Firms engage in corporate social responsibility (CSR) because they consider that some kind of competitive advantage accrues to them. We contend that resource-based perspectives (RBP) are useful to understand why firms engage in CSR activities and disclosure. From a resource-based perspective CSR is seen as providing internal or external benefits, or both. Investments in socially responsible activities may have internal benefits by helping a firm to develop new resources and capabilities which are related namely to know-how and corporate culture. In (...) effect, investing in social responsibility activities and disclosure has important consequences on the creation or depletion of fundamental intangible resources, namely those associated with employees. The external benefits of CSR are related to its effect on corporate reputation. Corporate reputation can be understood as a fundamental intangible resource which can be created or depleted as a consequence of the decisions to engage or not in social responsibility activities and disclosure. Firms with good social responsibility reputation may improve relations with external actors. They may also attract better employees or increase current employees’ motivation, morale, commitment and loyalty to the firm. This article contributes to the understanding of why CSR may be seen as having strategic value for firms and how RBP can be used in such endeavour. (shrink)

This study compares the Internet (corporate web pages) and annual reports as media of social responsibility disclosure (SRD) and analyses what influences disclosure. It examines SRD on the Internet by Portuguese listed companies in 2004 and compares the Internet and 2003 annual reports as disclosure media. The results are interpreted through the lens of a multi-theoretical framework. According to the framework adopted, companies disclose social responsibility information to present a socially responsible image so that they can legitimise their behaviours to (...) their stakeholder groups and influence the external perception of reputation. Results suggest that a theoretical framework combining legitimacy theory and a resource-based perspective provides an explanatory basis for SRD by Portuguese listed companies. (shrink)

Many arguments have been made against gene editing. This paper addresses the commonly invoked argument that gene editing violates human dignity and is ultimately a subversion of human nature. There are several drawbacks to this argument. Above all, the concept of what human dignity means is unclear. It is not possible to condemn a practice that violates human dignity if we do not know exactly what is being violated. The argument’s entire reasoning is thus undermined. Analyses of the arguments involved (...) in this discussion have often led to the conclusion that gene editing contravenes the principle of genetic identity (genetic immutability) thereby subverting a requisite of human dignity and ultimately threatening human nature. This paper refutes these arguments and shows that any opposition to gene editing cannot rely on the human dignity argument. (shrink)

Although Chinese law imposes informed consent for medical treatments, the Chinese understanding of this requirement is very different from the European one, mostly due to the influence of Confucianism. Chinese doctors and relatives are primarily interested in protecting the patient, even from the truth; thus, patients are commonly uninformed of their medical conditions, often at the family’s request. The family plays an important role in health care decisions, even substituting their decisions for the patient’s. Accordingly, instead of personal informed consent, (...) what actually exists is ‘family informed consent’. From a Western perspective, these features of Chinese law and Chinese culture might seem strange, contradicting our understanding of doctor-patient relationship and even the very essence of self-determination and fundamental rights. However, we cannot forget the huge influence of cultural factors in these domains, and that ‘Western’ informed consent is grounded on the individualistic nature of Western culture. This article will underline the differences between the Western and the Chinese perspectives, clarifying how each of them must be understood in its own cultural environment. But, while still respecting Chinese particularities, this paper advocates that China adopt patient individual informed consent because this is the only solution compatible with human dignity and human rights. We show that a new interpretation of quantum mechanics, in which the notion of event is defined without reference to measurement or observers, allows to construct a quantum general ontology based on systems, states and events. Unlike the Copenhagen interpretation, it does not resort to elements of a classical ontology. The quantum ontology in turn allows us to recognize that a typical behavior of quantum systems exhibits strong emergence and ontological non-reducibility. ABSTRACTWhile Spinoza stipulates an ideal moral person in the propositions on the ‘free man’ in Ethics IV, this account does not seem to be intended to function as a pedagogical tool of political relevance. Hence, it does not seem to correspond to the purpose of moral exemplarism. If we look for that kind of practical guidance, Spinoza’s political works seem more relevant. Interestingly, when we approach Spinoza’s political theory with moral exemplarism in mind, we find that instead of constructing his (...) exemplar on the idea of a supremely moral person, he emphasizes the concept of ingenium to chisel out an imperfect model of human behavior. We argue that the purpose of this is to avoid a utopian and inefficient political theory and to work out a moral practice that is capable of assisting people and communities in ethical self-transformation. The events surrounding COVID-19, combined with the mandatory quarantines widely imposed in Asia and Europe since the virus outbreak, have reignited discussion of the balance between individual rights and liberties and public health during epidemics and pandemics. This article analyses this issue from the perspectives of precaution and necessity. There is a difficult relationship between these two seemingly opposite principles, both of which are frequently invoked in this domain. Although the precautionary principle encourages the use of quarantines, including mandatory quarantines, (...) and associated restrictive measures, the principle of necessity puts a break on such measures. The COVID-19 pandemic reveals once again the different interrelations between these two principles. However, the alleged conflict between the PN and the PP is based on a superficial analysis. The relation between these two principles is far more complex, as this article will demonstrate. (shrink)

The Director-General of the WHO has suggested that China’s approach to the COVID-19 crisis could be the standard of care for global epidemics. However, as remarkable as the Chinese strategy might be, it cannot be replicated in other countries and certainly not in Europe. In Europe, there is a distribution of power between the European Union and its member states. In contrast, China’s political power is concentrated in the central government. This enables it to take immediate measures that affect the (...) entire country, such as massive quarantines or closing borders. Moreover, the Chinese legal framework includes restrictions on privacy and other human rights that are unknown in Europe. In addition, China has the technological power to easily impose such restrictions. In most European countries, that would be science fiction. These conditions have enabled China to combat epidemics like no other country can. However, the WHO might have been overoptimistic. The Chinese standard of care for treating COVID-19 also raises problematic issues for human rights, and the real consequences of these actions remain to be seen. (shrink)

Recent years have seen mounting challenge to the model of the criminal trial on the grounds it is not cost-effective, not preventive, not necessary, not appropriate, or not effective. These challenges have led to changes in the scope of the criminal law, in criminal procedure, and in the nature and use of criminal trials. These changes include greater use of diversion, of fixed penalties, of summary trials, of hybrid civil–criminal processes, of strict liability, of incentives to plead guilty, and of (...) preventive orders. The paper will assess the implications of these changes for the function of the criminal law, assessing the reasons behind them, and examining whether or not they are to be welcomed. Identifying the larger import of these changes draws attention to the changing relationship between state and citizen as well as changes in the nature of the state itself. These can in turn be attributed to a jostling among the different manifestations of the authoritarian state, the preventive state, and the regulatory state. These changes have profound normative implications for a liberal theory of the criminal law that require its re-articulation and its defence. A modest start may be to insist that where the conduct is criminal and the consequences are punitive the protections of criminal procedure and trial must be upheld. (shrink)

La finalidad de esta investigación es analizar en qué grado se refleja el aprendizaje por competencias en el Máster de Educación Secundaria en una Universidad española. Se ha realizado un análisis de contenido de las guías docentes mediante el software ‘ATLAS.ti’. Siguiendo un enfoque deductivo, las categorías analizadas han sido: 1) metodología activa, 2) contexto real, 3) proyectos integrados, 4) reflexión, y 5)evaluación plural. Los resultados muestran que hay pocas evidencias del diseñocurricular por competencias. Most courts around the world have been refusing wrongful life actions. The main argument invoked is that the supposed compensable injury cannot be classified as such, since life is always a blessing no matter how hard and painful it is.In opposition to mainstream scholars and the dominant case law, this article sustains that life must be distinguished from living conditions, the former being the real injury at stake, since some living conditions are so intolerable that in themselves they justify a (...) compensation within wrongful life actions. In recent decades, psychological research on the effects of mindfulness-based interventions has greatly developed and demonstrated a range of beneficial outcomes in a variety of populations and contexts. Yet, the question of how to foster subjective well-being and happiness remains open. Here, we assessed the effectiveness of an integrated mental training program The Art of Happiness on psychological well-being in a general population. The mental training program was designed to help practitioners develop new ways to nurture their own happiness. This (...) was achieved by seven modules aimed at cultivating positive cognition strategies and behaviors using both formal and informal practices. The program was conducted over a period of 9 months, also comprising two retreats, one in the middle and one at the end of the course. By using a set of established psychometric tools, we assessed the effects of such a mental training program on several psychological well-being dimensions, taking into account both the longitudinal effects of the course and the short-term effects arising from the intensive retreat experiences. The results showed that several psychological well-being measures gradually increased within participants from the beginning to the end of the course. This was especially true for life satisfaction, self-awareness, and emotional regulation, highlighting both short-term and longitudinal effects of the program. In conclusion, these findings suggest the potential of the mental training program, such as The Art of Happiness, for psychological well-being. (shrink)

Standpoint logic is a recently proposed formalism in the context of knowledge integration, which advocates a multi-perspective approach permitting reasoning with a selection of diverse and possibly conflicting standpoints rather than forcing their unification. In this paper, we introduce nested sequent calculi for propositional standpoint logics---proof systems that manipulate trees whose nodes are multisets of formulae---and show how to automate standpoint reasoning by means of non-deterministic proof-search algorithms. To obtain worst-case complexity-optimal proof-search, we introduce a novel technique in the context (...) of nested sequents, referred to as "coloring," which consists of taking a formula as input, guessing a certain coloring of its subformulae, and then running proof-search in a nested sequent calculus on the colored input. Our technique lets us decide the validity of standpoint formulae in CoNP since proof-search only produces a partial proof relative to each permitted coloring of the input. We show how all partial proofs can be fused together to construct a complete proof when the input is valid, and how certain partial proofs can be transformed into a counter-model when the input is invalid. These "certificates" (i.e. proofs and counter-models) serve as explanations of the (in)validity of the input. (shrink)

Greenwashing is a phenomenon that is linked to scandals that often occur at the supply-chain level. Nevertheless, research on this subject remains in its infancy; much more is needed to advance our understanding of stakeholders’ reactions to greenwashing. We propose here a new typology of greenwashing, based on the locus of discrepancy, i.e. the point along the supply-chain where the discrepancy between ‘responsible words’ and ‘irresponsible walks’ occurs. With three experiments, we tested how the different forms of greenwashing affect stakeholders’ (...) reactions, from both ethical and business perspectives. We developed our hypotheses by building on attribution theory, which seeks to account for how observers construct perceptions about events. We had anticipated that the more internal, controllable and intentional the discrepancy is, the greater the blame attributed to a company is, and the lower the intention to invest will be. When greenwashing occurs at a company level, this results in a higher level of blame attribution, while the intention to invest falls. Indirect greenwashing refers to a misbehaviour perpetrated by a supplier who claims to be sustainable, and which results in a less negative impact on a supplied company. We also propose the vicarious greenwashing, which occurs when the behaviour of a supplier is in breach of a company’s claims of sustainability. This type of greenwashing is nevertheless detrimental to investment. The findings here advance our understanding of how greenwashing shapes stakeholders’ reactions, and highlight the need for the careful management of the supply-chain. (shrink)

The use of reproductive techniques and the eventual reproductive negligence from the provider of reproductive services gave rise to situations in which the intended parents are deprived of raising a child genetically connected to them. Courts have been dealing with cases of those for years, but have systemically denied claimants compensation, failing to recognise as damage the loss of genetic connection. In 2017, for the first time, the Singapore High Court provided compensation for that damage, labelled “loss of genetic affinity”. (...) This paper will argue that the damage in question is the loss of genetic connection and results from a violation of reproductive rights because a key element of reproductive rights is to have children with whom we keep a genetic bond and raise them. The paper will explain why the arguments classically argued against such compensation are unfounded and it will argue for a compensation covering both patrimonial and non-patrimonial damages. O presente trabalho objetiva discutir as possíveis contribuições da Hermenêutica Filosófica de Gadamer para a pesquisa em Psicologia. Nessa direção, parte da problematização do modo como o conhecimento é produzido na Psicologia, com realce para a insuficiência do horizonte técnico-científico para aproximar-se dos fenômenos humanos. Recorre à Hermenêutica Filosófica de Gadamer na busca do desvelamento de outras possibilidades para tal fazer. Para tanto, parte da compreensão da hermenêutica, não na função de método, mas compreendida como condição humana originária. Aborda inicialmente (...) o reconhecimento da influência de Heidegger para o desenvolvimento da Hermenêutica Filosófica de Gadamer e, em seguida, tece uma possível articulação entre o horizonte aberto por Gadamer e a pesquisa em Psicologia, enfocando as compreensões do filósofo acerca da compreensão, do jogo e do diálogo. Por fim, ressalta as contribuições abertas pela Hermenêutica Filosófica para descortinar “direcionamentos” inspiradores às pesquisas no contexto da Psicologia na busca de compreender os fenômenos existenciais. Tal caminho, na medida em que não busca conclusões teoréticas e explicativas, ao manter-se na direção da pergunta, realça a dimensão compreensiva e hermenêutica originária da existência como radicalmente singular e possibilita a tessitura de diálogos entre Psicologia e Hermenêutica Filosófica. La característica más representativa de la música es su capacidad de generar emoción. Pero ¿por qué la música emociona? En este artículo mostramos los conocimientos actuales de la teoría musical y la neurociencia que intentan explicar las relaciones que existen entre la música y las emociones. En primer lugar, se repasan los conocimientos actuales sobre el procesamiento de los sonidos musicales a nivel cerebral y las posibles explicaciones del origen de la emoción musical, así como la contribución de los distintos (...) parámetros musicales a la generación de emociones, considerando estructuras musicales de nuestro mundo occidental. En segundo lugar, se presenta el canal táctil como un posible canal de transmisión de la emoción musical análogo al canal auditivo, pero con más limitaciones en la discriminación de frecuencias. Este acercamiento se produce desde la profunda fascinación que ejerce la música, con la esperanza de encontrar vías para explicar la transmisión de la emoción musical desde un canal alternativo. The rapidly expanding universe of information, media, and learning experiences available through digital technology is creating unique opportunities and vulnerabilities for children and adolescents. These issues are particularly salient during the developmental window at the transition from childhood into adolescence. This period of early adolescence is a time of formative social and emotional learning experiences that can shape identity development in both healthy and unhealthy ways. Increasingly, many of these foundational learning experiences are occurring in on-line digital environments. These expanding (...) vulnerabilities and opportunities are being further amplified for young adolescents growing up in low resourced settings around the world. Cultural and contextual factors influence access, use, and appropriation of digital technology. Further, neurobehavioral changes associated with the onset of puberty often coincide with entry into social media and more autonomous use of technology. In low-and-middle-income countries (LMICs), disparities in access, use, and appropriation of digital media can amplify prevailing economic gaps, and compound gender inequalities during early adolescence. In LMICs, adolescents are often the early adopters of mobile technology and social media platforms. While the impact of social media on the well-being, particularly mental health, of young adolescents has been a focus of research in high-income countries (HICs), much less is known about the impacts of social media use on young adolescents in LMICs. In this paper, we review what is known about the interaction between digital media and early adolescent development. We highlight crucial gaps in the evidence in LMICs; and describe some hypotheses and areas for future research to address these compelling issues. (shrink)

Arthur Anderson & Co. has made a significant contribution to assist and encourage the teaching of business ethics. They provided assistance initially through workshops and curriculum materials; currently they are using campus coordinators to disseminate information and materials. The curriculum materials can be used by the instructor to assist students in practicing their moral reasoning skills and cover four academic areas: Accounting, Finance, Marketing, and Management. These materials include business ethics video vignettes, suggestions on presentation methods, guidelines for implementing a (...) stakeholders' analysis approach to ethical reasoning, and possible discussion questions. The vignettes present ethical dilemmas that persons may encounter in entry level positions. We have used the vignettes, the accompanying discussion questions, and the suggested stakeholder analysis in class presentations. This paper presents a discussion of the basic concepts associated with cooperative learning, an example of the implementation of cooperative learning techniques using the Arthur Andersen Accounting Ethics Vignettes, and empirical results of the influence of these particular group discussions on the students' ethical responses. We did not attempt to measure whether the individuals' moral levels changed, but whether the group discussions stimulated any changes in the students attitudes toward the particular ethical dilemma they viewed. Although synthetic biology is a promising discipline, it also raises serious ethical questions that must be addressed in order to prevent unwanted consequences and to ensure that its progress leads toward the good of all. Questions arise about the role of this discipline in a possible redefinition of the concept of life and its creation. With regard to the products of synthetic biology, the moral status that they should be given as well as the ethically correct way to behave towards (...) them are not clear. Moreover, risks that could result from a misuse of this technology or from an accidental release of synthetic organisms into the environment cannot be ignored; concerns about biosecurity and biosafety appear. Here we discuss these and other questions from a personalist ontological framework, which defends human life as an essential value and proposes a set of principles to ensure the safeguarding of this and other values that are based on it. I approach a set of processes that involve transformations, transpositions, and intermediations between different expressive forms of Amazonian Indigenous Peoples associated with the use of ayahuasca. I focus on groups of the Pano linguistic stock, particularly the Huni Kuin (Kaxinawa) and the example of the MAHKU (Movimento dos Artistas Huni Kuin), a new artistic collective created by some of these Indigenous People. I point to the complex meanings of the various expressive forms of these peoples, from traditional (oral narratives, graphics, (...) visionary images linked to shamanic practices) to more recently adopted (figurative drawing and graphic recording in book format). I emphasize the importance of ayahuasca for the elaboration of these different expressive forms. By highlighting the meanings that imply the use of ayahuasca in certain Indigenous contexts, I also intend to contribute to the expansion of understanding of and broader debate about psychedelic experiences. Open innovation (OI) has gained widespread attention in recent years as a catalyst for sustainable management. Through OI, companies can harness their environmental capabilities to develop sustainable innovations that provide mutual benefits for companies and society. We explore the impact of Corporate Governance (CG) on Green Product Innovation (GPI) as OI and the impacts of GPI on corporate financial performance (CFP). Adopting Heckman's two-stage procedure to a panel of 622 science-based firms over the study period of 2008–2021, in the first (...) step, we test the link between boards of directors' characteristics and GPI engagement. In the second step, we test the relationship between GPI and CFP. The findings confirm that effective CG mechanisms positively impact GPI performance. Moreover, GPI is a positive predictor of reduced firm riskiness. Therefore, we provide new insights into the debate on the links among CG, GPI, and CFP that can help companies meet the new challenges of the ecological transition. (shrink)

ABSTRACTThis article looks to Attic comedy to explain Socrates’ first argument in Plato's Hippias Major: his refutation of Hippias’ claim that the Beautiful is a beautiful girl. As part of his argument, Socrates introduces three examples of beautiful things—a mare, a lyre and a pot —all of which are used in comedy as metaphorical obscenities for sexualized women. The author contends that an erotic reading of the text accomplishes what no other interpretation can: a unified account of the passage that (...) allows for Socrates’ successful refutation of a proposal in keeping with Hippias’ character. In addition, it explains Socrates’ choice of examples—in particular, the rarely cited χύτρα—and Hippias’ otherwise inexplicable reaction to the χύτρα, as well as the analogous relationship of monkeys and men to pots and girls. The aim is to present a discussion on the origins of the German Enlightenment, comparing the advances made by Leibniz, Crusius and Wolff. The particular element of seventeenth and eighteenth century German society is highlighted, in order to understand the specificities of the Kantian proposal, which is shown to be a process in development and not finished of freedom and autonomy.

Can we really transcend our own human point of view in approaching the non-human? Rather than confining anthropomorphism in the field of the superstitious or identifying it with anthropocentrism, we propose a “weak” anthropomorphism. By adopting phenomenology as methodology, particularly Merleau-Ponty’s notions of corporeity and flesh, we suggest that anthropomorphism is the result of a shared bodily perception: first of all, we are-in-the-world. What we have is not a divide between the human and the non-human, but rather a blurred and (...) fuzzy compound of human and non-human features, where the wild coincides with this symbiotic unit. Synthetic biology opens up the possibility of producing new entities not found in nature, whose classification as organisms or machines has been debated. In this paper we are focusing on the delimitation of the moral value of synthetic products, in order to establish the ethically right way to behave towards them. In order to do so, we use personalism as our ethical framework. First, we examine how we can distinguish between organisms and machines. Next, we discuss whether the products of (...) synthetic biology can be considered organisms at all and assess what their moral value is and how should we behave towards them. O notável lugar de destaque e o papel central das mulheres nas sociedades africanas pré-coloniais tem sido inferiorizado em empreendimentos coloniais de devastação dos modos de ser africano, com desdobramentos particulares sobre as mulheres em função da instrusão da hierarquia de gênero e da consequente generificação do trabalho. A descaracterização e criminalização das organizações socioeconômicas autóctones, matrifocalizadas, expressa-se pela nomenclatura de “economias informais”. À vista disso, o presente artigo teórico-empírico tem como objetivo articular como a categoria “matriarcado” se aplica à (...) lógica de organização socioeconômica reinventada na contemporaneidade, produzindo autonomia e independência de mulheres. Iniciamos com o embate ontológico e epistemológico que incita a resiliência das estruturas familiares e econômicas matriarcais nas Améfricas. Em seguida, na etapa empírica, constatamos as manifestações da matrifocalidade partir de relatos de lideranças de organizações econômicas e religiosas de matriz africana. Tais tecnologias econômicas matricentradas representam fonte de geração de vida individual e coletiva e – sobretudo – a capacidade de reinvenção dos princípios do matriarcado nas Améfricas contemporâneas. This text is a narrative that shows the fluid border between religion and culture, from my own observation at the Islamic community in Portugal. Despite the differences and complexities found in the group of Muslims in Portugal, due to its origins, to Islamic movements and strands, the Guinean Muslims will be the protagonists in this article, especially because it is a case of continuing migration in that country, which results in increase of that population in Portugal. In a way, this (...) finding helps illustrate the fluidity of relationships religion / culture, by the very practices from their particular cultures. In addition, as a Muslim majority, which comes from the same geographical region, reproducing ethnic traits, undergo a process of segregation, not only by the wider host society but also by the Islamic religious group based in Portugal, which is generating a conflict situation. O texto analisa como o problema da coisa em si em Kant, enquanto fundamento real ou não do fenômeno, foi reelaborado pelos filósofos pós-kantianos e como estes buscaram solucionar o possível dualismo da filosofia crítica. A investigação se concentra sobretudo na resposta de Schopenhauer ao problema, evidenciado pela primeira vez pelo filósofo Friedrich Heinrich Jacobi, um dos grandes críticos da filosofia transcendental e do idealismo.

The supply chain of the auto body industry in Duitama, Boyacá, faces challenges that affect its efficiency, such as the lack of integration of new technologies and organizational management models, limiting its competitiveness in expanded markets. The purpose of this research is to analyze the key links in the supply chain: procurement, production, distribution and organizational performance, in order to identify opportunities for improvement that promote the strengthening and sustainability of the local auto body industry. Methodologically, a qualitative approach with (...) descriptive scope is employed, using a documentary review and direct observation. The findings indicate that the main difficulty lies in the absence of integrated logistics and management strategies, which leads to the isolated operation of the links in the chain, reducing the efficiency and competitiveness of the companies. It is concluded that it is essential to develop proposals that promote the implementation of management guidelines that strengthen each link of the supply chain and are more integrative and effective, ensuring the continuity and business success of the bodywork sector in Duitama. El estudio estuvo destinado a determinar la necesidad de formación profesional sindical del representante de los trabajadores en la negociación colectiva. Los resultados principales son los siguientes: la diferencia entre la formación profesional y sindical esta en que la formación sindical es importante debido a que permite dotar a los cuadros sindicales de información general sobre el rol de los sindicatos y su papel en la negociación colectiva, por otro lado la formación profesional es importante ya que es una herramienta (...) que permite mejorar la calidad del empleo, entre otros, se determino que la formación profesional sindical del representante de los trabajadores, influye en su desempeño como negociador en una negociación colectiva. Traditional agricultural systems in Mediterranean Europe were characterised by diversity and multifunctionality, and polycultures played a fundamental role in them. Some of these farm systems and the traditional agricultural practices linked to them have now largely disappeared, but they are increasingly recognised as a valuable source of agroecological knowledge. In this study, we seek to recover the long-lost experience from a traditional Mediterranean intercropping system that combined the cultivation of vines and cereals. Using local historical resources available for a Catalan (...) village for the second half of the nineteenth century, we compare the characteristics and functioning of intercropping and monocultures of vines and cereals using socioeconomic and agrarian metabolism indicators, and discuss the advantages of the traditional intercropping system as an adaptation to the productive limitations of the agroecosystem (particularly in terms of soil quality and productivity, and availability of labour and draft force), but also as a peasant economy strategy that responded to a multifunctional balancing rationale. This way, this research contributes to recovering the knowledge and experience of a long-lasting traditional crop system that had been used until the second half of the twentieth century, and provides an understanding of the rationale and advantages of traditional Mediterranean crop systems beyond productivity and profit maximisation strategies.
