Socialist courts are supposed to apply the law, not make it, and socialist legality denies judicial decisions any precedential status. In 2011, the Chinese Supreme People’s Court designated selected decisions as Guiding Cases to be referred to by all judges when adjudicating similar disputes. One decade on, the paucity of citations to Guiding Cases has been taken as demonstrating the incongruity of case-based adjudication and the socialist legal tradition. Citations are, however, an imperfect measure of influence. Reproduction of language uniquely (...) traceable to Guiding Cases can also be evidence of their impact on judicial decision-making. We employ a local alignment tool to detect unattributed text reuse of Guiding Cases in local court decisions. Our findings suggest that Guiding Cases are more consequential than commonly assumed, thereby complicating prevailing narratives about the antagonism of socialist legality to case law. (shrink)

The extant literature has largely conceptualized abusive supervision as a hot and impulsive form of aggression. In this paper, we offer a cold and strategic perspective on how abusive supervision might be used strategically to achieve goals. Drawing on the Machiavellian literature and social interaction theory of aggression, we develop a moderated serial mediation model, in which leader Machiavellianism predicts their strategic use of abusive supervision on subordinates via the mediating role of leaders’ guanxi with direct supervisor. We further theorize (...) that this mediation effect is more pronounced when guanxi among team members (team member guanxi, TMG) is stronger, because Mach leaders are more likely to perceive high TMG as a threat to their power. Finally, we propose that Mach leaders’ strategic use of abusive supervision has negative implications for team outcomes, manifested in low levels of team voice and team organizational citizenship behaviors toward fellow team members (OCBI). Analyses of two studies—Study 1 using multi-wave data (355 leaders) from a US sample and Study 2 using a multi-wave, multi-source, and multilevel data (1252 subordinates and 273 leaders) from a Chinese sample—corroborated our model. This study provides a comprehensive examination of who, how, and when strategic abuse unfolds in the workplace and its negative implication for team outcomes. (shrink)

Implicit morality theories refer to people’s beliefs about whether individuals’ moral character is fixed or malleable. Drawing on the social cognitive theory of morality, we examine the relationship between employees’ implicit morality theories and their organizational citizenship behaviors toward coworkers (OCBC) and coworker-directed deviance (CDD) through a moral self-regulatory mechanism. A laboratory experiment (Study 1), an online experiment (Study 2), and a multi-wave, multi-source field survey (Study 3) found that the more employees held a fixed belief about morality, the lower (...) their sense of moral control, especially when their moral identity was lower. This perceived lack of moral control, in turn, predicted decreased OCBC, particularly when the workgroup ethical climate was weak. However, this relationship did not hold for CDD. Overall, our research highlights implicit morality theories as a novel antecedent of employees’ workplace behaviors, and identifies the underlying moral self-regulatory process, along with individual and situational boundary conditions. A test procedure optimization method was proposed in this paper to improve the test efficiency of the industrial robot servo system to be tested on the IRSS integrated testing platform. First, an ordered sequence was used to define the IRSS test project when tested on the IITP. The ordered sequence consisted of execution subelements, which were a combination of control variable parameters of the IITP. Second, the optimization relationships among the IRSS test projects were dug out according to the IRSS (...) test project sequences. Finally, by using the traveling salesmen problem, an optimization model was established based on the optimization relationships of the IRSS test projects, and the optimal test order of the IRSS test projects to be tested on the IITP was obtained by solving the model. A case analysis showed that the proposed method optimized the test procedure on the IITP effectively, and the test time when implementing the test on the IITP according to the optimized order was nearly 50% shorter than before optimization. This study aims to identify the influence of knowledge management practices on the entrepreneurial and organizational performance with the mediating effect of dynamic capabilities and moderating role of opportunity recognition. Data were gathered from 486 entrepreneurs and applied a structural equation model to test the hypotheses. We found that knowledge management practices have a positive and significant influence on dynamic capabilities, as well as have a significant impact on entrepreneurial and organizational performance. Moreover, results indicated that dynamic capabilities partially mediate (...) in the relationship between knowledge management practices on entrepreneurial and organizational performance. Furthermore, the relationship between knowledge management practices with entrepreneurial and organizational performance strengthening by opportunity recognition. Active reciprocity is a process of human harmonious development, which is based on reciprocity. Reciprocity is the result of trichotomy and the expression of golden mean; Active reciprocity is the expression of active golden mean, which discards the passive part of reciprocity. Active reciprocity is a form of rational collectivism which, generally speaking, has two rules for individual communication behavior, namely mutually benefiting and mutually tolerating. It also has three rules for individual behavior, namely benefiting the others without harming oneself, (...) benefiting both oneself and others, benefiting oneself without harming others. It has, through norms, incorporated values and ideas such as fairness, reason, democracy, philanthropism, freedom, harmony, as well as right, responsibility, respect, tolerance, trust, sustainable development. However, it has to be pointed out that active reciprocity should oriented towards altruism, with the minimum requirement of doing no harm to others. Otherwise it will result in moral relativism. The significance of topological indices is linked to their use in QSPR/QSAR modelling as descriptors. Mathematical associations between a particular molecular or biological activity and one or several biochemical and/or molecular structural features are QSPRs and QSARs. Coevolution spreading dynamics on complex networks is a hot topic, which attracts much attention in network science. This paper proposes a mathematical model to describe the two competing complex information spreading dynamics on multiplex networks. An individual can only accept one of the two pieces of information. A heterogeneous mean-field theory is developed to describe the spreading dynamics. We reveal different regions through Monte Carlo simulations of the competing complex information spreading dynamics: no global information, one information dominant, and two (...) information coexistence. We finally find that the heterogeneity of the multiplex networks’ degree distributions does not qualitatively affect the results. (shrink)

Taking support from ego-depletion theory, this study examines ego depletion as a mechanism that explains how employees’ organizational citizenship behavior leads to antagonistic consequences, i.e., service sabotage. Employees’ positive psychological capital is considered a moderator. PROCESS macro was used to test all the hypotheses using time-lagged, dyadic data collected from 420 employees and their 112 their supervisors associated with the service industry in China. This study finds that employees’ exhibition of OCB is positively linked to ego depletion, which in turn (...) drives service sabotage behavior. Furthermore, employees’ PsyCap weakens the effect of OCB on employees’ ego depletion. This study highlights the dark side of OCB, the mechanism through which it causes adverse effects, and the moderating effect of PsyCap. This book contributes to both the internal debate in liberalism and the application of political liberalism to the process of democratization in East Asia. Beyond John Rawls’ original intention to limit the scope of political liberalism to only existing and well-ordered liberal democracies, political liberalism has the potential to inspire and contribute to democratic establishment and maintenance in East Asia. Specifically, the book has two main objectives. First, it will demonstrate that political liberalism offers the most promising vision for liberal (...) democracy, and it can be defended against contemporary perfectionist objections. Second, it will show that perfectionist approaches to political Confucianism suffer from practical and theoretical difficulties. Instead, an alternative model of democracy inspired by political liberalism will be explored in order to achieve a multivariate structure for citizens to come to terms with democracy in their own ways, to support a neutral state that ensures the establishment and stability of democracy, and to maintain an active public role for Confucianism to prevent it from being banished to the private sphere. This paper studies a special scheduling problem under hierarchical management in nurse staff. This is a more complex rostering problem than traditional nurse scheduling. The first is that the rostering requirements of charge nurses and general nurses are different under hierarchical management. The second is that nurses are preferable for relative fair rather than absolute fair under hierarchical management. The model aims at allocating the required workload to meet the operational requirements, weekend rostering preferences, and relative fairness preferences. Two hybrid (...) heuristic algorithms based on multiobjective grey wolf optimizer and three corresponding single heuristic algorithms are employed to solve this problem. The experimental results based on real cases from the Third People’s Hospital, Panzhihua, China, show that MOGWO does not as good as it does on other engineering optimization. However, the hybrid algorithms based on MOGWO are better than corresponding single algorithms on generational distance and spacing of Pareto solutions. Furthermore, for relative fair rostering objective, NSGAII-MOGWO has more power to find the optimal solution in the dimension of relative fairness. (shrink)

There is a high need for cognition on earthquake risk to improve the public’s risk knowledge and risk awareness, so that they can make right decisions and take quick actions regarding mitigation measures and adjustments. In this study, search engine query data from the Baidu Index were extracted to reveal the information search behaviors of the Chinese public regarding the earthquake risk from 2010 to 2012. The data were also analyzed to discuss the characteristics of need for cognition on a (...) nationwide scale and over the long term. The results showed that graphic representations of need for cognition adhere to a “half-peak pattern” before and after earthquake events and dimensions in psychological distance theory, such as temporal distance, spatial distance, and social distance influence the need for cognition on earthquake risk that was the time and spatial discount effect. The implications for theory and practice regarding risk communication and management are discussed and concluded. (shrink)

Aging has become a serious social problem in China. Traditional informal long-term care is hard to sustain because of the reduction in family size and elders’ children migration to big cities. The institution offering services for the disabled elders has been a tendency. There exists a strange phenomenon: some nursing homes are difficult to enter for most disabled elders, while the other ones must search for elders to maintain operation. Therefore, for the evaluation of nursing homes, two problems should be (...) considered: selecting suitable nursing homes for disabled elders; obtaining the key factors influencing the selection of elders and helping nursing homes improve their services based on the key factors. First, we propose a new DEMATEL method for PLTSs to solve the second problem. Then, we present a novel PROMETHEE method to rank the alternatives and make a sensitivity analysis for criteria. Finally, we illustrate our proposed methods to an evaluation problem in Zhenjiang City by a case study. Based on the case study, we can obtain that our proposed methods are effective and practicable. The extraction process of palm seed oil was optimized. Using palm seed as raw material, oil extraction rate was used as an index. The effects of flash extraction, ultrasonic-assisted extraction, supercritical extraction, and aqueous enzymatic extraction on the yield of palm seed oil were investigated. The extraction methods and technological conditions of palm seed oil were optimized by the orthogonal method on the basis of single factor. The seed oil was analyzed and detected. The results showed that the water enzymatic (...) extraction method was the best, and the optimal extraction conditions were as follows: enzymatic hydrolysis time 16 h, enzymatic hydrolysis temperature 50°C, and enzymatic content 2.0%. The oil yield of palm seed was 16.48%. Conclusion. Water enzymatic extraction process of palm seed oil is reasonable, the active ingredients are rich, and the quality of seed oil is better, providing reference for the development and research of palm seed oil. In this paper, based on computer reading and processing of music frequency, amplitude, timbre, image pixel, color filling, and so forth, a method of image style transfer guided by music feature data is implemented in real-time playback, using existing music files and image files, processing and trying to reconstruct the fluent relationship between the two in terms of auditory and visual, generating dynamic, musical sound visualization with real-time changes in the visualization. Although recommendation systems have been well developed in real (...) applications, the limitations of CF algorithms are slowly coming to light as the number of people increases day by day, such as the data sparsity problem caused by the scarcity of rated items, the cold start problem caused by new items and new users. The work is dynamic, with real-time changes in music and sound. Taking portraits as an experimental case, but allowing users to customize the input of both music and image files, this new visualization can provide users with a personalized service of mass customization and generate personalized portraits according to personal preferences. At the same time, we take advantage of the BP neural network’s ability to handle complex nonlinear problems and construct a rating prediction model between the user and item attribute features, referred to as the PSO-BP rating prediction model, by combining the features of global optimization of particle swarm optimization algorithm, and make further improvements based on the traditional collaborative filtering algorithm. The motivation of the study is to explore the nexus tourism-led sustainable human capital development in Brazil, Russia, India, China, and South Africa for the period 1984–2019. The study applied several econometrical techniques for exposing the empirical association between tourism and HCD, such as the conventional and structural break unit root test, the combined cointegration test, long-run and short-run coefficients detected through implementing the Augmented Autoregressive Distributed Lagged, and directional causality by following Toda-Yamamoto with Fourier function. The unit-roots test established (...) variables are integrated in mixed order, wherein variables are stationary at a level or after the first difference. The estimated test statistics from the combined cointegration test and AARDL confirmed the long-run association between tourism, gross capital formation, financial development, and HCD. Tourism revealed a positive and statistically significant tie with HCD in the long run. Moreover, the joint effects of interactive terms TOR*GCF and TOR*FD established a positive and statistically significant relationship with HCD. In addition, the causality test revealed the feedback hypothesis available between tourism and HCD in all sample countries except India. In conclusion, the role of tourism development is critically important for sustainable HCD in BRICS. Therefore, in case of a policymaking concern, it is inevitable to address the tourism issues with care for capitalizing on the benefits for tourism development. (shrink)

Background Nurses often face ethical issues in their daily work that can have an impact on their level of job embeddedness. And positive job embeddedness is essential to reduce burnout among nurses and improve professional retention in the medical industry. However, few studies have focused on the relationship between moral distress, moral resilience, and job embeddedness. Objectives To investigate the relationship between moral distress, moral resilience, and job embeddedness, and explore the mediating role of moral resilience between moral distress and (...) job embeddedness among nurses. Design A quantitative, cross-sectional study. Methods Nurses from a number of tertiary general hospitals in central China were surveyed and assessed using the Moral Distress Scale, the Nurse Moral Resilience Scale, and the nurse job embeddedness Scale from February to March 2023. The study was conducted in line with the 1964 Declaration of Helsinki. Ethical consideration All study procedures were approved by the Ethics Committee of Hunan Normal University (No. 2023-313). Findings Moral distress was positively correlated with moral resilience ( β = 0.525, p < 0.01) and negatively correlated job embeddedness ( β = −0.470, p < 0.01). Moral resilience partially mediated the relationship between moral distress with job embeddedness ( β = −0.087, p < 0.01). Discussion The findings reveal a relationship between moral distress, job embeddedness, and moral resilience among nurses. Conclusion Moral distress and moral resilience are important correlates of job embeddedness in nurses. Interventions to reduce moral distress and increase moral resilience may have potential benefits for improving nurses’ job embeddedness. It is recommended that clinical nursing administrators create a favorable ethical atmosphere, educate nurses about ethics, and increase nurses' moral resilience. (shrink)

Perceived supervisor support is widely studied in terms of its positive outcomes. This paper, in contrast, investigates employees’ unethical pro-supervisor behavior as a negative consequence of perceived supervisor support. Drawing upon the multifoci approach of social exchange theory and the reciprocity principle, we hypothesized that perceived supervisor support can engender unethical pro-supervisor behavior via employees’ feelings of reciprocity towards the supervisor. Building on the instrumental reasons that underlie social exchanges, we further hypothesized that this mediation relationship is stronger for employees (...) high in Machiavellianism. We collected data for three experimental studies from full-time MBA students of a European business school and from U.S. working professionals, and the results provided consistent support for our proposed model. Taken together, the current study highlights the “dark side” of perceived supervisor support, in that it can lead to unethical behavior and that this effect can be accentuated by employees’ Machiavellianism. AbstractThis paper attempts to develop a comparative approach to the dream narratives of the Daoist philosopher Zhuang Zhou and the Austrian poet Hugo von Hofmannsthal. The analogous rhetorical function of the dream in their texts links the two authors from different cultures and traditions. As will be argued, in using dreams to stress a challenging and even deconstructive view of the so-called reality, both Zhuang and Hofmannsthal articulate their skepticism against substantial notions of human subjectivity and offer an imaginary life-world (...) which aims to remind us of the contingency of our being-forms. In so doing, they also shape an aesthetic way to keep oneself open to the perception and experience of the unbiased Dao or Being. Thus, their poetic texts can be read in the context of rethinking the boundary between our life and world. (shrink)

Entrepreneurial intention is an important condition for promoting substantive entrepreneurial behavior, which in turn alleviates employment pressure and promotes sustainable economic and social development. Based on national survey data of university students, descriptive statistical analysis of variables and binary logistic regression analysis were used to empirically analyze the factors influencing university students’ entrepreneurial intentions in five aspects, including innate endowment, acquired characteristics, entrepreneurship courses, and entrepreneurial practice, and social support. The regression results showed that both the factors of innate endowment (...) and acquired characteristics passed the significance test. The entrepreneurship course factor had a significant impact on entrepreneurial intention, with the mean value of the number of entrepreneurship courses hitting 1.80, which is much lower than the other subdivision factors, indicating that there is a greater demand for entrepreneurship courses offered by university students, while the actual situation is less than satisfactory. The entrepreneurial practice factor is also an important factor, with an overall mean of 3 or more, and has a significant impact on entrepreneurial intentions, but in comparison, the factor of having an off-campus practice base for entrepreneurial practice has the lowest mean score, which shows that there is some room for improvement in the construction of off-campus practice bases. The social support factor significantly influences the willingness to start a business, and the mean score for each factor is above the medium level. By understanding which students are more willing to start a business and which factors are more likely to influence their willingness to start a business, we can further consider what kind of entrepreneurial skills and entrepreneurship education can lead to high-quality entrepreneurship and employment.
