This article relates two forms of political and cultural marginality and emancipation to a third one, which, in traditional patriarchal cultures, is the embodiment of marginality par excellence: that of the female self. It explores their similar positioning in the spatial and temporal economy of power relations in a detailed analysis of Irina Grigorescu Pana's novel Melbourne Sundays, a fictionallyrical account of the Romanian author's 11-year exile in Australia, read as a narrative counterpart of her critical approach to exile in (...) The Tomis Complex: Exile and Eros in Australian Literature. These two works describe an experience happening at the intersection between the author's national background – that of Romania – and the postcolonial one of her country of adoption – Australia – as they become relevant from her personal and professional experience as a woman writer. Exile is thus reflected in language, being spatially constructed by means of metaphors such as book, theatre, carnival, garden, which are also relevant for the process of identity formation. The argument mainly relies on Kristeva's theories, an approach motivated by Pana's own choice of the Kristevan discourse of love/hate in relation to the theme of exile in her fictional and critical works, since, as she remarks, exiles and lovers share a marginal, though at the same time essential, position in postcolonial cultures. Background Only a few studies have been conducted to assess physicians’ knowledge of legal standards. Nevertheless, prior research has demonstrated a dearth of medical law knowledge. Our study explored physicians’ awareness of legal provisions concerning informed consent and confidentiality, which are essential components of the physician-patient relationship of trust. -/- Methods A cross-sectional study assessed attending physicians’ legal knowledge of informed consent and confidentiality regulations. The study was conducted in nine hospitals in Dolj County, Romania. Physicians were given a questionnaire (...) with ten scenarios and instructed to select the response that best reflected their practice. We assessed the responses of physicians who claimed their practice to be entirely legal. Their legal knowledge was evaluated by comparing their answers to applicable laws. We also calculated a score for the physicians who admitted to committing a legal breach. -/- Results Of the 305 respondents, 275 declared they never committed any law violation. However, their median correct answer score was 5.35 ± 1.66 out of 10. The specialty was the strongest predictor of legal knowledge, with emergency physicians rating the lowest and non-surgical physicians scoring the highest. Physicians who worked in both private and public sectors were better knowledgeable about legal issues than those who worked exclusively in the public sector. Results indicate that physicians are aware of the patient’s right to informed consent but lack comprehensive understanding. While most physicians correctly answered simple questions, only a tiny minority identified the correct solution when confronted with ethical dilemmas. The physicians who acknowledged breaching the law, on the other hand, had a slightly higher knowledge score at 5.45 ± 2.18. -/- Conclusion Legal compliance remains relatively low due to insufficient legal awareness. Physicians display limited awareness of legal requirements governing patient autonomy, confidentiality, and access to health data. Law should be taught in all medical schools, including undergraduate programs, to increase physicians’ legal knowledge and compliance. (shrink)

The main aim of this study was to examine whether the economic status determined pro-ecological attitudes and behaviour. The survey involved 207 adults with different economic status. Both economic status in childhood and the present were taken into consideration. Analysis of the results indicated that people raised in families with low and medium material status have not only more eco-friendly attitudes but also have a greater tendency towards various ‘green’ behaviours. The differences among people with different current material status concerning (...) their eco-friendly attitudes and behaviours are not so obvious. The most wealthy seem to have a less pro-ecological attitude, but on the other hand they are ready to put more money towards ecologically-friendly household expenses. (shrink)

BackgroundAlthough the Covid-19 epidemic challenged existing medical care norms and practices, it was no excuse for unlawful conduct. On the contrary, legal compliance proved essential in fighting the pandemic. Within the European legal framework for the pandemic, patients were still entitled to be treated equally, by a specialized physician, with the possibility of seeking a second medical opinion, in a confidential setting, following prior and informed consent. This study examines physicians’ practices regarding patients’ rights during the Covid-19 pandemic and the (...) effects of age, experience, and specialty on physicians’ behavior and preferences. Additionally, it explores the nexus of malpractice complaints, malpractice fear, and legal compliance.MethodsA cross-sectional study was conducted on a convenience sample of attending physicians and general practitioners to assess compliance with patients’ rights regulations. Respondents were physicians practicing in private and public settings in Southwestern Romania from July 2021 to May 2022.Results396 attending physicians and 109 general practitioners participated in the research. Attending physicians acknowledged patients’ rights in 55.7% of statements, while general practitioners showed a slightly higher level of compliance at 59.9%. Emergency and Anesthesia and Intensive Care physicians showed the lowest compliance. There were no significant behavioral differences based on physicians’ age, years in practice, work sector, or location. However, when faced with the question of prioritizing treatment for patients with similar medical conditions, 46.2% of attending physicians reported favoring the younger patients. This preference was common among physicians under 39. Additionally, over half of the attending physicians reported working outside their area of expertise due to staff shortages. Malpractice fear was high among physicians, although unrelated to patients’ claims, legal compliance, or working outside the scope of practice. It resulted in pressure and behavioral changes.ConclusionAdherence to patients’ rights was low during the Covid-19 pandemic. Physicians could benefit from educational and administrative support to ensure better legal compliance. Further research is needed to determine if this behavior persists beyond the pandemic context. In the Groundwork and all three Critiques, Kant expresses the hope of eventually unifying theoretical and practical reason in one system, with a principle common to both. But he never clarifies what this principle is, leaving scholars to advance different possibilities. I advance a new response to this problem: I claim that Kant begins to refer to what he calls the ‘autonomy of ideas of reason’ in his final decade, enabling a new approach to finally bridging the theoretical and the (...) practical. This concept of autonomy, however, is no longer equivalent to the moral autonomy attributed to the self-legislating will, nor does it refer to the spontaneity of theoretical reason. Instead, it corresponds to the autonomy ascribed to reflective judgment in representing both theoretical and practical ideas of reason. Thus, this conception furnishes a principle, the principle of purposiveness, which I propose as the unifying principle Kant had been seeking. (shrink)

En este libro, la autora desarrolla su concepción del juicio reflexionante inspirada en Emmanuel Kant y en Hannah Arendt para concentrarse en cómo cierto tipo de narraciones modelan nuestras nociones de lo que consideramos moral. Lara nos ofrece distintas concepciones sobre el mal en su formulación histórica mediante los ejemplos de las tragedias griegas, las diferentes concepciones sobre el mal en la obra de Shakespeare, el uso literario de la metáfora en la obra de Joseph Conrad y en narraciones fílmicas (...) que describen la crueldad humana. Lara sugiere que el aprendizaje moral es un proceso en el que intervienen las instituciones sociales, la voluntad de los individuos y de las sociedades para comprometerse a un debate abierto y con ello modelar los juicios colectivos sobre el pasado. Lara enfatiza que el juicio reflexionante se da entre un evento, una narración de dicho evento y la recepción pública de dicha narrativa. En este libro se aportan importantes métodos para la comprensión del fenómeno moral del mal, porque introducen nuevas verdades desvelatorias acerca de eventos particulares que no pueden ser simplemente captados por medio de categorías conceptuales. Lara utiliza como fuentes a Jürgen Habermas, Walter Benjamin, Primo Levi, Giorgio Agamben y Ariel Dorfman para probar la conclusión de este tipo de narraciones: la acción (de crueldad) ata de manera definitiva al perpetrador con su víctima. Suppose I say, ‘That is my dog’ and manage to refer to my dog, Fido. According to intentionalism, my intention to refer to Fido is part of the explanation of the way that the demonstrative gets Fido as its referent. A natural corollary is that the speaker is, to some extent, in control of this semantic fact. In this paper, we argue that intentionalism must give up the claim that the speaker is always in control, and thus, that intentions are (...) always the mental states that do the semantic work: we provide new examples where reference is successful but the speaker either lacks the intention to refer, or does not know how to refer; in all of these cases, the speaker is not in control of reference. We argue that these cases provide better objections against classical intentionalism than the ones offered by conventionalists (for example, Stojnić et al. 2013; Stojnić 2021) and also that our discussion has as notable consequence that referring is not an essentially intentional action. Finally, we put forward our own view, which gives up claims of control but retains from intentionalism the importance of the speaker’s mental states. (shrink)

Vor diesem Hintergrund wird dann die kritische Auslegung und Ausarbeitung dieses Begriffes im philosophisch-politischen Denken Axel Honneths dargelegt.

Observations on Two Mural Paintings from Early Medieval Rome. Fresco of St Agatha and an Unknown Painting with a Bust of the Saint Little is known about the two fragments of early medieval Roman paintings with female saints considered here. One was first exhibited in 2016; the other remained totally obscure until it came onto the antiquarian art market 2019. The goal of this study is to provide context for these two pieces by attempting to reconstruct their original art historical (...) environment. The study also aims, through archival and documentary research, to offer plausible dates by means of stylistic comparisons (e.g., frescoes in Santa Maria Antiqua, in the Catacombs of Generosa, in the narthex of Santa Sabina etc.) and to explore the fragments’ possible original provenance. For the painting with the bust of St Agatha, the study proposes a date around the late seventh-early eighth centuries; for the other, the first half of the eighth century. Our attempt is not to provide a consistent analysis and interpretation of Thrasymachus’ account of justice, but to present his rhetorical skills. In particular, the aim of this paper is to provide an account of behavior as an essential parameter in his teaching of rhetoric. Plato’s choice of Thrasymachus in order to confront Socrates is not a random one. He chooses a renowned Sophist in the (...) art of rhetoric, who places great emphasis on the release of emotions in rhetorical speech. Cosa sarebbe un’umanità in cui la forza brutale prendesse il posto della forza morale?” Sono trascorsi pochi mesi dallo scoppio del primo conflitto mondiale, quando Henri Bergson pone questi drammatici interrogativi. Incaricato dal governo francese, nel 1917 e nel 1918, di due missioni (...) diplomatiche presso la presidenza degli Stati Uniti, svolgerà questo compito anche attraverso la parola, scritta e orale, da alcuni giudicata semplice propaganda patriottica, di scarso interesse filosofico. Invece, in questo volume i suoi testi del periodo bellico, confrontati con alcune lettere degli anni 1914- 1936, sono esaminati come una tappa fondamentale di un itinerario speculativo che dai temi metafisici lo condurrà a quelli più squisitamente morali. Aver sperimentato la fatale alleanza tra il progresso tecnico e la forza brutale, indurrà infatti Bergson a porre in termini nuovi l’interrogativo sulla guerra e sulla storia stessa, considerando la costruzione della pace inseparabile da un profondo rinnovamento morale e da personalità esemplari capaci di attivare le necessarie risorse spirituali. La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Es crucial que la regulación sea integral y adaptable para garantizar un sistema jurídico justo y equitativo en la era digital. (shrink)

Se examina el "trauma" que, según la autora, se manifiesta como "rayones", lo que hace difícil traducirlo o interpretarlo, porque solo se percibe a través de la escucha. Se estudia lo que M. Heidegger exploró como "ser-ahí" y "ser-en-el-mundo", esto es, el estar lanzados al mundo en un de terminado contexto donde construimos nuestra subjetividad y aprendemos a (...) vivir, para entenderlo mediante estas experiencias femeninas singulares. ABSTRACT The text explores the experience lived during the period known as The Violence in Colombia by women now over 80. It examines the "trauma" that, according to the author, manifests itself in the form of "scratches", thus making it difficult to translate and interpret given that it is only perceptible through listening. The article discusses M. Heidegger's notions of Dasein and being-in-the-world, that is, our thrownness into the world in a specific context in which we construct our subjectivity and learn how to live, in order to understand them through these singular feminine experiences. Leibniz's repeated interventions in the Trinitarian polemics widespread throughout Europe in the seventeenth and eighteenth centuries cannot merely be read as scholastic exercises or concessions to the conventions of his time. On the contrary, they involved reflection on issues fundamental to Leibniz's philosophical doctrines: issues such as the relationship between faith and reason, the limitations of the human intellect and the various grades of human knowledge, and the significance of the ' analogia Trinitatis' reconsidered in light of the concept of (...) harmony. This paper concentrates on the writings of the young Leibniz before his visit to Paris and aims to examine the role played by contemporary discussions concerning the Trinity and the Incarnation in the formation of Leibniz's thought. This original and compelling book argues that previous studies of John Stuart Mill's work have neglected his egalitarianism and thus seriously misunderstood his views. Morales demonstrates that Mill was fundamentally concerned with how the exercise of unjust or arbitrary power by some individuals over others sabotages the possibility of human well-being and social improvement. Mill therefore believed that 'perfect equality'--more than liberty--was the foundation of democracy and that democracy was a moral ideal for the organization of human life in all (...) of its dimensions. This study explores the intra-organizational antecedents of sustainable governance by examining the impact of female presence at the corporate apex. Drawing upon the upper echelon theory, we investigate whether women in top positions influence sustainable governance practices. Our research focuses on a sample of companies operating within two distinct market economies: liberal market economies (LMEs) and coordinated market economies (CMEs). The United States, represented by the S&P100, and the United Kingdom, represented by the FTSE100, serve as examples of LMEs. Conversely, (...) Germany (DAX30), France (CAC40), Spain (IBEX35), and Switzerland (SMI) are illustrative of CMEs. Analyzing archival data spanning from 2010 to 2019, we confirm that the presence of a critical mass of women on the board of directors significantly increases the likelihood of establishing a sustainability committee within organizations. This relationship holds true across both LMEs and CMEs, highlighting the universal importance of gender diversity in driving sustainable governance initiatives. Interestingly, we observe that the impact of women with structural power on sustainability committee formation is specific to LMEs, suggesting the context-dependent nature of female leadership in sustainable governance.
