Current methods of obtaining an informed consent leave much to be desired. Patients rarely read consent forms or understand all of the risks, benefits, or alternatives associated with their treatment. Evaluating the advantages and disadvantages of treatment options often presents a more significant challenge for patients with lower levels of health literacy. This article reviews the evidence of shortcomings in our informed consent system and then explores the potential for a new approach to engage patients at all levels of health (...) literacy in their treatment decisions. Specifically, the article will examine the potential of shared decision-making to bridge gaps in knowledge, increase patient adherence to treatment, and improve health outcomes in low health literacy patient populations. Leveling barriers to treatment information for disadvantaged populations should be a public health imperative, especially if it can be shown to improve health outcomes and reduce health disparities. Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. The present work proposes a critical exploration of the epistemological foundations of modern contractualism, showing how its exclusion criteria operate through language games and the configuration of constitutional order. This critical exercise may improve the understanding of the conditions of possibility for a new social pact sense, in a political context marked by the Chilean popular revolt of 2019. Two consequential effects from above: the resignification of constitutional contents and the beginning of a constituent process.

Jaime Madden Teaching Online: Issues of Equity and Access in Writing-centric Formats The COVID-19 pandemic has turned us all into online teachers. In the context of this crisis, we have quickly learned new technologies and the affordances of asynchronous and synchronous delivery. We have grappled with the challenges of building community and supporting active engagement, and (...) we have turned to adapting our assessment methods for the remote environment. We have done this work at traditional colleges and universities, where online teaching was formerly the purview of graduate students and adjunct instructors. Online learning can no longer be associated with those who struggle to access traditional classrooms, such as disabled students and those who attend for-profit colleges. Instead, access to online learning can now be associated with access to wealth and to health—specifically as relates to avoiding contact with the virus. In K-12 education, we have seen districts that largely enroll white students make the decision to continue online or go hybrid for the fall 2020 semester, whereas those that largely enroll students of color are returning to the classroom.1 Inequalities pervade the teaching landscape as well. In a recent article published in this journal, coauthors writing as the Brocher Foundation Feminist Collective describe their experience and knowledge “of the ways that academia produces sickness.”2 The authors are white and cisgender women at Anglo-American and European universities, and even though they acknowledge that they did not experience high levels of racism, classism, linguistic marginalization, and/or illness, they still found themselves—at different stages of their careers—“worn thin” in a system where “bodies are disposable.”3 Commenting on this problem in another context, disability studies scholar Alison Kafer notes that disability is “more fundamental, more inevitable, for some than others.”4 The pandemic has made this much clear: able-bodied people are “temporarily able-bodied,” and those who experience racism and classism are among the most frequently and intensely sickened. In attending to how teachers and students transition online en masse, we need to consider how we are differently positioned within institutions governed by the logics of racialized capitalism. It is important to recognize not only which students can access these online spaces but also which skills such spaces tend to reward. It is also important to ask which teachers are disproportionately impacted by the transition online. In this piece, I describe the challenges of assessment and then wrestle with broader questions of access as a scholar invested in feminist studies and disability studies. The tension in online education between its promise of access and its methods of assessment is, I argue, worthy of urgent attention. The Challenges of Assessment I have taught online courses at four institutions: two private colleges and two public universities. This history up to the present state of affairs as it affects Native American women is contextualized as "patriarchal colonialism"and biocolonialism in genome research of indigenous peoples, since these marginalized women have had to contend with both hegemonies resulting in a sexualized and racialized mindset. En los resultados se evidencia un marcado uso del alófono aproximante labiodental sonoro en este tipo de habla y un comportamiento relativamente homogéneo en todo el país respecto de las principales variantes del fonema oclusivo bilabial sonoro. La comparación del fonema oclusivo (...) bilabial sonoro entre el español no estándar y el estándar muestra marcadas diferencias, datos que sugieren un cambio lingüístico en proceso desde el alófono aproximante bilabial sonoro al alófono aproximante labiodental sonoro.: In this study, we observed the phonetic variation of voiced bilabial occlusive phoneme in non-standard Spanish in a sample of Chilean speakers from cities whose geographical locations allow to cover the main urban sectors of the country. The results that show a marked use of voiced labiodental approximant allophone in this type of speech an a relatively homogenous behaviour in the whole country of the main variants of the voiced bilabial occlusive phoneme are presented. The comparison of voiced bilabial occlusive phoneme between non-standard and standard Spanish shows clear differences, data that suggest a linguistic change in process from voiced bilabial approximant allophone to voiced labiodental approximant allophone. Mark Eli Kalderon argues that morality is a fiction by means of which our emotional attitudes are conveyed. This is an improvement on the standard noncognitivist view, which denies that moral judgement is belief but claims instead that it is the expression of an emotional attitude. Noncognitivists tend to deny that moral sentences even purport to represent moral reality, and so they have developed non-standard semantics for moral discourse. Kalderon's fictionalism shows that noncognitivism can manage without such controversial semantics. (...) Medical practice should evolve alongside medical ethics. As our understanding of the ethical implications of physician-patient interactions becomes more nuanced, physicians should integrate those lessons into practice. As early as the 1930s, epidemiological studies began to identify that the rates of medical procedures varied significantly along geographic and socioeconomic lines. Dr. J. Alison Glover recognized that tonsillectomy rates in school children in certain school districts in England and Wales were in some cases eight times the rates of children in other (...) districts, with the only significant predictive factors being the current chief medical officer in the area and the socioeconomic well-being of the child's parents. Unfortunately, Dr. Glover's work revealed that the increase in tonsillectomies did not improve the health of adolescent patients and appeared to be performed “as a routine prophylactic ritual for no particular reason and with no particular result.”. Mark Sagoff draws on the last twenty years of debate over the foundations of environmentalism in this comprehensive revision of The Economy of the Earth. Posing questions pertinent to consumption, cost-benefit analysis, the normative implications of neo-Darwinism, the role of the natural in national history, and the centrality of the concept of place in environmental ethics, he analyses social policy in relation to the environment, pollution, the workplace, and public safely and health. In this book, Mark Johnston argues that God needs to be saved not only from the distortions of the "undergraduate atheists" but, more importantly, from the idolatrous tendencies of religion itself. Each monotheistic religion has its characteristic ways of domesticating True Divinity, of taming God's demands so that they do not radically threaten our self-love and false righteousness. Turning the monotheistic critique of idolatry on the monotheisms themselves, Johnston shows that much in these traditions must be condemned as false (...) and spiritually debilitating. A central claim of the book is that supernaturalism is idolatry. If this is right, everything changes; we cannot place our salvation in jeopardy by tying it essentially to the supernatural cosmologies of the ancient Near East. Remarkably, Johnston rehabilitates the ideas of the Fall and of salvation within a naturalistic framework; he then presents a conception of God that both resists idolatry and is wholly consistent with the deliverances of the natural sciences. Princeton University Press is publishing Saving God in conjunction with Johnston's forthcoming book Surviving Death, which takes up the crux of supernaturalist belief, namely, the belief in life after death. Mark Sagoff has written an engaging and provocative book about the contribution economics can make to environmental policy. Sagoff argues that economics can be helpful in designing institutions and processes through which people can settle environmental disputes. However, he contends that economic analysis fails completely when it attempts to attach value to environmental goods. It fails because preference-satisfaction has no relation to any good. Economic valuation lacks data because preferences cannot be observed. Willingness to pay is benchmarked on market (...) price and thus may reflect producer cost not consumer benefit. Moreover, economists cannot second-guess market outcomes because they have no better information than market participants. Mark Sagoff's conclusion is that environmental policy turns on principles that are best identified and applied through political processes. Written with verve and fluency, this book will be eagerly sought out by students and professionals in environmental policy as well as informed general readers. (shrink)

Mark Walker argues for Skeptical-Dogmatism-the view that we should disbelieve our cherished philosophical views, such as beliefs about what makes for a good life, religious beliefs, and political beliefs. To not disbelieve one's preferred views in these contested matters is hubristic.

A retraction of a scientific paper is made, most often due to errors or lack of publishing ethics on the part of authors, or, on occasion, duplicate publication by a publisher in error. The retraction notice that accompanies the retraction is an extremely important document, because it is the only information that provides a background to the public regarding the reason why the manuscript was retracted. In most cases, if the retraction notice is truly transparent, it will contain a few (...) sentences that indicate the reason, and possibly also the authors’ responsible, among other facts. According to the Committee on Publication Ethics (COPE), retraction notices should be free to view, i.e. open access. This opinion piece exposes how several publishers are selling access to retraction notices, including COPE members, despite, in some cases, being paying COPE members. mark schroeder University of Southern California 1 When Samuel Clarke gave his second Boyle lectures in 1705, he alleged in favor of his nonreductive, rationalist, intuitionist view that only ‘the extremest stupidity of mind, corruption of manners, or perverseness of spirit, can possibly make any man entertain the least doubt’ concerning it.1 Michael Huemer’s Ethical Intuitionism is offered in the same spirit, though he makes no assurances concerning the Truth and Certainty of the Christian Revelation.2 Not only are competing (...) metaethical views false, he alleges, those who accept them do not even do so on the basis of rational arguments (240). They are driven by bias (247), cynicism (242), and scientism (244), combined with a desire to be politically correct (albeit not in a ‘simplistic way’ (245)). Moreover, the persistence of non-intuitionist metaethical views, he suggests, has a pernicious effect on our society, encouraging vice and immorality (248). According to Huemer, what is important about intuitionism (his favored position) is that the dispute between intuitionism and ‘all other views’ is that ‘[a]nti-realist theories about value undermine our moral beliefs, our moral motivation, and even our sense of the meaning of life’ (248). He contends that ‘anti-realism really boils down to the view that nothing matters’ (249), despite explicitly acknowledging that most anti-realists would deny this, and apparently forgetting that among his targets of criticism in the book were supposed to be some realist views, as well—of the reductive variety. Although he calls his view ‘intuitionism,’ Huemer makes clear early on that what he wants to defend is not an epistemological view at all, but a metaphysical one. Both the physiological and the pathological morphogenetic processes that we can meet in embryogenesis, neogenesis and degenerative dysgenesis present common features: they are ruled by three different kinds of mechanisms, one related to cell migration, the second to cell differentiation and the third to cell proliferation. We deal here with an application to the cambial growth which essentially involves the third type of mechanism.Woody plants produce secondary tissue (secondary xylem and phloem) from a meristematic tissue called vascular cambium, responsible for (...) the radial growth of a tree. This paper focuses on the formation of secondary xylem, considered in two dimensions in a cross-section framework. A new discrete modelling approach is used, based on the cellular scale, in order to attain a more accurate understanding of how the elementary microscopic behaviour of each cell takes part in the macroscopic morphogenesis. The mathematical model essentially uses an occurrence method simulating the main features of radial growth with simple geometric rules, such as Thom's division rule (Thom,1972)to account for the cell proliferation. The study applies to concrete instances in which the changes made in the geometrical cellular patterns of the vascular cambium clearly affect the shape of the tree, as in Pinus radiata (D. Don.). In Naked, Krista K. Thomason offers a multi-faceted account of shame, covering its nature as an emotion, its positive and negative roles in moral life, its association with violence, and its provocation through invitations to shame, public shaming, and stigmatization. Along the way, she reflects on a range of examples drawn from literature, memoirs, journalism, and her own imagination. She also considers alternative views at length, draws a wealth of important distinctions, and articulates many of the most intuitive objections to (...) her own view in order to defend it more thoroughly. As such, the book’s subtitle, The Dark Side of Shame and Moral Life, undersells its scope and ambition. This is an exploration not just of shame’s dark side but a kaleidoscopic appreciation of both the nature and the (dis)value of shame and shaming. Somewhat undercutting this breadth, Thomason relies heavily on Kantian intuitions about equal respect and recognition for persons and their dignity; in several key arguments, she tells us to disregard predictable and systematic consequences of emotions, practices, and institutions so that we can better focus on their constitutive or internal aspects. Of course, every philosopher inevitably brings theoretical commitments to bear when writing about moral psychology, but non-Kantian readers should be forewarned that — despite the fact that Thomason says that she does “not assume any particular moral theory” — her ethical conclusions about shaming and stigmatizing are likely to be plausible only to those who are already snugly tied into a web of “Kantian commitments” (p. 9). "Plato and Nietzsche contra Phaedo-Platonism" would be an appropriate subtitle for this chapter, in which I develop a reading of Plato's Phaedo as a work of philosophical art, and Plato as a philosopher-artist (in a Nietzschean mode). The chapter includes an argument that, contrary to the standard reading, the Phaedo does not teach the doctrine of escape from the cycle of rebirth (pp. 151-160). As significant as this conclusion is in and for itself, it implies as well that Nietzsche cannot (...) appeal to this doctrine to condemn Socrates' attitude to life--though he does have other similar grounds on which to condemn him. My reading implies also that since in the Phaedo Plato subverts Socrates' style of philosophy, so objectionable to Nietzsche, we should take Plato as Nietzsche's ally in the struggle against Socrates rather than his enemy. There are productive material connections beyond mere internal or external relations. The concept of connection enables a creative reinterpretation of certain historical questions and, accordingly, the essay stresses the importance of the concepts of connection, nexus, and fusion in many philosophies, from Aristotle to Deleuze.

This chapter aims to expand the body of empirical literature considered relevant to virtue theory beyond the burned-over districts that are the situationist challenges to virtue ethics and epistemology. We thus raise a rather simple-sounding question: why doesn’t virtue epistemology have an account of intelligence? In the first section, we sketch the history and present state of the person-situation debate to argue for the importance of an interactionist framework in bringing psychological research in general, and intelligence research in particular, to (...) bear on questions of virtue. In Section 2, we discuss the history and present state of intelligence research to argue for its relevance to virtue epistemology. In Section 3, we argue that intelligence sits uneasily in both responsibilist and reliabilist virtue frameworks, which suggests that a new approach to virtue epistemology is needed. Reasoning is the iterative, path-dependent process of asking questions and answering them. Moral reasoning is a species of such reasoning, so it is a matter of asking and answering moral questions, which requires both creativity and curiosity. As such, interventions and practices that help people ask more and better moral questions promise to improve moral reasoning.

Several decades ago, Wheeler and Misner presented a model of electric charge based on the topological trapping of electric field lines in wormholes. In this paper, which does not argue for or against the "charge without charge" concept, I describe some generalizations of this model which might serve as topological analogs of color charges and electroweak charges.

In many countries throughout the world, regulators are struggling to determine whether and how to introduce competition into regulated industries. This essay exam- ines the complexities involved in the liberalization process. While stressing the impor- tance of case-specific analyses, this essay distinguishes liberalization policies that generally are procompetitive from corresponding anticompetitive liberalization policies.

As nanotechnology emerges as an important public policy issue, the FDA's relationship with society is about to be tested. Most would agree that fostering public input will be critical to developing effective public policy for nanotechnology. Yet, it will not be easy. Low public confidence in the FDA, the general lack of knowledge about nanotechnology among ordinary Americans, and the way in which the “average” citizen obtains and evaluates knowledge about a public policy issue all pose serious challenges to any (...) public outreach by the FDA. It will be necessary for the FDA to be attentive to not only its own public messages, but also to who is listening and how those messages are being perceived. (shrink)

He asserts that fetuses lack the defining characteristics of personhood, and thus are ineligible for what he terms “intrinsic” rights under his, and presumably any other, plausible libertarian theory. My counterargument is threefold: Narveson’s contractarianism can be interpreted in a way that is consistent with the pro-life perspective; because his theory permits no principled distinction (...) between the moral status of third trimester fetuses and newborns, the contrary reading of his social contract produces a result that is implausible and even repellent; and even if his version of contractarianism does imply a unique, aggressively pro-choice stance on abortion, there are competing libertarian theories that are receptive to pro-life views. Economic analysis presents climate change as a collective action problem, a market failure, or a problem about the allocation or distribution of property rights. Mark Sagoff argues that it is none of these. Economic theory cannot provide a useful way—either a model, method, or metaphor—to think about climate change. The reasons to reduce greenhouse gases are not economic, but ethical.
