If you were Monica Lewinski's mother, how would you describe Linda Tripp? Remember that Linda Tripp is the woman who tapped her own phone conversations with Monica and then used them to incriminate President Clinton. Marcia Lewis, Monica's actual mother, chose the following expression: "She is like a meddlesome witch, a praying mantis." This expression conveys a multiple analogy, a comparison in which several sources are likened to a target. In this case, the first source tells us that (...) class='Hi'>Marcia thinks of Linda as a disagreeable woman who entices youngsters into her confidence in order to ensnare them for her own purposes, much like the witch who trapped Hansel and Gretel. The second source tells us that Marcia thinks of Linda as a creature that ambushes others out of an inhuman lust for prey. ;This example shows the usefulness of multiple analogies in satisfying certain cognitive goals, such as constructing an adequate explanation of Linda Tripp and her behavior. Multiple analogies have also proven to be very useful in satisfying other kinds of cognitive goals, such as those of philosophers and scientists. However, no cognitive model of multiple analogies has yet been proposed or explored. This dissertation presents an exploration of multiple analogies as found in the literature of evolutionary biology, archaeology, and philosophy with the aim of proposing a cognitive model of this interesting mode of reasoning. This model is based upon the Multiconstraint theory of analogies, which is extended for the purpose, and also contrasted with previous theories of analogy. (shrink)

Gideon Rosen (2014) has drawn our attention to cases of duress of a particularly interesting sort: the person's ‘mind is not flooded with pain or fear’, she knows exactly what she is doing, and she makes a clear-headed choice to act in, as Rosen says, ‘awful ways’. The explanation of why we excuse such actions cannot be that the action was not voluntary. In addition, although some duress cases could also be viewed as necessity cases and thus as justified, Rosen (...) wisely sets aside that complicating factor by zeroing in on those cases where the action clearly is not justified. So why do we excuse in these cases, where the action is not justified and the agent acted voluntarily?Rosen thinks the key lies in the ‘ill will’ condition, ‘the idea that an act is blameworthy only if it manifests insufficient concern or regard for those affected’. He says this is relatively uncontroversial; much of my paper is taken up with calling the ‘ill will’ condition into question. I also take issue with Rosen on just how justifications and excuses differ. I argue in favour of understanding justifications (in a context where we are asking how justifications and excuses differ) as not requiring truth, but only reasonable belief. (shrink)

Adolf Meyer-Abich spent his career as one of the most vigorous and varied advocates in the biological sciences. Primarily a philosophical proponent of holistic thought in biology, he also sought through collaboration with empirically oriented colleagues in biology, medicine, and even physics to develop arguments against mechanistic and reductionistic positions in the life sciences, and to integrate them into a newly disciplinary theoretical biology. He participated in major publishing efforts including the founding of Acta Biotheoretica. He also sought international contacts (...) and worked for long stretches in Chile, the Dominican Republic, El Salvador, and the United States. His career straddled the Nazi period, which led him into a complex dance of support for and resistance to the regime. Despite the relative failure of his conceptual innovations to catch on, his ideas and writings sit squarely within the trajectory of thought and argument that has led to today’s reinvigoration of thought about conceptual integration in evolutionary developmental biology. It is widely agreed that the top three Model Penal Code culpability levels suffice for criminal liability, but the fourth is controversial. And it isn’t just the particular MPC wording; that negligence should be on the list at all is controversial. My question is: What makes negligence so different? What is it about negligence that gives rise to the view that it should not suffice for criminal liability? In addressing it, I draw attention to how we conduct the debate, and (...) how our framing of the issues is shaping it. My hope is to prompt thought and discussion on just what we want the element of mens rea to provide, and to draw attention to background assumptions that shape our views of what it should take for negligence to count as a species of mens rea. What is the relation between shame and shamelessness? It may seem obvious: shamelessness is simply the absence of shame. But on reflection, it becomes clear that the story is considerably more complicated. Michelle Mason's intriguing "On Shamelessness" prompts such reflection. Mason argues that we should be mindful of the "moral importance of shame" and "unapologetic in its defense", and she does so via an examination of shamelessness and an argument to the effect that shamelessness is a moral fault. The tacit (...) assumption is that insofar as shamelessness is a moral fault, the value of shame is vindicated. I challenge that assumption. (shrink)

Carrie Chapman Catt's engagement of race remains controversial. This article argues that there are two elements to Catt's career-long use of evolutionary arguments to map questions of sex and race. For Catt, evolutionary change instantiated (macroevolutionary) progress, but this progress depended on sex and race as linked categories of (microevolutionary) differentiation. In her arguments, the sexes always participate together in the same trajectory of evolutionary progress. Race, however, is a contingent category: different races can, but also may not, participate together (...) in the progress narrative. Anniversaries and funding crises prompt periodic calls to reevaluate the mission and public perceptions of the U.S. Land-Grant University system. One such call was issued by the Kellogg Commission on the Future of State Colleges and Land Grant Universities in their 1999 report, “Returning to Our Roots: the Engaged Institution.” Written by leaders of state universities and land-grant colleges, this report urges these institutions to engage more authentically and equitably in two-way relationships with their local constituents. Twenty years later, Land-Grant (...) Universities continue to struggle with building widespread public support for their missions and equitable involvement in research, teaching, and extension functions across diverse constituencies. While largely discounted by the Kellogg Commission, a fresh look at the role originally envisioned for the extension arm of the trifold land-grant mandate suggests that we may be conceiving of this system too narrowly. The establishment of statewide extension systems was once seen as a way to ensure that Land-Grant Universities would be accessible and responsive to all of a state’s residents. Extension systems continue to offer a front-door to a major public university in almost every county of the United States, but they tend to be viewed primarily as a way to translate science or distribute information from the university to the public. This discussion uses a historical and modern lens to reimagine the role that Extension could potentially play in catalyzing reciprocal, co-learning relationships between Land-Grant Universities and their diverse local constituencies. Justifications and excuses are defenses that exculpate. They are therefore much more like each other than like such defenses as diplomatic immunity, which does not exculpate. But they exculpate in different ways, and it has proven difficult to agree on just what that difference consists in. In this paper I take a step back from justification and excuse as concepts in criminal law, and look at the concepts as they arise in everyday life. To keep the task manageable, I focus (...) primarily on excuses and excusing activities, distinguishing them from justifications as well as from other close relatives, in particular, forgiving and pardoning. I draw upon J.L. Austin’s classic A Plea for Excuses, but expand on his account, suggesting that we offer excuses for reasons besides those he mentions. My hope is that my examination of excuses and excusing activities will help us rethink our views on just how justifications and excuses differ, views which often are worked out without much attention to how these concepts function in everyday life and to the connection between offers of excuses and justifications and the rules of civility. Neste artigo, analisamos algumas das peculiaridades da leitura que Agamben faz de Nietzsche, isto é, o uso que faz das ideias do pensador alemão para constituir a sua própria filosofia política. Assim, refletimos acerca do tensionamento e da polifonia entre a vontade de potência em sua configuração fisiopsicológica, e a grande política a partir da transvaloração dos valores. Indicamos essa tensão e polifonia tendo em vista o outro tipo de potência ao qual Agamben se inscreve, a aristotélica, para pensarmos sobre (...) as aberturas políticas que se descortinam a partir da crítica nietzschiana à política e à democracia liberal. Convém atentar ao argumento de Piazzesi de que a vontade de potência sintetiza os âmbitos mecanicista e valorativo que, em relação agonística, explicam a vontade de potência. O projeto Homo sacer começa e termina com uma crítica à biopolítica que Agamben compreende como sendo aquela nietzschiana. Esse é um tensionamento entre a concretização da transvaloração dos valores como possibilidade de superar o niilismo e criar o lastro para a grande política, pois insere no campo da fisiologia uma questão política, do paradigma da autonomia.Nietzsche e Agamben, com suas concepções divergentes de potência, apontam as possibilidades da política e os limites da democracia liberal. ExcerptQueer theory has a problem. This problem does not belong uniquely to queer theory, for it is common to and has consequences for all theory— social, psychological, literary, natural scientific, or otherwise—that seeks categories for the explanation of human phenomena. Queer theory, however, encounters and embodies this problem in uniquely significant ways. Queer theory seems, in fact, to have developed largely out of the friction generated by this problem in other earlier forms of theory—and may thus, ironically, contain the only (...) adequate answer to it.1 This problem is also hardly new, for it has exercised philosophers and critics from Kierkegaard to Feyerabend, from Kant to Žižek, from Schelling to de Man, Adorno, and Butler. This Part II of a two‐part article illustrates how research in evolutionary biology, anthropology, archeology, and psychology illuminates questions arising in philosophy—specifically questions about René Girard's theory of aggression. Part I looked at: (i) how old the systemic practice of severe aggression is; (ii) how much of it results from humanity's mimetic/social and competitive nature and how much from ecological, resource, and cultural conditions; and (iii) if ecological, resource, and cultural conditions are important, might we adapt this information toward greater (...) cooperativity today? Part II investigates Girard's theory of ritual sacrifice—especially human sacrifice—as a societal steam valve for the systemic aggression explored in Part I. Friends as well as foes of Kant have long been uneasy over his emphasis on duty, but lately the view that there is something morally repugnant about acting from duty seems to be gaining in popularity. More and more philosophers indicate their readiness to jettison duty and the moral 'ought' and to conceive of the perfectly moral person as someone who has all the right desires and acts accordingly without any notion that (s)he ought to act in this way. Elsewhere' (...) I have argued that such a picture of the perfectly moral person is flawed. In this paper I examine the claim that acting from duty is morally repugnant. There is some truth to this charge, but, I argue, the repugnance attaches not to acting from duty as such, but only to certain ways of acting from duty. In isolating the objectionable elements of acting from duty, I hope not only to vindicate the skeletal concept but also to offer illumination on the question of just how we should understand morally good conduct. The first situation that comes to mind on the subject of grieving on the job in healthcare happened about 37 years ago. I had a nice lady in ICU for several days in a row as a patient. She had (...) a bad myocardial infarction (MI) and was critical. We tried all the medications and pain meds, and nothing took her chest pain away. Meanwhile, her husband stayed with her all day, and all night. He doted after her 24/7. He slept in a chair and never went home for about three days, even though they lived just a few blocks from the hospital. I was amazed at what an awesome husband he was.Finally, after about three days, she fell asleep for more than 10 minutes. She had said her pain was gone. Her husband didn't want to leave her, but he asked me "if it would be okay" to go home and take a shower, eat a sandwich, and get the mail. He explained that he would be right back.I said, "Sure, now is a good time since her pain is gone and she's sleeping. You must take care of yourself too."The husband ran out in a hurry. About 10 minutes after he left, his wife suddenly had pain again and a run of ventricular tachycardia, (V-tach), which is a type of abnormal heart rhythm, or arrhythmia. Even though the V-tach stopped on its own, I called the husband and told him to come back because he wanted to be there if anything happened. A few minutes later, she had another run of V-tach, but this time, she coded and died. About two minutes after she died, the husband came running into the room—panicked and crying and talking to her dead body.He was saying, "I'm so sorry I left you! I shouldn't have left you!" I felt awful because I was the one who told him it was okay to go. Then I was crying with him and for the poor man.He then left for home, and their doctor (who was a well-known grouch-ass) appeared and saw that I was upset, and he asked me what my problem was. Why was I so sad about it? I thought, "Jerk, you are in the wrong career."Thinking about that doctor's reaction at the time, I wondered, "WTF is wrong with him!" I had known the doctor for several years because his mom was the head nurse of the surgical floor.
