Clinical ethics committees, with their typical threefold function of education, policy formation, and consultation, are present in nearly all U.S. hospitals today, and they are increasingly common in other healthcare settings such as long-term care and even home care. Ethics committees are at least as prevalent in Canadian hospitals as they are in U.S. hospitals, and their presence is growing in Europe, much of Asia, and Central and South America. Although ethics committees serve a variety of needs, their ultimate goal (...) ought to be to promote ethical practices or, in other words, to engender the integration of ethics into the life of the medical center. Of the three primary functions of ethics committees, ethics consultation has historically been the most controversial and problematic, and consult services in many healthcare institutions have struggled to thrive. Kuhn called "hackwork" because it is carried out within a framework it never calls into question, there is — in that same sense — no such thing as "normal art" (Princeton: Princeton University Press, 1982). The twenty years since thepublication of Sparshott's book have done nothing but underscore this point. No theme in the arts has been more prominent than the challenging of existing frameworks. Equally, no project in the philosophy of art has proven more important than the remapping and expanding of prior conceptual boundaries. In both the arts and the philosophy of art, the new norm is the foreswearing of the normal. And just as contemporary art challenges the concept we have of art itself, contemporary aesthetics challenges the traditional notion we have of aesthetics. Of late, this challenge has been vigorous, persistent, heated. Yet, although it has produced some affronts to establishedsensibilities, it has not led to the wholesale undoing of prior advances in aesthetic theory, as many had feared.It is this development, rather than any particular movement or advance within the field, that stands out as the distinguishing characteristic of aesthetics today. Similar assaults on basic assumptions, disciplinary borders, and theoretical frameworks have raged in neighboring academic domains where they have inspired debilitating internecine conflict and conceptual disarray. Postmodernist attacks on the very possibility of theoretical coherence have been the most notorious, but far from the exclusive, examples of effects of this sort. Similar skeptical developments have proven corrosive in disciplines from anthropology to theology. Yet the field of aesthetics has generally welcomed framework challenge. It has not been driven by it into warring camps, and has taken this challenge as a positive contribution to the field's strength and importance.Three excellent recent works illustrate different ways in which the a-normality of contemporary aesthetics is being played out, and demonstrate [End Page 105] why it is both constructive and worthwhile. Cynthia Freeland's But Is It Art? is presented as an introduction to art theory, but it is really a provocative analysis of ways in which the visual arts have blown out their parameters and the demands this development places on intelligent response. Noël Carroll's Beyond Aesthetics takes as its theme the idea that, to make proper sense of the present world of aesthetic phenomena, we must "reach beyond aesthetic theories of art and their various prohibitions." And Marcia Eaton's Merit, Aesthetic and Ethical argues that the truly important issues we encounter in making sense of aesthetic experience require an integration of normative considerations formerly thought of as discretely ethical or aesthetic. Each of these works looks at the ways art and aesthetics have forced us to think differently about both of them, due to the way each has recently evolved. Yet none of them takes the radical view that all of what happened before is rendered insignificant by the revolutionary novelty of current work. Instead, these works are syncretic in just the way that contemporary philosophy of art is syncretic; they show how apparent discontinuities can be squared with the general thrust of the best historical work.The picture that emerges from these (as well as many other recent works) is this: Aesthetics today is a discipline pleased both to rethink its own basic concepts and to examine its connections to a variety of regions of concern not traditionally regarded as its province. This has been the central tenet of the Lincoln Center Institute and its sister institutes around the world. They concentrate on specific works because it allows participants to focus their minds, emotions, and energies on one set of (...) images and experiences. Excited by such an approach, many teachers return year after year, eager to tackle a new and varied repertory.But they cannot repeat the summer institute forever. They may need to take other workshops to satisfy professional (re)certification requirements. The school district may no longer reimburse them for the cost of the workshop. Their team may develop other interests. Often they find that the school has displaced the arts with other priorities, particularly in the light of so-called proficiency exams mandated by state boards of education.Whatever the reason, if teachers want to continue to do something meaningful in the arts, they may well have to become their own summer institute, lesson planner, and teaching artist rolled into one. The question then becomes, "How well did you learn the lessons of the institute?" The first lesson requirement is, "Do you know how to choose an appropriate work of art around which to develop aesthetic experiences and reflection for your students?" Behind that question, however, lies another: "What is your definition of art?" This is no idle philosophical exercise because one's answer underlies everything else done in the classroom in the name of aesthetic education. [End Page 62]Several years ago, Marcia Mulder Eaton of the University of Minnesota developed an exercise that enables teachers to examine their definitions of art in a practical way. She asked teachers to complete the following sentence: "Something is a work of art if and only if _________." She then showed them several objects, with the request that they write on a piece of paper if each object was a work of art, according to the definitions that they had written down.When I ran the exercise at a summer teachers institute in Pittsburgh, I displayed in order (1) a small flag; (2) an original painting; (3) a cheap cup from Wal-Mart; (4) a piece of fruit; (5) some driftwood; (6) and a basin wrench.1 Teachers voted on each piece as it was shown. Once the voting was completed, I asked them how they voted and how they justified their vote in the light of their definitions. When I have run this exercise elsewhere, the definitions and resultant criteria have broken down into four groups: (1) it was created, therefore, it is art; (2) an expert, such as an art museum or a critic, may have decreed it to be art; (3) "it touched me in some way and I cannot describe that feeling other than to call it art"; and (4) "I'm no connoisseur but I know what I like." There are strengths and weaknesses in each position:1. Anything that humans make is art because it is an artifact. Weakness: The definition is too general2. We should respect the opinions of experts. After all, they studied the matter much longer and more deeply than we have. They know what they are talking about. Weakness: What if I think they are off base? What if there is something in the work that appeals to me?3. "It somehow has touched me and I want to cherish it." "There is something in there that causes me to respond. It, therefore, has some kind of power." Weakness: This position does not lend itself very well to public discussion, unless you have something you can point to or explain in a way that gets through to others.4. On standard readings of Grice, Gricean communication requires (a) possession of a concept of belief, (b) the ability to make complex inferences about others’ goal-directed behaviour, and (c) the ability to entertain fourth order meta-representations. To the extent that these abilities are pre-requisites of Gricean communication they are inconsistent with the view that Gricean communication could play a role in their development. In this paper, I argue that a class of ‘minimally Gricean acts’ satisfy the intentional structure described by Grice, (...) but require none of abilities (a)-(c). As a result, Gricean communicative abilities may indeed contribute to the development of (a)-(c) – in particular, by enabling language development. This conclusion has important implications for our theorising about cognitive development. (shrink)

This paper explores Albert Bandura's concept of moral disengagement in the context of organizational corruption. First, the construct of moral disengagement is defined and elaborated. Moral disengagement is then hypothesized to play a role in the initiation of corruption by both easing and expediting individual unethical decision-making that advances organizational interests. It is hypothesized to be a factor in the facilitation of organizational corruption through dampening individuals’ awareness of the ethical content of the decisions they make. Finally, it is hypothesized (...) to contribute to the perpetuation of corruption in organizations, because if individuals who have a greater propensity to morally disengage are more likely to make decisions that advance organizational interests regardless of the ethicality of those decisions, they may also be rewarded for those decisions in terms of organizational advancement. Together these studies form an argument that moral disengagement plays an important role in processes of organizational corruption. (shrink)

It is sometimes claimed that Gricean communication is necessarily a form of cooperative or ‘joint’ action. A consequence of this Cooperative Communication View is that Gricean communication could not itself contribute to an explanation of the possibility of joint action. I argue that even though Gricean communication is often a form of joint action, it is not necessarily so—since it does not always require intentional action on the part of a hearer. Rejecting the Cooperative Communication View has attractive consequences for (...) our theorising about human cognitive development, since it opens up the possibility of appealing to communicative interaction to explain the emergence of joint action in phylogeny. I present an annotated development of the basic ideas of the Geneva School approach to the foundations of physics and the structures which emerge as mathematical representations of the physically dual notions of state and property.

This paper examines the relationship between justice and colonialism. It defines colonialism; examines the kind of injustice that colonialism involved; and the possibility of corrective justice.

This thesis focuses on expressively rich languages that can formalise talk about probability. These languages have sentences that say something about probabilities of probabilities, but also sentences that say something about the probability of themselves. For example: (π): “The probability of the sentence labelled π is not greater than 1/2.” Such sentences lead to philosophical and technical challenges; but can be useful. For example they bear a close connection to situations where ones confidence in something can affect whether it is (...) the case or not. The motivating interpretation of probability as an agent's degrees of belief will be focused on throughout the thesis. -/- This thesis aims to answer two questions relevant to such frameworks, which correspond to the two parts of the thesis: “How can one develop a formal semantics for this framework?” and “What rational constraints are there on an agent once such expressive frameworks are considered?”. The author begins with an outline of Bernard William's moral philosophy, within which he locates William's notorious doctrine that reflection can destroy ethical knowledge. He then gives a partial defence of this doctrine, exploiting an analogy between ethical judgements and tensed judgements. The basic idea is that what the passage of time does for the latter, reflection can do for the former: namely, prevent the re-adoption of an abandoned point of view (an ethical point of view in the one case, (...) a temporal point of view in the other). In the final section the author says a little about how reflection might do this. According to proponents of the causal exclusion problem, there cannot be a sufficient physical cause and a distinct mental cause of the same piece of behaviour. Increasingly, the causal exclusion problem is circumvented via this compatibilist reasoning: a sufficient physical cause of the behavioural effect necessitates the mental cause of the behavioural effect, so the effect has a sufficient physical cause and a mental cause as well. The communicative interactions of very young children almost always involve language, gesture and directed gaze. In this study, ninety-six children were asked to determine the location of a hidden toy by understanding a communicative act that contained none of these familiar means. A light-and-sound mechanism placed behind the hiding place and illuminated by a centrally placed switch was used to indicate the location of the toy. After a communicative training session, an experimenter pressed the switch either deliberately or accidentally, and (...) with or without ostension. In no condition did she orient towards the hiding place. When the switch was pressed intentionally, children used the light-and-sound cue to find the toy – and tended to do so even in the absence of ostensive eye contact. When the experimenter pressed the switch accidentally, children searched randomly – demonstrating that they were tracking her communicative intent, and not merely choosing on the basis of salience. The absence of an effect of ostension contradicts research that ostension helps children to interpret the communicative intentions underlying unfamiliar signs. We explain this by concluding that while it may play a role in establishing a communicative interaction, it is not necessary for sustaining one; and that even with a highly novel communicative act – involving none of the means of communication on which children typically rely – three-year-olds can comprehend the communicative intentions behind an intentionally produced act. This paper develops a set of 16 criteria, divided into four groupings, for responsible business practice (RBP) in Small and Medium-Sized Enterprises (SMEs) drawn from the existing SME/RBP literature. The current lack of a general set of criteria against which such activity can be judged is noted and this deficit is redressed. In order to make an initial assessment in support of the criteria so derived, an exploratory feasibility study of RBP in U.K. Fair Trade organisations was conducted. The findings (...) from this study show that most but not all of the RBP criteria seem to be applicable to U.K. Fair Trade organisations but it is recommended that the complete set of criteria continues to be used in further research until such time as there is a general consensus as to which criteria are appropriate. Implications for RBP in small businesses in general, and for Fair Trade organisations in particular, are drawn out and suggestions for further research are identified. (shrink)

Jaegwon Kim once refrained from excluding distinct mental causes of effects that depend upon the sufficient physical cause of the effect. At that time, Kim also refrained from excluding distinct mental explanations of effects that depend upon complete physical explanations of the effect. More recently, he has excluded distinct mental causes of effects that depend upon the sufficient cause of the effect, since the physical cause is individually sufficient for the effect. But there has been, to this point, no parallel (...) shift in the explanatory realm, such that distinct mental explanations of effects that depend upon complete physical explanations of the effect are excluded since the physical explanation is objectively complete. In this paper I consider, defend, and apply this update to the principle of explanatory exclusion—an update, which, in the final analysis, demonstrates a significant advantage that non-reductive physicalism has over reductive physicalism. Associative duties—duties inherent to some of our relationships—are most commonly discussed in terms of intimate associations such as of families, friends, or lovers. In this essay I ask whether impersonal associations such as state or nation can also give rise to genuinely associative duties, i.e., duties of patriotism or nationalism. I distinguish between the two in terms of their objects: the object of patriotism is an institutionalized political community, whereas the object of nationalism is a group of people who share (...) a common identity, often grounded in a belief in shared history, and an aspiration for collective self-government together. I explore three arguments for the thesis that a special concern for one’s polity and fellow-citizens, or one’s nation and co-nationals, is an associative duty: from reciprocity, from collective self-determination, and from the well-being of compatriots or co-nationals. I argue that the relationship among compatriots is a more plausible contender for generating associative duties than the relationship among co-nationals, although even in this case there are questions whether these are genuinely associative duties, or simply special duties. Although the relationship among co-nationals is a less plausible contender for associative duties, the well-being argument does apply to the relationship among both co-nationals and compatriots. I also suggest that there is a certain privileging of the status quo in the way that associative duties arguments work, because they tend to operate from existing relations and associations. Many countries project that they will have difficulty to meet their demand for primary care based on an inadequate supply of primary care doctors. There are many reasons for this, and they tend to vary by country. The policy options available to these countries are to increase the number of local primary care doctors, recruit doctors from other countries, ration primary care, shift more primary care to specialists, or authorize other disciplines to provide primary care. This article examines lessons learned (...) in the United States over the past 50 years and proposes that expanding the use of nurse practitioners is the best solution when measured by feasibility, costs, ethics, and scope of the care delivered. Using nurse practitioners trained in country meets the World Health Organization global code of practice regarding the international recruitment of health personnel. (shrink)

This paper examines methodological issues associated with the theory of planned behaviour and explains that an alternative account of data used to support this theory can be provided by positioning theory. A case is presented that shows tests of the theory of planned behaviour fail to eliminate the possibility of alternative explanations for co-variation in its data. An agency or person-centered alternative shows how a causal interpretation can be reinterpreted as evidence of the actions of a person. Unlike the conceptualisation (...) of the individual as behaving in keeping with postulated underlying cognitive laws or rules we assume that the person has, through socialisation, acquired the skills necessary to initiate and manage their own actions. Unlike the interest in TPB data as a causal explanation of action we draw attention to the interpretation of patterns in these data as an aggregate of each person using a common mode of explanation to justify and explain their intentions. Kant, in his third Critique, confronts the issue of how rule-governed objective judgement is possible. He argues that it requires a particular kind of aesthetic response to one's experience. I dub this response 'the Feeling of Unity', and I raise the question whether it is a type of inexpressible knowledge. Using David Bell's account of these matters as a touchstone, I argue that it is.

This article is the product of a critical engagement that I have orchestrated between Husserl’s phenomenology and Stoic epistemology. I argue that the Stoic theory of knowledge, which is based upon the idea that the individual human being is a logos spermatikos, or “rational seed” of God, precludes any authentic doctrine of freedom, insofar as it enslaves the individual to a constant reference back toward God, as the source of “fundanlent” of all knowledge. However, the similarities between the Stoic theory (...) and the phenomenology of Husserl call us toward a deeper reading, and an asking of the important question: what constitutes freedom? This question can only be answered by thinking beyond both Stoic epistemological schemas and Husserlian intentionality, toward a doctrine of freedom that is best described as demiurgic.Cet article est le produit d’une enterprise critique organisée autour de la phénoménologie husserlienne et de I’épistémologie stoïcienne. Viola Cordova was the first Native American woman to receive a PhD in philosophy. Even as she became an expert on canonical works of traditional Western philosophy, she devoted herself to defining a Native American philosophy. Although she passed away before she could complete her life’s work, some of her colleagues have organized her pioneering contributions into this provocative book. In three parts, Cordova sets out a complete Native American philosophy. First she explains her own understanding of the nature of (...) reality itself—the origins of the world, the relation of matter and spirit, the nature of time, and the roles of culture and language in understanding all of these. She then turns to our role as residents of the Earth, arguing that we become human as we deepen our relation to our people and to our places, and as we understand the responsibilities that grow from those relationships. In the final section, she calls for a new reverence in a world where there is no distinction between the sacred and the mundane. Cordova clearly contrasts Native American beliefs with the traditions of the Enlightenment and Christianized Europeans. By doing so, she leads her readers into a deeper understanding of both traditions and encourages us to question any view that claims a singular truth. From these essays—which are lucid, insightful, frequently funny, and occasionally angry—we receive a powerful new vision of how we can live with respect, reciprocity, and joy. (shrink)
