The question of whether biologists should continue to use the Linnaean hierarchy has been a hotly debated issue. Invented before the introduction of evolutionary theory, Linnaeus's system of classifying organisms is based on outdated theoretical assumptions, and is thought to be unable to provide accurate biological classifications. Marc Ereshefsky argues that biologists should abandon the Linnaean system and adopt an alternative that is more in line with evolutionary theory. He traces the evolution of the Linnaean hierarchy from its introduction (...) to the present. He illustrates how the continued use of this system hampers our ability to classify the organic world, and then goes on to make specific recommendations for a post-Linnaean method of classification. Accessible to a wide range of readers by providing introductory chapters to the philosophy of classification and the taxonomy of biology, the book will interest both scholars and students of biology and the philosophy of science. RÉSUMÉ Le principal objectif de ce texte est d'apporter certaines clarifications par rapport à des problèmes et difficultés entourant l'usage actuel des notions de culture, d'appartenance et de dialogue. L'auteur montre que l'idée selon laquelle on pourrait être prisonnier de sa propre culture découle d'une transformation récente de la signification du concept de culture. Cette idée est critiquée comme étant un mythe, le mythe de la monade culturelle, reposant sur une mécompréhension des rapports entre culture, appartenance et dialogue. L'auteur s'efforce (...) de proposer une meilleure compréhension de ces trois concepts, de façon à éviter toute forme de relativisme radical. ABSTRACT The aim of this paper is to shed light on some difficulties and problems related to the current use of the concepts of culture, belonging and dialogue. The author shows that the idea that we could be prisoners of our own culture stems from a recent transformation of the meaning of the concept of culture. This idea is criticized as a myth, the myth of the cultural monad, based on a misunderstanding of the relationship among culture, belonging and dialogue. We are currently observing a shift in the relevance of ethical concerns regarding security screening systems. Due to technological progress, so my hypothesis goes, more direct consequences that such systems may have on the screening subjects' health and bodily privacy become increasingly unimportant compared to more indirect ones resulting from unrestrained information processing and excessive proliferation. However, a specific technical design of a screening system may help to prevent ethically unacceptable applications.

If the end of exoticism is one of the characteristics of our time, and if classical anthropology based its study of alterity on this exotic distance from the other, is anthropology still possible, and if so, to what end? The author uses these questions as a point of departure for a probing interrogation of ethnological practice, starting with Le;vi-Strauss. The author advocates an anthropology of 'proximity' in place of the usual anthropology of distance. He has studied such emblematic places of (...) Western modernity as the Parisian Metro, or such emblematic 'non-places' as airports, treating as valid anthropological objects phenomena that others might judge less 'pure' or 'significant' than systems of filiation or matrimonial alliance. He outlines an approach to anthropology that focuses on negotiating the social meanings we and others use in making sense of the world, and on the processes of identification that create the difference between same and other. La contribution de la tradition luthérienne à l’élaboration d’un concept substantiel de personne est ici examinée au moyen d’une analyse d’une formule récurrente sous la plume de Luther : Fides facit personam. Après avoir mis en évidence le cadre conceptuel qui donne sens à cet énoncé (la doctrine de la justification par la foi), on étudiera la manière dont deux théologiens contemporains, G. Ebeling et E. Jüngel, ont investi cette structure de base et dont ils se sont approprié l’énoncé de (...) Luther. Il apparaîtra à partir de cette étude que l’un comme l’autre conçoivent l’être personnel de l’homme comme son mode d’être authentique, lequel consiste en un être relationnel. Dans un tel dispositif, c’est la relation que Dieu entretient avec chaque homme qui fait de lui une personne et c’est dans la foi, c’est-à-dire la conscience de son acceptation par Dieu, que chacun peut se vivre comme la personne qu’il est et entretenir des relations authentiques avec Dieu, soi-même et les autres. This essay critiques Professor Martha Nussbaum's book, Liberty of Conscience: In Defense of America's Tradition of Religious Equality . Nussbaum's thesis is that the entire tradition of religious liberty in America can be both best understood and justified by recourse to the overarching principle of equal respect —that “[a]ll citizens have equal rights and deserve equal respect from the government under which they live.” Nussbaum insists that equal respect pervades the tradition and that all other values of religious liberty are (...) subordinate to it. She examines various free-exercise and establishment issues in light of this principle, concluding that the tradition of religious equality is under threat and calling for renewed vigilance in its defense. This essay criticizes Nussbaum's elevation of the principle of equal respect to supreme normative status. It claims that Nussbaum's single-minded focus on equal respect distorts and misunderstands the conflicts actually at issue in many religious liberty disputes. The essay focuses specifically on the inadequacies of her assessment of two prominent religious liberty cases, one in the free exercise and the other in the established context. This essay concludes that there are reasons for deep skepticism about Nussbaum's approach as a comprehensive theory of the religion clauses. (shrink)

Husserls Analyse der Wahrnehmung und Heideggers Zeittheorie sind beide in ihrem Theorieaufbau auf die Gegenständlichkeit der Gegenstände – oder auf den Gegenstandsbezug der Erfahrung und seine wesensmäßige Konstitution – fixiert. Hierin spiegelt sich, bei Heidegger explizit, Kantisches Erbe. Diese phänomenologische, transzendentalphilosophische Relevanz des Gegenstands verweist im Kern auf Intentionalität – und damit auf eine objektbezogene Selbstüberschreitungsfigur der Subjektivität. Ganz anders bestimmt Latour den Stellenwert der Dinge im Kollektiv, wenn er ihnen eine Handlungsmacht zuschreibt, die den traditionellen Gegensatz zwischen Handlungssubjekten und (...) Objektbehandlung einklammert. Der folgende Beitrag kreist den kritischen Punkt ein, der in der Theoriebildung zur Verzweigung phänomenologischer und ANTistischer Ansätze führt. Während sich die Phänomenologie im Zuge einer begrifflichen Rekonstruktion der Erfahrung von Gegenständen konsolidiert, ist die ANT auf die Beschreibung von Handlungsstrukturen ausgerichtet, die sich aus Aktanten aller Art zusammensetzen. Abschließend stellt sich die Frage, ob nicht die kollektivistische Soziologie Latours von dem methodischen Solipsismus der Phänomenologie lernen kann, dass es eine konstruktive Dimension und Machtfülle der deskriptiven Arbeit gibt, die nicht einfach den Akteuren überhaupt, sondern vor allem der Analytikerin überlassen ist? Husserl's analysis of perception and Heidegger's theory of time are both fixated on the objectivity of objects - or the objectrelation of experience and its essential constitution. This reflects - and in the case of Heidegger quite explicitly - Kantian heritage. This phenomenological, transcendental relevance of the object essentially refers to intentionality - and thus an object-related figure of self-transcending subjectivity. Quite differently, Latour determines the status of things in the collective, ascribing to them an agency that brackets the traditional opposition between acting subjects and passive objects. The contribution encircles precisely that critical point which leads to the separation of phenomenological and ANTistical approaches. While phenomenology grounds itself by reconstructing the experience of objects, ANT focuses on the description of the structures of action, which are composed of actants of all kinds. Finally, the question arises whether Latour's collectivist sociology can learn from phenomenology's methodological solipsism that there is a constructive dimension and plenitude of power in the work of description that is not just left to actors in general, but above all to the analyst herself? La refundición de la fenomenología que hemos emprendido desde las Meditaciones fenomenológicas (1992) nos ha conducido, aquí, a reexaminar la cuestión de la apercepción transcendental y la del cogito transcendental tal y como se conoce en Husserl. La problemática de la fenomenalización y del esquematismo fenomenológico de los fenómenos como nada más que fenómenos conducen a su descomposición en tres registros arquitectónicos, cuya estructura común es siempre la de una discordancia en la concordancia: el registro fuera del lenguaje con sus (...) proto-temporalizaciones inestables, el registro del lenguaje con sus temporalizaciones en presencia sin presente asignable, y el registro propiamente husserliano de los sentidos intencionales, temporalizándose en presentes. En este contexto, se examina la cuestión de la Stiftung propia de los a priori eidéticos husserlianos. (shrink)

Malgré des appels explicites à Descartes dans la phénoménologie telle que Husserl l'a conçue, on ne peut pas dire qu'y soient réellement prises en compte la problématique du doute hyperbolique, et encore moins ce qui va de pair avec cette dernière, la problématique du Malin Génie. Tout au plus y rencontre-t-on l'" hypothèse" de la "destruction du monde" et la question de la négation n'y est traitée que de façon assez triviale. Avec la question de l'épochè phénoménologique hyperbolique, cet ouvrage (...) s'efforce de montrer un certain nombre de conséquences cruciales que la mise en jeu de l'hyperbole introduit dans l'architectonique interne de la phénoménologie: questions de l'intentionnalité, du langage, du simulacre originaire, de l'apparence pure, etc. Non par retour au scepticisme classique, mais par ouverture d'un nouveau "scepticisme critique" qui n'exclut pas, nais réimplique autrement l'analyse phénoménologique, par-delà l'intentionnalité, toute doxa positionnelle (perception, intuition) ou quasi-positionnelle (imagination) étant mise en suspens. Le champ ainsi dégagé, fait de mobilités et d'instabilités, qui est désigné ici comme archaïque, est la base phénoménologique, et non pas le fondement du champ fort rigoureusement étudié par Husserl. La phénoménologique ne peut plus dès lors prétendre au titre de science, mais est amenée à s'exercer comme une sorte d'art philosophique, plus proche de la poésie et de la musique, où sont en jeu les profondeurs de notre vie dont le vécu husserlien n'est pour ainsi dire que la surface immédiatement perceptible, le plus souvent illusionnante. The work of David R. Lachterman, The Ethics of Geometry, subtitled A Genealogy of Modernity, concerns essentially the status of geometry in Euclid’s Elements and in Descartes’s Geometry. It is a remarkable work, at once by the declared breadth of its ambitions and by the very great precision of its analyses, which are always supported by a prodigious philosophical culture. David Lachterman’s concern is to grasp, by way of an in-depth commentary of certain, particularly crucial passages of these two foundational (...) works, the change in geometry’s status from the one to the other, and this, as a sort of symptom of what the Moderns, since Descartes, will always experience as a necessary, inaugural rupture with regard to tradition. This change is underlaid, according to the author, by a profound change in the philosophical ethos, and in particular, in the geometer’s ethos. One must understand ethos, Lachterman explains, in the manner of Aristotle: those characteristic means that human beings have by which to act in the world or to behave in relation to one another, or to themselves. There is thus an “ethics” of geometry, namely, in the manner and the style of doing geometry, of behaving as a mathematician both toward apprentices and toward the veritable nature of the “entities” which are to be taught or learnt, and which give their discipline its name. That there is a difference of ethos between Euclid and Descartes implies, according to Lachterman, that there is also a difference in the source of intelligibility of the “mathematical,” understood in the most general sense. This in turn implies a deeper difference in the mode of being in general: it suffices to note that, in the ancient case, the source of intelligibility of the geometric figure lies in the nature of the figure itself, and that in the modern case, the same source is found in the “strategies” and “tactics” suited to bringing the figure to its visibility or to its embodiment, 315 in order to notice that this change in the mode of access to intelligibility must have had profound repercussions upon philosophical thought. It is in this sense that the author’s design is also, at the same time, not genetic, but genealogical. The break between ancient and modern mathematics pleas in favor of a consideration of the rupture of modern thought relative to ancient thought; thus, implicitly—and it is one of the great merits of this book that it shows this—against all homogenizing levelling, in Heidegger’s fashion, of the history of thought down to the history of “the” discipline of metaphysics. If there is something Heideggerian, in the best sense of the term, in Lachterman’s way of considering ethos as coextensive with modes of being, there is, on the other hand, and we ought to be very glad of it, something anti-Heideggerian in his original manner of bringing out the effective novelty of modern thought. For, according to him, modern thought is no longer to be defined, explicitly or exclusively, by the so-called “metaphysics of subjectivity.” Instead, it is defined by a self-regulated, operative, and constructive productivity of thought—and this as much with regard to itself as to its objects. To put it briefly, whereas ancient thought is rather polarized by the logico-eidetic, modern thought is polarized by a sort of methodical constructivism, the status of which is, in reality, very complex. If Descartes speaks of “the construction of a problem,” while Leibniz speaks of the “construction of an equation,” and Kant of the “construction of a concept,” everything depends—as we might guess—upon the multiple meanings that the term ‘construction’ may take on. Is it to be taken in the sense of an absolute creation, a quasi ex nihilo creation, which would render mathematics divine? Is it the creation of artefacts, or again, is it the methodical exploration of problems posed to thought by the existence of objects or corresponding ideas, themselves supposed to be somewhere in the divine understanding? We already discern the breadth and the depth of the debate, and we sense that the essential will be played out in Lachterman’s commentaries on the famous Cartesian solution of the problem of Pappus—the birth certificate, as we know, of analytic geometry. El presente artículo se apoya en el comentario de un texto contenido en el § 5 del Apéndice general a las Investigaciones lógicas. A partir de ese texto problematizamos el concepto husserliano (jamás de veras comprendido por Heidegger) de fenómeno. A continuación se presentan algunas aporías relativas a la variación eidética en la exposición que de ella se da en Experiencia y juicio, así como otras relativas al problema de la percepción interna que, en la fenomenología no estándar que a (...) la luz de estas aporías se va perfilando, habrá de entenderse como un contacto de sí consigo, contacto ya entrañado en la idea del Nachschwimmen, metáfora que avanza el citado apéndice de Husserl. Proseguimos con una presentación de lo que entendemos, según la sugerencia que nos hiciera J.-T. Desanti, como �fenomenología no estándar�, esbozando algunos de sus conceptos fundamentales y el modo en el que se inscriben en el espíritu (que no en la letra) de la fenomenología de Husserl por cuanto dicha fenomenología no estándar es una versión de la fenomenología genética, versión que entiende que la estructura de correlación ego-cogitocogitatum o noesis-hylè-nóema descansa en estructuras (no eidéticas sino esquemáticas) más profundas. Se trata, fundamentalmente, del territorio de la afectividad (no intencional pero tampoco entendida como auto-afección), territorio correspondiente a la parte infigurable de la vivencia, parte a cuya fenomenalización abre lo que entendemos como �epojé fenomenológica hiperbólica�, y donde la phantasia, la afectividad y el esquematismo desempeñan un papel fundamental. El presente texto se interroga con respecto a la posibilidad de que el pensamiento heideggeriano del Ereignis pueda ir más allá de la «tautología simbólica» entendida como la identificación entre ser y pensar, dado que, si bien el Ereignis garantiza la mismidad y unidad de dicha co-implicación, apela a su vez a algo que se reserva en dicho don. A tal fin, se sirve de la formulación, según la cual el pensar consistiría en un encaminamiento del «habla» (Sprache) en tanto (...) el eco del «dicho» (Sage), el cual en su silenciamiento deja que tenga lugar el pronunciamiento de la palabra. Dicha articulación, no obstante, corre el riesgo de que el Ereignis cumpla un rol meramente «formal» debido a que su retraimiento en tanto Enteignis sólo sería la condición de posibilidad para la temporalización y espacialización de la morada del habla, con lo cual sólo a través del decir podría desplegarse un mundo. Así, más allá de Heidegger, se busca ahondar en dicha dimensión de retraimiento del Enteignis, a partir de la cual el habla se hace eco no de una nada, sino, más bien, de una multiplicidad originaria de Wesen salvajes en tanto la proto-temporalización de fenómenos de mundo fuera del lenguaje. El presente texto expone, en primer lugar, la tautología simbólica que habita la fenomenología del lenguaje en Husserl, en la medida en que, a pesar del reconocimiento de una dotación de sentido ontológico preexistente a la cual el sentido de la expresión debe adaptarse, en realidad la expresión cumple la función de reflejar dicho sentido noemático en una imagen (Abbild) tal y como es, a fin de poder ser figurado (Einbildung) en tanto concepto. Dicha reduplicación especular (Wiederspiegelung), a partir de (...) la cual lo antepredicativo sería reflejo fiel de lo predicativo, se corresponde con un «nominalismo fenomenológico», en tanto implica una pérdida de la densidad propiamente fenomenológica del lenguaje. En segundo lugar, sostiene que la poiética, es decir, la creación artística, es aquello que devela la dimensión de fenomenalidad del lenguaje mismo, en la medida en que hace uso de la «imaginación» (Einbildungskraft) en el sentido de una Einbildung haciéndose, la cual implica tanto una distorsión inherente a su efectuación, como una figuración que opera sin concepto, con lo cual en ella se fenomenalizan Wesen más primitivos o más salvajes que los propios a los eide lógicamente instituidos por el lenguaje. Se abordan aquí algunas dificultades de la ‘psiquiatría fenomenológica’ directamente en relación con la aprehensión de las patologías ‘psíquicas’ o ‘mentales’ dentro de un modelo de ‘normalidad’ derivado de la psicología del siglo XIX de inspiración filosófica. Desde el concepto de ‘sospecha’ freudiano, los estudios de las patologías mentales de Binswanger, los análisis de algunos problemas nucleares sobre la síntesis pasiva husserliana, Richir pretende explorar una nueva ‘vía’, más allá de los límites de la psiquiatría fenomenológica, que incluya, de manera (...) cuasi estructural, las formas de temporalización y espacialización que funcionan en las ‘flexiones’ patológicas del Dasein. En otras palabras, trata de relacionar sistemáticamente la temporalización/espacialización husserliana, entendida como síntesis pasiva, con la filosofía de la afectividad, de la Befindlichkeit heideggeriana, que pone en juego la dimensión de una pasividad originaria del Dasein, entendida bajo el signo de facticidad. Para ello, Richir comenta detallada y magistralmente el conocidísimo §29 de Ser y Tiempo, con el objetivo no solo de captar la matriz transcendental de la división interna de la Stimmung y de la Verstimmung sino, también, mostrar justamente cómo puede logarse, por un lado, cierta articulación de lo que Husserl denomina como síntesis pasiva de la temporalización con la Stimmung y la Befindlichkeit heideggerianas y, por el otro, una posible vía de articulación entre Stimmungen normales y V erstimmungen patológicas, esto es, de una división interna a la Stimmung que haga posible al menos la versión patológica en la Verstimmung. El presente texto comienza por recapitular los resultados obtenidos en los Fragmentos fenomenológicos sobre el lenguaje mediante una aproximación a la esencia del lenguaje a partir de una epoché fenomenológico hiperbólica que nos abre a un ámbito pre-intencional de sentido, el cual es denominado esquematismo de lenguaje. Dicho esquematismo constituye un ámbito, en el cual el sí mismo se refleja en su infigurabilidad tanto a nivel de su auto-afección como de su corporalidad a través de lo que se denomina phantasiai (...) «perceptivas», las cuales son a su vez transposiciones de phantasiai «primitivas» del esquematismo fuera del lenguaje, así como aquello que tiene lugar en el intercambio de miradas entre el recién nacido y la madre bajo el modelo concreto del balbuceo infantil. Dicha constitución de sí a partir de las phantasiai «perceptivas» será transpuesta en «esbozos de sentido» que guardarán el carácter infigurable de aquellas aunque transponiéndolas a su vez en «sentidos en esbozo», es decir, en signos de una lengua simbólicamente instituida y cuyo hacer sentido remite al sentido haciéndose de su origen. Es a dicho balbuceo infantil al que se denomina proto-musicalidad, y es lo que constituye aquello con lo cual «juega» la poesía y la música más allá de sus instituciones simbólicas respectivas. The remake that we have started of phenomenology since the Phenomenological Meditations (1992) has led us here to reexammine the question of transcendantal aperception and transcendental cogito such as it is known by Husserl. The problematic of phenomenalization and phenomenological schematism of phaenomena as but phaenomena leads to its decomposition in three architectonichal registers, whose common structure is each time that of a discordance into the accordance: register of off language with, its instable proto-temporalization, register of language with its temporalizations (...) in presence without a present that could be set, and utterly husserlian register of intentionnal meanings wich temporalize themselves in presents. In this context, the question of the Stiftung itself of eidetic husserlian a priori is examined. (shrink)

Today, the goals of pharmaceutical policy and medical practice are often undermined due to institutional corruption — that is, widespread or systemic practices, usually legal, that undermine an institution's objectives or integrity. In this symposium, 16 articles investigate the corruption of pharmaceutical policy, each taking a different look at the sources of corruption, how it occurs, and what is corrupted. We will see that the pharmaceutical industry's own purposes are often undermined. Furthermore, pharmaceutical industry funding of election campaigns and lobbying (...) skews the legislative process that sets pharmaceutical policy. Moreover, certain practices have corrupted medical research, the production of medical knowledge, the practice of medicine, drug safety, the Food and Drug Administration's oversight of the pharmaceutical market, and the trustworthiness of patient advocacy organizations.
