In 1996 Congress passed the Dickey–Wicker Amendment as part of an appropriations bill; it has been renewed every year since. The DWA bans federal funding for research using embryos and parthenotes. In this paper, we call for a public discussion on parthenote research and a questioning of its inclusion in the DWA. We begin by explaining what parthenotes are and why they are useful for research on reproduction, cancer, and stem cells. We then argue that the scientific difference between (...) embryos and parthenotes translates into ethical differences, and claim that research on parthenotes is much less ethically problematic. Finally, we contextualize the original passage of the DWA to provide an explanation for why the two were possibly conflated in this law. We conclude by calling for a public discussion on reconsidering the DWA in its entirety, starting with the removal of parthenogenesis from this prohibition of National Institutes of Health funding. This book proceeds from a single and very simple observation: throughout history, and up to the present, women have received a clear message that we are not supposed to prioritize ourselves. Indeed, the whole question of "self" is a problem for women - and a problem that issues from a wide range of locations, including, in some cases, feminism itself. The attempt to critique the profession of clinical ethics consultation by establishing the impossibility of ethics expertise has been a red herring. Decisions made in clinical ethics cases are almost never based purely on moral judgments. Instead, they are all-things-considered judgments that involve determining how to balance other values as well. A standard of justified decision-making in this context would enable us to identify experts who could achieve these standards more often than others, and thus provide a basis for expertise (...) in clinical ethics consultation. This article contributes to carework scholarship by examining the nexus of gender, class, and race in long-term care facilities. We draw out a family ideology at work that promotes good care of residents and thus benefits nursing homes. We also found that careworkers value fictive kin relationships with residents, yet we uncover how the family model may be used to exploit these low-income careworkers. Reflecting a subordinate and racialized version of being “part of the family,” we call for an ethic (...) of reciprocity and for concrete change toward valuing equally the humanity of those who need and those who give care. The question of whether clinical ethics consultants may engage in patient advocacy in the course of consultation has not been addressed, but it highlights for the field that consultants? allegiances, and the boundaries of appropriate professional practice, must be better understood. I consider arguments for and against patient advocacy in clinical ethics consultation, which demonstrate that patient advocacy is permissible, but not central to the practice of consultation. This study investigates the connection between corporate social responsibility (CSR) and corporate reputation among the public using fuzzy set qualitative comparative analysis (fsQCA). To examine complex processes underlying the reactions of this influential stakeholder group, hypotheses are drawn from the category diagnosticity approach. Thereby, a psychological model of perceived (im)morality is transferred to the CSR context. In line with these hypotheses, positive/negative CSR activities influence reputation in the expected directions (H1a, b), while the effects of specific configurations of CSR activities (...) reveal an asymmetry suggesting a negativity bias (H2). Further analyses confirm that positive effects require a consistent positive performance regarding prior reputations (H3a) and the aggregated CSR activities of several previous years (H3b, c). Moreover, the relevant patterns vary between industries (H4). The present study thus contributes to CSR research by investigating a powerful but hitherto understudied stakeholder group through a category diagnosticity lens combined with a configurational approach to analysis. Advancements in the field of biotechnology have accelerated the development of drugs that are manufactured from cultures of living cells, commonly referred to as “biologics.” Due to the complexity of the production process, generic biologics are unlikely to be chemically identical to the reference product, and accordingly are referred to as “biosimilars.”Encouraging the development of biosimilars has been presented as the key solution to decrease prices and increase access to biologics, but the development and use of biosimilars continues to raise (...) problems, none of which can easily be addressed. Developing a biosimilar requires considerable time and financial resources, and legitimate safety concerns necessitate elaborate clinical testing of biosimilars. As a consequence, the introduction of biosimilars onto the market has not resulted in significant price reductions, and concerns regarding the substitution and interchangeability of original biologics with biosimilars persist.This article will explain how the biologics production process distorts the trade-offs that traditionally guided both patent protection and regulatory exclusivities: disclosure as a key condition for benefiting from the corresponding monopoly position. Hence, we propose establishing a mechanism of mandatory deposit of the original biologic's cell line at the stage of the regulatory approval as the most effective remedy. (shrink)

With Spirits and Clocks, Dennis Des Chene completes a two-part project begun with Life’s Form: Late Aristotelian Conceptions of the Soul. In both volumes, Des Chene is concerned with the question of what makes living things living. For the Jesuit Aristotelians, the answer requires a complex analysis of the ontology of soul and power. For Descartes, of course, the answer is completely different; arguably, there is a sense in which his answer is: nothing. Indeed Des Chene does argue this, concluding (...) that for Descartes there are no living things in the Aristotelian sense: the body machine does not live, because it has no powers; the soul does not live because it has no role in nutrition, growth, and generation. Descartes’s physiology thus represents the most radical aspect of his natural philosophy, for he must eliminate souls from living things as part of the general project of eliminating Aristotelian forms from nature. As such, the importance of Descartes’s physiology is manifest; Des Chene’s study is a very welcome and original addition to the still-modest philosophical literature engaged with Descartes’sL’Homme and La description du corps humain. The Chinese material focuses on the Warring States, the Han, and the reinvention of the earlier lexicon in contemporary Chinese terms for such concepts as risk, randomness, and (statistical) chance. The Greek study focuses on Homer, Parmenides, the problem of fate and necessity, Platonic daimons, and the "On Fate" topos in Hellenistic Greece. The Office of Research Integrity found in 2011 that Vipul Bhrigu, a postdoctoral researcher who sabotaged a colleague’s research materials, was guilty of misconduct. However, I argue that this judgment is ill-considered and sets a problematic precedent for future cases. I first discuss the current federal definition of research misconduct and representative cases of research misconduct. Then, because this case recalls a debate from the 1990s over what the definition of “research misconduct” ought to be, I briefly recapitulate that history (...) and reconsider the Bhrigu case in light of that history and in comparison to other cases involving tampering. Finally, I consider what the aim of a definition of research misconduct ought to be, and argue that the precedent set by the reasoning in this case is problematic. (shrink)

This article presents the first author's experiences as an Australian doctoral student undertaking a PhD by publication in the arena of the social sciences. She published nine articles in refereed journals and a peer-reviewed book chapter during the course of her PhD. We situate this experience in the context of current discussion about doctoral publication practices, in order to inform both postgraduate students and academics in general. The article discusses recent thinking about PhD by publication and identifies the factors that (...) students should consider prior to adopting this approach, in terms of university requirements, supervisors' attitudes, the research subject matter, intellectual property, capacity and working style, and issues of co-authorship. It then outlines our perceptions of the advantages and disadvantages of undertaking a PhD by publication. We suggest that, in general, the advantages outweigh the disadvantages. We conclude by reflecting on how the first author's experiences relate to current discussions about fostering publications by doctoral students. (shrink)

This paper looks at two figures in the modern, European, eighteenth-century debate on luxury. It claims to better understand the differences between Francis Hutcheson and Bernard Mandeville by exploring how Hutcheson treated the topic of luxury as a distinction between two desires, thus differing from Mandeville's concept of luxury, and a concept of temperance based on moral sense. It explores why Hutcheson believed that luxury was a moral, social and political issue and particularly why he considered Mandeville the embodiment of (...) a threat that went beyond simple considerations of the content of The Fable of the Bees to touch on reflections on the equilibrium of a social and political system. It aims to show how the psychological and the moral dimension were connected to Hutcheson's political theory and how luxury was one of the key points of this connection. (shrink)

Clinical ethics consultation is on the horns of a dilemma. One horn skewers the field for its lack of standards, while the other horn skewers it for proposing arbitrary or deeply contested foundations. I articulate the dilemma by discussing several critiques of the field and the challenge of formulating standards and suggest that the solution lies, at least until a robust consensus emerges, with establishing a list of proscriptive standards to guide the field.

This article reviews how behavioral methods, event-related potentials, and functional magnetic resonance imaging are used to understand the acquisition of perceptual expertise in both adult and developmental populations. The purpose of this study is to provide an overview of the research focused on understanding the role and nature of experience in both the acquisition of perceptual expertise and the development of expert face processing. Behavioral tasks designed to assess perceptual expertise in adults include: perceptual discrimination and matching tasks and the (...) categorization and recognition memory tasks. Training studies are used to mimic the natural acquisition of face and non-face perceptual expertise. Using these various methods and techniques, studies of perceptual expertise prove useful to the understanding of specialization of perceptual skills and categorization abilities and expands our understanding of the function and plasticity of the visual system.
