way of thinking. Applying a nutrition-first approach, the ultimate goal is either disease remission or reversal. Hereby, ethical questions (...) arise as to whether physicians’ current understanding of chronic illness is outdated and morally reprehensible. In this case, physicians may need to recommend plant-based diets to every patient suffering from chronic conditions, while determining what other socioecological factors and environmental aspects play a role in the chronic disease process. This article provides insights to aspects of diet and chronic illness and discusses how the plant-based movement could redefine current understanding of chronic disease. The ethical justifications for recommending of a plant-based diet are analyzed. The article concludes that not advocating for plant-based nutrition is unethical and harms the planet and patients alike. (shrink)

In the absence of effective judicial remediation mechanisms after business-related human rights violations, companies themselves are expected to establish remediation procedures for affected victims and communities. This is a challenge for both companies and victims since comprehensive company-based grievance mechanisms are currently missing. In this paper, we explore how companies can provide effective remediation after human rights violations. Accordingly, we critically assess two different approaches to conflict resolution, alternative dispute resolution and restorative justice, for their potential to provide dialogue-based, non-judicial (...) remediation. We argue that remedy through agreement-driven ADR mechanisms risks marginalizing the interests and concerns of victims and affected community members, particularly in weak institutional contexts. Hence, we develop a dialogue-driven framework for corporate remediation of human rights violations grounded on RJ principles. This restorative framework provides a comprehensive CGM that focuses on the harms and needs of victims and aims at restoring justice through restorative dialogue. Based on a prompt discovery and a thorough investigation of the grievance, companies should design and prepare the remediation process together with victims, offenders and affected community members. Through restorative dialogue with the affected parties about the circumstances and impacts of the wrongdoing, companies can repair the harm, regain legitimacy amongst stakeholders as well as transform their business practices to avoid future human rights violations. ABSTRACTThe question of how to engage with stakeholders in situations of value conflict to create value that includes a plurality of conflicting stakeholder value perspectives represents one of the crucial current challenges of stakeholder engagement as well as of value creation stakeholder theory. To address this challenge, we conceptualize a discursive sharing process between affected stakeholders that is oriented toward discursive justification involving multiple procedural steps. This sharing process provides procedural guidance for firms and stakeholders to create pluralistic stakeholder value (...) through the discursive accommodation of diverging stakeholder value perspectives. The outcomes of such a discursive value-sharing process range from stakeholder value dissensus to low and increasing levels of stakeholder value congruence to stakeholder value consensus. Hence, this article contributes to the emerging literature on integrative stakeholder engagement by conceptualizing a procedural framework that is neither overly oriented towards dissensus nor consensus. Jahrhundert beschäftigt. Das vorliegende Buch untersucht die vielfältigen Motive dieses spannungsvollen Verhältnisses, von der Soziologie der Innerlichkeit bis zur Ästhetik. Grundlage ist die eingehende Analyse von Adornos Erstlingswerk und anderer Texte über den Dänen. Gleichwohl gilt es, dessen Denken auch in seiner Eigenständigkeit zu berücksichtigen. Denn nur wo beide auf Augenhöhe behandelt werden, lässt sich (...) die Frage nach dem Einfluss Kierkegaards auf Adorno stellen. Eine Antwort ist die Forschung bisher weitgehend schuldig geblieben, entweder weil sie sich die Deutung des Frankfurters zu eigen gemacht, oder diese umgekehrt als verfehlt abgetan hat. Was ihn mit Kierkegaard zugleich verbindet und entzweit, ist die Kritik des Deutschen Idealismus und die Radikalität, mit der das moderne autonome Subjekt als entfremdetes bestimmt wird.
