The naïve idea of “size” for collections seems to obey both Aristotle’s Principle: “the whole is greater than its parts” and Cantor’s Principle: “1-to-1 correspondences preserve size”. Notoriously, Aristotle’s and Cantor’s principles are incompatible for infinite collections. Cantor’s theory of cardinalities weakens the former principle to “the part is not greater than the whole”, but the outcoming cardinal arithmetic is very unusual. It does not allow for inverse operations, and so there is no direct way of introducing infinitesimal numbers. Here (...) we maintain Aristotle’s principle, instead halving Cantor’s principle to “equinumerous collections are in 1–1 correspondence”. In this way we obtain a very nice arithmetic: in fact, our “numerosities” may be taken to be nonstandard integers. These numerosities appear naturally suited to sets of ordinals, but they depend, for generic sets, on a “labelling” of the universe by ordinals. The problem of finding a canonical way of attaching numerosities to all sets seems to be worth further investigation. (shrink)

Networks for the exchange and/or sharing of genetic data are developing in many countries. We focus here on the situations in the US and France. We highlight some recent and remarkable differences between these two countries concerning the mode of access to, and the storage and use of genetic data, particularly as concerns two-sided markets and dynamic consent or dynamic electronic informed consent. This brief overview suggests that, even though the organization and function of these two-sided markets remain open to (...) criticism, dynamic e-IC should be more widely used, especially in France, if only to determine its real effectiveness. Within the current mainstream research in the foundations of physics, much attention has been turned to the program of Axiomatic Reconstruction of Quantum Theory in terms of Information-Theoretic principles (ARQIT). ARQIT aims at finding a few general information-theoretic principles from which, once translated into mathematical terms, one can formally derive the structure of quantum theory. This chapter explores the role of mechanistic explanations and mathematical explanations (in particular, structural explanations) within ARQIT. Merleau-Ponty has long been known as one of the most important philosophers of aesthetics, yet most discussions of his aesthetics focus on visual art. This book corrects that balance by turning to Merleau-Ponty's extensive engagement with literature. From Proust, Merleau-Ponty developed his conception of "sensible ideas," from Claudel, his conjoining of birth and knowledge as "co-naissance," from Valéry came "implex" or the "animal of words" and the "chiasma of two destinies." Literature also provokes the questions of expression, metaphor, and truth (...) and the meaning of a Merleau-Pontian poetics. The poetic of Merleau-Ponty is, the book argues, a poetic of the flesh, a poetic of mystery, and a poetic of the visible in its relation to the invisible. Ultimately, theoretical figures or "figuratives" that appear at the threshold between philosophy and literature enable the possibility of a new ontology. RESUMO A operação que nos interessa destacar gira em torno da zona de problematicidade que ilumina o trabalho crítico com materiais culturais e que supõe uma complementaridade conceitual entre os caminhos da biopolítica e da precariedade. Aquilo que essas análises e seu trabalho com materiais indicam, de um modo muito nítido, é um conjunto de dimensões, linhas de indagação e zonas de problematização que não adquirem a suficiente relevância nos debates contemporâneos sobre biopolítica e precariedade. Daí advém a necessidade de (...) elaborar uma ferramenta de trama conceitual que dê conta dos marcadores que codificam uma vida precária. Justamente, este é o ponto cego em comum e, ao mesmo tempo, o espaço de interseção conceitual que nos interessa: os percursos em biopolítica que não tenham considerado os processos de precarização da vida e, em igual medida, as teorizações sobre a condição precária que não tenham pensado em termos estritamente biopolíticos. Denominamos bios-precário a este nó conceitual a partir da conjunção entre a caixa de ferramentas de Judith Butler em relação à ontologia corporal da precariedade e ao cruzamento do percurso biopolítico de Roberto Esposito entre vida impessoal e biopolítica afirmativa. ABSTRACT The operation that we want to emphasize revolves around the problematic area that brings light to the critical work that uses cultural material and assumes a conceptual complementarity between the paths of biopolitics and precariousness. What these analyses and their work with materials clearly indicate is that a set of dimensions, lines of questioning and problematic zones are not given enough relevance in contemporary debates about biopolitics and precariousness. Therefore, there emerges the need to develop a conceptual tool that may account for markers that encode a precarious life. That is, precisely, the common blind spot and, at the same time, the space of conceptual intersection on which we focus: the biopolitical paths that have not been taken into account in the processes of precarization of life and, in equal measure, the theorization about the precarious condition that has not been developed in strictly biopolitical terms. We call this conceptual knot bíos-precarious. This concept stems from the confluence between Judith Butler’s tools in relation to the bodily ontology of precariousness and the intersection between impersonal life and affirmative biopolitics in Roberto Esposito’s biopolitical path. RESUMEN La operación que nos interesa subrayar gira en torno a la zona de problematicidad que ilumina el trabajo crítico con materiales culturales y que supone una complementariedad conceptual entre los recorridos de la biopolítica y de la precariedad. Lo que estos análisis y su trabajo con materiales indican, de un modo muy nítido, es un conjunto de dimensiones, líneas de indagación y zonas de problematización que no adquieren la suficiente relevancia en los debates contemporáneos sobre biopolítica y sobre precariedad. De allí la necesidad de elaborar una herramienta de entramado conceptual que dé cuenta de los marcadores que codifican una vida precaria. Both Leibniz and Humboldt are scholars in whose work we find a passionate interest in the history and development of languages combined with a strong theoretical commitment. Linking their names to linguistic comparativism draws attention to the contribution these scholars have made to the history of comparativism and also promotes discussion of the relationship of theory and practice in linguistic research in more general terms. In September 1986, a conference on Leibniz, Humboldt and the Origins of Comparativism' was held in (...) Rome. The paper analyzes the early theory building process of Thomas Hunt Morgan from the 1910s to the 1930s and the introduction of the invisible gene as a main explanatory unit of heredity. Morgan’s work marks the transition between two different styles of thought. In the early 1900s, he shifted from an embryological study of the development of the organism to a study of the mechanism of genetic inheritance and gene action. According to his contemporaries as well as to historiography, Morgan (...) separated genetics from embryology, and the gene from the whole organism. Other scholars identified an underlying embryological focus in Morgan’s work throughout his career. Our paper aims to clarify the debate by concentrating on Morgan’s theory building—characterized by his confidence in the power of experimental methods, and carefully avoiding any ontological commitment towards the gene—and on the continuity of the questions to be addressed by both embryology and genetics. The aim of this paper is to present a reflection on the idea of religiousness or religious sentiment in Benjamin Constant de Rebecque and the importance of this in free societies. For the author, the religious sentiment avoids the evils of selfishness and individualism and, at the same time, the dangers of political despotism and religious. In this sense, religion is seen as necessary to free societies. However, it must be separated from the priestly factions. Constant presents a strategy of (...) fusing a perspective of Enlightenment - with the concepts of progress and civilization - with aspects of the thought of Edmund Burke who advocated a more local interest. Thus, the "Greeks" - an "ideal type" avant la lettre - are presented with real people in history, which can help to think of our civilization. This text is an integrated and comprehensive account of theories of justice and judgement in contemporary political and moral philosophy. It offers a critical examination of judgement and normative validity in the recent works of Rawls, Habermas, Ackerman, Michaleman, and Dworkin. Ferrara demonstrates how the understanding of justice and normative validity, since the linguistic turn in philosophy, is defined in terms of reflective judgement. Alessandro Ferrara explains what he terms "the democratic horizon" - the idea that democracy is no longer simply one form of government among others, but is instead almost universally regarded as the only legitimate form of government, the horizon to which most of us look. Professor Ferrara reviews the challenges under which democracies must operate, focusing on hyperpluralism, and impresses a new twist onto the framework of political liberalism. The possible privatization of Social Security has long been a matter of theoretical interest to those who ideologically favor free markets and maximum personal autonomy. But in the spirit of an age when the Berlin Wall fell and the totalitarian Soviet empire collapsed through a peaceful revolution from within, the politics of Social Security has been remade in recent years in a similarly dramatic fashion.

During the twentieth century, the view that assertions and norms are valid insofar as they respond to principles independent of all local and temporal contexts came under attack from two perspectives: the partiality of translation and the intersubjective constitution of the self, understood as responsive to recognition. Defenses of universalism have by and large taken the form of a thinning out of substantive universalism into various forms of proceduralism. Alessandro Ferrara instead launches an entirely different strategy for transcending the (...) particularity of context without contradicting our pluralistic intuitions: a strategy centered on the exemplary universalism of judgment. Whereas exemplarity has long been thought to belong to the domain of aesthetics, this book explores the _other_ uses to which it can be put in our philosophical predicament, especially in the field of politics. After defining exemplarity and describing how something unique can possess universal significance, Ferrara addresses the force exerted by exemplarity, the nature of the judgment that discloses exemplarity, and the way in which the force of the example can bridge the difference between various contexts. Drawing not only on Kant's _Critique of the Power of Judgment_ but also on the work of Hannah Arendt, John Rawls, Ronald Dworkin, and Jürgen Habermas, Ferrara outlines a view of exemplary validity that is applicable to today's central philosophical issues, including public reason, human rights, radical evil, sovereignty, republicanism and liberalism, and religion in the public sphere. This article examines recent theories of democratic citizenship as well as the institutional separation of religion and politics in light of shortcomings with the traditional secularization thesis. Due to the fact that juridical norms and forms of consciousness develop at a more rapid pace than religious ones, received accounts of both democratic equality and toleration need to be reconceptualized. Questions concerning the legitimacy and neutrality of religious reasoning in democratic politics, as pursued in the work of Rawls and Habermas, also (...) need to be informed by further reflection on the confessional context and other empirical features of post-secular societies. Comparing the politics of same-sex marriage in Canada and Italy helps to illustrate this point. (shrink)

In this paper I examine the role of dispositional properties in the most frequently discussed interpretations of non-relativistic quantum mechanics. After offering some motivation for this project, I briefly characterize the distinction between non-dispositional and dispositional properties in the context of quantum mechanics by suggesting a necessary condition for dispositionality – namely contextuality – and, consequently, a sufficient condition for non-dispositionality, namely non-contextuality. Having made sure that the distinction is conceptually sound, I then analyze the plausibility of the widespread, monistic (...) ontological thesis about the reducibility of dispositional properties to categorical properties in the context of the philosophy of quantum mechanics. I conclude that with the exception of Bohmian mechanics, the other “minimally realist” views of quantum mechanics require essential dispositions, i.e., dispositions of a non-reducible kind. Interestingly, seen behind the lenses of dispositionalism, Bohr’s and Bohm’s interpretations of quantum mechanics are much closer than it is usually recognized, a fact that could teach us something about the way the quantum world is. Frank Michelman’s recent book Constitutional Essentials. On the Constitutional Theory of Political Liberalism is discussed from a specific angle, related to how Rawls’s ‘deflection procedure’ – called by Michelman ‘justification by constitution’ – is affected by two recent innovations in the paradigm of political liberalism: first, the extension of reasonable pluralism to a family of liberal political conceptions of justice that coexist in a liberal-democratic society; second, the idea of legitimation based on the criterion of reciprocity, aimed at supplementing the (...) liberal principle of legitimacy. In the attempt to probe Michelman’s assessment of the impact of these two innovations, three critical points are mentioned, for each of them, that suggest a somewhat more sceptical attitude than Michelman’s about the capacity of ‘justification by constitution’ to remain substantially unaltered, once these innovations are in place. In this paper I argue that the debate between the so-called “presentists” – according to whom only the present is real – and the “eternalists”, according to whom past present and future are equally real, has no ontological significance. In particular, once we carefully distinguish between a tensed and a tenseless sense of existence, it is difficult to find a single ontological claim on which the two parties could disagree. Since the choice of using a tense or a tenseless language (...) is dictated by purely pragmatic reasons, we should abstain from bringing to bear pseudo-debates generated by the “tensed” or the “tenseless theories” of time on the question of understanding the philosophical implications of contemporary spacetime theories, or notions like becoming, change and persistence in time. After some suggestions about how to clarify the confused metaphysical distinctions between dispositional and non-dispositional or categorical properties, I review some of the main interpretations of QM in order to show that – with the relevant exception of Bohm’s minimalist interpretation – quantum ontology is irreducibly dispositional. Such an irreducible character of dispositions must be explained differently in different interpretations, but the reducibility of the contextual properties in the case of Bohmian mechanics is guaranteed by the fact that the positions (...) of particles play the role of the categorical basis, a role that in other interpretations cannot be filled by anything else. In Bohr’s and Everett-type interpretations, dispositionalism is instrumentalism in disguise. (shrink)

My first and main claim is that physics cannot provide empirical evidence for the objectivity of absolute becoming, for the simple reason that it must presuppose it, at least to the extent that classical spacetime theories presuppose an ontology of events. However, the fact that a theory of absolute becoming must be situated in the a priori realm of metaphysics does not make becoming completely irrelevant for physics, since my second claim will consist in showing that relational becoming, once appropriately (...) defined and understood, properly belongs to the tangled set of issues usually referred to with the label “the arrow of time”. In this respect it is argued that the arrow of becoming is more fundamental both than the causal arrow and of other well-known physical processes that are temporally asymmetric. (shrink)

Within the author’s long-term project of updating John Rawls’s paradigm of “political liberalism” to a historical context different from the original one, this paper focuses on how political liberalism can help us understand populism and help liberal democracy survive the populist upsurge. In the first section, political liberalism is argued to be of help in directing our attention to three constitutive aspects of all sorts of populism: the conflation of “the people” with the electorate and the electorate with the nation, (...) the attribution of constituent power to the electorate, and a penchant for so-called “justified intolerance.” In the second section, enfeebled democracies and postliberal democracies are discussed as two distinctly dangerous outcomes of populist contagion. In this article by way of reply, the author responds to the challenging comments on The Democratic Horizon provided by Michelman, Benhabib, White, Scheuerman and Laden. In response to Michelman, some reflections are propounded (1) on the function of judicial review, in order to alleviate the tension between two understandings of the mandate of the highest interpreter of the constitution as aimed at remedying either an occlusion of democratic authorship or a shortfall of agreement, and (2) on the need to (...) rethink how the authority of the supreme interpreter relates to the will of the people in a deeply changed historical context. In response to Benhabib, the author discusses the new limits of the accommodation of diversity in Fairburg, a fictional polity that expands the Rawlsian standard of ‘ reasonable disagreement’, and defends the normative relevance and democratic credentials of his notion of ‘ multivariate polity’. In response to White, after recalling the importance of putting the ‘democratic ethos’ at the center of a reflection on the democratic quality of complex societies where formal procedures often mask elitist substance, the author defends the ‘political, not metaphysical’ credentials of ‘openness’ (as well as of ‘exemplarity’ as the ‘upstream source’ of openness) and accepts a complementarity of ‘openness’ and ‘presumptive generosity’. In response to Scheuerman, the author restates his focus on the democratic ethos as a supplement to, not a replacement of, the reflection on democratic procedures and defends the conceptual diversity of governance from government. In response to Laden, the author highlights the diversity of contexts to which his own and Laden’s versions of ‘democratic justification’ are responding and defends a more moderate version of ‘openness’, which still keeps constitutional essentials and political values shielded from ongoing questioning. Finally, the author interprets the debate aroused by The Democratic Horizon as indicative of the persistent vitality of the Rawlsian legacy in the 21st century. (shrink)

The paper discusses some thematic issues that emerge from the Kantian study of diseases of cognition and volition, taking into consideration his anthropological works and some problems emerging from his main critical works. Starting from the explanation of the taxonomy of the main mental illnesses, some epistemological themes will be illustrated, linked to the fallible relationship between transcendental truths and the empirical dimension of knowledge and to the Kantian concept of error. Subsequently, the study of affects and passions, conceived as (...) illnesses of volition, will show the difficulties linked to a total involvement of reason in moral action, concerning the shortcomings of human action with respect to the principle of responsibility. Finally, the paper will focus on the role of legal imputability in relation to moral responsibility and to mental diseases. (shrink)

Istinski realistička teorija prava – čija se mogućnost ispituje u ovome radu – trebala bi imati sljedeća obilježja. U svakom slučaju, trebala bi biti općenitija od postojećih teorija, to jest vrijediti kako za common law tako i za kontinentalnoeuropsko pravo; posljedično tome, trebala bi obrnuti odnos između zakonodavstva i pravosuđenja kakav obično uspostavljaju pozitivističke teorije. I u historiografiji i u poredbenom pravu, pri čemu je teorija prava njihov produžetak na višoj razini apstrakcije, središnji trenutak legal processa je pravosuđenje, dok se (...) zakonodavstvo može shvatiti kao jedan od mnogih pokušaja, možebitno ne i najuspješniji, ograničavanja i nadziranja pravosuđenja. Primjer objašnjavalačke sposobnosti istinski realističke teorije prava jest tzv. kriza izvora: zakonodavstvo uspostavlja suce, no oni su ti koji potom, u konačnici, određuju hijerarhiju izvora prava i sam položaj zakonodavstva u hijerarhiji.
